id="id0EF9A4596AE842C3B6B88A2ABC674777" style="OLC"><enum>I</enum><header>Drinking water</header><section id="id1a851967-dad5-4058-9724-b15b88ca7da0" section-type="subsequent-section" changed="not-changed"><enum>101.</enum><header>Technical assistance and grants for emergencies affecting public water systems</header><text display-inline="no-display-inline">Section 1442 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1</external-xref>) is amended—</text><paragraph id="id4a9d1424-e6c3-4e04-bab8-8b5d4a220dcb" changed="not-changed"><enum>(1)</enum><text>in subsection (b), in the first sentence—</text><subparagraph changed="not-changed" id="idDB756D165EAC490190AB17E12ADAB946" commented="no"><enum>(A)</enum><text>by inserting <quote>(including an emergency situation resulting from a cybersecurity event)</quote> after <quote>emergency situation</quote>; and</text></subparagraph><subparagraph changed="not-changed" id="id5BF7A36841AA482EABDC43B470911CC0"><enum>(B)</enum><text>by inserting <quote>, including a threat to public health resulting from contaminants, such as, but not limited to, heightened exposure to lead in drinking water</quote> after <quote>public health</quote>;</text></subparagraph></paragraph><paragraph id="iddc1c0408-889e-4586-b8c5-ae35a791c1d1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (d) and inserting the following:</text><quoted-block id="id2c336929-95f3-49c8-9fa6-b6c0a57840a9" style="OLC" act-name="" changed="not-changed"><subsection id="idb407f4db-16ce-4908-aeec-06fe1180e441" changed="not-changed"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out subsection (b) $35,000,000 for each of fiscal years 2022 through 2026.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idba73ebd5-d814-4c59-90de-b33f42b320aa" changed="not-changed"><enum>(3)</enum><text>in subsection (e), by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb6cf77a92a834304b50ed83f83cea4b5"><paragraph id="id170326f7d3c3417b958fb2bd32cbbcd5"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this subsection $15,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idE2F111D417FC44D5A9B0E294EF912ED2" changed="not-changed"><enum>(4)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="idD5718E700FEF413C97BE8362DDA43D4A" changed="not-changed"><enum>(5)</enum><text>by inserting after subsection (e) the following:</text><quoted-block id="id46087C900AE74EE4B0CE394E1F47FA24" style="OLC" act-name="" changed="not-changed"><subsection id="idB9A71DA3BAC341CE83D94E4B1A25EA82" changed="not-changed"><enum>(f)</enum><header>State-Based nonprofit organizations</header><text>The Administrator may provide technical assistance consistent with the authority provided under subsection (e) to State-based nonprofit organizations that are governed by community water systems.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8040c1b1-f99c-4277-b2d1-a8d645c69f8e" changed="not-changed"><enum>102.</enum><header>Drinking water State revolving loan funds</header><subsection id="idFDACC447DAB040B19C41C5DBD480204D"><enum>(a)</enum><header>Drinking water State revolving funds capitalization grant reauthorization</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text><paragraph id="id7070BDBDEAE14B4E828C8290B20A937A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(4)(A), by striking <quote>During fiscal years 2019 through 2023, funds</quote> and inserting <quote>Funds</quote>;</text></paragraph><paragraph id="id2F2C901434E14E22A97254A9755FC5BD"><enum>(2)</enum><text>in subsection (m)(1)—</text><subparagraph id="id1EA287E3BDD3429089BEDDE7B5D40938"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="idAE9B95E8E3C746979356071D9E116F3F"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id8DA8E5D45E21426AB70461548A9CBBA5"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id892EB6B22F804D2E904ED1077F7EC8A7" style="OLC" act-name=""><subparagraph id="id4B01E00B6B7948338ED5121C06A6A8F7"><enum>(D)</enum><text>$2,400,000,000 for fiscal year 2022;</text></subparagraph><subparagraph id="idE731FDCEC3E14357BFF2C449D595C014"><enum>(E)</enum><text>$2,750,000,000 for fiscal year 2023;</text></subparagraph><subparagraph id="id9D743337E2E64775A5E551201C0336A4"><enum>(F)</enum><text>$3,000,000,000 for fiscal year 2024; and</text></subparagraph><subparagraph id="idC1E7F6AF19C7499E942FBDE2E92295E0"><enum>(G)</enum><text>$3,250,000,000 for each of fiscal years 2025 and 2026.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idD900A67F1D574A71871F75D246336A5C"><enum>(3)</enum><text>in subsection (q), by striking <quote>2016 through 2021</quote> and inserting <quote>2022 through 2026</quote>.</text></paragraph></subsection><subsection id="id92C5E135096D4A45B331A15C3541080E"><enum>(b)</enum><header>Assistance for disadvantaged communities</header><text display-inline="yes-display-inline">Section 1452(d) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(d)</external-xref>) is amended—</text><paragraph id="id21F67967391745F1B7F953343E926601"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, grants, negative interest loans, other loan forgiveness, and through buying, refinancing, or restructuring debt</quote> after <quote>forgiveness of principal</quote>; and</text></paragraph><paragraph id="id02204826D75B4C94B9596E70B017A9EC"><enum>(2)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text><quoted-block id="id6DB938DEBE7B482C879D7FD1D7A433A0" style="OLC" act-name=""><subparagraph id="id26D228A87CD24ACD855DCBF5B2BB78C5"><enum>(B)</enum><text>to the extent that there are sufficient applications for loans to communities described in paragraph (1), may not be less than 12 percent.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id5f8aac28-6a2f-4237-8ff7-2357e90309c6" changed="not-changed"><enum>103.</enum><header>Source water petition program</header><text display-inline="no-display-inline">Section 1454 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-14">42 U.S.C. 300j–14</external-xref>) is amended—</text><paragraph id="idbd0385fd-8c3c-4570-98e4-b32fd8febdd2" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="idc2ab6706-2986-4a48-a235-aacc77a38f58" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), in the matter preceding clause (i), by striking <quote>political subdivision of a State,</quote> and inserting <quote>political subdivision of a State (including a county that is designated by the State to act on behalf of an unincorporated area within that county, with the agreement of that unincorporated area),</quote>;</text></subparagraph><subparagraph commented="no" id="ida76552c8-c40b-41b0-92c2-f56160938522" changed="not-changed"><enum>(B)</enum><text>in paragraph (4)(D)(i), by inserting <quote>(including a county that is designated by the State to act on behalf of an unincorporated area within that county)</quote> after <quote>of the State</quote>; and</text></subparagraph><subparagraph commented="no" id="id991d7ae6-259f-483b-9a3b-02e0a264172f" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id7a05334d-ac4d-41f0-8e6f-b725d0cdf546" style="OLC" act-name="" changed="not-changed"><paragraph id="id95434455-311f-4128-af04-bf6d2a3fb885" changed="not-changed"><enum>(5)</enum><header>Savings provision</header><text>Unless otherwise provided within the agreement, an agreement between an unincorporated area and a county for the county to submit a petition under paragraph (1)(A) on behalf of the unincorporated area shall not authorize the county to act on behalf of the unincorporated area in any matter not within a program under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id986c94e0-d056-4de2-9998-7e3bafc57dfa" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), in the first sentence, by striking <quote>2021</quote> and inserting <quote>2026</quote>.</text></paragraph></section><section id="id1398ed94-e586-4655-8d9c-441a19fb3053" changed="not-changed"><enum>104.</enum><header>Assistance for small and disadvantaged communities</header><subsection id="id9cad7d12-a45d-4765-8635-d315afa2fbc6" changed="not-changed"><enum>(a)</enum><header>Existing programs</header><text display-inline="yes-display-inline">Section 1459A of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19a">42 U.S.C. 300j–19a</external-xref>) is amended—</text><paragraph id="iddb2cd0eb-4ed3-4494-a31e-34100c782ee7" changed="not-changed"><enum>(1)</enum><text>in subsection (b)(2)—</text><subparagraph id="id2abc0bec-ba0b-4674-bd2b-97f6303375ce" changed="not-changed"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id6646fe1d-4102-4ca6-9a9a-7e6a787a62ee" changed="not-changed"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id98498d9a-4951-4f2b-9e82-0b52d85305c3" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id9856a7f9-2b57-4064-8a18-6c40848ea00c" style="OLC" act-name="" changed="not-changed"><subparagraph id="idd00b3859-aa54-4988-8695-1b52f4acbc8d" changed="not-changed"><enum>(D)</enum><text>the purchase of point-of-entry or point-of-use filters that are independently certified using science-based test methods for the removal of contaminants of concern;</text></subparagraph><subparagraph id="id7cda0660-a2ab-4391-ac57-397a9e10310a" changed="not-changed"><enum>(E)</enum><text>investments necessary for providing accurate and current information about—</text><clause id="idb6cc8414-6846-474e-b2e9-8b4d56264511" changed="not-changed"><enum>(i)</enum><text>the need for filtration and filter safety, including proper use and maintenance practices; and</text></clause><clause id="idbd8625d1-43f7-4cdd-a3c8-09201c5cf542" changed="not-changed"><enum>(ii)</enum><text>the options for replacing lead service lines (as defined section 1459B(a)) and removing other sources of lead in water; and</text></clause></subparagraph><subparagraph id="id647b9297-61f8-444d-af35-948b3d2877b9" changed="not-changed"><enum>(F)</enum><text>entering into contracts with nonprofit organizations that have water system technical expertise to assist underserved communities.</text></subparagraph><paragraph id="id9673a5fb-260f-4a2f-aaa3-fdd6229cfd14" changed="not-changed"><enum>(3)</enum><header>Contracting parties</header><text>A contract described in paragraph (2)(F) may be between a nonprofit organization described in that paragraph and—</text><subparagraph id="idefe9e447-5f37-4d94-801c-4982f0bbd994" changed="not-changed"><enum>(A)</enum><text>an eligible entity; or</text></subparagraph><subparagraph id="idc9e72ead-677f-4b1d-9484-f2ad2b59a9b3" changed="not-changed"><enum>(B)</enum><text>the State of an eligible entity, on behalf of that eligible entity.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idfe0bbab9-efb4-4007-90db-0dbe5f270ccc" commented="no" changed="not-changed"><enum>(2)</enum><text>in subsection (c), in the matter preceding paragraph (1), by striking <quote>An eligible entity</quote> and inserting <quote>Except for purposes of subsections (j) and (m), an eligible entity</quote>;</text></paragraph><paragraph commented="no" id="id94cdc6ed-a5ad-49c4-bdd1-826fd933b20b" changed="not-changed"><enum>(3)</enum><text>in subsection (g)(1), by striking <quote>to pay not less than 45 percent</quote> and inserting <quote>except as provided in subsection (l)(5) and subject to subsection (h), to pay not less than 10 percent</quote>;</text></paragraph><paragraph id="idec62af54-e8f4-4d6c-a207-be019e1bd2b9" changed="not-changed"><enum>(4)</enum><text>by striking subsection (k) and inserting the changed="not-changed"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out subsections (a) through (j)—</text><paragraph changed="not-changed" id="idEE628FCA063247158AF78F31913FA086"><enum>(1)</enum><text>$60,000,000 for fiscal year 2022;</text></paragraph><paragraph changed="not-changed" id="id496C337E7AFD4BB78EF2114D5DDB1ED5"><enum>(2)</enum><text>$80,000,000 for fiscal year 2023;</text></paragraph><paragraph changed="not-changed" id="idEF13948435C94D2A81764BF238AD120F"><enum>(3)</enum><text>$100,000,000 for fiscal year 2024;</text></paragraph><paragraph changed="not-changed" id="id3879869174F2449AA19F6244EDB7D156"><enum>(4)</enum><text>$120,000,000 for fiscal year 2025; and</text></paragraph><paragraph changed="not-changed" id="idF866540BE9594FC3BC872E2A80F6AC06"><enum>(5)</enum><text>$140,000,000 for fiscal year 2026.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida252f2a4-ca6f-4321-bd1b-64eed7bf6f01" changed="not-changed"><enum>(5)</enum><text>in subsection (l)—</text><subparagraph id="id273f017d-730f-405e-ad76-28f5a6ae8fe6" changed="not-changed"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="idd5e6880d-a86a-4c45-88ba-16d653b63402" commented="no" changed="not-changed"><enum>(i)</enum><text>by striking <quote>The Administrator may</quote> and inserting <quote>The Administrator shall</quote>; and</text></clause><clause id="id416e0c87-f1e3-4b87-9b3b-d6cbc1f25882" changed="not-changed"><enum>(ii)</enum><text>by striking <quote>fiscal years 2019 and 2020</quote> and inserting <quote>fiscal years 2022 through 2026</quote>;</text></clause></subparagraph><subparagraph changed="not-changed" id="id049CEB30ED764D69913B89C6EFFBC4E5"><enum>(B)</enum><text> in paragraph (5), by striking <quote>$4,000,000 for each id="id24729cfd-f6c7-4e02-9f3d-328e8abf9184" changed="not-changed"><enum>(D)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block act-name="" id="id33b53fbd-807b-45b6-b2a7-ef302c4e3198" style="OLC" changed="not-changed"><paragraph id="id70fda018-0dbc-4d66-a1ae-ac0483be7ed5" changed="not-changed"><enum>(5)</enum><header>Federal share for small, rural, and disadvantaged communities</header><subparagraph id="id75ee4964-890a-4d8d-b9f6-7f92a7af2271" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), with respect to a program or project that serves an eligible entity and is carried out using a grant under this subsection, the Federal share of the cost of the program or project shall be 90 percent.</text></subparagraph><subparagraph id="id52f159c6-b2a7-4cb7-95ef-8005b0b54208" changed="not-changed"><enum>(B)</enum><header>Waiver</header><text>The Administrator may increase the Federal share under subparagraph (A) to 100 percent if the Administrator determines that an eligible entity is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id34d50732-387b-47ba-8ba8-1dd5434bd172" changed="not-changed"><enum>(b)</enum><header>Connection to public water systems</header><text display-inline="yes-display-inline">Section 1459A of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19a">42 U.S.C. 300j–19a</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idd2fde2f2-7b5b-4996-a891-9659c588e5bd" display-inline="no-display-inline" style="OLC" act-name="" changed="not-changed"><subsection id="idd6ea24ab-f9b8-4872-989a-d4ce915df341" changed="not-changed"><enum>(m)</enum><header>Connection to public water systems</header><paragraph id="ide4314ddd-1778-44e9-9e59-95cbefcac6d7" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id3cf339f9-87a5-4025-8cef-974a3e392c22" changed="not-changed"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><clause id="id300a86fd-879c-444a-873a-0dc6b44ff636" changed="not-changed"><enum>(i)</enum><text>an owner or operator of a public water system that assists or is seeking to assist eligible individuals with connecting the household of the eligible individual to the public water system; or</text></clause><clause id="id2cdcac65-195f-463e-8009-0863f410a684" changed="not-changed"><enum>(ii)</enum><text>a nonprofit entity that assists or is seeking to assist eligible individuals with the costs associated with connecting the household of the eligible individual to a public water system.</text></clause></subparagraph><subparagraph id="idff316e15-3795-4c37-afc6-f55e6ff58ee7" changed="not-changed"><enum>(B)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> has the meaning given the term in section 603(j) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(j)</external-xref>).</text></subparagraph><subparagraph id="id38f84957-be28-42ab-8525-8a2c20e0a2ab" changed="not-changed"><enum>(C)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under paragraph (2).</text></subparagraph></paragraph><paragraph id="id89831840-a409-4da8-bf66-0b19ce535489" changed="not-changed"><enum>(2)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator shall establish a competitive grant program for the purpose of improving the general welfare under which the Administrator awards grants to eligible entities to provide funds to assist eligible individuals in covering the costs incurred by the eligible individual in connecting the household of the eligible individual to a public water system.</text></paragraph><paragraph commented="no" id="id0cde9821-d7a8-4919-9991-a3ef734c260d" changed="not-changed"><enum>(3)</enum><header>Application</header><text>An eligible entity seeking a grant under the program shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></paragraph><paragraph changed="not-changed" commented="no" id="idD65AC9B375C249B6AB138DDFC862A6BB"><enum>(4)</enum><header>Criteria</header><text>In selecting recipients for grants under the program, the Administrator shall consider—</text><subparagraph changed="not-changed" commented="no" id="id771FDD383A6446678BCFF43DF5CB14BD"><enum>(A)</enum><text>how public health would improve by awarding a grant to a particular eligible entity;</text></subparagraph><subparagraph changed="not-changed" commented="no" id="id1124E8B2FF5B49ACB22FFC1804C4056E"><enum>(B)</enum><text>the environmental implications of awarding a grant to a particular eligible entity;</text></subparagraph><subparagraph changed="not-changed" commented="no" id="idED41324903BC495880694BC5914794D7"><enum>(C)</enum><text>whether it is economically feasible for an eligible entity to provide the assistance described in paragraph (2); and</text></subparagraph><subparagraph changed="not-changed" commented="no" id="id4FFA3E4AF6944CB1A8FD31983013394A"><enum>(D)</enum><text>whether it is technically feasible for an eligible entity to provide the assistance described in paragraph (2).</text></subparagraph></paragraph><paragraph id="id840ca203-a6d0-4106-a1e7-a8ee67d0c4bf" changed="not-changed"><enum>(5)</enum><header>Voluntary connection</header><text>Before providing funds to an eligible individual for the costs described in paragraph (2), an eligible entity shall ensure and certify to the Administrator that—</text><subparagraph id="id596339c7-1e15-45fc-972d-574cd0110d65" changed="not-changed"><enum>(A)</enum><text>the eligible individual is voluntarily seeking connection to the public water system;</text></subparagraph><subparagraph id="id6503af26-08ef-4a37-b1f4-4784bf348964" changed="not-changed"><enum>(B)</enum><text>if the eligible entity is not the owner or operator of the public water system to which the eligible individual seeks to connect, the public water system to which the eligible individual seeks to connect has agreed to the connection; and</text></subparagraph><subparagraph id="id7a57d02d-619a-4468-938f-3bab5de094dd" changed="not-changed"><enum>(C)</enum><text>the connection of the household of the eligible individual to the public water system meets all applicable local and State regulations, requirements, and codes.