which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2DD51C7776344CA68397AC307334C4EC"><section section-type="section-one" id="H393B8691298B49F99133AF2F1BB1A468"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Oak Flat Act</short-title></quote>.</text></section><section id="HE45E23292D2743A79B9652E8F12778AF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="HB6F69525E7064697AA5582D1B6F464BD"><enum>(1)</enum><text display-inline="yes-display-inline">Section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>) authorizes Oak Flat, which is sacred to Indian Tribes in the region and is part of the larger Chí’chil Biłdagoteel Traditional Cultural Property listed in the National Register of Historic Places, to be transferred to Resolution Copper.</text></paragraph><paragraph id="id35D4D2AC96C2452EBB4BEB6FB4E18EC2"><enum>(2)</enum><text display-inline="yes-display-inline">Resolution Copper plans to hold Oak Flat privately for a mining project that will—</text><subparagraph id="idE6BB6A5CC80C480383B3AAC1CCE17CFC"><enum>(A)</enum><text display-inline="yes-display-inline">result in the physical destruction of Tribal sacred areas and deprive American Indians from practicing their religious ceremonies and other traditional practices;</text></subparagraph><subparagraph id="idCEE1750249194D729B437E28DC912B4B"><enum>(B)</enum><text display-inline="yes-display-inline">create significant negative environmental impacts by destroying Oak Flat and depleting and contaminating precious water resources; and</text></subparagraph><subparagraph id="idA648DB1340204AE2AAB9535EDA62743C"><enum>(C)</enum><text display-inline="yes-display-inline">require significant quantities of water, which will—</text><clause id="id6EA8A560B3BE43D0A79FF530284E1618"><enum>(i)</enum><text display-inline="yes-display-inline">likely affect the local hydrology, including the underlying aquifer; and</text></clause><clause id="id13C2DB9FDA584849A7FE2CE206991295"><enum>(ii)</enum><text display-inline="yes-display-inline">result in polluted water that will seep into drinking water supplies.</text></clause></subparagraph></paragraph><paragraph id="H2A491D61AB7D4B3AAAADA410E3803100"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE04FFF87C1AB4EEEBD0418CF6DB9DBA6"><enum>(A)</enum><text>Once Resolution Copper owns Oak Flat, Resolution Copper plans to use the highly destructive block cave mining method to remove 1 cubic mile of ore that (as of the date of enactment of this Act) is located 7,000 feet beneath the surface of the earth without replacing any of the earth removed, because that is the cheapest form of mining.</text></subparagraph><subparagraph id="idB846804919AC4B5ABAFB6D9397B2684C" indent="up1"><enum>(B)</enum><text>Resolution Copper admits that the surface of Oak Flat will subside and ultimately collapse, destroying forever the Tribal sacred areas described in paragraph (2)(A).</text></subparagraph></paragraph><paragraph id="H31C34CDC9A164AC28A8D2C4CF1EB2910"><enum>(4)</enum><text>The Tonto National Forest in which Oak Flat is located was established in 1905 from the ancestral homelands of American Indians, who were forcibly removed at gunpoint from Oak Flat and other areas of the Forest by the Army during the 1880s and held as prisoners of war until the early 1900s.</text></paragraph><paragraph id="H71A5088CC24B491ABAB677F33350D2E3"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id95D87282A7E44F33927B9D29490B3BB7"><enum>(A)</enum><text display-inline="yes-display-inline">Section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>)—</text><clause id="id34B2C733FAB54A6FAE059C3377250A6A" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">was included in that Act without proper legislative process, in a manner that circumvented the will of the majority of Members of Congress; and</text></clause><clause id="id38D0A99CC79946C49D7848992E3D5BBD" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">was originally introduced in the House of Representatives as H.R. 687 and in the Senate as S. 339 during the 113th Congress.</text></clause></subparagraph><subparagraph id="id92D149A9260B414ABA6D60C8F0F22E9A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">H.R. 687 was—</text><clause id="idEC546FFD074645D09AB0ADDE98B30CC3"><enum>(i)</enum><text display-inline="yes-display-inline">brought to the floor of the House of Representatives for consideration twice; and</text></clause><clause id="id16E9E2B650444E20B5FB59271E0A55E2"><enum>(ii)</enum><text display-inline="yes-display-inline">pulled from consideration each time.</text></clause></subparagraph><subparagraph id="id4679638211F74AE798CA3B974A8CFC8A" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">S. 339 was never considered—</text><clause id="idB8EE2DB07E4D4DD9831ECAB6FA3CE6AB"><enum>(i)</enum><text display-inline="yes-display-inline">by the Senate; or</text></clause><clause id="idA4CA0E3CBAB14A03B4B69626FDF94F32"><enum>(ii)</enum><text display-inline="yes-display-inline">for mark-up by the Committee on Energy and Natural Resources of the Senate.</text></clause></subparagraph><subparagraph id="id74825B3A38004299907F4706405BB510" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">Section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>) was included in that Act without majority support from either the House of Representatives or the Senate.</text></subparagraph><subparagraph id="idCD3A421C016C4F44871420C32DA49DCA" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">A proposed amendment to remove that section was not allowed to be considered before passage of the bill.