which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Global Magnitsky Human Rights Accountability Act to modify the foreign persons subject to sanctions and to remove the sunset for the imposition of sanctions, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Global Magnitsky Human Rights Accountability Reauthorization Act </short-title></quote>.</text></section><section id="id48DD23F39BF6422F96024F208EE4EA28"><enum>2.</enum><header>Modifications to and reauthorization of sanctions with respect to human rights violations</header><subsection id="id56E66D08A62D41F3B2B48ADA11FEA834"><enum>(a)</enum><header>Definitions</header><text>Section 1262 of the Global Magnitsky Human Rights Accountability Act (Subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id941686A4E04946278212D8B7FDAFFB39"><paragraph id="idF5E37F4A0F374D53BB42DEDB4CBA44C2"><enum>(2)</enum><header>Immediate family member</header><text>The term <term>immediate family member</term>, with respect to a foreign person, means the spouse, parent, sibling, or adult child of the person.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAC42B02EFF9E419FB06D012E6C231CB2"><enum>(b)</enum><header>Sense of Congress</header><text>The Global Magnitsky Human Rights Accountability Act (Subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) is amended by inserting after section 1262 the following new section: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id55BC9439017A46A1BAAD684C0EB04CEC"><section id="id5BABC75EEDD04393A4CCD466D3FA0554"><enum>1262A.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the President should establish and regularize information sharing and sanctions-related decision making with like-minded governments possessing human rights and anti-corruption sanctions programs similar in nature to those authorized under this subtitle.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idC75E3E69E7CC4ECB9D10DC9F95898A62"><enum>(c)</enum><header>Imposition of sanctions</header><paragraph id="id98E6AA4BA1FA4F70ABED3A2AE8FB6B0B"><enum>(1)</enum><header>In general</header><text>Subsection (a) of section 1263 of the Global Magnitsky Human Rights Accountability Act (Subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id272A6C6012D945948DD95086AE5FEAF8"><subsection id="idf0eff2763e1342eeae8958b96db9deac"><enum>(a)</enum><header>In general</header><text>The President may impose the sanctions described in subsection (b) with respect to—</text><paragraph id="id3B919253697440D393DF04B8F2921A59"><enum>(1)</enum><text>any foreign person that the President determines, based on credible information—</text><subparagraph id="ide929df09e9674bd8b608f2a273417436"><enum>(A)</enum><text>is responsible for or complicit in, or has directly or indirectly engaged in, serious human rights abuse or any violation of internationally recognized human rights;</text></subparagraph><subparagraph id="id11c5f7cfd8074ac6aae3752f06192b47"><enum>(B)</enum><text>is a current or former government official, or a person acting for or on behalf of such an official, who is responsible for or complicit in, or has directly or indirectly engaged in—</text><clause id="id61c96142d7b749b890303fa46bf1fb7a"><enum>(i)</enum><text>corruption, including—</text><subclause id="id352A9877A80A43C68B7B241403EF301E"><enum>(I)</enum><text>the misappropriation of state assets;</text></subclause><subclause id="id7F9B851A093F4A418DA46B749ADE1041"><enum>(II)</enum><text>the expropriation of private assets for personal gain;</text></subclause><subclause id="id90811997F71F4F0CA6AFD6A921AAAA57"><enum>(III)</enum><text>corruption related to government contracts or the extraction of natural resources; or</text></subclause><subclause id="id37FD3873FC1547D6BB09949902E34510"><enum>(IV)</enum><text>bribery; or</text></subclause></clause><clause id="id9efd84d6b89c4ef2a6412ae66df0c5a6"><enum>(ii)</enum><text>the transfer or facilitation of the transfer of the proceeds of corruption;</text></clause></subparagraph><subparagraph id="id16508931f7da4f17a77272ee41c67b46"><enum>(C)</enum><text>is or has been a leader or official of—</text><clause id="id27495b04ffb2471da7b496b07c8e2c48"><enum>(i)</enum><text>an entity, including a government entity, that has engaged in, or whose members have engaged in, any of the activities described in subparagraph (A) or (B) during the tenure of the leader or official; or</text></clause><clause id="ida3bb5236a40147aba82af39fce804d61"><enum>(ii)</enum><text>an entity whose property and interests in property are blocked pursuant to this section as a result of activities during the tenure of the leader or official;</text></clause></subparagraph><subparagraph id="ide3741d2eff8945278a1b6b55da9ba301"><enum>(D)</enum><text>has materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of—</text><clause id="idfd16ff67d58b4f44a7e07336bedbddec"><enum>(i)</enum><text>an activity described in subparagraph (A) or (B) that is conducted by a foreign person;</text></clause><clause id="id7b333c69d828468ab3ea2bfce35527b5"><enum>(ii)</enum><text>a person whose property