<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 879</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210322">March 22, 2021</action-date><action-desc><sponsor name-id="S337">Mr. Coons</sponsor> (for himself and <cosponsor name-id="S287">Mr. Cornyn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Education to make grants to support educational programs in civics and history, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6CE925F32E214E5D9C3FE80BC5383068"><section section-type="section-one" id="HEF277351737041E5BA138C3414A4599F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civics Secures Democracy Act</short-title></quote>.</text></section><section id="H41F2E59CDCF8404CBFDB334F5232CA29"><enum>2.</enum><header>Purposes; Rule of Construction</header><subsection id="idE4C23793E9D04F57AF6200FF8EBD688A"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text><paragraph id="HF887DDA0DBE14F3FA0C8F90BE4D0D2E7"><enum>(1)</enum><text>to support local educational agencies, elementary schools, and secondary schools in selecting and making available to all students innovative, engaging curricula and programs in civics and history that prepare them to understand American Government and engage in American democratic practices as citizens and residents of the United States;</text></paragraph><paragraph id="H4DE34A63773D4BB0990F2720E8FA5338"><enum>(2)</enum><text>to provide resources to institutions of higher education for the purposes of offering effective professional development opportunities to enable and encourage teachers to deliver instruction that engages students in learning civics and history;</text></paragraph><paragraph id="HC5B5EA722EC2431E903394533C066C3E"><enum>(3)</enum><text>to provide resources to nonprofit organizations that have developed, or are developing, programs in civic education that incorporate practices that are proven to be effective in engaging students, and to assist in making such curricula and programs more widely available to schools and students, particularly in rural and inner-city urban areas that have traditionally been underserved by civic learning programs;</text></paragraph><paragraph id="H545F1F75084F4B058D35ED5AE72E440A"><enum>(4)</enum><text>to provide resources to continue and expand research into practices, methods, and approaches that are effective in instructing elementary and secondary school students in civics and history;</text></paragraph><paragraph id="idB5F9F3C2915D41DA9112B441919F5BDF"><enum>(5)</enum><text>to diversify the civics, history, and government education workforce by offering targeted incentives and honoring those who commit to the profession;</text></paragraph><paragraph id="id7BBC72DDFEBE44B4817103B8DA928A5C"><enum>(6)</enum><text>to encourage participation in the National Assessment of Educational Progress assessments in civics and history in grades 4, 8, and 12, using a methodology sufficient to provide accurate State-level data on student proficiency in civics and history disaggregated so as to have statistical significance for every State;</text></paragraph><paragraph id="id2C3E513CF4DA49DAACEDEA8014D18629"><enum>(7)</enum><text>to reauthorize and modernize the existing Federal civics education grant program for institutions of higher education, including by strengthening academic independence and supporting partnerships between academic centers and local educational agencies; and</text></paragraph><paragraph id="id7E070BBA6B8542ABB2E91788DFE6DD93"><enum>(8)</enum><text>to strengthen and make independently sustainable the Harry S. Truman Scholarship Foundation Trust Fund and the James Madison Memorial Fellowship Trust Fund, which respectively support exceptional Americans who aspire to careers in public service and as secondary school history, government, and civics educators.</text></paragraph></subsection><subsection id="id8D0D9D6DB8FE416ABF18EDB39B3A6D78"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to authorize the Secretary of Education to prescribe a civics and history curriculum.</text></subsection></section><title id="idBC84FD47724B4414847B7EB4BAB63E9E" style="OLC"><enum>I</enum><header>Grant Program</header><section id="HFC1D02AB1AE2423E807D95705D5E7601"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H70C7F86F0BA24D0F9FEFC110572CA873"><enum>(1)</enum><text>The term <term>civics</term>, when used with respect to an educational program, means a program that addresses the following:</text><subparagraph id="H416A4232B7984EB5BF7823AE4D576035"><enum>(A)</enum><text display-inline="yes-display-inline">Acquisition of civic knowledge, including an understanding of the history, heritage, civic life, and civic institutions of the United States.</text></subparagraph><subparagraph id="H038C34BAF7E8486F8121BAC901EBB2F6"><enum>(B)</enum><text>Acquisition of civic skills, such as the ability to analyze text and determine the reliability of sources and an understanding of the ways in which civic institutions operate and how individuals may be involved in civic life.</text></subparagraph><subparagraph id="H4626FBF24C17494B9AD1A04233366D00"><enum>(C)</enum><text>Acquisition of civic dispositions, values such as appreciation for free speech, civil discourse, tolerance and inclusion, and understanding perspectives that differ from one’s own as well as a disposition to be civically engaged.</text></subparagraph><subparagraph id="H3FA79E7C08C345C7954E897A2465D99B"><enum>(D)</enum><text>Development of civic behaviors, including civic habits and practices such as voting, serving on juries, engagement in deliberative discussions, volunteering, attending public meetings, and other activities related to civic life.</text></subparagraph></paragraph><paragraph id="H64309E80C2954B679C39AB1DCC83360C"><enum>(2)</enum><text>The term <term>eligible entity</term> means—</text><subparagraph id="H38159AD38A844F358308BBC2D30A970A"><enum>(A)</enum><text>with respect to grant program under section 103, a State;</text></subparagraph><subparagraph id="H4627662F02414258A60F499AB508BC16"><enum>(B)</enum><text>with respect to the grant program under section 104, a qualified nonprofit organization;</text></subparagraph><subparagraph id="HE8A496B1A59242F993E0884674D86980"><enum>(C)</enum><text>with respect to the grant program under section 105, an institution of higher education; and</text></subparagraph><subparagraph id="HCA50DEB660C04C4B8CCB1B90ACB78BBB"><enum>(D)</enum><text display-inline="yes-display-inline">with respect to the grant program under section 106, a qualified researcher.