</text></subparagraph></paragraph><paragraph id="HA1C28CCD492A4D9E80E60B2D08A177DE"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7BBD3A4A86BF4397A040FEA7C333FD53"><enum>(A)</enum><text>Indian Tribes have—</text><clause id="id50271094ECF2470FBE62659F116A4CCF" indent="up1"><enum>(i)</enum><text>ceded or had taken from the Tribes millions of acres of land to help build the United States; and</text></clause><clause id="id9C053466046A4350879B678B367F7E0E" indent="up1"><enum>(ii)</enum><text>suffered under Federal assimilationist policies that sought to destroy Tribal cultures.</text></clause></subparagraph><subparagraph id="id0B22BD6C8EA747798316AF6C55AF1FEE" indent="up1"><enum>(B)</enum><text>Despite those policies, American Indians continue to practice their religions as they have done for thousands of years.</text></subparagraph><subparagraph id="idB800CEA72DD84928B9625E802CC2187B" indent="up1"><enum>(C)</enum><text>American Indian places of worship, or sacred areas, are often land-based, including mountains, streams, and trees.</text></subparagraph><subparagraph id="idA5093844BE8E4EF2BC78EB8A8756CE3F" indent="up1"><enum>(D)</enum><text>As a result of previous Federal land policies that resulted in the significant loss of land of Indian Tribes, many sacred areas of the Tribes are currently located on Federal land.</text></subparagraph></paragraph><paragraph id="HA76E380407CF4919BBD5406424BE3B44"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5719035EF35D4EB0AE2FEFDF687687CE"><enum>(A)</enum><text>The United States has a trust responsibility acknowledged by Congress to protect Tribal sacred areas on Federal land, including pursuant to laws requiring meaningful consultation with affected Indian Tribes before making decisions that will impact American Indians; but</text></subparagraph><subparagraph id="id653B3FF63F514E69AF6E6ADB7A29714D" indent="up1"><enum>(B)</enum><text>in contradiction to those laws, section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>) requires the mandatory conveyance of a Tribal sacred area located on Federal land, regardless of the outcome of consultation with affected Indian Tribes.</text></subparagraph></paragraph><paragraph id="HE6FBBC605AED4CC8A975571E851B6CB4"><enum>(8)</enum><text>Section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>)—</text><subparagraph id="id609C9FCF83C84C46B2467CF0CBC93863"><enum>(A)</enum><text>was strongly opposed by Indian Tribes throughout the United States because that section establishes a dangerous legislative precedent for the lack of protection of Tribal sacred areas located on Federal land by mandating the conveyance of Federal land with significant religious, cultural, historic, and anthropological significance for Indian Tribes to a private company that will destroy the land;</text></subparagraph><subparagraph id="H26D74E51569A44A79B921D483D03B078"><enum>(B)</enum><text>circumvents standard environmental review procedures that ensure that the public interest is protected, including the interests of Indian Tribes; and</text></subparagraph><subparagraph id="idA6C34E347E554AC8BB608E653722F3E7"><enum>(C)</enum><text>requires a mandatory conveyance of Oak Flat, regardless of the findings resulting from the environmental review process.</text></subparagraph></paragraph><paragraph id="H9F37FBD4D88A44828989814D6104E0F5"><enum>(9)</enum><text display-inline="yes-display-inline">The inclusion in the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 of section 3003 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>) establishes a negative precedent for—</text><subparagraph id="idE878FD8CD2DF49E1A1865FC145281AC8"><enum>(A)</enum><text display-inline="yes-display-inline">the legislative process; and</text></subparagraph><subparagraph id="id590DC3FA60814E279E3D465E470841C9"><enum>(B)</enum><text display-inline="yes-display-inline">Federal Indian policy.</text></subparagraph></paragraph></section><section id="id9666dcd63de74ee99087166228f23190"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ide12bb027c6f4420d88907ca26f288b82"><enum>(1)</enum><header>Oak Flat</header><text>The term <term>Oak Flat</term> means the approximately 2,422 acres of Forest Service land in the Tonto National Forest in southeastern Arizona commonly known as <quote>Oak Flat</quote> and generally depicted as <quote>Oak Flat Withdrawal Area</quote> on the map entitled <quote>Save Oak Flat Act of 2021</quote> and dated March 15, 2021.</text></paragraph><paragraph id="id1109a2be7c704d7789c2a1f4cfb857e8"><enum>(2)</enum><header>Resolution Copper</header><text>The term <term>Resolution Copper</term> means Resolution Copper Mining, LLC, a Delaware limited liability company. </text></paragraph></section><section id="HA87DD65D419444B8B3FA0004DAB44979"><enum>4.</enum><header>Repeal and withdrawal</header><subsection id="idDEE9B6C7973C413293F4F8A79ED64B3C"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 3003 of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/16/539p">16 U.S.C. 539p</external-xref>) is repealed.</text></subsection><subsection id="idaa2c840ca05746cf941eb1579a7bd3be"><enum>(b)</enum><header>Withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, Oak Flat is withdrawn from all forms of—</text><paragraph id="id286d177b328149a3828a7ed3d70dbcc7"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph><paragraph id="ide15cd7e0db8e4b97976e3b92ebc0db55"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="ide5edef14251d42228324ecf5df5b3319"><enum>(3)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials. </text></paragraph></subsection></section></legis-body></bill>
