<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 894</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210323">March 23, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To identify and refer members of the Armed Forces with a health care occupation who are separating from the Armed Forces for potential employment with the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hire Veteran Health Heroes Act of 2021</short-title></quote>.</text></section><section id="idCD731E1AB1ED4CBF98E1CD6A309CBDA3"><enum>2.</enum><header>Identification and referral of members of the Armed Forces with a health care occupation for potential employment with the Department of Veterans Affairs during separation from the Armed Forces</header><subsection id="id39B2B942FCD944ADB4524DD8555F432C"><enum>(a)</enum><header>Identification</header><text>The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall identify members of the Armed Forces in a health care occupation during the separation of such members from the Armed Forces.</text></subsection><subsection id="id4D17885DF020475493AA89FFF90E00F0"><enum>(b)</enum><header>Referral of interested individuals</header><paragraph id="id8A54A628C14946C391F63ABF8D47DE21"><enum>(1)</enum><header>In general</header><text>If a member of the Armed Forces identified under subsection (a) expresses an interest in working in a health care occupation within the Department of Veterans Affairs, the Secretary of Veterans Affairs shall refer the member to a recruiter of the Department for consideration of open positions in the specialty and geography of interest of the member.</text></paragraph><paragraph id="id6311DF06C6E34657901BA9E0212B1D1A"><enum>(2)</enum><header>Timing</header><text>Any referral of a member of the Armed Forces conducted under paragraph (1) shall be made not earlier than one year before the separation of the member from the Armed Forces.</text></paragraph></subsection><subsection id="idA730EA24BED5428986B03E68BB8BDE5B"><enum>(c)</enum><header>Rule of construction</header><text>Any identification of a member of the Armed Forces under subsection (a) or referral of such member under subsection (b) shall not be construed as a guarantee of employment of such member with the Department of Veterans Affairs.</text></subsection><subsection id="idb4b50bbf637d4216ba3561f638ef3bad"><enum>(d)</enum><header>Reports</header><text>Not later than each of one year and two years after the date of the enactment of this Act, the Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall submit to the appropriate committees of Congress a report on the efficacy of the identification and referral of separating members of the Armed Forces under this section.</text></subsection><subsection id="id264FD707311747E895D73AF355748EB3"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id97C269D565E74930B21114CDB96BEF94"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idCF92ADD8ECD14537B30E589C7EB2F6C1"><enum>(A)</enum><text>the Committee on Armed Services and the Committee on Veterans’ Affairs of the Senate; and</text></subparagraph><subparagraph id="idE615A5B35D4F4A50A45B68A87DC12FDF"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Veterans’ Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id6622CDD1A7154849BF2F11073DB18174"><enum>(2)</enum><header>Health care occupation</header><text>The term <term>health care occupation</term> means an occupation for which an individual may be appointed for employment with the Department of Veterans Affairs under section 7401 of title 38, United States Code. </text></paragraph></subsection></section></legis-body></bill>