</text></subparagraph></paragraph><paragraph id="H2ABEB4C4A1524CD88DDC108EA86FCD4D"><enum>(3)</enum><text>The term <term>evidence-based practices</term> means practices proven to contribute to the effectiveness of educational programs in civics, including—</text><subparagraph id="HA6F4CC3AC94C494786AE1228FF3A8BC2"><enum>(A)</enum><text display-inline="yes-display-inline">innovative and engaging classroom instruction in civics, Government, and history;</text></subparagraph><subparagraph id="HCEDCFDA4B885436987EBDC5807D7E568"><enum>(B)</enum><text display-inline="yes-display-inline">service learning and student civic projects linked to classroom learning;</text></subparagraph><subparagraph id="H1F34BBFA2CEF4811B3F01CD8D223A43B"><enum>(C)</enum><text>learning through participation in models and simulations of democratic processes and experiential learning;</text></subparagraph><subparagraph id="H20A2D5F21319442F9DC794E0698405AE"><enum>(D)</enum><text>guided classroom discussion of current issues and events;</text></subparagraph><subparagraph id="HE2F782AC08614CC585D5DBAFFD4A7FC2"><enum>(E)</enum><text>meaningful participation in school governance; and</text></subparagraph><subparagraph id="H3F701C1BA57243C68DB09B2CC1C236F2"><enum>(F)</enum><text>instruction in media literacy.</text></subparagraph></paragraph><paragraph id="HEEBBB5D06CE04AD1B859198703CC98D1"><enum>(4)</enum><text>The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="H8C27AB33DB0043A8AAA4CDF372E50A75"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>National Assessment of Educational Progress</term> means the National Assessment of Educational Progress carried out under section 303(b) of the National Assessment of Educational Progress Authorization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9622">20 U.S.C. 9622(b)</external-xref>).</text></paragraph><paragraph id="H2E543DD140A0419EAA02C0AA53DE094F"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>qualified nonprofit organization</term> means an organization that—</text><subparagraph id="HD9C2718D29DD4E4F85A5D70EACC6043A"><enum>(A)</enum><text display-inline="yes-display-inline">is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and which is exempt from taxation under section 501(a) of such Code; and</text></subparagraph><subparagraph id="H410266D5067E48E5A20CA29D544C9088"><enum>(B)</enum><text display-inline="yes-display-inline">has experience developing curricula, instructional models, and other educational programs for students in elementary schools and secondary schools.</text></subparagraph></paragraph><paragraph id="HA23CD0FD01FE40D7BEA6298E2AA026D4"><enum>(7)</enum><text>The term <term>qualified researcher</term> means—</text><subparagraph id="H764B06FE79004554A0046A3240FA6C05"><enum>(A)</enum><text>a nonprofit organization that has ability and capacity to carry out scientifically valid research; or</text></subparagraph><subparagraph id="HD71C34849E7E4BD4878242BEEAE1AE1D"><enum>(B)</enum><text>an individual affiliated with such an organization.</text></subparagraph></paragraph><paragraph id="HEFD2BA99FA6F41A18AC819F6CA428443"><enum>(8)</enum><text>The terms <term>English learner</term>, <term>elementary school</term>, <term>local educational agency</term>, <term>secondary school</term>, and <term>State</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph></section><section id="H4CE6752D58F74D52A772BB1C4E0DB08A"><enum>102.</enum><header>General provisions</header><subsection id="H2844AA23A2684D2DA6C209E6AD476769"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available under section 107 the Secretary of Education is authorized to carry out the civics education grant programs described in sections 103 through 106.</text></subsection><subsection id="H18ECE89699B541D18091536F295D5B95"><enum>(b)</enum><header>Application</header><text>To be considered for a grant under this Act, an eligible entity shall submit to the Secretary of Education an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="HABDF42BD89594EEA81126669C2A8896C"><enum>(c)</enum><header>Grant duration</header><text display-inline="yes-display-inline">Each grant under this Act shall be awarded for a period of not less than 3 years.</text></subsection><subsection id="HBE66C4C3F203400FB5DA0A273EF6F2AD"><enum>(d)</enum><header>Priority</header><text>Except as otherwise provided in this Act, the Secretary shall prioritize the award of grants to eligible entities that demonstrate the greatest potential to—</text><paragraph id="H4DEF9A0EA4CE48F3AB46DCEB6BEFEC5C"><enum>(1)</enum><text display-inline="yes-display-inline">improve knowledge and engagement among students traditionally underserved by comprehensive civic education and American history programs, including rural and inner-city urban students, English learners, students who have not completed high school, and other such students;</text></paragraph><paragraph id="H1A031E9259724E7FB0C02B2B55EF90BB"><enum>(2)</enum><text display-inline="yes-display-inline">close gaps in civic knowledge and achievement among students of different income levels, racial and ethnic groups, and native languages;</text></paragraph><paragraph id="HC0DDF432F8564CDCB8256B4FA3370709"><enum>(3)</enum><text display-inline="yes-display-inline">improve performance on the National Assessment of Educational Progress assessments in civics and history among students in grades 4, 8, and 12;</text></paragraph><paragraph id="HFAC433747EFD47D6810FB98ECA92ECCD"><enum>(4)</enum><text display-inline="yes-display-inline">integrate evidence-based practices for promoting student proficiency and engagement in civics; and</text></paragraph><paragraph id="H96A4BE3FAB114233B0BA75EA250681D0"><enum>(5)</enum><text display-inline="yes-display-inline">provide cost-effective, scalable delivery of programs and services.</text></paragraph></subsection></section><section id="HA67A2C241FC44E65806B095C2344B870"><enum>103.</enum><header>Grants to States</header><subsection id="H9A1EF808BECC4E1393E8C618CED6DC14"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary of Education is authorized to make grants to States, on a competitive basis, to support educational programs in civics and history in accordance with this section.</text></subsection><subsection id="HB84AAF8B07BA4D5CBF384897B144F952"><enum>(b)</enum><header>Grant amount</header><text display-inline="yes-display-inline">The amount of each grant to a State under this section shall be proportional to the amount received by all local educational agencies in the State under part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref> et seq.) for the previous fiscal year relative to the total such amount received by all local educational agencies in every State that receives a grant under this section.