which was referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>CONCURRENT RESOLUTION</legis-type><official-title display="yes">Requiring all Members of Congress to publish a public schedule.</official-title></form><resolution-body><section id="idED308BD6669A4A02B1F17544CF47702D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Transparency in Congress Resolution of 2022</short-title></quote>.</text></section><section id="idBFC98032A9AC41E8BD008D39D8465F39"><enum>2.</enum><header>Publication of public schedule</header><subsection id="id646C66CB259F4A1BB48E1812FC9C86E3"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id210545D4168E4411889398D658E11A82"><enum>(1)</enum><text>the term <term>disclosure</term> has the meaning given that term in section 2302(a)(2) of title 5, United States Code;</text></paragraph><paragraph id="idD6B2BDFB94444F0881084E7E66D0AEF7"><enum>(2)</enum><text>the term <term>Member of Congress</term> has the meaning given that term in section 2106 of title 5, United States Code, except that such term does not include the Vice President; and</text></paragraph><paragraph id="id659D394EA835414B9677F5C9A51C9C0B"><enum>(3)</enum><text>the term <term>public schedule</term> means the public schedule of a Member of Congress required to be published under subsection (b)(1). </text></paragraph></subsection><subsection id="id94E9A469FEA74CB083F50CA9CCC64C61"><enum>(b)</enum><header>Requirement</header><paragraph id="idF80AC989C3DE4B158151363A4EEA0C98"><enum>(1)</enum><header>In general</header><text>Not later than the last day of each month, each Member of Congress shall publish a public schedule of the Member of Congress for the preceding month that includes the following:</text><subparagraph id="id35531b2977bf42faa34450b5efa65e33"><enum>(A)</enum><text>A daily calendar of—</text><clause id="id824043BAC6A94BE4AAAD486C768D7F4D"><enum>(i)</enum><text>each hearing, meeting, or event attended by the Member of Congress during the month, either in person or by teleconference or other electronic means, at which the Member of Congress appears in his or her official capacity; and</text></clause><clause id="idB4A2876F72234C6AB36D6361A2C2C3F6"><enum>(ii)</enum><text>the floor activity of the Member of Congress during the month.</text></clause></subparagraph><subparagraph id="id6224972ace8c44eb9514a301612a04ed"><enum>(B)</enum><text>For each meeting or event described in subparagraph (A), if known by the Member of Congress—</text><clause id="id01d8cc0983394482af612a3695da4db3"><enum>(i)</enum><text>a general description of the individuals, entities, or organizations participating in the meeting or event; or</text></clause><clause id="idab94404066b047918678fb198c426485"><enum>(ii)</enum><text>a general description of the meeting or event.</text></clause></subparagraph></paragraph><paragraph id="idFC430690A57C4741B430606F6A47073E"><enum>(2)</enum><header>Exclusions</header><text>A public schedule is not required to include— </text><subparagraph id="id94FF576391C24D4FBA9225E9907ACC5B"><enum>(A)</enum><text>personal or campaign meetings or events; </text></subparagraph><subparagraph id="idc4a49ee7abcb4730a293cbc8d504d45f"><enum>(B)</enum><text>meetings or events with congressional staff; or</text></subparagraph><subparagraph id="id29CB20232D824FC79C7800FB1B9B62FD"><enum>(C)</enum><text>meetings or events at which the Member of Congress is not appearing in an official capacity.</text></subparagraph></paragraph></subsection><subsection id="id8099361cbae042b7b0b66d24a9d5d6e6"><enum>(c)</enum><header>Information not disclosed</header><text>A Member of Congress may determine to not disclose in a public schedule the following information:</text><paragraph id="id763d8175ffb54387a6362e86bb2850e3"><enum>(1)</enum><text>Any information—</text><subparagraph id="idec47b0ccd84745b996bed35c0238ad6e"><enum>(A)</enum><text>that implicates personal privacy or law enforcement concerns;</text></subparagraph><subparagraph id="id4fa3553940bf4083b824e0a494ceed1f"><enum>(B)</enum><text>that implicates the personal safety of congressional staff (including the time of the arrival or departure of congressional staff from their duty station); or</text></subparagraph><subparagraph id="id6fdec69d9de840f2b9b8359b61a9e892"><enum>(C)</enum><text>the release or disclosure of which would cause a threat to national security interests or reveal information that is confidential or classified.</text></subparagraph></paragraph><paragraph id="id2a64036201334f59915a61e0cd14e716"><enum>(2)</enum><text>Information related to particularly sensitive meetings, including a meeting with an anonymous or confidential whistleblower. </text></paragraph></subsection><subsection id="idf047b1af8e4b47de81a86972fd889d07"><enum>(d)</enum><header>Availability</header><paragraph id="idFB975705A38D4D3CB6EA4E8149D252BF"><enum>(1)</enum><header>In general</header><text>For each Congress and as required under subsection (b)(1), a Member of Congress shall make each monthly public schedule of the Member of Congress publicly available on the website of the Member of Congress at least until the date that is 30 days after—</text><subparagraph id="idA06B5B2B33994DD297224E8823E165F4"><enum>(A)</enum><text>the last day of the Congress; or</text></subparagraph><subparagraph id="id3ee0b41cbc814a839266ad6486b9be68"><enum>(B)</enum><text>in the case of a Member of Congress whose service as a Member of Congress ends before the last day of the Congress, the last day of such service. </text></subparagraph></paragraph></subsection><subsection id="id121932BD87C54CB883421433F9C594D9" commented="no"><enum>(e)</enum><header>Ethics implementation and guidance</header><text>The Select Committee on Ethics of the Senate and the Committee on Ethics of the House of Representatives—</text><paragraph commented="no" id="id7AB3C1091E154539A1354A319B3E6003"><enum>(1)</enum><text>shall have authority to implement this resolution with respect to Members of Congress of the applicable House; and</text></paragraph><paragraph commented="no" id="id85723005F68A4216A0C2655742D509A6"><enum>(2)</enum><text>may issue guidance as needed to implement this resolution. </text></paragraph></subsection><subsection id="idE1B98654DC1F423F88FE6F318B0AB310"><enum>(f)</enum><header>Effective date</header><text>A Member of Congress shall make available the public schedule of the Member of Congress in accordance with this section for each day on or after the date that is 180 days after the date of adoption of this resolution.</text></subsection></section></resolution-body></resolution>
