which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reduce the backlog of foreign nationals seeking employment-based visas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Backlog Elimination, Legal Immigration, and Employment Visa Enhancement Act</short-title></quote> or the <quote><short-title>BELIEVE Act</short-title></quote>.</text></section><section id="id84A56946B0BE4707AC8CD870EA9E8D79"><enum>2.</enum><header>Allocation of employment-based visas</header><subsection id="idD8168D6556604F54B6D8A6D447A9F294"><enum>(a)</enum><header>Worldwide level</header><text display-inline="yes-display-inline">Section 201(d)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)(1)(A)</external-xref>) is amended by striking <quote>140,000,</quote> and inserting <quote>270,000;</quote>.</text></subsection><subsection id="id08396b26de9446e3b552a0cb97720920"><enum>(b)</enum><header>Elimination of per-Country limitation for employment-Based immigrants</header><text>Section 202(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(a)(2)</external-xref>) is amended—</text><paragraph id="idEF33835564B241459FD8CFD0AE084162"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">and employment-based</header-in-text></quote>;</text></paragraph><paragraph id="idE12DB243E63C400B9C347AAF760C3F0F"><enum>(2)</enum><text>by striking <quote>subsections (a) and (b) of section 203</quote> and inserting <quote>section 203(a)</quote>; and</text></paragraph><paragraph id="id4CE98B4E0F4049AD82403BF9C0467526"><enum>(3)</enum><text>by striking <quote>such subsections</quote> and inserting <quote>such subsection</quote>.</text></paragraph></subsection><subsection id="id3785F196779540269884A34367DB6D8C"><enum>(c)</enum><header>Preference allocations for employment-Based immigrants</header><text>Section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) is amended—</text><paragraph id="id6D8F9A9A8D5A42E5B9BCC9F480A974AA"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>28.6 percent</quote> and inserting <quote>29.63 percent</quote>;</text></paragraph><paragraph id="idD5FE94E37A944870B8313F34C9A67120"><enum>(2)</enum><text>in paragraph (2)(A), by striking <quote>28.6 percent</quote> and inserting <quote>29.63 percent</quote>;</text></paragraph><paragraph id="id93152E7D55184666B2019C4F225A475C"><enum>(3)</enum><text>in paragraph (3)(A), in the matter preceding clause (i), by striking <quote>28.6 percent</quote> and inserting <quote>29.63 percent</quote>;</text></paragraph><paragraph id="idCD471E45ACFA44CFBA11A648FA4F1029"><enum>(4)</enum><text>in paragraph (4), by striking <quote>7.1 percent</quote> and inserting <quote>3.7 percent</quote>; and</text></paragraph><paragraph id="id7F112D5509AD4DBEADA64F1356121C08"><enum>(5)</enum><text>in paragraph (5)(A), in the matter preceding clause (i), by striking <quote>7.1 percent</quote> and inserting <quote>7.41 percent</quote>.</text></paragraph></subsection><subsection id="id427909445A41482BB27213C3BD87D192"><enum>(d)</enum><header>Treatment of family members</header><text display-inline="yes-display-inline">Section 203(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>) is amended by adding at the end the following: <quote>Visas issued to a spouse or child of an immigrant described in subsection (b) shall not be counted against the worldwide level of such visas set forth in section 201(d)(1) or the per country level set forth in section 202(a)(2).</quote>.</text></subsection></section><section id="id5e10e9d624d2432fa81100d813837b80"><enum>3.</enum><header>Health care workers</header><subsection id="id28944E5F3A024B068C6A7DDFC835EE62"><enum>(a)</enum><header>Exemption from numerical limitations</header><text display-inline="yes-display-inline">Section 201(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6340DE6671714750AAFACD34E090E9B8"><subparagraph id="idF838E4B93E184E5EA8107663C2207767" indent="up1"><enum>(F)</enum><text>Aliens who are members of an occupation that the Secretary of Labor has designated under Group I of Schedule A pursuant to section 656.15 of title 20, Code of Federal Regulations, and are coming to the United States to work in such occupation, and the spouses and children (as defined in subparagraph (A), (B), (C), (D), or (E) of section 101(b)(1)) of such aliens. Aliens described in this subparagraph may apply for an immigrant visa.