Evaluation by Comptroller General of the United States.</toc-entry></toc></subsection></section><section id="HAA5D0F67FF254EEDADC108297AF40768"><enum>2.</enum><header>Findings; statement of policy</header><subsection id="id61270758B4834E749179A10D21026D70"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph commented="no" id="H4D25EBAE48204AF8B76F9E8E20C8A854"><enum>(1)</enum><text display-inline="yes-display-inline">Communities of color, low-income communities, Tribal and Indigenous communities, fossil fuel-dependent communities, and other vulnerable populations, such as persons with disabilities, children, and the elderly, are disproportionately burdened by environmental hazards that include exposure to polluted air, waterways, and landscapes.</text></paragraph><paragraph commented="no" id="HE8D0E3FC843C4E74B5865BC135361C7A"><enum>(2)</enum><text display-inline="yes-display-inline">Environmental justice disparities are also exhibited through a lack of equitable access to green spaces, public recreation opportunities, and information and data on potential exposure to environmental hazards.</text></paragraph><paragraph commented="no" id="H7856D3CBB8534EBDA433CD9A2B2D50BD"><enum>(3)</enum><text display-inline="yes-display-inline">Communities experiencing environmental injustice have been subjected to systemic racial, social, and economic injustices and face a disproportionate burden of adverse human health or environmental effects, a higher risk of intentional, unconscious, and structural discrimination, and disproportionate energy burdens.</text></paragraph><paragraph commented="no" id="HCC10C3DF55FC47178F251F3CC30C6A06"><enum>(4)</enum><text display-inline="yes-display-inline">Environmental justice communities have been made more vulnerable to the effects of climate change due to a combination of factors, particularly the legacy of segregation and historically racist zoning codes, and often have the least resources to respond, making it a necessity for environmental justice communities to be meaningfully engaged as partners and stakeholders in government decision making as the United States builds its climate resilience.</text></paragraph><paragraph commented="no" id="H7D28519EE6054D188EFA9F51514DC289"><enum>(5)</enum><text display-inline="yes-display-inline">Potential environmental and climate threats to environmental justice communities merit a higher level of engagement, review, and consent to ensure that communities are not forced to bear disproportionate environmental and health impacts.</text></paragraph><paragraph commented="no" id="HF0504612106B4FFAA6163D62933E4B90"><enum>(6)</enum><text display-inline="yes-display-inline">The burden of proof that a proposed action will not harm communities, including through cumulative exposure effects, should fall on polluting industries and on the Federal Government in its regulatory role, not the communities themselves.</text></paragraph><paragraph commented="no" id="H32900AA58A7743BD9C2F3E3745FE0FFE"><enum>(7)</enum><text display-inline="yes-display-inline">Executive Order 12898 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to Federal actions to address environmental justice in minority populations and low-income populations) directs Federal agencies to address disproportionately high and adverse human health or environmental effects of its programs, but Federal agencies have been inconsistent in updating their strategic plans for environmental justice and reporting on their progress in enacting those plans.</text></paragraph><paragraph commented="no" id="H771BD8D911234009B8551A1810F99196"><enum>(8)</enum><text display-inline="yes-display-inline">Government action to correct environmental injustices is a moral imperative. Federal policy can and should improve public health and improve the overall well-being of all communities.</text></paragraph><paragraph commented="no" id="H42503A8314754FF08D1B6985C1A75382"><enum>(9)</enum><text display-inline="yes-display-inline">All people have the right to breathe clean air, drink clean water, live free of dangerous levels of toxic pollution, and share the benefits of a prosperous and vibrant pollution-free economy.</text></paragraph><paragraph commented="no" id="HBD723D0F0A16474F911A674625300F6D"><enum>(10)</enum><text display-inline="yes-display-inline">A fair and just transition to a pollution-free economy is necessary to ensure that workers and communities in deindustrialized areas have access to the resources and benefits of a sustainable future. That transition must also address the economic disparities experienced by residents living in areas contaminated by pollution or environmental degradation, including access to jobs, and members of those communities must be fully and meaningfully involved in transition planning processes.</text></paragraph><paragraph id="HEA788CE81B034F91A13FDC4CD2792BDD" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">It is the responsibility of the Federal Government to seek to achieve environmental justice, health equity, and climate justice for all communities. </text></paragraph></subsection><subsection id="id45A8FAC42AB644E2B2799888B150E51B"><enum>(b)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of Congress that each Federal agency should—</text><paragraph id="H7A2291616E5F4B3A9A3A53F162463A52"><enum>(1)</enum><text display-inline="yes-display-inline">seek to achieve environmental justice as part of its mission by identifying and addressing, as appropriate, disproportionately adverse human health or environmental effects of its programs, policies, practices, and activities on communities of color, low-income communities, and Tribal and Indigenous communities in each State and territory of the United States;</text></paragraph><paragraph id="H5B3481EC7F09435D8C0367C0E6154527"><enum>(2)</enum><text display-inline="yes-display-inline">promote meaningful involvement by communities and due process in the development, implementation, and enforcement of environmental laws;</text></paragraph><paragraph commented="no" id="H44EEB062CEA642ECB360EDAA07E8C450"><enum>(3)</enum><text display-inline="yes-display-inline">provide direct guidance and technical assistance to communities experiencing environmental injustice focused on increasing shared understanding of the science, laws, regulations, and policy related to Federal agency action on environmental justice issues; </text></paragraph><paragraph commented="no" id="H4273EA63E1F946F084D170E86F66B561"><enum>(4)</enum><text display-inline="yes-display-inline">cooperate with State governments, Tribal Governments, and local governments to address pollution and public health burdens in communities experiencing environmental injustice, and build healthy, sustainable, and resilient communities; and</text></paragraph><paragraph commented="no" id="HF99153B293C946009A12B568853CC1D6"><enum>(5)</enum><text display-inline="yes-display-inline">recognize the right of all people to clean air, safe and affordable drinking water, protection from climate hazards, and the sustainable preservation of the ecological integrity and aesthetic, scientific, cultural, and historical values of the natural environment.</text></paragraph></subsection></section><section id="HCCB7C4B6D5564E82A275A858DDA5D234"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H93F70D3FE66D4F2192251C9EB65D570B"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H4DD9588808F5483A875CE840D1F95515"><enum>(2)</enum><header>Advisory council</header><text>The term <term>Advisory Council</term> means the National Environmental Justice Advisory Council established by the President under section 18.</text></paragraph><paragraph id="H1EEFA23FAC1046379D049FC75C42FAE6"><enum>(3)</enum><header>Clearinghouse</header><text>The term <term>Clearinghouse</term> means the Environmental Justice Clearinghouse established by the Administrator under section 19.</text></paragraph><paragraph id="H671B67EF55D44E1C9E2E1EE41C95778F"><enum>(4)</enum><header>Community of color</header><text display-inline="yes-display-inline">The term <term>community of color</term> means a geographically distinct area in which the population of any of the following categories of individuals is higher than the average population of that category for the State in which the community is located:</text><subparagraph id="H98D56F6318144BD5BABF34CA8CD48336"><enum>(A)</enum><text display-inline="yes-display-inline">Black.</text></subparagraph><subparagraph id="H16B1DD5C78FC4E47A18C436B09C2AE85"><enum>(B)</enum><text>African American.</text></subparagraph><subparagraph id="HC0F4C4F5A4EA4077894F2D014FE013EB"><enum>(C)</enum><text>Asian.</text></subparagraph><subparagraph id="H1A1DFECF798147DB930E1FB3719C5742"><enum>(D)</enum><text>Pacific Islander.</text></subparagraph><subparagraph id="HCDF5E07647434C7A98A85C1A36A0D619"><enum>(E)</enum><text>Other non-White race.</text></subparagraph><subparagraph id="H828C59D3441A4F199C8038AE58B93F0C"><enum>(F)</enum><text>Hispanic.</text></subparagraph><subparagraph id="HC0610E64D2F94668ABF97B7617570167"><enum>(G)</enum><text>Latino.</text></subparagraph><subparagraph id="HFADF44BC19D54D90B5E9879C54BF8D82"><enum>(H)</enum><text>Linguistically isolated.</text></subparagraph></paragraph><paragraph id="HAB364D6BF0914491ACB4D958B752C51C"><enum>(5)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institute of Environmental Health Sciences.</text></paragraph><paragraph commented="no" id="H6DABAF9B7A3745D2BB5BF9EB819D37AA"><enum>(6)</enum><header>Disparate impact</header><text>The term <term>disparate impact</term> means an action or practice that, even if appearing neutral, actually has the effect of subjecting persons to discrimination on the basis of race, color, or national origin.</text></paragraph><paragraph commented="no" id="HB933BCD4DAB04ABD98A21848F6BC1050"><enum>(7)</enum><header>Disproportionate burden of adverse human health or environmental effects</header><text display-inline="yes-display-inline">The term <term>disproportionate burden of adverse human health or environmental effects</term> means a situation where there exists higher or more adverse human health or environmental effects on communities of color, low-income communities, and Tribal and Indigenous communities.</text></paragraph><paragraph id="H4882CBA875764EB4B0EF735A8140A0A6"><enum>(8)</enum><header>Environmental justice</header><text>The term <term>environmental justice</term> means the fair treatment and meaningful involvement of all people regardless of race, color, culture, national origin, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies to ensure that each person enjoys—</text><subparagraph id="H7C4A707810554E598DC513C842B8957A"><enum>(A)</enum><text>the same degree of protection from environmental and health hazards; and</text></subparagraph><subparagraph id="HAB9A855B6C8540E7B9F5BD53AAE766E6"><enum>(B)</enum><text>equal access to any Federal agency action on environmental justice issues in order to have a healthy environment in which to live, learn, work, and recreate.</text></subparagraph></paragraph><paragraph commented="no" id="H63B99A80348F4E0796A3350554B03A25"><enum>(9)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and Indigenous communities, that experiences, or is at risk of experiencing higher or more adverse human health or environmental effects.</text></paragraph><paragraph commented="no" id="HA53B02E732FA432FA726CC6F482EEDFB"><enum>(10)</enum><header>Environmental law</header><text display-inline="yes-display-inline">The term <term>environmental law</term> includes—</text><subparagraph commented="no" id="idC62A2F505E504F44B4FAE2DD0960C195"><enum>(A)</enum><text display-inline="yes-display-inline">the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.); </text></subparagraph><subparagraph commented="no" id="idAFE24C3505F44915A169E6DCD853E0BA"><enum>(B)</enum><text display-inline="yes-display-inline">the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.); </text></subparagraph><subparagraph commented="no" id="idAF677EC8B9FE4EBC8BBB3F3DC6A2F464"><enum>(C)</enum><text display-inline="yes-display-inline">the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref> et seq.); </text></subparagraph><subparagraph commented="no" id="idEBC32BBEC7054631A16D7C08514F89E2"><enum>(D)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text></subparagraph><subparagraph commented="no" id="id66EC25C9EEA843CD924FDBFF08310462"><enum>(E)</enum><text display-inline="yes-display-inline">the Pollution Prevention Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13101">42 U.S.C. 13101</external-xref> et seq.); </text></subparagraph><subparagraph commented="no" id="idA1AC2CB70AEC40E1AADB3D5A1EB38632"><enum>(F)</enum><text display-inline="yes-display-inline">the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.); </text></subparagraph><subparagraph commented="no" id="id9AA4989EB4244C108F8E3819222BE230"><enum>(G)</enum><text display-inline="yes-display-inline">the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref> et seq.);</text></subparagraph><subparagraph commented="no" id="id960EC480AC7640C286BB94DCB34900E8"><enum>(H)</enum><text display-inline="yes-display-inline">the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref> et seq.); and </text></subparagraph><subparagraph commented="no" id="idC027A5FD309F4594B5CB8467FA1E61D4"><enum>(I)</enum><text display-inline="yes-display-inline">the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="H9193E97CD2E0476BB3CA56C8D25B9FE1"><enum>(11)</enum><header>Fair treatment</header><text display-inline="yes-display-inline">The term <term>fair treatment</term> means the conduct of a program, policy, practice, or activity by a Federal agency in a manner that ensures that no group of individuals (including racial, ethnic, or socioeconomic groups) experience a disproportionate burden of adverse human health or environmental effects resulting from such program, policy, practice, or activity, as determined through consultation with, and with the meaningful participation of, individuals from the communities affected by a program, policy, practice, or activity of a Federal agency.</text></paragraph><paragraph commented="no" id="H4FBB443638D24914B736544302D48CDE"><enum>(12)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H0B73DDF3CFB34BA4B27E09821CC37378"><enum>(13)</enum><header>Local government</header><text>The term <term>local government</term> means—</text><subparagraph id="HF6F926C3FC6B4CEA96C447752F650B95"><enum>(A)</enum><text>a county, municipality, city, town, township, local public authority, school district, special district, intrastate district, council of governments (regardless of whether the council of governments is incorporated as a nonprofit corporation under State law), regional or interstate governmental entity, or agency or instrumentality of a local government; or</text></subparagraph><subparagraph id="H17328BF749DC407FA0740CB2FEA2129C"><enum>(B)</enum><text>an Indian Tribe or authorized Tribal organization, or Alaska Native village or organization, that is not a Tribal Government.