</text></subparagraph></paragraph><paragraph changed="not-changed" id="id16AC02DCBEE34633AEFADCB660A7AFD5"><enum>(6)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the program, which shall include a description of the use and deployment of amounts made available under the program.</text></paragraph><paragraph id="idb8369b11-7255-4bb6-8f2b-203789038f70" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(7)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the program $20,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd4e85463-3d7c-4f8f-aa8c-4e303bf71a9e" changed="not-changed"><enum>(c)</enum><header>Competitive grant pilot program</header><text>Section 1459A of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19a">42 U.S.C. 300j–19a</external-xref>) (as amended by subsection (b)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd01eabac-526e-425f-a1fc-e7d1f0aac856" changed="not-changed"><subsection id="id1dfc670a-0920-4fc1-ab7d-d34a860528dd" changed="not-changed"><enum>(n)</enum><header>State competitive grants for underserved communities</header><paragraph id="id52f8a363-486c-4d0f-8145-108f82b4c383" changed="not-changed"><enum>(1)</enum><header>In general</header><text>In addition to amounts authorized to be appropriated under subsection (k), there is authorized to be appropriated to carry out subsections (a) through (j) $50,000,000 for each of fiscal years 2022 through 2026 in accordance with paragraph (2).</text></paragraph><paragraph id="id40e43a41-993e-4bb3-ac20-1e8404e2abf1" changed="not-changed"><enum>(2)</enum><header>Competitive grants</header><subparagraph id="idb4457b40-0908-470c-9cb2-a9bdfa9701b8" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this section, the Administrator shall distribute amounts made available under paragraph (1) to States through a competitive grant program.</text></subparagraph><subparagraph id="id6363d9f1-45ee-469b-ae8e-77d1e0035443" commented="no" changed="not-changed"><enum>(B)</enum><header>Applications</header><text>To seek a grant under the competitive grant program under subparagraph (A), a State shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph id="id4a49ca54-426b-4b33-92d3-d128f1a905a7" changed="not-changed"><enum>(C)</enum><header>Criteria</header><text>In selecting recipients of grants under the competitive grant program under subparagraph (A), the Administrator shall establish criteria that give priority to States with a high proportion of underserved communities that meet the condition described in subsection (a)(2)(A).</text></subparagraph></paragraph><paragraph changed="not-changed" id="idC71AEFC315C64DCFB3E9D93E5D07FA61"><enum>(3)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the competitive grant program under paragraph (2)(A), which shall include a description of the use and deployment of amounts made available under the competitive grant program.</text></paragraph><paragraph id="ida9c37544-239e-46c6-8fd6-b2523826e307" changed="not-changed"><enum>(4)</enum><header>Savings provision</header><text>Nothing in this paragraph affects the distribution of amounts made available under subsection (k), including any methods used by the Administrator for distribution of amounts made available under that subsection as in effect on the day before the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id47e9d1e6-7f73-4107-9a23-a01a14a55155" changed="not-changed"><enum>105.</enum><header>Reducing lead in drinking water</header><text display-inline="no-display-inline">Section 1459B of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19b">42 U.S.C. 300j–19b</external-xref>) is amended—</text><paragraph id="idea8a5d5c-483d-4d3c-9089-92f3f3eb01aa" changed="not-changed"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="id8f38b44c-79f6-4a8d-9e20-c82786a030d4" changed="not-changed"><enum>(A)</enum><text>by inserting <quote>(except for subsection (d))</quote> after <quote>this section</quote>; and</text></subparagraph><subparagraph id="ida5c3ee16-7fe7-4661-8695-95da44963332" changed="not-changed"><enum>(B)</enum><text>by striking <quote>$60,000,000 for each of fiscal years 2017 through 2021</quote> and inserting <quote>$100,000,000 for each of fiscal years 2022 through 2026</quote>;</text></subparagraph></paragraph><paragraph id="id74c18306-7ccf-4225-ac91-7430d1477063" changed="not-changed"><enum>(2)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph><paragraph id="id33f62069-4451-4a0d-9bd0-0138262d58fe" changed="not-changed"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text><quoted-block id="idf2cf07e9-9382-4039-85a2-9f7d0ebf356c" style="OLC" act-name="" changed="not-changed"><subsection id="id92286168-6fd0-470f-aead-c85ddc11102a" changed="not-changed"><enum>(d)</enum><header>Lead mapping utilization grant pilot program</header><paragraph id="idd8f32594-a612-47db-9f36-696f95ed4618" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id0fd4a56e-dc43-4e44-8d14-c3c583d83a9a" changed="not-changed"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a municipality that is served by a community water system or a nontransient noncommunity water system in which not less than 30 percent of the service lines are known, or likely to contain, lead service lines.</text></subparagraph><subparagraph id="id6b44dced-a33c-492a-a720-f3365b28f772" changed="not-changed"><enum>(B)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under paragraph (2). </text></subparagraph></paragraph><paragraph id="id75ceb40b-3d0a-4d18-8b3b-d2e829281858" changed="not-changed"><enum>(2)</enum><header>Establishment</header><text>The Administrator shall establish a pilot program under which the Administrator shall provide grants to eligible entities to carry out lead reduction projects that are demonstrated to exist based on existing lead mapping of those eligible entities.</text></paragraph><paragraph id="idbb050c2a-2076-4493-9e4d-e41998fb9521" changed="not-changed"><enum>(3)</enum><header>Selection</header><subparagraph id="id3b36bdbf-3e63-4178-a074-337ba5ba1bc6" commented="no" changed="not-changed"><enum>(A)</enum><header>Application</header><text>To be eligible to receive a grant under the pilot program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph id="id32404048-1b74-431c-aaa7-658236d55b9d" changed="not-changed"><enum>(B)</enum><header>Prioritization</header><text>In selecting recipients under the pilot program, the Administrator shall give priority to an eligible entity that meets the affordability criteria established by the applicable State.</text></subparagraph></paragraph><paragraph id="idc5b2537d-91b5-42f9-8c92-f1dc42e6c1cb" changed="not-changed"><enum>(4)</enum><header>Report</header><text>Not later 2 years after the Administrator first awards a grant under the pilot program, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing—</text><subparagraph id="id60593ee7-ee02-4842-9d5d-d7b9db785976" changed="not-changed"><enum>(A)</enum><text>the recipients of grants under the pilot program;</text></subparagraph><subparagraph id="id627951b0-e57d-4c14-bb80-7ff150ef51e9" changed="not-changed"><enum>(B)</enum><text>the existing lead mapping that was available to recipients of grants under the pilot program; and</text></subparagraph><subparagraph id="idcbca1a69-9b0b-47da-b94a-af679d00db72" changed="not-changed"><enum>(C)</enum><text>how useful and accurate the lead mapping described in subparagraph (B) was in locating lead contaminants of the eligible entity.</text></subparagraph></paragraph><paragraph id="idd470294d-0c75-4be7-8b88-b2797db0eb26" changed="not-changed"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the pilot program $10,000,000, to remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4f06ca27-34a7-4cdc-9c2f-cf0c9ad1ae45" changed="not-changed"><enum>106.</enum><header>Operational sustainability of small public water systems</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block act-name="" id="id26ee64aa-bd54-4868-8a9c-edf925104878" style="OLC" changed="not-changed"><section id="idd3eb5bc5-cf06-4ceb-a464-1a8e3745aa19" changed="not-changed"><enum>1459E.</enum><header>Operational sustainability of small public water systems</header><subsection id="id880158a7-76a4-42d8-bf69-38cdc3d0a510" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id91307787-88b5-47ee-9a4b-d1711adea017" changed="not-changed"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id53982337289E4CB1B7027C69A5B268CA" changed="not-changed"><enum>(A)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="id907246E7A4524ED3AF1BE364738BB306" changed="not-changed"><enum>(B)</enum><text>a public corporation established by a unit of local government to provide water service;</text></subparagraph><subparagraph id="idFD5AEA16F31F4D80AB4DE1E53646D8F4" changed="not-changed"><enum>(C)</enum><text>a nonprofit corporation, public trust, or cooperative association that owns or operates a public water system; and</text></subparagraph><subparagraph id="id740AAF4763D54697910B9F17DCFC9227" changed="not-changed"><enum>(D)</enum><text>an Indian Tribe that owns or operates a public water system.</text></subparagraph></paragraph><paragraph id="ida4ae0874-0a6d-4a51-8682-1531c8f7d981" changed="not-changed"><enum>(2)</enum><header>Operational sustainability</header><text>The term <term>operational sustainability</term> means the ability to improve the operation of a small system through the identification and prevention of potable water loss due to leaks, breaks, and other metering or infrastructure failures.</text></paragraph><paragraph id="id1d7f417b-a6d0-4fd6-a989-a13d5c1239e3" changed="not-changed"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the grant program established under subsection (b).</text></paragraph><paragraph id="id3a89e7b0-c232-4ca5-bedc-c96ccc025476" changed="not-changed"><enum>(4)</enum><header>Small system</header><text>The term <term>small system</term> means a public water system that—</text><subparagraph id="iddc709831-b6e6-4b15-a996-fddf12cf0db4" changed="not-changed"><enum>(A)</enum><text>serves fewer than 10,000 people; and</text></subparagraph><subparagraph id="id4f65c235-ba09-4a5e-9be6-21aafea05ebb" changed="not-changed"><enum>(B)</enum><text>is owned or operated by—</text><clause id="idcdb8a632-9ab3-44ca-b6c1-7e147d8f3750" changed="not-changed"><enum>(i)</enum><text>a unit of local government;</text></clause><clause id="id2818ab06-74fe-436a-9e9e-a8cd017f8669" changed="not-changed"><enum>(ii)</enum><text>a public corporation;</text></clause><clause id="idd4ce0eea-8154-44fb-be7b-dd77ae40e1f7" changed="not-changed"><enum>(iii)</enum><text>a nonprofit corporation;</text></clause><clause id="idDFAAF26EF60E454AA8E28E471F7D443A" changed="not-changed"><enum>(iv)</enum><text>a public trust;</text></clause><clause id="idC1629EAC6AF843528C165E538D36545F" changed="not-changed"><enum>(v)</enum><text>a cooperative association; or</text></clause><clause id="idCC1F65310413492AAC902FF13645BC20" changed="not-changed"><enum>(vi)</enum><text>an Indian Tribe.</text></clause></subparagraph></paragraph></subsection><subsection id="idce4dd7ef-f379-4976-9166-af57cfc8874f" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator shall establish a program to award grants to eligible entities for the purpose of improving the operational sustainability of 1 or more small systems.</text></subsection><subsection id="id29ee845b-f60a-4886-a6e3-3bb57acd61b0" changed="not-changed"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><paragraph id="id75ab4db8-e359-4e4c-919d-78216df13d72" changed="not-changed"><enum>(1)</enum><text>a proposal of the project to be carried out using grant funds under the program;</text></paragraph><paragraph id="id9bed32b6-3b82-485a-b38c-6b599289d3ca" changed="not-changed"><enum>(2)</enum><text>documentation prepared by the eligible entity describing the deficiencies or suspected deficiencies in operational sustainability of 1 or more small systems that are to be addressed through the proposed project;</text></paragraph><paragraph id="iddd12f307-56e4-4a93-a163-9519cd162122" changed="not-changed"><enum>(3)</enum><text>a description of how the proposed project will improve the operational sustainability of 1 or more small systems;</text></paragraph><paragraph id="idfadb13ca-b88e-4658-b8da-8211222edc61" changed="not-changed"><enum>(4)</enum><text>a description of how the improvements described in paragraph (3) will be maintained beyond the life of the proposed project, including a plan to maintain and update any asset data collected as a result of the proposed project;</text></paragraph><paragraph id="ida20fbe20-06d1-4bab-806b-361d5bc70a28" changed="not-changed"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idefc58431-db32-4d82-ab55-8f2dcc37a70d" changed="not-changed"><enum>(A)</enum><text>if the eligible entity is located in a State that has established a State drinking water treatment revolving loan fund under section 1452, a copy of a written agreement between the eligible entity and the State in which the eligible entity agrees to provide a copy of any data collected under the proposed project to the State agency administering the State drinking water treatment revolving loan fund (or a designee); or</text></subparagraph><subparagraph indent="up1" id="idfbf9100d-2258-4dce-b05c-609e8f702de5" changed="not-changed"><enum>(B)</enum><text>if the eligible entity is located in an area other than a State that has established a State drinking water treatment revolving loan fund under section 1452, a copy of a written agreement between the eligible entity and the Administrator in which the eligible entity agrees to provide a copy of any data collected under the proposed project to the Administrator (or a designee); and</text></subparagraph></paragraph><paragraph id="id4e9742cc-fe08-449b-8714-75a213404d60" changed="not-changed"><enum>(6)</enum><text>any additional information the Administrator may require.</text></paragraph></subsection><subsection id="id4f0653f2-8d1a-4cbb-a3ca-dcf8bc698ef7" changed="not-changed"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity that receives a grant under the program shall use the grant funds to carry out projects that improve the operational sustainability of 1 or more small systems through—</text><paragraph id="id06d69eaf-f166-47ad-818a-16056014b64e" changed="not-changed"><enum>(1)</enum><text>the development of a detailed asset inventory, which may include drinking water sources, wells, storage, valves, treatment systems, distribution lines, hydrants, pumps, controls, and other essential infrastructure;</text></paragraph><paragraph id="id86c1c1ad-88b2-4d04-ba22-97408dc675e6" changed="not-changed"><enum>(2)</enum><text>the development of an infrastructure asset map, including a map that uses technology such as—</text><subparagraph id="id6380d9ec-450a-4082-af0b-bfe7c3fc3180" changed="not-changed"><enum>(A)</enum><text>geographic information system software; and</text></subparagraph><subparagraph id="id3f168652-0ceb-48fe-b2f6-4de12e30bceb" changed="not-changed"><enum>(B)</enum><text>global positioning system software;</text></subparagraph></paragraph><paragraph id="idd8711964-f0f6-4050-9468-b6b35d01ba59" changed="not-changed"><enum>(3)</enum><text>the deployment of leak detection technology;</text></paragraph><paragraph id="idaa293678-6f9c-4ac4-bfcb-58928937c4e0" changed="not-changed"><enum>(4)</enum><text>the deployment of metering technology;</text></paragraph><paragraph id="id7649f9f5-8cd0-481a-a3f4-36eb50e90f06" changed="not-changed"><enum>(5)</enum><text>training in asset management strategies, techniques, and technologies for appropriate staff employed by—</text><subparagraph id="id3b2b7c84-62c2-4749-a0ce-ecf1f0de3842" changed="not-changed"><enum>(A)</enum><text>the eligible entity; or</text></subparagraph><subparagraph id="id53082667-8179-421b-a287-26fa04ec70d3" changed="not-changed"><enum>(B)</enum><text>the small systems for which the grant was received;</text></subparagraph></paragraph><paragraph changed="not-changed" id="id93BF33B6B012453AAF398231A309BB71"><enum>(6)</enum><text>the deployment of strategies, techniques, and technologies to enhance the operational sustainability and effective use of water resources through water reuse; and</text></paragraph><paragraph id="id5677fba2-e8e0-4d4b-9d31-d584261914b9" changed="not-changed"><enum>(7)</enum><text>the development or deployment of other strategies, techniques, or technologies that the Administrator may determine to be appropriate under the program.</text></paragraph></subsection><subsection id="id919be0b1-5679-4473-8597-8aa3acbfa438" changed="not-changed"><enum>(e)</enum><header>Cost share</header><paragraph id="ida8eacca2-922f-4b17-ac51-cde33e5d9e1f" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Federal share of the cost of a project carried out using a grant under the program shall be 90 percent of the total cost of the project.</text></paragraph><paragraph id="idbeaa4fcf-f568-43a4-bd99-437e507fee79" changed="not-changed"><enum>(2)</enum><header>Waiver</header><text>The Administrator may increase the Federal share under paragraph (1) to 100 percent.</text></paragraph></subsection><subsection changed="not-changed" id="idAC7914BFE0614CD5A728CE6A2E6BC054"><enum>(f)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the program, which shall include a description of the use and deployment of amounts made available under the program.</text></subsection><subsection id="id986d4aef-724a-45c7-9c9b-8583797a7afa" changed="not-changed"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2022 through changed="not-changed"><enum>107.</enum><header>Midsize and large drinking water system infrastructure resilience and sustainability program</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) (as amended by section 106) is amended by adding at the end the following:</text><quoted-block id="idbe804e50-dc2b-4409-88c7-c7c34de4cdda" changed="not-changed" display-inline="no-display-inline" style="OLC" act-name=""><section id="id82f87f51-b24d-4ab0-8446-a81549ce4576" changed="not-changed"><enum>1459F.</enum><header>Midsize and large drinking water system infrastructure resilience and sustainability program</header><subsection id="id6ed770a3-0c06-4ef5-bbf6-14368aea4d8c" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idb8b69e8a-b85a-407e-af61-be7ac31f469f" changed="not-changed"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a public water system that serves a community with a population of greater than 10,000.</text></paragraph><paragraph id="idca323086-42ba-47ad-b4c3-b9c53a7c7fb9" changed="not-changed"><enum>(2)</enum><header>Natural hazard; resilience</header><text>The terms <term>resilience</term> and <term>natural hazard</term> have the meanings given those terms in section 1433(h).</text></paragraph><paragraph id="id29816983-31d0-4137-b635-a916048a9564" changed="not-changed"><enum>(3)</enum><header>Resilience and sustainability program</header><text>The term <term>resilience and sustainability program</term> means the Midsize and Large Drinking Water System Infrastructure Resilience and Sustainability Program established under subsection (b).</text></paragraph></subsection><subsection id="idbfe584e4-d4c7-4393-8977-6dc3d177eab5" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>The Administrator shall establish and carry out a program, to be known as the <quote>Midsize and Large Drinking Water System Infrastructure Resilience and Sustainability Program</quote>, under which the Administrator, subject to the availability of appropriations for the resilience and sustainability program, shall award grants to eligible entities for the purpose of increasing resilience to natural hazards, cybersecurity threats, and extreme weather events.