<section section-type="section-one" id="id59CFCDCA618C4146B7E94D70878705E9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recycling Enhancements to Collection and Yield through Consumer Learning and Education Act of 2021</short-title></quote> or the <quote><short-title>RECYCLE Act of 2021</short-title></quote>.</text></section> <section id="id7CED54F092744687986FEF33B6ADBB38"><enum>2.</enum><header>Definition of Administrator</header><text display-inline="no-display-inline">In this Act, the term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></section>
<section id="idD8BFCCAD88024FDF9D685669F13C183B"><enum>3.</enum><header>Consumer recycling education and outreach grant program</header>
<subsection id="id086DAA7AD7994CDDA50F2B5A07C774CF"><enum>(a)</enum><header>In general</header><text>The Administrator shall establish a program (referred to in this section as the <term>grant program</term>) to award competitive grants to eligible entities to improve the effectiveness of residential and community recycling programs through public education and outreach.</text></subsection> <subsection id="id2DC4D86D4C004A04AFF417809E51DD15"><enum>(b)</enum><header>Criteria</header><text>The Administrator shall award grants under the grant program for projects that, by using one or more eligible activities described in subsection (e)—</text>
<paragraph id="id531c59a119d446f2bad0901c07536995"><enum>(1)</enum><text>inform the public about residential or community recycling programs;</text></paragraph> <paragraph id="id404cfaea255749c5b66f8b25abdf029e"><enum>(2)</enum><text>provide information about the recycled materials that are accepted as part of a residential or community recycling program that provides for the separate collection of residential solid waste from recycled material; and</text></paragraph>
<paragraph id="idc5b47d5506534ffe9d2a4e3c23ee98e8"><enum>(3)</enum><text>increase collection rates and decrease contamination in residential and community recycling programs.</text></paragraph></subsection> <subsection id="id1AAB913E2F154EFA8AFBECCDC59EAD66"><enum>(c)</enum><header>Eligible entities</header> <paragraph id="id4A6D22E3D4C5481196D108C56A9448B7"><enum>(1)</enum><header>In general</header><text>An entity that is eligible to receive a grant under the grant program is—</text>
<subparagraph id="id854089D5EC9D40289B5B0F6D19FC6B5F"><enum>(A)</enum><text>a State;</text></subparagraph> <subparagraph id="id4A062010FE124CAE972C7AE65AB2556F"><enum>(B)</enum><text>a unit of local government;</text></subparagraph>
<subparagraph id="idFF861A92871A406F8EC0D4CA40F22C85"><enum>(C)</enum><text>a Tribal government;</text></subparagraph> <subparagraph id="idEF169432E8E341118F577A8F3502BF5C"><enum>(D)</enum><text>a nonprofit organization; or</text></subparagraph>
<subparagraph id="idA4B0681263134B058F63ABC0BD66ABE1"><enum>(E)</enum><text>a public-private partnership.</text></subparagraph></paragraph> <paragraph id="id5D5485D817C74B648BB5C2C26AB253AA"><enum>(2)</enum><header>Coordination of activities</header><text>Two or more entities described in paragraph (1) may receive a grant under the grant program to coordinate the provision of information to residents that may access two or more residential recycling programs, including programs that accept different recycled materials, to provide to the residents information regarding differences among those residential recycling programs.</text></paragraph></subsection>
<subsection id="id4F673D1679E245C0B0FBB5E3D64BB3D3"><enum>(d)</enum><header>Requirement</header>
<paragraph id="id59E9601DF4DF40EB804B549DF329ED1F"><enum>(1)</enum><header>In general</header><text>To receive a grant under the grant program, an eligible entity shall demonstrate to the Administrator that the grant funds will be used to encourage the collection of recycled materials that are sold to an existing or developing market.</text></paragraph> <paragraph id="id2758B90B1715471FAC5C59EB5F8E494A"><enum>(2)</enum><header>Business plans and financial data</header> <subparagraph id="idE52E67F40D2D40539CECD4BCE31DF947"><enum>(A)</enum><header>In general</header><text>An eligible entity may make a demonstration under paragraph (1) through the submission to the Administrator of appropriate business plans and financial data.</text></subparagraph>
<subparagraph id="id9800838D73034184AB516CA0379B6F4B"><enum>(B)</enum><header>Confidentiality</header><text>The Administrator shall treat any business plans or financial data received under subparagraph (A) as confidential information.</text></subparagraph></paragraph></subsection> <subsection id="idB293D7540B4049AC99B92928935403C2"><enum>(e)</enum><header>Eligible activities</header><text>An eligible entity that receives a grant under the grant program may use the grant funds for activities including—</text>
<paragraph id="id4e80b472edca443c8cda5b5c78776bfd"><enum>(1)</enum><text>public service announcements;</text></paragraph> <paragraph id="id0603efc3c430400fba48f65757f08dd6"><enum>(2)</enum><text>a door-to-door education and outreach campaign;</text></paragraph>
<paragraph id="id6b8b65711875482997027d7c27d43111"><enum>(3)</enum><text>social media and digital outreach;</text></paragraph> <paragraph id="iddceb9f14aa414aa9a6a35405c9cae69c"><enum>(4)</enum><text>an advertising campaign on recycling awareness;</text></paragraph>
