BILL</legis-type><official-title display="yes">To require covered companies to allow consenting cohabitating adults to open joint accounts, and for other purposes.</official-title></form><legis-body id="HF11854B5A0F54AF68266FADB733BD3A8" style="OLC"><section id="HD8F720A0A7AE4E0999F9AF4F28E01C3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Empowerment and Protection Act</short-title></quote>. </text></section><section id="HEDD19B6786B748B0AB90020223036268"><enum>2.</enum><header>Covered company joint accounts of consenting cohabitating adults</header><subsection id="H79DA348CAF5F4804B4B10B89E2FB809E"><enum>(a)</enum><header>Requirements for covered company joint accounts of consenting cohabitating adults</header><paragraph id="HA814E219EBC24283BD10ABD8AF829D6D" commented="no"><enum>(1)</enum><header>Joint accounts</header><subparagraph id="H7592CD8447394B008B6D5C70AE1A1745"><enum>(A)</enum><header>In general</header><text>Each covered company shall allow consenting cohabitating adults who are or will be customers of the covered company to open a joint account with the covered company for purposes of managing—</text><clause id="H2792E69AB1AD4AB88D744F16F32EC2D2"><enum>(i)</enum><text>the services provided by the covered company; and</text></clause><clause id="HCCCAEF0A2AB84EF695D81825A5566FD3"><enum>(ii)</enum><text>bills for such services.</text></clause></subparagraph><subparagraph id="H963EE70733B941AD832CC3C24F765DF9" commented="no"><enum>(B)</enum><header>Agreement required</header><text display-inline="yes-display-inline">A joint account may not be opened pursuant to this paragraph unless each of the consenting cohabitating adults agree to open the joint account.</text></subparagraph></paragraph><paragraph id="HA961D640579B4A408934ED3E194B30F0"><enum>(2)</enum><header>Names</header><text display-inline="yes-display-inline">Each joint account opened pursuant to paragraph (1) shall be in the name of each of the consenting cohabitating adults who opened the joint account.</text></paragraph><paragraph id="HF3EE4EAC62E243F98C97D8BDB8919EBC" commented="no"><enum>(3)</enum><header>Requests for information</header><text display-inline="yes-display-inline">With respect to a joint account opened pursuant to paragraph (1), each covered company shall, upon request by any of the consenting cohabitating adults that opened the joint account, provide to such consenting cohabitating adults—</text><subparagraph id="HDC2DC00CD6E64E9388FEE21909D76BA4"><enum>(A)</enum><text display-inline="yes-display-inline">information related to the joint account, including—</text><clause id="H273DA12751FF49E3BEE366A4355B944E"><enum>(i)</enum><text>bills;</text></clause><clause id="H959DE23F78A94B449EFA53E40B35BAC0"><enum>(ii)</enum><text>copies of paper and electronic mail; and</text></clause><clause id="HDC6D8207741349F6BD01099C26791D9E"><enum>(iii)</enum><text>any information about products or services provided.</text></clause></subparagraph><subparagraph id="H72D0B9765F304A1CBB2497AD7617CBDC"><enum>(B)</enum><text>access to any online portal for the joint account.</text></subparagraph></paragraph><paragraph id="H41FB898CB81B427E873A6FFCA5A53220"><enum>(4)</enum><header>Notification required</header><text display-inline="yes-display-inline">Each covered company shall provide a notice to each cohabitating adult that opens a joint account with the covered company that explains what information will be shared by the covered company with each of the consenting cohabitating adults.</text></paragraph><paragraph id="H5AD084F38BA94EBD81B0ACFD08E30AF0"><enum>(5)</enum><header>Regulation P</header><text display-inline="yes-display-inline">If a covered company is required by Regulation P (part 1016 of title 12, Code of Federal Regulations) to provide certain privacy notices such covered company shall provide such privacy notices to each of the consenting cohabitating adults who opened the joint account.</text></paragraph><paragraph id="H8287500962EC47EFA9E4E718CDD3CF9E" commented="no"><enum>(6)</enum><header>Civil actions</header><text display-inline="yes-display-inline">Any cohabitating adult who is harmed by a failure of a covered company to meet a requirement of this subsection may bring a civil action in a Federal or State court against such a covered company for an award of not more than $1,000 for each such failure.</text></paragraph></subsection><subsection id="HEDB46BCDFE23486499B8554C5E64F50D"><enum>(b)</enum><header>Effective date</header><text>The requirements of this section shall apply to covered companies beginning on the date that is 180 days after the date of the enactment of this section. </text></subsection><subsection id="H84C5AE8617F449DEA80FB28CB4BC8C4B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB20B1501999845ED882F4F6B2367E3A2" commented="no"><enum>(1)</enum><header>Consenting cohabitating adults</header><subparagraph id="H7C075EA522614EC69D13EF5527799B26" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>consenting cohabitating adults</term> means any adults who consent to cohabitate.