which was referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Establishing a Senate Select Committee on the United States withdrawal from Afghanistan.</official-title></form><resolution-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Senate Select Committee on the Afghanistan Withdrawal Resolution</short-title></quote>.</text></section><section id="id026d1d34096d49e8b18f0c928ddd7845"><enum>2.</enum><header>Establishment of Senate Select Committee</header><text display-inline="no-display-inline">There is established a select committee of the Senate, to be known as the Select Committee on the United States Withdrawal from Afghanistan (referred to in this resolution as the <quote>Senate Select Committee</quote>), to investigate and report on the United States withdrawal from Afghanistan.</text></section><section id="id56d5e3504451472e8dda878316278ce3"><enum>3.</enum><header>Membership</header><subsection id="idee98968434814022a10f3445fac9291d"><enum>(a)</enum><header>In general</header><text>The Senate Select Committee shall be composed of 20 Members of the Senate appointed according to the following:</text><paragraph id="id3379666f5f9042b09097b08cb72b0e79"><enum>(1)</enum><text>The majority leader of the Senate shall appoint 2 members.</text></paragraph><paragraph id="id67bdca87255e461ab965047c25c183f2"><enum>(2)</enum><text>The minority leader of the Senate shall appoint 2 members.</text></paragraph><paragraph id="id1ef463fdd7a949b58287b6dad50f083d"><enum>(3)</enum><text>The chairman of the Committee on Armed Services shall appoint 2 members.</text></paragraph><paragraph id="id50588c90b6424d14a2e91e64c8f3f436"><enum>(4)</enum><text>The ranking member of the Committee on Armed Services shall appoint 2 members.</text></paragraph><paragraph id="idcb3832549f864731b964a7ba41ef6a27"><enum>(5)</enum><text>The chairman of the Committee on Foreign Relations shall appoint 2 members.</text></paragraph><paragraph id="id36934e89d644463697c30eb0e5e8da82"><enum>(6)</enum><text>The ranking member of the Committee on Foreign Relations shall appoint 2 members.</text></paragraph><paragraph id="id31d12327f1af4fb4b2c4f48cd07804cb"><enum>(7)</enum><text>The chairman of the Committee on Homeland Security and Governmental Affairs shall appoint 2 members.</text></paragraph><paragraph id="id2c2a92238d3a438e90a23ab51d5f49a1"><enum>(8)</enum><text>The ranking member of the Committee on Homeland Security and Governmental Affairs shall appoint 2 members.</text></paragraph><paragraph id="ida51c276910bd444fbe16c341e351c02b"><enum>(9)</enum><text>The chairman of the Select Committee on Intelligence shall appoint 2 members.</text></paragraph><paragraph id="ide88d5e168ff74726819da876cbb58d57"><enum>(10)</enum><text>The ranking member of the Select Committee on Intelligence shall appoint 2 members.</text></paragraph></subsection><subsection id="id2732b454e2924aedb55c5a9b91bb1d5a"><enum>(b)</enum><header>Appointment of Co-Chairs</header><text>The majority leader and the minority leader of the Senate shall each appoint 1 co-chair of the Senate Select Committee from the members appointed to the Senate Select Committee.</text></subsection><subsection id="id6c94c46c4b99419dad48c5f9f188de58"><enum>(c)</enum><header>Date</header><text>Members of the Senate Select Committee shall be appointed not later than 14 calendar days after the date on which the Senate agrees to this resolution.</text></subsection><subsection id="id60de7d402b114bce86d542b44e48aa76"><enum>(d)</enum><header>Period of appointment</header><text>Members of the Senate Select Committee shall be appointed for the life of the Senate Select Committee.</text></subsection><subsection id="ide7d9b9f1bddc47f3afc941deba46c175"><enum>(e)</enum><header>Vacancies</header><text>A vacancy in the Senate Select Committee—</text><paragraph id="id76B0CB8404734FF6A1DF2A252ED8694F"><enum>(1)</enum><text>shall not affect the powers of the Senate Select Committee; and</text></paragraph><paragraph id="id484DA57A7CD74ED1BC86CBF65528ABB5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>shall be filled in the same manner as the original appointment. </text></paragraph></subsection></section><section id="idf3ad5016e89e4863a36b9b02041363e0"><enum>4.</enum><header>Investigation and report</header><subsection id="id265d06ce7a004b18b96241176da8cd01"><enum>(a)</enum><header>In general</header><text>The Senate Select Committee shall investigate and, not later than 1 year after the date of agreement to this resolution, shall submit a report to the Senate on the United States withdrawal from Afghanistan.