which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act and the Small Business Investment Act of 1958 to provide resources, counseling, and access to capital for child care providers, and for other purposes.</official-title></form><legis-body id="H5142C06E49F245B096A6190E0470F03F" style="OLC"><section id="H99A5FA9E47B54CB3A0B06B983860B3E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Care for Small Businesses Act</short-title></quote>.</text></section><section id="H29507F34F4EF4C84BF3BBC47F897A685"><enum>2.</enum><header>Small business loans for covered nonprofit child care providers</header><subsection id="H0991FFAA47D2443BA5C8F1CE3588F748"><enum>(a)</enum><header>In general</header><text>Section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H29510DBBA529495786C874A341935577" style="OLC"><subsection id="H316EE322D44F4B1C9B193CE95EE761D8"><enum>(gg)</enum><header>Covered nonprofit child care provider</header><text>In this Act, the term <term>covered nonprofit child care provider</term> means an organization—</text><paragraph id="HDDDD69B0EF0D4CBD829D078C514AE452"><enum>(1)</enum><text>that—</text><subparagraph id="H59E6DC46B44C461F9C87690E64B8A9B8"><enum>(A)</enum><text>is in compliance with licensing requirements for child care providers of the State in which the organization is located;</text></subparagraph><subparagraph id="HD296062288F0477CBBC14043908E4DC5"><enum>(B)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code;</text></subparagraph><subparagraph id="H2147D5CEDE154BB99D1AE19214CCA0D3"><enum>(C)</enum><text>is primarily engaged in providing child care for children from birth to compulsory school age; and</text></subparagraph><subparagraph id="H8AFA177A3799435D8AF38E0BAEE69EFC"><enum>(D)</enum><text display-inline="yes-display-inline">is in compliance with applicable industry-based size standard established under subsection (a);</text></subparagraph></paragraph><paragraph id="H9F6EE1D5088C45E7B02A80A75924E5C6"><enum>(2)</enum><text>for which each employee and regular volunteer complies with the criminal background check requirements under section 658H(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858f">42 U.S.C. 9858f(b)</external-xref>);</text></paragraph><paragraph id="H61F07DCECA5F44CE827D5DE701C759F5" commented="no"><enum>(3)</enum><text>that may—</text><subparagraph id="HCCE3D517C2874D98A35B984D85463A60" commented="no"><enum>(A)</enum><text>provide care for school-age children outside of school hours or outside of the school year; or</text></subparagraph><subparagraph id="H7C0B7709ABD84994AF89819438E19E16" commented="no"><enum>(B)</enum><text>offer preschool or prekindergarten educational programs; and</text></subparagraph></paragraph><paragraph id="H08D92DAE04A948E6B3ACCBEC90A815C1"><enum>(4)</enum><text>subject to any exemption under Federal law applicable to the organization, that certifies to the Administrator that the organization will not discriminate in any business practice, including providing services to the public, on the basis of race, color, religion, sex, sexual orientation, marital status, age, disability, or national origin.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3DD864203B08494B949607DCF9645C10"><enum>(b)</enum><header>Eligibility of nonprofit child care providers for 7<enum-in-header>(a)</enum-in-header> loans</header><text>Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HF38F5E2A443740FA8E2F2FF3B8A69793" display-inline="no-display-inline"><paragraph id="H86DD088F2E59400285755A94565EC7BF"><enum>(38)</enum><header>Covered nonprofit child care providers</header><subparagraph id="H358A1892348747588955D50C9F814EB8"><enum>(A)</enum><header>In general</header><text>The Administrator may guarantee loans made to a covered nonprofit child care provider under the same terms, conditions, and processes as a loan made under this subsection.</text></subparagraph><subparagraph id="H73676C6D195D4416871FC50F5C9C6870"><enum>(B)</enum><header>Loan guarantee</header><text>A covered nonprofit child care provider that receives a loan under this subsection—</text><clause id="HC7D80993BB9D442199870FAC30D8052F"><enum>(i)</enum><text>with respect to a loan greater than $500,000, shall obtain a guarantee of timely payment of the loan from another person; and</text></clause><clause id="H148248D8399F4FF685D6877196B423F4"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to a loan less than or equal to $500,000, may not be required to obtain a guarantee of timely payment of the loan.</text></clause></subparagraph><subparagraph id="HC8C4956DCD984ABFB1E2106C43839576" display-inline="no-display-inline"><enum>(C)</enum><header>Limitation on basis for ineligibility</header><text>The Administrator may not determine that a covered nonprofit child care provider is not eligible for a loan under this section on the basis that the proceeds of such loan will be used for a religious activity protected under the First Amendment to the Constitution of the United States (as determined by a court of competent jurisdiction).