</text></subsection><subsection id="id0a30d6b0-3889-4847-a25a-9da1ceb2a713" changed="not-changed"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity may only use grant funds received under the resilience and sustainability program to assist in the planning, design, construction, implementation, operation, or maintenance of a program or project that increases resilience to natural hazards, cybersecurity threats, or extreme weather events through—</text><paragraph commented="no" display-inline="no-display-inline" id="id346e13fe-0bee-4e48-a28d-5654546bf911" changed="not-changed"><enum>(1)</enum><text>the conservation of water or the enhancement of water-use efficiency;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f6b0e15-96e0-4f86-9f29-3893277f7a7e" changed="not-changed"><enum>(2)</enum><text>the modification or relocation of existing drinking water system infrastructure made, or that is at risk of being, significantly impaired by natural hazards or extreme weather events, including risks to drinking water from flooding;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c6435bc-4ad2-48cb-9ff1-ebe0cea73523" changed="not-changed"><enum>(3)</enum><text>the design or construction of new or modified desalination facilities to serve existing communities; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53431f90-7f05-4427-ba2f-3a256dbab601" changed="not-changed"><enum>(4)</enum><text>the enhancement of water supply through the use of watershed management and source water protection;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d5951fc-09c7-47b1-a9e9-f44d8f903b8b" changed="not-changed"><enum>(5)</enum><text>the enhancement of energy efficiency or the use and generation of renewable energy in the conveyance or treatment of drinking water;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff6c4316-1a62-4a2c-9e8e-003e166259a0" changed="not-changed"><enum>(6)</enum><text>the development and implementation of measures to increase the resilience of the eligible entity to natural hazards, cybersecurity threats, or extreme weather events; or</text></paragraph><paragraph display-inline="no-display-inline" changed="not-changed" commented="no" id="idF211230CD0934AC0848F45B777055627"><enum>(7)</enum><text>the conservation of water or the enhancement of a water supply through the implementation of water reuse measures.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id737f820d-8456-4b12-9e49-82e833213f3b" changed="not-changed"><enum>(d)</enum><header>Application</header><text>To seek a grant under the resilience and sustainability program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><paragraph commented="no" display-inline="no-display-inline" id="idb23499e4-479b-416b-ad0a-3635b14ee61b" changed="not-changed"><enum>(1)</enum><text>a proposal of the program or project to be planned, designed, constructed, implemented, operated, or maintained by the eligible entity;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0772a040-05e4-4fd4-ba83-385ccd9331fe" changed="not-changed"><enum>(2)</enum><text>an identification of the natural hazard risk or potential cybersecurity threat, as applicable, to be addressed by the proposed program or project;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8257ed83-109b-41db-8759-f49089433899" changed="not-changed"><enum>(3)</enum><text>documentation prepared by a Federal, State, regional, or local government agency of the natural hazard risk, potential cybersecurity threat, or risk for extreme weather events to the area where the proposed program or project is to be located;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide92334ac-c386-436f-851d-09e8dce8f125" changed="not-changed"><enum>(4)</enum><text>a description of any recent natural hazards, cybersecurity events, or extreme weather events that have affected the community water system of the eligible entity;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ece8945-fc7f-4acb-9a75-cb81a4f42c57" changed="not-changed"><enum>(5)</enum><text>a description of how the proposed program or project would improve the performance of the community water system of the eligible entity under the anticipated natural hazards, cybersecurity threats, or extreme weather events; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49d75762-7c4e-46e3-95c5-d419d4a9900e" changed="not-changed"><enum>(6)</enum><text>an explanation of how the proposed program or project is expected to enhance the resilience of the community water system of the eligible entity to the anticipated natural hazards, cybersecurity threats, or extreme weather events.</text></paragraph></subsection><subsection id="idFB2B6D22816D4317A85F2496C26F2591"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the resilience and sustainability program, which shall include a description of the use and deployment of amounts made available to carry out the resilience and sustainability program. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida752e556-5437-4598-92f2-d066199c739d" changed="not-changed"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" changed="not-changed" id="id1092DF7DA6DA4249A2645A3A79F18D30"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the resilience and sustainability program $50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" changed="not-changed" id="id658C89ADA13144119E0BF34C5C397C18"><enum>(2)</enum><header>Use of funds</header><text>Of the amounts made available under paragraph (1) for grants to eligible entities under the resilience and sustainability program—</text><subparagraph commented="no" display-inline="no-display-inline" changed="not-changed" id="idC21D04639A8B4438B44D58633B7111F7"><enum>(A)</enum><text>50 percent shall be used to provide grants to eligible entities that serve a population of—</text><clause commented="no" display-inline="no-display-inline" changed="not-changed" id="idB5C56177D0F947098234499849F60725"><enum>(i)</enum><text>greater than 10,000; and</text></clause><clause commented="no" display-inline="no-display-inline" changed="not-changed" id="id0042DCE1B7EA489286E93BCD7A9743F9"><enum>(ii)</enum><text>fewer than 100,000; and</text></clause></subparagraph><subparagraph id="id8F06F7E207E44BC5A092B4D455A679F0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>50 percent shall be used to provide grants to eligible entities that serve a population equal to or greater than 100,000.</text></subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idAA3EA88C21F74DCEA09E517FF546EC2A"><enum>(3)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1), not more than 2 percent may be used by the Administrator for the administrative costs of carrying out the resilience and sustainability program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2fc1ea16-655c-4321-a0ba-416da36e5d32" changed="not-changed"><enum>108.</enum><header>Needs assessment for nationwide rural and urban low-income community water assistance</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) (as amended by section 107) is amended by adding at the end the following:</text><quoted-block id="idfc64b56a-6c0f-4817-9618-8ae32723a389" style="OLC" act-name="" changed="not-changed"><section id="id04d62bbb-6134-4513-a359-9c0f8ae348ec" section-type="subsequent-section" changed="not-changed"><enum>1459G.</enum><header>Needs assessment for nationwide rural and urban low-income community water assistance</header><subsection id="idd57c971b-1ca7-44c5-9fb8-9760e731bde0" changed="not-changed"><enum>(a)</enum><header>Definition of low-Income household</header><text>In this section, the term <term>low-income household</term> means a household that has an income that, as determined by the State in which the household is located, does not exceed the greater of—</text><paragraph id="id27eddc77-1fe6-4a82-8b65-1722d40dbf89" changed="not-changed"><enum>(1)</enum><text>an amount equal to 150 percent of the poverty level of that State; and</text></paragraph><paragraph id="ida9ebf962-f075-42a7-b410-e5e2f6d5ff0a" changed="not-changed"><enum>(2)</enum><text>an amount equal to 60 percent of the State median income for that State.</text></paragraph></subsection><subsection id="id9a163c1d-bccb-41ab-8877-17ad5c45e94b" changed="not-changed"><enum>(b)</enum><header>Study; report</header><paragraph id="idbfe87ff5-13f6-45c4-a235-17a72f3effd8" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, not later than 2 years after the date of enactment of this section, the Administrator shall conduct, and submit to Congress a report describing the results of, a study regarding the prevalence throughout the United States of low-income households, including low-income renters, that spend a disproportionate amount of household income on public drinking water services to meet household needs.</text></paragraph><paragraph id="ide96142b7-de19-4ff1-80af-5c7fabc5b7e8" changed="not-changed"><enum>(2)</enum><header>Inclusions</header><text>The report under paragraph (1) shall include—</text><subparagraph id="id379ed3ac-dec7-4d0c-9dba-4c6e11fb907f" changed="not-changed"><enum>(A)</enum><text>recommendations of the Administrator regarding the best methods to increase access to affordable and reliable drinking water services;</text></subparagraph><subparagraph id="idc4f45595-9cdf-49b9-8a39-1d8a684944dc" changed="not-changed"><enum>(B)</enum><text>a description of the cost of each method described in subparagraph (A); and</text></subparagraph><subparagraph id="id2fc6c8be-987a-40d1-bdea-99cff94026ba" changed="not-changed"><enum>(C)</enum><text>with respect to the development of the report, a consultation with all relevant stakeholders.</text></subparagraph></paragraph><paragraph id="id81753543-71cc-4be9-b7ae-896286d140b9" changed="not-changed"><enum>(3)</enum><header>Agreements</header><text>The Administrator may enter into an agreement with another Federal agency to carry out the study under paragraph (1).</text></paragraph></subsection><subsection id="id67cb71bd-1676-4164-984f-df7d22acf1bd" changed="not-changed"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idd47e8dcb-d6af-4d0d-8f80-0edeaf267467" changed="not-changed"><enum>109.</enum><header>Lead contamination in school drinking water</header><text display-inline="no-display-inline">Section 1464 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24</external-xref>) is amended—</text><paragraph id="ide6fbc78a-0628-405e-a1d2-b5de85f00308" changed="not-changed"><enum>(1)</enum><text>in subsection (b)— </text><subparagraph id="idf181724e-4a18-4130-8d5e-25cd5730d7ee" changed="not-changed"><enum>(A)</enum><text>in the first sentence, by inserting <quote>public water systems and</quote> after <quote>to assist</quote>; and</text></subparagraph><subparagraph id="id9cedd2e1-e1f7-4a81-aec9-187bdabdfef0" changed="not-changed"><enum>(B)</enum><text>in the third sentence, by inserting <quote>public water systems,</quote> after <quote>schools,</quote>; and</after-quoted-block></quoted-block></subclause><subclause id="id87d14148-b40e-4f1b-ba88-6c7f737e5971" changed="not-changed"><enum>(IV)</enum><text>by adding at the end the following:</text><quoted-block id="ide4fa3b08-f112-4c34-b914-8858a0178102" style="OLC" act-name="" changed="not-changed"><clause id="id0a2478b7-d9bc-45ac-9a5e-5dfeabe21832" changed="not-changed"><enum>(ii)</enum><text>tribal consortia to assist tribal education agencies (as defined in section 3 of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5502">20 U.S.C. 5502</external-xref>)) in voluntary testing for lead contamination in drinking water at schools and child care programs under the jurisdiction of the tribal education agency.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id14a4b32e-f07d-4761-ad14-66f7930606c4" changed="not-changed"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="id3f5ab8a7-21e7-42e0-aea6-4568ef0fd517" changed="not-changed"><enum>(I)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></subclause><subclause id="idae898083-5f70-4408-9c59-c37e98b7f6e1" changed="not-changed"><enum>(II)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; or</text></subclause><subclause id="id39008941-0322-4a74-9dbe-bead8dea824e" changed="not-changed"><enum>(II)</enum><text>provides technical assistance to schools or child care programs in carrying out lead testing; <external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>) is amended—</text><paragraph id="id909ccbdd-3647-4447-9472-4cd3e7094276" changed="not-changed"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2640373a-7215-48ec-8d19-d023daf84c09" changed="not-changed"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>Subject to the availability of appropriations, the Administrator of the Environmental Protection Agency</quote> and inserting <quote>The Administrator of the Environmental Protection Agency (referred to in this section as the <term>Administrator</term>)</quote>; and</text></subparagraph><subparagraph id="idab7841c3-af9a-4323-b69c-a4cafd9bdaa3" changed="not-changed"><enum>(B)</enum><text>by striking <quote>to implement</quote> in the matter preceding paragraph (1) and all that follows through the period at the end of paragraph (2) and inserting <quote>to implement eligible projects described in subsection (b).</quote>;</text></subparagraph></paragraph><paragraph id="id61b700aa-a955-45a5-8ad3-a8e21719e944" changed="not-changed"><enum>(2)</enum><text>by redesignating subsection (d) as subsection (f);</text></paragraph><paragraph id="ide7e9615a-1117-4f4b-8826-b7ef6c84ff2f" changed="not-changed"><enum>(3)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block id="id28b88670-e718-4d61-bed2-88d94f8e3b44" style="OLC" act-name="" changed="not-changed"><subsection id="id2cccd919-9bdf-4c69-bd45-09f99ca18737" changed="not-changed"><enum>(c)</enum><header>Required projects</header><paragraph id="ide378802a-4922-48ac-8061-1a198b41f755" changed="not-changed"><enum>(1)</enum><header>In general</header><text>If sufficient applications exist, of the funds made available to carry out this section, the Administrator shall use 50 percent to carry out—</text><subparagraph id="id43a132b3-cc0e-48c6-93eb-ae0cb5c63ee0" changed="not-changed"><enum>(A)</enum><text>10 eligible projects described in subsection (b) that are within the Upper Missouri River Basin;</text></subparagraph><subparagraph id="id6ee7f33c-3819-44c5-9f59-ee1ed52204b0" changed="not-changed"><enum>(B)</enum><text>10 eligible projects described in subsection (b) that are within the Upper Rio Grande Basin;</text></subparagraph><subparagraph id="ide04067c2-0b9f-4205-97d1-b6e045d053b7" changed="not-changed"><enum>(C)</enum><text>10 eligible projects described in subsection (b) that are within the Columbia River Basin; and</text></subparagraph><subparagraph changed="not-changed" id="id29A5594A934146238D6C8704A85820B1"><enum>(D)</enum><text>10 eligible projects described in subsection (b) that are within the Lower Colorado River Basin.</text></subparagraph></paragraph><paragraph id="idde51d374-0b0d-4d14-a14f-134ac12ad8f7" changed="not-changed"><enum>(2)</enum><header>Requirement</header><text>In carrying out paragraph (1)(A), the Administrator shall select not fewer than 2 eligible projects for a reservation that serves more than 1 federally recognized Indian Tribe.</text></paragraph></subsection><subsection id="id50788677-3549-4f76-8ca9-bd083a4b5461" changed="not-changed"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out under this section shall be 100 percent.</text></subsection><subsection changed="not-changed" id="id2C523E292AB141FD90A43E623C6ED79D"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the program established under subsection (a), which shall include a description of the use and deployment of amounts made available under that program.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2e2e3f51-f240-4364-a749-1ab38afd13e5" changed="not-changed"><enum>(4)</enum><text>in subsection (f) (as so redesignated)—</text><subparagraph id="id8990de25-7e22-40a1-8dce-bebd3a8aee7d" changed="not-changed"><enum>(A)</enum><text>by striking <quote>There is</quote> and inserting <quote>There are</quote>;</text></subparagraph><subparagraph id="id84aea113-83b7-4c1c-910f-279b12f548b4" changed="not-changed"><enum>(B)</enum><text>by striking <quote>subsection (a) $20,000,000</quote> and inserting the following: </text><quoted-block id="id2e412d56-ce65-4ce2-936e-5216d94fa91a" style="OLC" act-name="" display-inline="yes-display-inline" changed="not-changed"><text>subsection (a)—</text><paragraph id="id9df308fe-5c9a-4616-ae52-433de50a7be4" changed="not-changed"><enum>(1)</enum><text>$20,000,000</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id52a899d3-e861-4633-8aba-78413523bfe9" changed="not-changed"><enum>(C)</enum><text>in paragraph (1) (as so designated), by striking <quote>2022.</quote> and inserting <quote>2021; and</quote>; and</text></subparagraph><subparagraph id="id362e3d7a-cce3-43af-ab47-69a86cbe3511" changed="not-changed"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="idc0d32066-b26e-4f3f-8e90-6efa41974f91" style="OLC" act-name="" changed="not-changed"><paragraph id="id67721846-873c-4e35-9c9d-11414dcac813" changed="not-changed"><enum>(2)</enum><text>$50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section changed="not-changed" id="id32E74E940B3B4B71823BC94AC321B1DE"><enum>111.</enum><header>Advanced drinking water technologies</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) (as amended by section 108) is amended by adding at the end the following:</text><quoted-block id="idCF50AB4BAF584FD48E0A53206181D928" display-inline="no-display-inline" style="OLC"><section id="id0eba00b7-72bb-47bf-a7d1-80470766e43c" section-type="subsequent-section" changed="not-changed"><enum>1459H.</enum><header>Advanced drinking water technologies</header><subsection id="id918ecd99-23d0-43c6-9662-e6d391119f11" changed="not-changed"><enum>(a)</enum><header>Study</header><paragraph id="idb22d4141-0ea8-47a7-b6dd-9f5477b4f9f5" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, not later than 1 year after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall carry out a study that examines the state of existing and potential future technology, including technology that could address cybersecurity threats, that enhances or could enhance the treatment, monitoring, affordability, efficiency, and safety of drinking water provided by a public water system.</text></paragraph><paragraph id="id0814c3a5-308e-4ad3-96ed-1dca8360defe" commented="no" changed="not-changed"><enum>(2)</enum><header>Report</header><text>The Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes the results of the study under paragraph (1).