which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide for coverage of dental services under the Medicare program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Dental Benefit Act of 2021</short-title></quote>.</text></section><section commented="no" id="H206DF0FF04BD41C0B239CB1DD20D338E"><enum>2.</enum><header>Coverage of dental services under the Medicare program</header><subsection commented="no" id="H5852C816C05844229343CE671BFE680A"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph commented="no" id="H5CA6FA92484B4C30B14F21F6875EE3E7"><enum>(1)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" id="H6158C4991D10461C8E9674519DFF19CC"><enum>(2)</enum><text>in subparagraph (HH), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" id="HF7EE76A807EC4BF89739E8016F92BB20"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H806C81F505314584B4A03F312DC1A2AC"><subparagraph commented="no" id="H9F453725320441D0B2943B639D5E4CFE" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">dental and oral health services (as defined in subsection (lll));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H48B28CE45D3940ECBEF8DF242ECEBDA7"><enum>(b)</enum><header>Dental and oral health services defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="other" id="HE5DA87AB34C042E5B3BF597C10A76DA5" other-style="archaic"><subsection commented="no" id="H8CCDCD8EFCD344CC85D30337904A6A22"><enum>(lll)</enum><header>Dental and oral Health Services</header><text>The term <term>dental and oral health services</term> means services (as defined by the Secretary) that are necessary to prevent disease and promote oral health, restore oral structures to health and function, and treat emergency conditions, including—</text><paragraph commented="no" id="idFAF03341069F49188C7B08874005D950"><enum>(1)</enum><text>routine diagnostic and preventive care such as dental cleanings, exams, and x-rays;</text></paragraph><paragraph commented="no" id="idBAB46684458F4390BD0260F8F551D39E"><enum>(2)</enum><text>basic dental services such as fillings and extractions;</text></paragraph><paragraph commented="no" id="idE87EB44AC45A4D6A9E2FDC2112CDA9FE"><enum>(3)</enum><text>major dental services such as root canals, crowns, and dentures;</text></paragraph><paragraph commented="no" id="id89B0C80D7ACA4F7899B8118CAC7A5EAF"><enum>(4)</enum><text>emergency dental care; and</text></paragraph><paragraph commented="no" id="id41CE7969F7704294A109AC3A6596CB81"><enum>(5)</enum><text>other necessary services related to dental and oral health (as defined by the Secretary).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id14A8B12B35DF40B0910FDB64B82FAC47"><enum>(c)</enum><header>Coverage of routine diagnostic and preventive care as a preventive service</header><text>Section 1861(ddd)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ddd)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD1591DF9398420CB8727B8DB6DA9BAA"><subparagraph commented="no" id="id26494574955D441B94E9A5F80F05B478" indent="up1"><enum>(D)</enum><text>Dental and oral health services described in paragraph (1) of subsection (lll), relating to routine diagnostic and preventive care.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCA5D3A68B35A4030A212CB55F8D9D6FD"><enum>(d)</enum><header>Payment; coinsurance; and limitations</header><paragraph id="H655B5B2C433C4EC7B2A08268CBAD7758"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="id12BC1496DE724926899125F52721E68F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking “and” before “(DD)”; and</text></subparagraph><subparagraph id="idE384DD43D8BD413695EDE4063E0716C0"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before the semicolon at the end the following: “and (EE) with respect to dental and oral health services (as defined in section 1861(lll), other than those services described in paragraph (1) of such section), the amount paid shall be the payment amount specified under section 1834(z).”.</text></subparagraph></paragraph><paragraph id="HF1DEEC506A3A4D16915B1B92016B757B"><enum>(2)</enum><header>Payment and limits specified</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0EBB835939D34CB9B05EF8B1ABF885E4"><subsection id="H2B259A5EA3BB499AA4D750A712004367"><enum>(z)</enum><header>Payment and limits for dental and oral health services</header><paragraph id="H025BC44CE6324338A9BC55B77970E321"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dental and oral health services (as defined in section 1861(lll), other than those services described in paragraph (1) of such section) shall be, subject to paragraph (3), the applicable percentage (specified in paragraph (2)) of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848.</text></paragraph><paragraph id="HACA269ACEBF3440EB92ED7C311C61C3D"><enum>(2)</enum><header>Applicable percentage</header><subparagraph id="idEF18E2CAF3424E21BA1844B8A82F3C85"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), subject to subparagraph (B), the applicable percentage specified in this paragraph is—</text><clause id="H8E4C1FDCB50B446D8F5A4E24D8DE6EFB"><enum>(i)</enum><text>for the first year beginning at least 6 months after the date of the enactment of this subsection, 0 percent;</text></clause><clause id="HECDCB5CB981D48CF8EC835890744F8DB"><enum>(ii)</enum><text>for the year following the year specified in subparagraph (A) and each subsequent year through the seventh year following the year specified in subparagraph (A), the applicable percent specified in this paragraph for the previous year increased by 10 percentage points; and</text></clause><clause id="H23DD0DAF6A0C42C1AF490D9339DCD9B4"><enum>(iii)</enum><text>for the eighth year following the year specified in subparagraph (A) and each subsequent year, 80 percent.