</text></subparagraph><subparagraph id="H8206EB92FBB24ADFB2742E4A326DC68F"><enum>(D)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Administrator shall submit to Congress a report that contains—</text><clause id="H6E926A4A850C45F9A5839E740B05525A"><enum>(i)</enum><text>for the year covered by the report, the number and dollar value of loans made under this paragraph; and</text></clause><clause id="H50534BFAE1B34EEDAA1C4DE0A421F18D"><enum>(ii)</enum><text>any other information determined relevant by the Administrator.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H87BE2B32E62E474985CDDDAD8BE9FA73" commented="no"><enum>(c)</enum><header>Eligibility of nonprofit child care providers for 504 financing</header><text display-inline="yes-display-inline">Title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H608F3651123F4CEC9DE53A22B8579F83" display-inline="no-display-inline"><section id="H9888DBD32A4C4229812F48EA7A2714DD" commented="no"><enum>511.</enum><header>Assistance for covered nonprofit child care providers</header><subsection id="H14086CCDFDAD46F293552180E1B01A77" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may provide financing under this title to a covered nonprofit child care provider (as defined in section 3(gg) of the Small Business Act).</text></subsection><subsection id="HD003CA94A8994E80B6E953F32243B3C6" commented="no"><enum>(b)</enum><header>Guarantee</header><text display-inline="yes-display-inline">A covered nonprofit child care provider that receives financing under this title—</text><paragraph id="HB33828ADD8FD42CC9DD4A0A8372A45A6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to financing in an aggregate amount greater than $500,000, shall obtain a guarantee of timely payment of the loan from another person; and</text></paragraph><paragraph id="H8CD725CC3F9A44599B18E5347EDD1A8B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to financing in an aggregate amount less than or equal to $500,000, may not be required to obtain a guarantee of timely payment of the loan.</text></paragraph></subsection><subsection id="H3762EAA0254444F3A187421E99972519" display-inline="no-display-inline" commented="no"><enum>(c)</enum><header>Limitation on basis for ineligibility</header><text>The Administrator may not determine that a covered nonprofit child care provider is not eligible for a loan under this section on the basis that the proceeds of such loan will be used for a religious activity protected under the First Amendment to the Constitution of the United States (as determined by a court of competent jurisdiction).</text></subsection><subsection id="HF98C526E40404D72B15F8F7015B69309" commented="no"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Administrator shall submit to Congress a report that contains—</text><paragraph id="H309CE4360F38488AAC50826AE92128A2" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">for the year covered by the report, the number and dollar value of financing provided to a covered nonprofit child care provider under this title; and</text></paragraph><paragraph id="HAE001A35BCF440FBA2DB5C83EF313A6E" commented="no"><enum>(2)</enum><text>any other information determined relevant by the Administrator.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1A5DC32914784D60A3BCC1143DACC7A5"><enum>3.</enum><header>Assistance provided by small business development centers</header><text display-inline="no-display-inline">Section 21(c)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)(3)</external-xref>) is amended—</text><paragraph id="H4B95C7FB25A1448EAEF9C96F7695BF34"><enum>(1)</enum><text>in subparagraph (T), by striking <quote>; and</quote>;</text></paragraph><paragraph id="H780F45DC74B3446C9FA3940BF4071F6E"><enum>(2)</enum><text>in the first subparagraph (U), in clause (v), by striking the period at the end and inserting a semicolon;</text></paragraph><paragraph id="H706CE130B30344FB9E453087E352386F"><enum>(3)</enum><text>by redesignating the second subparagraph (U) as subparagraph (V);</text></paragraph><paragraph id="HFFDFDD655AD2471BB82E3AA6DB5D438D"><enum>(4)</enum><text>in subparagraph (V), as so redesignated, in clause (ii)(II), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H50440BAD5838456DBFC8682C0CEDC265"><enum>(5)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HCBF056244156454A99C17685E33397E8" display-inline="no-display-inline"><subparagraph id="H045AF818E2FC4710A115B8E16F627483"><enum>(W)</enum><text display-inline="yes-display-inline">providing business assistance to small business concerns and covered nonprofit child care providers operating or interested in operating a child care business, including one-on-one advising sessions, workshops, or training cohorts on topics relating to—</text><clause id="H244F7A7B666B4F49BC386863D35DA7C2"><enum>(i)</enum><text>developing a business, financial, and marketing plan;</text></clause><clause id="H7826B760A56B4F549045AD513C470B7E"><enum>(ii)</enum><text>learning operational policies and procedures;</text></clause><clause id="H87FD86F3F4004975BD371CEAFE382F65"><enum>(iii)</enum><text>implementing methods for managing financial statements;</text></clause><clause id="HFA6495AC028A47ECA8064A2044D15EBD"><enum>(iv)</enum><text>fostering opportunities to expand the business and increase revenues; and</text></clause><clause id="H0AA00594B8B44D05BABF7392A3D3CABA"><enum>(v)</enum><text>other matters the Administrator determines appropriate.