which was read the first time</action-desc></action><action><action-date>March 25, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize dedicated domestic terrorism offices within the Department of Homeland Security, the Department of Justice, and the Federal Bureau of Investigation to analyze and monitor domestic terrorist activity and require the Federal Government to take steps to prevent domestic terrorism, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H33774F322E6F497186593215BECFA991"><section section-type="section-one" id="HE62DD81A148845CAB130DCFA7C3888F2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Terrorism and Hate Crimes Prevention Act of 2021</short-title></quote>.</text></section><section id="HCCF4958B2D2A4AE99A59F885AC9AD8F8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="HAB919747879E447CAAABCFF4E866B2C5"><enum>(1)</enum><text>the term <quote>Director</quote> means the Director of the Federal Bureau of Investigation;</text></paragraph><paragraph id="HBFFF3A93F47447FD92D86A41E6293AE1"><enum>(2)</enum><text>the term <quote>domestic terrorism</quote> has the meaning given the term in section 2331 of title 18, United States Code, except that it does not include acts perpetrated by individuals associated with or inspired by—</text><subparagraph id="H2837F6FC714949978C61F4230C337706"><enum>(A)</enum><text>a foreign person or organization designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></subparagraph><subparagraph id="H7242941C73E64FCE8BB77AAEBD853BA0"><enum>(B)</enum><text>an individual or organization designated under Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note); or</text></subparagraph><subparagraph id="HCE6A4B9EFC894ED2865584F95EA4CFC2"><enum>(C)</enum><text>a state sponsor of terrorism as determined by the Secretary of State under section 6(j) of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/4605">50 U.S.C. 4605</external-xref>), section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>), or section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></subparagraph></paragraph><paragraph id="H862251D0D8DB4345810A1CA27CEC9D68"><enum>(3)</enum><text>the term <quote>Domestic Terrorism Executive Committee</quote> means the committee within the Department of Justice tasked with assessing and sharing information about ongoing domestic terrorism threats;</text></paragraph><paragraph id="HF998524F84CF42ABBE7015556CE6A214"><enum>(4)</enum><text>the term <quote>hate crime incident</quote> means an act described in section 241, 245, 247, or 249 of title 18, United States Code, or in section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>);</text></paragraph><paragraph id="HAC757C08D0594D0FB204DE973C2C4A22"><enum>(5)</enum><text>the term <quote>Secretary</quote> means the Secretary of Homeland Security; and</text></paragraph><paragraph id="HF158E093EA494020AD044EA8272BF39C"><enum>(6)</enum><text>the term <quote>uniformed services</quote> has the meaning given the term in section 101(a) of title 10, United States Code.</text></paragraph></section><section id="H33C6B824E3064984B527D1F18F9670F9"><enum>3.</enum><header>Offices to combat domestic terrorism</header><subsection id="H8B660C97519F4C249BFCB6BEFBCFBEB3"><enum>(a)</enum><header>Authorization of offices To monitor, analyze, investigate, and prosecute domestic terrorism</header><paragraph id="H7E287B77160E4EC5936384E7D2A73619"><enum>(1)</enum><header>Domestic terrorism unit</header><text>There is authorized a Domestic Terrorism Unit in the Office of Intelligence and Analysis of the Department of Homeland Security, which shall be responsible for monitoring and analyzing domestic terrorism activity.</text></paragraph><paragraph id="H297BF47937F44176B87D04E2FAD4326E"><enum>(2)</enum><header>Domestic terrorism office</header><text>There is authorized a Domestic Terrorism Office in the Counterterrorism Section of the National Security Division of the Department of Justice—</text><subparagraph id="H6266A90E4B1646C29480F697E46681A3"><enum>(A)</enum><text>which shall be responsible for investigating and prosecuting incidents of domestic terrorism; and</text></subparagraph><subparagraph id="H87B106C8AFAB4B14ABF67724F377F5AF"><enum>(B)</enum><text>which shall be headed by the Domestic Terrorism Counsel.