which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide access to counsel for children and other vulnerable populations.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1824B9387CFE4236A50F0A55B5D9B32B"><section section-type="section-one" id="HD2834526A23741619DAFE27D2603457C"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Funding Attorneys for Indigent Removal Proceedings Act</short-title></quote> or the <quote><short-title>FAIR Proceedings Act</short-title></quote>.</text></section><section id="H34E6226AEE0F4450B48DAEB06C13BE46"><enum>2.</enum><header>Improving immigration court efficiency and reducing costs by increasing access to legal information</header><subsection id="H04B9692A8E1A479994FAF65B69DCB024"><enum>(a)</enum><header>Appointment of counsel in certain cases; right To review certain documents in removal proceedings</header><text>Section 240(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(b)</external-xref>) is amended—</text><paragraph id="HC079509D5337479E9BA3490894CC28DA"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="H496B30E8D9F7450B9F03FFAAB6244C19"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, or in the case of an unaccompanied alien child (as defined in section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)(2)</external-xref>)), under regulations of the Secretary of Health and Human Services</quote> after <quote>Attorney General</quote>;</text></subparagraph><subparagraph id="id09A29F4E29734DFBA163EBD6E5F121F8"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="H07C26CAFCBC643B29299E8AAA3F9A5ED"><enum>(i)</enum><text>by striking <quote>, at no expense to the Government,</quote>; and</text></clause><clause id="H0CE1F7F56C8A435993D02A5B4F681324"><enum>(ii)</enum><text>by striking the comma at the end and inserting a semicolon;</text></clause></subparagraph><subparagraph id="HB4F83D6DE64A49739815BFEA3C107FE0"><enum>(C)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (D) and (E), respectively;</text></subparagraph><subparagraph id="HACF5FC6F3F0B4521A000FEA2012AEF63"><enum>(D)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H413AEC08E24E4E888202B774D02B1D9E"><subparagraph id="H1FEC780FF574451EB2A28CD14EBBBA33"><enum>(B)</enum><text>the Attorney General, or in the case of an unaccompanied alien child, the Secretary of Health and Human Services, may appoint or provide counsel, at Government expense, to the alien;</text></subparagraph><subparagraph id="H4E9A63326DA948CB825F3F530F31ACAD"><enum>(C)</enum><text>the alien, at the beginning of such proceedings or as expeditiously as possible, shall automatically receive a complete copy of all relevant documents in the possession of the Department of Homeland Security (unless the alien waives the right to receive such documents by executing a knowing and voluntary written waiver in a language that he or she understands fluently), including—</text><clause id="id5D5F9893BF024982AE4FB38C6CBCC969"><enum>(i)</enum><text>all documents (other than documents protected from disclosure by privilege and documents containing national security information referred to in subparagraph (D), law enforcement sensitive information, or information prohibited from disclosure pursuant to any other provision of law) contained in the file maintained by the Government that includes information with respect to all transactions involving the alien during the immigration process (commonly referred to as an <quote>A-file</quote>); and</text></clause><clause id="id9BF0672B694A49C6A736E5C0D0C98A70"><enum>(ii)</enum><text>all documents pertaining to the alien that the Department of Homeland Security has obtained or received from other government agencies;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HDED4FE7E9CCC4BA6B00BF16E536CB78A"><enum>(E)</enum><text>in subparagraph (D), as redesignated, by striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text></subparagraph></paragraph><paragraph id="H64F64294280A45A19C23D7DC8BA0B416"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H358B88CB2361438EB1110F5A2B00A44D"><paragraph id="H3C8C4BBF1F1F4D7A8949EDA8554206EA"><enum>(8)</enum><header>Failure to provide alien required documents</header><text>In the absence of a waiver under paragraph (4)(C), a removal proceeding may not proceed until the alien—</text><subparagraph id="HC861E845B3FA4530A9D9EE3450DF36BE"><enum>(A)</enum><text>has received the documents required under such paragraph; and</text></subparagraph><subparagraph id="H2153F4DF769140CC8655B026F2988DDF"><enum>(B)</enum><text>has been provided meaningful time to review and assess such documents.