<paragraph id="id9d5a1cc6d5394aabb791e63085105f24"><enum>(5)</enum><text>the development and dissemination of—</text> <subparagraph id="id1B58E414B3E34EAB97D019528672DFF2"><enum>(A)</enum><text>a toolkit for a municipal and commercial recycling program;</text></subparagraph>
<subparagraph id="id0d92d1093ba04f59aad8a425271b53c4"><enum>(B)</enum><text>information on the importance of quality in the recycling stream;</text></subparagraph> <subparagraph id="id3eac512dcd05465399b91de5fe22567d"><enum>(C)</enum><text>information on the economic and environmental benefits of recycling; and</text></subparagraph>
<subparagraph id="idafb43008e675449882ddcf246ce1e9d3"><enum>(D)</enum><text>information on what happens to materials after the materials are placed into a residential or community recycling program;</text></subparagraph></paragraph> <paragraph id="id9f03d81fa8274720a03d9e59526571ed"><enum>(6)</enum><text>businesses recycling outreach;</text></paragraph>
<paragraph id="id0d30a5a6874d4d75952e7631b09f78f2"><enum>(7)</enum><text>bin, cart, and other receptacle labeling and signs; and</text></paragraph> <paragraph id="ide9e7e3ab694d45aca8ba9d6949ea8655"><enum>(8)</enum><text>such other activities that the Administrator determines are appropriate to carry out the purposes of this section.</text></paragraph></subsection>
<subsection id="id57DD1D30F1E24DFCA6D0250DB719385A"><enum>(f)</enum><header>Prohibition on use of funds</header><text>No funds may be awarded under the grant program for a residential recycling program that—</text> <paragraph id="id8e7a38422b494caeb8e16dad9af268a5"><enum>(1)</enum><text>does not provide for the separate collection of residential solid waste (as defined in section 246.101 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act)) from recycled material (as defined in that section), unless the funds are used to promote a transition to a system that separately collects recycled materials; or</text></paragraph>
<paragraph id="id9d284e2c56894da09debb587b246efc4"><enum>(2)</enum><text>promotes the establishment of, or conversion to, a residential collection system that does not provide for the separate collection of residential solid waste from recycled material (as those terms are defined under paragraph (1)).</text></paragraph></subsection> <subsection id="id5c46c656a2cc4a95969bd0ebc6c8dd6e"><enum>(g)</enum><header>Model recycling program toolkit</header> <paragraph id="id8CDA6005ABD04FFE82918A0348C52153"><enum>(1)</enum><header>In general</header><text>In carrying out the grant program, the Administrator, in consultation with other relevant Federal agencies, States, Indian Tribes, units of local government, nonprofit organizations, and the private sector, shall develop a model recycling program toolkit for States, Indian Tribes, and units of local government that includes, at a minimum—</text>
<subparagraph id="id8a401ea6ea1b470ba163d3d78d6bfeed"><enum>(A)</enum><text>a standardized set of terms and examples that may be used to describe materials that are accepted by a residential recycling program;</text></subparagraph> <subparagraph id="id7afc83faa2ab473684974d6df02fc3aa"><enum>(B)</enum><text>information that the Administrator determines can be widely applied across residential recycling programs, taking into consideration the differences in recycled materials accepted by residential recycling programs;</text></subparagraph>
<subparagraph id="id79eaafc06c1249cb8553a961ba7bf4ed"><enum>(C)</enum><text>educational principles on best practices for the collection and processing of recycled materials;</text></subparagraph> <subparagraph id="idd122821630ac424c9f455d8607e01bcb"><enum>(D)</enum><text>a community self-assessment guide to identify gaps in existing recycling programs;</text></subparagraph>
<subparagraph id="idab0db9f3833345f086a8330130e148a8"><enum>(E)</enum><text>training modules that enable States and nonprofit organizations to provide technical assistance to units of local government;</text></subparagraph> <subparagraph id="id35a8633fd695495bbc6d4e92b7fceef4"><enum>(F)</enum><text>access to consumer educational materials that States, Indian Tribes, and units of local government can adapt and use in recycling programs; and</text></subparagraph>
<subparagraph id="id678b02243f334112971bce046e259d1d"><enum>(G)</enum><text>a guide to measure the effectiveness of a grant received under the grant program, including standardized measurements for recycling rates and decreases in contamination.</text></subparagraph></paragraph> <paragraph id="id3FCFBFCAECBE4C65A62AEC3E53FE15F5"><enum>(2)</enum><header>Requirement</header><text>In developing the standardized set of terms and examples under paragraph (1)(A), the Administrator may not establish any requirements for—</text>
<subparagraph id="idCF1724A325E94002924AABC6C4007D17"><enum>(A)</enum><text>what materials shall be accepted by a residential recycling program; or</text></subparagraph> <subparagraph id="idC598A8D49A324B74B056E32A7AF2AA3F"><enum>(B)</enum><text>the labeling of products.</text></subparagraph></paragraph></subsection>