</text></subsection><subsection id="H3296F7E1836D4D589D7BB5260A2C2DEA"><enum>(c)</enum><header>State reservation</header><text display-inline="yes-display-inline">A State that receives a grant under this section may reserve not more than 5 percent of the amount of the grant for—</text><paragraph id="H3BFC35A3176E48419D433AFF84760601"><enum>(1)</enum><text>administrative costs of carrying out the State’s responsibilities under this section; and</text></paragraph><paragraph id="HCE8B5C01EC594C2ABF3249D2FB8552C6"><enum>(2)</enum><text display-inline="yes-display-inline">monitoring and evaluating programs and activities supported with the grant.</text></paragraph></subsection><subsection id="HB1D9A73893684131A3499F1C17A17F67"><enum>(d)</enum><header>Subgrants to local educational agencies</header><text display-inline="yes-display-inline">A State that receives a grant under this section shall use not less than 95 percent of the amount of the grant to make subgrants, on a competitive or formula basis, to local educational agencies within the State to assist such agencies in carrying out programs to improve the achievement of elementary and secondary school students in the fields of civics and history.</text></subsection><subsection id="H331F7343BCD74376BC305E5B377676EC"><enum>(e)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">A State shall use a grant under this section only to supplement the level of Federal, State, and local public funds that would, in absence of such grant, be made available for the activities supported by the grant, and not to supplant such funds.</text></subsection><subsection id="H146DB6FF3FDC43B085500B3309B2EF13"><enum>(f)</enum><header>Contents of application</header><text display-inline="yes-display-inline">As part of the application required under section 102(b), a State shall include a plan describing how the State intends to use the grant under this section. Each State plan shall include, at a minimum, the following:</text><paragraph id="HA8EDD9430C634E0DAAC0D9D308C64C34"><enum>(1)</enum><text display-inline="yes-display-inline">An explanation of how the State will use the grant to supplement, and not supplant, other public funds provided for educational programs in civics and history.</text></paragraph><paragraph id="H4725FD992FCC4ECDA17847D94DA41723"><enum>(2)</enum><text display-inline="yes-display-inline">Plans to address civics and history achievement gaps among students of different income levels, racial and ethnic backgrounds, and native languages.</text></paragraph><paragraph id="H9F25E50DCBD74407B6BB9C43DFA1FD8A"><enum>(3)</enum><text display-inline="yes-display-inline">Plans to improve civics and history achievement among traditionally underserved students, including rural and urban students and English learners.</text></paragraph><paragraph id="H4B0C2BC825FB4EBC81033CDF215C57EA"><enum>(4)</enum><text display-inline="yes-display-inline">Plans for making subgrants to local educational agencies as required under subsection (d), including—</text><subparagraph id="H76CE719AF2E743A3949E2498DBFE1CFD"><enum>(A)</enum><text>details of how the State intends to distribute funding to local educational agencies, whether by competition or through a formula-based system;</text></subparagraph><subparagraph id="H9F04D93EEECA496C973A19D224555402"><enum>(B)</enum><text>how the State’s approach to distributing funds to local educational agencies will take into account requirements of paragraphs (1) through (3);</text></subparagraph><subparagraph id="H1AC8A3499A5B48AE91254A7685324E2E"><enum>(C)</enum><text display-inline="yes-display-inline">criteria by which local educational agencies’ applications for funding will be evaluated, including how such applications will take into account the requirements of paragraphs (1) through (3);</text></subparagraph><subparagraph id="H03E33DA5444A4E3EB8D13465BBBC43AA"><enum>(D)</enum><text>how the State will ensure that local educational agencies will use grant funds to supplement, and not supplant, other public funding for educational programs in civics and history; and</text></subparagraph><subparagraph id="H6A1507CB780145D88C54DC5C3452AB31"><enum>(E)</enum><text>how the State will evaluate and hold local educational agencies accountable for improved student knowledge and achievement in civics and history.</text></subparagraph></paragraph><paragraph id="HB10D0C6B3DA64309BD28CC8AD2F6A599"><enum>(5)</enum><text display-inline="yes-display-inline">An assurance that the State will participate in the National Assessment of Educational Progress assessments in civics and history in grades 4, 8, and 12.</text></paragraph><paragraph id="HB6B709A825924B71A47A9372543C44A7"><enum>(6)</enum><text display-inline="yes-display-inline">In the case of a State applying to renew a grant previously received under this section, an evaluation of the effectiveness of the activities carried out using the previous grant, which shall be based on the results of the most recent National Assessment of Educational Progress assessment in civics and history, to the extent the results of such assessment are available at the time of the State’s application.</text></paragraph></subsection></section><section id="H51EB6F5103FC496CB124CA109D96C9C6"><enum>104.</enum><header>Grants to nonprofit organizations</header><subsection id="H35AB0E4FD517449D832BB2DC99AF967A"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary of Education is authorized to make grants to qualified nonprofit organizations, on a competitive basis, to assist such organizations in developing or expanding access to evidence-based curricula, instructional models, and other educational programs to enhance student knowledge and achievement in civics and history in elementary schools and secondary schools.</text></subsection><subsection id="H01B03D70E2904E35AA57325C7C2E349E"><enum>(b)</enum><header>Contents of application</header><text display-inline="yes-display-inline">As part of the application required under section 102(b), a qualified nonprofit organization shall include a proposal that demonstrates how the activities proposed to be carried out with the grant under this section will enhance student knowledge and achievement in civics and history in elementary schools and secondary schools.