</text></clause></subparagraph><subparagraph id="idECF46DCD948F41259B47D866F4A1A95F"><enum>(B)</enum><header>Special rule for certain low-income individuals</header><text>For purposes of paragraph (1), with respect to dental and oral health services described in such paragraph that are furnished to an individual who is a subsidy eligible individual (as defined in section 1860D–14(a)(3)), or who would be a subsidy eligible individual if the individual were enrolled in a prescription drug plan or an MA–PD plan under part D, for the first year beginning at least 6 months after the date of the enactment of this subsection and each subsequent year, the applicable percent specified in this paragraph is 80 percent.</text></subparagraph></paragraph><paragraph id="H604F5843D5DF40BB87AB04356715883F"><enum>(3)</enum><header>Limitations and Secretarial authority</header><subparagraph id="H5D26F186848E4DF990D17DB3FCBD3576"><enum>(A)</enum><header>Frequency</header><text>With respect to dental and oral health services that are—</text><clause id="HD5049645314243B1BB7361EDE099487E"><enum>(i)</enum><text display-inline="yes-display-inline">routine dental cleanings, payment may be made under this part for only two such cleanings during a 12-month period; and</text></clause><clause id="H86AC8250955D41BA84D59E118A53116A"><enum>(ii)</enum><text>routine exams, payment may be made under this part for only two such exams during a 12-month period.</text></clause></subparagraph><subparagraph id="H612474C3DC294790859C944649C93FFE"><enum>(B)</enum><header>Secretarial authority</header><clause id="HC90E0D13C18B49CCB2D4DE369DC7A24A"><enum>(i)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dental and oral services are covered under this part, including through application of a prior authorization requirement.</text></clause><clause commented="no" display-inline="no-display-inline" id="H05108147499440289809CCDF4890D894"><enum>(ii)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dental and oral health services to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></clause><clause id="id7A2E020467A44AB296C17DE039B3E222" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Authority to waive frequency limitations</header><text display-inline="yes-display-inline">The Secretary may waive any frequency limitation or other limitation as described in this paragraph for an individual (or category of individuals) as determined appropriate by the Secretary.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H77EB1687A1AC43DDA10522C5022FCB76"><enum>(e)</enum><header>Payment under physician fee schedule</header><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by striking <quote>risk assessment) ,</quote> and inserting <quote>risk assessment), (2)(II),</quote>.</text></subsection><subsection commented="no" id="HDFF104D2C44E4662BF355723B903F056"><enum>(f)</enum><header>Dental prostheses</header><paragraph commented="no" id="idD3449821295D41EEB8912181442A445A"><enum>(1)</enum><header>In general</header><text>Section 1861(s)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended—</text><subparagraph commented="no" id="HD0DE122FDC79436390EE1A704D8048F5"><enum>(A)</enum><text>by striking <quote>(other than dental)</quote> and inserting <quote>(including dental)</quote>; and</text></subparagraph><subparagraph commented="no" id="HFCC563886D1643A4833801C154805540"><enum>(B)</enum><text>by striking <quote>internal body</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDCF744B3DB0D40A9ADB6E6A62CACDE31"><enum>(2)</enum><header>Special payment rules</header><text>Section 1834(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2C5BB45A19794B2E94DC51ADA67072AE"><paragraph id="H09CD7A2D201E4D19A799B8D59F5BFDBA"><enum>(23)</enum><header>Payment and limits for dental prostheses</header><subparagraph id="H3526217868594EFB8E570D6B6A51EB85"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dental prostheses shall be, subject to subparagraph (C), the applicable percent (specified in subparagraph (B)) of the amount otherwise payable for such dental prostheses under this section.</text></subparagraph><subparagraph id="H26E3496BB9494CA6BAE9C62F150D8ED9"><enum>(B)</enum><header>Applicable percent</header><clause id="id860204091C054451ACFD59805838BD7D"><enum>(i)</enum><header>In general</header><text>For purposes of subparagraph (A), subject to clause (ii), the applicable percent specified in this subparagraph is—</text><subclause id="H07A91A8E3EC04BECA5AF0DB766914A0F"><enum>(I)</enum><text>for the first year beginning at least 6 months after the date of the enactment of this paragraph, 0 percent;</text></subclause><subclause id="H7173E2DF56194173BA71F1678D8E0031"><enum>(II)</enum><text>for the year following the year specified in clause (i) and each subsequent year through the seventh year following the year specified in clause (i), the applicable percent specified in this subparagraph for the previous year increased by 10 percentage points; and</text></subclause><subclause id="HAE3143A30D9E436A95DA24CA1110C690"><enum>(III)</enum><text>for the eighth year following the year specified in clause (i) and each subsequent year, 80 percent.