</text></paragraph></subsection><subsection commented="no" id="id85d58a22-2a87-4412-9450-7d1d12cab466" changed="not-changed"><enum>(b)</enum><header>Advanced drinking water technology grant program</header><paragraph commented="no" id="id0f084097-98f3-4d1a-bd90-4deb0a216368" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" id="id83199ef5-5f6c-42fd-9394-af2eb4519045" changed="not-changed"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means the owner or operator of a public water system that—</text><clause commented="no" id="id869a5f11-3b38-48b3-b4f1-fd7337d7b04c" changed="not-changed"><enum>(i)</enum><text>serves—</text><subclause commented="no" id="id0bdd0a89-42d6-4b12-b9cd-06b99bd365f7" changed="not-changed"><enum>(I)</enum><text>a population of not more than 100,000 people; or</text></subclause><subclause commented="no" id="idc79bbdd0-b718-4b25-9a82-c3ec15ecdb1f" changed="not-changed"><enum>(II)</enum><text>an underserved community;</text></subclause></clause><clause commented="no" id="id725d4229-fba0-4c16-94b3-d1f02de915dc" changed="not-changed"><enum>(ii)</enum><text>has plans to identify or has identified opportunities in the operations of the public water system to employ new or emerging, yet proven, technologies, including technology that could address cybersecurity threats, as determined by the Administrator, that enhance treatment, monitoring, affordability, efficiency, or safety of the drinking water provided by the public water system, including technologies not identified in the study conducted under subsection (a)(1); and</text></clause><clause id="idA36CF333CFA14D1299D6954E27A4EA24" changed="not-changed"><enum>(iii)</enum><text>has expressed an interest in the opportunities in the operation of the public water system to employ new or emerging, yet proven, technologies, including technology that could address cybersecurity threats, as determined by the Administrator, that enhance treatment, monitoring, affordability, efficiency, or safety of the drinking water provided by the public water system, including technologies not identified in the study conducted under subsection (a)(1). </text></clause></subparagraph><subparagraph commented="no" id="id54c9bab6-6b75-425d-baa7-66056d855fd3" changed="not-changed"><enum>(B)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under paragraph (2).</text></subparagraph><subparagraph commented="no" id="id9b2859f1-f19a-457b-9faf-68e8bab48b3e" changed="not-changed"><enum>(C)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means a political subdivision of a State that, as determined by the Administrator, has an inadequate system for obtaining drinking water.</text></subparagraph></paragraph><paragraph commented="no" id="id94625965-3bc4-4557-81d4-d3cf294b261d" changed="not-changed"><enum>(2)</enum><header>Establishment</header><text>The Administrator shall establish a competitive grant program under which the Administrator shall award grants to eligible entities for the purpose of identifying, deploying, or identifying and deploying technologies described in paragraph (1)(A)(ii). </text></paragraph><paragraph commented="no" id="id69e51915-1869-4d7a-a933-8e60195e9a75" changed="not-changed"><enum>(3)</enum><header>Requirements</header><subparagraph commented="no" id="idddf25b8e-59ff-40ac-8a9d-6e78e04eaf3b" changed="not-changed"><enum>(A)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph commented="no" id="id0562fcac-9837-4a2f-a2d4-79a3174e9b72" changed="not-changed"><enum>(B)</enum><header>Federal share</header><clause commented="no" id="id200fa3a2-5508-45a3-9f2c-88de3a3d1e24" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Federal share of the cost of a project carried out using a grant under the program shall not exceed 90 percent of the total cost of the project.</text></clause><clause commented="no" id="idabbee57f-25f5-467c-aad5-ada219a15465" changed="not-changed"><enum>(ii)</enum><header>Waiver</header><text>The Administrator may increase the Federal share under clause (i) to 100 percent if the Administrator determines that an eligible entity is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share. </text></clause></subparagraph></paragraph><paragraph commented="no" id="id8fcfe206-5e35-4210-97bf-fbab0e1701b4" changed="not-changed"><enum>(4)</enum><header>Report</header><text>Not later than 1 year after the date on which Administrator first awards a grant under the program, and annually thereafter, the Administrator shall submit to Congress a report describing—</text><subparagraph commented="no" id="id1fb03d9c-50c8-4d08-a017-f1c23ca4943f" changed="not-changed"><enum>(A)</enum><text>each recipient of a grant under the program during the previous 1-year period; and</text></subparagraph><subparagraph commented="no" id="id35851dc0-8a2e-409d-aacf-950d55bf1523" changed="not-changed"><enum>(B)</enum><text>a summary of the activities carried out using grants awarded under the program.</text></subparagraph></paragraph><paragraph commented="no" id="id9931585a-a5a8-4b96-9841-61cc71c68d44" changed="not-changed"><enum>(5)</enum><header>Funding</header><subparagraph commented="no" id="id31aa581b-8ca0-429c-b2ba-b69a5c064feb" changed="not-changed"><enum>(A)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the program $10,000,000 for each of fiscal years 2022 through 2026, to remain available until expended.</text></subparagraph><subparagraph id="idafbbdf0a-fa5a-4b8e-91b5-1e035142fbca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Administrative costs</header><text>Not more than 2 percent of the amount made available for a fiscal year under subparagraph (A) to carry out the program may be used by the Administrator for the administrative costs of carrying out the program.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="id1438B1BCADBD46C085B9B079169C18F2" style="OLC"><enum>II</enum><header>Clean water</header><section id="idEB68FF48742940C99302751156761841"><enum>201.</enum><header>Research, investigations, training, and information</header><subsection id="id6EF243D340DE4B26B7D34C6AE36C929C"><enum>(a)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 104(u) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(u)</external-xref>) is amended—</text><paragraph id="id2F99CBAF1BFA4B7AB6574BD4A0E9A3DA"><enum>(1)</enum><text>by striking <quote>and (7)</quote> and inserting <quote>(7)</quote>; and</text></paragraph><paragraph id="idCB293556060B4B898795B99FD1FCF794"><enum>(2)</enum><text>in paragraph (7)—</text><subparagraph id="idE63F8FA2865A404695DB6A4010BA1CAB"><enum>(A)</enum><text>by striking <quote>2023</quote> and inserting <quote>2021</quote>; and</text></subparagraph><subparagraph id="id69CF10150D48484C8A3A92ACAA569313"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and (8) not to exceed $75,000,000 for each of fiscal years 2022 through 2026 for carrying out subsections (b)(3), (b)(8), and (g), of which not less than $50,000,000 each fiscal year shall be used to carry out subsection (b)(8).</quote>.</text></subparagraph></paragraph></subsection><subsection id="id09D20E0FA72A4018A8552E18F4D1F156"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to Congress a report that describes the implementation of the grants authorized under subsections (b)(3), (b)(8), and (g) of section 104 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254</external-xref>), which shall include a description of the use and deployment of amounts made available to carry out those subsections.</text></subsection></section><section id="ida74dbd15-60e5-42cd-98d2-b33b02cb0016" changed="not-changed"><enum>202.</enum><header>Wastewater efficiency grant pilot program</header><subsection id="id5e241df7-c936-4b80-9a7f-b398408bf380" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4018e760-3c65-4fb6-840b-3861f5dae704" changed="not-changed"><enum>(1)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the wastewater efficiency grant pilot program established under subsection (b).</text></paragraph><paragraph id="ida37222e6-294f-4f12-8bf7-50c0d5e35226" changed="not-changed"><enum>(2)</enum><header>Treatment works</header><text>The term <term>treatment works</term> has the meaning given the term in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>).</text></paragraph></subsection><subsection id="id5581819f-f84f-4ea2-bca8-5f4d9098681e" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator shall establish a wastewater efficiency grant pilot program to award grants to owners or operators of publicly owned treatment works to carry out projects that create or improve waste-to-energy systems.</text></subsection><subsection commented="no" id="id555b4218-a138-413a-bbd4-a7590d9aff74" changed="not-changed"><enum>(c)</enum><header>Selection</header><paragraph commented="no" id="idfd4e730d-b360-4a37-8474-5dd635e8e66d" changed="not-changed"><enum>(1)</enum><header>Applications</header><text>To be eligible to receive a grant under the pilot program, an owner or operator of a treatment works shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></paragraph><paragraph commented="no" id="idaae2a9be-b89f-440c-a99f-95fd56ef3bdd" changed="not-changed"><enum>(2)</enum><header>Number of recipients</header><text>The Administrator shall select not more than 15 recipients of grants under the pilot program from applications submitted under paragraph (1).</text></paragraph></subsection><subsection id="id59b5e386-b544-4627-a96b-4a9e1641bc8e" changed="not-changed"><enum>(d)</enum><header>Use of funds</header><paragraph id="id554854ff-d4ff-4e78-ac5c-7adc16ae7a8d" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a recipient of a grant under the pilot program may use grant funds for—</text><subparagraph id="id3f3fac2d-5465-4c34-9ca2-88d94719cb19" changed="not-changed"><enum>(A)</enum><text>sludge collection;</text></subparagraph><subparagraph id="id94859989-bf41-46ba-bfa3-3645053d1e37" changed="not-changed"><enum>(B)</enum><text>installation of anaerobic digesters;</text></subparagraph><subparagraph id="id972b62d1-1b3b-4c3b-83d9-ae4e20ea908c" changed="not-changed"><enum>(C)</enum><text>methane capture;</text></subparagraph><subparagraph id="idf5726705-9c44-4e9f-af6c-692f2188bf45" changed="not-changed"><enum>(D)</enum><text>methane transfer;</text></subparagraph><subparagraph id="idc4bbf20b-f894-40da-9b0d-cfb09bf2e6a0" changed="not-changed"><enum>(E)</enum><text>facility upgrades and retrofits necessary to create or improve waste-to-energy systems; and</text></subparagraph><subparagraph id="id51413c19-f0cc-4a41-b8bb-df9da7e01e97" changed="not-changed"><enum>(F)</enum><text>other new and emerging, but proven, technologies that transform waste to energy.</text></subparagraph></paragraph><paragraph id="id47964629-43ba-4f7e-9cf0-5f991935d35d" changed="not-changed"><enum>(2)</enum><header>Limitation</header><text>A grant to a recipient under the pilot program shall be not more than $4,000,000.</text></paragraph></subsection><subsection commented="no" id="idc193daa7-228f-4c4b-b461-99815c9a3b30" changed="not-changed"><enum>(e)</enum><header>Reports</header><paragraph commented="no" id="iddc0f6500-0f07-42af-a3aa-a13f85719a03" changed="not-changed"><enum>(1)</enum><header>Report to the Administrator</header><text>Not later than 1 year after receiving a grant under the pilot program and each year thereafter for which amounts are made available for the pilot program under subsection (f), the recipient of the grant shall submit to the Administrator a report describing the impact of that project on the communities within 3 miles of the treatment works.</text></paragraph><paragraph commented="no" id="id04161fe8-6890-4991-b69e-5e9ba98f3825" changed="not-changed"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 1 year after first awarding grants under the pilot program and each year thereafter for which amounts are made available for the pilot program under subsection (f), the Administrator shall submit to Congress a report describing—</text><subparagraph commented="no" id="id48ba6e90-02fa-4ee1-a198-0e0b621a184c" changed="not-changed"><enum>(A)</enum><text>the applications received by the Administrator for grants under the pilot program; and</text></subparagraph><subparagraph commented="no" id="id4b59f35c-5227-4300-97aa-22234782e117" changed="not-changed"><enum>(B)</enum><text>the projects for which grants were awarded under the pilot program.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id8af61c70-b193-4502-8293-6a14c1f4353c" changed="not-changed"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph commented="no" id="idf4625893-4f1b-4976-bece-93e190ad634e" changed="not-changed"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the pilot program $20,000,000 for each of fiscal years 2022 through 2026, to remain available until expended.</text></paragraph><paragraph id="id5489326e-42e8-4e2a-9a53-043ae28e7b66" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator. </text></paragraph></subsection></section><section display-inline="no-display-inline" commented="no" id="idc7c571bf-9a23-475b-a777-a6b9d5cf5c59" changed="not-changed"><enum>203.</enum><header>Pilot program for alternative water source projects</header><text display-inline="no-display-inline">Section 220 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="id68040522-0a40-4972-91eb-f9018c8deca4" changed="not-changed"><enum>(1)</enum><text>in subsection (b), in the heading, by striking <quote><header-in-text style="OLC" level="subsection">In General</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Establishment</header-in-text></quote>;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="ideefbd850-331b-4f2b-9b2b-042aa7f108ff" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph display-inline="no-display-inline" commented="no" id="id2189d2b8-ccf4-45a7-a167-c2ca1a55ef9a" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (2); and</after-quoted-block></quoted-block></clause><clause id="id93c74273-ac69-4326-8367-7a4ea49ec4df" commented="no" changed="not-changed"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block id="ida869cba8-ac19-4285-92ba-bf5f760627b9" style="OLC" act-name="" changed="not-changed"><subparagraph id="ide99ee711-b562-4662-9949-324cc2a43db5" commented="no" changed="not-changed"><enum>(B)</enum><header>Rural or financially distressed community allocation</header><clause commented="no" id="id7f1f8ef3-3c7b-41fe-8e95-4c9b3f93fb8b" changed="not-changed"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text><subclause commented="no" changed="not-changed" id="id2E24FFB205FD4426A651C97E6574F362"><enum>(I)</enum><header>Financially distressed community</header><text>The term <term>financially distressed community</term> has the meaning given the term in subsection (c)(1).</text></subclause><subclause commented="no" changed="not-changed" id="idBF4970398BB74E2C8705352997407FE0"><enum>(II)</enum><header>Rural community</header><text>The term <term>rural community</term> means a city, town, or unincorporated area that has a population of not more than 10,000 inhabitants.</text></subclause></clause><clause commented="no" id="id10943acb-67fe-416d-a459-2e61b6a76fc5" changed="not-changed"><enum>(ii)</enum><header>Allocation</header><subclause commented="no" changed="not-changed" id="id05C0E8761DEB4859827FC78CC5D6F003"><enum>(I)</enum><header>In general</header><text>To the extent there are sufficient eligible project applications, the Administrator shall ensure that a State uses not less than 25 percent of the amount of the grants made to the State under subsection (a) in a fiscal year to carry out projects in rural communities or financially distressed communities for the purpose of planning, design, and construction of—</text><item id="id53e42719-eb61-45f5-b27f-eb8637cb0662" commented="no" changed="not-changed"><enum>(aa)</enum><text>treatment works to intercept, transport, control, treat, or reuse municipal sewer overflows, sanitary sewer overflows, or stormwater; or</text></item><item id="id623b5bf7-9231-46e7-83a9-daf25abbca83" commented="no" changed="not-changed"><enum>(bb)</enum><text>any other measures to manage, reduce, treat, or recapture stormwater or subsurface drainage water eligible for assistance under section 603(c).</text></item></subclause><subclause commented="no" changed="not-changed" id="id6EE71CE47B3C4657936386477C721CA2"><enum>(II)</enum><header>Rural communities</header><text>Of the funds allocated under subclause (I) for the purposes described in that subclause, to the extent there are sufficient eligible project applications, the Administrator shall ensure that a State uses not less than 60 percent to carry out projects in rural communities.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph changed="not-changed" commented="no" id="id4564642AE7034327A8A1EC0C23112C02"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id053065BBA88C4A2F826C6F5DABE24C3E" style="OLC" act-name=""><paragraph id="idAFF2E6B2CE154D74B1E5675452C4049D"><enum>(2)</enum><header>Use of funds</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that describes the implementation of the grant program under this section, which shall include a description of the use and deployment of amounts made available under the program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idc19851f3-3079-433a-9210-d37855a15ca6" changed="not-changed"><enum>205.</enum><header>Clean water infrastructure resiliency and sustainability program</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block id="id0fd51a37-3b85-44b2-93ba-2f0f617515a1" changed="not-changed" display-inline="no-display-inline" style="OLC"><section id="ida3f9705d-1eed-4877-97a1-38bd18a34a4b" changed="not-changed"><enum>222.</enum><header>Clean water infrastructure resiliency and sustainability program</header><subsection id="idb3e3b439-4037-4742-a1f3-035ac6fdf31f" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id67ff587e-fe65-4b97-9948-f569dcfc6123" changed="not-changed"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id25de295b-18c5-45e6-9a8a-188ddebedbb3" changed="not-changed"><enum>(A)</enum><text>a municipality; or</text></subparagraph><subparagraph id="idb74cb56a-1aaf-4225-9c97-3b40d2a4f78a" changed="not-changed"><enum>(B)</enum><text>an intermunicipal, interstate, or State agency.</text></subparagraph></paragraph><paragraph id="ida3de2680-6ebd-42d5-b8ad-aa9437152821" changed="not-changed"><enum>(2)</enum><header>Natural hazard</header><text>The term <term>natural hazard</term> means a hazard caused by natural forces, including extreme weather events, sea-level rise, and extreme drought conditions.</text></paragraph><paragraph id="ida62e8c8c-b2b1-49cd-8226-ff7a6aaf5f00" changed="not-changed"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the clean water infrastructure resilience and sustainability program established under subsection (b).</text></paragraph></subsection><subsection id="id47f98a9c-80be-4679-87f6-64f1cb524252" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator shall establish a clean water infrastructure resilience and sustainability program under which the Administrator shall award grants to eligible entities for the purpose of increasing the resilience of publicly owned treatment works to a natural hazard or a cybersecurity threat.