committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To award grants to certain institutions of higher education to educate and train students to participate in the telecommunications workforce.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Minority Participation And Careers in Telecommunications Act</short-title></quote> or the <quote><short-title>IMPACT Act</short-title></quote>.</text></section><section id="id54DC6B6F2FB14F859359514BF61E7877"><enum>2.</enum><header>Telecommunications Workforce Training Grant Program</header><subsection id="idF7D07E530A71470A9DC4B40AABF1513F"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idA4F3513DDF04472CBB1D132A9F10F876" commented="no"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph commented="no" id="id2C4E14EDDCD74ACFA3525ABF161EEE45"><enum>(2)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant awarded under subsection (b).</text></paragraph><paragraph commented="no" id="id0423E7EA6B4F44DC9B6EE17D59F18472"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a historically Black college or university, Tribal College or University, or minority-serving institution, or a consortium of such entities, that forms a partnership with 1 or more of the following entities to carry out a training program:</text><subparagraph id="id46231fe4a98d4619a5e1eac5d88511f2" commented="no"><enum>(A)</enum><text>A member of the telecommunications industry, such as a company or industry association.</text></subparagraph><subparagraph id="id6b3d07c6ce8b481bbb2180382dfab43e" commented="no"><enum>(B)</enum><text>A labor-management organization.</text></subparagraph><subparagraph id="id5be50b4b10ea4bca88992e1a396cb3f6" commented="no"><enum>(C)</enum><text>The Telecommunications Industry Registered Apprenticeship Program.</text></subparagraph><subparagraph id="id1d882b3786194d719ca5f6237efbee7b" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>A nonprofit organization dedicated to helping individuals gain employment in the telecommunications industry.</text></subparagraph><subparagraph id="id416512754edb42818f0307acfd6490e0"><enum>(E)</enum><text>A community or technical college with experience in providing workforce development for individuals seeking employment in the telecommunications industry or a similar industry.</text></subparagraph></paragraph><paragraph commented="no" id="id9084FDC091244AF5B49D8F50F8492D42"><enum>(4)</enum><header>Fund</header><text>The term <term>Fund</term> means the Telecommunications Workforce Training Grant Program Fund established under subsection (c)(1).</text></paragraph><paragraph commented="no" id="id1DB0406E432D4130B39F6B1ACD07031D"><enum>(5)</enum><header>Grant Program</header><text>The term <term>Grant Program</term> means the Telecommunications Workforce Training Grant Program established under subsection (b). </text></paragraph><paragraph commented="no" id="idCB9EAF75F6584AD5AE388A7441ACC2BC"><enum>(6)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term ‘part B institution’ in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph><paragraph commented="no" id="id84C1610EB705409BB9E526896452ABBA"><enum>(7)</enum><header>Industry field activities</header><text>The term <term>industry field activities</term> means activities at active telecommunications worksites, such as towers, construction sites, and network management hubs.</text></paragraph><paragraph commented="no" id="id1040D97E939646D686B45FF7E88C6F1E"><enum>(8)</enum><header>Industry partner</header><text>The term <term>industry partner</term> means an entity described in subparagraphs (A) through (E) of paragraph (3) with which an eligible entity forms a partnership to carry out a training program.</text></paragraph><paragraph id="id34d2aacd776e4eb594a6a01b419a20be" commented="no"><enum>(9)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph><paragraph commented="no" id="id54EDB7A2C28E4BB1910741F8F04B233B"><enum>(10)</enum><header>Training program</header><text>The term <term>training program</term> means a credit or non-credit program developed by an eligible entity, in partnership with an industry partner, that—</text><subparagraph commented="no" id="id1DD1F100B8D94DC5B8CF7B4A2FC86CB4"><enum>(A)</enum><text>is designed to educate and train students to participate in the telecommunications workforce; and</text></subparagraph><subparagraph commented="no" id="idC506FE28034B48AB802B71AB86411D3D"><enum>(B)</enum><text>includes a curriculum and apprenticeship or internship opportunities.</text></subparagraph></paragraph><paragraph commented="no" id="idAE012EF5A00241C8ACA735BA32243BCA"><enum>(11)</enum><header>Tribal College or University</header><text>The term <term>Tribal College or University</term> has the meaning given the term in section 316(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>).</text></paragraph></subsection><subsection commented="no" id="idCB3A26E55786415987DC81773FC24F43"><enum>(b)</enum><header>Program</header><text>The Assistant Secretary, acting through the Office of Minority Broadband Initiatives established under section 902(b)(1) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), shall establish a program, to be known as the <quote>Telecommunications Workforce Training Grant Program</quote>, under which the Assistant Secretary awards grants to eligible entities to develop training programs.