</text></subparagraph></paragraph><paragraph id="H7747C28609104CD89ACE882E0E808910"><enum>(14)</enum><header>Low-income community</header><text display-inline="yes-display-inline">The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with an annual household income equal to, or less than, the greater of—</text><subparagraph id="H28C93472AB8B4380A76DFF17AB5727B2"><enum>(A)</enum><text display-inline="yes-display-inline">an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="H08C3D39686D04822B0A5938BB169B12D"><enum>(B)</enum><text display-inline="yes-display-inline">200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="HAF442EF7A64B4725BF56BE04A2F4936A"><enum>(15)</enum><header>Population</header><text display-inline="yes-display-inline">The term <term>population</term> means a census block group or series of geographically contiguous blocks representing certain common characteristics, such as race, ethnicity, national origin, income level, health disparities, or other public health and socioeconomic attributes.</text></paragraph><paragraph id="HDF703BAD3DEF401A887C2C94BAA88FB5"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="idD975FA8A7A8040AD927D233AA8D573CE"><enum>(A)</enum><text>any State of the United States;</text></subparagraph><subparagraph id="id7500DA7B85104ABEB065E36B4AB12CB7"><enum>(B)</enum><text>the id="idEEBCA7CB1AD24A99A04B84B31F929DA4"><enum>(D)</enum><text>the United States Virgin Islands;</text></subparagraph><subparagraph id="id6C0A45496E774D2590714590E1CBBE39"><enum>(E)</enum><text>Guam;</text></subparagraph><subparagraph id="id6DF461EC9649494399D56A09E95E1B17"><enum>(F)</enum><text>American Samoa; and </text></subparagraph><subparagraph id="id29DB73CB53A54F60B5D26E2BFE7A9AC6"><enum>(G)</enum><text>the Commonwealth of the Northern Mariana Islands.</text></subparagraph></paragraph><paragraph id="H22D3030CEA2349B6B7F690FC24DB5471"><enum>(17)</enum><header>Tribal and Indigenous community</header><text>The term <term>Tribal and Indigenous community</term> means a population of people who are members of—</text><subparagraph id="H389736E939AD43A08A57F3DF506CC506"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph id="HBAC8C68480404276B2A9FD0635B78E43"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph id="H82EDB8DE1BC04D9ABA1E0AE26DCA6B75"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; or</text></subparagraph><subparagraph id="HD3612F8D030446689A1F053EE0869B12"><enum>(D)</enum><text display-inline="yes-display-inline">any other community of Indigenous people located in a State.</text></subparagraph></paragraph><paragraph commented="no" id="H5206BEB523C5442B9EB4BB7C3E2B05B7"><enum>(18)</enum><header>Tribal Government</header><text>The term <term>Tribal Government</term> means the governing body of an Indian Tribe.</text></paragraph><paragraph id="H570A7AFFC94D41BC98955995FD3D2533" commented="no"><enum>(19)</enum><header>White House interagency council</header><text>The term <term>White House interagency council</term> means the White House Environmental Justice Interagency Council described in section 8.</text></paragraph></section><section id="H1FD0D37EAD70432FA69EDEBAB79E2A67"><enum>4.</enum><header>Prohibited discrimination</header><text display-inline="no-display-inline">Section 601 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref>) is amended—</text><paragraph id="HF3FFA2E656A6465891BAF148B3DAEBFD"><enum>(1)</enum><text>by striking <quote>No</quote> and inserting <quote>(a) No</quote>; and</text></paragraph><paragraph id="H14C9CEB024804A1992020B172C5F6C0C"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H391FD9F0700845ACBC103DC79B71C87C" display-inline="no-display-inline" style="OLC"><subsection id="HBD22AAE8F04D4E12A313FF7D771A633D"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4CF74C8BF19444009C3A16BA4B07E057"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H20B5E46FA9F444119CF3EB2F3BD70BE9"><enum>(A)</enum><text>Discrimination (including exclusion from participation and denial of benefits) based on disparate impact is established under this title if—</text><clause id="H4CD60C8D1B6C4976A12D4FC6EAE0D5F0" indent="up2"><enum>(i)</enum><text>an entity subject to this title (referred to in this subsection as a <term>covered entity</term>) has a program, policy, practice, or activity that causes a disparate impact on the basis of race, color, or national origin and the covered entity fails to demonstrate that the challenged program, policy, practice, or activity is related to and necessary to achieve the nondiscriminatory goal of the program, policy, practice, or activity alleged to have been operated in a discriminatory manner; or</text></clause><clause id="H5489AFC88BDC423A931F253D1260047C" indent="up2"><enum>(ii)</enum><text>a less discriminatory alternative program, policy, practice, or activity exists, and the covered entity refuses to adopt such alternative program, policy, practice, or activity.</text></clause></subparagraph><subparagraph id="H32DDE2F98F3E46E4965214EF3DDCE048" indent="up2"><enum>(B)</enum><text>With respect to demonstrating that a particular program, policy, practice, or activity does not cause a disparate impact, the covered entity shall demonstrate that each particular challenged program, policy, practice, or activity does not cause a disparate impact, except that if the covered entity demonstrates to the courts that the elements of the covered entity’s decision-making process are not capable of separation for analysis, the decision-making process may be analyzed as 1 program, policy, practice, or activity.</text></subparagraph></paragraph><paragraph id="H4F63CE68584847E5B77E69EE16285AD9" indent="up1"><enum>(2)</enum><text>A demonstration that a program, policy, practice, or activity is necessary to achieve the goals of a program, policy, practice, or activity may not be used as a defense against a claim of intentional discrimination under this title.</text></paragraph><paragraph indent="up1" id="idB4773792C2C341019185A9EB334F70DD"><enum>(3)</enum><text>In this subsection—</text><subparagraph id="id246278A5817F487980FD560708D2B877"><enum>(A)</enum><text>the term <term>demonstrates</term> means to meet the burdens of going forward with the evidence and of persuasion; and</text></subparagraph><subparagraph id="idAE4BF8CA8D3947D5B95FE011FD1B7805"><enum>(B)</enum><text>the term <term>disparate impact</term> has the meaning given the term in section 3 of the <short-title>Environmental Justice For All Act</short-title>.</text></subparagraph></paragraph></subsection><subsection id="H49FE6EC4CB6240ADBD8F242027584E4D" commented="no" display-inline="no-display-inline"><enum>(c)</enum><text display-inline="yes-display-inline">No person in the United States shall be subjected to discrimination, including retaliation or intimidation, because such person opposed any program, policy, practice, or activity prohibited by this title, or because such person made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7C1655A4D5044A9A90FB64AAE5C72130" commented="no"><enum>5.</enum><header>Right of action</header><subsection id="H56F719B5095240518807913ABABA7542" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 602 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref>) is amended—</text><paragraph id="HD0E18961D395484A88BB980AA64B5477" commented="no"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Each Federal department and agency which is empowered</quote>; and</text></paragraph><paragraph id="H5C7BA8544F6049399773DB367A5E939F" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HDB4ED435299B49AEBA12736F6A24E280" style="OLC"><subsection id="H22DFCEDF3CE64806A63AC5C96942CF14" commented="no"><enum>(b)</enum><text>Any person aggrieved by the failure to comply with this title, including any regulation promulgated pursuant to this title, may file suit in any district court of the United States having jurisdiction of the parties, without respect to the amount in controversy and without regard to the citizenship of the parties.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H19E39010BDA0406184A9AE2AFA5C26CE" commented="no"><enum>(b)</enum><header>Effective date</header><paragraph id="HFECF62516C4A4F98A514A1096B19A0C8" commented="no"><enum>(1)</enum><header>In general</header><text>This section, including the amendments made by this section, takes effect on the date of enactment of this Act.</text></paragraph><paragraph id="H4F3BB30EBBC94248AAA9FB99934DD177" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Application</header><text>This section, including the amendments made by this section, applies to all actions or proceedings pending on or after the date of enactment of this Act.</text></paragraph></subsection></section><section id="H2B56A2CDF0A04BC8A4F62A7DD30A9385"><enum>6.</enum><header>Rights of recovery</header><text display-inline="no-display-inline">Title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref> et seq.) is amended by inserting after section 602 the following:</text><quoted-block id="H9E50A0C74FC743E8A072D7B1D07A14FE" display-inline="no-display-inline" style="OLC"><section id="H6B7BFC95BF6142529D86FECAC37DD4C7"><enum>602A.</enum><header>Actions brought by aggrieved persons</header><subsection id="H07E4805FF8AE4245A6308CC4E50BABA2"><enum>(a)</enum><header>Claims based on proof of intentional discrimination</header><text>In an action brought by an aggrieved person under this title against an entity subject to this title (referred to in this section as a <term>covered entity</term>) who has engaged in unlawful intentional discrimination (not a practice that is unlawful because of its disparate impact) prohibited under this title (including its implementing regulations), the aggrieved person may recover equitable and legal relief (including compensatory and punitive damages), attorney’s fees (including expert fees), and costs of the action, except that punitive damages are not available against a government, government agency, or political subdivision.</text></subsection><subsection id="H00A8F6943FD741ECBC1938061DB5CFD9" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Claims based on the disparate impact standard of proof</header><text>In an action brought by an aggrieved person under this title against a covered entity who has engaged in unlawful discrimination based on disparate impact prohibited under this title (including implementing regulations), the aggrieved person may recover attorney’s fees (including expert fees), and costs of the action.</text></subsection><subsection id="H2E731411CB0A4371811156F8EA5CEDDB" commented="no"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="id047B46030B59413A832534958FA59399"><enum>(1)</enum><header>Aggrieved person</header><text display-inline="yes-display-inline">The term <term>aggrieved person</term> means a person aggrieved by discrimination on the basis of race, color, or national origin.</text></paragraph><paragraph commented="no" id="id0D49193AA0A745C59B235879F3C4AC2E"><enum>(2)</enum><header>Disparate impact</header><text display-inline="yes-display-inline">The term <term>disparate impact</term> has the meaning given the term in section 3 of the <short-title>Environmental Justice For All Act</short-title>.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id48796c1a60fd403595b904da605541e3"><enum>7.</enum><header>Consideration of cumulative impacts and persistent violations in certain permitting decisions</header><subsection id="idaddc58af68f146f09ff6564bcf1ce8d4"><enum>(a)</enum><header>Federal water pollution control act</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended—</text><paragraph id="id33d1f220d79a4e55aa29bce3c00ed82d"><enum>(1)</enum><text>by striking the section designation and heading and all that follows through <quote>Except as</quote> in subsection (a)(1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77739b714e1645c8a3fabd73021c9ac3"><section id="idb09143af68414ddead37e3c25f15da08"><enum>402.</enum><header>National pollutant discharge elimination system</header><subsection id="id4d7c9f11c4bf479cb60ac1a39ccaf402"><enum>(a)</enum><header>Permits issued by administrator</header><paragraph id="id2a51d30ecc3845ef8ea822e47280e86e"><enum>(1)</enum><header>In general</header><text>Except as</text></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idf85f536feee3478685eb960802e6da98"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id342ca7b2675e41a9a81379e651d0ca8e"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id7ab616a7240043478bac603d8990e5c8"><enum>(i)</enum><text>by striking <quote>upon condition that such discharge will meet either (A) all</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="idbd16b8f6212447b5be2925c8c18b05ad"><text>subject to the conditions that—</text><subparagraph id="idb5cdf7ba1143474bba5f700bef879bca"><enum>(A)</enum><text>the discharge will achieve compliance with, as applicable—</text><clause id="ideccb3bd46b3549669113ee8909d00bdd"><enum>(i)</enum><text>all</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id7c0707ecbb8b415bbe85b54bbcf69b05"><enum>(ii)</enum><text>by striking <quote>403 of this Act, or (B) prior</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id7abaf50aa2d147369b02191ad1f41ca4"><text>403; or</text><clause id="ide8df436bd9e347ae91fc3beea3a83bf4"><enum>(ii)</enum><text>prior</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id4e9a96b5d8a84022b5e6366f0e534b3c"><enum>(iii)</enum><text>by striking <quote>this Act.</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id670ccfb5885342aea4030d42aed2309a"><text>this Act; and</text><subparagraph id="id525594cbd5fe49cca7642d96c49916fb"><enum>(B)</enum><text>with respect to the issuance or renewal of the permit—</text><clause id="id292de796703847ca92c8d553b3692185"><enum>(i)</enum><text>based on an analysis by the Administrator of existing water quality and the potential cumulative impacts (as defined in section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>)) of the discharge, considered in conjunction with the designated and actual uses of the impacted navigable water, there exists a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation; or</text></clause><clause id="id413fb023442a46489587a5e153f7296d"><enum>(ii)</enum><text>if the Administrator determines that, due to those potential cumulative impacts, there does not exist a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, the permit or renewal includes such terms and conditions as the Administrator determines to be necessary to ensure a reasonable certainty of no harm.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id90e562ea14aa42778d9f398ef45278f8"><enum>(B)</enum><text>in paragraph (2), by striking <quote>assure compliance with the requirements of paragraph (1) of this subsection, including conditions on data and information collection, reporting, and such other requirements as he deems appropriate.</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="idf4efa0654216408a8fbebb115841bc92"><text>ensure compliance with the requirements of paragraph (1), including—</text><subparagraph id="idd32938cfd77444fb915b1e2625226d54"><enum>(A)</enum><text>conditions relating to—</text><clause id="id779e78a4eb1c44d0b312a089697c8b7a"><enum>(i)</enum><text>data and information collection;</text></clause><clause id="idcef2d9fdba4947168720f285b30ca8b3"><enum>(ii)</enum><text>reporting; and</text></clause><clause id="ida77728d19412415681bfd3a82bad8dc1"><enum>(iii)</enum><text>such other requirements as the Administrator determines to be appropriate; and</text></clause></subparagraph><subparagraph id="id413377e810e348cd9118e8addd7db25b"><enum>(B)</enum><text>additional controls or pollution prevention requirements.