<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 969</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210325">March 25, 2021</action-date><action-desc><sponsor name-id="S348">Mr. Paul</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish Federal Regulatory Review Commissions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H00B790E64871400E9530BDDF8A97B883"><section section-type="section-one" id="H7CEFF3716BD3407FA84737CD5A16727A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coronavirus Regulatory Repeal Act of 2021</short-title></quote>.</text></section><section id="H1EF0E30805DF4A6E9FCEC2C299AEC054"><enum>2.</enum><header>Repeal or Modification of Regulations during the emergency period</header><text display-inline="no-display-inline">Any regulation waived or modified during the emergency period shall be repealed or modified, as applicable, the day after the expiration of the emergency period and thereafter, unless a Federal Regulatory Review Commission recommends the regulation should not be repealed or modified, as applicable, and a law is enacted confirming the recommendation.</text></section><section id="H30E03F9194C84E8488617CDFF002598E"><enum>3.</enum><header>Federal Regulatory Review Commissions</header><subsection id="HCC9F9A80C13E4779AA3DA18980D06DD5"><enum>(a)</enum><header>Establishment</header><text>There are established Commissions to be known as the <quote>Federal Regulatory Review Commissions</quote>.</text></subsection><subsection id="H95A8BB4432CA43EFA97878BBD76B97FA"><enum>(b)</enum><header>Members</header><text>Each Commission shall be composed of members of the congressional committee of each jurisdiction and the head of each agency under the jurisdiction of that committee (in this Act referred to as the <quote>members</quote>). </text></subsection><subsection id="H39684D95760547618915B54C23E571D9"><enum>(c)</enum><header>Information</header><text display-inline="yes-display-inline">Members may obtain information from individuals with expertise in the operations and regulations of government programs.</text></subsection><subsection id="HDD171C320F19460590CA2EE9E9BFC4EF"><enum>(d)</enum><header>Duties of the Commissions</header><paragraph id="H0B62B0F1382947E7B76EB3B16B48889D"><enum>(1)</enum><header>Review of Federal regulations</header><text display-inline="yes-display-inline">Not later than 2 months after the date of the enactment of this Act, each Commission shall submit to the Speaker of the House of Representatives and the majority leader of the Senate an official recommendation, on the repeal or modification of each regulation waived or modified during the emergency period. Each regulation waived or modified during the emergency period shall remain waived or modified, as applicable, during the review period by the Commission.</text></paragraph><paragraph id="HC65FD2D23AC640D8AB6348A85B71840B"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">The deadline in paragraph (1) may be extended for an additional month if the Congress enacts legislation extending such deadline by a vote of a majority of the House of Representatives and the Senate.</text></paragraph></subsection><subsection id="H6CE39873597447989F5A0D84273A827F"><enum>(e)</enum><header>Report to Congress</header><paragraph id="H6BCE0F630D724620A50C64A620D793C2"><enum>(1)</enum><header>Agency report on regulations</header><text display-inline="yes-display-inline">Not later than 1 month after the date of the enactment of this Act, the head of each agency shall submit to each congressional committee of jurisdiction a report that includes—</text><subparagraph id="H347BDC55EE9E484DBAC5E7DA33EF186E"><enum>(A)</enum><text>an analysis of whether or not the agency can function without the regulation or with the modified regulation, as applicable; and</text></subparagraph><subparagraph id="HD484E6682C3D4899AAD1690610B9ACCA"><enum>(B)</enum><text display-inline="yes-display-inline">an analysis of whether the regulation should be restored to its original state before the emergency period or should remain repealed or modified, as applicable.</text></subparagraph></paragraph><paragraph commented="no" id="H869A040E7AFE46E5BBC9B5B8D9ACDCA0"><enum>(2)</enum><header>Public comment period required</header><text display-inline="yes-display-inline">The head of an agency shall provide a public comment period before submitting a report pursuant to paragraph (1).</text></paragraph></subsection><subsection commented="no" id="H52C67895F22B4763B056DD9311306CD4"><enum>(f)</enum><header>Congressional recommendation</header><text display-inline="yes-display-inline">Not later than 1 month after receiving a report from the head of each agency pursuant to subsection (e), each committee shall submit to the Speaker of the House of Representatives and the majority leader of the Senate an official recommendation on whether or not the repealed or modified regulation should be re-established. </text></subsection><subsection commented="no" id="H2C142A2742D04E66A0BBFBD13D12DEE8"><enum>(g)</enum><header>Sunset of Commissions</header><text>The Commissions established in this section shall terminate on the final day of the final recommendation by each committee. </text></subsection></section><section id="H9C981A6A1D21431297639D2419F19A94"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HD0363A8406EE4B5E9C5E3FA933B2060B"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code. </text></paragraph><paragraph id="HB8ADB664CFEB4CFBBC3B9EFC1B0DBC32"><enum>(2)</enum><header>Emergency period</header><text>The term <term>emergency period</term> means the duration of a public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) as a result of confirmed cases of 2019 novel coronavirus (COVID–19), including any renewal thereof.</text></paragraph><paragraph id="H5A64A95346854494BF64A2270BCE83E8"><enum>(3)</enum><header>Regulation</header><text>The term <term>regulation</term> has the meaning given the term <term>rule</term> under section 551 of title 5, United States Code.</text></paragraph></section></legis-body></bill>
