which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize a grant program for the development and implementation of housing supply and affordability plans, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Supply and Affordability Act</short-title></quote>.</text></section><section id="idF4BF430E403A48C7B82910402BCEA25B"><enum>2.</enum><header>Local housing policy grant pilot program</header><subsection id="id8103823ACE594319A9C1782A594EF048"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idE7A9A5A671514681838C29A2D504787A"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph><paragraph id="id677474E15F8F470B913E0B76AD1A14C3"><enum>(2)</enum><header>Cost-burdened household</header><text>The term <term>cost-burdened household</term> means a household that spends not less than 30 percent of the income of the household on housing.</text></paragraph><paragraph id="idE3F8EAE2AE4345B19DC0ECAE74F4CB0C"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State, a political subdivision of a State, a coalition of States or political subdivisions of States, an Indian Tribe, or a Native Hawaiian organization that—</text><subparagraph id="idE9AA34D7B82E4DC48265F909E7A57019"><enum>(A)</enum><text>demonstrates, with respect to the area under the jurisdiction of the State, political subdivision, coalition, Indian Tribe, or organization—</text><clause id="idFEB1449962374035836003E6C852365C"><enum>(i)</enum><text>rising housing costs or a reasonable expectation that housing costs will rise in the area; and</text></clause><clause id="id0C03BF72110F4361B9F012AB921AA9E7"><enum>(ii)</enum><text>a housing supply shortage;</text></clause></subparagraph><subparagraph id="id48C84FA0ECAB43CA971E668E4C43730F"><enum>(B)</enum><text>if applying for a planning grant—</text><clause id="id5DF7BF15811C4F7BA2521C6F699A2E86"><enum>(i)</enum><text>intends to develop, or is in the process of developing, a housing policy plan; and</text></clause><clause id="idCA3C452448544868BC438CE3E82AA0CB"><enum>(ii)</enum><text>demonstrates an intent to use a portion of the planning grant to engage with community stakeholders and housing practitioners in developing a housing policy plan; and</text></clause></subparagraph><subparagraph id="id629DC69F41784D278DB0B070C3E55176"><enum>(C)</enum><text>if applying for an implementation grant—</text><clause id="id8C86C4CA80B14B0896D63106ACBE8200"><enum>(i)</enum><text>has adopted and plans to implement, or is in the process of implementing, a housing policy plan; and</text></clause><clause id="id8B55C87FF1D64316946FE5C1949C21E6"><enum>(ii)</enum><text>demonstrates the engagement of community stakeholders and housing practitioners in developing the housing policy plan.</text></clause></subparagraph></paragraph><paragraph id="idD23EDCF5348946318E3C88A62500E0B1"><enum>(4)</enum><header>Housing policy plan</header><text>The term <term>housing policy plan</term> means a comprehensive plan of an eligible entity to, with respect to the area under the jurisdiction of the eligible entity—</text><subparagraph id="id9C8F05C854A448E09F2A3EF80744A132"><enum>(A)</enum><text>increase the housing supply in the area, while avoiding the displacement of the residents of the area; </text></subparagraph><subparagraph id="idED1B82AD8DD44BA286B850AF058A7F70"><enum>(B)</enum><text>increase the affordability of housing in the area; and</text></subparagraph><subparagraph id="idA00E760D4A8B4B958F5EA544DF470CA3"><enum>(C)</enum><text>reduce barriers to housing development in the area.</text></subparagraph></paragraph><paragraph id="id9905AB11F5AC4E80B463720EB38CC7CE"><enum>(5)</enum><header>Implementation grant</header><text>The term <term>implementation grant</term> means a grant awarded under subsection (c).</text></paragraph><paragraph id="id423A051E889E4BC1AE18888BE44D476C"><enum>(6)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id7011F370E7F04FED9B264456B6B6A703"><enum>(7)</enum><header>Native Hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text></paragraph><paragraph id="id66DBFFD7290B434A8EE5BA987BB326FB"><enum>(8)</enum><header>Planning grant</header><text>The term <term>planning grant</term> means a grant awarded under subsection (b).