</text></subparagraph></paragraph><paragraph id="H4ED871DCB575418BA4CC1B52229FCE4F"><enum>(3)</enum><header>Domestic terrorism section of the fbi</header><text>There is authorized a Domestic Terrorism Section within the Counterterrorism Division of the Federal Bureau of Investigation, which shall be responsible for investigating domestic terrorism activity.</text></paragraph><paragraph id="HEF8B55AFFBBD4283B4664A98F19DDC5E"><enum>(4)</enum><header>Staffing</header><text>The Secretary, the Attorney General, and the Director shall each ensure that each office authorized under this section in their respective agencies shall—</text><subparagraph id="HF2279B04DC594B5DA7609BD0134D57CE"><enum>(A)</enum><text>have adequate number of employees to perform the required duties;</text></subparagraph><subparagraph id="H3DD2E583723C4EDABE0AD469278168D4"><enum>(B)</enum><text>have not less than one employee dedicated to ensuring compliance with civil rights and civil liberties laws and regulations; and</text></subparagraph><subparagraph id="H048BD0D5D2C949A3A5AFC6FA4ACFE19A"><enum>(C)</enum><text>require that all employees undergo annual anti-bias training.</text></subparagraph></paragraph><paragraph id="HF731B0C541DD4E5A999E4A9D15A1316F"><enum>(5)</enum><header>Sunset</header><text>The offices authorized under this subsection shall terminate on the date that is 10 years after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H4AA9F8BAEEEB48DA80A87D0F93A0A51D"><enum>(b)</enum><header>Joint report on domestic terrorism</header><paragraph id="HADD7309E42344809A16EB9FE9FBACC17"><enum>(1)</enum><header>Biannual report required</header><text>Not later than 180 days after the date of enactment of this Act, and each 6 months thereafter for the 10-year period beginning on the date of enactment of this Act, the Secretary of Homeland Security, the Attorney General, and the Director of the Federal Bureau of Investigation shall submit a joint report authored by the domestic terrorism offices authorized under paragraphs (1), (2), and (3) of subsection (a) to—</text><subparagraph id="HC7B38AE79D6F4238ADBF4D5E90C26B75"><enum>(A)</enum><text>the Committee on the Judiciary, the Committee on Homeland Security and Governmental Affairs, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="H3E4B9947FCA444349C250259484893D8"><enum>(B)</enum><text>the Committee on the Judiciary, the Committee on Homeland Security, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H912308FD269C44269F895C1E098C3B28"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include—</text><subparagraph id="HDCD8E308FFC6469F81724D221FC60421"><enum>(A)</enum><text>an assessment of the domestic terrorism threat posed by White supremacists and neo-Nazis, including White supremacist and neo-Nazi infiltration of Federal, State, and local law enforcement agencies and the uniformed services; and</text></subparagraph><subparagraph id="HBED8C67141494B15B4C786959B13B8D5"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H02D39D57A46B491A952E2FDD8CCD616B"><enum>(i)</enum><text>in the first report, an analysis of incidents or attempted incidents of domestic terrorism that have occurred in the United States since April 19, 1995, including any White-supremacist-related incidents or attempted incidents; and</text></clause><clause id="HE1B736A4157841C6AD4D9B1524DF0A94" indent="up1"><enum>(ii)</enum><text>in each subsequent report, an analysis of incidents or attempted incidents of domestic terrorism that occurred in the United States during the preceding 6 months, including any White-supremacist-related incidents or attempted incidents; and</text></clause></subparagraph><subparagraph id="HEA31DBE4676C430CA62F1C3EC2D949AE"><enum>(C)</enum><text>a quantitative analysis of domestic terrorism for the preceding 6 months, including—</text><clause id="H2D43BFD2D9964FFB906B4288BA243853"><enum>(i)</enum><text>the number of—</text><subclause id="H25E10D9DB15E4CB6B2212CE9AE951FD5"><enum>(I)</enum><text>domestic terrorism related assessments initiated by the Federal Bureau of Investigation, including the number of assessments from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism;</text></subclause><subclause id="H5F6CA74FE4444DF7A52AF331512E336A"><enum>(II)</enum><text>domestic terrorism-related preliminary investigations initiated by the Federal Bureau of Investigation, including the number of preliminary investigations from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and