which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make any city or county that has in effect any law or ordinance that is in violation of Federal immigration law ineligible for any Federal grant, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF61EEE21EA2D43179ABF8B0CE9F90766"><section section-type="section-one" id="H95C921ACE0BE4E069BC9EDDB8ABF0CA6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Sanctuary Cities Act of 2021</short-title></quote>.</text></section><section id="HCE088350E087429283B7C70E596C22FA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HFF18EE22AB65430FAE419038B934E28C"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>detainer</term> means any order or request by the Secretary of Homeland Security—</text><subparagraph id="H9E464853E3D346C4980B90A40530AAE2"><enum>(A)</enum><text>to temporarily hold an alien in custody until such alien may be taken into Federal custody;</text></subparagraph><subparagraph id="H5CF59C368AC94FF8974082EBE11F32E1"><enum>(B)</enum><text>to transport an alien for transfer to Federal custody; or</text></subparagraph><subparagraph id="H92ED7446A70F492398C3617A7DF142A7"><enum>(C)</enum><text>to notify the Secretary of Homeland Security before the release of an alien from State or local custody.</text></subparagraph></paragraph><paragraph id="H5870719527DB457DBD4903A02304C651"><enum>(2)</enum><text>The term <term>immigration laws</term> has the meaning given such term under section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="HB55850935CB24D268C8EBECEBFFAB90C" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>The term <term>unit of local government</term> has the meaning given such term under section 901(a)(3) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251(a)(3)</external-xref>). </text></paragraph></section><section section-type="subsequent-section" id="HACDF795FD405445481DD89D2DEDAB8C7"><enum>3.</enum><header>Ineligibility for Federal grants of certain jurisdictions that violate the immigration laws</header><subsection id="HE50FB3EB59B4472CADFA089391A9ABD4"><enum>(a)</enum><header>Ineligible jurisdictions</header><text display-inline="yes-display-inline">A State or unit of local government is an ineligible jurisdiction for purposes of this section if such State or unit of local government—</text><paragraph id="HD4F86B9F5C604BC99D7C8A47A528D4E0"><enum>(1)</enum><text>violates section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>);</text></paragraph><paragraph id="H1396D26CAB1544AEB35EEC13468326B5"><enum>(2)</enum><text>otherwise restricts compliance with a detainer issued by the Secretary of Homeland Security; or</text></paragraph><paragraph id="H8D9C1614FDB6476D861001D608F02349"><enum>(3)</enum><text>has any law or policy in effect that violates the immigration laws.</text></paragraph></subsection><subsection id="H1E579892240C4AB0A130239A918438CD"><enum>(b)</enum><header>Annual determination of ineligible jurisdictions</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall—</text><paragraph id="idBD6C3644860E4CBCAA18F891A5F880E6"><enum>(1)</enum><text>determine which States and units of local government are ineligible jurisdictions based on the criteria set forth in subsection (a); and </text></paragraph><paragraph id="id7EA9A9AB10B34DB0AA529E676D2052FA"><enum>(2)</enum><text>submit a list of such ineligible jurisdictions, including the specific criteria upon which each such determination was based, to Congress.</text></paragraph></subsection><subsection id="HF2E0664E410942D49601FBD8572AA705"><enum>(c)</enum><header>Prohibition on Federal financial assistance</header><text display-inline="yes-display-inline">A State or unit of local government may not receive any Federal financial assistance (as such term is defined in section 7501(a)(5) of title 31, United States Code) for the fiscal year following any fiscal year in which the Secretary of Homeland Security determines that such State or unit of local government is an ineligible jurisdiction under this section.</text></subsection></section><section id="H5AF7F2A094D84E4496B48EAD4F92CF40"><enum>4.</enum><header>Limitation on liability for compliance with detainer</header><text display-inline="no-display-inline">A State or unit of local government, and any law enforcement officer of such State or unit of local government, acting in compliance with a detainer issued by the Secretary of Homeland Security, shall be considered to be acting under color of Federal authority for purposes of determining liability, and immunity from suit, in any civil action brought by the alien under Federal or State law.</text></section><section commented="no" id="H62C002179B2C4E4EA0851480B49FC21A"><enum>5.</enum><header>Workplace protections for law enforcement</header><text display-inline="no-display-inline">Section 15(a) of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/215">29 U.S.C. 215(a)</external-xref>) is amended—</text><paragraph commented="no" id="HDDEF340F395141E3B7F4B19C4E7B2F63"><enum>(1)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph commented="no" id="H5DCDFD23B1844FC6B989D29798EAC39D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5F0227F2509644A7AAAC9221F19014B6"><paragraph commented="no" id="H7D4678CCB0F74BABA5EF4FA8F73BC08A"><enum>(6)</enum><text display-inline="yes-display-inline">in the case of a State or unit of local government, to discharge or in any other manner discriminate against any law enforcement officer of that State or unit of local government because such law enforcement officer has taken any action to comply with a detainer (as such term is defined in section 2 of the <short-title>Ending Sanctuary Cities Act of 2021</short-title>) issued by the Secretary of Homeland Security.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