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0E09745AB738404FAC2D499A4F956D50"><enum>(b)</enum><header>Petition</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended—</text><paragraph id="id0F759AA8FE0A48E88047489AF7BDA706"><enum>(1)</enum><text>by shifting subparagraph (L) 4 ems to the left; and</text></paragraph><paragraph id="id03DFFB7F79804660A3677412B97ADF18"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id01F386D6146B4CE893D62CB7FA19DF78"><subparagraph id="id984CECDA82124A83AD31910A2FD55742" indent="up2"><enum>(M)</enum><text>Any employer desiring and intending to employ within the United States an alien entitled to classification under section 201(b)(1)(F) may file a petition with the Secretary of Homeland Security for such classification on behalf of such alien.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id461e0d2da64548ac9e9855d9c05e03b6"><enum>4.</enum><header>Dependents of nonimmigrants</header><subsection id="id5c59b4ad4e3f4363a45572d530ae2a6b"><enum>(a)</enum><header>Exemption from numerical limitations for certain college graduates</header><text>Section 201(b)(1) of the Immigration and Nationality Act, as amended by section 3(a), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1D3C7AC5E24B4349A875EBAECE1E9E1A"><subparagraph id="id126975849123424D9E6C724A9F667CF3" indent="up1"><enum>(G)</enum><text>Aliens who—</text><clause id="id70332666BB864DEAA2FC82506B6B88A1"><enum>(i)</enum><text>are not inadmissible under section 212(a) or deportable under section 237(a);</text></clause><clause id="id7AF673B172B847AC8AB78D53452BE4A4"><enum>(ii)</enum><text>have lived in the United States an aggregate period of not less than 10 years;</text></clause><clause id="id6E10705692C34B13A6175D583568C441"><enum>(iii)</enum><text>were admitted as a dependent of a nonimmigrant under subparagraph (E), (H), or (L) of section 101(a)(15); and</text></clause><clause id="idDF2755169BB5411BA7F71EBDFF87DFA2"><enum>(iv)</enum><text>graduated from an institution of higher education (as defined in section 102(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)</external-xref>)) in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAD7EC6A19C8341C6BD244A9D3476486A"><enum>(b)</enum><header>Petition</header><text>Section 204(a)(1) of the Immigration and Nationality Act, as amended by section 3(b), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCD728DCCAB3C4C56849776C4C4E48963"><subparagraph commented="no" display-inline="no-display-inline" id="id655E87434D1548D4B905F4184D22DC69" indent="up2"><enum>(N)</enum><text>Any employer desiring and intending to employ within the United States an alien entitled to classification under section 201(b)(1)(G) may file a petition with the Secretary of Homeland Security for such classification on behalf of such alien.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8df7791ddde34384a1eff9a8421ff068"><enum>(c)</enum><header>Authorization of employment for children and spouses of nonimmigrants</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8562206A512948EF9ACAF7DBC62C8A28"><subsection id="id03fc8d1605ac4078aaa87ba38f133d37"><enum>(s)</enum><text>The Secretary of Homeland Security shall—</text><paragraph id="idFA24B685F52A434A9055BDCBDE5B324E"><enum>(1)</enum><text>authorize an alien spouse admitted under subparagraph (E), (H), or (L) of section 101(a)(15), who is accompanying or following to join a principal alien admitted under any such subparagraph, to engage in employment in the United States; and </text></paragraph><paragraph id="idBA5C8A2C04CB4403B4B8431D64FED558"><enum>(2)</enum><text>provide such alien spouse with an <quote>employment authorized</quote> endorsement or other appropriate work permit.