</text></subsection><subsection id="id1e1dca28-a0f6-4551-a0a3-1c655a1d7aad" changed="not-changed"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity that receives a grant under the program shall use the grant funds for planning, designing, or constructing projects (on a system-wide or area-wide basis) that increase the resilience of a publicly owned treatment works to a natural hazard or a cybersecurity threat through—</text><paragraph id="id98d52a36-63d3-4e11-a563-2580f08f5af2" changed="not-changed"><enum>(1)</enum><text>the conservation of water;</text></paragraph><paragraph id="id13be2bb8-091d-4126-9cb6-1cb3138effc6" changed="not-changed"><enum>(2)</enum><text>the enhancement of water use efficiency;</text></paragraph><paragraph id="id5f7f8694-1d59-466b-b754-e204ac7c3ae5" changed="not-changed"><enum>(3)</enum><text>the enhancement of wastewater and stormwater management by increasing watershed preservation and protection, including through the use of—</text><subparagraph id="id12843b19-3a1b-4221-9ac9-29104c4ef81a" changed="not-changed"><enum>(A)</enum><text>natural and engineered green infrastructure; and</text></subparagraph><subparagraph id="id682f5c46-1592-456e-8722-17c000f0fe66" changed="not-changed"><enum>(B)</enum><text>reclamation and reuse of wastewater and stormwater, such as aquifer recharge zones;</text></subparagraph></paragraph><paragraph id="idca7a1c4e-21ca-4828-9f3e-a3be3f8dd5e3" changed="not-changed"><enum>(4)</enum><text>the modification or relocation of an existing publicly owned treatment works, conveyance, or discharge system component that is at risk of being significantly impaired or damaged by a natural hazard;</text></paragraph><paragraph id="id50192e91-d79b-40f1-a110-36ad894cef86" changed="not-changed"><enum>(5)</enum><text>the development and implementation of projects to increase the resilience of publicly owned treatment works to a natural hazard or a cybersecurity threat, as applicable; or</text></paragraph><paragraph id="id0dab4cd3-e4b2-4855-910b-4607d42265fe" changed="not-changed"><enum>(6)</enum><text>the enhancement of energy efficiency or the use and generation of recovered or renewable energy in the management, treatment, or conveyance of wastewater or stormwater.</text></paragraph></subsection><subsection id="id933bfe58-7fc7-43d4-95f2-76feb5a0883a" changed="not-changed"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><paragraph id="idf085a8cb-b24c-41ad-b28e-f9fda5ba9eba" changed="not-changed"><enum>(1)</enum><text>a proposal of the project to be planned, designed, or constructed using funds under the program;</text></paragraph><paragraph id="idcb446480-c44b-43bf-9794-b87b05dbb66d" changed="not-changed"><enum>(2)</enum><text>an identification of the natural hazard risk or potential cybersecurity threat, as applicable, to be addressed by the proposed project;</text></paragraph><paragraph id="idb7be22f7-425b-42bb-be7d-9736a445002a" changed="not-changed"><enum>(3)</enum><text>documentation prepared by a Federal, State, regional, or local government agency of the natural hazard risk or potential cybersecurity threat, as applicable, of the area where the proposed project is to be located;</text></paragraph><paragraph id="id10179a45-c4e9-428a-9b35-253efbe16350" changed="not-changed"><enum>(4)</enum><text>a description of any recent natural hazard events or cybersecurity threats that have affected the publicly owned treatment works;</text></paragraph><paragraph id="id2ab8ed59-e9d2-4fd6-891b-c94e93c00b58" changed="not-changed"><enum>(5)</enum><text>a description of how the proposed project would improve the performance of the publicly owned treatment works under an anticipated natural hazard or cybersecurity threat, as applicable; and</text></paragraph><paragraph id="id3ee585e9-1963-4a3a-bde8-57bd8c569a0c" changed="not-changed"><enum>(6)</enum><text>an explanation of how the proposed project is expected to enhance the resilience of the publicly owned treatment works to an anticipated natural hazard or cybersecurity threat, as applicable.</text></paragraph></subsection><subsection id="idac988cdd-066c-47d7-8cd7-5ef2b56be958" changed="not-changed"><enum>(e)</enum><header>Grant amount and other federal requirements</header><paragraph id="id7f0ef3f9-f615-4c15-b300-900bdef01334" changed="not-changed"><enum>(1)</enum><header>Cost share</header><text>Except as provided in paragraph (2), a grant under the program shall not exceed 75 percent of the total cost of the proposed project.</text></paragraph><paragraph id="idD69B617DD45541F6A2237BA1D0DF58D6" changed="not-changed"><enum>(2)</enum><header>Exception</header><subparagraph id="idEDADB4DECF5543DFBC147085AD93DD8D" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a grant under the program shall not exceed 90 percent of the total cost of the proposed project if the project serves a community that—</text><clause id="id06867688DBE04BFAA107AEA8E3E38F79" changed="not-changed"><enum>(i)</enum><text>has a population of fewer than 10,000 individuals; or</text></clause><clause id="id4EC418B4204D48D8B0D11B4C461479A4" changed="not-changed"><enum>(ii)</enum><text>meets the affordability criteria established by the State in which the community is located under section 603(i)(2).</text></clause></subparagraph><subparagraph id="id3575A6C2405549D1BDB9A475296AFE0B" changed="not-changed"><enum>(B)</enum><header>Waiver</header><text>At the discretion of the Administrator, a grant for a project described in subparagraph (A) may cover 100 percent of the total cost of the proposed project.</text></subparagraph></paragraph><paragraph id="id67316995-3b5b-409e-8d4a-a17d7fb26086" changed="not-changed"><enum>(3)</enum><header>Requirements</header><text>The requirements of section 608 shall apply to a project funded with a grant under the program.</text></paragraph></subsection><subsection changed="not-changed" id="id45B8BE163B5643E788A88FDEA9D4956B"><enum>(f)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator shall submit to Congress a report that describes the implementation of the program, which shall include—</text><paragraph changed="not-changed" id="id059368AC92834D17B90F56FF65F6AE17"><enum>(1)</enum><text>a description of the use and deployment of amounts made available under the program; and</text></paragraph><paragraph changed="not-changed" id="idB4B0373114F349E0A54F7469D61A2B89"><enum>(2)</enum><text>an accounting of all grants awarded under the program, including a description of each grant recipient and each project funded using a grant under the program.</text></paragraph></subsection><subsection id="id26f2b01c-b15d-48e2-bc9d-e27dd28bd75b" changed="not-changed"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="id274bbf40-c63c-46cf-8950-b5b29652a04d" changed="not-changed"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="id0ac455e5-6df8-4886-8fe8-0cdf3bf92730" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Limitation on use of funds</header><text>Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id24ca5b1f-2697-48ef-a3ab-5c3218818350" commented="no" changed="not-changed"><enum>206.</enum><header>Small and medium publicly owned treatment works circuit rider program</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) (as amended by section 205) is amended by adding at the end the following:</text><quoted-block act-name="" id="idf414d075-e680-4c61-b6b2-2827cb0b4c1b" style="OLC" changed="not-changed"><section id="id5b6d93e5-ff54-4626-b601-7ab164635372" commented="no" changed="not-changed"><enum>223.</enum><header>Small and medium publicly owned treatment works circuit rider program</header><subsection id="id11195bc5-60fd-4cc6-9b1d-a9f8511d7b59" commented="no" changed="not-changed"><enum>(a)</enum><header>Establishment</header><text>Subject to the availability of appropriations, not later than 180 days after the date of enactment of this section, the Administrator shall establish a circuit rider program (referred to in this section as the <quote>circuit rider program</quote>) under which the Administrator shall award grants to qualified nonprofit entities, as determined by the Administrator, to provide assistance to owners and operators of small and medium publicly owned treatment works to carry out the activities described in section 602(b)(13).</text></subsection><subsection id="idf1303b3f-6487-4de3-a3db-28a618fe0060" commented="no" changed="not-changed"><enum>(b)</enum><header>Limitation</header><text>A grant provided under the circuit rider program shall be in an amount that is not more than $75,000.</text></subsection><subsection id="idfb2a7ca3-6af1-4216-87ff-3684f4bbc33f" commented="no" changed="not-changed"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date on which the Administrator establishes the circuit rider program, and every 180 days thereafter, the Administrator shall submit to Congress a report describing—</text><paragraph id="id88a35d55-1dd4-44a8-9b63-3a22e393fa66" commented="no" changed="not-changed"><enum>(1)</enum><text>each recipient of a grant under the circuit rider program; and</text></paragraph><paragraph id="id5ad942f4-00b3-4c68-98cd-85ffd9cf47d7" commented="no" changed="not-changed"><enum>(2)</enum><text>a summary of the activities carried out under the circuit rider program.</text></paragraph></subsection><subsection id="idc745fef0d6464285893679b70de4d215"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="ida646cfdc9d08424793399d9cfe8c616d"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for the period of fiscal years 2022 through 2026.</text></paragraph><paragraph id="idf3d8a52e407b443b829b9486b126d89e"><enum>(2)</enum><header>Limitation on use of funds</header><text>Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id63bd1d86-5ddc-4ad2-b0a0-98e62759b606" changed="not-changed"><enum>207.</enum><header>Small publicly owned treatment works efficiency grant program</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) (as amended by section 206) is amended by adding at the end the following:</text><quoted-block id="id8b9020f6-4b65-4dbf-8c44-8cbe217f8d37" changed="not-changed" display-inline="no-display-inline" style="OLC" act-name=""><section id="idcf7f0e0b-9439-4ddf-bdf2-39098409c3c8" changed="not-changed"><enum>224.</enum><header>Small publicly owned treatment works efficiency grant program</header><subsection id="id231c3a97-76ee-4630-808d-57379cfaf7d9" changed="not-changed"><enum>(a)</enum><header>Establishment</header><text>Subject to the availability of appropriations, not later than 180 days after the date of enactment of this section, the Administrator shall establish an efficiency grant program (referred to in this section as the <quote>efficiency grant program</quote>) under which the Administrator shall award grants to eligible entities for the replacement or repair of equipment that improves water or energy efficiency of small publicly owned treatment works, as identified in an efficiency audit.</text></subsection><subsection id="id00c0eb2e-0d47-4324-bea0-e122be26df6f" changed="not-changed"><enum>(b)</enum><header>Eligible entities</header><text>The Administrator may award a grant under the efficiency grant program to an owner or operator of a small publicly owned treatment works that serves—</text><paragraph id="id12d76b56-a54e-4daa-82a9-07d81a77f5d1" changed="not-changed"><enum>(1)</enum><text>a population of not more than 10,000 people; or</text></paragraph><paragraph id="id879a591b-62ef-4193-a95d-1197187ff248" changed="not-changed"><enum>(2)</enum><text>a disadvantaged community.</text></paragraph></subsection><subsection id="id64795670-6a62-4408-83f7-d57a51187676" changed="not-changed"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date on which the Administrator establishes the efficiency grant program, and every 180 days thereafter, the Administrator shall submit to Congress a report describing—</text><paragraph id="idbb67f118-6e9d-4825-b020-b785e11385b2" changed="not-changed"><enum>(1)</enum><text>each recipient of a grant under the efficiency grant program; and</text></paragraph><paragraph id="id22fe9f74-0cd5-4415-a37e-e3c06750e6c5" changed="not-changed"><enum>(2)</enum><text>a summary of the activities carried out under the efficiency grant program.</text></paragraph></subsection><subsection changed="not-changed" id="id2AD323612B8940639C2C1850F40290BE"><enum>(d)</enum><header>Use of funds</header><paragraph changed="not-changed" id="id37A389AE9CE34A91BFB143CD9CAE320C"><enum>(1)</enum><header>Small systems</header><text>Of the amounts made available for grants under this section, to the extent that there are sufficient applications, not less than 15 percent shall be used for grants to publicly owned treatment works that serve fewer than 3,300 people.</text></paragraph><paragraph id="id5d1be8e7-f443-4610-be67-d0705aaf4f56" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">Of the amounts made available for grants under this section, not more than 2 percent may be used to pay the administrative costs of the Administrator. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8054f043708243b8b289947500c8820d"><enum>208.</enum><header>Grants for construction, refurbishing, and servicing of individual household decentralized wastewater systems for individuals with low or moderate income</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) (as amended by section 207) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id19d82373d1734cbdbd6861d82e890cf5"><section id="idd024d4aad4b24ae588200dab2ff23bd9"><enum>225.</enum><header>Grants for construction, refurbishing, and servicing of individual household decentralized wastewater systems for individuals with low or moderate income</header><subsection id="id703e69385e5f42f5917399291486f300"><enum>(a)</enum><header>Definition of eligible individual</header><text>In this section, the term <term>eligible individual</term> means a member of a low-income or moderate-income household, the members of which have a combined income (for the most recent 12-month period for which information is available) equal to not more than 50 percent of the median nonmetropolitan household income for the State or territory in which the household is located, according to the most recent decennial census.</text></subsection><subsection id="id5E55159ED29E418FA02E541C5C6AE9F2"><enum>(b)</enum><header>Grant program</header><paragraph id="idf1f3e11977d14e98ae693edaba312bc7"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Administrator shall establish a program under which the Administrator shall provide grants to private nonprofit organizations for the purpose of improving general welfare by providing assistance to eligible individuals—</text><subparagraph id="id64fc783c2a914c86ba0a51de02ddcc03"><enum>(A)</enum><text>for the construction, repair, or replacement of an individual household decentralized wastewater treatment system; or</text></subparagraph><subparagraph id="idba0bdbb00a264f219cab6227caec4cca"><enum>(B)</enum><text>for the installation of a larger decentralized wastewater system designed to provide treatment for 2 or more households in which eligible individuals reside, if—</text><clause id="id2e9af9781dcd4363b989c1cbf43c04ca"><enum>(i)</enum><text>site conditions at the households are unsuitable for the installation of an individually owned decentralized wastewater system;</text></clause><clause id="idc2b19bd0021949deb339767482c7a48e"><enum>(ii)</enum><text>multiple examples of unsuitable site conditions exist in close geographic proximity to each other; and</text></clause><clause id="id32fb5320f857480ebe319186730df832"><enum>(iii)</enum><text>a larger decentralized wastewater system could be cost-effectively installed. </text></clause></subparagraph></paragraph><paragraph id="idd78a578ba12742d9978172a6fa188b0b"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a grant under this subsection, a private nonprofit organization shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator determines to be appropriate.</text></paragraph><paragraph id="id9984e04c0d934be2b55de9c1472c7506"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this subsection, the Administrator shall give priority to applicants that have substantial expertise and experience in promoting the safe and effective use of individual household decentralized wastewater systems.</text></paragraph><paragraph id="idd5802eaed43c43628cc27d922de91bbb"><enum>(4)</enum><header>Administrative expenses</header><text>A private nonprofit organization may use amounts provided under this subsection to pay the administrative expenses associated with the provision of the services described in paragraph (1), as the Administrator determines to be appropriate.</text></paragraph></subsection><subsection id="ida06d1a8193374da0af763e525bfb7db3"><enum>(c)</enum><header>Assistance</header><paragraph id="id831262503fe44d6c80d9668a30148137"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a private nonprofit organization shall use a grant provided under subsection (b) for the services described in paragraph (1) of that subsection.</text></paragraph><paragraph id="id259fc03c4ee04a1fb69f334d2f4afe48"><enum>(2)</enum><header>Application</header><text>To be eligible to receive the services described in subsection (b)(1), an eligible individual shall submit to the private nonprofit organization serving the area in which the individual household decentralized wastewater system of the eligible individuals is, or is proposed to be, located an application at such time, in such manner, and containing such information as the private nonprofit organization determines to be appropriate.</text></paragraph><paragraph id="id229b541efbad41f0b07b9df039eeae69"><enum>(3)</enum><header>Priority</header><text>In awarding assistance under this subsection, a private nonprofit organization shall give priority to any eligible individual who does not have access to a sanitary sewage disposal system.</text></paragraph></subsection><subsection id="id7822d1cf922d44af84f65dcb0c4da398"><enum>(d)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this section, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the recipients of grants under the program under this section and the results of the program under this section.</text></subsection><subsection id="idcc902c09d5fb427d82b62a72fad0df77"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="id1925da4a58ff49e587266748d840f23d"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section $50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="id2bb317bed6714903b86d2ae4b32e3eeb"><enum>(2)</enum><header>Limitation on use of funds</header><text>Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idaa5079c8b70f4842868ec611ffd619d1"><enum>209.</enum><header>Connection to publicly owned treatment works</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) (as amended by section 208) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5d513c9b23fc49cab7f828d25a546468"><section id="id0c5ab72878484ded81fd2f33be4a5960"><enum>226.</enum><header>Connection to publicly owned treatment works</header><subsection id="idcc5e7d1ca2ad4d418a9f0164e061250b"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id30934dd2d4854a82a4c73c8f87a5f435"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id2c5694734f3a43d496dc97793ac291bd"><enum>(A)</enum><text>an owner or operator of a publicly owned treatment works that assists or is seeking to assist low-income or moderate-income individuals with connecting the household of the individual to the publicly owned treatment works; or</text></subparagraph><subparagraph id="id80d6569a9c2549c2b297cdb98ad59cc6"><enum>(B)</enum><text>a nonprofit entity that assists low-income or moderate-income individuals with the costs associated with connecting the household of the individual to a publicly owned treatment works.