</text></subsection><subsection id="id783e73c3006e4011ac79eec9185caee0"><enum>(b)</enum><header>Elements</header><text>The report required under subsection (a) shall address the following:</text><paragraph id="id4feb6f999c014b6eb229f51d75c1a5c9"><enum>(1)</enum><text>Intelligence products available to the United States Government over the course of the withdrawal, including as related to—</text><subparagraph id="ideba5069ba3dd413aba14435241f74b68"><enum>(A)</enum><text>anticipated timelines for a Taliban takeover of Afghanistan, especially as the Taliban seized control of Afghanistan districts and provinces, often without fighting, in early to mid 2021;</text></subparagraph><subparagraph id="id2b55206b398747fcb08edd681254a529"><enum>(B)</enum><text>the ability of the Afghan National Defense and Security Forces to prevent a Taliban takeover of Afghanistan after the withdrawal of the United States Armed Forces and associated combat, logistical, and other support;</text></subparagraph><subparagraph id="id99da8992155649f0bf969f1428b9f219"><enum>(C)</enum><text>the willingness of then-President of the Islamic Republic of Afghanistan Ashraf Ghani and other Afghan political leaders to remain in Afghanistan as the military situation deteriorated, including any plans such leaders may have made to escape Afghanistan as the Taliban advanced;</text></subparagraph><subparagraph id="id1c0c850a33544b48bb5fa865141cc3e5"><enum>(D)</enum><text>any other intelligence that may have informed decisions by the United States Government regarding the timeline for the withdrawal of its forces, moving of its embassy in Kabul, initiation of a noncombatant evacuation operation, force requirements for a noncombatant evacuation operation, or related matters; and</text></subparagraph><subparagraph id="id3d9725457af74189b37ec4c94bfe0554"><enum>(E)</enum><text>any dissenting views shared in writing or other formats, including verbally, by United States diplomats, military commanders, or other government officials regarding the topics described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="iddc17e3315a884a76bbba2d8503cf9421"><enum>(2)</enum><text>The failure to secure Hamid Karzai International Airport, relocate the United States Embassy in Kabul, and initiate a noncombatant evacuation operation prior to Kabul’s imminent collapse, despite warnings by military commanders on the ground that such a collapse was increasingly likely and could occur rapidly, including—</text><subparagraph id="ide2f4832d53574f4fb7f18a9219dc1985"><enum>(A)</enum><text>the failure by the United States Government to accelerate the fortification of the Hamid Karzai International Airport, the relocation of the United States Embassy in Kabul, or the initiation of the noncombatant evacuation operation in response to warnings that the Government of the Islamic Republic of Afghanistan was increasingly likely to collapse and could do so rapidly;</text></subparagraph><subparagraph id="ida4ec2715f8a0452f9740ec294ebb1347"><enum>(B)</enum><text>the development of a <quote>trigger assessment tool</quote> or other conditions-based planning aids to support monitoring of and timely response to the deteriorating security environment in Afghanistan, including use of such aids by Department of Defense and Department of State officials in Afghanistan;</text></subparagraph><subparagraph id="id8f73ff1990e141e3a276aaf04f9fba70"><enum>(C)</enum><text>table-top exercises or other planning events held at agency or interagency levels, with particular focus on planning assumptions, associated timelines, and participant reactions to the planning events;</text></subparagraph><subparagraph id="idf227409e20594931bfbba372f1be3ef4"><enum>(D)</enum><text>any decision by the Department of State or other Federal agency to delay or deprioritize planning for a noncombatant evacuation operation, including for the purpose of demonstrating confidence in the Government of the Islamic Republic of Afghanistan;</text></subparagraph><subparagraph id="ide8875791e11b40af92226e839063e9de"><enum>(E)</enum><text>any suggestion by Department of State or other United States Government officials that executing a noncombatant evacuation operation would constitute failure for the United States in Afghanistan, as reported by the United States Central Command investigation of the Abbey Gate bombing; and</text></subparagraph><subparagraph id="id97496dbc89994d9da2488d069b392c15"><enum>(F)</enum><text>any orders, instructions, or other guidance provided to Department of Defense officials to prevent such officials from planning for a noncombatant evacuation operation with multinational partners, as reported by the United States Central Command investigation of the Abbey Gate bombing.