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id76151decdd6a46ab98b94dc2c5ab6658"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="id9792affa8def4956beefd983788897a2"><enum>(A)</enum><text>in each of paragraphs (1)(D), (2)(B), and (3) through (7), by striking the semicolon at the end and inserting a period;</text></subparagraph><subparagraph id="id9372c3dc178b451dafa2fa3a2eaaddb2"><enum>(B)</enum><text>in paragraph (8), by striking <quote>; and</quote> at the end and inserting a period; and</text></subparagraph><subparagraph id="idd7e87c1d47af46da9d97e8221fad6403"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id34623a8619b6466791be36597971ec87"><paragraph id="id21cf4d4ac29542bb86c968503043d158"><enum>(10)</enum><text>To ensure that no permit will be issued or renewed if, with respect to an application for the permit, the State determines, based on an analysis by the State of existing water quality and the potential cumulative impacts (as defined in section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>)) of the discharge, considered in conjunction with the designated and actual uses of the impacted navigable water, that the terms and conditions of the permit or renewal would not be sufficient to ensure a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id1415dafc82564d1ab79652f3f009a9dc"><enum>(b)</enum><header>Clean air act</header><paragraph id="id65e66f2f5dfd4181abebcf38c0c564ff"><enum>(1)</enum><header>Definitions</header><text>Section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>) is amended—</text><subparagraph id="id1525eee5bee04e75900bf11e8a4ff446"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>As used in this title—</quote> and inserting <quote>In this title:</quote>;</text></subparagraph><subparagraph id="idf81390d100c24db6bb2ae7c1f1e5565e"><enum>(B)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (5), and (4), respectively, and moving the paragraphs so as to appear in numerical order; and</text></subparagraph><subparagraph id="id60d137a342254e689be4545cea5536eb"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2a520e10bd7d4c109598f5262a068310"><paragraph id="id90240987874f4224a2b7110a848d5786"><enum>(2)</enum><header>Cumulative impacts</header><text>The term <term>cumulative impacts</term> means any exposure to a public health or environmental risk, or other effect occurring in a specific geographical area, including from an emission, discharge, or release—</text><subparagraph id="idab090c4660614afb97756992f5c9c861"><enum>(A)</enum><text>including—</text><clause id="iddc73446921a14aaba30855433a180bf6"><enum>(i)</enum><text>environmental pollution released—</text><subclause id="id3d63c8cc0a734ac3b638659e9a39bb84"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id1d1c76f99d904c77b31288b2c6d07b53"><enum>(aa)</enum><text>routinely;</text></item><item id="id85c5c1d6764d40a7a78219dab9f59cd7" indent="up1"><enum>(bb)</enum><text>accidentally; or</text></item><item id="id820c0b648fad4b859c47717feb267a2a" indent="up1"><enum>(cc)</enum><text>otherwise; and</text></item></subclause><subclause id="idc24612aa0e594a0ba20bbe7f2279a7d4"><enum>(II)</enum><text>from any source, whether single or multiple; and</text></subclause></clause><clause id="id12640184d55e41f6b18b6e92f48b80a6"><enum>(ii)</enum><text>as assessed based on the combined past, present, and reasonably foreseeable emissions and discharges affecting the geographical area; and</text></clause></subparagraph><subparagraph id="id0682350517b7494e84691c4828cbece5"><enum>(B)</enum><text>evaluated taking into account sensitive populations and other factors that may heighten vulnerability to environmental pollution and associated health risks, including socioeconomic characteristics.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idab723024c61e404a8e0fb5798c70f0be"><enum>(2)</enum><header>Permit programs</header><text>Section 502(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661a">42 U.S.C. 7661a(b)</external-xref>) is amended—</text><subparagraph id="idd0c7b0288df9442e969ebb8195300327"><enum>(A)</enum><text>in paragraph (5)—</text><clause id="id51436d70567340b0b77c929e8148f5a2"><enum>(i)</enum><text>in subparagraphs (A) and (C), by striking <quote>assure</quote> each place it appears and inserting <quote>ensure</quote>; and</text></clause><clause id="id4d5ebdaf020d4d4a921ebf12333fe1b7"><enum>(ii)</enum><text>by striking subparagraph (F) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id29bbb3ed4a55481bbd1ab0300d731f86"><subparagraph id="id9b210f15d78748bb82f13efd86da3ad2"><enum>(F)</enum><text>ensure that no permit will be issued or renewed, as applicable, if—</text><clause id="id1d15d03e0e9c4bf6a64dca2146c2df15"><enum>(i)</enum><text>with respect to an application for a permit or renewal of a permit for a major source, the permitting authority determines under paragraph (9)(A)(i)(II)(bb) that the terms and conditions of the permit or renewal would not be sufficient to ensure a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, of the applicable census block groups or Tribal census block groups (as those terms are defined by the Director of the Bureau of the Census); or</text></clause><clause id="id0bea5f5a811545c3be1731b9b5d4dc75"><enum>(ii)</enum><text>the Administrator objects to the issuance of the permit in a timely manner under this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idfcf8a5837daf419fab31e628d56fdb7a"><enum>(B)</enum><text>by striking paragraph (9) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc57fa33e38104754bd825c3f732e504b"><paragraph id="id2ebdd05909f14d4f9c4c133c090484ae"><enum>(9)</enum><header>Major sources</header><subparagraph id="id2360e88687044e53a13ca22469b6ea6d"><enum>(A)</enum><header>In general</header><text>With respect to any permit or renewal of a permit, as applicable, for a major source, a requirement that the permitting authority shall—</text><clause id="idf50f7495d02e4c0f942d17d223893add"><enum>(i)</enum><text>in determining whether to issue or renew the permit—</text><subclause id="id086004fa9f8541cb97048d02a8ab7b11"><enum>(I)</enum><text>evaluate the potential cumulative impacts of the major source, as described in the applicable cumulative impacts analysis submitted under section 503(b)(3), taking into consideration other pollution sources and risk factors within a community;</text></subclause><subclause id="idb63ed824dc0e4010bce657573f63b459"><enum>(II)</enum><text>if, due to those potential cumulative impacts, the permitting authority cannot determine that there exists a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, of any census block groups or Tribal census block groups (as those terms are defined by the Director of the Bureau of the Census) located in, or immediately adjacent to, the area in which the major source is, or is proposed to be, located—</text><item id="id838f764ca26f49d7845262755632099a"><enum>(aa)</enum><text>include in the permit or renewal such standards and requirements (including additional controls or pollution prevention requirements) as the permitting authority determines to be necessary to ensure a reasonable certainty of no such harm; or</text></item><item id="idd4c352aba944465b8d8e7f5e3111e235"><enum>(bb)</enum><text>if the permitting authority determines that standards and requirements described in item (aa) would not be sufficient to ensure a reasonable certainty of no such harm, deny the issuance or renewal of the permit;</text></item></subclause><subclause id="id045604a2f58e41ec95e6b95b600139be"><enum>(III)</enum><text>determine whether the applicant is a persistent violator, based on such criteria relating to the history of compliance by an applicant with this Act as the Administrator shall establish by not later than 180 days after the date of enactment of the Environmental Justice for All Act;</text></subclause><subclause id="id34b04cae377447ee976893f3bed97b21"><enum>(IV)</enum><text>if the permitting authority determines under subclause (III) that the applicant is a persistent violator and the permitting authority does not deny the issuance or renewal of the permit pursuant to subclause (II)(bb)—</text><item id="ida26d726368284055b8fe54247076d04f"><enum>(aa)</enum><text>require the applicant to submit a plan that describes—</text><subitem id="id104a20b348fc408f822f0b044cf9093d"><enum>(AA)</enum><text>if the applicant is not in compliance with this Act, measures the applicant will carry out to achieve that compliance, together with an approximate deadline for that achievement;</text></subitem><subitem id="id931704b5dd8c4dae8b580def62cf1850"><enum>(BB)</enum><text>measures the applicant will carry out, or has carried out to ensure the applicant will remain in compliance with this Act, and to mitigate the environmental and health effects of noncompliance; and</text></subitem><subitem id="id494a452e773d4f15affed1197693b337"><enum>(CC)</enum><text>the measures the applicant has carried out in preparing the plan to consult or negotiate with the communities affected by each persistent violation addressed in the plan; and</text></subitem></item><item id="iddd5768f6acb846a2a740a110c67c5a48"><enum>(bb)</enum><text>once such a plan is submitted, determine whether the plan is adequate to ensuring that the applicant—</text><subitem id="id9733bc2c84f4430c9c69cadb863c5436"><enum>(AA)</enum><text>will achieve compliance with this Act expeditiously;</text></subitem><subitem id="id8e23d7d30bc4481a8789c6baf59ba90f"><enum>(BB)</enum><text>will remain in compliance with this Act;</text></subitem><subitem id="id23d801ea17564e6185234318dbec25c5"><enum>(CC)</enum><text>will mitigate the environmental and health effects of noncompliance; and</text></subitem><subitem id="idc70c992df2994718bef04ad2914da4a5"><enum>(DD)</enum><text>has solicited and responded to community input regarding the plan; and</text></subitem></item></subclause><subclause id="id7601f64823df467b864641d82cf9d034"><enum>(V)</enum><text>deny the issuance or renewal of the permit if the permitting authority determines that—</text><item id="id0407cc2c86f64a36a70939d4ee799115"><enum>(aa)</enum><text>the plan submitted under subclause (IV)(aa) is inadequate; or</text></item><item id="id89e6969021a147db9178242b66587861"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="ide4cc73ead3f94e1aa580a425ecef6d9e"><enum>(AA)</enum><text>the applicant has submitted a plan on a prior occasion, but continues to be a persistent violator; and</text></subitem><subitem id="idd7fd4b496c99445b915658584fd4d5d2" indent="up1"><enum>(BB)</enum><text>no indication exists of extremely exigent cir­cum­stances excusing the persistent violations; and</text></subitem></item></subclause></clause><clause id="id1624a322ecb94a349c9a70fedbe8d3e7"><enum>(ii)</enum><text>in the case of such a permit with a term of 3 years or longer, require permit revisions in accordance with subparagraph (B).</text></clause></subparagraph><subparagraph id="id364daa14449449269fe5fabadee49c87"><enum>(B)</enum><header>Revision requirements</header><clause id="id5e08212be0cf4e87b1043293792c989a"><enum>(i)</enum><header>Deadline</header><text>A revision described in subparagraph (A)(ii) shall occur as expeditiously as practicable and consistent with the procedures established under paragraph (6) but not later than 18 months after the promulgation of such standards and regulations.</text></clause><clause id="id62107caa802b473fb7b0510c04bd6fe7"><enum>(ii)</enum><header>Exception</header><text>A revision under this paragraph shall not be required if the effective date of the standards or regulations is a date after the expiration of the permit term.</text></clause><clause id="id49ea8b05c46c4e99878f65777568f38a"><enum>(iii)</enum><header>Treatment as renewal</header><text>A permit revision under this paragraph shall be treated as a permit renewal if it complies with the requirements of this title regarding renewals.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id09884af4ee884d85ba5d7ddea94558bd"><enum>(3)</enum><header>Permit applications</header><text>Section 503(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661b">42 U.S.C. 7661b(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id80ad0bb2a764425d933c649e90cc209f"><paragraph id="id9fdbcdda196941bfaf8081edbf81ae7c"><enum>(3)</enum><header>Major source analyses</header><text>The regulations required by section 502(b) shall include a requirement that an applicant for a permit or renewal of a permit for a major source shall submit, together with the compliance plan required under this subsection, a cumulative impacts analysis for each census block group or Tribal census block group (as those terms are defined by the Director of the Bureau of the Census) located in, or immediately adjacent to, the area in which the major source is, or is proposed to be, located that analyzes—</text><subparagraph id="id9686007737254eaebe338eb47f6c53b6"><enum>(A)</enum><text>community demographics and locations of community exposure points, such as schools, day care centers, nursing homes, hospitals, health clinics, places of religious worship, parks, playgrounds, and community centers;</text></subparagraph><subparagraph id="id709d4843a61c4d278d559a5b3dbbbfec"><enum>(B)</enum><text>air quality and the potential effect on that air quality of emissions of air pollutants (including pollutants listed under section 108 or 112) from the major source, including in combination with existing sources of pollutants;</text></subparagraph><subparagraph id="id470a147d8cf14bcc922851f2022c58a6"><enum>(C)</enum><text>the potential effects on soil quality and water quality of emissions of lead and other air pollutants that could contaminate soil or water from the major source, including in combination with existing sources of pollutants; and</text></subparagraph><subparagraph id="id9546fcf3d1e34d53ac38c490fde39409"><enum>(D)</enum><text>public health and any potential effects on public health from the major source.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="H6F707CBE55EB4CFA900B9BF28D5CE950"><enum>8.</enum><header>White House Environmental Justice Interagency Council</header><subsection commented="no" id="H84B4FA07AAF74053A2E0D8CC94ED00B2"><enum>(a)</enum><header>In general</header><text>The President shall maintain within the Executive Office of the President a White House Environmental Justice Interagency Council.</text></subsection><subsection commented="no" id="H4B3892DB27514336A936A6B371E6DD2E"><enum>(b)</enum><header>Purposes</header><text>The purposes of the White House interagency council are—</text><paragraph commented="no" id="H1AC387F8483C4887876A68202204C2E4"><enum>(1)</enum><text display-inline="yes-display-inline">to improve coordination and collaboration among Federal agencies and to help advise and assist Federal agencies in identifying and addressing, as appropriate, the disproportionate human health and environmental effects of Federal programs, policies, practices, and activities on communities of color, low-income communities, and Tribal and Indigenous communities;</text></paragraph><paragraph commented="no" id="HFFCF1214F02F4726A877357A7F668ABF"><enum>(2)</enum><text>to promote meaningful involvement and due process in the development, implementation, and enforcement of environmental laws;</text></paragraph><paragraph commented="no" id="H5B852693407841A8AE6AC084702B0B71"><enum>(3)</enum><text>to coordinate with, and provide direct guidance and technical assistance to, environmental justice communities, with a focus on increasing community understanding of the science, regulations, and policy related to Federal agency actions on environmental justice issues;</text></paragraph><paragraph commented="no" id="HC4D6327176904A649555A47EC20B981C"><enum>(4)</enum><text>to address environmental health, pollution, and public health burdens in environmental justice communities, and build healthy, sustainable, and resilient communities; and</text></paragraph><paragraph id="id2884ecaedec64a9c90357a097472bb0f"><enum>(5)</enum><text>to develop and update a strategy to address current and historical environmental injustice, in consultation with the National Environmental Justice Advisory Council and local environmental justice leaders, that includes—</text><subparagraph id="id8645521265964A07B5D8C32FDF14C5F2"><enum>(A)</enum><text>clear performance metrics to ensure accountability; and </text></subparagraph><subparagraph id="id94ED8D0EEEE548F4933CCD4A4EDC8F3A"><enum>(B)</enum><text>an annually published public performance scorecard on the implementation of the White House interagency council.