</text></subparagraph></paragraph><paragraph id="id6454588fb1234eb99653fc9e60d95baa"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under subsection (b).</text></paragraph><paragraph id="id2742a004c16a4755a90c250c25e9e132"><enum>(3)</enum><header>Qualified individual</header><text>The term <term>qualified individual</term> has the meaning given the term <term>eligible individual</term> in section 603(j).</text></paragraph></subsection><subsection id="idc9e7488a2386416a99e1b580c34992c9"><enum>(b)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator shall establish a competitive grant program with the purpose of improving general welfare, under which the Administrator awards grants to eligible entities to provide funds to assist qualified individuals in covering the costs incurred by the qualified individual in connecting the household of the qualified individual to a publicly owned treatment works.</text></subsection><subsection id="idc8d69fbf0ac64ebabc9fd633f7b1e0b2"><enum>(c)</enum><header>Application</header><paragraph id="idcd686572b16445a5abc81ea67ef3ed81"><enum>(1)</enum><header>In general</header><text>An eligible entity seeking a grant under the program shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may by regulation require.</text></paragraph><paragraph id="id59861e4df006447c86dec613875fe678"><enum>(2)</enum><header>Requirement</header><text>Not later than 90 days after the date on which the Administrator receives an application from an eligible entity under paragraph (1), the Administrator shall notify the eligible entity of whether the Administrator will award a grant to the eligible entity under the program.</text></paragraph></subsection><subsection id="iddf9adf9e9ffd43f8be9a8474d5c51802"><enum>(d)</enum><header>Selection criteria</header><text>In selecting recipients of grants under the program, the Administrator shall use the following criteria:</text><paragraph id="id424a6cb40b414533a141d143dfe15caa"><enum>(1)</enum><text>Whether the eligible entity seeking a grant provides services to, or works directly with, qualified individuals.</text></paragraph><paragraph id="idfe54f5d5f774470e99f75dd7ae488c13"><enum>(2)</enum><text>Whether the eligible entity seeking a grant—</text><subparagraph id="id0692791e65314891b21a0d11d6569d71"><enum>(A)</enum><text>has an existing program to assist in covering the costs incurred in connecting a household to a publicly owned treatment works; or</text></subparagraph><subparagraph id="id110a35ccd17d44cb8b23e8c8baa600bc"><enum>(B)</enum><text>seeks to create a program described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id4cc9eb3a9ec94623bc286ce630a66785"><enum>(e)</enum><header>Requirements</header><paragraph id="iddfddc994f7c941a3bdceac1ad34e23b9"><enum>(1)</enum><header>Voluntary connection</header><text>Before providing funds to a qualified individual for the costs described in subsection (b), an eligible entity shall ensure that—</text><subparagraph id="id4d02053e86be427a9f441ea7dd5cbb49"><enum>(A)</enum><text>the qualified individual has connected to the publicly owned treatment works voluntarily; and</text></subparagraph><subparagraph id="id085c9dca74914dbfae9c71e46eea72bd"><enum>(B)</enum><text>if the eligible entity is not the owner or operator of the publicly owned treatment works to which the qualified individual has connected, the publicly owned treatment works to which the qualified individual has connected has agreed to the connection.</text></subparagraph></paragraph><paragraph id="id3bf7a7e2c3604dc6a7f69cf038f0771b"><enum>(2)</enum><header>Reimbursements from publicly owned treatment works</header><text>An eligible entity that is an owner or operator of a publicly owned treatment works may reimburse a qualified individual that has already incurred the costs described in subsection (b) by—</text><subparagraph id="id31918b7dbc3b4402b299574598fda330"><enum>(A)</enum><text>reducing the amount otherwise owed by the qualified individual to the owner or operator for wastewater or other services provided by the owner or operator; or</text></subparagraph><subparagraph id="ida69e5aa1516f4ace85cbdee3f092a6b5"><enum>(B)</enum><text>providing a direct payment to the qualified individual.</text></subparagraph></paragraph></subsection><subsection id="id9AD912FFC8D445038EBA2C55188DDB3B"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="id2ac1be512b0e48c39b44895d3c3f7249"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the program $40,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="id3820845f4b27455f92acb91a2e643bb5"><enum>(2)</enum><header>Limitations on use of funds</header><subparagraph id="idB8ECAF654D5E4906A8FB0417578BD57F" commented="no"><enum>(A)</enum><header>Small systems</header><text>Of the amounts made available for grants under paragraph (1), to the extent that there are sufficient applications, not less than 15 percent shall be used to make grants to—</text><clause id="id25CD53633D73440ABB42EF93DA5F1599" commented="no"><enum>(i)</enum><text>eligible entities described in subsection (a)(1)(A) that are owners and operators of publicly owned treatment works that serve fewer than 3,300 people; and</text></clause><clause id="idC2CA4D7A97B84A8DB300B3419D848AA0" commented="no"><enum>(ii)</enum><text>eligible entities described in subsection (a)(1)(B) that provide the assistance described in that subsection in areas that are served by publicly owned treatment works that serve fewer than 3,300 people.</text></clause></subparagraph><subparagraph id="idC0DF6B1C4D534BD88935822DB7044BB9"><enum>(B)</enum><header>Administrative costs</header><text>Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id92CC4ABEBA0D447A9042A3174D50F395"><enum>210.</enum><header>Clean water State revolving funds</header><subsection id="id875ea5fb8bd648bbaa750e67de933afc"><enum>(a)</enum><header>Use of funds</header><paragraph id="id64B5A893DA7C49AE801A628D3F127E8B"><enum>(1)</enum><header>In general</header><text>Section 603 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended—</text><subparagraph id="idfaa1c9b19358416395f1a0dceeda3bcf"><enum>(A)</enum><text>in subsection (d), in the matter preceding paragraph (1), by inserting <quote>and provided in subsection (k)</quote> after <quote>State law</quote>;</text></subparagraph><subparagraph id="id24c6deef2b354eee812253aee7f754e8"><enum>(B)</enum><text>in subsection (i)—</text><clause id="idbd2181f8e7b3421a8f1a50c73c86c1cd"><enum>(i)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>, including forgiveness of principal and negative interest loans</quote> and inserting <quote>(including forgiveness of principal, grants, negative interest loans, other loan forgiveness, and through buying, refinancing, or restructuring debt)</quote>; and</text></clause><clause id="id340fd9314d694a82856894951796e45b"><enum>(ii)</enum><text>in paragraph (3), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18866bec4c39468f81e817c859ab851d"><subparagraph id="id7fc14f95497145db97a3c5d69063e14d"><enum>(B)</enum><header>Total amount of subsidization</header><text>For each fiscal year, of the amount of the capitalization grant received by the State under this title, the total amount of additional subsidization made available by a State under paragraph (1)—</text><clause id="idaa10620e73de488ebbff35f8e40ffc3c"><enum>(i)</enum><text>may not exceed 30 percent; and</text></clause><clause id="ida9ae213ad3cd4330ae2378ac1cb82576"><enum>(ii)</enum><text>to the extent that there are sufficient applications for assistance to communities described in that paragraph, may not be less than 10 percent.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id2f88fc12a5ad468781107c92db247f4e"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1968426ab4f146abac69e0c0e1aba45c"><subsection id="id0b09ecd7c4f54ce8944b634f96d66027"><enum>(k)</enum><header>Additional use of funds</header><text>A State may use an additional 2 percent of the funds annually allotted to each State under this section for nonprofit organizations (as defined in section 104(w)) to provide technical assistance to rural, small, and tribal publicly owned treatment works (within the meaning of section 104(b)(8)(B)) in the State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3ff759f7aea146aa98c1accb1073e31a"><enum>(2)</enum><header>Technical amendment</header><text>Section 104(w) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(w)</external-xref>) is amended by striking <quote>treatments works</quote> and inserting <quote>treatment works</quote>.</text></paragraph></subsection><subsection id="idF7D7DC9F1A8E433CA15ED7B1208E25D0"><enum>(b)</enum><header>Capitalization grant reauthorization</header><text display-inline="yes-display-inline">Section 607 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1387">33 U.S.C. 1387</external-xref>) is amended to read as follows:</text><quoted-block id="id4FAAC5CE9E7047E580D0CBF128088308" style="OLC" act-name=""><section id="idA2F74C5B6DAF4BF69206BD4E4892654B" section-type="subsequent-section"><enum>607.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out the purposes of this title—</text><paragraph id="id9FEA9F9834CB4FDFA138F9DBD00EF06A"><enum>(1)</enum><text>$2,400,000,000 for fiscal year 2022;</text></paragraph><paragraph id="idAD9179C07C664E0B920F1B0FD091A172"><enum>(2)</enum><text>$2,750,000,000 for fiscal year 2023;</text></paragraph><paragraph id="id3A109C06076B441C9962F21BD6F95D97"><enum>(3)</enum><text>$3,000,000,000 for fiscal year 2024; and</text></subparagraph><subparagraph id="id9F952DF2FCA3424D8118A1E02575BBD8"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>community-based organizations</quote> and all that follows through the period at the end and inserting the following: </text><quoted-block id="idA90850B8A930417F9636B091C3970684" style="OLC" act-name="" display-inline="yes-display-inline"><text>community-based organizations and public works departments or agencies to align water and wastewater utility workforce recruitment efforts, training programs, retention efforts, and community resources with water and wastewater utilities—</text><clause id="id66B98F59358749ECAE7F361DD42EC568"><enum>(i)</enum><text>to accelerate career pipelines;</text></clause><clause id="idD0BE21287CC944F2BAC9712A89800F8F"><enum>(ii)</enum><text>to ensure the sustainability of the water and wastewater utility workforce; and</text></clause><clause id="idD844A45F7B7D4D2BB78D2D4B7D27FCB6"><enum>(iii)</enum><text>to provide access to workforce opportunities.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id37598FC6433640DF906F1B813B6E3C9D"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id4D20E428E8CB4C6C983BDB8BE505EF6E"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id11E532C430E34FBAAF74C667E01D7F76" commented="no"><enum>(i)</enum><text>by striking subparagraph (B);</text></clause><clause commented="no" id="idF8F8200B0CBF40359C3549B0D1185F01"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>; and</text></clause><clause id="idCCD175E0C25845F9A70ED1D2D3F3B0B5"><enum>(ii)</enum><text>individuals seeking to advance careers within the water and wastewater utility sector; and</text></clause></subparagraph><subparagraph id="idA6BEB847B22F4772AA8C393B53D55C82"><enum>(C)</enum><text>expanding the use and availability of activities and strategies, including the development of innovative activities and strategies, that relate to the maintenance and retention of a sustainable workforce in the water and wastewater utility sector.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="id4A843D264D5842C496BF17B491FDA0E0"><enum>(B)</enum><text>in paragraph (2)—</text><clause commented="no" id="id4DE193A1128A4C7F922F7597D558100C"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>institutions—</quote> and inserting <quote>institutions, or public works departments and agencies—</quote>; and</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph commented="no" id="id6D59F0D80BC74E0C9DF84DAC9988BEE5"><enum>(C)</enum><text>in paragraph (3)—</text><clause commented="no" id="id188A005D926D49A587065BC1ECD868CF"><enum>(i)</enum><text>in subparagraph (D)(ii), by inserting <quote>or certification</quote> after <quote>training</quote>; and</text></clause><clause commented="no" id="idA65109CD139B49779726DF76F4C6ACA0"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>ensure that incumbent water and waste water utilities workers</quote> and inserting <quote>are designed to retain incumbent water and wastewater utility workforce workers by ensuring that those workers</quote>; and</text></clause></subparagraph><subparagraph commented="no" id="id1596E9EE7D534C609D5FDD9DA0B049B2"><enum>(D)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block id="id5F48977C0E1242B493B64CAE0B9DDB5E" style="OLC" act-name=""><paragraph id="idBFA1B266F22346318455081AF74C1E92"><enum>(4)</enum><header>Working group; report</header><subparagraph id="id940EA6E4EB5B4333A40AA7AD386925E1"><enum>(A)</enum><header>In general</header><text>The Administrator shall establish and coordinate a Federal interagency working group to address recruitment, training, and retention challenges in the water and wastewater utility workforce, which shall include representatives from—</text><clause id="id7402E6866C16418D80E6A7ECA8F43205"><enum>(i)</enum><text>the Department of Education;</text></clause><clause id="id91DFB3001BF2416C834B4F61DF7F3104"><enum>(ii)</enum><text> the Department of Labor;</text></clause><clause id="idDBC74557447144309F9963BB8331C13A"><enum>(iii)</enum><text>the Department of Agriculture;</text></clause><clause id="id3E0F231F20264FA1907865A7E2590F00"><enum>(iv)</enum><text>the Department of Veterans Affairs; and</text></clause><clause id="idB7EBEF05919E4651A14BE050A9168DC0"><enum>(v)</enum><text>other Federal agencies, as determined to be appropriate by the Administrator.</text></clause></subparagraph><subparagraph id="id54B403DAF57A4C669C08EFAF18A1FD60" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Drinking Water and Wastewater Infrastructure Act of 2021</short-title>, the Administrator, in coordination with the working group established under subparagraph (A), shall submit to Congress a report describing potential solutions to recruitment, training, and retention challenges in the water and wastewater utility workforce. </text></subparagraph></paragraph><paragraph id="id6FB451777C874557BEEABA9FB46715E2"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id379D9CBAF55341AFB3523CF6037081CE"><enum>(3)</enum><text>by redesignating subsections (a) and (b) as subsections (b) and (c), respectively; and</text></paragraph><paragraph commented="no" id="id797B75060E334D07BC49700E5FCC7920"><enum>(4)</enum><text>by inserting before subsection (b) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96f340711a3d44b98e3c91256d0ec391"><subsection id="id8accd337490b4d0f8d6b0de12ed89ace"><enum>(a)</enum><header>Definition of public works department or agency</header><text>In this section, the term <term>public works department or agency</term> means a political subdivision of a local, county, or regional government that designs, builds, operates, and maintains water infrastructure, sewage and refuse disposal systems, and other public water systems and facilities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id9E731627D9FF4E1D8632329DF275A328"><enum>212.</enum><header>Grants to Alaska to improve sanitation in rural and Native villages</header><text display-inline="no-display-inline">Section 303(e) of the Safe Drinking Water Act Amendments of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/33/1263a">33 U.S.C. 1263a(e)</external-xref>) is amended by striking <quote>this section</quote> and all that follows through the period at the end and inserting the following: </text><quoted-block id="id74F50DC814684BF69AA335E5F67C099A" style="OLC" act-name="" display-inline="yes-display-inline"><text>this section—</text><paragraph id="idE4059AC006BA4AC4A1E7CB364EC773A5"><enum>(1)</enum><text>$40,000,000 for each of fiscal years 2022 through 2024;</text></paragraph><paragraph id="id9CABB2A140924528AA7DE5818D71AA5F"><enum>(2)</enum><text>$50,000,000 for fiscal year 2025; and</text></paragraph><paragraph id="id9943EF6F7B654D8D97671300EE18889C"><enum>(3)</enum><text>$60,000,000 for fiscal year 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3b8f3b22-404a-4d88-8af1-ea29864ff11a" section-type="subsequent-section" changed="not-changed"><enum>213.</enum><header>Water data sharing pilot program</header><subsection id="id8783e742-0377-4e78-a6b7-845db4702ba2" changed="not-changed"><enum>(a)</enum><header>Establishment</header><paragraph id="id9536f167-0830-4314-a452-54768e0d482c" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Administrator shall establish a competitive grant pilot program (referred to in this section as the <term>pilot program</term>) under which the Administrator may award grants to eligible entities under subsection (b) to establish systems that improve the sharing of information concerning water quality, water infrastructure needs, and water technology, including cybersecurity technology, between States or among counties and other units of local government within a State, which may include—</text><subparagraph id="id1d2581fc-d086-48df-a043-a26225dba4f1" changed="not-changed"><enum>(A)</enum><text>establishing a website or data hub to exchange water data, including data on water quality or water technology, including new and emerging, but proven, water technology; and</text></subparagraph><subparagraph id="idfce76ec5-a660-4d2b-8ce3-7239b8bb6617" changed="not-changed"><enum>(B)</enum><text>intercounty communications initiatives related to water data. </text></subparagraph></paragraph><paragraph id="id14aed8ef-bee7-4cd8-b050-ca7bea24b72e" changed="not-changed"><enum>(2)</enum><header>Requirements</header><subparagraph id="id1cf8ce0d-d5a8-4f9c-97ae-3033653e5514" changed="not-changed"><enum>(A)</enum><header>Data sharing</header><text>The Internet of Water principles developed by the Nicholas Institute for Environmental Policy Solutions shall, to the extent practicable, guide any water data sharing efforts under the pilot program.</text></subparagraph><subparagraph id="id95d06586-5700-45c0-ab75-2f0e395ff240" changed="not-changed"><enum>(B)</enum><header>Use of existing data</header><text>The recipient of a grant under the pilot program to establish a website or data hub described in paragraph (1)(A) shall, to the extent practicable, leverage existing data sharing infrastructure.</text></subparagraph></paragraph></subsection><subsection id="id052a8540-e62d-40f5-a64b-f13c06868cb1" changed="not-changed"><enum>(b)</enum><header>Eligible entities</header><text>An entity eligible for a grant under the pilot program is—</text><paragraph id="id10b0953d-e29a-4e0a-9975-4be0ef327cf1" changed="not-changed"><enum>(1)</enum><text>a State, county, or other unit of local government that—</text><subparagraph id="id64c07db4-3a77-4045-9ffd-87188b5d6055" changed="not-changed"><enum>(A)</enum><text>has a coastal watershed with significant pollution levels;</text></subparagraph><subparagraph id="id517bc413-5150-4fff-9219-2081e72cf14b" changed="not-changed"><enum>(B)</enum><text>has a water system with significant pollution levels; or</text></subparagraph><subparagraph id="idc280ef96-f54a-4574-a441-0dfbcd90a807" changed="not-changed"><enum>(C)</enum><text>has significant individual water infrastructure deficits; or</text></subparagraph></paragraph><paragraph id="id9b7ae131-7075-432c-bbd5-622abd83372d" changed="not-changed"><enum>(2)</enum><text>a regional consortium established under subsection (d).