</text></subsection><subsection id="HCE1D1460B01448E9BB30D2C1B1C8CED8"><enum>(c)</enum><header>Priority of awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to qualified nonprofit organizations that propose to use the grant to develop or expand access to curricula, instructional models, and other educational programs that—</text><paragraph id="H4167BB07FDA14BE291BB8746DF6D39A4"><enum>(1)</enum><text display-inline="yes-display-inline">address the learning needs of traditionally underserved students, including rural and inner-city urban students and English learners; and</text></paragraph><paragraph id="HE4D2113037024BC1A7738372399772A5"><enum>(2)</enum><text display-inline="yes-display-inline">incorporate evidence-based practices to enhance student learning and engagement in civics and history.</text></paragraph></subsection></section><section id="HD572C92A2A1844529F5F9F934DD6F561"><enum>105.</enum><header>Grants to institutions of higher education</header><subsection id="HBA5A5FC457884FD4828FEA0578387D12"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary of Education is authorized to make grants to institutions of higher education, on a competitive basis, to assist such institutions in developing and implementing programs to train elementary and secondary school teachers in methods for instructing and engaging students in civics and history.</text></subsection><subsection id="H94CD18CAFB374C7DA156943A8A1D05F2"><enum>(b)</enum><header>Contents of application</header><text display-inline="yes-display-inline">As part of the application required under section 102(b), an institution of higher education shall include a proposal demonstrating that the institution—</text><paragraph id="H2523DAE2928A42178019DAACCCDBB814"><enum>(1)</enum><text>has the ability to train elementary and secondary school teachers to provide comprehensive civics education;</text></paragraph><paragraph id="H540F2C6FCFD942238E4950BFA2C6F4EA"><enum>(2)</enum><text>is familiar with research on practices that are proven to contribute to effective instruction in civics and history and will incorporate such research into the training provided to teachers using the grant; and</text></paragraph><paragraph id="HE190D61E8B274780B3A810411BB3F028"><enum>(3)</enum><text>will use the grant to make training in civics education available to elementary and secondary school teachers in the State or geographic region served by the institution.</text></paragraph></subsection><subsection id="H57CB938626884D51AA8252BDD6AD7EF1"><enum>(c)</enum><header>Priority of awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to institutions of higher education that propose to use the grant to carry out training programs for teachers that—</text><paragraph id="H462791363A9F4759A28C67CB2B247F45"><enum>(1)</enum><text>address the specific needs of teachers working with traditionally underserved students, including rural and inner-city urban students and English learners; and</text></paragraph><paragraph id="H709A180D180942AFA0149CF92F546B9D"><enum>(2)</enum><text display-inline="yes-display-inline">incorporate evidence-based practices for improving the ability of teachers to provide effective instruction in civics and history.</text></paragraph></subsection><subsection id="id694BBD60C50145DEAF1843965B7ACEDE"><enum>(d)</enum><header>Reservation of funds</header><text>From the amounts made available to carry out this section, 35 percent shall be reserved to award grants, on a competitive basis, to institutions of higher education that are eligible to receive funds under—</text><paragraph id="id6A8607F0E1EC4B529D5C6C98DD6CC6D5"><enum>(1)</enum><text>part A or part B of title III of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1057">20 U.S.C. 1057</external-xref> et seq., 1060 et seq.);</text></paragraph><paragraph id="id66C373B4301C4494A6EBDE9338D5FED7"><enum>(2)</enum><text>part A or part B of title V of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1101">20 U.S.C. 1101</external-xref> et seq., 1102 et seq.); or</text></paragraph><paragraph id="id24A19BDCFF0942829EED359C54B29966"><enum>(3)</enum><text>subpart 4 of part A of title VII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1136a">20 U.S.C. 1136a</external-xref> et seq.).</text></paragraph></subsection></section><section id="HC6B01E35888F4B6ABE1BDAF0293A6ADA"><enum>106.</enum><header>Research grants</header><subsection id="H5F6FE5BD178143C0A030DAFBD32E8967"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary of Education is authorized to make grants, on a competitive basis, to qualified researchers to research and evaluate—</text><paragraph id="HF899AEF23BAA4210A94D4731024704FC"><enum>(1)</enum><text display-inline="yes-display-inline">elementary and secondary school students’ knowledge of civics and history; and</text></paragraph><paragraph id="H8A8D2CDB761B4A38BBD21F7D2ECE1CED"><enum>(2)</enum><text display-inline="yes-display-inline">effective instructional practices and educator professional development in the fields of civics and history.</text></paragraph></subsection><subsection id="H183A1CF2341C4E49B86B96B88093E553"><enum>(b)</enum><header>Contents of application</header><text display-inline="yes-display-inline">As part of the application required under section 102(b), a qualified researcher shall include a description of the project to be funded with the grant under this section. The description of the project shall include a separate section that describes how the project may directly or indirectly affect civics education generally, which may include effects such as—</text><paragraph id="H3522F0BCD06940C0A0F5E8A360B7D6A0"><enum>(1)</enum><text>achieving the full participation of women, persons with disabilities, and underrepresented minorities in civics and history education;</text></paragraph><paragraph id="HAE794D7C942A4B59A92E39D78B35682D"><enum>(2)</enum><text>increasing public civic literacy and civic engagement;</text></paragraph><paragraph id="HD0841A7B53AC43C4ACA4F596DE526A49"><enum>(3)</enum><text>developing a diverse educator workforce; or</text></paragraph><paragraph id="H5DACB53852644FBBBDDD1CC12C0B30C5"><enum>(4)</enum><text>other such effects.</text></paragraph></subsection><subsection id="H0CAAEE87FD00443885C7BE0A78CE043F"><enum>(c)</enum><header>Priority of awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to qualified researchers who propose to carry out activities that will benefit historically underserved communities, including rural and inner-city urban communities and communities of English learners.</text></subsection></section><section id="id6104378C43D24ADDB12FEA98E6AC3DD7"><enum>107.