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HF5EB55F299F744B5A3704C5559790DF5"><enum>(c)</enum><header>Composition</header><text>The White House interagency council shall be composed of members as follows (or their designee):</text><paragraph commented="no" id="H61A457A6876C41ADBF02D311D94035A6"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture. </text></paragraph><paragraph commented="no" id="H8F2534BB0E3A4B718ADCFA018A87DDD0"><enum>(2)</enum><text>The Secretary of Commerce.</text></paragraph><paragraph commented="no" id="H32B05A7EF0B44AC8A9747154A5644E3E"><enum>(3)</enum><text>The Secretary of Defense.</text></paragraph><paragraph commented="no" id="H6D6C10B9817C45FA89F9452CC9D926AC"><enum>(4)</enum><text>The Secretary of Education.</text></paragraph><paragraph commented="no" id="H8059F698577A4937BE94E87451BCBBED"><enum>(5)</enum><text>The Chairperson of the White House interagency council. </text></subsection><subsection commented="no" id="H9913D8E016B14F3194804736F36022DD"><enum>(e)</enum><header>Reporting to President</header><text>The White House interagency council shall report to the President through the Chairperson of the Council on Environmental Quality.</text></subsection><subsection commented="no" id="H2F5546FAD4E24D28821207CF76B277D0"><enum>(f)</enum><header>Uniform consideration guidance</header><paragraph commented="no" id="H81C2DF0E5C9B4393BF78F0AD6BF7FABF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure that there is a common level of understanding of terminology used in dealing with environmental justice issues, not later than 1 year after the date of enactment of this Act, after coordinating with and conducting outreach to environmental justice communities, State governments, Tribal Governments, and local governments, the White House interagency council shall develop and publish in the Federal Register a guidance document to assist Federal agencies in defining and applying the following terms:</text><subparagraph commented="no" id="HDF9F0B639C5D4000A17A91321B9CEC7E"><enum>(A)</enum><text>Health disparities.</text></subparagraph><subparagraph commented="no" id="H2280D3A1266640EAB4EBC9F656A7F78C"><enum>(B)</enum><text>Environmental exposure disparities.</text></subparagraph><subparagraph commented="no" id="HA364A1D8601F44CCBB6BAAFFC589D1ED"><enum>(C)</enum><text display-inline="yes-display-inline">Demographic characteristics, including age, sex, and race or ethnicity.</text></subparagraph><subparagraph commented="no" id="H3834D5A515754032B8DB9CB3E0A579A6"><enum>(D)</enum><text display-inline="yes-display-inline">Social stressors, including poverty, housing quality, access to health care, education, immigration status, linguistic isolation, historical trauma, and lack of community resources.</text></subparagraph><subparagraph commented="no" id="HC9C1DA9136A74450B9ED2A4D074D26EF"><enum>(E)</enum><text>Cumulative impacts or risks.</text></subparagraph><subparagraph commented="no" id="HC52934F4571148E3AD7A631D5DFF7F2A"><enum>(F)</enum><text display-inline="yes-display-inline">Community vulnerability or susceptibility to adverse human health and environmental effects (including climate change).</text></subparagraph><subparagraph commented="no" id="HAD76C16CBCE4480785F648BBFFC238E6"><enum>(G)</enum><text>Barriers to meaningful involvement in the development, implementation, and enforcement of environmental laws.</text></subparagraph><subparagraph commented="no" id="H3611028CA1914A19BBADFD4EFB5BA6D7"><enum>(H)</enum><text display-inline="yes-display-inline">Community capacity to address environmental concerns, including the capacity to obtain equitable access to environmental amenities.</text></subparagraph></paragraph><paragraph commented="no" id="HD7FAE0735CE74E48ABF0B1EE11C0D8A4"><enum>(2)</enum><header>Public comment</header><text>For a period of not less than 30 days, the White House interagency council shall seek public comment on the guidance document developed under paragraph (1).</text></paragraph><paragraph commented="no" id="HC1A1A470261148F8A3EA79A82FCD29AE"><enum>(3)</enum><header>Documentation</header><text>Not later than 90 days after the date of publication of the guidance document under paragraph (1), the head of each Federal agency participating in the White House interagency council shall document the ways in which the Federal agency will incorporate guidance from the document into the environmental justice strategy of the Federal agency developed and finalized under section 9(b).</text></paragraph></subsection><subsection commented="no" id="HB62051A462234BF890B1CA57383047F0"><enum>(g)</enum><header>Development of interagency Federal environmental justice strategy</header><paragraph commented="no" id="H25F9E3B670B047118D8232BACC09CEDD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than once every 3 years, after notice and opportunity for public comment, the White House interagency council shall update a coordinated interagency Federal environmental justice strategy to address current and historical environmental injustice.</text></paragraph><paragraph id="ida86e8b5a568446039e33bb5671fe0ebc"><enum>(2)</enum><header>Development of strategy</header><text>In carrying out paragraph (1), the White House interagency council shall—</text><subparagraph id="id0b963d94624847d19973a40330456d90"><enum>(A)</enum><text>consider the most recent environmental justice strategy of each Federal agency that participates in the White House interagency council that is developed and finalized under section 9(b);</text></subparagraph><subparagraph id="id3cd76367557b4f019960311d18f846ae"><enum>(B)</enum><text>consult with the National Environmental Justice Advisory Council and local environmental justice leaders; and</text></subparagraph><subparagraph id="id8e230161515449969033393469b61147"><enum>(C)</enum><text>include in the interagency Federal environmental justice strategy clear performance metrics to ensure accountability.</text></subparagraph></paragraph><paragraph id="id82b31f32f39244c9b9a940a90cf23fa6"><enum>(3)</enum><header>Annual performance scorecard</header><text>The White House interagency council shall annually publish a public performance scorecard on the implementation of the interagency Federal environmental justice strategy.</text></paragraph></subsection><subsection commented="no" id="H7C0CD6E9B37C47ED9BA12B237B90DC3A"><enum>(h)</enum><header>Submission of report to President</header><paragraph commented="no" id="HC71FD7074F184973B90EDAF7E0B80348"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after updating the interagency Federal environmental justice strategy under subsection (g)(1), the White House interagency council shall submit to the President a report that contains—</text><subparagraph commented="no" id="HF1B36BCDBA1E40989AE47128C3EE1B4C"><enum>(A)</enum><text>a description of the implementation of the interagency Federal environmental justice strategy; and</text></subparagraph><subparagraph commented="no" id="HE0A556B361C84F12834FA1B5B881E7CF"><enum>(B)</enum><text>a copy of the finalized environmental justice strategy of each Federal agency that participates in the White House interagency council that is developed and finalized under section 9(b).</text></subparagraph></paragraph><paragraph commented="no" id="HD900DD47ACED4B808C1B443E9A8D3BFD"><enum>(2)</enum><header>Public availability</header><text>The head of each Federal agency that participates in the White House interagency council shall make the report described in paragraph (1) available to the public (including by posting a copy of the report on the website of each Federal agency).</text></paragraph></subsection><subsection id="idb6c406730a344deca32865856d27a301"><enum>(i)</enum><header>Administration</header><paragraph id="idCE429F2079CF434F8625D0F71499EB43"><enum>(1)</enum><header>Office of Administration</header><text>The Office of Administration within the Executive Office of the President shall provide funding and administrative support for the White House interagency council, to the extent permitted by law and within existing appropriations. </text></paragraph><paragraph id="id2A2672F47DB6444580DBAA920A7E9A69"><enum>(2)</enum><header>Other agencies</header><text>To the extent permitted by law, including section 1535 of title 31, United States Code (commonly known as the <quote>Economy Act</quote>), and subject to the availability of appropriations, the Secretary of Labor, the Secretary of Transportation, and the Administrator of the Environmental Protection Agency shall provide administrative support for the White House interagency council, as necessary.</text></paragraph></subsection><subsection id="id6f02a96519664c329650507be08b0bb6"><enum>(j)</enum><header>Meetings and staff</header><paragraph id="id0D88D238EEC0471FA0F8EF888895DB71"><enum>(1)</enum><header>Chairperson</header><text>The Chairperson of the Council on Environmental Quality shall—</text><subparagraph id="idB09D6F41F641400E860F3D5BF85C015A"><enum>(A)</enum><text>convene regular meetings of the White House interagency council;</text></subparagraph><subparagraph id="id15279879A5504E0185B9110033D2BC6A"><enum>(B)</enum><text>determine the agenda of the White House interagency council in accordance with this section; and </text></subparagraph><subparagraph id="id839598C678924AABBBC13F9E77504AE9"><enum>(C)</enum><text>direct the work of the White House interagency council. </text></subparagraph></paragraph><paragraph id="id5DFF9B58B8184C1DB09E8F7FD784F9B1"><enum>(2)</enum><header>Executive Director</header><text>The Chairperson of the Council on Environmental Quality shall designate an Executive Director of the White House interagency council, who shall coordinate the work of, and head any staff assigned to, the White House interagency council.</text></paragraph></subsection><subsection id="id198b0f989e6649939d5cd98453253dee"><enum>(k)</enum><header>Officers</header><text>To facilitate the work of the White House interagency council, the head of each agency described in subsection (c) shall assign a designated official within the agency to be an Environmental Justice Officer, with the authority—</text><paragraph id="idFA3AC754760F47E4BBC8CC6BA46C750C"><enum>(1)</enum><text>to represent the agency on the White House interagency council; and </text></paragraph><paragraph id="id9ADB7DC18D4D4FB892086DA49D2E3B37"><enum>(2)</enum><text>to perform such other duties relating to the implementation of this section within the agency as the head of the agency determines to be appropriate.</text></paragraph></subsection><subsection id="idb521da48efad4427ab554e8f60fb2085"><enum>(l)</enum><header>Establishment of subgroups</header><text>At the direction of the Chairperson of the Council on Environmental Quality, the White House interagency council may establish 1 or more subgroups consisting exclusively of White House interagency council members or their designees under this section, as appropriate. </text></subsection></section><section commented="no" id="HEEBC815BC0DE42D6A86EAFF366CD7218"><enum>9.</enum><header>Federal agency actions and responsibilities</header><subsection commented="no" id="HF46D8F6284B242BCADDC2BD6832C5F48"><enum>(a)</enum><header>Conduct of programs</header><text display-inline="yes-display-inline">Each Federal agency that participates in the White House interagency council shall conduct each program, policy, practice, and activity of the Federal agency that adversely affects, or has the potential to adversely affect, human health or the environment in a manner that ensures that each such program, policy, practice, or activity does not have an effect of excluding any individual from participating in, denying any individual the benefits of, or subjecting any individual to discrimination or disparate impact under, such program, policy, practice, or activity of the Federal agency on the basis of the race, color, national origin, or income level of the individual. </text></subsection><subsection commented="no" id="HF9CF5C0030C940919432BF83431ED5D3"><enum>(b)</enum><header>Federal agency environmental justice strategies</header><paragraph commented="no" id="HB40E9FA57BF047CEBCC9A238B5098A76"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and after notice and opportunity for public comment, each Federal agency that participates in the White House interagency council shall develop and finalize an agencywide environmental justice strategy that—</text><subparagraph commented="no" id="H6BD378675AD4415984D92B2DE4040805"><enum>(A)</enum><text display-inline="yes-display-inline">identifies staff to support implementation of the Federal agency’s environmental justice strategy;</text></subparagraph><subparagraph commented="no" id="H6569287049B3476CB65389AC8E2F7034"><enum>(B)</enum><text>identifies and addresses any disproportionately high or adverse human health or environmental effects of its programs, policies, practices, and activities on—</text><clause commented="no" id="HC97E289B855F40D0ABECC8A308D088C1"><enum>(i)</enum><text display-inline="yes-display-inline">communities of color;</text></clause><clause commented="no" id="HCAD829961AEB476188B25FFA31FFF18D"><enum>(ii)</enum><text display-inline="yes-display-inline">low-income communities; and</text></clause><clause commented="no" id="HB37092968B2D4DA0AFA10F768415C7D0"><enum>(iii)</enum><text>Tribal and Indigenous communities; and</text></clause></subparagraph><subparagraph commented="no" id="HB317E8A4D2894C70A6188CA7778FE487"><enum>(C)</enum><text>complies with each requirement described in paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" id="H1F8AEFFD74A2456DA74C9FDC792EF885"><enum>(2)</enum><header>Contents</header><text>Each environmental justice strategy developed by a Federal agency under paragraph (1) shall contain—</text><subparagraph commented="no" id="H7FC4724FB7E04F7DB61F8B98B78884BA"><enum>(A)</enum><text>an assessment that identifies each program, policy, practice, and activity (including any public participation process) of the Federal agency, relating to human health or the environment that the Federal agency determines should be revised—</text><clause commented="no" id="H09E6A0D5FD1E4A5B86036E5CC4E9DD6A"><enum>(i)</enum><text>to ensure that all persons have the same degree of protection from environmental and health hazards;</text></clause><clause commented="no" id="HB3677743814B4C119778C30DFD2888FE"><enum>(ii)</enum><text display-inline="yes-display-inline">to ensure meaningful public involvement and due process in the development, implementation, and enforcement of all Federal laws;</text></clause><clause commented="no" id="HCBEB47DE9C904CCFA96526A459A6F1AA"><enum>(iii)</enum><text>to improve direct guidance and technical assistance to environmental justice communities with respect to the understanding of the science, regulations, and policy related to Federal agency action on environmental justice issues;</text></clause><clause commented="no" id="HF1E9BC9CC519452784353A556F287CAB"><enum>(iv)</enum><text>to improve cooperation with State governments, Tribal Governments, and local governments to address pollution and public health burdens in environmental justice communities, and build healthy, sustainable, and resilient communities;</text></clause><clause commented="no" id="H87E1F1E084324006958C76E3CD3469E2"><enum>(v)</enum><text>to improve Federal research and data collection efforts related to—</text><subclause commented="no" id="H4CBD4794E9A246F0AE93452BBC816B9B"><enum>(I)</enum><text>the health and environment of communities of color, low-income communities, and Tribal and Indigenous communities;</text></subclause><subclause commented="no" id="HB414E7E1FBBC41C0A96925E5E9E7616E"><enum>(II)</enum><text>climate change; and</text></subclause><subclause commented="no" id="HB2BF3F5658D04C1985F4EED10D4C2131"><enum>(III)</enum><text>the inequitable distribution of burdens and benefits of the management and use of natural resources, including water, minerals, and land; and</text></subclause></clause><clause commented="no" id="H793DA88E34984A81872D25541ECB30E4"><enum>(vi)</enum><text>to reduce or eliminate disproportionately adverse human health or environmental effects on communities of color, low-income communities, and Tribal and Indigenous communities; and</text></clause></subparagraph><subparagraph commented="no" id="HE63C21D7042D4ACBB697EC14D9CDC74B"><enum>(B)</enum><text>a timetable for the completion of—</text><clause commented="no" id="HE87E44BE864E44E7A25B8C75DB1FF2F2"><enum>(i)</enum><text>each revision identified under subparagraph (A); and</text></clause><clause commented="no" id="HD4D9ACCBFEF44AABBB78B23359F0FE80"><enum>(ii)</enum><text>an assessment of the economic and social implications of each revision identified under subparagraph (A).