</text></paragraph></subsection><subsection id="id335d1933-4426-402c-a690-34bbcd18680c" commented="no" changed="not-changed"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under the pilot program, an eligible entity under subsection (b) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subsection><subsection commented="no" id="id220a6ee4-51cd-479c-bc45-28a7c6be96c5" changed="not-changed"><enum>(d)</enum><header>Regional consortia</header><paragraph commented="no" id="idada8bcbe-ce5d-4492-af70-1ee517cd5f02" changed="not-changed"><enum>(1)</enum><header>Establishment</header><text>States may establish regional consortia in accordance with this subsection.</text></paragraph><paragraph commented="no" id="id2a28222e-3543-4425-89c1-eddd57dc3c56" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text>A regional consortium established under paragraph (1) shall—</text><subparagraph commented="no" id="ide0738ea8-906d-464c-89ad-a2a80562a166" changed="not-changed"><enum>(A)</enum><text>include not fewer than 2 States that have entered into a memorandum of understanding—</text><clause commented="no" id="id6f719ad6-7043-4bd6-a4c5-0a950a291f44" changed="not-changed"><enum>(i)</enum><text>to exchange water data, including data on water quality; or </text></clause><clause commented="no" id="id158be62b-809f-4e83-8ae3-b73c18e521cd" changed="not-changed"><enum>(ii)</enum><text>to share information, protocols, and procedures with respect to projects that evaluate, demonstrate, or install new and emerging, but proven, water technology;</text></clause></subparagraph><subparagraph commented="no" id="id6627f7a1-b235-47d1-a5a4-ca394b80604e" changed="not-changed"><enum>(B)</enum><text>carry out projects—</text><clause commented="no" id="ida5a35e2a-7404-47c2-b8ee-67cd2751c762" changed="not-changed"><enum>(i)</enum><text>to exchange water data, including data on water quality; or</text></clause><clause commented="no" id="id71cb2ed6-43be-43f5-a610-ad8ab4e5e216" changed="not-changed"><enum>(ii)</enum><text>that evaluate, demonstrate, or install new and emerging, but proven, water technology; and</text></clause></subparagraph><subparagraph commented="no" id="iddf3ecaac-94fa-4b58-89c7-b922caa7e5a9" changed="not-changed"><enum>(C)</enum><text>develop a regional intended use plan, in accordance with paragraph (3), to identify projects to carry out, including projects using grants received under this section.</text></subparagraph></paragraph><paragraph commented="no" id="id8fc06584-2944-432e-9c3f-b3c7284a2b24" changed="not-changed"><enum>(3)</enum><header>Regional intended use plan</header><text>A regional intended use plan of a regional consortium established under paragraph (1)—</text><subparagraph commented="no" id="id1dda50c3-f0c0-477e-89e7-0c9e4336ccd4" changed="not-changed"><enum>(A)</enum><text>shall identify projects that the regional consortium intends to carry out, including projects that meet the requirements of paragraph (2)(B); and </text></subparagraph><subparagraph commented="no" id="id4771941f-1742-48f7-a926-06247da172cb" changed="not-changed"><enum>(B)</enum><text>may include—</text><clause commented="no" id="id14a3da0c-233b-4ef1-85c7-be6f4a95d651" changed="not-changed"><enum>(i)</enum><text>projects included in an intended use plan of a State prepared under section 606(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1386">33 U.S.C. 1386(c)</external-xref>) within the regional consortium; and</text></clause><clause commented="no" id="id75fecf29-1ff4-422f-bfda-f65b91ebbdb5" changed="not-changed"><enum>(ii)</enum><text>projects not included in an intended use plan of a State prepared under section 606(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1386">33 U.S.C. 1386(c)</external-xref>) within the regional consortium. </text></clause></subparagraph></paragraph></subsection><subsection changed="not-changed" id="idE6D0987635584928A732BDADF6A4FBC8"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to Congress a report that describes the implementation of the pilot program, which shall include—</text><paragraph changed="not-changed" id="idBBB2F18B27C34C4D821F15053C6C468B"><enum>(1)</enum><text>a description of the use and deployment of amounts made available under the pilot program; and</text></paragraph><paragraph changed="not-changed" id="idBFE2E1F1DFC04C3DAA36566EB84BDED0"><enum>(2)</enum><text>an accounting of all grants awarded under the program, including a description of each grant recipient and each project funded using a grant under the pilot program.</text></paragraph></subsection><subsection id="id798dc6b1-f1bc-4576-81b5-f129933e27af" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(f)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="id65d960dc-3b75-40c0-8555-1becd5f61673" changed="not-changed"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the pilot program $15,000,000 for each of fiscal years 2022 through 2026, to remain available until expended.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id652c070a-418f-4e0e-bdb4-6ef084b80331" changed="not-changed"><enum>(2)</enum><header>Requirement</header><text>Of the funds made available under paragraph (1), not more than 35 percent may be used to provide grants to regional consortia established under subsection (d). </text></paragraph></subsection></section><section id="idf5144c0d-7859-4201-9e93-8d442931be51" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="not-changed"><enum>214.</enum><header>Final rating opinion letters</header><text display-inline="no-display-inline">Section 5028(a)(1)(D)(ii) of the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3907">33 U.S.C. 3907(a)(1)(D)(ii)</external-xref>) is amended by striking <quote>final rating opinion letters from at least 2 rating agencies</quote> and inserting <quote>a final rating opinion letter from at least 1 rating agency</quote>. </text></section><section id="id8236bf64-1606-40b1-b457-f115785fc6be" changed="not-changed"><enum>215.</enum><header>Water infrastructure financing reauthorization</header><subsection id="id7dcbf3c041c84c369d6c69648c6e53df"><enum>(a)</enum><header>Applications</header><text>Section 5023 of the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3902">33 U.S.C. 3902</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90100dde3a18438d8991576fa234ebe2"><subsection id="id81b3f9d6d86e4873bd23e49dd526bb97"><enum>(c)</enum><header>Budgetary treatment</header><text>If the recipient of financial assistance under this subtitle is an eligible entity other than a Federal entity, agency, or instrumentality and the dedicated sources of repayment of that financial assistance are non-Federal revenue sources, the project or asset for which financial assistance is being provided shall, for purposes of budgetary treatment under the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661">2 U.S.C. 661</external-xref> et seq.)—</text><paragraph id="idd698d9764d694896be88843dad4f1928"><enum>(1)</enum><text>be deemed to be non-Federal; and</text></subparagraph></paragraph><paragraph id="idfa95bf80-7b60-4a0d-bd88-49c5ec33064d" commented="no" changed="not-changed"><enum>(3)</enum><text>in subsection (e)(1), by striking <quote>2020 and 2021</quote> and inserting <quote>2022 through 2026</quote>.</text></paragraph></subsection></section><section id="id8c21bb54-55e0-46ae-a927-b6985efb1b33" changed="not-changed"><enum>216.</enum><header>Small and disadvantaged community analysis</header><subsection id="id6159f9f1-7488-4fbc-af51-733914b48fba" changed="not-changed"><enum>(a)</enum><header>Analysis</header><text>Not later than 1 year after the date of enactment of this Act, using environmental justice data of the Environmental Protection Agency, including data from the environmental justice mapping and screening tool of the Environmental Protection Agency, the Administrator shall carry out an analysis under which the Administrator shall assess the programs under title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref> et seq.) and section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) to identify historical distributions of funds to small and disadvantaged communities and new opportunities and methods to improve on the distribution of funds under those programs to low-income communities, rural communities, minority communities, and communities of indigenous peoples, in accordance with Executive Order 12898 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; 60 Fed. Reg. 6381; relating to Federal actions to address environmental justice in minority populations and low-income populations).</text></subsection><subsection id="id043f559c-931d-431c-a863-abcba7bfcd44" changed="not-changed"><enum>(b)</enum><header>Report</header><text>On completion of the analysis under subsection (a), the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committees on Energy and Commerce and Transportation and Infrastructure of the House of Representatives a report describing—</text><paragraph id="id52c0365a-cb51-4b10-a619-cd10336bc24b" changed="not-changed"><enum>(1)</enum><text>the results of the analysis; and</text></paragraph><paragraph id="idaca6b5dd-5271-4b46-88f2-4cf20ba5d454" changed="not-changed"><enum>(2)</enum><text>the criteria the Administrator used in carrying out the analysis. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idA2727F6796AC480FA6DDF17A06C38340" section-type="subsequent-section" changed="not-changed"><enum>217.</enum><header display-inline="yes-display-inline">Stormwater infrastructure technology</header><subsection commented="no" display-inline="no-display-inline" id="idD919BB02E30C4B27A2A28EFD91BC21B5" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id45EBF17CDF444619A68098069CDC8F85" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Center</header><text display-inline="yes-display-inline">The term <term>center</term> means a center of excellence for stormwater control infrastructure established under subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55EB55B6989F4FABA6AF24DB5971AFFC" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5C4346A86B5745B7B24A02825AF1782E" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a State, Tribal, or local government; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id136226924E2F4D109471CF6E153BAAB8" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a local, regional, or other public entity that manages stormwater or wastewater resources or other related water infrastructure.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd3304ef-6f6a-4cb5-8eea-415047a1e2fd" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible institution</header><text display-inline="yes-display-inline">The term <term>eligible institution</term> means an institution of higher education, a research institution, or a nonprofit organization—</text><subparagraph commented="no" display-inline="no-display-inline" changed="not-changed" id="idEE3A5F56561244FDB1CF6A51CA92F4CC"><enum>(A)</enum><text display-inline="yes-display-inline">that has demonstrated excellence in researching and developing new and emerging stormwater control infrastructure technologies; and</text></subparagraph><subparagraph display-inline="no-display-inline" changed="not-changed" commented="no" id="idD0925D8B8BBC4EB7B507D270C2BD8825"><enum>(B)</enum><text>with respect to a nonprofit organization, the core mission of which includes water management, as determined by the Administrator.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id71002D8A96E64087B9E162006DE55AD3" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Centers of Excellence for stormwater control infrastructure technologies</header><paragraph commented="no" display-inline="no-display-inline" id="id93F2122ED4074B04A27A8A679F205563" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of centers</header><subparagraph commented="no" display-inline="no-display-inline" id="id51B5D480414A417E9B2225D1B24228A2" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Administrator shall provide grants, on a competitive basis, to eligible institutions to establish and maintain not less than 3, and not more than 5, centers of excellence for new and emerging stormwater control infrastructure technologies, to be located in various regions throughout the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76C940762E2B4B1DB9D40D32469E2FBA" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">General operation</header><text display-inline="yes-display-inline">Each center shall—</text><clause commented="no" display-inline="no-display-inline" id="idE8E293BEEF4F4CA79D30C858808DDDF3" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">conduct research on new and emerging stormwater control infrastructure technologies that are relevant to the geographical region in which the center is located, including stormwater and sewer overflow reduction, other approaches to water resource enhancement, alternative funding approaches, and other environmental, economic, and social benefits, with the goal of improving the effectiveness, cost efficiency, and protection of public safety and water quality;</text></clause><clause display-inline="no-display-inline" commented="no" id="id043F3CB862144487B74123C6C5DBC056" changed="not-changed"><enum>(ii)</enum><text>maintain a listing of—</text><subclause display-inline="no-display-inline" commented="no" id="id0F9FBB21ED604542B9CBA50FC97A98AF" changed="not-changed"><enum>(I)</enum><text>stormwater control infrastructure needs; and</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id38E44A08E35647BC814C4D415AFC5808" changed="not-changed"><enum>(II)</enum><text>an analysis of new and emerging stormwater control infrastructure technologies that are available;</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="id2D7A2AB7C1234ADFB0D1E258290DA89F" changed="not-changed"><enum>(iii)</enum><text>analyze whether additional financial programs for the implementation of new and emerging, but proven, stormwater control infrastructure technologies would be useful; </text></clause><clause commented="no" display-inline="no-display-inline" id="idC470CEC1BA764BEEA614F550A8413E3B" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">provide information regarding research conducted under clause (i) to the national electronic clearinghouse center for publication on the Internet website established under paragraph (3)(B)(i) to provide to the Federal Government and State, Tribal, and local governments and the private sector information regarding new and emerging, but proven, stormwater control infrastructure technologies;</text></clause><clause commented="no" display-inline="no-display-inline" id="idA5634F83FA0C40D9BB7DF4045DC1548D" changed="not-changed"><enum>(v)</enum><text display-inline="yes-display-inline">provide technical assistance to State, Tribal, and local governments to assist with the construction, operation, and maintenance of stormwater control infrastructure projects that use innovative technologies;</text></clause><clause commented="no" display-inline="no-display-inline" id="idA347069BD5D44C499BCB80DED270C66F" changed="not-changed"><enum>(vi)</enum><text display-inline="yes-display-inline">collaborate with institutions of higher education and private and public organizations, including community-based public-private partnerships and other stakeholders, in the geographical region in which the center is located; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7BB15B57779E4BCE8CF15276FF48E40E" changed="not-changed"><enum>(vii)</enum><text display-inline="yes-display-inline">coordinate with the other centers to avoid duplication of efforts.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF31A433D08D842A399201445B9E78DA8" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this subsection, an eligible institution shall prepare and submit to the Administrator an application at such time, in such form, and containing such information as the Administrator may require.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65A6860401E24C24A7AAE9505A08B01D" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">National electronic clearinghouse center</header><text display-inline="yes-display-inline">Of the centers established under paragraph (1)(A), 1 shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id84FAE2E43AEA4B3085DD18D9FCC17134" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">be designated as the <quote>national electronic clearinghouse center</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A3E51D4168443908E678A23A95B8FC9" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">in addition to the other functions of that center—</text><clause commented="no" display-inline="no-display-inline" id="id5354F92AF6034A88A7726D825BE42004" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">develop, operate, and maintain an Internet website and a public database that contains information relating to new and emerging, but proven, stormwater control infrastructure technologies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id23420AF174D347D29B27F34B42FC83D0" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">post to the website information from all centers.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id0A9F41724C4E4AE591D42A54F5578809" changed="not-changed"><enum>(4)</enum><header>Authorization of appropriations</header><subparagraph display-inline="no-display-inline" commented="no" id="idAE048810FE0E4FE38B053F63680F4E51" changed="not-changed"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2022 through 2026.</text></subparagraph><subparagraph id="id56A3BD494EC74DFA89A16D345C25535D" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">Of the amounts made available for grants under subparagraph (A), not more than 2 percent may be used to pay the administrative costs of the Administrator. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id500F521959D5403ABD630F53AB597D05" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Stormwater control infrastructure project grants</header><paragraph commented="no" display-inline="no-display-inline" id="idBA2CA435FDF44E9B9D594ADA9B49659C" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Grant authority</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Administrator shall provide grants, on a competitive basis, to eligible entities to carry out stormwater control infrastructure projects that incorporate new and emerging, but proven, stormwater control technologies in accordance with this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAEAA54060E54EF5879DD7A8A562DE47" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Stormwater control infrastructure projects</header><subparagraph commented="no" display-inline="no-display-inline" id="idC97771CCAA5E469FB15CB584A38F385C" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Planning and development grants</header><text display-inline="yes-display-inline">The Administrator may make planning and development grants under this subsection for the following projects:</text><clause commented="no" display-inline="no-display-inline" id="idCB16082DD2C340F18954B218D7F530A9" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">Planning and designing stormwater control infrastructure projects that incorporate new and emerging, but proven, stormwater control technologies, including engineering surveys, landscape plans, maps, and implementation plans.