<subsection id="idCA376CD2C76B400686CDF5C0A8088238"><enum>(a)</enum><header>Clean water programs</header>
<paragraph id="idE6CF4661068F401488A731DF50103B9A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">At the beginning of each fiscal year, the Administrator of the Environmental Protection Agency (referred to in this section as the <quote>Administrator</quote>) shall obligate, for the fiscal year—</text> <subparagraph id="id47772B7E62E24E7C9B37054F014BA7F0"><enum>(A)</enum><text display-inline="yes-display-inline">not more than $174,250,000 for making grants under section 104(b)(8) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(b)(8)</external-xref>);</text></subparagraph>
<subparagraph id="id92BE6B4060A44C77A29B9D25F51D7DD5"><enum>(B)</enum><text>not more than $522,750,000 for making grants under section 106 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256</external-xref>);</text></subparagraph> <subparagraph id="id1615EA9AA08642B18390207FA68FEB69"><enum>(C)</enum><text display-inline="yes-display-inline">not more than $871,250,000 for making grants under section 222 of that Act (as added by section 5);</text></subparagraph>
<subparagraph id="idDA1372CA839D45B49FDCAA12993F96AB"><enum>(D)</enum><text display-inline="yes-display-inline">not more than $871,250,000 for making grants under section 319 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1329">33 U.S.C. 1329</external-xref>); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idBC787EAD36B1449C853255107C258A54"><enum>(E)</enum><text display-inline="yes-display-inline">not more than $15,682,500,000 for making capitalization grants under section 601 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id5BB211395F9F4AFEB67E72837AF1C92E"><enum>(2)</enum><header>Funding</header><text>On October 1 of each fiscal year, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Administrator to carry out this subsection $18,122,000,000, to remain available until expended.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id6ADAC907F1FA46A2AD7332A8CC666B42"><enum>(3)</enum><header>Availability of funds</header><text>Amounts transferred to the Administrator under paragraph (2) and obligated by the Administrator under paragraph (1) shall remain available to the Administrator, without further appropriation or fiscal year limitation, for the purposes for which the amounts were obligated.</text></paragraph></subsection>
<subsection id="id04FAE189BDF6444DBB43F21CEE8A3E8E"><enum>(b)</enum><header>Safe drinking water funding</header>
<paragraph id="id9D9B2C5E094C48A09D9B0CB6B6F11B99"><enum>(1)</enum><header>In general</header><text>At the beginning of each fiscal year, the Administrator shall obligate, for the fiscal year—</text> <subparagraph id="id301A895F5667427EB3418D6B3EEB22B0"><enum>(A)</enum><text display-inline="yes-display-inline">not more than $174,250,000 for providing technical assistance under section 1442(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1(e)</external-xref>);</text></subparagraph>
<subparagraph id="idD6BC407FEF0E4FF59D53D23EA12E8A3F"><enum>(B)</enum><text display-inline="yes-display-inline">not more than $15,159,750,000 for making capitalization grants under section 1452 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idBFB9CAEED608454381F6AA6CF76AC09E"><enum>(C)</enum><text display-inline="yes-display-inline">not more than $1,045,500,000 for making grants under section 1465 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idE0562A03D68946D19EEC0D06F170188D"><enum>(2)</enum><header>Funding</header><text>On October 1 of each fiscal year, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Administrator to carry out this subsection $16,379,500,000, to remain available until expended.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id90A24D5CD8914CBF92BD34C4D4A973F2"><enum>(3)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">Amounts transferred to the Administrator under paragraph (2) and obligated by the Administrator under paragraph (1) shall remain available to the Administrator, without further appropriation or fiscal year limitation, for the purposes for which the amounts were obligated.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="idB7BB92DE90FF4C91A3F7B31211E4F2B3"><enum>(c)</enum><header display-inline="yes-display-inline">Household water well systems</header>
<paragraph commented="no" display-inline="no-display-inline" id="id706BA2B022C14961BCEB6ED426CE6FCC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">At the beginning of each fiscal year, the Secretary of Agriculture (referred to in this subsection as the <quote>Secretary</quote>) shall obligate, for the fiscal year, not more than $348,500,000 for making grants under section 306E of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id52840538693B40CA868A4233EA566EA6"><enum>(2)</enum><header>Funding</header><text>On October 1 of each fiscal year, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this subsection $348,500,000, to remain available until expended.