R. 10046</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241025">October 25, 2024</action-date><action-desc><sponsor name-id="L000601">Mr. Landsman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the submission of the Vehicle Choice Report by the Secretary of Commerce, to increase the clean vehicle tax credit, the previously-owned clean vehicle credit, and the alternative fuel refueling property tax credit, and for other purposes.</official-title></form><legis-body id="H49AFB7BEECEF485DB25F583DED049BAD" style="OLC"><section id="HB261DF1094694456A7492468F5BED4FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Vehicle Choice Act</short-title></quote>.</text></section><section id="H6B0A94B0B83044428E7355D9D9935B7B"><enum>2.</enum><header>Vehicle reports</header><subsection id="HBD6A16D820BB451EAE63463617777653"><enum>(a)</enum><header>Vehicle choice report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary of Commerce shall submit to Congress a report titled the <quote>Vehicle Choice Report</quote> on the quantity of new motor vehicle varieties available for purchase in the United States that includes—</text><paragraph id="HC90491EB8AB841218889611ED3849447"><enum>(1)</enum><text display-inline="yes-display-inline">the number of varieties available of personal use, light-duty vehicles, light-duty trucks, heavy-duty vehicles, and heavy-duty pickup trucks and vans; and</text></paragraph><paragraph id="H25AD09746C4B49DAAE172F8FA5C130E3"><enum>(2)</enum><text display-inline="yes-display-inline">an accounting of the trends in average and median purchase prices and ownership costs (including insurance, fuel, and maintenance) of personal use, light-duty vehicles, light-duty trucks, heavy-duty vehicles, and heavy-duty pickup trucks and vans.</text></paragraph></subsection><subsection id="HD174E839EB0B47FE81196E011AAC4882" commented="no"><enum>(b)</enum><header>Reports on critical minerals for hybrid and electric vehicles</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, and annually thereafter for the next 5 years, the Secretary of Energy, in consultation with the Secretary of the Interior, the Secretary of Commerce, the Secretary of Defense, the Secretary of Agriculture, and the United States Trade Representative, shall submit to Congress a report—</text><paragraph id="HF0EF5345914B4FA49BDBD8AEA33E491C"><enum>(1)</enum><text display-inline="yes-display-inline">that identifies the critical minerals (as defined section 2 of Executive Order 13817 (82 Fed. Reg. 60835; relating to a Federal strategy to ensure secure and reliable supplies of critical minerals)) needed for the manufacture or operation of hybrid vehicles, electric vehicles, battery technologies, and other related emerging technologies; and</text></paragraph><paragraph id="H486B90FAF21D4DA1B924E2E5CEE8261A"><enum>(2)</enum><text>that describes implementation of section 4 of Executive Order 13817 with respect to the critical minerals identified under paragraph (1) of this subsection. </text></paragraph></subsection><subsection id="HEDCD04F17E3F485F871E363FFF237230" commented="no"><enum>(c)</enum><header>Study and reports on gasoline super-users</header><paragraph id="H4AC94B2E672744B4A9B8BEDE801CD545" commented="no"><enum>(1)</enum><header>Initial study and report</header><subparagraph id="H88DE03DD46C543309D2FBC0C20544CD5" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretary of Energy, in consultation with the Secretary of Transportation, shall submit to Congress a report that identifies the 100 routes used most by gasoline super-users.</text></subparagraph><subparagraph id="H556ED53EDABA473FB2209C7E5BF6E21A" commented="no"><enum>(B)</enum><header>Availability on websites of the Departments</header><text display-inline="yes-display-inline">The Secretary of Energy and the Secretary of Transportation shall make the report submitted under paragraph (1) available on the website of the Department of Energy and the website of the Department of Transportation.</text></subparagraph></paragraph><paragraph id="H57418F85735C449990FE1B07C918CA28" commented="no"><enum>(2)</enum><header>Electric vehicle charging station availability and usage reports</header><text display-inline="yes-display-inline">Not later than 1 year after the report is submitted under paragraph (1), and annually thereafter for the following 5 years, the Secretary of Energy, in consultation with the Secretary of Transportation, shall submit to Congress and make available to the public a report on the availability and usage rates of electric vehicle charging stations along the routes identified in the report submitted under paragraph (1).</text></paragraph></subsection><subsection id="H9982AD7418C74B12B20ED36231AE1F90" commented="no"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HD87B74493A9D4B9DB720161E498787C2" commented="no"><enum>(1)</enum><header>Gasoline super-user</header><subparagraph id="H52DEFAE1D6A4484C863170C1E008E46A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>gasoline super-user</term> means a motor vehicle that is in the top 10 percent for gasoline consumption, per year, on average, as determined under subparagraph (B).