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0CEC84D62D874113AC72C3446A76AD59"><enum>4.</enum><header>Assistance provided by women’s business centers</header><text display-inline="no-display-inline">Section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>) is amended—</text><paragraph id="H3F6A73E40EE44C138329C63B5411755A"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HFB3FF79908A64D0C99E2053E17B97B17"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or, to the extent provided in this subsection, for the benefit of covered nonprofit child care providers</quote> after <quote>by women</quote>;</text></subparagraph><subparagraph id="H53399320FBE242C4A371B56FE8ABEE02"><enum>(B)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H42481A8F485E478F9FB230B5F4D9D5F0"><enum>(C)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H9AF05F91C5364D72B12A861C4A6C400C"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H8A2D3FAB1E014117B1ECCE3988FE6CE8" display-inline="no-display-inline"><paragraph id="H217A204AF9C1481A9403F8D46EF1E63C"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to a project for the benefit of a small business concern or covered nonprofit child care provider or operating or interested in operating a child care business, business assistance, including one-on-one advising sessions, workshops, or training cohorts on topics relating to—</text><subparagraph id="H8D1D1ABFFE3F4220A478FCE1DD091FA6"><enum>(A)</enum><text>developing a business, financial, and marketing plan;</text></subparagraph><subparagraph id="H59843FE3E33242568FC4EF1C2E40F8C0"><enum>(B)</enum><text>learning operational policies and procedures;</text></subparagraph><subparagraph id="H6ECD25D35B44455AA001FDEC6E9F3E59"><enum>(C)</enum><text>implementing methods for managing financial statements;</text></subparagraph><subparagraph id="H3BCC1C46E2E3433A87BD03398D904EFF"><enum>(D)</enum><text>fostering opportunities to expand the business and increase revenues; and</text></subparagraph><subparagraph id="H1E28B04521D94301A2DE51433608C46A"><enum>(E)</enum><text>other matters the Administrator determines appropriate.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H80E4318E06D940BCA46FA5CE38E4795A"><enum>(2)</enum><text>in subsection (d), by inserting <quote>and, to the extent permitted under subsection (b), to covered nonprofit child care providers</quote> after <quote>small business concerns</quote>; and</text></paragraph><paragraph id="H6E9D32FA705B4D2B86C4B1CD3627880F"><enum>(3)</enum><text>in subsection (n)(1), by striking <quote>or small business concern</quote> each place it appears and inserting <quote>, small business concern, or covered nonprofit child care provider</quote>.</text></paragraph></section><section id="H19CCBFFD94AC40CCBEB9A5ACD33AC893"><enum>5.</enum><header>Child care resource guide</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text><paragraph id="HD006D6C6B6D449B1926B995AF7BF6D1F"><enum>(1)</enum><text>by redesignating section 49 as section 50; and</text></paragraph><paragraph id="H893123CC9007418AB281DFBF76F14369"><enum>(2)</enum><text>by inserting after section 48 the following new section:</text><quoted-block id="HE83CF1B33E814B39800A8B0F68662281" style="OLC"><section id="H65E9D482589D47E4AC30AC35C6217B86"><enum>49.</enum><header>Child care resource guide</header><subsection id="H4EB13C14570E4D38903AAF41E7CFCE04"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section and not less frequently than every 4 years thereafter, the Administrator shall publish or update a resource guide for small business concerns operating or planning to operate as child care providers.</text></subsection><subsection id="HD7E1AAC5F2694DCAA81E167CE21F28E6"><enum>(b)</enum><header>Guidance on small business concern matters</header><text>The resource guide required under subsection (a) shall include—</text><paragraph id="H7DD62425D64D4CE79897D0AACB14A2F6"><enum>(1)</enum><text display-inline="yes-display-inline">guidance for such small business concerns related to business operations of a child care provider (including marketing and management planning);</text></paragraph><paragraph id="H5B3A4E22FCE84ABEB23DBC0C34790238"><enum>(2)</enum><text display-inline="yes-display-inline">references to other Federal programs and guides, resources, and websites relating to the overall quality of child care provider operations, including safety measures and training for employees of such provider; and</text></paragraph><paragraph id="HB1285BA047B34D5AB4610ADC8AA81C20"><enum>(3)</enum><text>any other matters the Administrator determines appropriate.