</text></subclause></clause><clause id="id9b082fa50c93481a9799b12f87b9e3bf" commented="no"><enum>(ii)</enum><header>Special rule for certain low-income individuals</header><text>For purposes of subparagraph (A), with respect to dental prostheses furnished to an individual who is a subsidy eligible individual (as defined in section 1860D–14(a)(3)), or who would be a subsidy eligible individual if the individual were enrolled in a prescription drug plan or an MA–PD plan under part D, for the first year beginning at least 6 months after the date of the enactment of this paragraph and each subsequent year, the applicable percent specified in this subparagraph is 80 percent.</text></clause></subparagraph><subparagraph id="HAE7417517E2244E591C00881B2C988DF"><enum>(C)</enum><header>Limitations and Secretarial authority</header><clause id="HE5BA8DEF6D934E1789E228360FB8D903"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Payment may be made under this part for an individual for—</text><subclause id="H60EC446B03D4410CAF6325EBAD39796B"><enum>(I)</enum><text display-inline="yes-display-inline">not more than one full upper and one full lower dental prostheses once every five years; and</text></subclause><subclause id="H7294272D0D6F4835A066F4A76DC2D799"><enum>(II)</enum><text display-inline="yes-display-inline">not more than one partial upper dental prostheses and one partial lower dental prostheses once every five years.</text></subclause></clause><clause id="H11891D8ACE194ACEB1F0009793588858"><enum>(ii)</enum><header>Secretarial authority</header><subclause id="HC26C69254550408E98F0ABF8AE263EF3"><enum>(I)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dental prostheses are covered under this part, including through application of a prior authorization requirement.</text></subclause><subclause display-inline="no-display-inline" id="H7EF8CC1200C2462F9C4A48627A381860"><enum>(II)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dental prostheses to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></subclause><subclause display-inline="no-display-inline" id="idBEEDC8B0640C447BA5A27745FCB5F64F" commented="no"><enum>(III)</enum><header>Authority to waive frequency limitations</header><text display-inline="yes-display-inline">The Secretary may waive any frequency limitation or other limitation as described in this subparagraph for an individual (or category of individuals) as determined appropriate by the Secretary</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H6A9A932EACCF42B2A3AC0676CA68F310"><enum>(g)</enum><header>Repeal of ground for exclusion</header><text>Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by striking paragraph (12).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HAB665DA95E174C0CB52CD923AD6DDA7D"><enum>(h)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2022.</text></subsection></section><section id="id0BAE97ABA91044C988B31FF7983015A0"><enum>3.</enum><header>Increased FMAP for additional expenditures for medicare cost-sharing for dental and oral health services</header><text display-inline="no-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="HF00EE1DA10EA4798A7D2E03CEC678B15"><enum>(1)</enum><text>in subsection (b), by striking <quote>and (ff)</quote> and inserting <quote>(ff), and (ii)</quote>; and</text></paragraph><paragraph id="H7490EA0268754E20B94FCACA147E5BEB"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF6EA92B534BF4A11BECFB0E648B14ED2"><subsection id="H27F45226765D4625995D6C402A2458F0"><enum>(ii)</enum><header>Increased FMAP for additional expenditures for medicare cost-Sharing for dental and oral health services</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), with respect to the portion of the amounts expended by a State for medical assistance for medicare cost-sharing (as defined in subsection (p)(3)) for qualified medicare beneficiaries described in subsection (p)(1) that is attributable to the coverage under part B of title XVIII of dental and oral health services (as defined in section 1861(lll)), as determined by the Secretary, the Federal medical assistance percentage for a State that is one of the 50 States or the District of Columbia shall be equal to 100 percent.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5B8A9A4A618D4AF8AD1AC6F2995D2669"><enum>4.</enum><header>Preventive Services Taskforce</header><subsection id="id1107098FD4A54E6CBEADC8E0F81093EE"><enum>(a)</enum><header>In general</header><text>Section 915(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/299b-4">42 U.S.C. 299b–4(a)(1)</external-xref>) is amended, in the first sentence, by inserting <quote>, including at least 1 oral health professional</quote> after <quote>expertise</quote>.</text></subsection><subsection id="idBC250D1A316B4EC7B3C034B517012F7C"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect January 1, 2022. </text></subsection></section></legis-body></bill>
