table of contents</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Compensation Optimization and Modernization for Physicians to Ensure Treatment Excellence and Service Act</short-title></quote> or the <quote><short-title>VA COMPETES Act</short-title></quote>.</text></section><section id="H74E810CF361448EF894F69E7BD3D4096"><enum>2.</enum><header>Modification of pay limitation for physicians, podiatrists, optometrists, and dentists of Department of Veterans Affairs</header><subsection id="H4368F2C1CE2846CCACEC1B954EBCA64E"><enum>(a)</enum><header>Market pay</header><paragraph id="H1D84F6C414844CF78FD6C8E2F4B9D4AB"><enum>(1)</enum><header>In general</header><text>Section 7431 of title 38, United States Code, is amended—</text><subparagraph id="H46CFFAC0B50948E1947C5B9ECC70CC6C"><enum>(A)</enum><text>by striking subsections (a), (b), and (d);</text></subparagraph><subparagraph id="H8579BADF08044D5890C9F0AEE4402C24"><enum>(B)</enum><text>by redesignating subsections (c), (e), (f), (g), and (h) as subsections (a), (b), (c), (d), and (e), respectively;</text></subparagraph><subparagraph id="H4D2127B6ECA04822B7E8C170FC012D80"><enum>(C)</enum><text>by inserting <quote>optometrists,</quote> after <quote>podiatrists,</quote> each place it appears;</text></subparagraph><subparagraph id="HDDF5A5B8882A4447898B08106F9AB9F5"><enum>(D)</enum><text>by inserting <quote>optometrist,</quote> after <quote>podiatrist,</quote> each place it appears;</text></subparagraph><subparagraph id="HD903B4AAD9AD40B0AD78F4E71E36D8F6"><enum>(E)</enum><text>in subsection (a), as so redesignated—</text><clause id="HA0C6D8F89E8548B7825F8C9842A1E6A5"><enum>(i)</enum><text>by striking the matter preceding paragraph (1) and inserting <quote>Pay of physicians, podiatrists, optometrists, and dentists in the Veterans Health Administration shall consist of market pay, which shall meet the following requirements:</quote>;</text></clause><clause id="HAD3B7E92F2E6448BB490CB00E645AA71"><enum>(ii)</enum><text>in paragraph (4)—</text><subclause id="HFEA344D6EEA4477F89B46BCF23DC0AD5"><enum>(I)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subclause><subclause id="H47628D15E513483EBA2E4CB923AF7C6B"><enum>(II)</enum><text>by redesignating subparagraph (F) as subparagraph (I); and</text></subclause><subclause id="H2E4B388E9F014FC796EA884157806AA1"><enum>(III)</enum><text>by inserting after subparagraph (E) the following new subparagraphs:</text><quoted-block style="OLC" id="H3EA1B3308C694D2A8610127A561F15D8" display-inline="no-display-inline"><subparagraph id="HE30E8F37A9D04DDCABF8DB14AD5C219B"><enum>(F)</enum><text display-inline="yes-display-inline">the performance of the physician, podiatrist, optometrist, or dentist based on specific criteria prescribed by the Secretary, including the parameters to determine the relevant timeframe of performance;</text></subparagraph><subparagraph id="H4D3198067DFC49FA91E53752A204C21D"><enum>(G)</enum><text display-inline="yes-display-inline">the annual pay adjustments under section 5303 of title 5;</text></subparagraph><subparagraph id="H07F843094DE546E6B37EA5521725C1AF"><enum>(H)</enum><text display-inline="yes-display-inline">the nonforeign cost of living adjustment allowance authorized under section 5941 of title 5; and </text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause></clause><clause id="HECBF8371BD454C54A1D0FBDD1AD7EE87"><enum>(iii)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the following new sentence: <quote>Such a notice shall include a statement of whether the market pay will increase, decrease, or remain unchanged following such evaluation.</quote>; and</text></clause><clause id="H30FB0C74A67F462D9328D679E6CA29EF"><enum>(iv)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs: </text><quoted-block style="OLC" id="H9CFA3253F8FC4A44AD2DF2738ADF4E1E" display-inline="no-display-inline"><paragraph id="HCADCD70DC15F4E46838701985E09D7E9"><enum>(7)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that each physician, podiatrist, optometrist, and dentist in the Veterans Health Administration is— </text><subparagraph id="H85132D98BDA7465ABAEC84B5F425E831"><enum>(A)</enum><text>advised, on an annual basis, of the criteria referred to in paragraph (4)(F);</text></subparagraph><subparagraph id="H3CA035B233554D9BB600E0BCBE48CB09"><enum>(B)</enum><text>evaluated in accordance with such criteria; and</text></subparagraph><subparagraph id="H1889969A678B418196101CCB13AF867B"><enum>(C)</enum><text>compensated in accordance with—</text><clause id="HC587B70083B746A989652D872CA6B82A"><enum>(i)</enum><text>applicable assignment and pay levels, subject to relevant pay limitations; and</text></clause><clause id="HC395E1C33F714ED585BDD1717A3739C5"><enum>(ii)</enum><text>the extent to which such criteria are met.