which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restrict funds to local educational agencies that have obligated previously appropriated funds and reopen schools for in-person learning.</official-title></form><legis-body><section id="id596B92250CD641F7A49ACD529330BAB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reopen for Kids Act</short-title></quote>.</text></section><section id="idD3950C98BD664ABF9FA53E149A430D5F"><enum>2.</enum><header>Funding for reopening</header><subsection id="id5605323a70e14fe0b16937b604c2ef55"><enum>(a)</enum><header>No new funds until available funds are obligated</header><text>Notwithstanding any other provision of law, no funds appropriated under part 1 of subtitle A of title II of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) may be used to provide assistance to a local educational agency to prevent, prepare for, or respond to the coronavirus—</text><paragraph id="id8B945A90B377407F875B4E0F9E943D54"><enum>(1)</enum><text>while funds awarded to such local educational agency under the Elementary and Secondary School Emergency Relief Fund or Governor’s Emergency Education Relief Fund under title VIII of division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) or title III of the Coronavirus Response and Relief Supplemental Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) remain unobligated; and</text></paragraph><paragraph id="id829C27574C304926AB288061089CA0CE"><enum>(2)</enum><text>unless the local educational agency—</text><subparagraph id="id828FD6E0092E449A8A1CD2900190D2BA"><enum>(A)</enum><text>submits a plan to the State educational agency to provide full-day, in-person learning 5 days a week for all students medically able to participate at all public schools served by the local educational agency; and </text></subparagraph><subparagraph id="id46ce4470cda04528883c381ea0c581f3"><enum>(B)</enum><text>fully implements such plan, except as provided in subsection (b), not later than 14 days after the date the State educational agency approves such plan. </text></subparagraph></paragraph></subsection><subsection id="idc62bb4819c2643a09af61d183ccdfc4c"><enum>(b)</enum><header>Amendment to reopening plan</header><paragraph id="id1D9C807065D74F36956060EAD59FBEDC"><enum>(1)</enum><header>In general</header><text>If a local educational agency determines there is a significant rise in COVID cases in the area served by the local educational agency after the plan described in subsection (a)(2)(A) has been implemented, the local educational agency may amend the plan. </text></paragraph><paragraph id="id8607327DED804D49A455CEB4D426D813"><enum>(2)</enum><header>Amendment</header><text>An amendment under paragraph (1)—</text><subparagraph id="idD02EE8BDB4B74FFC8A952C367581D045"><enum>(A)</enum><text>shall be approved by the Governor, in consultation with the local school board; </text></subparagraph><subparagraph id="idF0A55A3647864A259CC500145BECB975"><enum>(B)</enum><text>may include a short-term reversion to part-time or full-time virtual learning, if warranted by a significant rise in COVID cases in the area served by the local educational agency; and </text></subparagraph><subparagraph id="id43E68CE21E3E4BE5AEFBC9B90EB8EBD3"><enum>(C)</enum><text>shall specify a date by which, or conditions under which, the local educational agency will return to providing in-person learning as described in subsection (a)(2)(A).</text></subparagraph></paragraph></subsection><subsection id="id2cbc2a29177347b490b06ef23ff3a018"><enum>(c)</enum><header>Return of funds</header><paragraph id="idCA065C056317491E98DE175D76BD99B0"><enum>(1)</enum><header>In general</header><text>A local educational agency that, as determined by the State educational agency, fails to implement the plan described in subsection (a)(2)(B) not later than 14 days after the date the State educational agency approves such plan, shall return to the State—</text><subparagraph id="id2F7513C8F50F4DA58E0BA7B55365609A"><enum>(A)</enum><text>75 percent of the funds received by the end of the first 7 days the implementation of the plan is delayed beyond the 14 days; and </text></subparagraph><subparagraph id="id538FCB25415C4AEF86D2E671F6DE4F42"><enum>(B)</enum><text>the remaining 25 percent of the funds received by the end of the second 7 days the implementation of the plan is delayed beyond the 14 days.</text></subparagraph></paragraph><paragraph id="idF7B294B66E87442A84476D0C309AA4FC"><enum>(2)</enum><header>Coming into compliance</header><text>Notwithstanding paragraph (1), a local educational agency that implements the plan within 14 days of being in noncompliance shall be eligible to receive the full amount under part 1 of subtitle A of title II of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) for which the agency is eligible. </text></paragraph><paragraph id="id55D70E32FEC941D1922370622BA3F6EF"><enum>(3)</enum><header>Funds to be returned to treasury</header><text>A State shall return all funds returned to the State under paragraph (1) to the general fund of the Department of the Treasury. </text></paragraph></subsection></section></legis-body></bill>
