<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 993</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210325">March 25, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, and <cosponsor name-id="S389">Mr. Kennedy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit certain business concerns from receiving assistance from the Small Business Administration, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idC6F62A594722458680F41DCCCAFB928D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing SBA Assistance from Going to China Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA5EB984AED624363838C57B25E006C93"><enum>2.</enum><header>Prohibition on affiliation with the People's Republic of China</header><subsection id="idD3BEE47CB10045EF873B30447CC435A3"><enum>(a)</enum><header>In general</header><text>Section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE26ECDFD7294416087B5BBD8D261B79F"><paragraph id="id360C22A5275D4A36968947562536E80D"><enum>(10)</enum><header>Prohibition on affiliation with the People's Republic of China</header><text>For purposes of this Act, a small business concern may not—</text><subparagraph id="idE5E71DA78F4548558C9187C75AEF8F63"><enum>(A)</enum><text>be headquartered in the People's Republic of China; or</text></subparagraph><subparagraph id="id412A5C2AFA4E4618A436C4FC50F34736"><enum>(B)</enum><text>have more than 25 percent of the voting stock of the small business concern owned by affiliates that are citizens of the People's Republic of China.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idEE82BF4C3836420BB42758DB5BEE3FEA"><enum>(b)</enum><header>Regulations and guidance</header><text>The Administrator of the Small Business Administration shall amend the regulations and guidance of the Administration, including sections 120.100, 120.110, and 121.105 of title 13, Code of Federal Regulations, to carry out the amendment made by this Act.</text></subsection></section></legis-body></bill>
