R. 10151</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241118">November 18, 2024</action-date><action-desc><sponsor name-id="L000602">Ms. Lee of Pennsylvania</sponsor> (for herself and <cosponsor name-id="M000194">Ms. Mace</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 44, United States Code, to modernize data practices to improve government, and for other purposes.</official-title></form><legis-body id="HB94539CB0F044BBD8576F96AA48E490A" style="OLC"><section id="H55135D357C9047FDBF8620FF471DBE41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Data Practices to Improve Government Act</short-title></quote>.</text></section><section id="H52974763158C41068093761A062C49BB" commented="no"><enum>2.</enum><header>Modernizing data practices to improve government</header><subsection id="H334DD2B357C7460BB1EEB4E28B94C81B"><enum>(a)</enum><header>Definitions</header><text>Section 3502 of title 44, United States Code, is amended—</text><paragraph id="HF8BD191AD9CE4F7897719F49AFF31E86"><enum>(1)</enum><text>in paragraph (22), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="HAE4574F1B3744C468F8B9CA145F4ED73"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (23), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="HB8B54B3DCCAF4D96A59C7CF3BE1CDB27"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H0C3BF4DFED1B42AAA77D3FA30CD30CAC" style="OLC"><paragraph id="H25C52083E5A743B1B153C31A2740AA9F"><enum>(24)</enum><text>the term <term>artificial intelligence</term>—</text><subparagraph id="HDE98642932924D39A01898D80C57240E"><enum>(A)</enum><text>has the meaning given the term <term>artificial intelligence</term> in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>); and</text></subparagraph><subparagraph id="H2D0A7D4600D242B196FDE7EFAD45A784"><enum>(B)</enum><text>includes the artificial systems and techniques described in paragraphs (1) through (5) of section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/4061">10 U.S.C. 4061</external-xref> note prec.); and </text></subparagraph></paragraph><paragraph id="H98EF7F6A5B014554B73D73A0EF4AFFD4"><enum>(25)</enum><text>the term <term>data governance</term> means the policies and procedures of an agency to manage data throughout the lifecycle of such data, including acquisition, collection, analysis, protection, use, dissemination, disposal, or archival, including—</text><subparagraph id="HD7FB52ED34D54895A42026FF0C166567"><enum>(A)</enum><text>any data asset; and</text></subparagraph><subparagraph id="H043F31C4F1AE4C5090526B4F0DCA7C02"><enum>(B)</enum><text>any action taken and any technology or process used by an agency to manage such data or data asset.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA14B822214754156B3A3F35C194F053E"><enum>(b)</enum><header>Chief Data Officer qualifications</header><text display-inline="yes-display-inline">Subsection (b) of section 3520 of title 44, United States Code, is amended by striking <quote>data management, governance (including creation, application, and maintenance of data standards), collection, analysis, protection, use, and dissemination, including with respect to</quote> and inserting <quote>data management and data governance, including with respect to creation, application, and maintenance of data standards and</quote>.</text></subsection><subsection id="H5699E0805B60476D86CA97F135D13431" commented="no"><enum>(c)</enum><header>Revival of law</header><text display-inline="yes-display-inline">In the case of a termination and repeal under subsection (e)(2) of section 3520A of title 44, United States Code, such section 3520A shall be effective as in effect on December 14, 2024, as if such section had not been repealed, and such section shall apply retroactively to any period of repeal.