and interests in property are blocked pursuant to this section; or</text></clause><clause id="id113662b0b16b48c29d3e780894e601a8"><enum>(iii)</enum><text>an entity, including a government entity, that has engaged in, or whose members have engaged in, an activity described in subparagraph (A) or (B) conducted by a foreign person; or</text></clause></subparagraph><subparagraph id="idf0728e6b747343b1971dc931cfd5cac1"><enum>(E)</enum><text>is owned or controlled by, or acts or is purported to act for or on behalf of, directly or indirectly, a person whose property and interests in property are blocked pursuant to this section; and</text></subparagraph></paragraph><paragraph id="idA44A9E58A9B1431ABD6E91792E6673A3"><enum>(2)</enum><text>any immediate family member of a person described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id66B80CABDEA74EEEBE89C55DD99777CE"><enum>(2)</enum><header>Sanctions described</header><text>Clause (ii) of subsection (b)(2)(C) of such section is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAE841E44BBD54B2B9ECA7AA67902CB0B"><clause id="id29e7b93a23084016bc8d8c0761cb6981"><enum>(ii)</enum><header>Good</header><text>In this subparagraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id0D92DDCADABB4FC2A7091F984A72FB98"><enum>(3)</enum><header>Consideration of certain information</header><text>Subsection (c)(2) of such section is amended by inserting <quote>corruption and</quote> after <quote>monitor</quote>.</text></paragraph><paragraph id="idCFE7F0B198194D57BEC17118EECAC5F2"><enum>(4)</enum><header>Requests by Congress</header><text>Subsection (d) of such section is amended—</text><subparagraph id="id6380BAFFC09A43989A2E0119390A4755"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idD953EC0811A94183B2CFE50AD606A11B"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)</quote>; and</text></clause><clause id="id8A365B51984446C698732D1EDAF3859B"><enum>(ii)</enum><text>in subparagraph (B)(i), by inserting <quote>or an immediate family member of the person</quote>; and</text></clause></subparagraph><subparagraph id="id66D901A0EAF045B6AD487144CFA5357C"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id86223D509E5647488ED096282567A37B"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id8905AB9310B94903B77AFE991F28F1A9"><enum>(I)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">human rights violations</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">serious human rights abuse or violations of internationally recognized human rights</header-in-text></quote>; and</text></subclause><subclause id="idB78AA6FC493E4A05AA902EB898BB0F97"><enum>(II)</enum><text>by striking <quote>described in paragraph (1) or (2) of subsection (a)</quote> and inserting <quote>described in subsection (a)(1) relating to serious human rights abuse or any violation of internationally recognized human rights</quote>; and</text></subclause></clause><clause id="idF1CF6C493B8846369A5758A66E9E86D0"><enum>(ii)</enum><text>in subparagraph (B), in the matter preceding clause (i), by striking <quote>described in paragraph (3) or (4) of subsection (a)</quote> and inserting <quote>described in subsection (a)(1) relating to corruption or the transfer or facilitation of the transfer of the proceeds of corruption</quote>.</text></clause></subparagraph></paragraph><paragraph id="id113D2512CBEF491499D8AB5EEB910CB6"><enum>(5)</enum><header>Termination of sanctions</header><text>Subsection (g) of such section is amended, in the matter preceding paragraph (1), by inserting <quote>and the immediate family members of that person</quote> after <quote>a person</quote>.</text></paragraph></subsection><subsection id="id034D8320ED8C4F6E919338BA61889AC8"><enum>(d)</enum><header>Reports to Congress</header><text>Section 1264(a) of the Global Magnitsky Human Rights Accountability Act (Subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) is amended—</text><paragraph id="idB6054DCA71A345BB912587130A11CDBC"><enum>(1)</enum><text>in paragraph (5), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="idA7213A0D1CE94C6BA51CBBD90DDDD2CB"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idF089A053FB62401E9BA81D079CFF7F88"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id805A81AB93D54769B8D756AFD9CA43E0"><paragraph id="idb1f98c961388464e9a3a45dc16c39472"><enum>(7)</enum><text>A description of additional steps taken by the President through diplomacy and assistance to foreign or security sectors to address persistent underlying causes of serious human rights abuse, violations of internationally recognized human rights, and corruption in each country in which foreign persons with respect to which sanctions have been imposed under section 1263 are located.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7C01952B7F9E4E4B8232695594F23CC3"><enum>(e)</enum><header>Repeal of sunset</header><text>Section 1265 of the Global Magnitsky Human Rights Accountability Act (Subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) is repealed.</text></subsection></section></legis-body></bill>