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text><paragraph id="idAEB1CDD05E0C457B81AA3B1D9BB544D7"><enum>(1)</enum><text display-inline="yes-display-inline">for fiscal year 2022 and for each of the 5 succeeding fiscal years—</text><subparagraph id="HCFA4887C24F74CACB43D1B8F798F49E3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">$585,000,000 to carry out section 103;</text></subparagraph><subparagraph id="HFC7E7C74E38F41E497F0B0A0DBB4EF7F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">$200,000,000 to carry out section 104; and</text></subparagraph><subparagraph id="HECDE8825EDDA46C79CC184E3A35CC6B8" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">$50,000,000 to carry out section 106; and</text></subparagraph></paragraph><paragraph id="H978F65801F534245AE42F3A49772C9A8" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">$150,000,000 for fiscal year 2022 and for each of the 5 succeeding fiscal years to carry out—</text><subparagraph commented="no" id="id468A1CE17811448092421CE3B93490CF"><enum>(A)</enum><text display-inline="yes-display-inline">section 105; and</text></subparagraph><subparagraph commented="no" id="id104F1E0B3C0C407E818EF0EA298343F1"><enum>(B)</enum><text display-inline="yes-display-inline">section 805 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161e">20 U.S.C. 1161e</external-xref>).</text></subparagraph></paragraph></section></title><title id="id6B76BF2D2E004106A58A5639AB3C929C" style="OLC"><enum>II</enum><header>Amendments to other laws</header><section id="id27ec24c56f504b669593848edfdc8de4"><enum>201.</enum><header>Prince Hall Civics Fellowship Program</header><text display-inline="no-display-inline">The James Madison Memorial Fellowship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/4501">20 U.S.C. 4501</external-xref> et seq.) is amended—</text><paragraph id="id5E5A48FC6C604318BAD54A41412F3CE3"><enum>(1)</enum><text>in section 802, by inserting <quote>, and to establish the Prince Hall Civics Fellowship Program which is designed to diversify the civics and history education workforce</quote> after <quote>development</quote>;</text></paragraph><paragraph id="id5AD31C64AAAB477695B91D2CAFD99FBB"><enum>(2)</enum><text>in section 807—</text><subparagraph id="id069C46A7E3E04860AC57F585E57E3CB0"><enum>(A)</enum><text>by striking <quote>this title</quote> and inserting <quote>section 804</quote> each place the term appears; and</text></subparagraph><subparagraph id="id6FA1AE6165434F0FB7978A0629E26D7A"><enum>(B)</enum><text>by striking <quote>this Act</quote> and inserting <quote>section 804</quote> each place the term appears; and</text></subparagraph></paragraph><paragraph id="idC3C9FB3161824E0C86A80E313CF5A51A"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after section 810 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id97223A2CB2AE4102AB9E132CE4768250"><section id="idC26A5D7EF012406298BB1521F4ADDE69" commented="no"><enum>810A.</enum><header>Prince Hall Civics Fellowship Program</header><subsection id="ID87ac7017c475459780c71bc29b87e2c7" commented="no"><enum>(a)</enum><header>In general</header><text>Notwithstanding sections 804 through 810—</text><paragraph commented="no" id="idC6EE36C496A74821B83209FC51657D86"><enum>(1)</enum><text>the Foundation is authorized to award scholarships under an additional fellowship program to be administered by the James Madison Fellowship Program, which shall be known as the <quote>Prince Hall Civics Fellowship Program</quote>; and</text></paragraph><paragraph commented="no" id="id148A2839DFB849DC9B341F10BBF77CAC"><enum>(2)</enum><text> the terms and conditions under this section shall apply with respect to the Prince Hall Civics Fellowship Program.</text></paragraph></subsection><subsection commented="no" id="id82118EECFACE49CAA16A6AF8BDD78899"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Prince Hall Civics Fellowship Program is to diversify the civics and history education workforce. </text></subsection><subsection id="ID4496b88f1a0a472a9ab304524ade7362" commented="no"><enum>(c)</enum><header>Applications</header><text>In order to be eligible to receive a scholarship under the Prince Hall Civics Fellowship Program, an individual shall submit an application to the Foundation, containing an assurance that the applicant meets the following requirements: </text><paragraph id="ID2ea347a947dd42978b55a9a96288d53a" commented="no"><enum>(1)</enum><text>The applicant holds a valid teaching credential in the applicant's home State and a baccalaureate degree or higher degree in the subject of humanities, political science, government, or American history, or a dual degree in one of those subjects and education.</text></paragraph><paragraph id="IDcc806f63eed84962b2bdbd738e45f880" commented="no"><enum>(2)</enum><text>The applicant will commit to 5 years of teaching in kindergarten through grade 12 and will provide verification for each year of employment.</text></paragraph></subsection><subsection id="IDc982e913aa0246c0a72c8782940787fd" commented="no"><enum>(d)</enum><header>Selection</header><text>The Foundation shall, either directly or by contract, provide for the conduct of a nationwide competition for the purpose of selecting recipients of fellowships under the Prince Hall Civics Fellowship Program (referred to as <quote>fellows</quote>). The Foundation shall adopt selection procedures which shall assure that—</text><paragraph id="ID1c1a2618595546429807836cc2bafd3d" commented="no"><enum>(1)</enum><text>the number of recipients selected from each State is in proportion to each State’s share of funding under part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref> et seq.); and</text></paragraph><paragraph id="IDf606092ac02c4235abc70005e62f5adf" commented="no"><enum>(2)</enum><text>in selecting fellows, priority is given to individuals—</text><subparagraph id="id4F04442F1C1A442B866045377AA34ADC" commented="no"><enum>(A)</enum><text>who are teaching in communities to which the individual has ties at the time of the individual's application for the fellowship; or</text></subparagraph><subparagraph id="id7BBBCD145B624C769360291A4240E95E" commented="no"><enum>(B)</enum><text>are from populations underrepresented in the civics and history education workforce.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id694C1717D78A4C878648767C87BFED27"><enum>(e)</enum><header>Amount of fellowship</header><text>Each fellow shall receive a stipend of $5,000 for each year, not to exceed a total of 5 years, that the fellow is employed as a teacher in kindergarten through grade 12 and submits employment verification to the Foundation in the manner prescribed by the Foundation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H9B403488F54A4383AA7E1B8F626E4716"><enum>202.