prohibiting cost recovery related to smart grid projects, and for other purposes.</official-title></form><legis-body id="H57B78A22EFA44583A7B0C9A5A4874ADF" style="OLC"><section id="H8BA68462B4194342925CC860B02E1D32" section-type="section-one"><enum>1.</enum><header>Smart grid cost recovery</header><subsection id="H1BC3AA951D4E494CBD327D814AD5C940"><enum>(a)</enum><header>Consideration and determination respecting certain ratemaking standards</header><paragraph id="H753E0E8E56974E1E92799F3520AF963C"><enum>(1)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 111(d)(18)(B) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)(18)(B)</external-xref>) is repealed.</text></paragraph><paragraph id="H2A12332E3B924474971D92D6001FE5AE"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2321BE01675D4565AAE1923A7821717C" display-inline="no-display-inline"><paragraph id="HF23EE89ED32B4963929DF7869F00BB4A"><enum>(22)</enum><header>Prohibition on rate recovery for smart grid investments</header><text display-inline="yes-display-inline">No electric utility may recover from ratepayers any capital, operating expenditure, or other costs of the electric utility relating to the deployment of any smart grid system.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H202E19E94CB5409784D86A2F79AFC6B6"><enum>(b)</enum><header>Obligations To consider and determine</header><paragraph id="H93BFBE27D7D7493EB0882EC44FB0FDB6"><enum>(1)</enum><header>Time limitations</header><text display-inline="yes-display-inline">Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HB9FDA7855E894DC1888BF62DA8CE9887" display-inline="no-display-inline"><paragraph id="HA2794BCC90AF4CD18C47BD8BA5E5F9D0"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2F96D0396A62416485BA588215FDE67B"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph><subparagraph id="H3D34B163C9004EE2BFF7300C8326338E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H14FE6A7161DA4C86AAF1C281DAAD12EE"><enum>(2)</enum><header>Failure to comply</header><text display-inline="yes-display-inline">Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote>.</text></paragraph><paragraph id="H479DE2981C614D87A334687E32D2FF91"><enum>(3)</enum><header>Prior State actions</header><text display-inline="yes-display-inline">Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1CC5F5491D8540D5BC52EE3FB8DCDB20" display-inline="no-display-inline"><subsection id="HB1FF3A646EC842C18A89EBE2A840AAA7"><enum>(i)</enum><header>Prior State actions</header><text display-inline="yes-display-inline">Subsections (b) and (c) shall not apply to the standard established by paragraph (22) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="H9A187FC4590447AA99AC857490FF852B"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="HAFEFE537C8954B788C1316614833F508"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="HE88905671A09483CBC432047B77C8C67"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility during the 3-year period ending on that date of enactment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE6B3834B41094EDFB53B99C2BD6A8D42"><enum>(c)</enum><header>Prior and pending proceedings</header><text display-inline="yes-display-inline">Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote>.</text></subsection></section></legis-body></bill>
