which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide temporary impact aid construction grants to eligible local educational agencies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3A64747A67774E188AEFD58845FD031E"><section section-type="section-one" id="H458720D33653424FA0D294774794DC23"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Impact Aid Infrastructure Act</short-title></quote>.</text></section><section id="H7D2FB30F594844A98A9BC24291819758"><enum>2.</enum><header>Impact aid construction grants authorized</header><subsection id="H1D46A25E552A48CAB80881255677F9A2"><enum>(a)</enum><header>Funding and sunset</header><paragraph id="H3461E9F891A94AB38771473E3C24A3CF"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $1,000,000,000 for fiscal year 2022 to carry out this Act.</text></paragraph><paragraph commented="no" id="H982FBE3DD6874FFE8F9F792781C6A641"><enum>(2)</enum><header>Supplemental funding</header><text>The amount authorized under paragraph (1) shall be in addition to any amounts authorized to be appropriated or otherwise made available to carry out section 7007 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707</external-xref>).</text></paragraph><paragraph id="HB6116AC3F9274871BE7FC95A1C50435C"><enum>(3)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">Any amounts appropriated under paragraph (1) shall remain available until expended.</text></paragraph><paragraph id="H5BF196C141D149FBB45121791C44CE4F"><enum>(4)</enum><header>Sunset</header><text>The authority to award grants under this Act shall expire at the end of the 3-year period beginning on the date on which funds are first made available to award a grant under this Act.</text></paragraph></subsection><subsection id="H280C58A6CC7B4065A660488681CC2D47"><enum>(b)</enum><header>Reservation for management and oversight</header><text display-inline="yes-display-inline">From the funds appropriated under subsection (a)(1), the Secretary of Education may reserve not more than half of 1 percent for management and oversight of the activities carried out with those funds.</text></subsection><subsection id="HE2357D0779C3430FA8FCCBE3E63B171E"><enum>(c)</enum><header>Formula grants</header><paragraph id="id6DC1F49131AF4BAE99B81D89635EFC65"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From 40 percent of the funds appropriated under subsection (a)(1) and not reserved under subsection (b), the Secretary of Education shall make payments in accordance with section 7007(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(a)</external-xref>).</text></paragraph><paragraph id="id5D19FC98758942319E9FC1CE71E7E6AA"><enum>(2)</enum><header>Special rule</header><text>The Secretary of Education when calculating the total number of weighted student units as described in paragraph (3)(A)(i)(II) of section 7007(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(a)</external-xref>) shall include the total number of weighted student units of children described in subparagraphs (B) and (D)(i) of section 7003(a)(1) of such Act for all local educational agencies not meeting the requirements as described in section 7007(a)(2)(B) of such Act but that meet the requirements of section 572(a)(2) of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/7703b">20 U.S.C. 7703b</external-xref>).</text></paragraph></subsection><subsection id="HC42DE011079F4B41B356E3FFE45BCDCD"><enum>(d)</enum><header>Competitive grants</header><text display-inline="yes-display-inline">From 60 percent of the funds appropriated under subsection (a)(1) and not reserved under subsection (b), the Secretary of Education—</text><paragraph id="H1A6F301B05B441EA884B4AD366C7B617"><enum>(1)</enum><text>shall award emergency grants in accordance with section 7007(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)</external-xref>), except as otherwise provided in this Act; and</text></paragraph><paragraph id="H09F3A5ECB6844006A21D7795B1DB627E"><enum>(2)</enum><text>may award modernization grants in accordance with section 7007(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)</external-xref>), except as otherwise provided in this Act.</text></paragraph></subsection></section><section id="HDF3BBFB3D0F14D53BBB08DAB6C76C1BC"><enum>3.</enum><header>Eligibility</header><subsection id="HB8FCDA78AA554DBDBBCB77121C0A6FDC"><enum>(a)</enum><header>Eligibility for emergency grants</header><paragraph id="H8B21605AF97147DCA783C99D33803BEF"><enum>(1)</enum><header>In general</header><text>For purposes of receiving an emergency grant under section 2(d)(1), in addition to a local educational agency that meets the eligibility requirements for the award of such a grant under any of subparagraphs (A), (C), or (D) of section 7007(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)(3)</external-xref>), a local educational agency that meets the requirements described in paragraph (2) (without regard to whether the agency meets any of the requirements of such subparagraphs (A), (C), or (D)), shall be eligible for such a grant.</text></paragraph><paragraph id="H65FB6D10CD224EAAB519C73A60035C1E"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">A local educational agency meets the requirements of this paragraph, if such agency has—</text><subparagraph id="H804176ED7389440B958E6548AC22485D"><enum>(A)</enum><text display-inline="yes-display-inline">a total taxable assessed value of real property that may be taxed for school purposes of less than $100,000,000; or</text></subparagraph><subparagraph id="HE8E8F5BFFA8F41738701D1730D847536"><enum>(B)</enum><text>an assessed value of real property per student that may be taxed for school purposes that is less than the average of the assessed value of real property per student that may be taxed for school purposes in the State in which the local educational agency is located.</text></subparagraph></paragraph></subsection><subsection id="HBEA0C87C40A7489896477F8F8E587B97"><enum>(b)</enum><header>Eligibility for modernization grants</header><paragraph id="H093918CD68CF4D09B594A8CC6EBC5FF4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of receiving a modernization grant under section 2(d)(2), in addition to a local educational agency that meets the eligibility requirements for the award of such a grant under any of subparagraphs (B), (C), or (D) of section 7007(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)(3)</external-xref>), a local educational agency that meets the requirements described in paragraph (2) (without regard to whether the agency meets any of the requirements of such subparagraphs (B), (C), or (D)), shall be eligible for such a grant.</text></paragraph><paragraph id="HDA0F9AB183C84F9FB65C18C7455B600E"><enum>(2)</enum><header>Requirements</header><text>A local educational agency meets the requirements of this paragraph, if such agency has—</text><subparagraph id="HAC0FBF5688A84BFEACB3CB311F5E3E32"><enum>(A)</enum><text display-inline="yes-display-inline">a total taxable assessed value of real property that may be taxed for school purposes of less than $100,000,000; or</text></subparagraph><subparagraph id="HA1D28454F70345F89B346813C04936D5"><enum>(B)</enum><text>an assessed value of real property per student that may be taxed for school purposes that is less than the average of the assessed value of real property per student that may be taxed for school purposes in the State in which the local educational agency is located.</text></subparagraph></paragraph></subsection><subsection id="H8EBD891CCEF54C72941CBCA9409C98BF"><enum>(c)</enum><header>Local educational agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>local educational agency</term> has the meaning given the term in section 7013 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7713">20 U.S.C. 7713</external-xref>).</text></subsection></section><section id="H5C9E805161214D8BB13625E9BEBB8CCA"><enum>4.</enum><header>Inapplicability of certain provisions</header><text display-inline="no-display-inline">Clauses (i) and (vi) of section 7007(b)(5)(A) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)(5)(A)</external-xref>) shall not apply to grants made under section 2(d).</text></section></legis-body></bill>