</text></subparagraph></paragraph><paragraph id="idb4c9de287ff442c9873d400427d4cadc"><enum>(3)</enum><text>The decision to prioritize evacuating as many individuals as possible over protecting members of the United States Armed Forces and thoroughly vetting all prospective evacuees, as reported by the United States Central Command investigation of the Abbey Gate bombing, including—</text><subparagraph id="id6679d699e6944a178302ade6fb635f23"><enum>(A)</enum><text>force protection measures, including obstacles, barriers, and other measures, implemented at the Hamid Karzai International Airport prior to and during execution of the noncombatant evacuation operation; and</text></subparagraph><subparagraph id="ide4d7012785cc4bccaab9ac5414661974"><enum>(B)</enum><text>force protection measures not implemented at the Hamid Karzai International Airport, with an explanation for why such force protection measures were not implemented and implications of the failure to implement such measures for risk to force during execution of the noncombatant evacuation operation.</text></subparagraph></paragraph><paragraph id="id6dd4a1b4ca4749128dd34c970914bc78"><enum>(4)</enum><text>Threat reporting prior to the suicide bombing at Abbey Gate, additional force protection measures implemented in response to such threat reporting, and additional force protection measures not implemented in response to such threat reporting, with an assessment of why certain additional force protection measures were not taken.</text></paragraph><paragraph id="idb0968d67f6a34d4f95432222481eb6b7"><enum>(5)</enum><text>The failure to thoroughly vet evacuees prior to their transfer to United States territory, military installations, or other locations outside of Afghanistan, including detailed descriptions of—</text><subparagraph id="id78dcfd1d8db649b0922009c6525e1dce"><enum>(A)</enum><text>any delays by the Department of State to send adequate numbers of consular officials to Hamid Karzai International Airport to facilitate thorough vetting of prospective evacuees;</text></subparagraph><subparagraph id="id0f6cdfb8274445a1989b3721ec511384"><enum>(B)</enum><text>any changes to guidance issued by the Department of State regarding the vetting of prospective evacuees over the course of the noncombatant evacuation operation;</text></subparagraph><subparagraph id="idf74d6413e3204df1869708bb96f5f2c9"><enum>(C)</enum><text>any guidance issued by the President or other United States Government officials to reduce standards for or expedite vetting of prospective evacuees prior to their removal from Afghanistan;</text></subparagraph><subparagraph id="idb559112a35974b08b321124039f6bb8e"><enum>(D)</enum><text>any failure by the United States Government to utilize all existing biometric databases or proper identification standards when processing individuals to be removed from Afghanistan; and</text></subparagraph><subparagraph id="id9de62db873404f58a0fea7048db92700"><enum>(E)</enum><text>any criminal incidents involving evacuees following their transfer to United States territory.</text></subparagraph></paragraph><paragraph id="id92958c1815c14aa894e34dc4cde74e45"><enum>(6)</enum><text>The total number of United States nationals left in Afghanistan following the United States withdrawal from Afghanistan, and the knowledge on the part of United States Government officials of the total number of United States nationals left in Afghanistan when such officials informed Congress that the United States Government had not left Americans behind in Afghanistan.</text></paragraph><paragraph id="idc96f846e403648a8a94e3a9b51a5a30f"><enum>(7)</enum><text>Equipment provided by the United States to the Afghan National Defense and Security Forces and recovered by the Taliban following the collapse of the Afghan National Defense and Security Forces, including the type and amount of such equipment recovered by the Taliban as well as the manner in which the Taliban has been able to use such equipment.