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idA63A47449373432883473421597EB166"><enum>(3)</enum><header>Availability of funds</header><text>Amounts transferred to the Secretary under paragraph (2) and obligated by the Secretary under paragraph (1) shall remain available to the Secretary, without further appropriation or fiscal year limitation, for the purposes for which the amounts were obligated.</text></paragraph></subsection></section> <section id="HE1BEE83E10D14033987201DF9564243E"><enum>3.</enum><header>Report on affordability, discrimination and civil rights violations, public participation in regionalization, and data collection</header> <subsection id="HF30D714976744341993173EB04595EE2"><enum>(a)</enum><header>Study</header> <paragraph id="H3E650F1DD6B9451E86007D5F3556D6D0"><enum>(1)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency (referred to in this section as the <quote>Administrator</quote>) shall conduct a study on water and sewer services.</text></paragraph>
<paragraph id="HCFB226EF394F4B5EA291CE00F0BE5DD0"><enum>(2)</enum><header>Affordability</header><text>In conducting the study under paragraph (1), the Administrator shall study water affordability nationwide, including—</text> <subparagraph id="H0180241E7170484680B79F43DEEE7D09"><enum>(A)</enum><text display-inline="yes-display-inline">rates for water and sewer services, increases in those rates during the 10-year period ending on the date on which the Administrator begins to carry out the study, and water service disconnections due to unpaid water service charges; and</text></subparagraph>
<subparagraph id="H9DDFDC2C28F34C8CBD9AF888DF67FC74"><enum>(B)</enum><text display-inline="yes-display-inline">for promoting affordable, equitable, transparent, and reliable water and sewer service, the effectiveness of funding under—</text> <clause id="id655C557CA5F84C05969CF62012098384"><enum>(i)</enum><text display-inline="yes-display-inline">section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text></clause>
<clause id="idA0D45481ABA94E48ACEB3B6567950C11"><enum>(ii)</enum><text display-inline="yes-display-inline">section 601 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref>)</text></clause></subparagraph></paragraph> <paragraph id="H62B40BCD55CA4A9797BACB3EE132AB58"><enum>(3)</enum><header>Discrimination and civil rights</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator, in collaboration with the Civil Rights Division of the Department of Justice, shall study—</text>
<subparagraph id="H1806B1C4024A431B9AC55EFDC759A9CE"><enum>(A)</enum><text>discriminatory practices of water and sewer service providers; and</text></subparagraph> <subparagraph id="H3AF2530D3AD84AC488DFB41621E127BF"><enum>(B)</enum><text display-inline="yes-display-inline">violations by water and sewer service providers that receive Federal assistance of civil rights under title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref> et seq.) with respect to equal access to water and sewer services.</text></subparagraph></paragraph>
<paragraph id="H4CCF24CE0BDA47A1857790F4329A4D32"><enum>(4)</enum><header>Public participation in regionalization</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall evaluate efforts to regionalize public water systems (as defined in section 1401 of the Safe Water Drinking Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)) and sewer services with respect to public participation in—</text> <subparagraph id="H0F23E2B582CC47ACA5776E2E0AA535C7"><enum>(A)</enum><text>the decision to undergo the regionalization; and</text></subparagraph>
<subparagraph commented="no" id="H5A2F602D7EBD4CEEAE4D42AD28FFA864"><enum>(B)</enum><text>decisionmaking by the board of directors (or other governing body) of the entity that provides, or oversees or coordinates the provision of, water by the public water systems subject to the regionalization.</text></subparagraph></paragraph> <paragraph id="HB7778EDE75B1453F93895330BD83ACF6"><enum>(5)</enum><header>Data collection</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall collect information, assess the availability of information, and evaluate the methodologies used to collect information, related to—</text>
<subparagraph id="HB291A1AABC9445F3ABF0C6B0FBD33931"><enum>(A)</enum><text>people living without water or sewer services;</text></subparagraph> <subparagraph id="HE3291D3E881D4CE8B2F372B72DABAD40"><enum>(B)</enum><text display-inline="yes-display-inline">water service disconnections due to unpaid water service charges, including disconnections experienced by households containing children, elderly persons, disabled persons, chronically ill persons, or other vulnerable populations; and</text></subparagraph>
<subparagraph id="HDED400D33E544FF5BE1F34BE35FAA0D3"><enum>(C)</enum><text display-inline="yes-display-inline">disparate effects, on the basis of race, gender, or socioeconomic status, of water service disconnections and the lack of public water service.</text></subparagraph></paragraph></subsection> <subsection id="H0C58985FAD674B669361CDD3B28A3195"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to Congress a report that contains—</text>
<paragraph id="H3C2137D8CD15430CA37D719597ED2045"><enum>(1)</enum><text>the results of the study under subsection (a)(1); and</text></paragraph> <paragraph id="HFD8FF92C895942249F54F28C9603E3C6"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for utility companies, Federal agencies, and States with respect to the results of the study.</text></paragraph></subsection></section>
