medical opinions for veterans with service-connected disabilities who die from COVID–19 to determine whether their service-connected disabilities were the principal or contributory causes of death, section-type="subsequent-section" id="id5B0213DCE74C40089AF03C07575610B9" changed="deleted" reported-display-style="strikethrough" committee-id="SSVA00"><enum>2.</enum><header>Medical opinions for certain veterans with service-connected disabilities who die of COVID–19</header><text display-inline="no-display-inline">In any case in which a veteran with one or more service-connected disabilities dies, the death certificate identifies Coronavirus Disease 2019 (COVID–19) as the principal or contributory cause of death, the death certificate does not clearly identify any of the service-connected disabilities as the principal or contributory cause of death, and a claim for benefits is filed with respect to the veteran under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/13">chapter 13</external-xref> of title 38, Unites States Code, the Secretary of Veterans Affairs shall secure a medical opinion to determine if a service-connected disability was the principal or contributory cause of death.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idf8cdd6d5-a777-4066-9c68-91f66c6c53c1" changed="added" reported-display-style="italic" committee-id="SSVA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Survivor Benefits during COVID–19 Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="ide9d957be-4206-44c3-a296-0eaa09a6e98e" changed="added" reported-display-style="italic" committee-id="SSVA00"><enum>2.</enum><header>Medical opinions for certain veterans with service-connected disabilities who die of COVID–19</header><subsection changed="added" reported-display-style="italic" committee-id="SSVA00" id="id21241F9C6F5F4513A5B3671E80B954B6"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(a)</added-phrase></enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall secure a medical opinion to determine if a service-connected disability was the principal or contributory cause of death before notifying the survivor of the final decision in any case in which all of the following factors are met:</text><paragraph id="id0522d5cd65f4469d9d24a5f425cefc47" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(1)</added-phrase></enum><text>A claim for compensation is filed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/13">chapter 13</external-xref> of title 38, Unites States Code, with respect to a veteran with one or more service-connected disabilities who dies. </text></paragraph><paragraph id="id4c56346e804744a3b6f5e18b85246ed5" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(2)</added-phrase></enum><text>The death certificate for the veteran identifies Coronavirus Disease 2019 (COVID–19) as the principal or contributory cause of death.</text></paragraph><paragraph id="id357c152e8cd64c788efff99989f83a4a" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(3)</added-phrase></enum><text>The death certificate does not clearly identify any of the service-connected disabilities of the veteran as the principal or contributory cause of death.</text></paragraph><paragraph id="id7f1d2cf0891a4f73b5f4bc92fdcdd630" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(4)</added-phrase></enum><text>A service-connected disability of the veteran includes a condition more likely to cause severe illness from COVID–19 as determined by the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="idc270a69a773149d892b4c2113c87e3bb" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(5)</added-phrase></enum><text>The claimant is not entitled to benefits under section 1318 of such title.</text></paragraph><paragraph id="ide8e86b0c52ba4b00a2035b1d2e9406a8" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(6)</added-phrase></enum><text>The evidence to support the claim does not result in a preliminary finding in favor of the claimant.</text></paragraph></subsection><subsection id="id75b157b20fee49fd872ddc5a7c561c9d" changed="added" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(b)</added-phrase></enum><header>Outreach</header><text>The Secretary shall provide information to veterans, dependents, and veterans service organizations about applying to dependency and indemnity compensation when a veteran dies from COVID–19. The Secretary shall provide such information through the website of the Department of Veterans Affairs and via other outreach mechanisms.</text></subsection></section></legis-body><endorsement><action-date>June 24, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
