<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 87</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S348">Mr. Paul</cosponsor>, and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the expenditure for an abortion of Federal funds authorized or appropriated for preventing, preparing for, or responding to the COVID–19 pandemic, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBEF8247CE2FA4F7F87DFA38965A22DE9"><section section-type="section-one" id="H421F2943C56B4242B4841786A0B57615"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Protecting Life in Crisis Act</short-title></quote>.</text></section><section id="HDED01B9427B947E0A54D563C9A259161"><enum>2.</enum><header>Prohibiting the expenditure of COVID–19 funding for any abortion</header><subsection id="HEFF8701653D545E98CB9A30C99F88D6E"><enum>(a)</enum><header>Prohibitions</header><paragraph id="HE5AA80C982BC48068189BDB75916588E"><enum>(1)</enum><header>In general</header><text>No funds authorized or appropriated by Federal law for the purpose of preventing, preparing for, or responding to the COVID–19 pandemic, domestically or internationally, and none of the funds in any trust fund to which funds are authorized or appropriated by Federal law for such purpose, shall be expended for any abortion.</text></paragraph><paragraph id="H4D17A7675CD04FB5BC65A853FEB4F38D"><enum>(2)</enum><header>Specified health benefits coverage</header><text display-inline="yes-display-inline">None of the funds authorized or appropriated by Federal law for the purpose described in subsection (a), and none of the funds in any trust fund to which funds are authorized or appropriated by Federal law for such purpose, shall be expended for, nor shall any credit for such purpose be allowed under the internal revenue laws with respect to, coverage under a qualified health plan offered through an Exchange established pursuant to title I of the Patient Protection and Affordable Care Act, COBRA continuation coverage, or any other coverage, if such coverage includes coverage of abortion.</text></paragraph><paragraph id="H526B9E1294FB49B38EFFB0D4C7185120"><enum>(3)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>COBRA continuation coverage</term> means continuation coverage provided pursuant to part 6 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1161">29 U.S.C. 1161</external-xref> et seq.) (other than under section 609 of such Act), title XXII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300bb-1">42 U.S.C. 300bb–1</external-xref> et seq.), <external-xref legal-doc="usc" parsable-cite="usc/26/4980B">section 4980B</external-xref> of the Internal Revenue Code of 1986 (other than subsection (f)(1) of such section insofar as it relates to pediatric vaccines), or section 8905a of title 5, United States Code, or under a State program that provides comparable continuation coverage. Such term does not include coverage under a health flexible spending arrangement under a cafeteria plan within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/26/125">section 125</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection><subsection id="H2A86B5CBD93D4FD0AA33FDBD72E8B24F"><enum>(b)</enum><header>Treatment of abortions related to rape, incest, or preserving the life of the mother</header><text>The limitations established in subsection (a) shall not apply to an abortion—</text><paragraph id="HEE704CAE66624A0FB1A9B2C4187808E4"><enum>(1)</enum><text>if the pregnancy is the result of an act of rape or incest; or</text></paragraph><paragraph id="HE15CD5E27866496A8A6BE57BCCF3625E"><enum>(2)</enum><text>in the case where a woman suffers from a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the woman in danger of death unless an abortion is performed.</text></paragraph></subsection><subsection id="H30CE0494405B43E28308770224C035ED"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to require a plan or coverage described in subsection (a) to provide coverage of any abortion.</text></subsection></section></legis-body></bill>