<section commented="no" id="H44B9E7B818854EB18E1B66E0F09C09FB"><enum>4.</enum><header>Technical assistance to rural and small municipalities and Tribal governments</header><text display-inline="no-display-inline">Section 104(u)(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(u)(7)</external-xref>) is amended by striking <quote>not to exceed $25,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$175,000,000 for each of fiscal years 2021 through 2025</quote>.</text></section> <section id="HE713C3717F374CD09B4311C5589E8332"><enum>5.</enum><header>Residential onsite sewage disposal system improvement</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HE609D6B3B67142D58A58782C9979495B">
<section id="HC19CAE7235A1449FAD0337ED0E226B18"><enum>222.</enum><header>Residential onsite sewage disposal systems</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this section, the Administrator shall establish a grant program to make grants to users of a septic tank and drainage field for costs associated with repairing, replacing, or upgrading the septic tank and drainage field.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HCE984CAD9C2348B99CD7CAFF20AFBBA1"><enum>6.</enum><header>Household water well systems</header><text display-inline="no-display-inline">Section 306E(d) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e(d)</external-xref>) is amended by striking <quote>$20,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$348,500,000 for each fiscal year</quote>.</text></section>
<section id="H829CBACA252D45598D1DA60B423CFBC5"><enum>7.</enum><header>State water pollution control revolving funds</header>
<subsection id="HC16F17AB857A4493888F28D25144DCE7"><enum>(a)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) is amended—</text> <paragraph id="HEE06236A8A38465494C23B7D4578D2AA"><enum>(1)</enum><text>in paragraph (2), by striking <quote>will be made to the State with funds to be made available</quote> and inserting <quote>were made to the State with funds made available for fiscal year 2021</quote>;</text></paragraph>
<paragraph id="HAE38401D27A74EAA9199DDAEF766BB65"><enum>(2)</enum><text>in paragraph (13)(B)(iii), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H9D5AB5CC9C314FDDA72B46B037EA39DF"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></paragraph>
<paragraph id="HDA585B4B70D64EF1A3011889DE9FF861"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE5D78D18E9DC45AEB46328D7A91B7546"> <paragraph id="HD6FF86D1EA9743C49D227B31A0D56AED"><enum>(15)</enum><text display-inline="yes-display-inline">the State will not provide financial assistance using amounts from the fund for any project that will provide substantial direct benefits to new communities, lots, or subdivisions, other than a project to construct an advanced decentralized wastewater system; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H2552310185344E00A0AB6DCE6DA1D001"><enum>(b)</enum><header>Projects and activities eligible for assistance</header><text display-inline="yes-display-inline">Section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended—</text> <paragraph id="H8845BF9657504C38A34934D8DAA51DDE"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11)(B), by striking <quote>and</quote> at the end;</text></paragraph>
<paragraph id="H84431DFFF853466FB1A3C8DEB5F35FAF"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (12)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H914F9D80D45B485C931C914879DBCD53"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H12093E1CA34F49C5ABF3513B6B64074B">
<paragraph commented="no" id="H6F7A0CE1E10C4B99A51D59B36BC6A874"><enum>(13)</enum><text display-inline="yes-display-inline">to any municipality or intermunicipal, interstate, or State agency for—</text> <subparagraph commented="no" id="HD431EF2F735A4D308BD7786FCD674FE9"><enum>(A)</enum><text>purchasing from a willing seller a privately owned treatment works for the purpose of bringing the treatment works into public ownership; and</text></subparagraph>
<subparagraph commented="no" id="HB708C9D094A648F4B20AAE361B64566D"><enum>(B)</enum><text display-inline="yes-display-inline">expenses related to canceling a contract for the operation or management of a publicly owned treatment works.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5B10199C06F24CDC9394614A9D3EA26D"><enum>(c)</enum><header>Increasing the amount of additional subsidization by the State</header><text display-inline="yes-display-inline">Section 603(i)(3) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)(3)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H426E7AF479CA47C4B00165FBEF24A4EE">
<subparagraph id="H2CD3CEAE4C6746EAB4F310E2BE4655D3"><enum>(B)</enum><header>Additional limitation</header><text display-inline="yes-display-inline">A State may use not less than 50 percent of the total amount received by the State in capitalization grants under this title for a fiscal year for providing additional subsidization under this subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H4778EA8094D54AF3A07C8CC0D65D258C"><enum>8.</enum><header>Use of State revolving loan funds under the Safe Drinking Water Act</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text>
