which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to ensure that kombucha is exempt from any excise taxes and regulations imposed on alcoholic beverages.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H09FD82F3BA984D779976592730D01E7F"><section section-type="section-one" id="H531416109DB64A47B88CC76E8CD678AF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our Manufacturers from Being Unfairly taxed while Championing Health Act</short-title></quote> or <quote><short-title>KOMBUCHA</short-title></quote>.</text></section><section id="H85382AA7C32F4482B30FE49245B3DC03"><enum>2.</enum><header>Tax-free production of kombucha</header><subsection id="H59819C0C70C446BD9889AA843B09B5EC"><enum>(a)</enum><header>Exception from definition of brewer</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/26/5052">section 5052</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H345964053F34443BB7CFFD3376AEB00F"><subsection id="H13090897035343839A92F7B7237C7737"><enum>(d)</enum><header>Brewer</header><paragraph id="HBF1B75BEE6B8460A9C58287A983AF0E1"><enum>(1)</enum><header>In general</header><text>For purposes of this chapter, the term <term>brewer</term> means any person who brews beer or produces beer for sale.</text></paragraph><paragraph id="H976A66694677407689501E74101E971A"><enum>(2)</enum><header>Exception</header><text>The term <term>brewer</term> shall not include any person who—</text><subparagraph id="H89B695F8C3444DF98ED0F65448FD3BD0"><enum>(A)</enum><text>produces only beer exempt from tax under subsection (e) of section 5053, or</text></subparagraph><subparagraph id="H72567D8B22EC4609B949D4527181F753"><enum>(B)</enum><text>produces only kombucha exempt from tax under subsection (i) of such section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA7FFCAAC6BCA40649EF1F2438B2238AA"><enum>(b)</enum><header>Exemption from tax</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5053">Section 5053</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H34A6206B98424A43953B7A2495C4C66D"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j), and</text></paragraph><paragraph id="H69F986E36C7444B7B12A5036F9474FEB"><enum>(2)</enum><text>by inserting after subsection (h) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE0018068FE4C42E4A8EDA04DC8D03799"><subsection id="HE0E21F27981D4ADD97CE53B00A4D9654"><enum>(i)</enum><header>Production of kombucha</header><paragraph id="H9C6B7D9859CE4EF2BD80E7E2415EAEDB"><enum>(1)</enum><header>In general</header><text>Subject to regulation prescribed by the Secretary, any person may, without payment of tax, produce kombucha for consumption or sale.</text></paragraph><paragraph id="H83E6BE76F5614A2A84467238FD6A721A"><enum>(2)</enum><header>Definition</header><text>For purposes of this chapter, the term <term>kombucha</term> means a beverage which—</text><subparagraph id="HBABFDEEE82C14D38AFB9172ED1A65348"><enum>(A)</enum><text>is fermented solely by a symbiotic culture of bacteria and yeast,</text></subparagraph><subparagraph id="H350D98C4A08149A29AA0198BDA910C19"><enum>(B)</enum><text>contains not more than 1.25 percent of alcohol by volume,</text></subparagraph><subparagraph id="H8EF9D130F1AB4E978BE756DF6828A487"><enum>(C)</enum><text>is sold or offered for sale as kombucha, and</text></subparagraph><subparagraph id="HCC527F93C4D240D8B03A03FBCE039B84"><enum>(D)</enum><text>is derived from—</text><clause id="HFBB751FF99C240E7B7834303AE4198F5"><enum>(i)</enum><text>sugar, malt or malt substitute, tea, or coffee, and</text></clause><clause id="H6D88A59E88C9437DA005E8F323AEC6D5"><enum>(ii)</enum><text>not more than 20 percent other wholesome ingredients.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H22ADA7060E0E4A1E95D99F80736C53A9"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to calendar quarters beginning after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
