which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to require a DNA test to determine the familial relationship between an alien and an accompanying minor, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAE0B24431B444B75AD8725302E7B72B0"><section section-type="section-one" id="HC0B9D1CA4F6F4B37BC183C24DD4F56BF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Child Trafficking Now Act</short-title></quote>.</text></section><section id="H84FDBFADC7784F72810C489DBE684D60"><enum>2.</enum><header>DNA Testing</header><text display-inline="no-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) is amended by inserting after section 211 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0AC22A853A1348A6BB5986EB5A96F3E5"><section id="H8876A812CAAE47F2BBA9CAF6E516C89E"><enum>211A.</enum><header>Familial relationship documentary requirements</header><subsection id="HD0AED9547C2E4E7AB615015566430BF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), an alien who has attained 18 years of age may not be admitted into the United States with a minor.</text></subsection><subsection id="H67E7B5EE128B4FC5A06AEE6CC3F6F84A"><enum>(b)</enum><header>Exceptions</header><text>An alien described in subsection (a) may be admitted into the United States with a minor if—</text><paragraph id="H7480E6B169E74107ACF13233E4001898"><enum>(1)</enum><text>the alien presents to the Secretary of Homeland Security—</text><subparagraph id="id4B5F44F5F8344AF6AABB0F897364E33B"><enum>(A)</enum><text>one or more documents that prove that the alien is a relative or guardian of the minor; and</text></subparagraph><subparagraph id="id5757EDBAFDFD4A649139F12FFC42382A"><enum>(B)</enum><text>a witness that testifies that the alien is a relative or guardian of the minor; or</text></subparagraph></paragraph><paragraph id="HD1B66580E77F4B308E19F197237BB19F"><enum>(2)</enum><text>a DNA test administered by the Secretary of Health and Human Services proves that the alien is a relative of the minor.</text></paragraph></subsection><subsection id="HE748EA962FE2460096226574666062C9"><enum>(c)</enum><header>Administration of DNA test</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall request, and the Secretary of Health and Human Services shall administer, a DNA test only in a case in which the Secretary of Homeland Security is unable to determine, based on the evidence presented under subsection (b)(1), that the alien is a relative or guardian of the minor accompanying the alien.</text></subsection><subsection id="HF6E1FE51EA9545A48E4E3C9818E68187"><enum>(d)</enum><header>Denial of consent</header><paragraph id="H10B1264141F24C2B8E390FDFA891C26C"><enum>(1)</enum><header>Alien</header><text>An alien described in subsection (a) is inadmissible if—</text><subparagraph id="H30F84440B8504DD89E09F779F825892A"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security determines that the alien has presented insufficient evidence under subsection (b)(1) to prove that the alien is a relative of the minor; and</text></subparagraph><subparagraph id="HAAB334B9142543659EE510D016137D16"><enum>(B)</enum><text>the alien refuses to consent to a DNA test.</text></subparagraph></paragraph><paragraph id="H98A038EA64C346AF9A02AF66FEF8540F"><enum>(2)</enum><header>Minor</header><text display-inline="yes-display-inline">A minor accompanying an alien who is inadmissible under paragraph (1) shall be treated as an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)).</text></paragraph></subsection><subsection id="H437FCB8D6D1341EB87A9675487A46DF2"><enum>(e)</enum><header>DNA test results</header><text>In a case in which the results of the DNA test fail to prove that the alien described in subsection (a) is a relative of a minor accompanying the alien, an immigration officer shall conduct interviews as necessary to determine whether the alien is a relative or guardian of the minor.</text></subsection><subsection id="H3F413512AD81458E804CAC18DD6587F0"><enum>(f)</enum><header>Arrest</header><text>An immigration officer may arrest, pursuant to section 287, an alien described in subsection (a) if the immigration officer—</text><paragraph id="HBFDA3048422B4BE7AF1DF7A6F2BBEEFF"><enum>(1)</enum><text>determines, after conducting interviews pursuant to subsection (e), that the alien is not related to the minor accompanying the alien; and</text></paragraph><paragraph id="H19E265F9A3A043A0909A955E82EFAEF7"><enum>(2)</enum><text>has reason to believe that the alien is guilty of a felony offense, including the offenses of human trafficking, recycling of a minor, and alien smuggling.</text></paragraph></subsection><subsection id="H1E517D9C66C3474C8CC72CE54648E2BC"><enum>(g)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HE0B1528001F542419910E6EDD302802D"><enum>(1)</enum><header>Minor</header><text>The term <term>minor</term> means an alien who has not attained 18 years of age.</text></paragraph><paragraph id="H903E51B9B9DD43D1AA1D93C0B720AB3D"><enum>(2)</enum><header>Recycling</header><text>The term <term>recycling</term> means, with respect to a minor, that the minor is being used to enter the United States on more than 1 occasion, by an alien who has attained 18 years of age and is not the relative or the guardian of the minor;</text></paragraph><paragraph id="HBD203939B6124DD1A60ABCD7D0A864D6"><enum>(3)</enum><header>Relative</header><text>The term <term>relative</term> means an individual related by consanguinity within the second degree, as determined by common law.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8FF278AF776040D89FA139ABE40BF0A3"><enum>3.</enum><header>Criminalizing recycling of minors</header><subsection id="HCA34E3C7B493427293D0113019364272"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/69">Chapter 69</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1F3C65074AA44251B64A8B7425C6A898"><section id="HA5AAD93A2DE744038AA94C23A62282CA"><enum>1430.</enum><header>Recycling of minors</header><subsection id="HE005BF484CEE4E7E9ABAC0B2318766C4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever, being 18 years of age or over, knowingly uses, for the purpose of entering the United States, a minor to whom the individual is not a relative or guardian, shall be fined under this title, imprisoned not more than 10 years, or both.</text></subsection><subsection id="H4C7E810F9C5E4E90AEA85D072F275564"><enum>(b)</enum><header>Relative</header><text display-inline="yes-display-inline">In this section, the term <term>relative</term> means an individual related by consanguinity within the second degree as determined by common law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4B12EB3A413D43398ECCD811BAED1803"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/69">chapter 69</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA99E47918D4A41F2A150BE48EF6EAAB6"><toc regeneration="no-regeneration"><toc-entry level="section">1430. Recycling of minors.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