</text></paragraph><paragraph id="id6be699b1b9c14e6094bf43bc68e78c59"><enum>(8)</enum><text>Detailed descriptions of—</text><subparagraph id="id429b9c82c6c14abf9c1ebd33bc139f67"><enum>(A)</enum><text>orders issued by the President related to the United States withdrawal from Afghanistan, including with regard to the relocation of the United States Embassy in Kabul and the initiation and execution of the noncombatant evacuation operation;</text></subparagraph><subparagraph id="id4829e9607dfc400487edf48859d82ed6"><enum>(B)</enum><text>analysis or recommendations provided by the Assistant to the President for National Security Affairs, the Secretary of State, the Secretary of Defense, the Chairman of the Joint Chiefs of Staff, the Commander of United States Central Command, and other national security leaders related to the United States withdrawal from Afghanistan, including as related to—</text><clause id="id1892544dc7ea4be087650c6ebca38b5b"><enum>(i)</enum><text>the deteriorating military situation in Afghanistan; and</text></clause><clause id="idb3f4ade868a64116849318bb166607a9"><enum>(ii)</enum><text>the consequent need to accelerate the relocation of the United States Embassy in Kabul and the initiation of the noncombatant evacuation operation; and</text></clause></subparagraph><subparagraph id="id7398b52a053f4f0db6aed54b12d06521"><enum>(C)</enum><text>requests for forces or other requests for additional authorities or resources made to the President by the Secretary of Defense, the Secretary of State, or other national security leaders during the United States withdrawal from Afghanistan, and the President’s responses to any such requests.</text></subparagraph></paragraph><paragraph id="id4e04c37a240b47568dd44b71697a45f4"><enum>(9)</enum><text>Any other matters identified by members of the Senate Select Committee.</text></paragraph></subsection><subsection id="id90c4ba695a134020a2558a9363c3e13f"><enum>(c)</enum><header>Form</header><text>The report required under subsection (a) shall be submitted in unclassified form but may contain a classified annex.</text></subsection></section><section id="id4541c56fd05a421a9ff7a22c6b35dda9"><enum>5.</enum><header>Meetings, hearings, and access to information</header><subsection id="id081171b10dde4c24a75616120389e9b5"><enum>(a)</enum><header>Meetings</header><paragraph id="idd861bc08da6a4908976d50ee16566dab"><enum>(1)</enum><header>In general</header><text>The Senate Select Committee shall meet at the call of the co-chairs or at the request of at least 3 members.</text></paragraph><paragraph id="id780d3d65d9b04ee9810fd90d788deb1a"><enum>(2)</enum><header>Quorum</header><text>Half of the members of the Senate Select Committee shall constitute a quorum.</text></paragraph><paragraph id="id9f6ce3cffa074dd9b364d0293ddc85cd"><enum>(3)</enum><header>Voting</header><text>Proxy voting shall be allowed on behalf of the members of the Senate Select Committee.</text></paragraph></subsection><subsection id="id62876923c66d4696952f69dfa0d23819"><enum>(b)</enum><header>Hearings</header><paragraph id="id97a687a3e4724f8292e855a81b0be694"><enum>(1)</enum><header>In general</header><text>The Senate Select Committee shall, for the purposes described in section 4, hold such hearings, compel attendance of such witnesses, take or compel such testimony, receive or compel such evidence, and administer such oaths as the Senate Select Committee considers advisable.</text></paragraph><paragraph id="id6219a0e653f942ccbf5c2ab10fe52d9c"><enum>(2)</enum><header>Frequency</header><text>The Senate Select Committee shall hold an open hearing no less frequently than once per month until it has received open testimony from all of the witnesses listed in paragraph (3).</text></paragraph><paragraph id="id97995f162f8442cfac983ca902b5d633"><enum>(3)</enum><header>Witnesses</header><text>The co-chairs shall hear testimony from the following before the Senate Select Committee in open session, even if the person holds a different public office or no longer holds public office at the time of the hearing:</text><subparagraph id="ida237c995934644188c1dfaf81be2cef3"><enum>(A)</enum><text>Assistant to the President for National Security Affairs Jake Sullivan.</text></subparagraph><subparagraph id="id2756a209b6fa44229ed990ffe542ee4b"><enum>(B)</enum><text>Secretary of State Antony Blinken.</text></subparagraph><subparagraph id="idd2a034a11ddd46cd849a38da91d65d98"><enum>(C)</enum><text>Secretary of Defense Lloyd Austin.</text></subparagraph><subparagraph id="idccde10fd2f1b45c490d42e54d80e4baa"><enum>(D)</enum><text>Secretary of Homeland Security Alejandro Mayorkas.</text></subparagraph><subparagraph id="iddd6f95a1caf84ecb92399d2250828916"><enum>(E)</enum><text>Director of National Intelligence Avril Haines.