</text></subsection><subsection commented="no" id="idC44342EE0B644CA6BC7184E46686E164"><enum>(c)</enum><header>Fund</header><paragraph commented="no" id="id8EE0D28E515E45909ABDBF17471BECB6"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Telecommunications Workforce Training Grant Program Fund</quote>.</text></paragraph><paragraph commented="no" id="id9E061EF827014C1BAF309B99E2063511"><enum>(2)</enum><header>Availability</header><text>Amounts in the Fund shall be available to the Assistant Secretary to carry out the Grant Program.</text></paragraph></subsection><subsection commented="no" id="id314E9A26BBC74E6ABDAEAF1D69B3DE6A"><enum>(d)</enum><header>Application</header><paragraph commented="no" id="idC360F459BD3E425D91C34A964691C3A3"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a covered grant shall submit an application to the Assistant Secretary at such time, in such manner, and containing such information as the Assistant Secretary may require.</text></paragraph><paragraph commented="no" id="idDE183401F32849A8801666DD05B4239A"><enum>(2)</enum><header>Contents</header><text>An eligible entity shall include in an application under paragraph (1)—</text><subparagraph commented="no" id="id9750CDA5C6384E018509D91633328B77"><enum>(A)</enum><text>a commitment from the industry partner of the eligible entity to collaborate with the eligible entity to develop a training program, including curricula and internships or apprenticeships;</text></subparagraph><subparagraph id="id29888d7034244dd2b1d4d2bfd612b44b"><enum>(B)</enum><text>a description of how the eligible entity plans to use the covered grant, including the type of training program the eligible entity plans to develop; and</text></subparagraph><subparagraph commented="no" id="idDC2C4DE2CC3C4008B3502B142B5D7047"><enum>(C)</enum><text>a plan to increase female student participation in the training program of the eligible entity.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id4414E35C16564608B09411715253258A"><enum>(e)</enum><header>Use of funds</header><text>An eligible entity may use a covered grant, with respect to the training program of the eligible entity, to—</text><paragraph commented="no" id="idFCAB5D237F6D402BBB3D851448A437D4"><enum>(1)</enum><text>hire faculty members to teach courses in the training program;</text></paragraph><paragraph commented="no" id="id0C0483E1A8EC48ECA99CB96BA2B25EDF"><enum>(2)</enum><text>train faculty members to prepare students for employment in jobs related to the deployment of next-generation communications networks, including 5G networks, and fiber infrastructure, particularly in—</text><subparagraph id="id92ae7d53bfc644fe847fd59de5608871"><enum>(A)</enum><text>broadband and wireless network engineering;</text></subparagraph><subparagraph id="idf4c802fe98dc4db89cf99674d2dd5954"><enum>(B)</enum><text>network deployment;</text></subparagraph><subparagraph id="id044ddd7c12244d5e958bb8f8efe5adbf"><enum>(C)</enum><text>industry field activities; and</text></subparagraph><subparagraph id="idee64151fdcba48cdaf1dd296a27ac2ac"><enum>(D)</enum><text>cybersecurity;</text></subparagraph></paragraph><paragraph id="id672E81B638DC4F07932B1D013C4A79CE"><enum>(3)</enum><text>design and develop curricula and other components necessary for degrees, courses, or programs of study, including certificate programs and credentialing programs, that comprise the training program;</text></paragraph><paragraph id="id89d3da69ea804346b0c1153488a40e6b" commented="no"><enum>(4)</enum><text>pay for costs associated with instruction under the training program, including the costs of equipment, telecommunications training towers, laboratory space, classroom space, and instructional field activities;</text></paragraph><paragraph id="idc6ba6bd3329b45a598860ca1a33f8f48"><enum>(5)</enum><text>fund scholarships, student internships, apprenticeships, and pre-apprenticeship opportunities;</text></paragraph><paragraph id="idef916e57939b4a6cb0b473b9f7d16df3"><enum>(6)</enum><text>recruit students for the training program; and</text></paragraph><paragraph id="idbf6ea0240f144629bc405e4c5ad9d20f"><enum>(7)</enum><text>support the enrollment in the training program of individuals working in the telecommunications industry in order to advance professionally in the industry.</text></paragraph></subsection><subsection id="id4ECB3A5C95034336A76D520498EF8735"><enum>(f)</enum><header>Grant awards</header><paragraph id="id7041329B18A84CD28AD4D916835DB440"><enum>(1)</enum><header>Deadline</header><text>Not later than December 31, 2022, the Assistant Secretary shall award all covered grants.</text></paragraph><paragraph id="idCF52BDBC422A4457B9CB4341E07F2938"><enum>(2)</enum><header>Minimum allocation to certain entities</header><text>The Assistant Secretary shall award not less than—</text><subparagraph id="id0BDFEF6B49AA43D7A97AE24B0CDB178B"><enum>(A)</enum><text>30 percent of covered grant amounts to historically Black colleges or universities; and</text></subparagraph><subparagraph id="idEAA53508838C4EF9948B584D7855C9CB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>30 percent of covered grant amounts to Tribal Colleges or Universities.