</text></paragraph></subsection><subsection id="idA6264C81263F4FE0ACF628629ACCBC4D"><enum>(t)</enum><text>The Secretary of Homeland Security shall authorize an alien child admitted under subparagraph (E), (H), or (L) of section 101(a)(15), who is accompanying or following to join a principal alien admitted under any such subparagraph, to engage in employment in the United States, and shall provide such child with an <quote>employment authorized</quote> endorsement or other appropriate work permit if—</text><paragraph id="id076C51B89A984693AD2ABF61F13AFE08"><enum>(1)</enum><text>the child is at least 16 years of age;</text></paragraph><paragraph id="id480B60208C1946119FE90CE278B5D71E"><enum>(2)</enum><text>the child, or the child’s legal representative, requests such work authorization; and</text></paragraph><paragraph id="idB12C64CAFEB04C7DB5AEFE5FB2611043"><enum>(3)</enum><text>any employment in which the child may engage complies with the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201</external-xref> et seq.).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id694FE7C2F8E94A1F8A6D64F2D9E78829"><enum>(d)</enum><header>Adjustment of status early filing for nonimmigrants with approved immigrant petitions</header><text>Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended—</text><paragraph id="id5C9B3AFFC4694EE0B6B2D82C56A35F89"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id29FBE74F3DFF4D87B7C4E6F029793695"><subsection id="id396D111017184CD29594BD1658BE5494"><enum>(a)</enum><header>Status as person admitted for permanent residence on application and eligibility for immigrant visa</header><text>The Secretary of Homeland Security, in the discretion of the Secretary and under such regulations as the Secretary may prescribe, may adjust the status of an alien who was inspected and admitted or paroled into the United States or the status of any other alien with an approved petition for classification as a VAWA self-petitioner if—</text><paragraph id="idBC1EB8CA36B142708D8918A569633DCE"><enum>(1)</enum><text>the alien makes an application for such adjustment;</text></paragraph><paragraph id="id3B2A2C342C9444E9837E56447022D4B4"><enum>(2)</enum><text>the alien is eligible to receive an immigrant visa and is admissible to the United States for permanent residence; and</text></paragraph><paragraph id="id035E0123E0DB40299845E45D837413B9"><enum>(3)</enum><text>an immigrant visa is immediately available to the alien at the time the alien’s application is adjudicated.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id548710b31552426286350b15a3cec83e"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9014b382c2074325a9ef822cabaf77b4"><subsection id="id2a58b1ba0c2641f6a6aa9ad1d136ae69"><enum>(n)</enum><header>Adjustment of status application after an approved immigrant petition</header><paragraph id="idef5bad95b8c74e9a9b8e9258c8dce792"><enum>(1)</enum><header>Application</header><text>An alien who has an approved immigrant petition may file an application for adjustment of status under subsection (a), which, if the alien is otherwise eligible, shall remain pending until a visa number becomes available.</text></paragraph><paragraph id="ide013684f15094c7180e63a7c59c0f16e"><enum>(2)</enum><header>Status</header><text>An admissible alien who has properly filed an adjustment of status application under subsection (a) shall, throughout the pendency of such application—</text><subparagraph id="idc56d7b61a9da4f7e8121e06f460f61ce"><enum>(A)</enum><text>have a lawful status and be considered lawfully present for purposes of section 212(a); and</text></subparagraph><subparagraph id="ida8347362deda453795a5c322546ed183"><enum>(B)</enum><text>following a biometric background check, be eligible for employment and travel authorization incident to such status.</text></subparagraph></paragraph><paragraph id="id0F1AE13D40174DCA9082FD900D132486"><enum>(3)</enum><header>Biometric background check</header><text>Any biometric background check performed with respect to an alien during the 1-year period immediately preceding the alien’s submission of an application for an adjustment of status under subsection (a) shall be sufficient for meeting the biometric background check requirement under paragraph (2)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