</enum><header>National Assessment of Educational Progress</header><text display-inline="no-display-inline">Section 303(b) of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9622">20 U.S.C. 9622(b)</external-xref>) is amended—</text><paragraph id="H2BFF7E9DBA1A402BBB06C262BDF6ECA3"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="HAB9D1A1993D14501B0A0D61FEE148123"><enum>(A)</enum><text>by redesignating subparagraphs (D) through (H) as subparagraphs (E) through (I) respectively;</text></subparagraph><subparagraph id="HAD36F6E9FA2B49999A8A363B5D77C55F"><enum>(B)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H23511A56CD3F47ECA4F26A11751F44E8"><subparagraph id="H6E7C9DFB814A40D79F9859E9F1001124"><enum>(D)</enum><text display-inline="yes-display-inline">conduct a national assessment, using a methodology sufficient to provide accurate, disaggregated, statistically significant State-level data on student proficiency for every State, on student academic achievement in public and private elementary schools and secondary schools at least once every 2 years, in grades 4, 8, and 12 in civics and history;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB68A67A3843F49188F1DEA89FD97751D"><enum>(C)</enum><text>in subparagraph (E), as so redesignated, by striking <quote>history, geography, civics</quote> and inserting <quote>geography</quote>; and</text></subparagraph></paragraph><paragraph id="HBD430C6C7864475583AFA1177AAFC05F"><enum>(2)</enum><text>in paragraph (3)(A)—</text><subparagraph id="HC45BBB766E534ED0B765F06FDA5E8DD5"><enum>(A)</enum><text>in clause (i), by striking <quote>(2)(E)</quote> and inserting <quote>(2)(F)</quote>;</text></subparagraph><subparagraph id="HB37A39CDCEE643F2840CC1A601EC9EB5"><enum>(B)</enum><text>by redesignating clauses (iii) and (iv) as clauses (iv) and (v), respectively;</text></subparagraph><subparagraph id="H3D60FF8A2EF748D8837AA41858DD0838"><enum>(C)</enum><text>by inserting after clause (ii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB0CFB9D5F5CE4B279089F47A86590B91"><clause id="H73E227A189514F20BE4ED3A1BDE2311D"><enum>(iii)</enum><text display-inline="yes-display-inline">shall conduct biennial State academic assessments of student achievement in civics and history in grades 4, 8, and 12, as described in paragraph (2)(D)</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAE877279728146258BC333BCF7CDB17D"><enum>(D)</enum><text>in clause (iv), as so redesignated, by striking <quote>(2)(D)</quote> and inserting <quote>(2)(E)</quote>.</text></subparagraph></paragraph></section><section id="id8C4C5EAAFB7A4174B762E3496396E934"><enum>203.</enum><header>USA Civics Act</header><text display-inline="no-display-inline">Section 805 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161e">20 U.S.C. 1161e</external-xref>) is amended—</text><paragraph id="id71931B7984D3416A9FC30D574C7F82F9"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">history for freedom</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">civics education program</header-in-text></quote>;</text></paragraph><paragraph id="id66ED6BE988CE4F8BB9F9379B85EE6A5C"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id181241DA3B1940B19D670109AD8BE874"><enum>(A)</enum><text>by striking <quote>subsection (f)</quote> and inserting <quote>subsection (g)</quote>;</text></subparagraph><subparagraph id="id0275DCEAE3AE4B9F8A135F7B6A0D299E"><enum>(B)</enum><text>by striking <quote>the Secretary is authorized to award three-year grants, on a competitive basis,</quote> and inserting <quote>the Secretary is authorized to award grants, once every 3 years and on a competitive basis,</quote>;</text></subparagraph><subparagraph id="id24DB69B4073C41E29BD82866BA4F6A5F"><enum>(C)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idB6E4376A407243A8BC0777934C5F588C" style="OLC"><paragraph id="id03DB4CD44D364498A97629EA2613D481"><enum>(1)</enum><text>American political thought and history;</text></paragraph><after-quoted-block>; or</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idD2BD2F78144C409B8D226FBEB229B2AE"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idF1FA9143ACA7499F9C6F2A2FFD5DAB80" style="OLC"><paragraph id="id398F6AFD06A94937B913262B261F6C75"><enum>(4)</enum><text>the means of participation in political and civic life.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idAA05246BE6A346A199A3EE9B92B45CAC"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="idFAD0A1B34C2C49D08BF7B25BDC6CD444"><enum>(A)</enum><text>in paragraph (1), by striking <quote>as defined in section 101.</quote> and inserting <quote>, or a partnership that includes an institution of higher education and one or more nonprofit organizations, whose missions and demonstrated expertise are consistent with the purpose of this section.</quote>;</text></subparagraph><subparagraph id="id6EA079EB89BA4443BB6C9321F391E9BE"><enum>(B)</enum><text>in paragraph (2), by striking <quote>that emerged</quote> and all that follows through the period at the end and inserting <quote>founded on the principles of representative democracy, constitutional government, individual rights, market economics, religious freedom and religious tolerance, and freedom of thought and inquiry.</quote>; and</text></subparagraph><subparagraph id="id43FDEEDAFE474F4CA483D640D634512B"><enum>(C)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id57712AB996454F40AFCA14B44EC06ADE" style="OLC"><paragraph id="id73371E53FE2E4DE696C4F0A700B392D9"><enum>(3)</enum><header>American political thought and history</header><text>The term <term>American political thought and history</term> means—</text><subparagraph id="IDA4FD13AF21EA4B868EFF7B233EE1A01C"><enum>(A)</enum><text>the significant constitutional, political, intellectual, economic, social, and foreign policy trends and issues that have shaped the course of American history; and</text></subparagraph><subparagraph id="IDD936F7841DCE405B8ADFC4EF61E99C5D"><enum>(B)</enum><text>the key episodes, turning points, texts, and figures involved in the constitutional, political, intellectual, diplomatic, social, and economic history of the United States.