<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 921</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 18, United States Code, to further protect officers and employees of the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id08a0b0c7-8088-40e4-a7e2-6a1ea9bfa5ec" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jaime Zapata and Victor Avila Federal Officers and Employees Protection Act</short-title></quote>.</text></section><section id="idb613bdab-9be6-41fd-854f-298b05ac03c8" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id06eff136-9c95-4dc6-acf2-73f13866e38c" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">since the founding of the Nation, officers and employees of the United States Government have dutifully and faithfully served the United States overseas, including in situations that place them at serious risk of death or bodily harm, in order to preserve, protect, and defend the interests of the United States;</text></paragraph><paragraph id="id57e816ff-b0c3-4882-99fd-3af3a68af6c3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">securing the safety of such officers and employees while serving overseas is of paramount importance and is also in furtherance of preserving, protecting, and defending the interests of the United States;</text></paragraph><paragraph id="id77de925e-eede-41d0-b4ca-65e69c03ed39" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">Federal courts, including the United States Court of Appeals for the Second Circuit, the United States Court of Appeals for the Ninth Circuit, and the United States Court of Appeals for the Eleventh Circuit, have correctly interpreted section 1114 of title 18, United States Code, to apply extraterritorially to protect officers and employees of the United States while the officers and employees are serving abroad;</text></paragraph><paragraph id="idD9B7CEFEDF6C466F8DE9190A5B7443CB" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">in a case involving a violent attack against Federal law enforcement officers Jaime Zapata and Victor Avila, a panel of a Federal court of appeals held that section 1114 of title 18, United States Code, does not apply extraterritorially, creating a split among the United States circuit courts of appeals; </text></paragraph><paragraph id="id15BCEB3C11C54F71A700AEDC1B0F302D" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">in light of the opinion described in paragraph (4), it has become necessary for Congress to clarify the original intent that section 1114 of title 18, United States Code, applies extraterritorially; and</text></paragraph><paragraph id="id3648b4d5f6a942928d9f8822fa08f7f1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(6)</enum><text display-inline="yes-display-inline">it is further appropriate to clarify the original intent that sections 111 and 115 of title 18, United States Code, apply extraterritorially as well. </text></paragraph></section><section id="id6de6f481-ae03-44b8-a655-b1870d0db83e" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Protection of officers and employees of the United States</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text><paragraph id="id74AD80CD2F784751AE76CB4AA979F869" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in section 111, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id477FD7596E7449CF8B09D7265E9B64C5" changed="not-changed"><subsection id="id5AD88675887B43B1BDCEAE27243B3D4A" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Extraterritorial jurisdiction</header><text display-inline="yes-display-inline">There is extraterritorial jurisdiction over the conduct prohibited by this section.</text></subsection><after-quoted-block display="yes">; </after-quoted-block></quoted-block></paragraph><paragraph id="idB737FA779104417A8989E7618C3DCC38" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in section 115, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38A06C56FB4F408C8B068FC778EA9D13" changed="not-changed"><subsection id="idA68AC3C4ED3F48C28E2CDC36B5C62E09" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(e)</enum><text display-inline="yes-display-inline">There is extraterritorial jurisdiction over the conduct prohibited by this section.</text></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1578831470FB4FBBB5A064829B9C1647" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1114—</text><subparagraph id="idbc5e09a6-0d6f-4262-9aef-7c340747f984" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(a) <header-in-text level="subsection" style="USC">In general</header-in-text>.—</quote> before <quote>Whoever</quote>;