how many preliminary investigations resulted from assessments;</text></subclause><subclause id="HE2971FA587204717BBCB700DCEE08C00"><enum>(III)</enum><text>domestic terrorism-related full investigations initiated by the Federal Bureau of Investigation, including the number of full investigations from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and how many full investigations resulted from preliminary investigations and assessments;</text></subclause><subclause id="H72303052A6F9418B968EBC0E86FB6CB3"><enum>(IV)</enum><text>domestic terrorism-related incidents, including the number of incidents from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, the number of deaths and injuries resulting from each incident, and a detailed explanation of each incident;</text></subclause><subclause id="HB13E5BADFD214CACBC3BEE4D847FCB09"><enum>(V)</enum><text>Federal domestic terrorism-related arrests, including the number of arrests from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and a detailed explanation of each arrest;</text></subclause><subclause id="H394F3FFFAD9446E7B92412A3E3726B58"><enum>(VI)</enum><text>Federal domestic terrorism-related indictments, including the number of indictments from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and a detailed explanation of each indictment;</text></subclause><subclause id="HAC09AD9261D6441CBC14D2A31EDEA4AC"><enum>(VII)</enum><text>Federal domestic terrorism-related prosecutions, including the number of incidents from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and a detailed explanation of each prosecution;</text></subclause><subclause id="H7E6B89E0DA26449184A3937AFC9DCFA8"><enum>(VIII)</enum><text>Federal domestic terrorism-related convictions, including the number of convictions from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism, and a detailed explanation of each conviction; and</text></subclause><subclause id="H2B0E588D97DA4EA09F00DC30A8D9D90E"><enum>(IX)</enum><text>Federal domestic terrorism-related weapons recoveries, including the number of each type of weapon and the number of weapons from each classification and subcategory, with a specific classification or subcategory for those related to White supremacism; and</text></subclause></clause><clause id="id083F35B2606541F59111D42BAD8F75E4"><enum>(ii)</enum><text>an explanation of each individual case that progressed through more than 1 of the stages described under clause (i)—</text><subclause id="idDE7C4A4A84394943B130921848016214"><enum>(I)</enum><text>including the specific classification or subcategory for each case; and</text></subclause><subclause id="id86C369A9FD23415F90E69064756100BC" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>not including personally identifiable information not otherwise releasable to the public. </text></subclause></clause></subparagraph></paragraph><paragraph id="HCF0DF4EC8A2046F0A4C0C7751381F01F"><enum>(3)</enum><header>Hate crimes</header><text>In compiling a joint report under this subsection, the domestic terrorism offices authorized under paragraphs (1), (2), and (3) of subsection (a) shall, in consultation with the Civil Rights Division of the Department of Justice and the Civil Rights Unit of the Federal Bureau of Investigation, review each hate crime incident reported during the preceding 6 months to determine whether the incident also constitutes a domestic terrorism-related incident.</text></paragraph><paragraph id="HADE5EAEC9B6D41C78F7B95D705206688"><enum>(4)</enum><header>Classification and public release</header><text>Each report submitted under paragraph (1) shall be—</text><subparagraph id="H709BB42E4E4947BBA9CC79CFDE556802"><enum>(A)</enum><text>unclassified, to the greatest extent possible, with a classified annex only if necessary; and</text></subparagraph><subparagraph id="H8E48AFE5C23B498AAFF30415B4CD7626"><enum>(B)</enum><text>in the case of the unclassified portion of the report, posted on the public websites of the Department of Homeland Security, the Department of Justice, and the Federal Bureau of Investigation.