</text></paragraph><paragraph id="idB3021F4F0B484B9B81330C9521C9052B"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development, acting through the Assistant Secretary for Community Planning and Development, in coordination with—</text><subparagraph id="id3FAB6D00089F420E874E861289A4139A"><enum>(A)</enum><text>the Office of Economic Resilience of the Office of Community Planning and Development of the Department;</text></subparagraph><subparagraph id="id50066FFA4C50425FB5A5C7B0E294B597"><enum>(B)</enum><text>the Office of Policy Development and Research of the Department;</text></subparagraph><subparagraph id="id7C47D84876D9446CA468A4769F6A84B8"><enum>(C)</enum><text>the Office of Fair Housing and Equal Opportunity of the Department;</text></subparagraph><subparagraph id="id8F3D440A9A274D1492F8167322165F35"><enum>(D)</enum><text>the Office of Housing of the Department; and</text></subparagraph><subparagraph id="id62F7863BE66C477ABBCD0A6833F98D5C"><enum>(E)</enum><text>the Office of Public and Indian Housing of the Department.</text></subparagraph></paragraph><paragraph id="id9F957AEC06D945BE861F1BD5498EAA19"><enum>(10)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States.</text></paragraph></subsection><subsection id="id2BFAB8E4DB8E49D4A40FB96E88655816"><enum>(b)</enum><header>Planning grants</header><text>The Secretary may award grants on a competitive basis to eligible entities for the purpose of developing and evaluating housing policy plans.</text></subsection><subsection id="idAC45F89453C041938299ADB9D50E2DAB"><enum>(c)</enum><header>Implementation grants</header><text>The Secretary may award grants on a competitive basis to eligible entities for the purpose of implementing housing policy plans.</text></subsection><subsection id="id247CD351F2904224AA0B1F6ABB1528C9"><enum>(d)</enum><header>Rural area minimum</header><text>The Secretary shall award not less than 10 percent of the funds awarded to eligible entities under this section to eligible entities located in rural areas.</text></subsection><subsection id="idCCC058346A534345B5C4CBF4204A6995"><enum>(e)</enum><header>Applications</header><paragraph id="id4779DE87105C4EC188C56CC41CC808B4"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="id7B5D0406C78E4396B5AA162788C436AD"><enum>(2)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to an eligible entity that—</text><subparagraph id="id502181E237174536B07C5285C5AAB1C4"><enum>(A)</enum><text>has or is likely to develop a housing policy plan that will—</text><clause id="id2B3826D58F3A481CBBA3712BAE2E7662"><enum>(i)</enum><text>improve housing supply, affordability, and accessibility for all individuals of every race and income level;</text></clause><clause id="idE20D79EE382745E88B30460305932656"><enum>(ii)</enum><text>reduce barriers to affordable housing development; and</text></clause><clause id="id71B78E66DCE14264876864B1E971578C"><enum>(iii)</enum><text>avoid the displacement of residents by new housing developments in the area under the jurisdiction of the eligible entity;</text></clause></subparagraph><subparagraph id="idD3AB63626AFD43BD85A3ED72DA7A40D0"><enum>(B)</enum><text>in developing or implementing a housing policy plan, intends to leverage and efficiently use funds from—</text><clause id="idA469F50DA92841EABF646D023CD9C9A0"><enum>(i)</enum><text>another Federal, State, or local assistance program relating to housing; or</text></clause><clause id="idDF3E79357E3040B1809498A01AC66DED"><enum>(ii)</enum><text>a private funding source;</text></clause></subparagraph><subparagraph id="id28FA8F9B36CD426CB8FA058931629342"><enum>(C)</enum><text>intends to—</text><clause id="id40FB8B21D86648A79794820EAFC00E8C"><enum>(i)</enum><text>increase the supply and affordability of housing that is located—</text><subclause id="id5E5CAD32DA174FE7BC198C67D4F22D55"><enum>(I)</enum><text>near local transit options; and</text></subclause><subclause id="id05133811FB204393813A5488419FAD6D"><enum>(II)</enum><text>in areas in which a significant or expanding supply of jobs or demand for employment is concentrated;</text></subclause></clause><clause id="id887D0FC1962E4555A3132BFBAF9C8FE0"><enum>(ii)</enum><text>coordinate with local transportation and workforce agencies in accomplishing the increase described in clause (i); and</text></clause><clause id="id3544ECC575D44E35AF992926D9773D7A"><enum>(iii)</enum><text>where appropriate, coordinate policy development for, and analysis and implementation of, the housing policy plan of the eligible entity at a regional scale to achieve a more equitable distribution of affordable housing across jurisdictional boundaries; or</text></clause></subparagraph><subparagraph id="id71CB777829AB4712B176058A7787D8DB"><enum>(D)</enum><text>is a coalition of States or political subdivisions of States.