which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, to award grants to support community-based programs for harm reduction services for individuals who use substances.</official-title></form><legis-body id="H4F5035CCDF7D4F7685E2A5180E03F055" style="OLC"><section id="HA5A9AE0991BD46BD95C80DC8332D0708" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Substance Use Care Gap Act of 2024</short-title></quote>. </text></section><section id="H3B22B6734349463181BBC5A73886A758"><enum>2.</enum><header>Grants for community-based harm reduction services for substance use disorder</header><text display-inline="no-display-inline">Part D of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd">42 U.S.C. 290dd et seq.</external-xref>) is amended by inserting after section 544 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3</external-xref>) the following:</text><quoted-block style="OLC" id="HE5ECAFDABF6046BAA3B4659D5CE06D7A" display-inline="no-display-inline"><section id="HDBE03C3DFBDD4EC0907BC5EF8E0E274B"><enum>544A.</enum><header>Grants for community-based harm reduction services for substance use disorder</header><subsection id="H534381196BEF444E92A1DA41C0263A05"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Assistant Secretary for Mental Health and Substance Use and in consultation with the Director of the Centers for Disease Control and Prevention, shall award grants to eligible entities to support community-based programs for harm reduction services for individuals with substance use disorder or individuals who use substances.</text></subsection><subsection id="H5423DAEB0E2A4F5FB67C754EBFB5BC31"><enum>(b)</enum><header>Eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="HC58FF573AFE04E28ABF2EF01460603D2"><enum>(1)</enum><text>a State, local, Tribal, or territorial government;</text></paragraph><paragraph id="HAC5897624A3C455CBBDA94D415583F1C"><enum>(2)</enum><text>a Tribal organization;</text></paragraph><paragraph id="HE415974444E34717B66E16174D5D8BC2"><enum>(3)</enum><text display-inline="yes-display-inline">a community-based harm reduction program, including a syringe services program;</text></paragraph><paragraph id="HD6D27AAD12B3492A979A867310110A78"><enum>(4)</enum><text>a primary and behavioral health organization; or</text></paragraph><paragraph id="H105100BC92BE47CF8936E1867064E6B0"><enum>(5)</enum><text>an opioid treatment program.</text></paragraph></subsection><subsection id="HBBA0174677E24A99BEC836D48573D0CA"><enum>(c)</enum><header>Subgrants</header><text>For the purposes for which a grant is awarded under this section, the eligible entity receiving the grant may award subgrants to—</text><paragraph id="H0C2C19530BA84F2C95AF7DCEBE8BA527"><enum>(1)</enum><text>a Federally qualified health center;</text></paragraph><paragraph id="H712179E7A0AB49FF8E9CE868577E4F68"><enum>(2)</enum><text>an opioid treatment program;</text></paragraph><paragraph id="H44099DC5FE6847B2A6BC10F841DC1775"><enum>(3)</enum><text display-inline="yes-display-inline">a health care provider or organization providing services to individuals with substance use disorders or individuals who use substances; and</text></paragraph><paragraph id="HCB0CA6792A69461CA02A9F8CCAA8C0BB"><enum>(4)</enum><text>any nonprofit organization that the Secretary deems appropriate, which may include Urban Indian organizations (as defined in section 4 of the Indian Health Care Improvement Act).</text></paragraph></subsection><subsection id="HB82D78A536C845179B70ECF69407B3C6"><enum>(d)</enum><header>Application</header><text>To seek a grant under this section, an eligible entity shall submit to the Secretary, in such form and manner as specified by the Secretary, an application that describes—</text><paragraph id="HDFC2F1D47275438DBE291C180EABA614"><enum>(1)</enum><text>the intended uses of funds provided through the grant;</text></paragraph><paragraph id="HEC0B85EDFCF94AB7AFACD724E68E3E46"><enum>(2)</enum><text display-inline="yes-display-inline">how the activities funded through the grant will support community-based harm reduction programs providing harm reduction services for individuals who use substances; and</text></paragraph><paragraph id="HC11C9A3EA71B4F18BA69B4DC5DC8503D"><enum>(3)</enum><text>any other information and assurances the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="H8C08128DE8F34FD996D79A97135E4A7A"><enum>(e)</enum><header>Use of grant funds</header><text>Grant funds awarded under this section to an eligible entity shall be used to support community-based harm reduction programs providing harm reduction services for individuals who use substances, which—</text><paragraph id="H5CA1207BE5854DFC803F8427B732BA68"><enum>(1)</enum><text>may include—</text><subparagraph id="HDDAF0419F5AB4E0FAFA0571E9EAB5762"><enum>(A)</enum><text display-inline="yes-display-inline">preventing and controlling the spread of infectious diseases and the consequences of such diseases for individuals who use substances, such as through legally authorized or permitted syringe services programs, including the purchase of syringes;</text></subparagraph><subparagraph