</text></subparagraph></paragraph><paragraph id="HA6BA4FD83E5347FB81869D2AF12952B0"><enum>(5)</enum><header>Nonduplication</header><text display-inline="yes-display-inline">If two or more provisions of this subsection or any other law impose requirements on an agency to report or analyze information on domestic terrorism that are substantially similar, the agency shall construe such provisions as mutually supplemental, so as to provide for the most extensive reporting or analysis, and shall comply with each such requirement as fully as possible.</text></paragraph></subsection><subsection id="H33711DA3871D400CBB695A1189235B26"><enum>(c)</enum><header>Domestic terrorism executive committee</header><text>There is authorized a Domestic Terrorism Executive Committee, which shall—</text><paragraph id="H0340C1CB76804B148D95D494B6DE07AB"><enum>(1)</enum><text>meet on a regular basis, and not less regularly than 4 times each year, to coordinate with United States Attorneys and other key public safety officials across the country to promote information sharing and ensure an effective, responsive, and organized joint effort to combat domestic terrorism; and</text></paragraph><paragraph id="HC32CD64A863D464CADCB75FDA4DB9D50"><enum>(2)</enum><text>be co-chaired by—</text><subparagraph id="H83C5CBDA36E94A47B9A311EB2F218FE7"><enum>(A)</enum><text>the Domestic Terrorism Counsel authorized under subsection (a)(2)(B);</text></subparagraph><subparagraph id="H174DA344AED3403CAD83117744BFE306"><enum>(B)</enum><text>a United States Attorney or Assistant United States Attorney;</text></subparagraph><subparagraph id="H63CF931EEB834D99A7DF7FFFB6192D7B"><enum>(C)</enum><text>a member of the National Security Division of the Department of Justice; and</text></subparagraph><subparagraph id="H2D9630D147944AF5BE97A5D43EB4443B"><enum>(D)</enum><text>a member of the Federal Bureau of Investigation.</text></subparagraph></paragraph></subsection><subsection id="H6C628BB96E904BB7A82B7EAD80025305"><enum>(d)</enum><header>Focus on greatest threats</header><text>The domestic terrorism offices authorized under paragraphs (1), (2), and (3) of subsection (a) shall focus their limited resources on the most significant domestic terrorism threats, as determined by the number of domestic terrorism-related incidents from each category and subclassification in the joint report for the preceding 6 months required under subsection (b).</text></subsection></section><section id="H24FED51CFCA74598A696CBAA3590C9DB"><enum>4.</enum><header>Training to combat domestic terrorism</header><subsection id="HD09272233FC5483EBD58AE768E2491B0"><enum>(a)</enum><header>Required training and resources</header><text>The Secretary, the Attorney General, and the Director shall review the anti-terrorism training and resource programs of their respective agencies that are provided to Federal, State, local, and Tribal law enforcement agencies, including the State and Local Anti-Terrorism Program that is funded by the Bureau of Justice Assistance of the Department of Justice, and ensure that such programs include training and resources to assist State, local, and Tribal law enforcement agencies in understanding, detecting, deterring, and investigating acts of domestic terrorism and White supremacist and neo-Nazi infiltration of law enforcement and corrections agencies. The domestic-terrorism training shall focus on the most significant domestic terrorism threats, as determined by the quantitative analysis in the joint report required under section 3(b).</text></subsection><subsection id="HA22BDECB481140F1A8B1767F80699305"><enum>(b)</enum><header>Requirement</header><text>Any individual who provides domestic terrorism training required under this section shall have—</text><paragraph id="H3F8FEFD983F54A76A7F048C1F54D974F"><enum>(1)</enum><text>expertise in domestic terrorism; and</text></paragraph><paragraph id="H632692ACFCD84744AE01AB8829755157"><enum>(2)</enum><text>relevant academic, law enforcement, or other community-based experience in matters related to domestic terrorism.</text></paragraph></subsection><subsection id="H7A630C99F5F747ACAFBCDE5D3EA78E43"><enum>(c)</enum><header>Report</header><paragraph id="H9804BF95D33B4056817BC312478C9AF4"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act and twice each year thereafter, the Secretary, the Attorney General, and the Director shall each submit a biannual report to the committees of Congress described in section 3(b)(1) on the domestic terrorism training implemented by their respective agencies under this section, which shall include copies of all training materials used and the names and qualifications of the individuals who provide the training.