<subsection id="id056f7d0f99a04bd19a2205b3c73aa726"><enum>(h)</enum><header>School curriculum</header><text>The Administrator shall provide assistance to the educational community, including nonprofit organizations, such as an organization the science, technology, engineering, and mathematics program of which incorporates recycling, to promote the introduction of recycling principles and best practices into public school curricula.</text></subsection> <subsection id="idbae5a56aec894f108a8db28a48129df9"><enum>(i)</enum><header>Reports</header> <paragraph id="idC58E933F366140E5AA8977D2F7C4673F"><enum>(1)</enum><header>To the Administrator</header><text>Not earlier than 180 days, and not later than 2 years, after the date on which a grant under the grant program is awarded to an eligible entity, the eligible entity shall submit to the Administrator a report describing, by using the guide developed under subsection (g)(1)(G)—</text>
<subparagraph id="idF80C6F99D17D4F1CB57BD6E83091A47B"><enum>(A)</enum><text>the change in volume of recycled material collected through the activities funded with the grant;</text></subparagraph> <subparagraph id="id19DEC475DE674B76AEC4C2B67829F640"><enum>(B)</enum><text>the change in participation rate of the recycling program funded with the grant;</text></subparagraph>
<subparagraph id="idB49D8E2ABC3C4A1AA04AEE1BBDB0C2B7"><enum>(C)</enum><text>the reduction of contamination in the recycling stream as a result of the activities funded with the grant; and</text></subparagraph> <subparagraph id="idB328EBBB4E7B4D2DAB12068D220593C8"><enum>(D)</enum><text>such other information as the Administrator determines to be appropriate.</text></subparagraph></paragraph>
<paragraph id="id4A5D1EA4AC964B73818833F586EC54EB"><enum>(2)</enum><header>To Congress</header><text>The Administrator shall submit to Congress an annual report describing—</text> <subparagraph id="id74EE31DE652C46BAA7323EF46FDF04CC"><enum>(A)</enum><text>the effectiveness of residential recycling programs awarded funds under the grant program, including statistics comparing the quantity and quality of recycled materials collected by those programs, as described in the reports submitted to the Administrator under paragraph (1); and</text></subparagraph>
<subparagraph id="idF6E016865D9E47E78C48F838DC09527B"><enum>(B)</enum><text>recommendations on additional actions to improve residential recycling.</text></subparagraph></paragraph></subsection></section> <section id="ide701e3bcb0194720b29d8dd0876798ed"><enum>4.</enum><header>Federal procurement</header><text display-inline="no-display-inline">Section 6002 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6962">42 U.S.C. 6962</external-xref>) is amended—</text>
<paragraph id="idF2EB2590D73443B29723CD175DC186F0"><enum>(1)</enum><text>in subsection (e), in the matter preceding paragraph (1), by striking <quote>and from time to time, revise</quote> and inserting <quote>review not less frequently than once every 5 years, and, if appropriate, revise, in consultation with recyclers and manufacturers of products containing recycled content, not later than 2 years after the completion of the initial review after the date of enactment of the <short-title>Recycling Enhancements to Collection and Yield through Consumer Learning and Education Act of 2021</short-title> and thereafter, as appropriate</quote>; and</text></paragraph> <paragraph id="id70708AF9D45C4BD5AFBDB3DC3C6AC690"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="id22FD65B5B66C44CC8E75E834F428E42A"><enum>(j)</enum><header>Consultation and provision of information by Administrator</header><text>The Administrator shall—</text> <paragraph id="id66E9A35FAEF441E88270CDD97B08AA65"><enum>(1)</enum><text>consult with each procuring agency, including contractors of the procuring agency, to clarify the responsibilities of the procuring agency under this section; and</text></paragraph>
<paragraph id="idA249BF0DDA8F45199356BCCA3ED7529B"><enum>(2)</enum><text>provide to each procuring agency information on the requirements under this section and the responsibilities of the procuring agency under this section.</text></paragraph></subsection> <subsection id="id730a34aa2c694f899ec01d678c72d6d1"><enum>(k)</enum><header>Reports</header><text>The Administrator, in consultation with the Administrator of General Services, shall submit to Congress an annual report describing—</text>
<paragraph id="id511CC550890C4A6B848756D2C3DCBBB9"><enum>(1)</enum><text>the quantity of federally procured recycled products listed in the guidelines under subsection (e); and</text></paragraph> <paragraph id="idE0B1AE13BF094F23BDB287F5370A7E4D"><enum>(2)</enum><text>with respect to the products described in paragraph (1), the percentage of recycled material in each product.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="idd942aabfdbc2421b9487183b1b623eee"><enum>5.</enum><header>Authorization of appropriations</header>
<subsection id="id11904F00B5D74C2B838298F038628D09"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator to carry out this Act and the amendments made by this Act $15,000,000 for each of fiscal years 2022 through 2026.</text></subsection> <subsection id="id79E61967EAF94E0B8FA87916C366EB7B"><enum>(b)</enum><header>Requirement</header><text>Of the amount made available under subsection (a) for a fiscal year, not less than 10 percent shall be allocated to low-income communities (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986).</text></subsection></section>
