which was read twice and referred to the <committee-name committee-id="SSHR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 12, 2022</action-date><action-desc>Reported by <sponsor name-id="S229">Mrs. Murray</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to expand the allowable use criteria for new access points grants for community health centers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maximizing Outcomes through Better Investments in Lifesaving Equipment for (MOBILE) Health Care Act</short-title></quote>.</text></section><section id="id96B5D82F50C64ED5B56F27689C5CD378" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>2.</enum><header>New access points grants</header><text display-inline="no-display-inline">Section 330(e)(6)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(e)(6)(A)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDA47938175464A84995D5C67E969BD33" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><clause id="id416D42EA127B4445979B0C694A84912D"><enum>(v)</enum><header>Mobile units</header><subclause id="idFC3D9B3B71164122ABD38D59D824B4E5"><enum>(I)</enum><header>In general</header><text>A mobile unit may qualify as a new delivery site under clause (i), regardless of whether the applicant additionally proposes to establish a permanent, full-time site.</text></subclause><subclause id="id0A754DFC98694A71A04006C19A46335D"><enum>(II)</enum><header>Definition of mobile unit</header><text>In this clause, the term <term>mobile unit</term>—</text><item id="idC69886636FDD4EC6BAD1C2576F19CCD9"><enum>(aa)</enum><text>means a unit that is staffed by clinicians working for or on behalf of a health center to provide medical or oral health services at one or more locations— </text><subitem id="id3870DE1AB8C74792A8299666472F58BF"><enum>(AA)</enum><text>to a target population specified in the application for a grant under subparagraph (A) or (B) of paragraph (1); and</text></subitem><subitem id="idA58DB0C5C6AC4A1485A46C077FB5D1F4"><enum>(BB)</enum><text>for a total of not less than 40 hours per week; and</text></subitem></item><item id="id7C23E417DB0E4DD6B3EBDE44FBCCE144"><enum>(bb)</enum><text>may include a geographic rotation so long as access to medical or oral health services through such unit for such target population is available not less than 2 times per month for each geographic location.</text></item></subclause></clause><clause id="idDB26ACBF5CD64694B6A9F43AE059DFCA"><enum>(vi)</enum><header>Costs for renovation and new construction</header><text>The costs for which a grant described in clause (i) is made may include costs associated with—</text><subclause id="idFB94C1BCAE0F4C3AAB029EDCDD227EA1"><enum>(I)</enum><text>acquiring, leasing, expanding, or renovating an existing building for providing health services to medically underserved populations;</text></subclause><subclause id="id515EA09A74DF4D6198348A33D5ADD306"><enum>(II)</enum><text>constructing a new building for such purposes; or</text></subclause><subclause id="id93029F8B963D47D98DF18BADB21F0DC5"><enum>(III)</enum><text>acquiring, leasing, expanding, or renovating mobile medical equipment or vehicles to establish a new delivery site for such purposes.</text></subclause></clause><clause id="id9731AB8FB4554DE0AAF23D3AFD481F33"><enum>(vii)</enum><header>Requirements with respect to real property, equipment, and other capital assets</header><subclause id="idD047F600F5F04E18B56F2F1E4A0F1C84"><enum>(I)</enum><header>Real property</header><text>A recipient of a grant described in clause (i) shall use any real property constructed, purchased, or significantly improved with funds awarded through such grant for the purposes for which the property was so constructed, purchased, or significantly improved for a period of 12 years. At the conclusion of such period, any Federal interest under this paragraph in such property shall expire.</text></subclause><subclause id="id0CCA0E26CAD84944A505035215B3F150"><enum>(II)</enum><header>Equipment and other capital assets</header><text>A recipient of a grant described in clause (i) shall use any equipment or asset, other than real property, acquired with funds awarded through such grant for the purposes for which the equipment or asset was so acquired for a period that is the lesser of the remaining useful life of the equipment or asset or 6 years. At the conclusion of such period, any Federal interest under this paragraph in such equipment or asset shall expire.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id828a4849-1b84-4217-92c8-96e2e02b03b6" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maximizing Outcomes through Better Investments in Lifesaving Equipment for (MOBILE) Health Care Act</short-title></quote>.</text></section><section id="idfc521a43-5f14-43fe-b42e-02b18e28967d" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>2.</enum><header>New access points grants</header><subsection id="idBC8464186F994BFB98615062689AF268"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 330(e)(6)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(e)(6)(A)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id46D629770C12402F9D0FB416DE72B49C" changed="added" reported-display-style="italic" committee-id="SSHR00"><clause id="id8bad4d9d-9e28-4e2f-88c9-f3591e76416f"><enum>(v)</enum><header>Mobile units</header><text>An existing health center may be awarded funds under clause (i) to establish a new delivery site that is a mobile unit, regardless of whether the applicant additionally proposes to establish a permanent, full-time site. In the case of a health center that is not currently receiving funds under this section, such health center may be awarded funds under clause (i) to establish a new delivery site that is a mobile unit only if such health center uses a portion of such funds to also establish a permanent, full-time site.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbcc64edc510342efa3840d3557a4fb5c"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on January 1, 2024.</text></subsection></section></legis-body><endorsement><action-date>July 12, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
