RES. 16</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action display="yes"><action-date date="20210126">January 26, 2021</action-date><action-desc><sponsor name-id="S270">Mr. Schumer</sponsor> submitted the following resolution; which was considered and agreed to</action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">To provide for related procedures concerning the article of impeachment against Donald John Trump, President of the United States. </official-title></form><resolution-body><section id="S1" display-inline="yes-display-inline" section-type="undesignated-section"><text>That— </text><paragraph id="id6d270155e835484e82ab85f6cc4e1053"><enum>(1)</enum><text>pursuant to rules III and IV of the Rules and Procedures and Practice When sitting on Impeachment Trials, on Tuesday, February 9, 2021, the Senate shall proceed to the consideration of the article of impeachment and that the Secretary of the Senate shall notify the House of Representatives of the time and place fixed for the Senate to proceed upon the impeachment of Donald John Trump in the Senate Chamber; </text></paragraph><paragraph id="idCA8E2B216EE644CF824B9E9AB613AF3E"><enum>(2)</enum><text>under rule VIII of the Procedure and Guidelines for Impeachment Trials in the United States Senate—</text><subparagraph id="id952f1f8d95e042d6b92b70d1d0a7057a"><enum>(A)</enum><text>the summons shall be issued in the usual form to Donald John Trump, provided that he may have until 12:00 pm on Tuesday, February 2, 2021, to file his answer with the Secretary of the Senate; </text></subparagraph><subparagraph id="idBAA2C4A280A84FC5BE2C3749C6A8CD86"><enum>(B)</enum><text>the House of Representatives may have until 12:00 pm on Monday, February 8, 2021, to file its replication with the Secretary of the Senate;</text></subparagraph><subparagraph id="id4F46A415DE6042D4AE79837DA0B2BC85"><enum>(C)</enum><text>if the House of Representatives wishes to file a trial brief, it shall be filed by 10:00 am on Tuesday, February 2, 2021;</text></subparagraph><subparagraph id="idE7EB91CBACFC438E9CBEEEE71E99E9CA"><enum>(D)</enum><text>if Donald John Trump wishes to file a trial brief, it shall be filed by 10:00 am on Monday, February 8, 2021; and</text></subparagraph><subparagraph id="idDD14033F283047E585DE1C76AE788636"><enum>(E)</enum><text>the House of Representatives may file a rebuttal brief no later than 10:00 am on Tuesday, February 9, 2021; </text></subparagraph></paragraph><paragraph id="idF65F170C064C424A891B4E6097D4DFE2"><enum>(3)</enum><text>the Senate directs the parties, in addition to addressing the charge of incitement of insurrection in the Article of Impeachment approved by the House on January 13, 2021, to address in their trial briefs whether Donald John Trump is subject to the jurisdiction of a court of impeachment for acts committed as President of the United States, notwithstanding the expiration of his term in said office; and</text></paragraph><paragraph id="id4A06AF29530E4051BC4EBFC3C7EA6714"><enum>(4)</enum><text>the Senate directs the parties to be prepared to address at the commencement of the trial on February 9, 2021, whether Donald John Trump is subject to the jurisdiction of a court of impeachment for acts committed as President of the United States, notwithstanding the expiration of his term in said office. </text></paragraph></section></resolution-body></resolution>