<paragraph commented="no" id="HFC36725485A644FF91F555D33749639A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> <subparagraph commented="no" id="H10BE59DFFAD546F09216FEEAAB6B3997"><enum>(A)</enum><text>in paragraph (2)—</text>
<clause id="HDC100620B6844C568F9807F70EA5C64B"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>publicly owned, operated, and managed</quote> before <quote>community water systems</quote>; and</text></clause> <clause commented="no" id="H82D61905756D49C783DC5B8EDC563151"><enum>(ii)</enum><text>by striking subparagraph (E) and inserting the following:</text>

<subparagraph commented="no" id="id3A37221C6612412CBE225ED5E9725A79"><enum>(E)</enum><header>Acquisition of real property</header><text>The funds under this section may be used for—</text> <clause commented="no" id="id52D61A46A2154C0BB804F3911BC40E61"><enum>(i)</enum><text>purchasing from a willing seller a privately owned community water system for the purpose of bringing the community water system into public ownership; or</text></clause>
<clause commented="no" id="idBE3AAAD01EF04D15984C4D3B33D8D27A"><enum>(ii)</enum><text>for the expenses related to canceling a contract for the operation or management of a community water system.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HCB0EA4EFFBCB41F3AB4E4A5754C3E74B"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph commented="no" id="H47859EA86866487BB6944E9D18F94CEB"><enum>(6)</enum><header>Exception to public ownership, operation, and management requirement</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2)(A), a public water system that regularly serves fewer than 10,000 persons, and that is not owned, operated, or managed by any person who owns, operates, or manages any other public water system, may receive assistance under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" id="H82058B8F471844469DA166048BA478A9"><enum>(2)</enum><text>in subsection (d), by striking paragraph (2) and inserting the following:</text>

<clause id="id02740D9B7B0E4B8B9B2AADE98C7445B4"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide protections for households facing service disconnection due to unpaid water service charges; and</text></clause> <clause id="id4912FDDDC64E4059B6D9E207AEC042B9"><enum>(iii)</enum><text display-inline="yes-display-inline">to promote universal equal access to water services.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" id="H2E35B177B28841C682292786885D94F7"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (k)(1), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD99AB8CDE428494EBFAFFE0D68B9AEFA"> <subparagraph commented="no" id="HCD26A7E8837B441FB8816709D8A53B4D"><enum>(E)</enum><text>Provide assistance in the form of a grant to owners of private property on which a lead service line (as defined in section 1459B(a)) is or may be located, for the purpose of replacing the lead service line with a service line that is lead free (as defined in section 1417(d)).</text></subparagraph>
<subparagraph commented="no" id="HFD71D611442247CDA285D386ECF7DE82"><enum>(F)</enum><text>Provide assistance to a publicly owned, operated, and managed community water system for the purpose of updating a treatment plant or switching water sources due to contamination from per- and polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) (as defined by the State in which the community water system is located).</text></subparagraph> <subparagraph commented="no" id="H94B523A0E05D49EDB4E742720D91F81F"><enum>(G)</enum><text>Provide assistance in the form of a grant to an owner of a household water well that has been contaminated by per- and polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) (as defined by the State in which the household well is located) for the purpose of purchasing and installing a household filtration system.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HFF5C910A926243F1843FEA784B46F37B"><enum>9.</enum><header>Drinking water grant programs</header>
<subsection commented="no" display-inline="no-display-inline" id="H501F25F348774171A7220E031040C08C"><enum>(a)</enum><header>School drinking water improvement</header><text display-inline="yes-display-inline">Section 1465 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25</external-xref>) is amended—</text> <paragraph commented="no" id="HD3A52700DDB943EFB0F7E10C6BDD61CB"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">fountain</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">infrastructure</header-in-text></quote>;</text></paragraph>
<paragraph commented="no" id="H25BF23F7FEBD416698479895CD4029B8"><enum>(2)</enum><text>in subsection (a), by striking <quote>fountains manufactured prior to 1988</quote> and inserting <quote>infrastructure</quote>;</text></paragraph> <paragraph commented="no" id="HE99FDF38C2A84C53930BD53A812094B4"><enum>(3)</enum><text>by striking subsection (b) and inserting the following:</text>