</text></clause></subparagraph></paragraph><paragraph id="H77179142C691434F86BA91F574E21B23"><enum>(8)</enum><text>Not later than 120 days after the last day of each fiscal year, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report covering that fiscal year that includes the following:</text><subparagraph id="H384975C9A2DD418EA32D5424BBF0DD5F"><enum>(A)</enum><text>A list of each medical specialty clinic that conducted an evaluation of market pay during the fiscal year covered by the report.</text></subparagraph><subparagraph id="HA46DEAF95FD8411FA379934C5DC1DC63"><enum>(B)</enum><text>For each evaluation described in subparagraph (A)—</text><clause id="H02616FFC242F40B6B28A97BACD757A52"><enum>(i)</enum><text>a list of occupations for which pay was evaluated, disaggregated by medical specialty, number of authorized full-time employees, and onsite full-time employees as of the date of the evaluation;</text></clause><clause id="H8C446609092940918BA75D0036BFAACA"><enum>(ii)</enum><text>the date such evaluation was completed;</text></clause><clause id="HAD9354E024D643FEB4FB3246F1E193E7"><enum>(iii)</enum><text>whether a market pay adjustment was made following the evaluation per each occupation and specialty evaluated;</text></clause><clause id="H89206269B04F4DC583C98CF523927B64"><enum>(iv)</enum><text>whether applicable employees were notified of such evaluation;</text></clause><clause id="HFF8B233C68494D5F9EEA0F552469DD3A"><enum>(v)</enum><text>whether local labor partners were notified of such evaluation; and</text></clause><clause id="HD7654A69C0E445F4B99E96E8B9902BE3"><enum>(vi)</enum><text>in the case of an evaluation that resulted in an adjustment of pay—</text><subclause id="HC28AB2CB5FFE4431B9CEAFC3C65225E2"><enum>(I)</enum><text>the date such adjustment—</text><item id="H31B3A2567F0E40D8AA5158DE3587497C"><enum>(aa)</enum><text>was implemented; and</text></item><item id="H881E91453C0B4F04B54F3A2F2ED8CE59"><enum>(bb)</enum><text>became effective; and</text></item></subclause><subclause id="H0362580AE5024E8694AF9FDCABE421D8"><enum>(II)</enum><text>the percentage of employees of each occupation and specialty for which pay was adjusted pursuant to such evaluation.</text></subclause></clause></subparagraph><subparagraph id="H2283D8836D3649F98B2792D530429442"><enum>(C)</enum><text>A list of facilities of the Department that did not conduct an evaluation of market pay, pursuant to paragraph (5), during the fiscal year covered by the report.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H55B17DE7D9EB4EA8A87C979719BE2130"><enum>(F)</enum><text>in subsection (b), as so redesignated—</text><clause id="HA6DB77F10A7D476A8C1F08705FC9C1B0"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text style="USC" level="subsection">total</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="subsection">market</header-in-text></quote>;</text></clause><clause id="HA618DFBFF7F54254A673734463E11D61"><enum>(ii)</enum><text>in paragraph (1)(A)—</text><subclause id="H6CFFE6A9ED094D03A1161F4313B1CBEB"><enum>(I)</enum><text>by striking <quote>annual</quote> each place it appears and inserting <quote>market</quote>; and</text></subclause><subclause id="H1BDABCBB300A49A89D9EE60865335FFB"><enum>(II)</enum><text>by inserting <quote>, optometrists,</quote> after <quote>podiatrists</quote>;</text></subclause></clause><clause id="HACBCCA13816B427F9D5F261BE1820F9D"><enum>(iii)</enum><text>by striking paragraphs (2) and (3);</text></clause><clause id="HD5AC39ED97D44FDA8AACE04DFC29C16A"><enum>(iv)</enum><text>by redesignating paragraph (4) as paragraph (2);</text></clause><clause id="HA717A30550654D5090C80F508CA9770A"><enum>(v)</enum><text>in paragraph (2), as so redesignated—</text><subclause id="HF7CB0052D19A4FD7A889C7CE83C953BA"><enum>(I)</enum><text>by striking <quote>Except as provided in sections 7404A(c) and 7410(a)(2) of this title, in no case may the total amount of compensation</quote> and inserting <quote>The total amount of market pay under subsection (a)</quote>; and</text></subclause><subclause id="HEDD8DC911779485AB8DAF10BDA04C99E"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>not</quote> before <quote>exceed</quote>; and</text></subclause></clause><clause id="H4EF6BF1EB20644C0AF3E4D4C2439B6CB"><enum>(vi)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA4170D38BFA44916A24608E7858424A6"><paragraph