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H11DCA370152A4AA8966777B4D5123504"><enum>(b)</enum><header>Clarification regarding the authority of the Attorney General and the Secretary of Health and Human Services To appoint counsel to aliens in immigration proceedings</header><text>Section 292 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1362">8 U.S.C. 1362</external-xref>) is amended—</text><paragraph id="H5F363C5F39F141B0B8C8D25386D606A8"><enum>(1)</enum><text>by striking <quote>In any</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H26BC101D9AC84A589D02F06C430DC433"><subsection id="HE12264FAA3EE40BE806A5C38974E1FCE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In any proceeding conducted under section 235, 236, 238, 240, or 241, or under any other section of this Act, including</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HD73AB0EE619B48AC8D76E582230AC637"><enum>(2)</enum><text>in subsection (a), as redesignated—</text><subparagraph id="HE8150F35EF4341F4BE365C3AA2A440DA"><enum>(A)</enum><text>by striking <quote>(at no expense to the Government)</quote>; and</text></subparagraph><subparagraph id="HC2FFD05A76764DFFA12AFA8D890D15B7"><enum>(B)</enum><text>by striking <quote>he shall</quote> and inserting <quote>the person shall</quote>; and</text></subparagraph></paragraph><paragraph id="H8DBAF4F771004332AECB4D58C1D8BA12"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H067D3F17F2BF4FD191D24F29C5262A21"><subsection id="HF55C9D26A4CE4E488F71FA973057642C"><enum>(b)</enum><header>Access to counsel</header><paragraph id="idE270D28E092C495293AAEE14B69211C3"><enum>(1)</enum><header>In general</header><text>The Attorney General may appoint or provide counsel to aliens in any proceeding conducted under section 235, 236, 238, 240, or 241, or under any other section of this Act. </text></paragraph><paragraph id="idC023A07209FB4A309C4F850D8333DB70"><enum>(2)</enum><header>Unaccompanied alien children</header><text>The Secretary of Health and Human Services may appoint or provide counsel to unaccompanied alien children (as defined in section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)(2)</external-xref>)) in any applicable proceeding conducted pursuant to any section of this Act.</text></paragraph><paragraph id="idC8D6D2EAFF65429483FA0F0ABEE4DDDF"><enum>(3)</enum><header>Immigration detention and border facilities</header><text>The Secretary of Homeland Security shall ensure that aliens have access to counsel inside all immigration detention and border facilities.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF7CB282E21264338BD1560C74B9134C7"><enum>(c)</enum><header>Appointment of counsel for children and vulnerable aliens</header><paragraph id="H600FDF7EE4F24FFABE375C47EC570D2F"><enum>(1)</enum><header>In general</header><text>Section 292 of the Immigration and Nationality Act, as amended by subsection (b), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H521CDD2A9D7D43D99004970BFA4F0582"><subsection id="H09BB64C7E15C45478DA5EB02EB7DEE33"><enum>(c)</enum><header>Unaccompanied alien children</header><text>Notwithstanding subsection (b), the Secretary of Health and Human Services shall appoint or provide counsel at Government expense, if necessary, at the beginning of immigration proceedings, or as expeditiously as possible, to represent in such proceedings unaccompanied alien children. </text></subsection><subsection id="idAAE49B8BEB58458C8B4E0210B687B67C"><enum>(d)</enum><header>Other vulnerable aliens</header><text>Notwithstanding subsection (b), the Attorney General shall appoint or provide counsel at Government expense, if necessary, at the beginning of immigration proceedings or as expeditiously as possible, to represent in such proceedings any alien who has been determined by the Secretary of Homeland Security or the Attorney General to be—</text><paragraph id="H3573059418C84F64955555575482448E"><enum>(1)</enum><text>a child who is not an unaccompanied alien child;</text></paragraph><paragraph id="H89938366080D494F995BC1375333CD5C"><enum>(2)</enum><text>a person with a disability;</text></paragraph><paragraph id="H60EBFE6C0FF84932AFA588FAA4EAEA94"><enum>(3)</enum><text>a victim of abuse, torture, or violence;</text></paragraph><paragraph id="H3D7C2821E485474D9A397DF656895347"><enum>(4)</enum><text display-inline="yes-display-inline">an individual whose income is at or below 200 percent of the poverty line (as defined by the Office of Management and Budget and revised annually in accordance with section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>)) applicable to a family of the size involved; or</text></paragraph><paragraph id="H711B27CEBCA54CE6AD15C18F241CF2E4"><enum>(5)</enum><text>an individual whose circumstances require the appointment of counsel to help ensure the fair resolution and efficient adjudication of the proceedings.</text></paragraph></subsection><subsection id="H8D77A829C5D44204963A4B647A162A47"><enum>(e)</enum><header>Extension to consolidated cases</header><text>If the Attorney General has consolidated the case of an alien for whom counsel was appointed under subsection (c) or (d) with the case of another alien who does not have counsel, the counsel appointed under subsection (c) or (d), as applicable, shall be appointed to represent such other alien.</text></subsection><subsection id="HCC0E1BDA23704935ACC0082CC03A50B6"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Office of Refugee Resettlement of the Department of Health and Human Services and to Executive Office for Immigration Review of the Department of Justice, such sums as may be necessary to carry out this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H06F4B656BD194D85836362B66627C945"><enum>(2)</enum><header>Rulemaking</header><subparagraph id="id6DC60DBDCC5D4D2483D032E78398571C"><enum>(A)</enum><header>Unaccompanied alien children</header><text>The Secretary of Health and Human Services shall promulgate regulations to implement section 292(c) of the Immigration and Nationality Act, as added by paragraph (1), in accordance with the requirements set forth in section 3006A of title 18, United States Code.