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id99C2223CC04042F08726F5E6CC0DB9EF"><enum>(4)</enum><text>in subsection (c)(2)—</text><subparagraph id="id8A31CEA2AA1A487F9CEC35A138648838"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>traditional</quote> and all that follows through the semicolon and inserting <quote>American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life;</quote>; and</text></subparagraph><subparagraph id="id480F4BAC113F43E3BCA05DE18C5CBE57"><enum>(B)</enum><text>in subparagraph (B), by inserting <quote>, which may include the creation or use of open educational resources</quote> after <quote>subsection (e)(1)(B)</quote>;</text></subparagraph></paragraph><paragraph id="idF498EA58DA5F4D41A901DCF9F6B2C3F2"><enum>(5)</enum><text>in subsection (d)—</text><subparagraph id="idB3F60FAD59FC40A1ACB80A8CB71E0F0C"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id3B5D7DB7477A49BEBED42A057DA9ACAE" style="OLC"><paragraph id="id14F856B37A6949DAB42EC137DC161378"><enum>(1)</enum><text>increase access to quality programming that expands knowledge of American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id15492C851E7A410680742266391A0241"><enum>(B)</enum><text>in paragraph (2), by striking <quote>traditional American history, free institutions, or Western civilization</quote> and inserting <quote>American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life.</quote>;</text></subparagraph></paragraph><paragraph id="id3DB4E43E99A844F49995491DBB593654"><enum>(6)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idD9A493B1D0CD484BA0F1BF128F6191C7" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ID187A6A41B3394A3284284F6E5100F17D"><enum>(e)</enum><header display-inline="yes-display-inline">Use of funds</header><paragraph commented="no" display-inline="no-display-inline" id="IDE0DBE7C5E47F431DB575AFD824082E9B"><enum>(1)</enum><header>Required use of funds</header><text>Funds provided under this section shall be used—</text><subparagraph display-inline="no-display-inline" commented="no" id="idF6F63A0EBCF24B70BF65BC06A67E3196"><enum>(A)</enum><text>for collaboration with local educational agencies for the purpose of providing elementary school and secondary school teachers an opportunity to enhance their knowledge of American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life; and</text></subparagraph><subparagraph id="ID9E5BDAFE4BB843A88DE9DD3537FDE3E8"><enum>(B)</enum><text>to carry out one or more of the following:</text><clause id="id6DA410E5E92A44378BE0F9DADC6AFD18"><enum>(i)</enum><text>Establishing or strengthening academic programs or centers focused on American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life, which may include—</text><subclause id="ID292A4FF4323149EE9F5E5CAD07818194"><enum>(I)</enum><text>design and implementation of programs of study, courses, lecture series, seminars, and symposia;</text></subclause><subclause id="IDFBE4C0635CAC42FC8D5F8E29B824CB04"><enum>(II)</enum><text>development, publication, and dissemination of instructional materials;</text></subclause><subclause id="ID8142A5B93EF4467D84F580F78DF7947F"><enum>(III)</enum><text>research;</text></subclause><subclause id="ID71EF5D7558164EEF9108366F31B4BE90"><enum>(IV)</enum><text>support for faculty teaching in undergraduate and, if applicable, graduate programs; or</text></subclause><subclause id="ID4D33F52BAC784420B212D8E2F1B355FD"><enum>(V)</enum><text>support for graduate and postgraduate fellowships, if applicable.</text></subclause></clause><clause id="IDCF57BEE0EA114F69BFFB58A907536E26"><enum>(ii)</enum><text>For teacher preparation initiatives that stress content mastery regarding American political thought and history, free institutions, the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life.</text></clause><clause id="ID3C0F4419EC2E475AAFCDDC4BF9FD351D"><enum>(iii)</enum><text>To conduct outreach activities to ensure that information about the activities funded under this section is widely disseminated—</text><subclause id="IDD0ECFF58BA43400EBF85AC1D3EAB221A"><enum>(I)</enum><text>to undergraduate students (including students enrolled in teacher education programs, if applicable);</text></subclause><subclause id="ID8420E0A8BCF141D98CBBEB774628A9FF"><enum>(II)</enum><text>to graduate students (including students enrolled in teacher education programs, if applicable);</text></subclause><subclause id="ID1A5175CA1236432A8863347E1A8063DD"><enum>(III)</enum><text>to faculty;</text></subclause><subclause id="ID22CED5560A3C444EBE3522D5A801F3FE"><enum>(IV)</enum><text>to local educational agencies; and</text></subclause><subclause id="ID4F208AC87B4C45E4811EC5CA692989E1"><enum>(V)</enum><text>within the local community.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAFABA8A5FE9B4FB4AB8394023ADFCABC"><enum>(2)</enum><header>Allowable uses of funds</header><text>Funds provided under this section may be used to support—</text><subparagraph id="ID8970EBC5D49F479F85CB1DEE437BBA9D"><enum>(A)</enum><text>collaboration with entities such as—</text><clause id="IDA1F9072C97DD41BCB4458A70E07441E1"><enum>(i)</enum><text>nonprofit organizations whose missions and demonstrated expertise are consistent with the purpose of this section, for assistance in carrying out activities described under subsection (a); and</text></clause><clause id="id57F5FCE103BB4F609090EE69D3E7BE32"><enum>(ii)</enum><text>Federal or State humanities programs, which may include those funded by the National Endowment for the Humanities;</text></clause></subparagraph><subparagraph id="ID90B356221F914EB3957464BB55038688"><enum>(B)</enum><text>the creation and use of open educational resources on American political thought and history, free institutions, or the impact of American representative democracy and constitutional democracies globally, or the means of participation in political and civic life; and</text></subparagraph><subparagraph id="id3A0D4E3D9E8D4609B4BEBBBD891D5274"><enum>(C)</enum><text>other activities that meet the purposes of this section.</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id71ABC92E0EA74D9397A25218EFD0348C"><enum>(7)</enum><text>by redesignating subsection (f) as subsection (g);</text></paragraph><paragraph id="id086E5E6350E34390AD2341FCA5F6EA0A"><enum>(8)</enum><text>in subsection (g), as redesignated by paragraph (7), by striking <quote>2009</quote> and inserting <quote>2022</quote>; and</text></paragraph><paragraph id="id136F16D1A7ED4F5286A07085CD108D79"><enum>(9)</enum><text>by inserting after subsection (e) the following:</text><quoted-block display-inline="no-display-inline" id="id28955275E00549E1B149BB1D8139ADA4" style="OLC"><subsection id="idDDBA0B42C3B54EA28F4291058C25AF0E"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to authorize the Secretary to prescribe an American political thought and history curriculum.