id="HF44ECCACAA874931A02EF116DCA6D3EE"><enum>(B)</enum><text display-inline="yes-display-inline">overdose prevention programs, such as distributing opioid overdose reversal medication to individuals at risk of overdose and individuals likely to witness or respond to an overdose; and</text></subparagraph><subparagraph id="HF251AF43E2344EA59AF17CC8E0ED163E"><enum>(C)</enum><text>connecting individuals who use substances to overdose education, harm reduction treatment and counseling, treatment services, recovery support services, and health education, and encouraging such individuals to take steps to reduce the negative personal and public health impacts of substance use or misuse; and</text></subparagraph></paragraph><paragraph id="HB045E79940754070ACA99365B9D2DF50"><enum>(2)</enum><text display-inline="yes-display-inline">shall include establishing or maintaining processes, protocols, and mechanisms for referral to evidence-based treatment and recovery support services.</text></paragraph></subsection><subsection id="H786BF8CDDE5C434784575CC08A0ACAA0"><enum>(f)</enum><header>Best practices</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary, in consultation with the Director of the Centers for Disease Control and Prevention, shall issue guidance, based on information collected from grantees under this section, detailing best practices and promising methods for community-based harm reduction programs providing harm reduction services described in subsection (e).</text></subsection><subsection id="H0669EDFF5B5B49E6AA27B1A17FB16FAC"><enum>(g)</enum><header>Technical assistance</header><text>The Secretary, including through the Tribal Training and Technical Assistance Center of the Substance Abuse and Mental Health Services Administration, as applicable, shall provide eligible entities with technical assistance concerning—</text><paragraph id="H034D3816E0DA45C1B3E0BEE3A1ACC39E"><enum>(1)</enum><text>grant application and submission procedures under this section;</text></paragraph><paragraph id="H7AB602C446034C25B3B7BE9B1C34F9AD"><enum>(2)</enum><text>management activities for grant awards under this section; and</text></paragraph><paragraph id="H45C296A7651E4423888CB972112BE94F"><enum>(3)</enum><text>enhancing outreach and direct support to rural and underserved communities and providers in addressing substance use through a grant under this section.</text></paragraph></subsection><subsection id="H162F1EF1ADC44B07860AAEF35541D543"><enum>(h)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this section, and biennially thereafter, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</text><paragraph id="HF3DF79476ED747719B7F3EB8821D5AE3"><enum>(1)</enum><text>assesses how grant funding allocated under this section has affected the efforts of States to—</text><subparagraph id="H8025171C870D45E9B7C3173AAEBF0D00"><enum>(A)</enum><text>address substance use;</text></subparagraph><subparagraph id="HD887FB648BBF4EFB92C53356D1AC9592"><enum>(B)</enum><text display-inline="yes-display-inline">prevent and control the spread of infectious diseases, and the consequences of such diseases for individuals who use substances; and</text></subparagraph><subparagraph id="H420DB98B9A794EF6A783A9386ECA7197"><enum>(C)</enum><text display-inline="yes-display-inline">connect individuals who use substances to overdose education, harm reduction treatment and counseling, treatment services, recovery support services, and health education; and</text></subparagraph></paragraph><paragraph id="HD1674C0306FC401EAA057D48D63B233D"><enum>(2)</enum><text>includes any other information the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="HEE156036AEF647669B5B2C9327BFE438"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC55984CFC28C4F178CFBB95F35503082"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>Federally qualified health center</quote> has the meaning given to that term in section 1861(aa) of the Social Security Act.</text></paragraph><paragraph id="HAA3C6445C15B47C98A318A75D4F1EC60"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>opioid treatment program</quote> has the meaning given to that term in section 8.2 of title 42, Code of Federal Regulations (or any successor regulations).</text></paragraph><paragraph id="H6EC85B4F31C0403B8B4FDB19AB51D934"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>Urban Indian organization</quote> has the meaning given to that term in section 4 of the Indian Health Care Improvement Act.</text></paragraph></subsection><subsection id="H4CA8716AA67F4CCCA44EB69F354278E0"><enum>(j)</enum><header>Authorization of appropriations</header><paragraph id="HC75AD1897D544F67B00A1EEC4E66F486"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2025 through 2029.</text></paragraph><paragraph id="H30A3046CF9664ACAB4E2F2F81641A74A"><enum>(2)</enum><header>Federal administrative expenses</header><text>Of the amounts made available for each fiscal year to award grants under subsection (a), the Secretary shall use not more than 2 percent for Federal administrative expenses, training, technical assistance, and evaluation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
