which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the adjustment or modification by the Secretary of Agriculture of loans for critical rural utility service providers, and for other purposes.</official-title></form><legis-body style="OLC"><section section-type="section-one" id="id983A37709633442985BEEDBD7BEDAC45"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flexible Financing for Rural America Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id33C4C0C63FE84E18ACE7A31C06F27C5F"><enum>2.</enum><header>Loan adjustments for critical rural utility service providers</header><subsection id="H8CA716821DB44EF6BB937145203C3FE1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the borrower of a qualified loan described in subsection (b) may submit to the Secretary of Agriculture (referred to in this section as the <term>Secretary</term>) a request to adjust the interest rate or modify any other term of the qualified loan, which shall include a report summarizing how the adjustment or modification will assist the borrower in providing critical utility services to a rural community.</text></subsection><subsection id="HE983B326208D489BA47216B8491ABE24"><enum>(b)</enum><header>Qualified loan described</header><text>A qualified loan referred to in subsection (a) is a loan made or guaranteed on or before the date of enactment of this Act under—</text><paragraph display-inline="no-display-inline" id="HCB18D26E02194E8DB450CEEF2CCE2157"><enum>(1)</enum><text>section 4, 201, 305, 306, or 601 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/904">7 U.S.C. 904</external-xref>, 922, 935, 936, 950bb); or</text></paragraph><paragraph id="H0F6BE2E10A894969AA3AF6E3B58EEB58"><enum>(2)</enum><text>the program carried out under the matter under the heading <quote><header-in-text style="appropriations" level="appropriations-small">Distance Learning, Telemedicine, and Broadband Program</header-in-text></quote> in title I of division A of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123 Stat. 118) (commonly known as the <quote>Broadband Initiatives Program</quote>).</text></paragraph></subsection><subsection id="H8D7D2A240F944A49B0AFE6337AAD5CEB"><enum>(c)</enum><header>Adjustment of interest rate; modification of loan terms</header><paragraph id="idE8D59395B71F40EB863CF3A1814FD71B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On receipt by the Secretary of a request made under subsection (a) with respect to a loan, the Secretary, or the Secretary of the Treasury in the case of a loan owned by the Federal Financing Bank—</text><subparagraph id="H5B29B6AA0D4E4CCFB73923F94EC521BC"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a request for an interest rate adjustment, shall adjust the interest rate on the loan to the cost of funds to the Department of the Treasury for obligations of comparable maturity to the term remaining on the outstanding balance of the loan or other such higher rate as the borrower may request; and</text></subparagraph><subparagraph id="H5166CD17A32B4EE2A3B556B77EEE556B"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a request for a modification to a loan term other than the adjustment described in subparagraph (A), may use the authorities provided in sections 2, 201, 306C, and 703 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/902">7 U.S.C. 902</external-xref>, 922, 936c, 950cc–2) and section 331(b)(4) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1981">7 U.S.C. 1981(b)(4)</external-xref>) to make such other modifications to the loan terms that the Secretary, in consultation with the Secretary of the Treasury in the case of a loan owned by the Federal Financing Bank, determines are necessary—</text><clause id="idADAFB71D2CD047A68F629685B354A6F0"><enum>(i)</enum><text display-inline="yes-display-inline">to address changes in the financial position of the borrower due to the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19 (or any renewal of that declaration); and </text></clause><clause id="idC6A139FD0BD648D8BCFD58A8959ED015"><enum>(ii)</enum><text display-inline="yes-display-inline">to promote the financial sustainability of the borrower.</text></clause></subparagraph></paragraph><paragraph id="idA883573B8E1B4EBA87A4A584BABB8E56"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">An adjustment or modification under subparagraph (A) or (B), respectively, of paragraph (1) shall apply—</text><subparagraph id="id489B0017D8C24524B8118D958B868D34"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the first calendar day after the payment date immediately following the request; but</text></subparagraph><subparagraph id="id7FF8A7BDDE4A42EEAD2A45C978161E2A"><enum>(B)</enum><text>not earlier than 30 days after the date of the request.</text></subparagraph></paragraph></subsection><subsection id="HF37489DADBBF418588FE7849AD476DB0"><enum>(d)</enum><header>No fees or penalties</header><text>In carrying out this section, the Secretary, or the Secretary of the Treasury in the case of a loan owned by the Federal Financing Bank, shall not impose or collect any fee from, or impose any penalty on, a borrower.</text></subsection><subsection id="H33695A01C7E048EAA7DE811468F46EA8"><enum>(e)</enum><header>Notice</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary, in coordination with the Secretary of the Treasury, shall publish in the Federal Register a notice of the benefits available to borrowers under this section. </text></subsection><subsection id="H9F93C84B39C443CE91E762614E8C6365"><enum>(f)</enum><header>Appropriations; reimbursements</header><paragraph id="HBCD7A4D7C5944D18BBF4D2F7A03C7A9F"><enum>(1)</enum><header>In general</header><text>Out of any amounts in the Treasury not otherwise appropriated—</text><subparagraph id="id6EB999BA651046DF9378B9302ABF5E41"><enum>(A)</enum><text>there are appropriated to the Secretary such sums as are necessary, to remain available until December 31, 2021, for the cost of interest rate adjustments under subsection (c)(1)(A); </text></subparagraph><subparagraph id="idD73194032A4242128F8258A5CE129B98"><enum>(B)</enum><text>there is appropriated to the Secretary $300,000,000, to remain available until December 31, 2021, for the cost of modifications under subsection (c)(1)(B); and</text></subparagraph><subparagraph id="id6bdf276cd45f45fead964d6109420e00"><enum>(C)</enum><text>there are appropriated to the Federal Financing Bank such sums as are necessary, to remain available until December 31, 2023, for the liquidation of residual intragovernmental amounts owed by the Federal Financing Bank in connection with qualified loans described in subsection (b) modified after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="idF184B9F94D584434B786252F33422752"><enum>(2)</enum><header>Calculation</header><text>For purposes of paragraph (1)(C), the calculation of the sums necessary for the liquidation of residual intragovernmental amounts owed shall take into account all amounts otherwise transferred to the Federal Financing Bank for the qualified loans described in that paragraph.</text></paragraph><paragraph id="id9ddc5514eb1041bc91ff082ebf659794"><enum>(3)</enum><header>Emergency designation</header><subparagraph id="id62e787cb49364b76ba7546ce08de6698"><enum>(A)</enum><header>In general</header><text>The amounts provided by this Act are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subparagraph><subparagraph id="idea7f6c95982040bcaef8f1b85b3ef8b4"><enum>(B)</enum><header>Designation in senate</header><text>In the Senate, this Act is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