<subsection commented="no" id="HDB691A0FDA6846F7B76D7923ECE7B703"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds awarded under the grant program may be used to pay costs associated with—</text> <paragraph commented="no" id="H76079B01D2E14DC597524842C6C51A16"><enum>(1)</enum><text>installing, repairing, or replacing the infrastructure necessary to ensure that drinking water fountains, drinking water coolers, and bottle filling stations at schools are lead free (as defined in section 1417(d)); and</text></paragraph>
<paragraph commented="no" id="H91ADD2F80A9B4824A537096EBD3E77BF"><enum>(2)</enum><text display-inline="yes-display-inline">monitoring and reporting of lead levels in the drinking water of schools, as determined appropriate by the Administrator.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HAAA60801ABD345C7A113BD78F784679D"><enum>(4)</enum><text>in subsection (d)—</text>
<subparagraph id="H2E0E65641DE34F93964110CCC7F821AE"><enum>(A)</enum><text>by striking <quote>$5,000,000</quote> and inserting <quote>$1,050,000,000</quote>; and</text></subparagraph> <subparagraph id="HD1286F10548F486AA7AE3FD003B70D4D" commented="no"><enum>(B)</enum><text>by striking <quote>fiscal years 2019 through 2021</quote> and inserting <quote>fiscal years 2021 through 2024</quote>.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="H6722C75EEB914C4B92B7606FF17D2DC2"><enum>(b)</enum><header>Tribal drinking water</header><text display-inline="yes-display-inline">Section 1452(i)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(i)(1)</external-xref>) is amended, in the first sentence—</text> <paragraph commented="no" id="H5BEE2198EB0443A8B6F1F2786BC10579"><enum>(1)</enum><text>by striking <quote>1 1/2</quote> and inserting <quote>3</quote>; and</text></paragraph>
<paragraph commented="no" id="H85265F03E9E7441C8F4166A8367AB66E"><enum>(2)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></paragraph></subsection></section> <section id="H11517E421F844D70B8C1B9B1B2057B1F"><enum>10.</enum><header>Requirement for the use of American materials in drinking water infrastructure</header><text display-inline="no-display-inline">Section 1452(a)(4)(A) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)(4)(A)</external-xref>) is amended by striking <quote>During fiscal years 2019 through 2023, funds</quote> and inserting <quote>Funds</quote>.</text></section>
<section id="HAE04DEF2084B4A1C99462559AA170D23"><enum>11.</enum><header>Labor provisions</header>
<subsection id="H98B462F67BA34E0AAFA1106BFDDB17AA"><enum>(a)</enum><header>Prevailing rate of wage</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act affects the applicability of the requirements relating to labor standards of sections 513 and 602(b)(6) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1372">33 U.S.C. 1372</external-xref>, 1382(b)(6)) and section 1450(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-9">42 U.S.C. 300j–9(e)</external-xref>) to projects carried out under those Acts.</text></subsection> <subsection id="HC348BA9B384F4E06AC0B293CB897427A"><enum>(b)</enum><header>Project labor agreements</header> <paragraph commented="no" id="HCA7A9AF653A64B819F22B691CE1DBC0A"><enum>(1)</enum><header>Clean water revolving funds</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) (as amended by section 7(a)) is amended by adding at the end the following:</text>

<paragraph commented="no" id="H72DFBE9B62004C49806FBCCEA84DDF4C"><enum>(16)</enum><text display-inline="yes-display-inline">the State will—</text> <subparagraph commented="no" id="HD7C661AD36DE4CE981B98BAA279F29BB"><enum>(A)</enum><text display-inline="yes-display-inline">permit recipients of assistance under this title to enter into agreements authorized under section 8(f) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(f)</external-xref>) (commonly known as <quote>project labor agreements</quote>) with respect to projects for building or construction carried out with that assistance; and</text></subparagraph>
<subparagraph commented="no" id="H45C0FD680C8640DE9FC260719515E4BE"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that, to the maximum extent practicable, recipients of assistance under this title carry out the projects through the use of the agreements described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H0511C9B91304498582F2B53FD50BA966"><enum>(2)</enum><header>Drinking water revolving funds</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text>
<subparagraph id="HA39D0CD819674BDEB736CCFBA3A825CE"><enum>(A)</enum><text>in subsection (a) (as amended by section 8(1)), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD453D65C76EB42E7923C08A4F28F1988"> <paragraph id="H66E8591D96DD4EAFB0712833333FF56C"><enum>(7)</enum><header>Project labor agreements</header><text display-inline="yes-display-inline">Each agreement under this subsection shall require that the State permit recipients of assistance under this section to enter into an agreement authorized under section 8(f) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(f)</external-xref>) (commonly known as a <quote>project labor agreement</quote>) with respect to projects for building or construction carried out with that assistance.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