</text></clause></subparagraph></paragraph><paragraph commented="no" id="H412C710DAC104E7885AA53AD958DDA38"><enum>(3)</enum><header>Reports</header><subparagraph commented="no" id="HA3A1FB64B9714D52A1ADE2C3B9D1EE97"><enum>(A)</enum><header>Annual reports</header><text>Not later than 2 years after the finalization of an environmental justice strategy under this subsection, and annually thereafter, a Federal agency that participates in the White House interagency council shall submit to the White House interagency council a report describing the progress of the Federal agency in implementing the environmental justice strategy of the Federal agency.</text></subparagraph><subparagraph commented="no" id="HD86816D1C0444A72A45A9BC0E123FBFB"><enum>(B)</enum><header>Periodic reports</header><text>In addition to the annual reports described in subparagraph (A), upon receipt of a request from the White House interagency council, a Federal agency shall submit to the White House interagency council a report that contains such information as the White House interagency council may require.</text></subparagraph></paragraph><paragraph commented="no" id="HBF217A2F0F634962862362512E4DD75F"><enum>(4)</enum><header>Revision of agencywide environmental justice strategy</header><text>Not later than 5 years after the date of enactment of this Act, each Federal agency that participates in the White House interagency council shall—</text><subparagraph commented="no" id="H472B65776C2A4B238C099A0628F5B8E7"><enum>(A)</enum><text>evaluate and revise the environmental justice strategy of the Federal agency; and</text></subparagraph><subparagraph commented="no" id="HDC2B20A8F84742049D6AEBCD9A94E9F6"><enum>(B)</enum><text>submit to the White House interagency council a copy of the revised version of the environmental justice strategy of the Federal agency.</text></subparagraph></paragraph><paragraph commented="no" id="H43FE4FEF86B241A2BF5A84122BF38736"><enum>(5)</enum><header>Petition</header><subparagraph commented="no" id="H5052F4AD7AC943C6B552BA24EDCEC418"><enum>(A)</enum><header>In general</header><text>The head of a Federal agency may submit to the President a petition for an exemption of any requirement described in this section with respect to any program or activity of the Federal agency if the head of the Federal agency determines that complying with such requirement would compromise the agency’s ability to carry out its core missions. </text></subparagraph><subparagraph commented="no" id="H8E67EC07B19E4430972C1F6EC4784D0C"><enum>(B)</enum><header>Availability to public</header><text>Each petition submitted by a Federal agency to the President under subparagraph (A) shall be made available to the public (including through a description of the petition on the website of the Federal agency).</text></subparagraph><subparagraph commented="no" id="HE9C0B9F1AECB406982311D30D714CD72"><enum>(C)</enum><header>Consideration</header><text display-inline="yes-display-inline">In determining whether to grant a petition for an exemption submitted by a Federal agency to the President under subparagraph (A), the President shall make a decision that reflects both the merits of the specific case and the broader national interest in breaking cycles of environmental injustice, and shall consider whether the granting of the petition would likely—</text><clause commented="no" id="HBFC837D686014A87933648F26C4035C6"><enum>(i)</enum><text display-inline="yes-display-inline">result in disproportionately adverse human health or environmental effects on communities of color, low-income communities, and Tribal and Indigenous communities; or</text></clause><clause commented="no" id="HE28677D8DABD4D3A924BA1416ABA0830"><enum>(ii)</enum><text>exacerbate, or fail to ameliorate, any disproportionately adverse human health or environmental effect on any community of color, low-income community, or Tribal and Indigenous community.</text></clause></subparagraph><subparagraph commented="no" id="H5B771CEE97864CFE96F6068A89A43CEC"><enum>(D)</enum><header>Appeal</header><clause commented="no" id="H89114AFA53E749F09388789222F9FE9C"><enum>(i)</enum><header>In general</header><text>Not later than 90 days after the date on which the President approves a petition under this paragraph, an individual may appeal the decision of the President to approve the petition.</text></clause><clause commented="no" id="H8441ED5A15BD4475B004ACAE20FAD427"><enum>(ii)</enum><header>Written appeal</header><subclause commented="no" id="HFCCD9D7BE0F846F7A7D9EF4DDE1CB5CF"><enum>(I)</enum><header>In general</header><text>To appeal a decision of the President under clause (i), an individual shall submit a written appeal to—</text><item commented="no" id="H5BC0D99E49AD46B5AD8E4B1F694A4572"><enum>(aa)</enum><text>the Council on Environmental Quality;</text></item><item commented="no" id="H35B62C2511E047259223FD2FF8FE8674"><enum>(bb)</enum><text>the Deputy Assistant to the President for Environmental Policy; or</text></item><item commented="no" id="H2BE9B57546E24189B1A55E8FB835AD03"><enum>(cc)</enum><text>the Assistant to the President for Domestic Policy.</text></item></subclause><subclause commented="no" id="H0D56363B10394B578B21EA2CDA096DFB"><enum>(II)</enum><header>Contents</header><text>A written appeal shall contain a description of each reason why the exemption that is the subject of the petition is unnecessary.</text></subclause></clause><clause commented="no" id="H692B1CBD2829462FAEA6204D306C1EC4"><enum>(iii)</enum><header>Requirement of President</header><text>Not later than 90 days after the date on which an agency or officer described in clause (ii)(I) receives a written appeal submitted by an individual under that clause, the President shall provide to the individual a written notification describing the decision of the President with respect to the appeal.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HB0CBDD7D0CE54AD2A2071D41779E02E5"><enum>(c)</enum><header>Human health and environmental research, data collection, and analysis</header><paragraph commented="no" id="H6BF970F285074F7AB8DC2D3C95184A42"><enum>(1)</enum><header>Research</header><text>Each Federal agency, to the maximum extent practicable and permitted by applicable law, shall—</text><subparagraph commented="no" id="HA70A2EA2D5774F32A4D9709B8A041256"><enum>(A)</enum><text>in conducting environmental, public access, or human health research, include diverse segments of the population in epidemiological and clinical studies, including segments at high risk from environmental hazards, such as communities of color, low-income communities, and Tribal and Indigenous communities;</text></subparagraph><subparagraph commented="no" id="HA195BE391512482D993F17A30301435C"><enum>(B)</enum><text display-inline="yes-display-inline">in conducting environmental or human health analyses, identify multiple and cumulative exposures, including potentially exacerbated risks due to current and future climate impacts; and</text></subparagraph><subparagraph commented="no" id="H8F7D023FA5B644EAB734EC5E3E21CD54"><enum>(C)</enum><text>actively encourage and solicit community-based science, and provide to communities of color, low-income communities, and Tribal and Indigenous communities the opportunity to comment on and participate in the development and design of research strategies carried out pursuant to this Act.</text></subparagraph></paragraph><paragraph commented="no" id="H9694E2C10CBB4202B72E41476D82B2F4"><enum>(2)</enum><header>Disproportionate impact</header><text>To the maximum extent practicable and permitted by applicable law (including section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act</quote>)), each Federal agency shall—</text><subparagraph commented="no" id="H19075A2EA84445B780AD9FF30931D2F8"><enum>(A)</enum><text display-inline="yes-display-inline">collect, maintain, and analyze information assessing and comparing environmental and human health risks borne by populations identified by race, national origin, income, or other readily available and appropriate information; and</text></subparagraph><subparagraph commented="no" id="H83C9BA5D5ABE457EA72C4FAC1AAD01F4"><enum>(B)</enum><text>use that information to determine whether the programs, policies, and activities of the Federal agency have disproportionally adverse human health or environmental effects on communities of color, low-income communities, and Tribal and Indigenous communities.</text></subparagraph></paragraph><paragraph commented="no" id="H17E3ED8B9A1546A89D985567BD41C18A"><enum>(3)</enum><header>Information relating to non-Federal facilities</header><text>In connection with the implementation of Federal agency environmental justice strategies under subsection (b), each Federal agency, to the maximum extent practicable and permitted by applicable law, shall collect, maintain, and analyze information relating to the race, national origin, and income level, and other readily accessible and appropriate information, for communities of color, low-income communities, and Tribal and Indigenous communities in proximity to any facility or site expected to have a substantial environmental, human health, or economic effect on the surrounding populations, if the facility or site becomes the subject of a substantial Federal environmental administrative or judicial action.</text></paragraph><paragraph commented="no" id="H3F5E18C95ABD43AA97239CB80BD18E44"><enum>(4)</enum><header>Impact from Federal facilities</header><text>Each Federal agency, to the maximum extent practicable and permitted by applicable law, shall collect, maintain, and analyze information relating to the race, national origin, and income level, and other readily accessible and appropriate information, for communities of color, low-income communities, and Tribal and Indigenous communities in proximity to any facility of the Federal agency that is—</text><subparagraph commented="no" id="HC862DECF74A0423CBA133B69BC70FD8D"><enum>(A)</enum><text>subject to the reporting requirements under the Emergency Planning and Community Right-to-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11001">42 U.S.C. 11001</external-xref> et seq.), as required by Executive Order 12898 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to Federal actions to address environmental justice in minority populations and low-income populations); and</text></subparagraph><subparagraph commented="no" id="H4A23A2C6F5DF436D8FA536DEDDF83B5E"><enum>(B)</enum><text>expected to have a substantial environmental, human health, or economic effect on surrounding populations.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H957FD921723A46019C3058CD9A9042ED"><enum>(d)</enum><header>Consumption of fish and wildlife</header><paragraph commented="no" id="HDA22C6B080E84BB6BC91D91275535C0E"><enum>(1)</enum><header>In general</header><text>Each Federal agency shall develop, publish (unless prohibited by law), and revise, as practicable and appropriate, guidance on actions of the Federal agency that will impact fish and wildlife consumed by populations that principally rely on fish or wildlife for subsistence.</text></paragraph><paragraph commented="no" id="HA09EC1079F0742E5968D7BBF614849E3"><enum>(2)</enum><header>Requirement</header><text>The guidance described in paragraph (1) shall—</text><subparagraph commented="no" id="HF0E081D6B5B74EFCBDECC7EFF1CAE952"><enum>(A)</enum><text>reflect the latest scientific information available concerning methods for evaluating the human health risks associated with the consumption of pollutant-bearing fish or wildlife; and</text></subparagraph><subparagraph commented="no" id="H668726B7A1DC42DA8C0F9A3CD6353A44"><enum>(B)</enum><text>publish the risks of such consumption patterns.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H7D9F4A9B535B44FEA0CB8A8406A43F09"><enum>(e)</enum><header>Mapping and screening tool</header><text>The Administrator shall make available to the public an environmental justice mapping and screening tool (such as EJScreen or an equivalent tool) that includes, at a minimum, the following features:</text><paragraph commented="no" id="HA50603277C084DE283DA97987684FC43"><enum>(1)</enum><text>Nationally consistent data.</text></paragraph><paragraph commented="no" id="H6F0329969EFB474EB631183D1FDE1AA7"><enum>(2)</enum><text>Environmental data.</text></paragraph><paragraph commented="no" id="HB751F7FF69774216882D63199662C205"><enum>(3)</enum><text>Demographic data, including data relating to race, ethnicity, and income.</text></paragraph><paragraph commented="no" id="HC5E4A328F13648108F7C510CD41FD70A"><enum>(4)</enum><text>Capacity to produce maps and reports by geographical area.</text></paragraph><paragraph commented="no" id="HD33CC783055943CCB8BFE30EE79521B8"><enum>(5)</enum><text display-inline="yes-display-inline">Data on national parks and other federally protected natural, historic, and cultural sites.</text></paragraph></subsection><subsection commented="no" id="HB4BCCA5EBB3F46458624ED88A0481185"><enum>(f)</enum><header>Judicial review and rights of action</header><text>Any person may commence a civil action—</text><paragraph commented="no" id="H030B35D2C61440C89EA182618CB99B9C"><enum>(1)</enum><text>to seek relief from, or to compel, an agency action under this section (including regulations promulgated pursuant to this section); or</text></paragraph><paragraph commented="no" id="H77AC154450FB463E891685AACCE50BBF"><enum>(2)</enum><text>otherwise to ensure compliance with this section (including regulations promulgated pursuant to this section).