</text></paragraph><paragraph id="H49AC4E87B74843DCAC078A441DE2A9A2"><enum>(2)</enum><header>Classification and public release</header><text>Each report submitted under paragraph (1) shall be—</text><subparagraph id="H0E52C21863DF440DB176BC97C33A8676"><enum>(A)</enum><text>unclassified, to the greatest extent possible, with a classified annex only if necessary; and</text></subparagraph><subparagraph id="H67D11824D34A47BBA9DB7DCA79A09555"><enum>(B)</enum><text>in the case of the unclassified portion of each report, posted on the public website of the Department of Homeland Security, the Department of Justice, and the Federal Bureau of Investigation.</text></subparagraph></paragraph></subsection></section><section id="H98A26A594C4F49AAA3B5361A37008FF3"><enum>5.</enum><header>Interagency task force</header><subsection id="H6384DF0182D647F1A9E597B005120620"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General, the Director, the Secretary, and the Secretary of Defense shall establish an interagency task force to analyze and combat White supremacist and neo-Nazi infiltration of the uniformed services and Federal law enforcement agencies.</text></subsection><subsection id="H60ECC0116766404B9A49EF92861E0E51"><enum>(b)</enum><header>Report</header><paragraph id="H0AC148553BE24755AD6B623F0E5BB538"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the interagency task force is established under subsection (a), the Attorney General, the Director, the Secretary, and the Secretary of Defense shall submit a joint report on the findings of the task force and the response of the Attorney General, the Director, the Secretary, and the Secretary of Defense to such findings, to—</text><subparagraph id="H6CCAF29C0D1949CCB7DAC19EE0CD479A"><enum>(A)</enum><text>the Committee on the Judiciary of the Senate;</text></subparagraph><subparagraph id="HDBAB6EBCF12E458791B7F47700D4FE84"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph id="H664DB5BEA79944EAA00511D77BCFD895"><enum>(C)</enum><text>the Select Committee on Intelligence of the Senate;</text></subparagraph><subparagraph id="HC9F08FFA07764FBEB55121F969EBD450"><enum>(D)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="H189CBAFE1F1242A5A46959FBB209F341"><enum>(E)</enum><text>the Committee on the Judiciary of the House of Representatives;</text></subparagraph><subparagraph id="H06457D61F618487593C19EFA8101797E"><enum>(F)</enum><text>the Committee on Homeland Security of the House of Representatives;</text></subparagraph><subparagraph id="H62C5C4F8EB8340A1BEDAEE22C171B3F4"><enum>(G)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph><subparagraph id="H2041EEC822D24EF7B337AAD1802C0D1D"><enum>(H)</enum><text>the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H8654593B0BC1429EBF0AF232D6FBBAB9"><enum>(2)</enum><header>Classification and public release</header><text>The report submitted under paragraph (1) shall be—</text><subparagraph id="HC45A989393AD468784A9800C4BD0C964"><enum>(A)</enum><text>submitted in unclassified form, to the greatest extent possible, with a classified annex only if necessary; and</text></subparagraph><subparagraph id="H7D7CD257C6BD41709AE7DE0905F1EA39"><enum>(B)</enum><text>in the case of the unclassified portion of the report, posted on the public website of the Department of Defense, the Department of Homeland Security, the Department of Justice, and the Federal Bureau of Investigation.</text></subparagraph></paragraph></subsection></section><section id="H217CC9E846D5416C872992B530846549"><enum>6.</enum><header>Department of justice support for hate crime incidents with a nexus to domestic terrorism</header><subsection id="HD2F36C06643E48DEBFC3E008E025CA2D"><enum>(a)</enum><header>Community relations service</header><text display-inline="yes-display-inline">The Community Relations Service of the Department of Justice, authorized under section 1001(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000g">42 U.S.C. 2000g</external-xref>), may offer the support of the Service to communities where the Department of Justice has brought charges in a hate crime incident that has a nexus to domestic terrorism.