</text></subparagraph></paragraph><paragraph id="id5D5C509564D5425CAB0894BD9CB77ADB"><enum>(3)</enum><header>Scoring</header><text>The Secretary shall base the degree of priority given to an eligible entity that satisfies 1 or more subparagraphs under paragraph (2) on a scoring system established by the Secretary.</text></paragraph></subsection><subsection id="id7D159F13BF9446EC9F0184B5086DCF8B" commented="no"><enum>(f)</enum><header>Housing policy plan guidance</header><paragraph commented="no" id="id5B7588856829463EA71DD11666AFCB4A"><enum>(1)</enum><header>In general</header><text>The Secretary shall issue guidance that includes recommended policies, strategies, and reforms for eligible entities to adopt in housing policy plans to—</text><subparagraph commented="no" id="id0791419010984B0592E946065EB6B8A2"><enum>(A)</enum><text>improve the elasticity of housing supply;</text></subparagraph><subparagraph commented="no" id="idFA4ED468145144EDA92DE9A1F0E827B9"><enum>(B)</enum><text>expand the supply and affordability of housing;</text></subparagraph><subparagraph commented="no" id="idF83A070B0D724AC4A0D6AE3AB5655943"><enum>(C)</enum><text>reduce barriers to housing development; and</text></subparagraph><subparagraph commented="no" id="idEA1684F67FCB47D1A8EAF4C0FD99350B"><enum>(D)</enum><text>meaningfully reduce housing segregation by income and race.</text></subparagraph></paragraph><paragraph commented="no" id="id04FEF064857B4EC7B16FBB9590757A66"><enum>(2)</enum><header>Policies</header><text>The guidance issued under paragraph (1) shall include recommendations for policies, strategies, and reforms to—</text><subparagraph commented="no" id="idEFD006938B1C48F08E2993A52383C7F0"><enum>(A)</enum><text>encourage and support the repurposing of land or structures for housing development;</text></subparagraph><subparagraph commented="no" id="id7CD9A68676F34EF19325ACE1D7741E82"><enum>(B)</enum><text>allow for a greater variety of housing types;</text></subparagraph><subparagraph commented="no" id="idDF3BF18FBC1D4A088F8F7324E096875F"><enum>(C)</enum><text>revise land use policies to allow for the development of more housing;</text></subparagraph><subparagraph commented="no" id="idE38D8F051A7840158B1B324597357C3B"><enum>(D)</enum><text>streamline approval processes for housing development;</text></subparagraph><subparagraph commented="no" id="idB8915929840B4C15A1DC75961A1B1D75"><enum>(E)</enum><text>provide financial incentives to support affordable housing development; and</text></subparagraph><subparagraph commented="no" id="idA8F88090853E4CDFA55C33235AF5DC35"><enum>(F)</enum><text>support inclusive engagement with community members relating to reforms to expand housing supply.</text></subparagraph></paragraph><paragraph commented="no" id="id0864736FD73143F589A45505F514BD86"><enum>(3)</enum><header>Areas</header><text>The guidance issued under paragraph (1) shall include recommendations for policies, strategies, and reforms for urban, suburban, and rural areas.</text></paragraph></subsection><subsection id="idD2742FBFC62E4156A57233D8F5289E4D"><enum>(g)</enum><header>Matching requirement</header><paragraph id="idDF78F42A20684F5499EC17C361FDE288"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), an eligible entity that receives a grant under this section shall provide non-Federal contributions in an amount equal to the amount of the grant.</text></paragraph><paragraph id="id9AA64FF2AC614075841F3614C69C98BD"><enum>(2)</enum><header>Eligible matching funds</header><text>If an eligible entity uses funds from another Federal assistance program relating to housing in developing or implementing a housing policy plan for which the eligible entity also receives a grant under this section, any non-Federal contribution made by the eligible entity as part of that Federal assistance program shall be counted towards the requirement under paragraph (1).