which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide competitive grants for the promotion of Japanese American confinement education as a means to understand the importance of democratic principles, use and abuse of power, and to raise awareness about the importance of cultural tolerance toward Japanese Americans, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Japanese American Confinement Education Act</short-title></quote>.</text></section><section id="id72CDEB875F764118A6020B8BD229435C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4C13101EF7B9468187EF3828769B39EC"><enum>(1)</enum><header>Japanese American museum</header><text>The term <term>Japanese American museum</term> means a museum located in the United States established to promote the understanding and appreciation of the ethnic and cultural diversity of the United States by illustrating the Japanese American experience throughout the history of the United States.</text></paragraph><paragraph id="id5A62A5B90C634B089E0C7411A0FD8BE2"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="idC93B613234404D068BAFA76E71B65734"><enum>3.</enum><header>Competitive grants for Japanese American confinement education</header><subsection id="id795D06523FDD463F87BD739F37D152BF"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a program to award competitive grants to a Japanese American museum to educate individuals in the United States on the historical importance of Japanese American confinement during World War II so that present and future generations may learn from Japanese American confinement and the commitment of the United States to equal justice under the law.</text></subsection><subsection id="id5977BCB31230431FB1DCC50E01A8D203"><enum>(b)</enum><header>Use of funds</header><text>A grant awarded under subsection (a)—</text><paragraph id="id69639588A02B48D28F2851026583F4B0"><enum>(1)</enum><text>shall be used—</text><subparagraph id="id1DA28064B9604BD1BD9CD174169B31D6"><enum>(A)</enum><text>for the research and education relating to the Japanese American confinement in World War II; and</text></subparagraph><subparagraph id="idF6DA6056E8D049FCADD478AEE3CA6F89"><enum>(B)</enum><text>for the disbursement of accurate, relevant, and accessible resources to promote understanding about how and why the Japanese American confinement in World War II happened, which— </text><clause id="id7575056D4BA141FEA8F0F452642DA5BD"><enum>(i)</enum><text>shall include digital resources; and </text></clause><clause id="id1F11CFDD37B84D43864D4AEF60E8FC03"><enum>(ii)</enum><text>may include other types of resources, including print resources and exhibitions; and</text></clause></subparagraph></paragraph><paragraph id="id45203D5D782A4F169DDC863C2B320FD2"><enum>(2)</enum><text>shall not be used at a Japanese American museum that does not provide—</text><subparagraph id="idB5D39E75B95B4B3D9B3DA0B353069664"><enum>(A)</enum><text>free admission to individuals who were placed within a Japanese American confinement camp; and</text></subparagraph><subparagraph id="idD1B29E1024B14870947EFE9B103A99EE"><enum>(B)</enum><text>dedicated free admission hours for the general public not less than once per month.</text></subparagraph></paragraph></subsection><subsection id="id8447ED71A2FE49699AC22E788E6CFB70"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, a Japanese American museum shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="id6404C404F2F146FABAE83499D5017D27"><enum>(d)</enum><header>Deadline for award</header><text>Not later than 120 days after the date on which the Secretary receives an application from a Japanese American museum for a grant that is approved by the Secretary under this section, the Secretary shall award a grant to the Japanese American museum.</text></subsection><subsection id="id1026A8CC0BC247E6B6676D0EBC0DADFD"><enum>(e)</enum><header>Priority considerations</header><text>In awarding a grant under this section, the Secretary shall give priority using the following considerations:</text><paragraph id="id9FDEA25B1F57448880548C118ED3823D"><enum>(1)</enum><text>The needs of the Japanese American museum.</text></paragraph><paragraph id="id02B00393B8004FF1909D7AAA645EA5B7"><enum>(2)</enum><text>The proximity of the project for which the grant funds will be used to cities with populations that include not less than 100,000 Japanese Americans, as certified by the most recent census.</text></paragraph><paragraph id="idAA0B0B6C2E40438DA435BA5DF2F9BAF0"><enum>(3)</enum><text>The ability and commitment of the Japanese American museum to use grant funds—</text><subparagraph id="id7241D483098945CB9B2C32566DD9669C"><enum>(A)</enum><text>to educate future generations of individuals in the United States; and</text></subparagraph><subparagraph id="idDA0BA45DA01B4AA5B2285662C20271F2"><enum>(B)</enum><text>to locate Japanese American confinement survivors.</text></subparagraph></paragraph><paragraph id="id81C342F1895A4888A0F1B4506A31779B"><enum>(4)</enum><text>The existing relationship the Japanese American museum has with Japanese American cultural and advocacy organizations.</text></paragraph></subsection><subsection id="id5A24279498B14FE3827961F5816FCFEC"><enum>(f)</enum><header>Report</header><text>Not later than 90 days after the end of each fiscal year for which a Japanese American museum obligates or expends amounts made available under a grant under this section, the Japanese American museum shall submit to the Secretary and the appropriate committees of Congress a report that—</text><paragraph id="idACB909F9ED6440E2B1BE7AAD0E6A17D0"><enum>(1)</enum><text>specifies the amount of grant funds obligated or expended for the preceding fiscal year;</text></paragraph><paragraph id="id08A5398AC94C4A42A73CE5792273D443"><enum>(2)</enum><text>specifies any purposes for which the funds were obligated or expended; and</text></paragraph><paragraph id="idEA73EB743D7D4F8DA289F08BCFC5BD55"><enum>(3)</enum><text>includes any other information that the Secretary may require to more effectively administer the grant program.</text></paragraph></subsection><subsection id="id5D96B55F93F6431DAC5EDB16BCF4B902"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this Act $2,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><section id="id2C82B211547744A4B55E803319200491"><enum>4.</enum><header>Preservation of historic confinement sites</header><subsection id="idA70D81A6F73048118A44E1B7042691ED"><enum>(a)</enum><header>Sunset</header><text>Section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/109/441">Public Law 109–441</external-xref> (120 Stat. 3288) is amended by striking subsection (e).</text></subsection><subsection id="id4BEEC7B5AAB3435DADD4C52C8BC0ABF1"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 4 of <external-xref legal-doc="public-law" parsable-cite="pl/109/441">Public Law 109–441</external-xref> (120 Stat. 3290) is amended, in the first sentence—</text><paragraph id="idBD6B9F6C42E6406482CB31CF78A62055"><enum>(1)</enum><text>by striking <quote>are authorized</quote> and inserting <quote>is authorized</quote>; and</text></paragraph><paragraph id="id145F77FDC6024B70B6F53D1246E9437C"><enum>(2)</enum><text>by inserting <quote>for fiscal year 2022 and each fiscal year thereafter</quote> after <quote>this Act</quote>.</text></paragraph></subsection></section></legis-body></bill>