</text></subparagraph></paragraph><paragraph commented="no" id="id519CBE8B755A42AB9E38CAACC5A558D3"><enum>(3)</enum><header>Evaluation criteria</header><text>As part of the final rules issued under subsection (g), the Assistant Secretary shall develop criteria for evaluating applications for covered grants. </text></paragraph></subsection><subsection commented="no" id="id313AE554FED94515B93B8F38E61AA7F3"><enum>(g)</enum><header>Rules</header><text>Not later than 180 days after the date of enactment of this Act, after providing public notice and an opportunity to comment, the Assistant Secretary, in consultation with the Secretary of Labor and the Secretary of Education, shall issue final rules governing the Grant Program.</text></subsection><subsection id="idB92E0F4B18E04DA28093000E41511A36"><enum>(h)</enum><header>Term</header><text>The Assistant Secretary shall establish the term of a covered grant, which may not be less than 5 years.</text></subsection><subsection commented="no" id="id5D16D2FF92E042608649102A46A615B6"><enum>(i)</enum><header>Grantee reports</header><text>During the term of a covered grant received by an eligible entity, the eligible entity shall submit to the Assistant Secretary an annual report that, with respect to the preceding year—</text><paragraph commented="no" id="id3DE1D5647F62442EAF9FA2DBA5B6D6D4"><enum>(1)</enum><text>describes how the eligible entity used the covered grant amounts;</text></paragraph><paragraph commented="no" id="id21227E7725934E9CA8E905D1E61EC1F3"><enum>(2)</enum><text>describes the progress the eligible entity made in developing and executing the training program of the eligible entity;</text></paragraph><paragraph commented="no" id="idD22E51244AA14EF081B6BCB9C280A0B5"><enum>(3)</enum><text>describes the number of faculty and students participating in the training program of the eligible entity;</text></paragraph><paragraph id="id75819b23821d4f25b5631d8eb338b362"><enum>(4)</enum><text>describes the partnership with the industry partner of the eligible entity, including the commitments and in-kind contributions made by the industry partner; and</text></paragraph><paragraph id="id57fafd61f84542acb0f4206e3b7f56be"><enum>(5)</enum><text>includes data on internship, apprenticeship, and employment opportunities and placements.</text></paragraph></subsection><subsection commented="no" id="idF8737215459F4F44B88E944D8E03D233"><enum>(j)</enum><header>Oversight</header><paragraph commented="no" id="id931FCE0C7F6E42A0A1674EE6DB680ACA"><enum>(1)</enum><header>Audits</header><text>The Inspector General of the Department of Commerce shall audit the Grant Program in order to—</text><subparagraph commented="no" id="id76B668EE92DC4EFB995F45492A173F9C"><enum>(A)</enum><text>ensure that eligible entities use covered grant amounts in accordance with—</text><clause commented="no" id="idBD52349188424E4BAB8E44FD6B8E1C64"><enum>(i)</enum><text>the requirements of this section; and</text></clause><clause commented="no" id="idEAB2848F81EB4174B2B62F13E8A29AF7"><enum>(ii)</enum><text>the overall purpose of the Grant Program, as described in subsection (b); and</text></clause></subparagraph><subparagraph commented="no" id="idFC935DBC976D4006B4575A363BC69C17"><enum>(B)</enum><text>prevent waste, fraud, and abuse in the operation of the Grant Program.</text></subparagraph></paragraph><paragraph id="idfe90f74b7345474f9688a2a8b6315d71"><enum>(2)</enum><header>Revocation of funds</header><text>The Assistant Secretary shall revoke a grant awarded to an eligible entity that is not in compliance with the requirements of this section or the overall purpose of the Grant Program, as described in subsection (b).</text></paragraph></subsection><subsection commented="no" id="id09ACD3E98DAD47C5AE3D67AF410D93E6"><enum>(k)</enum><header>Annual report to Congress</header><text>Each year, until all covered grants have expired, the Assistant Secretary shall submit to Congress a report that—</text><paragraph commented="no" id="id656F4EF306A64A50BC19BDE8D35DD37B"><enum>(1)</enum><text>identifies each eligible entity that received a covered grant and the amount of the covered grant;</text></paragraph><paragraph commented="no" id="id2E38EC712EC74B6ABD8212C74CF7C4FE"><enum>(2)</enum><text>describes the progress each eligible entity described in paragraph (1) has made toward accomplishing the overall purpose of the Grant Program, as described in subsection (b);</text></paragraph><paragraph id="idd41255e72ce44e52bdb5a0586f4f0020"><enum>(3)</enum><text>summarizes the job placement status or apprenticeship opportunities of students who have participated in the training program of the eligible entity; and</text></paragraph><paragraph id="id2F27C9F089C84CA8A2E4ED91DE6F35CC"><enum>(4)</enum><text>includes the findings of any audits conducted by the Inspector General of the Department of Commerce under subsection (j)(1) that were not included in the previous report submitted under this subsection.</text></paragraph></subsection><subsection commented="no" id="id3949C41EA2624405B01725FB0984F227"><enum>(l)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Fund $100,000,000 for fiscal year 2021, to remain available until expended.</text></subsection></section></legis-body></bill>