</text></subparagraph><subparagraph id="id642fc87e56cd44a98fc0914af23536d4"><enum>(F)</enum><text>Director of the Central Intelligence Agency William Burns.</text></subparagraph><subparagraph id="idbaad60893fd54c289c8d94e11d3d7cdf"><enum>(G)</enum><text>Chairman of the Joint Chiefs of Staff General Mark Milley.</text></subparagraph><subparagraph id="ideeec131db0f747cda2abb111a6efb8af"><enum>(H)</enum><text>Under Secretary of Defense for Policy Colin Kahl.</text></subparagraph><subparagraph id="idad3c7823b8bf4d31b2f2611cba49b7de"><enum>(I)</enum><text>Former United States Ambassador to Afghanistan Ambassador John Bass.</text></subparagraph><subparagraph id="id683a85fef1ec4ff097124073633f6a1e"><enum>(J)</enum><text>Former United States Ambassador to Afghanistan Ambassador Ross Wilson.</text></subparagraph><subparagraph id="id342eb90234274cbe9a756c9302d5ce46" commented="no"><enum>(K)</enum><text>Former Commander of United States Forces Afghanistan—Forward Rear Admiral Peter Vasely.</text></subparagraph><subparagraph id="id2961319cd907483b8e04a8a109a37576" commented="no"><enum>(L)</enum><text>Former Commanding General of Joint Task Force—Crisis Response Brigadier General Farrell J. Sullivan.</text></subparagraph><subparagraph id="id6928e3d11dd34843acecc8fd2dd691aa"><enum>(M)</enum><text>Former Commanding General of 82nd Airborne Division Lieutenant General Christopher T. Donahue.</text></subparagraph><subparagraph id="id1a9e256d28b7495999fd24206ae13307"><enum>(N)</enum><text>Any other individuals, including former United States Government officials, identified by the co-chairs or a group of 3 members of the Senate Select Committee.</text></subparagraph></paragraph><paragraph id="id1f0b290665994890895ba544b3470c33"><enum>(4)</enum><header>Transparency</header><text>The Senate Select Committee may receive classified testimony in a closed session, but any witnesses questioned in a closed session shall also testify in an open session, in the interest of public transparency.</text></paragraph><paragraph id="id7b5c14676e0d4a10bc8de54337cd9216"><enum>(5)</enum><header>Questioning</header><text>Co-chairs shall permit members of the Senate Select Committee to question witnesses at a hearing for periods longer than 5 minutes or multiple periods of 5 minutes, at the request of a member.</text></paragraph><paragraph id="idd5b0327cb35747ee9e22455f86f64c12"><enum>(6)</enum><header>Procedures</header><subparagraph id="id0b3c8ca9cf1c462d8a18b5d39b3fd154"><enum>(A)</enum><header>Announcement</header><text>The co-chairs of the Senate Select Committee shall make a public announcement of the date, time, place, and subject matter of any hearing to be conducted, not less than 7 days in advance of such hearing, unless the co-chairs determine that there is good cause to begin such hearing at any earlier date.</text></subparagraph><subparagraph id="idff01060bc24a46d098e2f3b8fe0693b5"><enum>(B)</enum><header>Written statement</header><text>A witness appearing before the Senate Select Committee shall file a written statement of proposed testimony and respond in writing to any advance questions from the Senate Select Committee at least 2 calendar days before the appearance of the witness unless the requirement is waived by the co-chairs.</text></subparagraph></paragraph></subsection><subsection id="iddc8e2c162c864ad7b96b1c924507c1de"><enum>(c)</enum><header>Cooperation from Federal agencies</header><paragraph id="ide38a9455526c4ef6ad0ba96419166321"><enum>(1)</enum><header>Technical assistance</header><text>Upon written request of the co-chairs, a Federal agency shall provide technical assistance to the Senate Select Committee in order for the Senate Select Committee to carry out its duties.</text></paragraph><paragraph id="id9a039ad06e284d76b1bb2a5e3eb5bb6f"><enum>(2)</enum><header>Provision of information</header><text>The National Security Council, the Secretary of Defense, the Secretary of State, the Secretary of Homeland Security, the Director of National Intelligence, the heads of the elements of the intelligence community, and the heads of other relevant Federal agencies shall expeditiously provide information requested by the Senate Select Committee related to the investigation and report under required under section 4, and in no case later than 3 weeks after a request by a member of the Senate Select Committee.</text></paragraph><paragraph id="id73f11d4ec6a34c3a96d20f6a2c0f5a0a"><enum>(3)</enum><header>Limitation on exclusions</header><text>Federal agencies shall not withhold information from the Senate Select Committee, including for reasons of classification, executive privilege, or attorney-client privilege.