</text></paragraph><paragraph id="id525CBCB21DE142D986FBE509FB3F3421"><enum>(3)</enum><header>Reduced matching requirement</header><text>Based on the available resources of an eligible entity, the Secretary may reduce the amount of non-Federal contributions required to be provided by the eligible entity under paragraph (1).</text></paragraph></subsection><subsection id="id7EF8BDF5896D469A94007637A62D04A0"><enum>(h)</enum><header>Use of funds</header><paragraph id="idF73455C23F0D4459B244413C01283DB6"><enum>(1)</enum><header>Planning grants</header><text>An eligible entity receiving a planning grant shall use funds from the planning grant to finance activities to help develop and evaluate a housing policy plan for the area under the jurisdiction of the eligible entity, including—</text><subparagraph id="id1EEE57C2E5EF4F5C902F1EEC93F0F3C9" commented="no"><enum>(A)</enum><text>quantifying existing and projected housing needs for households of every income level, including extremely low-income families, as defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>);</text></subparagraph><subparagraph commented="no" id="id3F989439458B40918A1FD696B41C36EF"><enum>(B)</enum><text>documenting the characteristics of—</text><clause commented="no" id="id2FC2A11D0068485FAB8CFF5AFDA660A3"><enum>(i)</enum><text>the housing in the area;</text></clause><clause commented="no" id="idF05410338026435BB52575B11C5F5F13"><enum>(ii)</enum><text>the households of the area, including cost-burdened households; and</text></clause><clause commented="no" id="id1C49F0F51BB54203BE16C7E16A08055C"><enum>(iii)</enum><text>housing underproduction in the area;</text></clause></subparagraph><subparagraph id="id714F2BFB6263479AAF310D43BFDA0BBD" commented="no"><enum>(C)</enum><text>developing strategies to increase the housing supply and the variety of housing types in the area to satisfy the housing needs of the population of the area;</text></subparagraph><subparagraph id="id49FF81CF8AEE424DBB3C5CFBDBC355E4" commented="no"><enum>(D)</enum><text>analyzing population and employment trends in the area and documenting projections of those trends;</text></subparagraph><subparagraph id="idC9500DFA286543548D21F5A40E961DEE" commented="no"><enum>(E)</enum><text>considering strategies to minimize displacement of low-income families, as defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>), as a result of redevelopment in the area;</text></subparagraph><subparagraph id="id1D8174445A5F47698A8668D4BA9A0D11" commented="no"><enum>(F)</enum><text>providing for participation and input from community members, community groups, local builders, local realtors, nonprofit housing advocates, and local religious groups; and</text></subparagraph><subparagraph id="id0625DBEE286E44C1A4160D8E42424423" commented="no"><enum>(G)</enum><text>creating a schedule of programs and actions to implement the recommendations of the housing policy plan, including a plan for adopting actions through a local implementing ordinance or another regulatory process, such as a land use plan or a comprehensive plan.</text></subparagraph></paragraph><paragraph id="id3DC1A7B7761A42C9BEC834601C3AFCC4"><enum>(2)</enum><header>Implementation and planning grants</header><text>An eligible entity receiving a grant under this section shall use a portion of the funds from the grant to submit the report required under subsection (j)(1).</text></paragraph></subsection><subsection id="idFB897E55D8174BFBA7844637330D48D2"><enum>(i)</enum><header>Learning network</header><paragraph id="idE319D6A7B7364F26AAD5BC45D2F39029"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the Secretary awards the first planning grant or implementation grant under this section, the Secretary shall establish a learning network to—</text><subparagraph id="id12331EE341A3494B9FE1CE7DBBC7B8C6"><enum>(A)</enum><text>facilitate problem-solving relating to the development and implementation of housing policy plans; and</text></subparagraph><subparagraph id="id06F67F6785834D44915B84B421A9BDE2"><enum>(B)</enum><text>disseminate best practices and effective strategies and policies to improve local housing supply and affordability.