</text></subsection><subsection id="HD0AD6899FE6B41DE9D4C1991E3EDCD69" commented="no"><enum>(d)</enum><header>Chief Data Officer Council</header><text display-inline="yes-display-inline">Section 3520A of title 44, United States Code, is amended—</text><paragraph id="H40EF0E787DF546FEBCC96FEB068EAC9D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" id="H5BB69A3CB3E744A3BAC5418A4BB09CE8" display-inline="no-display-inline"><paragraph id="H30C5D929D44749059BD84A77A8388C7C" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">identify opportunities and procedures to improve data governance to—</text><subparagraph id="HA1368DBD98444EBCB075EF027C71D9BC"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate new technology solutions for improving the collection and use of data;</text></subparagraph><subparagraph id="HDDD6FB105CBF4A1F960BC3562728A2BC" commented="no"><enum>(B)</enum><text>ensure the public data assets are transparent and of sufficient quality for the intended use of the data asset; and</text></subparagraph><subparagraph id="H7143509421574FD6AF996820519A145D" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">support the head of each agency with the efforts by the agency to reliably and securely use emerging technology and artificial intelligence to improve operational efficiency across agencies.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H6147573EE97849DB9BDF9A172E8301A0" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking paragraph (4) and inserting the following:</text><quoted-block style="USC" id="H49866C2BCD4B4580AD5631C3A839B07F" display-inline="no-display-inline"><paragraph id="H6B53492292CF44D8A8B89E7E7DFCFDDA" commented="no"><enum>(4)</enum><header>Ex Officio Members</header><text display-inline="yes-display-inline">The Director shall select a representative to serve as an ex-officio member of the Council for each of the following:</text><subparagraph id="HAC93CDD69918472CAE0EF23D78559B27" commented="no"><enum>(A)</enum><text>Agency Chief Information Officers.</text></subparagraph><subparagraph id="HF6DB65D2950E446D8DACD30E5D6EEDD0" commented="no"><enum>(B)</enum><text>Agency Evaluation Officers.</text></subparagraph><subparagraph id="HA4FD02F810D742CB9C9D76B5077A9DC1" commented="no"><enum>(C)</enum><text>Senior agency officials for privacy.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDCB889FA739B4AA192D805EDBB0A9926"><enum>(3)</enum><text>by striking subsections (d) and (e) and inserting the following:</text><quoted-block style="OLC" id="H95FB9814554D40AEAE6C7BC34999B6AE" display-inline="no-display-inline"><subsection id="H27852BF1AB7B4F298BB62D639F34EB44" commented="no"><enum>(d)</enum><header>Reports</header><text>The Council shall submit to the Director, the Committee on Homeland Security and Governmental Affairs of the Senate, and the Committee on Oversight and Accountability of the House of Representatives the following:</text><paragraph id="HBE95F6B21C15439088844A9D6C597B7B"><enum>(1)</enum><text>Not later than 2 years after the date of the enactment of this subsection, and every two years thereafter, a report on the work of the Council that includes—</text><subparagraph id="HDA425AE0597E4AC39412A2B329205AB5" commented="no"><enum>(A)</enum><text>a description of any work of the Council to ensure progress on each purpose and function of the Council described under subsection (b); and</text></subparagraph><subparagraph id="H3C1781B250B34F15866AC08B8C79108D"><enum>(B)</enum><text display-inline="yes-display-inline">any update to the recommendations provided in the report required under paragraph (2).</text></subparagraph></paragraph><paragraph id="HEF2FBE76EA754608A27FCEB626F001E4"><enum>(2)</enum><text>Not later than 1 year after the date of the enactment of this subsection, a report that includes the following:</text><subparagraph id="H618B1E9538AF4F46AC879FB100353012"><enum>(A)</enum><text>Recommendations and best practices for agencies on developing data assets, data governance policies, and infrastructure to enable adoption, maintenance, use, and interoperability of emerging technology and artificial intelligence, such as for use in training, testing, and operation of artificial intelligence within agencies, that includes the following:</text><clause id="HF29EC01C5D09463EA839E31B1A4B89A1"><enum>(i)</enum><text>An assessment of ways to strengthen and clarify the roles and responsibilities of senior agency officials with respect to data governance.</text></clause><clause id="H76D0C05495E34FDDAA563DEA704B896D"><enum>(ii)</enum><text>An identification of data available to 1 or more agencies at the time of the submission of the report that would benefit other agencies if the data were shared or made accessible to such other agencies.