</text></paragraph></subsection><subsection id="H5A4D5A84010A4E129BD1DA5DAFD94470"><enum>(c)</enum><header>Publication and dissemination required</header><paragraph id="H1C845FDA4F514382A13BFA484AFB6A99"><enum>(1)</enum><header>Publication</header><text display-inline="yes-display-inline">The Administrator, women’s business centers (as described under section 29), small business development centers, chapters of the Service Corps of Retired Executives (established under section 8(b)(1)(B)), and Veteran Business Outreach Centers (as described under section 32) shall make the resource guide required under subsection (a) publicly available on an appropriate website.</text></paragraph><paragraph id="H05B8DF27E7BA423D9304D5F7B5E2B142"><enum>(2)</enum><header>Distribution</header><subparagraph id="H24D1909B697547A1854C1F9DBCFECA92"><enum>(A)</enum><header>By Administrator</header><text display-inline="yes-display-inline">The Administrator shall distribute the resource guide required under subsection (a) electronically to offices of the Administration, including district offices.</text></subparagraph><subparagraph id="H9C22083665F647E3B04E8A5F71F79E9F"><enum>(B)</enum><header>By other entities</header><text display-inline="yes-display-inline">District offices of the Administration, women’s business centers (as described under section 29), small business development centers, chapters of the Service Corps of Retired Executives (established under section 8(b)(1)(B)), and Veteran Business Outreach Centers (as described under section 32) shall—</text><clause id="H0E710658380A4ADE99987E1A43A05D59"><enum>(i)</enum><text>distribute the resource guide required under subsection (a) to small business concerns operating or planning to operate as child care providers; and</text></clause><clause id="H47F46B40FABE4235B4EB56175301751B"><enum>(ii)</enum><text>make available physical copies of such guide.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H501D71D3119649DB848818F3DE35E830"><enum>6.</enum><header>Report on for-profit child care providers</header><subsection id="H753FA37F3BB64012A1F0D6D03FC8C339"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Administrator of the Small Business Administration shall submit to Congress a study and report on for-profit child care providers that includes—</text><paragraph id="H7AE3F5CE1B744D51A0CB6A743D29BC6E"><enum>(1)</enum><text>an assessment of the challenges and needs of such providers;</text></paragraph><paragraph id="H9638BDEE5D0F4E11A292799A48D64168"><enum>(2)</enum><text>a description of the resources and support that the Small Business Administration provides to such providers;</text></paragraph><paragraph id="H13B42AE97193477D8B27DA2F0948597A"><enum>(3)</enum><text>any deficiencies in the resources and support described under paragraph (2); and</text></paragraph><paragraph id="H3D13A45A5B364BE9BF425EE49705DC28"><enum>(4)</enum><text>any recommendations for legislative actions necessary to address any challenges or needs faced by such providers that are identified by the report required in this subsection.</text></paragraph></subsection><subsection id="H40286D9FCEEB46D69EDD366409DCF76B"><enum>(b)</enum><header>Designated employee duties</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall designate a full-time employee within the Administration as a point of contact for for-profit child care providers. Such employee shall—</text><paragraph id="H0B124FB8A5504FAB8B4BF3B592FFCC0B"><enum>(1)</enum><text>carry out the study required under subsection (a); and</text></paragraph><paragraph id="HA5A36E66DC8646B2A28E59DB716479AC"><enum>(2)</enum><text>provide recommendations to the Administrator on how to better deliver existing resources and support to for-profit child care providers.</text></paragraph></subsection><subsection id="H1314754CAED14431AD99C5DE3164DB89"><enum>(c)</enum><header>For-Profit child care provider defined</header><text display-inline="yes-display-inline">The term <term>for-profit child care provider</term> has the meaning given the term <term>eligible child care provider</term> in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>) and is a provider that operates—</text><paragraph id="HA63704F25E2D4C49A2CF41FF8855B667"><enum>(1)</enum><text display-inline="yes-display-inline">on a for-profit basis; and</text></paragraph><paragraph id="HB06581AE81544755AFAD375DCDA81A11"><enum>(2)</enum><text>in one or more of the several States or the District of Columbia.</text></paragraph></subsection></section></legis-body></bill>
