<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 894</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To identify and refer members of the Armed Forces with a health care occupation who are separating from the Armed Forces for potential employment with the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hire Veteran Health Heroes Act of 2021</short-title></quote>.</text></section><section id="id15627D7C8AF04EB891063EC79FD05B93" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Identification and referral of members of the Armed Forces with a health care occupation for potential employment with the Department of Veterans Affairs during separation from the Armed Forces</header><text display-inline="no-display-inline">Section 207 of the VA Choice and Quality Employment Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/46">Public Law 115–46</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/7401">38 U.S.C. 7401</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id52B063CA1CDF4B8D8F56625C4D8516D8" changed="not-changed"><section id="id281A4036C8C14EA8949F287BA040FF5B" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="not-changed"><enum>207.</enum><header display-inline="yes-display-inline">Identification and referral of members of the Armed Forces with a health care occupation for potential employment with the Department of Veterans Affairs during separation from the Armed Forces</header><subsection id="id99EF48EC6E624C5F9F5EE7EB9B646663" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall establish a program to identify and refer members of the Armed Forces with a health care occupation for employment with the Department of Veterans Affairs during the separation of such members from the Armed Forces.</text></subsection><subsection id="id4379672B734E4A298186D1483389BCFC" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Referral of interested individuals</header><paragraph id="id14A22D4A05AB4FADBE43AB8118740BB9" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a member of the Armed Forces identified under subsection (a) expresses an interest in working in a health care occupation within the Department of Veterans Affairs, the Secretary of Veterans Affairs shall refer the member to a recruiter of the Department for consideration of open positions in the specialty and geography of interest to the member.</text></paragraph><paragraph id="id4AF7711CE062479BA6BE66040E658232" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">Any referral of a member of the Armed Forces conducted under paragraph (1) shall be made not earlier than one year before the separation of the member from the Armed Forces.</text></paragraph></subsection><subsection id="id21FA199FAF244DF885214DCC411E0B56" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Any identification of a member of the Armed Forces under subsection (a) or referral of such member under subsection (b) shall not be construed as a guarantee of employment of such member with the Department of Veterans Affairs.</text></subsection><subsection id="id50C5A12B0EF04A81AF9BB65ACAFD9E19" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than each of one year and two years after the date of the enactment of the <short-title>Hire Veteran Health Heroes Act of 2021</short-title>, the Secretary of Veterans Affairs shall submit to the appropriate committees of Congress a report on the program established under subsection (a).</text></subsection><subsection id="idF68A2154E64B4991A45CBE2087E8FD18" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id229AC958ED2842AE85B1AD8868886996" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idFFF44CC086E0485FA1875DC0ECBA5EE4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Armed Services and the Committee on Veterans’ Affairs of the Senate; and</text></subparagraph><subparagraph id="idFE80CE3F989F411DA336640CC0934EF7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Armed Services and the Committee on Veterans’ Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id00C4B696A87F4CF3BFC3EFD19A34E78E" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Health care occupation</header><text display-inline="yes-display-inline">The term <term>health care occupation</term> means an occupation for which an individual may be appointed for employment with the Department of Veterans Affairs under section 7401 of title 38, United States Code.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestation-date date="20210721" chamber="Senate">Passed the Senate July 21, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