</text></clause><clause commented="no" display-inline="no-display-inline" id="id727D3CF02C714C0EB329849D1CEED4A0" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">Identifying and developing standards necessary to accommodate stormwater control infrastructure projects, including those projects that incorporate new and emerging, but proven, stormwater control technologies.</text></clause><clause commented="no" display-inline="no-display-inline" id="id3E0DBD1F804247B2AA89E95569283970" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">Identifying and developing fee structures to provide financial support for design, installation, and operations and maintenance of stormwater control infrastructure, including new and emerging, but proven, stormwater control infrastructure technologies.</text></clause><clause display-inline="no-display-inline" commented="no" id="id2DB94198CA194021AFFB67569F435EFC" changed="not-changed"><enum>(iv)</enum><text>Developing approaches for community-based public-private partnerships for the financing and construction of stormwater control infrastructure technologies, including feasibility studies, stakeholder outreach, and needs assessments.</text></clause><clause commented="no" display-inline="no-display-inline" id="id43D0CFFCEFEA4809A6BB706720A5E9B0" changed="not-changed"><enum>(v)</enum><text display-inline="yes-display-inline">Developing and delivering training and educational materials regarding new and emerging, but proven, stormwater control infrastructure technologies for distribution to—</text><subclause commented="no" display-inline="no-display-inline" id="idC960412DBDF34B4F96A067E921D4531C" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">individuals and entities with applicable technical knowledge; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idADB885ED939D45E29B6583C2F6E22D66" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">the public.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74A7BE8D6A9C455FBC96819ADA7C638E" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Implementation grants</header><text display-inline="yes-display-inline">The Administrator may make implementation grants under this subsection for the following projects:</text><clause commented="no" display-inline="no-display-inline" id="id5CC5A332387643118EA1FB9DC3AC43C2" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">Installing new and emerging, but proven, stormwater control infrastructure technologies.</text></clause><clause commented="no" display-inline="no-display-inline" id="idD6B2091C33654449853CE2186C39AC54" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">Protecting or restoring interconnected networks of natural areas that protect water quality.</text></clause><clause commented="no" display-inline="no-display-inline" id="idC50F5E062A064F5D937201B89B17707E" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">Monitoring and evaluating the environmental, economic, or social benefits of stormwater control infrastructure technologies that incorporate new and emerging, but proven, stormwater control technology.</text></clause><clause commented="no" display-inline="no-display-inline" id="idA6CC5D0C63E04F6C82BBE47CE44DD8A3" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">Implementing a best practices standard for stormwater control infrastructure programs.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE087B239854147BA9723B015E275216A" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, to be eligible to receive a grant under this subsection, an eligible entity shall prepare and submit to the Administrator an application at such time, in such form, and containing such information as the Administrator may require, including, as applicable—</text><subparagraph commented="no" display-inline="no-display-inline" id="id207BE880518540BF8FEAD0468B410F6E" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the stormwater control infrastructure project that incorporates new and emerging, but proven, technologies;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02076FEF0E8842A2A4E0707552883ECC" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a plan for monitoring the impacts of the stormwater control infrastructure project on the water quality and quantity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2612532044B54D9CA4608ED478F36E32" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">an evaluation of other environmental, economic, and social benefits of the stormwater control infrastructure project; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB90E2F3CA64C4585916BFF6518444F16" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">a plan for the long-term operation and maintenance of the stormwater control infrastructure project and a tracking system, such as asset management practices.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idADB99E3831F24FD49F965B5A3C1F605A" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In making grants under this subsection, the Administrator shall give priority to applications submitted on behalf of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5C669C1B98254A5FBCD04D34E03B1C36" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a community that—</text><clause commented="no" display-inline="no-display-inline" id="idD629A56DEB6142A19FDD71DEEC0EA137" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">has combined storm and sanitary sewers in the collection system of the community; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id4DCC39A276C04D9F85DF2F2E32AB5012" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">is a small, rural, or disadvantaged community, as determined by the Administrator; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC3FFBB000AAF44328D5E40B6426F4129" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">an eligible entity that will use not less than 15 percent of the grant to provide service to a small, rural, or disadvantaged community, as determined by the Administrator.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4607F19A88FD45789DDF1C7F74BD9B77" changed="not-changed"><enum>(5)</enum><header display-inline="yes-display-inline">Maximum amounts</header><subparagraph commented="no" display-inline="no-display-inline" id="id1AA0BE4110554EB7830F791C8AF71BA6" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Planning and development grants</header><clause commented="no" display-inline="no-display-inline" id="id26DCD6EFFF064586B97C4AC385414D6C" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">Single grant</header><text display-inline="yes-display-inline">The amount of a single planning and development grant provided under this subsection shall be not more than $200,000.</text></clause><clause commented="no" display-inline="no-display-inline" id="id3FD8D6F963214A29B6D1ADCA7797EB92" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Aggregate amount</header><text display-inline="yes-display-inline">The total amount of all planning and development grants provided under this subsection for a fiscal year shall be not more than <fraction>1/3</fraction> of the total amount made available to carry out this subsection.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC2EAD0F68E914BEEAEA661C9CB5A4335" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Implementation grants</header><clause commented="no" display-inline="no-display-inline" id="id6750243631D34FE4801C666BF5A52E52" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">Single grant</header><text display-inline="yes-display-inline">The amount of a single implementation grant provided under this subsection shall be not more than $2,000,000.</text></clause><clause commented="no" display-inline="no-display-inline" id="id56565267368F41C79D06029AA822AF7F" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Aggregate amount</header><text display-inline="yes-display-inline">The total amount of all implementation grants provided under this subsection for a fiscal year shall be not more than <fraction>2/3</fraction> of the total amount made available to carry out this subsection.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74F5945A4EA94CF19FE132AEDCBAFABF" changed="not-changed"><enum>(6)</enum><header display-inline="yes-display-inline">Federal share</header><subparagraph commented="no" display-inline="no-display-inline" id="id748FB5B8D73540F59834DCC70214EBD7" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), the Federal share of a grant provided under this subsection shall not exceed 80 percent of the total project cost.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id886A9B43B9A54FB0A26BC2C98FC8799C" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Credit for implementation grants</header><text display-inline="yes-display-inline">The Administrator shall credit toward the non-Federal share of the cost of an implementation project carried out under this subsection the cost of planning, design, and construction work completed for the project using funds other than funds provided under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71485B88BF2740DB94DABA640226A662" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The Administrator may waive the Federal share limitation under subparagraph (A) for an eligible entity that has adequately demonstrated financial need.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDBD11F50AB954811AB06DDBD98F2DD28" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator first awards a grant under this section, the Administrator shall submit to Congress a report that includes, with respect to the period covered by the report—</text><paragraph commented="no" display-inline="no-display-inline" id="id23A0C4BCEDDE4819B8CB7D7BEB6A6A23" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">a description of all grants provided under this section;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8989230A41745B68DDF17182FB31604" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a detailed description of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id654658F3BBC4447AB34D8B337240624C" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the projects supported by those grants; and</text></subparagraph><subparagraph commented="no" projects;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45ED19B6068A4F77BAFEFF1B4B2C8E9A" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the improvements in technology, environmental benefits, resources conserved, efficiencies, and other benefits of the projects funded under this section;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8170E3D67204F8FA4264A2977592D6C" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improvements to promote and support new and emerging, but proven, stormwater control infrastructure, including research into new and emerging technologies, for the centers, grants, and activities under this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1BABB44AAB7C40EFA520FD5DD1B18DB9" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">a description of existing challenges concerning the use of new and emerging, but proven, stormwater control infrastructure.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8EB4AD29639B407B89D12B9EDD4DB034" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="idA3C27E48F3CB4B578C3941AC962B406F" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section (except for subsection (b)) $10,000,000 for each of fiscal years 2022 through 2026. </text></paragraph><paragraph id="idBF07FB4970174A2B83AC6A4A6EAD9F31" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator. </text></paragraph></subsection></section><section id="id3ea2117013b2441e8ee482f11fbbb0f1" changed="not-changed" commented="no"><enum>218.</enum><header>Water Reuse Interagency Working Group</header><subsection id="id46a88d4de133467397272412f2ca3a32" changed="not-changed" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a Water Reuse Interagency Working Group (referred to in this section as the <term>Working Group</term>).</text></subsection><subsection id="idF28B2DC9CCBD4B3185F5FF9886C9A2B5" changed="not-changed" commented="no"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Working Group is to develop and coordinate actions, tools, and resources to advance water reuse across the United States, including through the implementation of a National Water Reuse Action Plan that creates opportunities for water reuse in the mission areas of each of the Federal agencies included in the Working Group under subsection (c) (referred to in this section as the <term>Action Plan</term>).</text></subsection><subsection id="idd8790b3bfd7a44fb9bbfe01b504d61e9" changed="not-changed" commented="no"><enum>(c)</enum><header>Chairperson; membership</header><text>The Working Group shall be—</text><paragraph id="idBE7292E7852A4003BE353A70483D244E" changed="not-changed" commented="no"><enum>(1)</enum><text>chaired by the Administrator; and</text></paragraph><paragraph id="idFAF1B69173A9414CBFD7623BD3C655AF" changed="not-changed" commented="no"><enum>(2)</enum><text>comprised of senior representatives from such Federal agencies as the Administrator determines to be appropriate.</text></paragraph></subsection><subsection id="idf4d3bee6e4364710a88c1128593d483b" changed="not-changed" commented="no"><enum>(d)</enum><header>Duties of the Working Group</header><text>In carrying out this section, the Working Group shall—</text><paragraph id="id99b074789a4d40efb8b7eeca6b0fd07a" changed="not-changed" commented="no"><enum>(1)</enum><text>with respect to water reuse, leverage the expertise of industry, the research community, nongovernmental organizations, and government;</text></paragraph><paragraph id="idaa2654d0ef2e4dd3ac712becb91edbf5" changed="not-changed" commented="no"><enum>(2)</enum><text>seek to foster water reuse as an important component of integrated water resources management;</text></paragraph><paragraph id="id0ea6466f5ddf4fc38da16956ef37539a" changed="not-changed" commented="no"><enum>(3)</enum><text>conduct an assessment of new opportunities to advance water reuse and annually update the Action Plan with new actions, as necessary, to pursue those opportunities;</text></paragraph><paragraph id="idFFE09DBC69064C45BC987C72FC4781AA" changed="not-changed" commented="no"><enum>(4)</enum><text>seek to coordinate Federal programs and policies to support the adoption of water reuse;</text></paragraph><paragraph id="id3c35f276e9a44222828f2cbaba1eae7a" changed="not-changed" commented="no"><enum>(5)</enum><text>consider how each Federal agency can explore and identify opportunities to support water reuse through the programs and activities of that Federal agency; and</text></paragraph><paragraph id="id3ccf1469f6d44ab593554db456c84ba5" changed="not-changed" commented="no"><enum>(6)</enum><text>consult, on a regular basis, with representatives of relevant industries, the research community, and nongovernmental organizations.</text></paragraph></subsection><subsection id="id287af78626fe417a9c4eef524ccfb568" changed="not-changed" commented="no"><enum>(e)</enum><header>Report</header><text>Not less frequently than once every 2 years, the Administrator shall submit to Congress a report on the activities and findings of the Working Group.</text></subsection><subsection id="id7B02D9656B1A4AEB891AB20B383165BC" changed="not-changed" commented="no"><enum>(f)</enum><header>Sunset</header><paragraph id="id7DECDB15F27749688E0DFFC38B54DDF3" changed="not-changed" commented="no"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Working Group shall terminate on the date that is 6 years after the date of enactment of this Act.</text></paragraph><paragraph id="id97AB46CB6D3E4EA88659E00B374BDB00" changed="not-changed" commented="no"><enum>(2)</enum><header>Extension</header><text>The Administrator may extend the date of termination of the Working Group under paragraph (1). </text></paragraph></subsection></section><section display-inline="no-display-inline" changed="not-changed" commented="no" id="id73808C8A7B5B4662ABF31B80F09B71EA"><enum>219.</enum><header>Advanced clean water technologies study</header><subsection display-inline="no-display-inline" changed="not-changed" commented="no" id="idFA7B9D5328F24B72BDF5DAC258793A1C"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, not later than 1 year after the date of enactment of this Act, the Administrator shall carry out a study that examines the state of existing and potential future technology, including technology that could address cybersecurity threats, that enhances or could enhance the treatment, monitoring, affordability, efficiency, and safety of wastewater services provided by a treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)).</text></subsection><subsection display-inline="no-display-inline" changed="not-changed" commented="no" id="id9F5E323D79F448F89292FAB6C6D2C849"><enum>(b)</enum><header>Report</header><text>The Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes the results of the study under subsection (a). </text></subsection></section><section display-inline="no-display-inline" changed="not-changed" commented="no" id="id11B75F3D80454D98A3230E53BC26E082"><enum>220.</enum><header>Clean water infrastructure needs survey</header><subsection display-inline="no-display-inline" changed="not-changed" commented="no" id="idD2EBB5DFCFAE45F39A0F7AE80EC41C0E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, and not less frequently than once every 4 years thereafter, the Administrator shall—</text><paragraph display-inline="no-display-inline" changed="not-changed" commented="no" id="idFEF12C22AE3E4BD9ABE40E3C15C9858D"><enum>(1)</enum><text display-inline="yes-display-inline">conduct and complete an assessment of wastewater system capital improvement needs of all treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)) in the United States that are eligible for assistance from State water pollution control revolving funds established under title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref> et seq.); and</text></paragraph><paragraph display-inline="no-display-inline" changed="not-changed" commented="no" id="id276CD29828784835BFB880518230F326"><enum>(2)</enum><text>submit to Congress a report describing the results of the assessment completed under paragraph (1).</text></paragraph></subsection><subsection display-inline="no-display-inline" changed="not-changed" commented="no" id="idFE415007F82E4BF092E991F2C57AE86E"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the initial needs survey under subsection (a) $5,000,000, to remain available until expended.</text></subsection></section></title></legis-body></bill>
