which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to foster efficient markets and increase competition and transparency among packers that purchase livestock from producers.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H129B0B8D196F40CF9F7396EF8FD41F56"><section section-type="section-one" id="HFA26C280AE334A05AA8A6C28BD8C4CFE"><enum>1.</enum><header>Spot market purchases of livestock by packers</header><text display-inline="no-display-inline">Chapter 5 of subtitle B of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636">7 U.S.C. 1636</external-xref> et seq.) is amended—</text><paragraph id="H241A11933CDA44D2A0350B5975FD718A"><enum>(1)</enum><text>by redesignating section 260 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636i">7 U.S.C. 1636i</external-xref>) as section 261; and</text></paragraph><paragraph id="H4865C474DF39422E9F30D3608B2A4B0A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 259 the following:</text><quoted-block style="OLC" id="H0400FE8C923249E3AE38AAF29CDA820E"><section id="H008979E62FF943A2A4DA9F221A51FDF5"><enum>260.</enum><header>Spot market purchases of livestock by packers</header><subsection id="H0D71462B3A3A4351982D12D5508DA4D6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H84FF932893214ECABF51D9FBA8EBFE6A"><enum>(1)</enum><header>Covered packer</header><subparagraph id="H4DE1F98131E04671AE3D0A32F249CDFC"><enum>(A)</enum><header>In general</header><text>The term <term>covered packer</term> means a packer that is required under this subtitle to report to the Secretary each reporting day information on the price and quantity of livestock purchased by the packer.</text></subparagraph><subparagraph id="H37F6D5DF4107490BBF2D28468CC2CCE4"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered packer</term> does not include a packer that owns only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph id="H2308D27AB3354DAB8B0CCF282ADF6794"><enum>(2)</enum><header>Livestock</header><text>The term <term>livestock</term> does not include—</text><subparagraph id="H0124E0012F844CC79192FADB5C6A7E33"><enum>(A)</enum><text>pork;</text></subparagraph><subparagraph id="H7033ECF4B51F4F43AE5AE6E9209347F4"><enum>(B)</enum><text>poultry;</text></subparagraph><subparagraph id="HE84C4EA35228468FB281183900923526"><enum>(C)</enum><text>a dairy-bred, dairy-bred cross, or beef animal over 30 months of age; or</text></subparagraph><subparagraph id="HE978FB64A9C5446BA8BE551E30F501D3"><enum>(D)</enum><text>a foreign-born beef animal.</text></subparagraph></paragraph><paragraph id="H946CC06EDED4486EA992F2E3C7A55168"><enum>(3)</enum><header>Nonaffiliated producer</header><text>The term <term>nonaffiliated producer</term> means a producer of livestock—</text><subparagraph id="H85189EF53DBB426892D9964F09014934"><enum>(A)</enum><text>that sells livestock to a covered packer; and</text></subparagraph><subparagraph id="HB2886F6DF3F64E59A2B9C4ADEE41DB88"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id5E1336A7D2C04ED199E580BF1B8B038A"><enum>(i)</enum><text>that has less than 1 percent equity interest in that covered packer; </text></clause><clause id="id9210F0DFCA634F569BF93F8A74F6C024" indent="up1"><enum>(ii)</enum><text>in which that covered packer has less than 1 percent equity interest;</text></clause><clause indent="up1" id="idB743F1D3C81D40FBBA13F3A4CA251AF3"><enum>(iii)</enum><text>that has no officers, directors, employees, or owners that are officers, directors, employees, or owners of that covered packer; and</text></clause><clause indent="up1" id="id0E014023907242048321A8E7ECEEA0A9"><enum>(iv)</enum><text>that has no fiduciary responsibility to that covered packer.</text></clause></subparagraph></paragraph><paragraph id="H1608661F723E4093AE710BCA3C679BB7"><enum>(4)</enum><header>Spot market sale</header><subparagraph id="H5D399CD8EF5C41DB97E5650CF03172B4"><enum>(A)</enum><header>In general</header><text>The term <term>spot market sale</term> means a purchase and sale of livestock by a covered packer from a nonaffiliated producer—</text><clause id="HDCF492BB553A4D9E8D66C65252D0895F"><enum>(i)</enum><text>under an agreement that specifies a firm base price that may be equated with a fixed dollar amount on the date on which the agreement is entered into;</text></clause><clause id="H5207F5ECE3DD4DFAACB26BDC5C9A53C0"><enum>(ii)</enum><text>under which the livestock are slaughtered not more than 14 days after the date on which the agreement is entered into; and</text></clause><clause id="H67EE9DE810164CE58F835365019BD474"><enum>(iii)</enum><text display-inline="yes-display-inline">under which a reasonable competitive bidding opportunity exists on the date on which the agreement is entered into, as determined under subparagraph (B).</text></clause></subparagraph><subparagraph id="H5A459DF75813448ABB3B6AED37496AFC"><enum>(B)</enum><header>Reasonable competitive bidding opportunity</header><text>For the purposes of subparagraph (A)(iii), a reasonable competitive bidding opportunity is considered to exist if—</text><clause id="HFF1E4763AA9B43DA9E57AFE442821475"><enum>(i)</enum><text>no written or oral agreement precludes the nonaffiliated producer from soliciting or receiving bids from other covered packers; and</text></clause><clause id="H916C73F585D34DFF91637B0E73B2A716"><enum>(ii)</enum><text>no circumstance, custom, or practice exists that—</text><subclause id="H3132A639785A463AA42B8E3D95C7308B"><enum>(I)</enum><text>establishes the existence of an implied contract (as determined in accordance with the Uniform Commercial Code); and</text></subclause><subclause id="H5C6C6DF6E0D64CA19AD3CD34ED8F15BA"><enum>(II)</enum><text>precludes the nonaffiliated producer from soliciting or receiving bids from other covered packers.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H1872C00503F241218B077DAA415A9F61"><enum>(b)</enum><header>General rule</header><text>Of the quantity of livestock that is slaughtered by a covered packer during each reporting week in each plant, the covered packer shall slaughter not less than 50 percent of the quantity through spot market sales from nonaffiliated producers.</text></subsection><subsection id="HE424B6F3E961436AB8D9733577B8FCAB"><enum>(c)</enum><header>Nonpreemption</header><text>Notwithstanding section 259, this section does not preempt any requirement of a State or political subdivision of a State that requires a covered packer to purchase a greater percentage of livestock on the spot market than the percentage required under this section.</text></subsection><subsection id="HDFD56D54C3724DF8A52C376284901BB3"><enum>(d)</enum><header>Relationship to other provisions</header><text>Nothing in this section affects the interpretation of any other provision of this Act, including section 202.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