</text></subparagraph><subparagraph id="HC46B86AE69F540DEB9727F2FF3069A02" commented="no"><enum>(B)</enum><header>Childcare provider</header><text display-inline="yes-display-inline">With respect to a covered company that is a childcare provider licensed by a State, the term <term>consenting cohabitating adults</term> means the custodial parents of a child who is or will be served by such a covered company.</text></subparagraph></paragraph><paragraph id="H9A2B23505CA7407AA26F94EB09860BD1"><enum>(2)</enum><header>Covered company</header><text display-inline="yes-display-inline">The term <term>covered company</term> includes—</text><subparagraph id="H90AE7E1B582F4ACB8310970B94BB8F5C"><enum>(A)</enum><text display-inline="yes-display-inline">an electric utility (as defined in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>));</text></subparagraph><subparagraph id="H24489861C8404C86AE0CBD7BD0806379"><enum>(B)</enum><text>a gas utility (as defined in section 302 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3202">15 U.S.C. 3202</external-xref>));</text></subparagraph><subparagraph id="H75DB5516AE33435AAD9C5C535C9746C5"><enum>(C)</enum><text>a water utility;</text></subparagraph><subparagraph id="HBE619EB4EE174F7BB05337B912450E94"><enum>(D)</enum><text>an owner or operator of a sanitary landfill (as defined in section 1004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>));</text></subparagraph><subparagraph id="H704CBD37889D4032AB865515BE993336"><enum>(E)</enum><text>a provider of internet access service;</text></subparagraph><subparagraph id="H9CED46B751EE42A383755DF55DC229D0"><enum>(F)</enum><text display-inline="yes-display-inline">a provider of telephone service;</text></subparagraph><subparagraph id="HFE8CB3A2164447D3883C0BD9373BC7E8"><enum>(G)</enum><text display-inline="yes-display-inline">any person who rents a dwelling that is covered by the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>);</text></subparagraph><subparagraph id="H2C7E93F100454D99AD70BE2636CB1426"><enum>(H)</enum><text display-inline="yes-display-inline">any childcare provider licensed by a State;</text></subparagraph><subparagraph id="HB66A40D5A2594FF18E4D6A95B38D9039"><enum>(I)</enum><text>any person who originates a residential mortgage loan;</text></subparagraph><subparagraph id="HD569B586B0A840E598DEA9E8EC95FC98"><enum>(J)</enum><text>any person who leases a residential dwelling unit;</text></subparagraph><subparagraph id="H164EEBBC28364E7EA7FF5BC7F9658CB2"><enum>(K)</enum><text>any person who is a servicer of a residential mortgage loan; and</text></subparagraph><subparagraph id="H44843D2B268E4061AB51E76A7A46AFC6"><enum>(L)</enum><text display-inline="yes-display-inline">a multichannel video programming distributor (as defined in section 602 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/522">47 U.S.C. 522</external-xref>)).</text></subparagraph></paragraph><paragraph id="H0450AF51FB624FD19E8A6A879DC711D2"><enum>(3)</enum><header>Residential mortgage loan</header><text>The term <term>residential mortgage loan</term> has the meaning given the term in section 103(d)(d) of the Truth in Lending Act (15 U.S.C. 1602(d)(d)).</text></paragraph><paragraph id="H73436A076FA94102BCCB5A38CA44488C"><enum>(4)</enum><header>Servicer</header><text display-inline="yes-display-inline">The term <term>servicer</term> has the meaning given the term in section 6(i)(2) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(i)(2)</external-xref>). </text></paragraph><paragraph id="H9A69E1D6E141484E9E9A169A6A289CF0"><enum>(5)</enum><header>Telephone service</header><text display-inline="yes-display-inline">The term <term>telephone service</term> means any of the following:</text><subparagraph id="H6F217E493705483FA37A5CF7A666E4F6"><enum>(A)</enum><text display-inline="yes-display-inline">Voice service (as defined in section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>)).</text></subparagraph><subparagraph id="HF0A0FED323834FE6AB21E091B02E876F"><enum>(B)</enum><text display-inline="yes-display-inline">Commercial mobile service (as defined in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>)).</text></subparagraph><subparagraph id="HCF16258135FE4701833C155E5E3F9B06"><enum>(C)</enum><text display-inline="yes-display-inline">Commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)).</text></subparagraph></paragraph><paragraph id="HD4A88E03571045739E603D79F669B74E"><enum>(6)</enum><header>Water utility</header><text>The term <term>water utility</term> means the owner or operator of—</text><subparagraph id="HABA1C05179F4432BB303D4E26910AE91"><enum>(A)</enum><text>a public water system (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)); or</text></subparagraph><subparagraph id="HFE39FFD7CCA24D56A1DBE75E79A9FD83"><enum>(B)</enum><text>a treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