id="HBB9D12237C944B029113BF7DFCD73AE0" indent="up1"><enum>(3)</enum><text>Notwithstanding any compensation or pay limitations under this title or title 5, the Secretary may authorize the Under Secretary for Health to pay physicians, podiatrists, optometrists, and dentists—</text><subparagraph id="HB50D58875E204DD79FB2ED6052800042"><enum>(A)</enum><text>awards authorized under this title;</text></subparagraph><subparagraph id="H26CFB388B0AA4F3A8F2ADA1BA08E4AA9"><enum>(B)</enum><text>advance payments, recruitment or relocation bonuses, and retention allowances authorized under section 7410(a) of this title or as otherwise provided by law;</text></subparagraph><subparagraph id="HD7A321872AFE45E689D586D2C013E694"><enum>(C)</enum><text>incentives or bonuses under section 706 of this title or as otherwise provided by law; and</text></subparagraph><subparagraph id="HDA8F605840094EB5A3832651238C80DB"><enum>(D)</enum><text>earnings from fee-basis appointments under section 7405(a)(2) of this title.</text></subparagraph></paragraph><paragraph id="H55FF890DE53142C689C1606511B966A8" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE6EE5A1CC7DE470DA350DDA074BDA183"><enum>(A)</enum><text>The Secretary may waive any pay limitation described in this section (including tier limitations) as the Secretary determines necessary for the recruitment or retention of critical health care personnel that the Secretary determines would provide direct patient care.</text></subparagraph><subparagraph id="H51A03B900BCE4E3B86C63E2BAAE2BC68" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Priority for such waivers shall be given for positions, locations, and care provided through contracts at a high cost to the Department.</text></subparagraph><subparagraph id="HFBD1476DCC034A71B7A9EA7AE0B33BA6" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">During the period the authority under subparagraph (A) is effective, the Secretary may not issue more than 300 waivers under such subparagraph. </text></subparagraph><subparagraph indent="up1" id="H6922E674F644411EBC527A14573023CB"><enum>(D)</enum><text>The Secretary may prescribe requirements, limitations, and other considerations for waivers under such subparagraph.</text></subparagraph><subparagraph id="H618970E797B941689956DBC2F770C7F3" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the VA COMPETES Act, and annually thereafter, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report that includes— </text><clause id="H96B192E3132B46D1980729872223F380"><enum>(i)</enum><text>any updates to the requirements, limitations, and considerations prescribed under subparagraph (B) during the period covered by the report;</text></clause><clause id="HAFF4D04B82D54160BC922BAE0F562600"><enum>(ii)</enum><text>a description of the findings of each review, if any, conducted pursuant to subparagraph (G);</text></clause><clause id="HE4C4BDAB8D004DA498F01373B4D72FDF"><enum>(iii)</enum><text>a description of each waiver under subparagraph (A) in effect as of the date of the submission of the report, including the—</text><subclause id="H31D00579CA704E338AB40AF76CF9A738"><enum>(I)</enum><text>duty location, position, specialty, market, and performance considerations for the waiver; and</text></subclause><subclause id="H8DD25603A0164657B43EC83FCBC41296"><enum>(II)</enum><text>impact, if any, of the waiver on contracted care purchased by the Department for the region; and</text></subclause></clause><clause id="HC1151F80636A4C518C75E2433A37E92F"><enum>(iv)</enum><text>a list of any separation actions during the period covered by the report with respect to a position for which a waiver under subparagraph (A) is in effect.</text></clause></subparagraph><subparagraph id="H35E8E3781B19406DA54C1A531102439A" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">The authority of the Secretary under subparagraph (A) shall terminate on the date that is five years after the date of enactment of the VA COMPETES Act.</text></subparagraph><subparagraph id="H1FC15A29A6544D9FB8429B856E488BD2" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">The Chief Human Capital Officer of the Department, the Chief Financial Officer of the Department, and the Office of the General Counsel of the Department shall review any waiver issued pursuant to subparagraph (A).; </text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H33A0FB933981409DAB709F5C5399EF48"><enum>(G)</enum><text>in subsection (c), as so redesignated, by striking <quote>subsections (a) and (b) of and</quote>;</text></subparagraph><subparagraph id="HEAD1D059E4E842B69FAFE3D1AFF0F129"><enum>(H)</enum><text>in subsection (d), as so redesignated—</text><clause id="H626E9961559046AE99CCD16CFF6B2C63"><enum>(i)</enum><text>in paragraph (1), by striking <quote>subsection (c)</quote> and inserting <quote>subsection (a)</quote>; and</text></clause><clause id="HC8F068A027854A50AD3C409F91F1F1C8"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H434A87B21F4E4200BFF2539DB664F546"><paragraph id="HC2EAD51836DB4255A035A1B50BCDBF88" indent="up1"><enum>(3)</enum><text>An individual receiving market pay under subsection (a) may not receive an adjustment or a nonforeign cost of living allowance under sections 5303 or 5941 of title 5.