</text></subparagraph><subparagraph id="H70928065212B4BC992B0EB1B4A7A50C3"><enum>(B)</enum><header>Determination</header><text display-inline="yes-display-inline">The Secretary of Energy, in consultation with the Administrator of the Environmental Protection Agency, shall determine how much gasoline is consumed per year for each make and model of motor vehicle. In making any such determination, the Secretary of Energy shall divide the average miles driven per year by all motor vehicles by the average fuel economy for the applicable make and model of motor vehicle. </text></subparagraph></paragraph><paragraph id="H77DFF03321FD4E76AB2960B46277A182"><enum>(2)</enum><header>Heavy-duty pickup trucks and vans</header><text display-inline="yes-display-inline">The term <term>heavy-duty pickup trucks and vans</term> has the meaning given that term in section 523.7 of title 49, Code of Federal Regulations.</text></paragraph><paragraph id="H1A8A5232E67E47D0B8088D332286C16E"><enum>(3)</enum><header>Heavy-duty vehicle; light-duty vehicle; light-duty truck</header><text display-inline="yes-display-inline">The terms <term>heavy duty vehicle</term>, <term>light-duty vehicle</term>, and <term>light-duty truck</term> have the meaning given those terms in section 86.082–2(b) of title 40, Code of Federal Regulations.</text></paragraph><paragraph id="H2BFF4702760F4E9EA2890246FB2954BD"><enum>(4)</enum><header>Motor vehicle</header><text display-inline="yes-display-inline">The term <term>motor vehicle</term> has the meaning given that term in section 30102(a) of title 49, United States Code. </text></paragraph><paragraph id="H035909FFDFE040688EA4D69F967519C6"><enum>(5)</enum><header>New</header><text display-inline="yes-display-inline">The term <term>new</term>, with respect to a motor vehicle, means that—</text><subparagraph id="H74744283D2CD4468B04D6D858512F400"><enum>(A)</enum><text>a sale is not recorded and a title has not been issued for that vehicle; </text></subparagraph><subparagraph id="HDBE6C0DA8EA540AA977401C98F577F41"><enum>(B)</enum><text>the only documentation on the vehicle is the point of origin of the manufacturer; and</text></subparagraph><subparagraph id="HE4A4E1C01586495285EACBA9983074BA" commented="no"><enum>(C)</enum><text>there may be recorded mileage for that vehicle. </text></subparagraph></paragraph></subsection></section><section id="HBB8336AC535940EDA7038FAF84F11CD1"><enum>3.</enum><header>Modification of clean vehicle tax credit</header><subsection id="HAC48A26FE9354B3B944E8DC71907C5CF"><enum>(a)</enum><header>Increase in credit amount</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/30D">Section 30D(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$3,750</quote> in paragraphs (2) and (3) and inserting <quote>$7,500</quote>.</text></subsection><subsection id="H02189D1CC69640D697251AD44FF256A5"><enum>(b)</enum><header>Modification of limitation based on modified adjusted gross income</header><text>Section 30D(f)(10)(B) of such Code is amended—</text><paragraph id="HC3A97C65964C4489969BC3CB9672C995"><enum>(1)</enum><text>by striking <quote>$300,000</quote> in clause (i) and inserting <quote>$225,000</quote>,</text></paragraph><paragraph id="HE7D86550DE5E446E9DC4C6E8541D360C"><enum>(2)</enum><text>by striking <quote>$225,000</quote> in clause (ii) and inserting <quote>$169,000</quote>, and</text></paragraph><paragraph id="H31F946A18D534BEF9F96BB6CEC4A88F5"><enum>(3)</enum><text>by striking <quote>$150,000</quote> in clause (iii) and inserting <quote>$112,500</quote>. </text></paragraph></subsection><subsection id="HF23A77D90C8A4EFD97757C4458181CB5"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to vehicles placed in service after the date of the enactment of this Act.</text></subsection></section><section id="H4F6C98286B214950AF05B302E6F796F2"><enum>4.</enum><header>Increase of previously-owned clean vehicle credit</header><subsection id="HD4EAEC5C6D5E4880ADB3A71FC990FD56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/25E">Section 25E(a)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="HBC317BD130604A0984056A71A4A13C89"><enum>(1)</enum><text>by striking <quote>$4,000</quote> in paragraph (1) and inserting <quote>$8,000</quote>, and</text></paragraph><paragraph id="HB056B799A1E24246956EDDB1B939495F"><enum>(2)</enum><text>by striking <quote>30 percent</quote> in paragraph (2) and inserting <quote>60 percent</quote>.</text></paragraph></subsection><subsection id="HA862CDD7551044FB9B775561AE7E0307"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to vehicles acquired after the date of the enactment of this Act.</text></subsection></section><section id="H05A358ABBB8E4D5F93C452B71286A6AE"><enum>5.</enum><header>Increase of alternative fuel refueling property tax credit</header><subsection id="H5042D0D19FB841C3815F8410DCD00AA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/30C">Section 30C(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>30 percent</quote> and inserting <quote>50 percent</quote>.</text></subsection><subsection id="H5B2F92D975B64CE4A395939E39886C6B"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to qualified alternative fuel vehicle refueling property placed in service after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