</text></subsection><subsection id="H0C37AD64165748F893A09DC5C3E85669"><enum>(b)</enum><header>Federal bureau of investigation</header><text>Section 249 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H0A2329FB056F44728E16AE4E494E93C6"><subsection id="H2F9E1514C04C4466B982CFB27E628D11"><enum>(e)</enum><header>Federal bureau of investigation</header><text>The Attorney General, acting through the Director of the Federal Bureau of Investigation, shall assign a special agent or hate crimes liaison to each field office of the Federal Bureau of Investigation to investigate hate crimes incidents with a nexus to domestic terrorism (as such term is defined in section 2 of the <short-title>Domestic Terrorism and Hate Crimes Prevention Act of 2021</short-title>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id3dcb6482fe0547e5aac1d83bc18ccfbb"><enum>7.</enum><header>Review of COVID–19 hate crimes</header><subsection id="iddfec6ddfb9e547dda6158a5c40a3483a"><enum>(a)</enum><header>In general</header><text>Not later than 14 days after the date of enactment of this Act, the Attorney General shall designate an officer or employee of the Department of Justice whose sole responsibility during the applicable period shall be to facilitate the expedited review of COVID–19 hate crimes and reports of any such crime to Federal, State, or local law enforcement agencies.</text></subsection><subsection id="id3a90d226ea9e4c049806c265ba5c530e"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4557756c3bd24c4faf7cf38ff12dbcd4"><enum>(1)</enum><header>Applicable period</header><text>The term <term>applicable period</term> means the period beginning on the date on which the officer or employee is designated under subsection (a), and ending on the date that is 1 year after the date on which the emergency period described in subparagraph (B) of section 1135(g)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)</external-xref>) ends, except that the Attorney General may extend such period as appropriate.</text></paragraph><paragraph id="id5c9d86533d5e4e3cb60110222626304e"><enum>(2)</enum><header>COVID–19 hate crime</header><text>The term <term>COVID–19 hate crime</term> means a crime of violence (as such term is defined in section 16 of 18, United States Code) that is motivated by—</text><subparagraph id="id074abdb07dc74e19a97f55095a18a307"><enum>(A)</enum><text>the actual or perceived race, ethnicity, age, color, religion, national origin, sexual orientation, gender, gender identity, or disability of any person; and</text></subparagraph><subparagraph id="id0d2e08ffa35d44a389a931cfe3757b9d"><enum>(B)</enum><text>the actual or perceived relationship to the spread of COVID–19 of any person because of the characteristic described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id4b68d19148ed4fe49b7eea76083bfed0"><enum>(c)</enum><header>Guidance</header><paragraph id="idf5f6d993d23949cba9f06693f9cfb7db"><enum>(1)</enum><header>Guidance for law enforcement agencies</header><text>The Attorney General shall issue guidance for State and local law enforcement agencies on how to—</text><subparagraph id="id96a624c2d7c04c24a0a813c9192ba88c"><enum>(A)</enum><text>establish online reporting of hate crimes or incidents, and to have online reporting available in multiple languages as determined by the Attorney General; and</text></subparagraph><subparagraph id="idab99885f6c184b74b2a033d2c7c63b03"><enum>(B)</enum><text>expand culturally competent and linguistically appropriate public education campaigns, and collection of data and public reporting of hate crimes.</text></subparagraph></paragraph><paragraph id="id031011dee03b4367b994b76782c87736" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Guidance relating to COVID–19 pandemic</header><text>The Attorney General and the Secretary of Health and Human Services, in coordination with the COVID–19 Health Equity Task Force and community-based organizations, shall issue guidance describing best practices to mitigate racially discriminatory language in describing the COVID–19 pandemic. </text></paragraph></subsection></section><section id="HA6365DA24D5D47B88C3F45B4474A4AC8"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Department of Justice, the Federal Bureau of Investigation, the Department of Homeland Security, and the Department of Defense such sums as may be necessary to carry out this Act.</text></section></legis-body><endorsement><action-date>March 25, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