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H771E8E6F693D4F769A9E9544D40E0570"><enum>(I)</enum><text>in subsection (e), as so redesignated, by striking <quote>subsection (c), (d), or (e) except for the responsibilities of the Secretary under subsection (e)(1)</quote> and inserting <quote>subsection (a) or (b) except for the responsibilities of the Secretary under subsection (b)(1)</quote>.</text></subparagraph></paragraph><paragraph id="HC33B30327FBF481C908C85A2A21A5C4A"><enum>(2)</enum><header>Report on waiver authority</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report that includes a description of the requirements, limitations, and other considerations prescribed under section 7431(b)(4)(B) of title 38, United States Code, as added by paragraph (1). </text></paragraph><paragraph id="HDF7C33D397CB423BBD49A83B3131692C"><enum>(3)</enum><header>Conforming amendments</header><subparagraph id="H3B665E3DB9CF4C28BC844FB8CE8F7A85"><enum>(A)</enum><header>Incentives for recruitment</header><text>Section 706(d)(6) of title 38, United States Code, is amended by striking <quote>total amount of compensation under section 7431(e)(4)</quote> and inserting <quote>total amount of market pay under section 7431</quote>.</text></subparagraph><subparagraph id="H169503A63C2046B8AC2E5627791C3460"><enum>(B)</enum><header>Awards</header><text>Section 7404A(c) of such title is amended by striking <quote>the limitation under section 7431(e)(4)</quote> and inserting <quote>a limitation under section 7431</quote>.</text></subparagraph><subparagraph id="H3063AC439D13408B8D672CFFA706E5F7" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Additional pay authorities</header><text>Section 7410(a)(2) of such title is amended by striking <quote>the limitation under section 7431(e)(4)</quote> and inserting <quote>a limitation under section 7431</quote>. </text></subparagraph><subparagraph id="HB8582A128DF74CC38CB38B66F49D83C7"><enum>(D)</enum><header>Pay of Under Secretary for Health</header><text>Section 7432(b)(1) of such title is amended—</text><clause id="HE10C5DCD34A549319034F0B5121EE4EC"><enum>(i)</enum><text>by inserting <quote>, podiatrist, optometrist,</quote> after <quote>physician</quote>;</text></clause><clause id="HD7E44BE53C784CD180FFB5DD9E089E80"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>the market pay element of pay of physicians and dentists</quote> and inserting <quote>market pay</quote>; and </text></clause><clause id="H016BFCC15F9B4EECAF19B0DECD599456"><enum>(iii)</enum><text>by striking <quote>7431(c)</quote> and inserting <quote>7431</quote>.</text></clause></subparagraph><subparagraph id="H04E933A2D7D047BD8856FD1F63E63B39" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header>Administrative matters</header><text>Section 7433 of such title is amended by inserting <quote>optometrists,</quote> after <quote>physicians,</quote> each place it appears.</text></subparagraph><subparagraph id="HDC2A4126729B4C2FB7371F1981BEDEEC"><enum>(F)</enum><header>Competitive pay</header><text>Section 7451(a)(2)(C) of such title is amended by inserting <quote>optometrist,</quote> after <quote>physician,</quote>. </text></subparagraph><subparagraph id="HEBDFB218330944089C7A0FC50699CB26"><enum>(G)</enum><header>Compensation and professional standards for certain medical officers</header><text>Section 27(b) of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3528">50 U.S.C. 3528(b)</external-xref>) is amended by striking <quote>section 7431(e)(1)(C)</quote> and inserting <quote>section 7431(b)(1)(C)</quote>. </text></subparagraph></paragraph><paragraph id="H3554B257C0624D4A96DE49E1E1506614" commented="no"><enum>(4)</enum><header>Clerical amendments</header><subparagraph id="H30DBBF89BFDA42FE9CE09BDE54E29B3A" commented="no"><enum>(A)</enum><header>Section heading</header><clause id="H88233EFB9B4D4E6199722D10CEEB8A63" commented="no"><enum>(i)</enum><header>In general</header><text>The heading for section 7431 of title 38, United States Code is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1D0FC314FCCB41C0818DA568D6F002B0"><section id="H7179551C86934207953872A6C753E476" commented="no"><enum>7431.