which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to allow for greater State flexibility with respect to excluding providers who are involved in abortions.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6924A26BD6F2473CB0E85BCA724346DF"><section section-type="section-one" id="H77187FD11649407598850D53581BC8C3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Women’s Public Health and Safety Act</short-title></quote>.</text></section><section id="H6DAF839F6C6B4E57ADA19D3FF3BA1CCE"><enum>2.</enum><header>Increasing State flexibility in determining participation of providers who perform, or participate in the performance of, abortions</header><text display-inline="no-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text><paragraph id="H8BE0069B108343F981380EBDF854C902"><enum>(1)</enum><text>in subsection (a)(23), by striking <quote>subsection (g)</quote> and inserting <quote>subsections (g) and (tt),</quote>; and</text></paragraph><paragraph id="H458F354664DA41D28AA5992789A3F255"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="traditional" display-inline="no-display-inline" id="HDFC91672949F4E058637C305A58CECA1"><subsection id="HB6C4692714C249359B367CF36B66500C"><enum>(tt)</enum><header>Rules with respect to determination of participation of providers who perform, or participate in the performance of, abortions</header><paragraph id="HB4A9C91360F04ACEBA7BD7313E3CB529"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), for purposes of this title, a State, at its option, may establish criteria with respect to the participation under the State plan (or a waiver of such plan) of an institution, an agency, an entity, or a person who performs, or participates in the performance of, abortions.</text></paragraph><paragraph id="H691D433646E846CE96B9A43521ABB8D8"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to an abortion—</text><subparagraph id="H019BEE6E499F43C4BD036E889A239B1E"><enum>(A)</enum><text display-inline="yes-display-inline">if the pregnancy is the result of an act of rape or incest; or</text></subparagraph><subparagraph id="H07040D45CBAC49868726DE0C39330043"><enum>(B)</enum><text display-inline="yes-display-inline">in the case where a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself.</text></subparagraph></paragraph><paragraph id="H4E11150496154147AB33F9B1C7A89737"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the terms <term>institution</term>, <term>agency</term>, or <term>entity</term> mean the entire legal institution, agency, or entity, or any part thereof, including any institution, agency, or entity that controls, is controlled by, or is under common control with such institution, agency, or entity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