</text></subparagraph><subparagraph id="id659AEB83283744AC82FD0C68EA29C9B1"><enum>(B)</enum><header>Other vulnerable aliens</header><text>The Attorney General shall promulgate regulations to implement section 292(d) of the Immigration and Nationality Act, as added by paragraph (1), in accordance with the requirements set forth in section 3006A of title 18, United States Code. </text></subparagraph></paragraph></subsection></section><section id="HB09660D08B78402095259B99A07642C9"><enum>3.</enum><header>Access by counsel and legal orientation at detention facilities</header><subsection id="HCFB39AF9DA7E405495085DDA9DAC12AD"><enum>(a)</enum><header>Access to counsel</header><text>The Secretary of Homeland Security shall facilitate access to counsel for all aliens detained in facilities under the supervision of U.S. Immigration and Customs Enforcement or of U.S. Customs and Border Protection, including providing information to such aliens regarding legal services programs at detention facilities.</text></subsection><subsection id="H68DEED1F008E48808CEE1731F1772E06"><enum>(b)</enum><header>Access to legal orientation programs</header><paragraph id="idF5B6D00BCE154056B1D502B36749C585"><enum>(1)</enum><header>Procedures</header><text>The Secretary of Homeland Security, in consultation with the Attorney General, shall establish procedures—</text><subparagraph id="id8C603DEF1C9E4673A27276168F87E1C0"><enum>(A)</enum><text>to ensure that legal orientation programs are available for all detained aliens, including aliens held in U.S. Customs and Border Protection facilities; and</text></subparagraph><subparagraph id="id24FA134A98884759A9718BC8C466B330"><enum>(B)</enum><text>to inform such aliens of—</text><clause id="id6ECD9EB4E58047118B474E9E1BD28388"><enum>(i)</enum><text>the basic procedures of immigration hearings;</text></clause><clause id="idAB614440987A482C97B7EFD496117377"><enum>(ii)</enum><text>their rights relating to such hearings under Federal immigration laws;</text></clause><clause id="id387826918B0C4FC89BB8E0F940FBECAC"><enum>(iii)</enum><text>information that may deter such aliens from filing frivolous legal claims; and</text></clause><clause id="id3044D88CC68541A39FEB842048FE8D5F"><enum>(iv)</enum><text>any other information that the Attorney General considers appropriate, such as a contact list of potential legal resources and providers.</text></clause></subparagraph></paragraph><paragraph id="idC016AE24CE774DACAC09477AEF1F711E"><enum>(2)</enum><header>Universal availability</header><text>Access to legal orientation programs under paragraph (1) may not be limited by the alien’s current immigration status, prior immigration history, or potential for immigration relief.</text></paragraph></subsection></section><section id="H332B45865D8349DD8B006699B2817A63"><enum>4.</enum><header>Report on access to counsel</header><subsection id="H76E9DFAB653146BD9C9AA492C6CBA53A"><enum>(a)</enum><header>Report</header><text>Not later than December 31 of each year, the Secretary of Homeland Security, in consultation with the Attorney General and the Secretary of Health and Human Services, shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> regarding the extent to which aliens described in subsections (c) and (d) of section 292 of the Immigration and Nationality Act, as added by section 2(c)(1), have been provided access to counsel.</text></subsection><subsection id="H5EFCF2B5CD474D4BAC85D54000B2274B"><enum>(b)</enum><header>Contents</header><text>Each report submitted pursuant to subsection (a) shall include, for the immediately preceding 1-year period—</text><paragraph id="HAE51A85E36BA4B94AA706A688A326C2B"><enum>(1)</enum><text>the number and percentage of aliens described in section 292(c) of the Immigration and Nationality Act and in paragraphs (1), (2), (3), and (4), respectively, of section 292(d) of such Act who were represented by counsel, including information specifying—</text><subparagraph id="H5CFBB3CD9CA14AABB6770FD799B62838"><enum>(A)</enum><text>the stage of the legal process at which the alien was represented; and</text></subparagraph><subparagraph id="H50F34CE3656E4B16ADA55A7699D61EC5"><enum>(B)</enum><text>whether the alien was in government custody; and</text></subparagraph></paragraph><paragraph id="H3135522B17DF4B5B995F15B2B6E9A9D1"><enum>(2)</enum><text>the number and percentage of aliens who received legal orientation presentations.</text></paragraph></subsection></section><section id="H4DE3B48A78D540FB93322395F73AF936"><enum>5.</enum><header>Motions to reopen</header><text display-inline="no-display-inline">Section 240(c)(7)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(7)(C)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0797D94657F940E0A74C07F11C4D2517"><clause id="HA9EA1B77EB18489786096E1B9D51524A"><enum>(v)</enum><header>Special rule for aliens entitled to appointment of counsel</header><text>If the Secretary of Health and Human Services or the Attorney General fail to appoint counsel for an alien in accordance with subsection (c) or (d) of section 292, as applicable—</text><subclause id="H0F6A6F08617F4E4AB3C733AD75FA81AF"><enum>(I)</enum><text>no limitation under this paragraph pertaining to the filing of any motion under this paragraph by such alien shall apply; and</text></subclause><subclause id="HCBD89B0A3C3D427DB18E45DEE8BAF745"><enum>(II)</enum><text>the filing of such a motion shall stay the removal of the alien.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