</text></paragraph></subsection><subsection commented="no" id="H5FBADB5EE79F4EA683A4D0BB493E8295"><enum>(g)</enum><header>Information sharing</header><text>In carrying out this section, each Federal agency, to the maximum extent practicable and permitted by applicable law, shall share information and eliminate unnecessary duplication of efforts through the use of existing data systems and cooperative agreements among Federal agencies and with State, local, and Tribal governments.</text></subsection><subsection commented="no" id="H0014C430F55043A9B852147EDECEF8E6"><enum>(h)</enum><header>Codification of guidance</header><paragraph commented="no" id="H03BD8EAD261A4077A16DAA55C984EF4C"><enum>(1)</enum><header>Council on Environmental Quality</header><text>Sections II and III of the guidance issued by the Council on Environmental Quality entitled <quote>Environmental Justice Guidance Under the National Environmental Policy Act</quote> and dated December 10, 1997, are enacted into law.</text></paragraph><paragraph commented="no" id="H8369C82650EB47E9B1C0D74569FFC1D7"><enum>(2)</enum><header>Environmental Protection Agency</header><text>The guidance issued by the Environmental Protection Agency entitled <quote>EPA Policy on Consultation and Coordination with Indian Tribes: Guidance for Discussing Tribal Treaty Rights</quote> and dated February 2016 is enacted into law.</text></paragraph></subsection></section><section commented="no" id="H255F6EF656D84BF395F0B7A0C8CDE1AB"><enum>10.</enum><header>Ombuds</header><subsection commented="no" id="HFA4F72B3B11444339EBF3F9D4FE2A4EF"><enum>(a)</enum><header>Establishment</header><text>The Administrator shall establish within the Environmental Protection Agency a position of Environmental Justice Ombuds.</text></subsection><subsection commented="no" id="H6130EEA0A490472380BBC25D9ED3E0D4"><enum>(b)</enum><header>Reporting</header><text>The Environmental Justice Ombuds shall—</text><paragraph commented="no" id="HEFC558C2AB6643C8842136F4CD1F8D72"><enum>(1)</enum><text>report directly to the Administrator; and</text></paragraph><paragraph commented="no" id="HA426A9F822FB44D68EDB0D4EEC42DCA3"><enum>(2)</enum><text display-inline="yes-display-inline">not be required to report to the Office of Environmental Justice of the Environmental Protection Agency.</text></paragraph></subsection><subsection commented="no" id="HA7C9B439FAD04EFFA4165894C11BB1EC"><enum>(c)</enum><header>Functions</header><text>The Environmental Justice Ombuds shall—</text><paragraph commented="no" id="H589E84FBEC4B4A2A9480F18668D26D43"><enum>(1)</enum><text>in coordination with the Inspector General of the Environmental Protection Agency, establish an independent, neutral, accessible, confidential, and standardized process—</text><subparagraph commented="no" id="H1AFDAA6D442842A0BF4E46DD5C40D978"><enum>(A)</enum><text>to receive, review, and process complaints and allegations with respect to environmental justice programs and activities of the Environmental Protection Agency; and</text></subparagraph><subparagraph commented="no" id="HB685C42B296D4EF999BE89B41EB66937"><enum>(B)</enum><text>to assist individuals in resolving complaints and allegations described in subparagraph (A); </text></subparagraph></paragraph><paragraph commented="no" id="HB8C8649A744A432B9A7FA557DAE7BDBE"><enum>(2)</enum><text display-inline="yes-display-inline">identify and thereafter review, examine, and make recommendations to the Administrator to address recurring and chronic complaints regarding specific environmental justice programs and activities of the Environmental Protection Agency identified by the Ombuds pursuant to paragraph (1); </text></paragraph><paragraph commented="no" id="H4B608CA5F3BC40C4A8430C95F6BFC25E"><enum>(3)</enum><text>review the Environmental Protection Agency’s compliance with policies and standards of the Environmental Protection Agency with respect to its environmental justice programs and activities; and</text></paragraph><paragraph commented="no" id="HB21A33259AF74FCABE63802AA2D9404A"><enum>(4)</enum><text display-inline="yes-display-inline">produce an annual report that details the findings of the regional staff, feedback received from environmental justice communities, and recommendations to increase cooperation between the Environmental Protection Agency and environmental justice communities.</text></paragraph></subsection><subsection commented="no" id="H06E9D24AC84E4D7A8C9EEB9EADAD6F0B"><enum>(d)</enum><header>Availability of report</header><text>The Administrator shall make each report produced pursuant to subsection (c) available to the public (including by posting a copy of the report on the website of the Environmental Protection Agency).</text></subsection><subsection commented="no" id="H90379BB9553B4E66B93DA18CFAF448DD"><enum>(e)</enum><header>Regional staff</header><paragraph commented="no" id="HEAD81B48F6B54974AD609A766A3AD8E8"><enum>(1)</enum><header>Authority of Environmental Justice Ombuds</header><text>The Administrator shall allow the Environmental Justice Ombuds to hire such staff as the Environmental Justice Ombuds determines to be necessary to carry out at each regional office of the Environmental Protection Agency the functions of the Environmental Justice Ombuds described in subsection (c).</text></paragraph><paragraph commented="no" id="HF17D7F81FBDA435CBB5D204BDC34995C"><enum>(2)</enum><header>Purposes</header><text>Staff hired pursuant to paragraph (1) shall—</text><subparagraph commented="no" id="H556A8AC9C8F3495196C484F08BF47376"><enum>(A)</enum><text>foster cooperation between the Environmental Protection Agency and environmental justice communities;</text></subparagraph><subparagraph commented="no" id="H7BD1EFF964564A74BE7BC3F398B61202"><enum>(B)</enum><text>consult with environmental justice communities on the development of policies and programs of the Environmental Protection Agency;</text></subparagraph><subparagraph commented="no" id="H4E023F3A2F1A46908CE45DD15F6F53CC"><enum>(C)</enum><text>receive feedback from environmental justice communities on the performance of the Environmental Protection Agency; and</text></subparagraph><subparagraph commented="no" id="HAE842B63B26745A28B1D7AB3D350A675"><enum>(D)</enum><text>compile and submit to the Environmental Justice Ombuds such information as may be necessary for the Ombuds to produce the annual report described in subsection (c).</text></subparagraph></paragraph><paragraph commented="no" id="H560482C4C379423BAD8A53186DB71466"><enum>(3)</enum><header>Full-time position</header><text>Each individual hired by the Environmental Justice Ombuds under paragraph (1) shall be hired as a full-time employee of the Environmental Protection Agency.</text></paragraph></subsection></section><section commented="no" id="H47157EB9D42F4BDB9D2C976A50C718CC"><enum>11.</enum><header>Access to parks, outdoor spaces, and public recreation opportunities</header><subsection commented="no" id="H421CE7D3D37C40BC9CFD10A773F2FACC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="H9DD66A62D7C34684BAB9CA065893085B"><enum>(1)</enum><header>Eligible entity</header><subparagraph commented="no" id="HEA85CD2B3BD34BB1A3E1CBBD92057FF8"><enum>(A)</enum><header>In general</header><text>The term <term>eligible entity</term> means—</text><clause commented="no" id="H3B2E1B652ECB436AB6854BFCD4E065E0"><enum>(i)</enum><text>a State;</text></clause><clause commented="no" id="H0115828B74B54E9BA03DBC5A4133266D"><enum>(ii)</enum><text>a political subdivision of a State, including—</text><subclause commented="no" id="HFF51AF723CD54AD1A90B2EC8F1B57C63"><enum>(I)</enum><text>a city; and</text></subclause><subclause commented="no" id="HE255CCBE9311425781A3733020598B16"><enum>(II)</enum><text>a county;</text></subclause></clause><clause commented="no" id="HEE7A93FB23D146309959B00F1078E91C"><enum>(iii)</enum><text>a special purpose district, including park districts; and</text></clause><clause commented="no" id="H86E7CC7DB60A40B19B10CC59D1103160"><enum>(iv)</enum><text>an Indian Tribe.</text></clause></subparagraph><subparagraph commented="no" id="H6CD08AA71A074F8FA673DB4BFD8776A5"><enum>(B)</enum><header>Political subdivisions and Indian Tribes</header><text>A political subdivision of a State or an Indian Tribe shall be considered an eligible entity only if the political subdivision or Indian Tribe represents or otherwise serves a qualifying urban area.</text></subparagraph></paragraph><paragraph commented="no" id="H2620139178A64A8A8BD409961A12D7EB"><enum>(2)</enum><header>Outdoor recreation legacy partnership grant program</header><text>The term <term>Outdoor Recreation Legacy Partnership Grant Program</term> means the program established under subsection (b).</text></paragraph><paragraph commented="no" id="HC4C2F7F73DA84ADBAC50D4D32BF32F7C"><enum>(3)</enum><header>Qualifying urban area</header><text display-inline="yes-display-inline">The term <term>qualifying urban area</term> means an area identified by the Census Bureau as an “urban area” in the most recent census.</text></paragraph><paragraph commented="no" id="H673D68208AFD47E3AC982DC3B7208BEB"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection commented="no" id="H131EE72E83FE4544B4713BC527EFC7C1"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish an outdoor recreation legacy partnership grant program under which the Secretary may award grants to eligible entities for projects—</text><paragraph commented="no" id="H18B3EA37468241D5AE69358A57A5666A"><enum>(1)</enum><text>to acquire land and water for parks and other outdoor recreation purposes;</text></paragraph><paragraph commented="no" id="HD9A2A7EA6927451BA70952C8F3AB6F64"><enum>(2)</enum><text>to develop new or renovate existing outdoor recreation facilities; and</text></paragraph><paragraph id="HB7B2DBE8B0634808B1398119A4C9A194"><enum>(3)</enum><text display-inline="yes-display-inline">to develop projects that provide opportunities for outdoor education and public land volunteerism.</text></paragraph></subsection><subsection commented="no" id="H77CE03E5F5F44448A8BDD9517B5D3B7F"><enum>(c)</enum><header>Matching requirement</header><paragraph commented="no" id="H84C7F8407FD34484A15C24D754FD5BE3"><enum>(1)</enum><header>In general</header><text>As a condition of receiving a grant under subsection (b), an eligible entity shall provide matching funds in the form of cash or an in-kind contribution in an amount equal to not less than 100 percent of the amounts made available under the grant.</text></paragraph><paragraph commented="no" id="HCA22CB85457B4BA0A085888805C5E2DB"><enum>(2)</enum><header>Sources</header><text>The matching amounts referred to in paragraph (1) may include amounts made available from State, local, nongovernmental, or private sources.</text></paragraph><paragraph id="HBC6659C6FB204B9385A7946A81D94D0B"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive all or part of the matching requirement under paragraph (1) if the Secretary determines that—</text><subparagraph id="H2980FC7B6EFC414D94C2911BA0D24303"><enum>(A)</enum><text>no reasonable means are available through which an applicant can meet the matching requirement; and</text></subparagraph><subparagraph id="HEB26B20464104088BC1A124FFB4F15CD"><enum>(B)</enum><text>the probable benefit of the project outweighs the public interest in the matching requirement.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H8D17B810D65440A88963D5C4E977B1FB"><enum>(d)</enum><header>Eligible uses</header><paragraph commented="no" id="HC852D6FB6FB7450C8FA04E4B73503373"><enum>(1)</enum><header>In general</header><text>A grant recipient may use a grant awarded under this section—</text><subparagraph commented="no" id="HB68C32E04E114DDC888CE44DC74E76BD"><enum>(A)</enum><text>to acquire land or water that provides outdoor recreation opportunities to the public; and</text></subparagraph><subparagraph commented="no" id="H3AAA278DD91D4451B0EF4B96A4F24AF3"><enum>(B)</enum><text>to develop or renovate outdoor recreational facilities that provide outdoor recreation opportunities to the public, with priority given to projects that—</text><clause commented="no" id="HC7721308D0D447B6902B2661BF1F4272"><enum>(i)</enum><text>create or significantly enhance access to park and recreational opportunities in an urban or suburban area that lacks access to such activities;</text></clause><clause commented="no" id="H252DDC5BEFA64D78B416281E72507302"><enum>(ii)</enum><text>engage and empower underserved communities and youth;</text></clause><clause commented="no" id="H0118EA8B8C734227BE724E7C4E5F60E3"><enum>(iii)</enum><text>provide opportunities for youth employment or job training;</text></clause><clause commented="no" id="HC14C0358BA544B20B33F6CC44CE99691"><enum>(iv)</enum><text>establish or expand public-private partnerships, with a focus on leveraging resources; and</text></clause><clause commented="no" id="H3A54F195787B4AD395A9F7C3582AC4FE"><enum>(v)</enum><text>take advantage of coordination among various levels of government.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H104ED0A3665C488E8AFB935954E1DB1F"><enum>(2)</enum><header>Limitations on use</header><text>A grant recipient may not use grant funds for—</text><subparagraph commented="no" id="H0BFA966B96DB43DFA666A18BD9885049"><enum>(A)</enum><text>grant administration costs;</text></subparagraph><subparagraph commented="no" id="HF8FEE0598F4E4986879950945A20D35A"><enum>(B)</enum><text>incidental costs related to land acquisition, including appraisal and titling;</text></subparagraph><subparagraph commented="no" id="HF920E359C6BF434093B66B51B6B2CAC2"><enum>(C)</enum><text>operation and maintenance activities;</text></subparagraph><subparagraph commented="no" id="H24FF9BAB011945E9936A47188EC9D5A7"><enum>(D)</enum><text>facilities that support semiprofessional or professional athletics;</text></subparagraph><subparagraph commented="no" id="H148D1EACF587433EBE4BFBFE86F8BDD9"><enum>(E)</enum><text>indoor facilities, such as recreation centers or facilities that support primarily non-outdoor purposes; or</text></subparagraph><subparagraph commented="no" id="HD259EA1A38EC42968A166B2D37C43AEB"><enum>(F)</enum><text>acquisition of land or interests in land that restrict access to specific persons.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H7DA0140746014CADB30E7E81D661F962"><enum>(e)</enum><header>National park service requirements</header><text>In carrying out the Outdoor Recreation Legacy Partnership Grant Program, the Secretary shall—</text><paragraph commented="no" id="H1C5B2713131740579B5E87CF91312D99"><enum>(1)</enum><text>conduct an initial screening and technical review of applications received; and</text></paragraph><paragraph commented="no" id="H18F997E269344BC8A83F499114904143"><enum>(2)</enum><text>evaluate and score all qualifying applications.</text></paragraph></subsection><subsection commented="no" id="H9F06B9640B624355B2A9B44269B90419"><enum>(f)</enum><header>Reporting</header><paragraph commented="no" id="HD6FA2DDC22204E5FA7EA43C4AA75F765"><enum>(1)</enum><header>Annual reports</header><text>Not later than 30 days after the last day of each report period, each State lead agency that receives a grant under this section shall annually submit to the Secretary performance and financial reports that—</text><subparagraph commented="no" id="H1F89A1EDA85B426185370E9E1C7F044D"><enum>(A)</enum><text>summarize project activities conducted during the report period; and</text></subparagraph><subparagraph commented="no" id="HC646D28AEF024CF898CEAFA94B5C2F74"><enum>(B)</enum><text display-inline="yes-display-inline">provide the status of the project, including a description of how the project has improved access to parkland, open space, or recreational facilities from the community perspective.