which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to ensure that the 2021 recovery rebates as provided for in the American Rescue Plan Act are not provided to prison inmates convicted of rape and that such sums shall be redirected to the Department of Justice to be paid out in the form of restitution to compensate victims of crime. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Prohibiting 2021 Recovery Rebates from being provided to certain prisoners</header><subsection id="id95FEC1BD625245E79FBA0652EBA62463"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6428B">Section 6428B</external-xref> of the Internal Revenue Code of 1986, as added by section 9601 of the American Rescue Plan Act of 2021, is amended—</text><paragraph id="idEFEE9BFFB6764DDAA9598FBD0AEB381F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (h) and (i) as subsections (i) and (j), respectively;</text></paragraph><paragraph id="idB2AD22B50FC84D3BA40C4635008D460B"><enum>(2)</enum><text>in subsection (j), as so redesignated, by striking <quote>subsection (h)(1)</quote> each place it appears and inserting <quote>subsection (i)(1)</quote>; and</text></paragraph><paragraph id="id0284E76DED9D491DB46FC8DE51D1FB9A"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFF68D903B82F4379AC2C63B5AB89ACE7"><subsection id="id2A97236BE1404644957ED4FFAD08D533"><enum>(h)</enum><header>Special rules with respect to certain prisoners</header><paragraph id="id81B27F17BD534380B76FA3F8AED15F78"><enum>(1)</enum><header>Disallowance of credit</header><subparagraph id="idCD9D3C8C8DF9439294B4E5BE033BB29E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), no credit shall be allowed under subsection (a) to an eligible individual who is, for each day during calendar year 2021—</text><clause id="id9b0eb55fea70421f986f63073005334f"><enum>(i)</enum><text>confined in a jail, prison, or other penal institution or correctional facility pursuant to the conviction of the individual for a rape offense under Federal or State law; or </text></clause><clause id="id9c17cebaa6ee4a989b46c4bc081d3aed"><enum>(ii)</enum><text>is confined by court order in an institution at public expense in connection with—</text><subclause id="idc9cb2bbfebed44708e6c8deeccb85aab"><enum>(I)</enum><text>a verdict or finding that the individual is guilty but insane, with respect to a rape offense under Federal or State law;</text></subclause><subclause id="ida8fb22aec1e14ec9bdf941ee41bbec65"><enum>(II)</enum><text>a verdict or finding that the individual is not guilty of such an offense by reason of insanity;</text></subclause><subclause id="id3f726177975f482587ff11ce9d39641a"><enum>(III)</enum><text>a finding that such individual is incompetent to stand trial under an allegation of such an offense; or</text></subclause><subclause id="id4ec8fcc961584b0396bd85701c371ae9"><enum>(IV)</enum><text>a similar verdict or finding with respect to such an offense based on similar factors (such as a mental disease, a mental defect, or mental incompetence).</text></subclause></clause></subparagraph><subparagraph id="id5598D40680AB40D6817F9DD0047024A9"><enum>(B)</enum><header>Joint return</header><text>In the case of eligible individuals filing a joint return where 1 spouse is described in subparagraph (A), subsection (b)(1) shall be applied by substituting <quote>$1,400</quote> for <quote>$2,800</quote>.</text></subparagraph></paragraph><paragraph id="idA265A84A46C2422EB139665BD0F79F0C"><enum>(2)</enum><header>Denial of advance refund or credit</header><text>No refund or credit shall be made or allowed under subsection (g) with respect to any individual whom the Secretary has knowledge is, at the time of any determination made pursuant to paragraph (3) of such subsection, described in clause (i) or (ii) of paragraph (1)(A) of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC31A37CF9E0742EAB9E29EE6ADCF9DD4"><enum>(b)</enum><header>Crime Victims Fund</header><paragraph id="id169F8AEC68E44ECC9A7437C422B90964"><enum>(1)</enum><header>In general</header><text>There are transferred to the Crime Victims Fund, established under section 1402 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101</external-xref>), out of any money in the Treasury not otherwise obligated, an amount equal to the total reduction in outlays by reason of the amendment made by subsection (a). </text></paragraph><paragraph id="id56EB07E0ACAA4728BF9C37E015760E53"><enum>(2)</enum><header>Use of funds</header><text>Any amount transferred to the Crime Victims Fund under paragraph (1) shall be merged with and be available for the same purposes as amounts deposited in the Crime Victims Fund under section 1402(b) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101(b)</external-xref>). </text></paragraph></subsection><subsection id="id6443B48952444C57815F72FE04F95465"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of section 9601 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>). </text></subsection></section></legis-body></bill>
