which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make certain improvements relating to the supply chain of the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBB5D5E2B04984958B419ED94E915FC0B"><section section-type="section-one" id="HFB858775EE0A4DC594BE03645AB28FE9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Supply Chain Resiliency Act</short-title></quote>.</text></section><section id="HA4398E42CC2440C188E3DC26194C1E6F"><enum>2.</enum><header>Department of Veterans Affairs supply chain resiliency</header><subsection id="HB740F3C2E21A427A9C923FD47E9B9773"><enum>(a)</enum><header>Report on critical items and requirements</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report containing each of the following:</text><paragraph id="H2244FBBDDCF9482185AF335955084CF1"><enum>(1)</enum><text>A description of the items and types of items the Secretary considers critical with respect to—</text><subparagraph id="HDDB756BAD22F4422984F1F12ECD3156A"><enum>(A)</enum><text>the ongoing response to the Coronavirus 2019 (COVID–19) pandemic; and</text></subparagraph><subparagraph id="HF013FCC14EBF4FDB955CAC3AA3EEABF9"><enum>(B)</enum><text>future epidemic, pandemic, emergency, national emergency, or natural disaster scenarios.</text></subparagraph></paragraph><paragraph id="H6B07C39729D4457FB23B30A0ACBE5061"><enum>(2)</enum><text>The quantities of the items described in paragraph (1) that are available, as of the date of the enactment of this Act, in inventories, emergency caches, or other emergency inventories of the Department of Veterans Affairs.</text></paragraph><paragraph id="H800B416AE1494175B3D58EDE0939ED11"><enum>(3)</enum><text>The anticipated quantities of the items described in paragraph (1) that would be necessary under potential epidemic, pandemic, emergency, national emergency, or natural disaster scenarios the Secretary determines to be relevant for planning purposes.</text></paragraph><paragraph id="H8A1764B9772942D5A67A1641EC9148FB"><enum>(4)</enum><text display-inline="yes-display-inline">The assumptions and key planning factors used by the Secretary to identify the items, types of items, and necessary quantities of items for types of scenarios, as described in paragraphs (1) and (3).</text></paragraph></subsection><subsection id="H5F57788F49194A448EC9C60F6772130D"><enum>(b)</enum><header>Participation in Warstopper Program</header><paragraph id="idBD86B233AE324115B73B75AD418A3A3D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs and the Secretary of Defense shall enter into an agreement to provide for the participation of the Department of Veterans Affairs in the program known as the <quote>Warstopper Program</quote> of the Defense Logistics Agency, or any successor program.</text></paragraph><paragraph id="id336279680B2E4BE38737D612A4E62AF6"><enum>(2)</enum><header>Requirements</header><text>Pursuant to the agreement under paragraph (1), the Defense Logistics Agency shall—</text><subparagraph id="HC99051CCFFBB44F9979D36681EAA0566"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the maintenance and stability of the items that are identified as critical in the report required under subsection (a) and that the Secretary of Veterans Affairs and the Secretary of Defense determine are appropriate for the Warstopper Program;</text></subparagraph><subparagraph id="H7FEE75667B9040829C077E55B56F5AF3"><enum>(B)</enum><text display-inline="yes-display-inline">establish guidance for the participation of the Department of Veterans Affairs in the Warstopper Program that includes an identification of the items and types of items that are critical to the needs of the Department of Veterans Affairs; and</text></subparagraph><subparagraph id="H01C0B1876F4745C292F8EA28EC2F88C5"><enum>(C)</enum><text display-inline="yes-display-inline">use existing contracts and agreements and enter into new contracts and agreements, as necessary, with manufacturers and distributors to reserve the supply of such critical items rather than rely on holding physical inventories of such items.</text></subparagraph></paragraph></subsection><subsection id="HD4E89A3868CA4764A73C0F75937C43AE"><enum>(c)</enum><header>Report on implementation</header><paragraph id="H37A3C6EE5E0F4285BB2B15029AC7EDFC"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the implementation of this section.</text></paragraph><paragraph id="id8EE32FAB8FAE4BF7B9BE438B7763D3F9"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall contain each the following:</text><subparagraph id="HCECE93792BBA4AC38B5CF96DEE1E5A8B"><enum>(A)</enum><text>An implementation plan for the participation of the Department of Veterans Affairs in the Warstopper Program, including milestones and timelines for related administrative, contracting, and readiness activities.</text></subparagraph><subparagraph id="H08D24D8D04D549F88B6FAF8E90C65EC4"><enum>(B)</enum><text display-inline="yes-display-inline">For each of the items and associated quantities identified in paragraphs (1) and (3) of subsection (a)—</text><clause id="H2777FE0FE88D482F835C98D1FB42C1E2"><enum>(i)</enum><text>the method by which the Secretary of Veterans Affairs plans to ensure the Department continues to have access to adequate quantities of such items and types of items, including in the Warstopper Program and in regional, physical inventories; and</text></clause><clause id="H4962EACC5D6E42BEB16262005CA7EBAD"><enum>(ii)</enum><text>justifications for the method or methods identified under clause (i).</text></clause></subparagraph></paragraph><paragraph id="H57BCC39BEF5543E3BB05BA0C3AA5D92E"><enum>(3)</enum><header>Updates to report</header><text display-inline="yes-display-inline">The Secretary shall update the report required under paragraph (1) on an annual basis for each of the two years following the submission of the report under such paragraph and submit such updates to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives.</text></paragraph></subsection><subsection id="H5FCA567283454360956A6310DD6A48BD"><enum>(d)</enum><header>Prohibition on exclusive reliance on regional inventories</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall ensure that the Department does not exclusively rely on holding regional, physical inventories of critical items in order to respond to greater than expected needs for such items during epidemic, pandemic, emergency, national emergency, or natural disaster situations.</text></subsection></section></legis-body></bill>