</text></clause><clause id="H76DB941F31FD4DD69ACB478860CB2357"><enum>(iii)</enum><text>Criteria agencies should consider when using data to train any artificial intelligence used by agencies, including recommendations for—</text><subclause id="HC8265162A64D4F5A87C620B246CE8B66"><enum>(I)</enum><text>ways to make such data more transparent to the public and the employees of the agency using the trained artificial intelligence; and</text></subclause><subclause id="HFDC01B220FCE4CF48A84898814872946"><enum>(II)</enum><text>processes and procedures to analyze and test such data for potential risks.</text></subclause></clause><clause id="HF2C80ECBBF724004A104A476A33391D1"><enum>(iv)</enum><text>Recommendations for defining, generating, using, and ensuring the privacy and security of synthetic data in the Federal Government.</text></clause></subparagraph><subparagraph id="H1D33AC0B8F3E48BE8622B21E9C5E0C76"><enum>(B)</enum><text>An indication of how agencies can incorporate such recommendations and best practices into agency processes and statutory requirements.</text></subparagraph></paragraph></subsection><subsection id="H8FEC3A965E51456DB807EEB49EA3C459"><enum>(e)</enum><header>Director responsibilities</header><paragraph id="H3BA302B56BC8445A9302A76D027E2591"><enum>(1)</enum><header>Data governance guidance</header><text>The Director, upon receipt of a report required under subsection (d), may issue or amend, as necessary, guidance to agencies with respect to the implementation of any recommendation included in the report in accordance with this chapter.</text></paragraph><paragraph id="HC77A78B85AB54A6580FDA82780A93635"><enum>(2)</enum><header>Chief data officer inventory</header><text>Not later than 270 days after the date of the enactment of this subsection, the Director, in consultation with the Council, shall make available on a public website, and update not less frequently than annually, an inventory of Chief Data Officers, including, with respect to each agency—</text><subparagraph id="H931C45EAF8E14913B38A4AAE70FB67CA"><enum>(A)</enum><text>a list of each Chief Data Officer, including, with respect to each Chief Data Officer—</text><clause id="H8A5315BBD271436F8771FFACCCFB6DD6"><enum>(i)</enum><text>any additional role or title the Chief Data Officer holds at the agency; and</text></clause><clause id="HF9ACC0DE9ED747B18D68DC84284591F8"><enum>(ii)</enum><text>each responsibility and statutory authority of the Chief Data Officer relating to data and artificial intelligence that are not described in section 3520(c); and</text></clause></subparagraph><subparagraph id="HFA49D8E77D804BF289960C3970638517"><enum>(B)</enum><text>an identification of resources needed by Chief Data Officers, including to support the adoption of artificial intelligence at agencies.</text></subparagraph></paragraph></subsection><subsection id="H5D608E280689460DB2379E2FEBA90E8D"><enum>(f)</enum><header>Evaluation</header><text>Not later than 2 years after the date of the enactment of this subsection, and not less frequently than every 2 years thereafter, the Comptroller General shall submit to Congress a report on—</text><paragraph id="HE0AF495B4F094B1387FEC8880F216391"><enum>(1)</enum><text>whether the duties of the Council improved the use of evidence, data, and program evaluation in the Federal Government; and</text></paragraph><paragraph id="H7D271F9418A948749BA2F8BC14F0A24B"><enum>(2)</enum><text>any barrier or challenge preventing the Council from accomplishing the requirements under this section.</text></paragraph></subsection><subsection id="HAC688564CECB40C784DD7E1AABF4E7CF" commented="no"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require an agency to implement any recommendation developed pursuant to subsection (d).</text></subsection><subsection id="HC1F547AE0A1E4C8D99315B3AA5314B0D" commented="no"><enum>(h)</enum><header>Sunset</header><text>This section shall have no force or effect on and after December 14, 2031.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HFAFB3A88EEB642398BEFB8AB3D594B79"><enum>3.</enum><header>No additional funds</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</text></section></legis-body></bill>