</text></paragraph></subsection><subsection id="ide5044591ea2343259da6a706973bc7cd"><enum>(d)</enum><header>Subpoena authority</header><text>Members of the Senate Select Committee are authorized to—</text><paragraph id="id51f033c43e654673a85f30977d060ae3"><enum>(1)</enum><text>compel by subpoena the furnishing of information by United States Government officials and other individuals, including former United States Government officials; and</text></paragraph><paragraph id="idc03d479460b6451fa645f8333ff2569b"><enum>(2)</enum><text>take or order the taking of depositions, including pursuant to subpoena, in the same manner as a standing committee of the Senate.</text></paragraph></subsection></section><section id="id529ac238e50841609d3cbc85a1f66fc5"><enum>6.</enum><header>Administration</header><subsection id="id45fc4b46e38f41b3847658f26d9384f6"><enum>(a)</enum><header>Funding</header><text>There shall be paid, out of the contingent fund of the Senate from the appropriations account <quote>Miscellaneous Items,</quote> such sums as may be necessary for the expenses of the Senate Select Committee, subject to the rules and regulations of the Senate.</text></subsection><subsection id="id33ff42251f014ca48a16e71f72df51d1"><enum>(b)</enum><header>Expenses</header><text>In carrying out its functions, the Senate Select Committee is authorized to incur expenses in the same manner and under the same conditions as the Joint Economic Committee is authorized under section 11 of the Employment Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1024">15 U.S.C. 1024</external-xref>). </text></subsection><subsection id="idec7a3191b1fe4fc2b4dc543f4266061d"><enum>(c)</enum><header>Staffing</header><paragraph id="id8095d22c12b045b58434be40643587a8"><enum>(1)</enum><header>Staff director</header><text>The co-chairs, acting jointly, shall hire the staff director of the Senate Select Committee.</text></paragraph><paragraph id="id036e94b7110a4b29863e305c41e8719c"><enum>(2)</enum><header>Other staff</header><text>The co-chairs, acting jointly, may employ such additional staff as they determine necessary for the Senate Select Committee to carry out its duties.</text></paragraph><paragraph id="id4c67607f49f145008f7b5f220a09f98f"><enum>(3)</enum><header>Compensation</header><text>The co-chairs, acting jointly, may appoint and fix the compensation of the staff director and additional staff as they determine necessary, within the guidelines for employees of the Senate and following all applicable rules and employment requirements of the Senate.</text></paragraph><paragraph id="idd494b005b98f42aa93a79270f6fdfbc7"><enum>(4)</enum><header>Ethical standards</header><text>Members and staff of the Senate Select Committee shall comply with the ethics rules of the Senate.</text></paragraph></subsection><subsection id="ide345de96b7ed4150a76971df39ca0797"><enum>(d)</enum><header>Facilities</header><text>The Senate Select Committee shall have priority access to—</text><paragraph id="ide7dbc514ca014dd88229eb5bf3f24bc7"><enum>(1)</enum><text>rooms of the Senate for purposes of meetings, hearings, and other Senate Select Committee functions; and</text></paragraph><paragraph id="ide999c81948574fd08e0aad7b64896bfe"><enum>(2)</enum><text>secure facilities for purpose of receiving classified testimony and handling other classified materials.</text></paragraph></subsection><subsection id="id83f3d86c300e4a88aec14b1cda3eec83"><enum>(e)</enum><header>Termination</header><text>The Senate Select Committee shall terminate on the later of the following:</text><paragraph id="ideadf1ebecd354e47869f42f6216c9292"><enum>(1)</enum><text>30 days after the submission of the report required under section 4(a).</text></paragraph><paragraph id="ide4e004ef80c74a6bb0ec4a8629c26002"><enum>(2)</enum><text>30 days after the Senate Select Committee has held open hearings with all of the witnesses listed under section 5(b)(3).</text></paragraph><paragraph id="ida12cfe3ac5544e6ca0e4d389d118fc58"><enum>(3)</enum><text>The expiration of the Congressional session during which the Senate agrees to this resolution.</text></paragraph></subsection><subsection id="id9bd192533f9a4f1c9ad55444fecdbc09"><enum>(f)</enum><header>Disposition of records</header><text>Upon the termination of the Senate Select Committee, the records of the Senate Select Committee shall become the records of the Committee on Armed Services. </text></subsection></section></resolution-body></resolution>