</text></subparagraph></paragraph><paragraph commented="no" id="H4B07F8CC20AC4B5C8A5DA2D3128D8F32"><enum>(2)</enum><header>Final reports</header><text>Not later than 90 days after the earlier of the date of expiration of a project period or the completion of a project, each State lead agency that receives a grant under this section shall submit to the Secretary a final report containing such information as the Secretary may require.</text></paragraph></subsection><subsection commented="no" id="H39A283AE07D04033AA9CF5957CBEEACA"><enum>(g)</enum><header>Revenue sharing</header><text display-inline="yes-display-inline">Section 105(a)(2) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note) is amended—</text><paragraph id="H69F4DFCCA8DE4C65AED41E7941138D93"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote>;</text></paragraph><paragraph id="HCB3F91748D6248CA8C7AFB9E898CFBF9"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph id="H5A50B70590F84CE1B6A6844AD5A9B027"><enum>(A)</enum><text>by striking <quote>25 percent</quote> and inserting <quote>20 percent</quote>; and</text></subparagraph><subparagraph id="H4CA42024606840DD8A31563D011E22FE"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph></paragraph><paragraph id="HA0DF5A43096549EB80F59B0505796C8D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD1CFCD60AF2D464FAF7D39A488F0F698"><subparagraph id="H70A427DAD76046379E45F5C6A4FEBA65"><enum>(C)</enum><text display-inline="yes-display-inline">5 percent to provide grants under the Outdoor Recreation Legacy Partnership Grant Program established under section 11(b) of the <short-title>Environmental Justice For All Act</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H200E22C6BE84483DA17D8D3120390C8C"><enum>12.</enum><header>Transit to trails grant program</header><subsection id="HD86931446B814B37BAA35D7A6692C6E6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFEF2A798EB894E7E86F4F2D77F77BC1B"><enum>(1)</enum><header>Critically underserved community</header><text>The term <term>critically underserved community</term> means—</text><subparagraph id="H625D9BE1C1364E989B44B252C0083490"><enum>(A)</enum><text>a community that can demonstrate to the Secretary that the community has inadequate, insufficient, or no park space or recreation facilities, including by demonstrating—</text><clause id="HC4DA9866E20D4D09B4DE47B65F37DAA0"><enum>(i)</enum><text>quality concerns relating to the available park space or recreation facilities;</text></clause><clause id="H0BA37E290A9845D4A69F12374CDAF36F"><enum>(ii)</enum><text>the presence of recreational facilities that do not serve the needs of the community; or</text></clause><clause id="HF04BD6294C304EB2A231DD08410F8213"><enum>(iii)</enum><text>the inequitable distribution of park space for high-need populations, based on income, age, or other measures of vulnerability and need;</text></clause></subparagraph><subparagraph id="H01754814988E44F896B91037B17216C7"><enum>(B)</enum><text>a community in which at least 50 percent of the population is not located within <fraction>1⁄2</fraction> mile of park space;</text></subparagraph><subparagraph id="HC7A69285066640C587694F44D54670B5"><enum>(C)</enum><text>a community that is designated as a qualified opportunity zone under <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph><subparagraph id="HE46F145643994715B1194F93B316649A"><enum>(D)</enum><text>any other community that the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="HD94BDB5F6E154216B5974AC01A9D9B74"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H51CAF7BED328400BBA3CD488D360EA50"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H2C402FF96D2240ABAD7F3BA4CBA8004F"><enum>(B)</enum><text>a political subdivision of a State (including a city or a county) that represents or otherwise serves an urban area or a rural area;</text></subparagraph><subparagraph id="H9C6CEDB9586E402CA3E1F67B5BDCECB7"><enum>(C)</enum><text>a special purpose district (including a park district);</text></subparagraph><subparagraph id="H4DF83E46D83B4BF9AF14E860021D199E"><enum>(D)</enum><text>an Indian Tribe that represents or otherwise serves an urban area or a rural area; or</text></subparagraph><subparagraph id="H62D0E7FE56944556B93C5EBB46A0C732"><enum>(E)</enum><text>a metropolitan planning organization (as defined in section 134(b) of title 23, United States Code).</text></subparagraph></paragraph><paragraph id="H404DCA6544A54B19B8B93DDB98C9DD57"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the Transit to Trails Grant Program established under subsection (b)(1).</text></paragraph><paragraph id="H995E9362EC6D400F98BB4C684B6DADB8"><enum>(4)</enum><header>Rural area</header><text>The term <term>rural area</term> means a community that is not an urban area.</text></paragraph><paragraph id="HBE92839790FB437491509093807A0414"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="H8F8CDFF954BB4DBF81242D008DAE776E"><enum>(6)</enum><header>Transportation connector</header><subparagraph id="HEBF4A99473D84A47A6BFE8322D4CB5CF"><enum>(A)</enum><header>In general</header><text>The term <term>transportation connector</term> means a system that—</text><clause id="H0D011A27CB60438AB535F9BAB27381B6"><enum>(i)</enum><text>connects 2 ZIP Codes or communities within a 175-mile radius of a designated service area; and</text></clause><clause id="HB151080CFB3B4C67A6DB19D8C6810D1A"><enum>(ii)</enum><text>offers rides available to the public.</text></clause></subparagraph><subparagraph id="H5FE2D080A4C8455995A06BD9F4526651"><enum>(B)</enum><header>Inclusions</header><text>The term <term>transportation connector</term> includes microtransits, bus lines, bus rails, light rail, rapid transits, or personal rapid transits.</text></subparagraph></paragraph><paragraph id="HEACD2B81650448439370AD303AB381AA"><enum>(7)</enum><header>Urban area</header><text>The term <term>urban area</term> means a community that—</text><subparagraph id="HD9BFABC3FD3A4C3F8BB5050226EF7EA4"><enum>(A)</enum><text>is densely developed;</text></subparagraph><subparagraph id="H176D7ACE335A42C68D7236D1CBD740EA"><enum>(B)</enum><text>has residential, commercial, and other nonresidential areas; and</text></subparagraph><subparagraph id="H891DF0BC9EE54748AF154E5843ABC109"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HAE36291A38E546C287322430CFEFB76D"><enum>(i)</enum><text>is an urbanized area with a population of 50,000 or more; or</text></clause><clause id="H1A14E7668122452981010529A54729AE" indent="up1"><enum>(ii)</enum><text>is an urban cluster with a population of—</text><subclause id="H249CD72F9FB24216A7F00129234DFB6D"><enum>(I)</enum><text>not less than 2,500; and</text></subclause><subclause id="HFDF0F81BB1B2444DBED505D93AACAE51"><enum>(II)</enum><text>not more than 50,000.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HDA8B873F0AF24E7DB3A4B288B737DE98"><enum>(b)</enum><header>Grant program</header><paragraph id="HB537BECCA3F541E481A020B19CDE46DF"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a grant program, to be known as the <quote>Transit to Trails Grant Program</quote>, under which the Secretary shall award grants to eligible entities for—</text><subparagraph id="HB7400D6F130342898A209A31B3A4ADF8"><enum>(A)</enum><text>projects that develop transportation connectors or routes in or serving, and related education materials for, critically underserved communities to increase access and mobility to Federal or non-Federal public land, waters, parkland, or monuments; or</text></subparagraph><subparagraph id="H9F0663F27D2C41A29B3A1AB963B1890D"><enum>(B)</enum><text>projects that facilitate transportation improvements to enhance access to Federal or non-Federal public land and recreational opportunities in critically underserved communities.</text></subparagraph></paragraph><paragraph id="H31BC4262190545AFB3FC4D1E076841A7"><enum>(2)</enum><header>Administration</header><subparagraph id="H8CC71423F5454E0A87D9FED22CB809B0"><enum>(A)</enum><header>In general</header><text>The Secretary shall administer the program to assist eligible entities in the development of transportation connectors or routes in or serving, and related education materials for, critically underserved communities and Federal or non-Federal public land, waters, parkland, and monuments.</text></subparagraph><subparagraph id="HEF22E998C72E45508E831B2F067CCFB3"><enum>(B)</enum><header>Joint partnerships</header><text>The Secretary shall encourage joint partnership projects under the program, if available, among multiple agencies, including school districts, nonprofit organizations, metropolitan planning organizations, regional transportation authorities, transit agencies, and State and local governmental agencies (including park and recreation agencies and authorities) to enhance investment of public sources.</text></subparagraph><subparagraph id="H10A41D60116F4C43AE574A0A34D478D2"><enum>(C)</enum><header>Annual grant project proposal solicitation, review, and approval</header><clause id="H70B563553F124FC4AB627BE52B96BE98"><enum>(i)</enum><header>In general</header><text>The Secretary shall—</text><subclause id="H47E3CA6AF7E949658DF1869EE1084C06"><enum>(I)</enum><text>annually solicit the submission of project proposals for grants from eligible entities under the program; and</text></subclause><subclause id="H36A8F280088940E58F30477C791AC94A"><enum>(II)</enum><text>review each project proposal submitted under subclause (I) on a timeline established by the Secretary.</text></subclause></clause><clause id="HCA3D0BF2B33F4C52BCD185E1FA958EB5"><enum>(ii)</enum><header>Required elements for project proposal</header><text>A project proposal submitted under clause (i)(I) shall include—</text><subclause id="HF147F776D6D7479FADB04CF3711721E9"><enum>(I)</enum><text>a statement of the purposes of the project;</text></subclause><subclause id="HDA1AFF2A77EE4D538FAE513CA79034C6"><enum>(II)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subclause><subclause id="H5C25B38FC22D4C75BE9E56D66FB4F50C"><enum>(III)</enum><text>a description of the qualifications of the entity or individuals identified under subclause (II);</text></subclause><subclause id="HDB5164599959477F87A9B43B9451F9A9"><enum>(IV)</enum><text>a description of—</text><item id="H9E8A4BCEF6AE4244A4C54459E39BCF50"><enum>(aa)</enum><text>staffing and stakeholder engagement for the project;</text></item><item id="HC2FD0651B6824570BB61B6C414906417"><enum>(bb)</enum><text>the logistics of the project; and</text></item><item id="HBF452022001E46128A470691B228B042"><enum>(cc)</enum><text>anticipated outcomes of the project;</text></item></subclause><subclause id="H6B8EA3D0E932412A917AF88958F64BE3"><enum>(V)</enum><text>a proposed budget for the funds and time required to complete the project;</text></subclause><subclause id="HECCD4653909E4BFFBF01B7D217B53FCD"><enum>(VI)</enum><text>information regarding the source and amount of matching funding available for the project;</text></subclause><subclause id="HF6E8B4811C384322AE56AC94CFBF3619"><enum>(VII)</enum><text>information that demonstrates the clear potential of the project to contribute to increased access to parkland for critically underserved communities; and</text></subclause><subclause id="H5CF363A3CA504ADC847AD99BFFCE81EB"><enum>(VIII)</enum><text>any other information that the Secretary considers to be necessary for evaluating the eligibility of the project for funding under the program.</text></subclause></clause><clause id="H3E469CAB0D364114917F54F90DB3627D"><enum>(iii)</enum><header>Consultation; approval or disapproval</header><text>The Secretary shall, with respect to each project proposal submitted under this subparagraph, as appropriate—</text><subclause id="HB073A15A79A94309B6076599FB37CB34"><enum>(I)</enum><text>consult with the government of each State in which the proposed project is to be conducted;</text></subclause><subclause id="HCD517C5AB41745D8A1E6B5D8F726D40F"><enum>(II)</enum><text>after taking into consideration any comments resulting from the consultation under subclause (I), approve or disapprove the proposal; and</text></subclause><subclause id="H97C23282C77D40FEAF49350A9769DF20"><enum>(III)</enum><text>provide written notification of the approval or disapproval to—</text><item id="H9776145D61D147998AC6BA539E5D25B8"><enum>(aa)</enum><text>the individual or entity that submitted the proposal; and</text></item><item id="HF9BAF4203BA74900860887F7240F1E24"><enum>(bb)</enum><text>each State consulted under subclause (I).</text></item></subclause></clause></subparagraph><subparagraph id="HC120A18FCF6F47E9B6ACDBFE806DE403"><enum>(D)</enum><header>Priority</header><text>To the extent practicable, in determining whether to approve project proposals under the program, the Secretary shall prioritize projects that are designed to increase access and mobility to local or neighborhood Federal or non-Federal public land, waters, parkland, monuments, or recreational opportunities.</text></subparagraph></paragraph><paragraph id="HB18114528D1E493C8DDA7500B8EAE611"><enum>(3)</enum><header>Transportation planning procedures</header><subparagraph id="HE48115ABE1A545D9958C33B21A9C41F0"><enum>(A)</enum><header>Procedures</header><text>In consultation with the head of each appropriate Federal land management agency, the Secretary shall develop, by rule, transportation planning procedures for projects conducted under the program that are consistent with metropolitan and statewide planning processes.</text></subparagraph><subparagraph id="HBF325F7C69B34F76AF9400033B53C21B"><enum>(B)</enum><header>Requirements</header><text>All projects carried out under the program shall be developed in cooperation with States and metropolitan planning organizations.</text></subparagraph></paragraph><paragraph id="H4D395D0D78BE44018B8E7DB6B1D87F55"><enum>(4)</enum><header>Non-Federal contributions</header><subparagraph id="HF349C0E54A2D4F2390B7E4DB6EF6657A"><enum>(A)</enum><header>In general</header><text>As a condition of receiving a grant under the program, an eligible entity shall provide funds in the form of cash or an in-kind contribution in an amount equal to not less than 100 percent of the amount of the grant.</text></subparagraph><subparagraph id="HF55E456906F3410685DFF5614F27DE69"><enum>(B)</enum><header>Sources</header><text>The non-Federal contribution required under subparagraph (A) may include amounts made available from State, local, nongovernmental, or private sources.</text></subparagraph></paragraph><paragraph id="HF3B06D5F905C4CCB8564B9A010F105C8"><enum>(5)</enum><header>Eligible uses</header><text>Grant funds provided under the program may be used—</text><subparagraph id="H7C37807515D0478882A07E3CC5BADE84"><enum>(A)</enum><text>to develop transportation connectors or routes in or serving, and related education materials for, critically underserved communities to increase access and mobility to Federal and non-Federal public land, waters, parkland, and monuments; and</text></subparagraph><subparagraph id="HC5D8137F803A40D898D9F15F6E674AA9"><enum>(B)</enum><text>to create or significantly enhance access to Federal or non-Federal public land and recreational opportunities in an urban area or a rural area.