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id321be835b82d472e91825a7892728022" commented="no"><enum>204.</enum><header>Sustaining the Truman Foundation</header><text display-inline="no-display-inline">Section 10(b) of <external-xref legal-doc="public-law" parsable-cite="pl/93/642">Public Law 93–642</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/20/2001">20 U.S.C. 2001</external-xref> et seq.) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8628e2bb94d4423990153d84b83ffa50"><subsection id="id60949c4e0cf245b183ddc3d4449cc61b" commented="no"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id1e918496dad849ab8270fcd8c9676fa3"><enum>(1)</enum><text>It shall be the duty of the Secretary of the Treasury to invest in full the amounts appropriated to the fund.</text></paragraph><paragraph id="id9607ab9d9e0941ac90fcd4b16b1d31aa" indent="up1" commented="no"><enum>(2)</enum><text>Investments of amounts appropriated to the fund shall be made in public debt securities of the United States with maturities suitable to the fund. For such purpose, such obligations may be acquired—</text><subparagraph id="id8847FF31FA28436FA0B3579C655365B3" commented="no"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph><subparagraph id="id531A2079A964481CB17657E460D69655" commented="no"><enum>(B)</enum><text>by purchase of outstanding obligations at the market price. </text></subparagraph></paragraph><paragraph commented="no" indent="up1" id="id074E52EAA39B418483B81F7997D78D8F"><enum>(3)</enum><text>The purposes for which obligations of the United States may be issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/31">chapter 31</external-xref> of title 31, United States Code, are hereby extended to authorize the issuance at par of special obligations exclusively to the fund. Such special obligations shall bear interest at a rate equal to the average rate of interest, computed as to the end of the calendar month next preceding the date of such issue, borne by all marketable interest-bearing obligations of the United States then forming a part of the public debt, except that where such average rate is not a multiple of <fraction>1/8</fraction> of 1 percent, the rate of interest of such special obligations shall be the multiple of <fraction>1⁄8</fraction> of 1 percent next lower than such average rate. Such special obligations shall be issued only if the Secretary determines that the purchases of other interest-bearing obligations of the United States, or of obligations guaranteed as to both principal and interest by the United States or original issue or at the market price, is not in the public interest.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8865CBD367F54F1E8AF7020E2CC99992"><enum>205.</enum><header>Sustaining the Madison Foundation</header><text display-inline="no-display-inline">Subsection (b) of section 811 of the James Madison Memorial Fellowship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/4510">20 U.S.C. 4510</external-xref>) is amended to read as follows:</text><quoted-block id="id4BFADFFD2F3648C9B1E0845317F4C77A" display-inline="no-display-inline" style="OLC"><subsection id="id0C90C30733FA4354A4081BB3737762AC"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id94DB9CF04E504CA4A1121D964A45C078"><enum>(1)</enum><text>It shall be the duty of the Secretary of the Treasury to invest in full the amounts appropriated to the fund.</text></paragraph><paragraph id="id74F052D4F45649FFA9F7D09CFA47734C" indent="up1"><enum>(2)</enum><text>Subject to paragraph (3), investments of amounts appropriated to the fund shall be made in public debt securities of the United States with maturities suitable to the fund. Such special obligations shall be issued only if the Secretary determines that the purchases of other interest-bearing obligations of the United States, or of obligations guaranteed as to both principal and interest by the United States or original issue or at the market price, is not in the public interest.</text></paragraph><paragraph id="idB3EA66510D124CD99186B207004E6F68" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6059DCCD1A9B495090CB31A05475473A"><enum>(A)</enum><text>Notwithstanding paragraph (2), upon receiving a determination of the Board described in subparagraph (B), the Secretary shall invest up to 40 percent of the fund’s assets in securities other than public debt securities of the United States, provided that the securities are traded in established United States markets.</text></subparagraph><subparagraph id="id44B4D474697A40B9B581684188D286EC" indent="up1"><enum>(B)</enum><text>A determination described in this subparagraph is a determination by the Board that investments as described in subparagraph (A) are necessary to enable the Foundation to carry out the purposes of this title without any diminution of the number of fellowships provided under section 804.</text></subparagraph><subparagraph id="id96E8576DC53E40C0BBD1E0F4FB5DF363" indent="up1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>Nothing in this paragraph shall be construed to limit the authority of the Board to increase the number of fellowships provided under section 804, or to increase the amount of the fellowship authorized by section 809, as the Board considers appropriate and is otherwise consistent with the requirements of this title.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD9CAE55C16F844BA81A3EB1AD7CFFEDD"><enum>206.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text><paragraph id="idAB55E78800D445508C5C993B277B8B2A"><enum>(1)</enum><text display-inline="yes-display-inline">for fiscal year 2022 and for each of the 5 succeeding fiscal years, $15,000,000 to carry out section 201;</text></paragraph><paragraph id="id910EEF1CB3814E888D91F219FD2A1985"><enum>(2)</enum><text>for fiscal year 2022, $300,000,000 for the Harry S. Truman Scholarship Foundation Trust Fund, established by section 10 of <external-xref legal-doc="public-law" parsable-cite="pl/93/642">Public Law 93–642</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/20/2009">20 U.S.C. 2009</external-xref>); and</text></paragraph><paragraph id="idd166fbe9d5034ad58615f9f55b06f001"><enum>(3)</enum><text>for fiscal year 2022, $20,000,000 for the James Madison Memorial Fellowship Trust Fund, established by section 811 of the James Madison Memorial Fellowship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/4510">20 U.S.C. 4510</external-xref>).</text></paragraph></section></title></legis-body></bill>