</enum><header>Market pay</header></section><after-quoted-block>.</after-quoted-block></quoted-block></clause><clause id="H67B63934DC9145E08C019BDA0E459D6F" commented="no"><enum>(ii)</enum><header>Table of sections</header><text>The table of sections at the beginning of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/74">chapter 74</external-xref> of title 38, United States Code, is amended by striking the item relating to section 7431 and inserting the following new item:</text><quoted-block style="USC" id="HE43AC329975D44B5860F1BE1F30008F9"><toc><toc-entry level="section" idref="H7179551C86934207953872A6C753E476">7431. and</text></paragraph><paragraph id="H63011809CB3C4CD2877009C646EEFB0D" commented="no"><enum>(2)</enum><text>in the list in subsection (b)—</text><subparagraph id="H2117F612C46B45D48A76BEAC9007C573" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in the first heading of the list following the colon, by striking <quote>PODIATRIST (DPM), AND DENTIST</quote> and inserting <quote>PODIATRIST (DPM), OPTOMETRIST (OD), AND DENTIST</quote>; and </text></subparagraph><subparagraph id="H1A52DF24609C4086A9F1F90B95974ADF" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in the third heading of the list following the colon, by striking <quote>CLINICAL CHIROPRACTOR AND OPTOMETRIST SCHEDULE</quote> and inserting <quote>CLINICAL CHIROPRACTOR SCHEDULE</quote>.</text></subparagraph></paragraph></subsection><subsection id="HC96FBDECC00A41D4B41A4601164F37EF" commented="no"><enum>(c)</enum><header>Retroactive authority for compensation</header><paragraph commented="no" id="H8EA93CCF64344781B12957FAE44BA7ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may pay retroactive compensation to a covered employee in an amount that equals the amount of compensation that was authorized to be paid to such covered employee during the period specified in paragraph (2), but was deferred and paid to such employee in the calendar year following the calendar year in which such compensation was authorized because the payment of such compensation would have exceeded an applicable cap on annual compensation. </text></paragraph><paragraph commented="no" id="HEF577BCD08584835B86C378D19F19982"><enum>(2)</enum><header>Period specified</header><text>The period specified in this paragraph is the period beginning on January 8, 2006, and ending on December 31, 2017.</text></paragraph><paragraph commented="no" id="HF41A960895E14C5985781853D83FCC59"><enum>(3)</enum><header>Exclusion</header><text>Compensation authorized under this subsection shall not be included in the calculation of any aggregate limit on compensation for a covered employee for the year in which it is paid.</text></paragraph><paragraph id="H324A454F1E24481FB9865FC21F776762" commented="no"><enum>(4)</enum><header>Charging of compensation</header><text>Compensation authorized under this subsection shall be charged to the appropriate medical care appropriation account of the Department of Veterans Affairs for the fiscal year in which the work was performed except as follows:</text><subparagraph id="HDA9A91D8934D402484A721DC723A4EB2" commented="no"><enum>(A)</enum><text>In the case of an account that has closed pursuant to section 1552 of title 31, United States Code, the compensation shall be charged to a current appropriation account in accordance with section 1553 of such title.</text></subparagraph><subparagraph id="H8ADEA3FFE9EE4AFEB18FD3F2D1AA0719" commented="no"><enum>(B)</enum><text>In the case of an expired account that has not closed, if charging the compensation to the expired account would cause such account to have a negative unliquidated or unexpended balance, the compensation may be charged to a current appropriation account available for the same purpose.</text></subparagraph></paragraph><paragraph commented="no" id="HE8A31EE9AB2144DBB0106E9255468D97"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" id="HDC970E561105438EA5BA4BADE3135CF5"><enum>(A)</enum><text>The term <term>compensation</term> means any pay, including salary, awards, and incentives.</text></subparagraph><subparagraph id="H6AF8EBC4404E40988DCD35C66FB28581" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>The term <term>covered employee</term> means a physician, podiatrist, or dentist subject to market pay under section 7431 of title 38, United States Code.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