</text></subparagraph></paragraph><paragraph id="id7261A11BD9C34F728F247EFE01DB8A43"><enum>(2)</enum><header>Accessibility</header><text>The learning network established under paragraph (1) shall be accessible to—</text><subparagraph id="idD6DDF8C05B7646BDAC8C18802B78C2EA"><enum>(A)</enum><text>eligible entities that receive a grant under this section; and</text></subparagraph><subparagraph id="id333BAA3D97EC409597B675D686514014"><enum>(B)</enum><text>eligible entities that submit an application under subsection (e).</text></subparagraph></paragraph></subsection><subsection id="idBF835A875AF84A3E98C8420DAAA4EE8B"><enum>(j)</enum><header>Reports and study</header><paragraph id="idF7D9EBBC42BC41779EC5FB1B5F3DDB5E"><enum>(1)</enum><header>Grant recipient reports</header><text>Not later than 180 days after the date on which an eligible entity receives a grant under this section, and not less frequently than quarterly thereafter for a 3-year period, the eligible entity shall submit to the Secretary a report that includes—</text><subparagraph id="id6BA4F44D32594A2287DA3F1E4DE6431A"><enum>(A)</enum><text>a description of the expenditures the eligible entity has made with funds from the grant;</text></subparagraph><subparagraph id="id0B8C77AD260145F0AA1E203F314CB527"><enum>(B)</enum><text>for an eligible entity receiving a planning grant, a summary of the progress of the eligibility entity towards finalizing a housing policy plan; and</text></subparagraph><subparagraph id="id33C7A999EDA34614B0CB6B71F90A3055"><enum>(C)</enum><text>for an eligible entity receiving an implementation grant, data relating to the success of the implementation of the housing policy plan of the eligible entity.</text></subparagraph></paragraph><paragraph id="idBD9C7DEAFDFC4B3D802020416BC6EAD1"><enum>(2)</enum><header>Secretary study and report</header><subparagraph id="id66B39E4FB5A842A59F6F718A4D677DCF"><enum>(A)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall conduct a study on—</text><clause id="id62C7D9D7FF2A44B38369CD3AE91DF4DA"><enum>(i)</enum><text>the impact of implementation grants and planning grants on the areas under the jurisdiction of eligible entities receiving those grants; and</text></clause><clause id="idF8B92CD0ACA34793A5E18FE81FF033D3"><enum>(ii)</enum><text>successful strategies from housing policy plans that were impactful in—</text><subclause id="id9E2EBFC90583416FB914F3433024EEC2"><enum>(I)</enum><text>expanding the housing supply; and</text></subclause><subclause id="idB5E06120F89749BEA7A0ED75DB088989"><enum>(II)</enum><text>increasing the quantity of quality and affordable housing, while avoiding the displacement of the residents of an area.</text></subclause></clause></subparagraph><subparagraph id="id6429F742D18C4A68876E99EF71589132"><enum>(B)</enum><header>Report</header><text>Not later than 1 year after the date on which the Secretary completes the study required under subparagraph (A), the Secretary shall submit to the appropriate committees of Congress a report on the study. </text></subparagraph></paragraph></subsection><subsection id="id37EF4A146CCE4BE6B8B9BE997CD1778A"><enum>(k)</enum><header>Appropriations</header><paragraph id="id456EBCAE350E4151BF603C8FC63AEA25"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated, and there are appropriated, to the Secretary, out of any money in the Treasury not otherwise appropriated, $300,000,000 for each of fiscal years 2022 through 2026 to carry out this Act.</text></paragraph><paragraph id="idA76A62C184644E2F8FDC74180A81FD4A" commented="no"><enum>(2)</enum><header>Emergency designation</header><subparagraph commented="no" id="id0C895774F79C4352AA250792BAC2A831"><enum>(A)</enum><header>In general</header><text>The amounts provided by this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subparagraph><subparagraph id="id1fd5ae6dd47a4667b13a503f6617c5fe"><enum>(B)</enum><header>Designation in senate</header><text>In the Senate, this section is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