</text></subparagraph></paragraph><paragraph id="HEDF09E63ED5244D3A1F0400A7AC39076"><enum>(6)</enum><header>Grant amount</header><text>A grant provided under the program shall be—</text><subparagraph id="H42744DC3B6FB4DD8B3D8F7F16D888C02"><enum>(A)</enum><text>not less than $25,000; and</text></subparagraph><subparagraph id="H439DBBF3059941D6B3B08639BEC3C820"><enum>(B)</enum><text>not more than $500,000.</text></subparagraph></paragraph><paragraph id="H5FB8FF838B324144B0E50CB08709CA4B"><enum>(7)</enum><header>Technical assistance</header><text>It is the intent of Congress that grants provided under the program deliver project funds to areas of greatest need while offering technical assistance to all applicants and potential applicants for grant preparation to encourage full participation in the program.</text></paragraph><paragraph id="HC1A7B33A969F46E5B0CB93E85672D216"><enum>(8)</enum><header>Public information</header><text>The Secretary shall ensure that current schedules and routes for transportation systems developed after the receipt of a grant under the program are available to the public, including on a website maintained by the recipient of a grant.</text></paragraph></subsection><subsection id="HF556F29D74C54382AD7BBBC98F1682DF"><enum>(c)</enum><header>Reporting requirement</header><paragraph id="H576A263B3A9643E1BE442450894BB432"><enum>(1)</enum><header>Reports by grant recipients</header><text>The Secretary shall require a recipient of a grant under the program to submit to the Secretary at least 1 performance and financial report that—</text><subparagraph id="H6176B3899B6F48838201C478AFB7945A"><enum>(A)</enum><text>includes—</text><clause id="HD0E1477043D44A8ABCAD9EEF1982CE10"><enum>(i)</enum><text>demographic data on communities served by the project; and</text></clause><clause id="H4EC9D039561D46B49A76B6CDB31BED4B"><enum>(ii)</enum><text>a summary of project activities conducted after receiving the grant; and</text></clause></subparagraph><subparagraph id="H5CA54EC8947F44CDAFE977031EDC427F"><enum>(B)</enum><text>describes the status of each project funded by the grant as of the date of the report.</text></subparagraph></paragraph><paragraph id="HB764A6875512460699F23217490D5CDC"><enum>(2)</enum><header>Additional reports</header><text>In addition to the report required under paragraph (1), the Secretary may require additional reports from a recipient, as the Secretary determines to be appropriate, including a final report.</text></paragraph><paragraph id="H3B56AD600B924C6DB03A4917C4D60B4C"><enum>(3)</enum><header>Deadlines</header><text>The Secretary shall establish deadlines for the submission of each report required under paragraph (1) or (2).</text></paragraph></subsection><subsection id="HEDE7516E90DA4418852ECE241F6AEB73"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each fiscal year.</text></subsection></section><section id="HDEBE7A4DF12D4DDE8C56B4964F912BF0"><enum>13.</enum><header>Repeal of sunset for the Every Kid Outdoors program</header><text display-inline="no-display-inline">Section 9001(b) of the John D. Dingell, Jr. Conservation, Management, and Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6804">16 U.S.C. 6804</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/9">Public Law 116–9</external-xref>) is amended by striking paragraph (5).</text></section><section id="id42a704bcf3b54907986c4e739a400225"><enum>14.</enum><header>Protections for environmental justice communities against harmful Federal actions</header><subsection id="id59de67e145b145c891babea3dd85e1bd"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to establish additional protections relating to Federal actions affecting environmental justice communities in recognition of the disproportionate burden of adverse human health or environmental effects faced by such communities.</text></subsection><subsection id="idefb22eadc2b041a786a65d86a5797569"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idfd2d50fd028f4ae88b106cf8a5e1d8fb"><enum>(1)</enum><header>Environmental impact statement</header><text>The term <term>environmental impact statement</term> means the detailed statement of environmental impacts of a proposed action required to be prepared pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.). </text></paragraph><paragraph id="id8067da22f4764faaab8933f0fe814f19"><enum>(2)</enum><header>Federal action</header><text>The term <term>Federal action</term> means a proposed action that requires the preparation of an environmental impact statement, environmental assessment, categorical exclusion, or other document under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></paragraph></subsection><subsection id="id749a5fb91c53451996f804192e3b1305"><enum>(c)</enum><header>Preparation of a community impact report</header><text>A Federal agency proposing to take a Federal action that has the potential to cause negative environmental or public health impacts on an environmental justice community shall prepare a community impact report assessing the potential impacts of the proposed action.</text></subsection><subsection id="id65dd84462720474e9b6ba4ea381364a5"><enum>(d)</enum><header>Contents</header><text>A community impact report described in subsection (c) shall—</text><paragraph id="id64e1dbc134d0410b8c3b9992461c9760"><enum>(1)</enum><text>assess the degree to which a proposed Federal action affecting an environmental justice community will cause multiple or cumulative exposure to human health and environmental hazards that influence, exacerbate, or contribute to adverse health outcomes;</text></paragraph><paragraph id="idbc73b2b2d89e498d8cb04308e900df9c"><enum>(2)</enum><text>assess relevant public health data and industry data concerning the potential for multiple or cumulative exposure to human health or environmental hazards in the area of the environmental justice community and historical patterns of exposure to environmental hazards and Federal agencies shall assess these multiple, or cumulative effects, even if certain effects are not within the control or subject to the discretion of the Federal agency proposing the Federal action;</text></paragraph><paragraph id="id3da44f26b0224cd3a0738cdfd3639fe4"><enum>(3)</enum><text>assess the impact of such proposed Federal action on such environmental justice community’s ability to access public parks, outdoor spaces, and public recreation opportunities;</text></paragraph><paragraph id="id7582c6b1a4fe495da71f59ec22828943"><enum>(4)</enum><text>evaluate alternatives to or mitigation measures for the proposed Federal action that will—</text><subparagraph id="id20af2f67e7de42e2a4fcfc1ec3cb739a"><enum>(A)</enum><text>eliminate or reduce any identified exposure to human health and environmental hazards described in paragraph (1) to a level that is reasonably expected to avoid human health impacts in environmental justice communities; and</text></subparagraph><subparagraph id="idf07bebbb68fb4812aadedcbf6c8028f8"><enum>(B)</enum><text>not negatively impact an environmental justice community’s ability to access public parks, outdoor spaces, and public recreation opportunities; and</text></subparagraph></paragraph><paragraph id="id985377baad2048d3adda2edb3a617993"><enum>(5)</enum><text>analyze any alternative developed by members of an affected environmental justice community that meets the purpose and need of the proposed action.</text></paragraph></subsection><subsection id="idc4bcdff1c04649829263a73538555dfe"><enum>(e)</enum><header>Delegation</header><text>Federal agencies shall not delegate responsibility for the preparation of a community impact report described in subsection (c) to any other entity.</text></subsection><subsection id="id881699ca590341ae915e32e0e482b75c"><enum>(f)</enum><header>National environmental policy act requirements for environmental justice communities</header><text>When carrying out the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) for a proposed Federal action that may affect an environmental justice community, a Federal agency shall—</text><paragraph id="idac5cd3625dd144018d8e3d54ff052218"><enum>(1)</enum><text>consider all potential direct, indirect, and cumulative impacts caused by the action, alternatives to such action, and mitigation measures on the environmental justice community required by that Act;</text></paragraph><paragraph id="id0c75477bd528485d81744d37d035addd"><enum>(2)</enum><text>require any public comment period carried out during the scoping phase of the environmental review process to be not less than 90 days;</text></paragraph><paragraph id="id99c0a984ac784f289eba340e7053efea"><enum>(3)</enum><text>provide early and meaningful community involvement opportunities by—</text><subparagraph id="id8ce51b148ca141ca933984ec6106040c"><enum>(A)</enum><text>holding multiple hearings in such community regarding the proposed Federal action in each prominent language within the environmental justice community; and</text></subparagraph><subparagraph id="idef297bf9f43646bebbcf937e6d7567bb"><enum>(B)</enum><text>providing notice of any step or action in the process under that Act that involves public participation to any representative entities or organizations present in the environmental justice community, including—</text><clause id="id5c3a8cd1bea74e5699c89663b131ceb9"><enum>(i)</enum><text>local religious organizations;</text></clause><clause id="id590606fff46a484aa964d7c6584a648e"><enum>(ii)</enum><text>civic associations and organizations;</text></clause><clause id="id6441894b31594e89a8245dfba4e82408"><enum>(iii)</enum><text>business associations of people of color;</text></clause><clause id="idce3e7c10974749ec82ce815a27536e4a"><enum>(iv)</enum><text>environmental and environmental justice organizations, including community-based grassroots organizations led by people of color;</text></clause><clause id="id4bc46eb7a4ac4643bb097fe00a9d14d3"><enum>(v)</enum><text>homeowners’, tenants’, and neighborhood watch groups;</text></clause><clause id="id726a631abe30482aae7a9414109d5056"><enum>(vi)</enum><text>local governments and Tribal Governments;</text></clause><clause id="id10f68d578c464c4287d35cebf859382e"><enum>(vii)</enum><text>rural cooperatives;</text></clause><clause id="id9030cf7b41e844489cd90d1e7ef3aa1e"><enum>(viii)</enum><text>business and trade organizations;</text></clause><clause id="ideb860f1fe21941d6b94b60617d31937e"><enum>(ix)</enum><text>community and social service organizations;</text></clause><clause id="id5f77c0914fcf45d0bbc1bb844285d70d"><enum>(x)</enum><text>universities, colleges, and vocational schools;</text></clause><clause id="id79d04d9d5e974ac6b84d0203e95c6f68"><enum>(xi)</enum><text>labor and other worker organizations;</text></clause><clause id="idd7b7359ac56f428ca2b35071119ee879"><enum>(xii)</enum><text>civil rights organizations;</text></clause><clause id="idd2d65f4cf6994f42965e61d5bac0e799"><enum>(xiii)</enum><text>senior citizens’ groups; and</text></clause><clause id="id1038535bec794a1babe0b9847adab2e0"><enum>(xiv)</enum><text>public health agencies and clinics; and</text></clause></subparagraph></paragraph><paragraph id="idace947f3ad784f15a09676a277db9398"><enum>(4)</enum><text>provide translations of publicly available documents made available pursuant to that Act in any language spoken by more than 5 percent of the population residing within the environmental justice community.</text></paragraph></subsection><subsection id="id3dacaf13ecd04a17bf276c207516b281"><enum>(g)</enum><header>Communication methods and requirements</header><text>Any notice provided under subsection (f)(3)(B) shall be provided—</text><paragraph id="id075c522daf084a65bb57e0d157d98ff5"><enum>(1)</enum><text>through communication methods that are accessible in the environmental justice community, which may include electronic media, newspapers, radio, direct mailings, canvassing, and other outreach methods particularly targeted at communities of color, low-income communities, and Tribal and Indigenous communities; and</text></paragraph><paragraph id="idf434bfc46d2e4670840faf247f05667c"><enum>(2)</enum><text>at least 30 days before any hearing in such community or the start of any public comment period.</text></paragraph></subsection><subsection id="id44907b2b3bdc49e6b90894ceeae49fcd"><enum>(h)</enum><header>Requirements for actions requiring an environmental impact statement</header><text>For any proposed Federal action affecting an environmental justice community requiring the preparation of an environmental impact statement, the Federal agency shall provide the following information when giving notice of the proposed action:</text><paragraph id="id10df9587925f45089c5ee11df5901e53"><enum>(1)</enum><text>A description of the proposed action.</text></paragraph><paragraph id="id2ce49ef9aec14041b8d8b080864d1402"><enum>(2)</enum><text>An outline of the anticipated schedule for completing the process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), with a description of key milestones.</text></paragraph><paragraph id="idc432fc4849c04aaaa94e8548c2410966"><enum>(3)</enum><text>An initial list of alternatives and potential impacts.</text></paragraph><paragraph id="id34439d70120e4d3d9c3ba60cff357460"><enum>(4)</enum><text>An initial list of other existing or proposed sources of multiple or cumulative exposure to environmental hazards that contribute to higher rates of serious illnesses within the environmental justice community.</text></paragraph><paragraph id="id8df1add8c47440ef8685d61098532388"><enum>(5)</enum><text>An agency point of contact.</text></paragraph><paragraph id="id066a520961774bdbb5d53e501126ea77"><enum>(6)</enum><text>Timely notice of locations where comments will be received or public meetings held.</text></paragraph><paragraph id="idbd2ed3806aad4e85b4602523bba26e5e"><enum>(7)</enum><text>Any telephone number or locations where further information can be obtained.</text></paragraph></subsection><subsection id="idd8e5c4a114394e92b87516c2dca3b402"><enum>(i)</enum><header>National environmental policy act requirements for indian tribes</header><text>When carrying out the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) for a proposed Federal action that may affect an Indian Tribe, a Federal agency shall—</text><paragraph id="id6a2d70fbfe88471d8e173e27d0c5281a"><enum>(1)</enum><text>seek Tribal representation in the process in a manner that is consistent with the government-to-government relationship between the United States and Tribal Governments, the Federal Government’s trust responsibility to federally recognized Indian Tribes, and any treaty rights;</text></paragraph><paragraph id="iddaa15277595f40598bb76d3070290cef"><enum>(2)</enum><text>ensure that an Indian Tribe is invited to hold the status of a cooperating agency throughout the process under that Act for any proposed action that could impact an Indian Tribe, including actions that could impact off reservation lands and sacred sites; and</text></paragraph><paragraph id="id481c444840284132bdd1b56e9c6cd06f"><enum>(3)</enum><text>invite an Indian Tribe to hold the status of a cooperating agency in accordance with paragraph (2) not later than the date on which the scoping process for a proposed action requiring the preparation of an environmental impact statement commences.</text></paragraph></subsection><subsection id="id5fa6dd689f4a4e38bcbcc9367e3809b9"><enum>(j)</enum><header>Agency determinations</header><text>Federal agency determinations about the analysis of a community impact report described in subsection (c) shall be subject to judicial review to the same extent as any other analysis performed under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></subsection><subsection id="id3d54d0e0910647b08f0c1148e8842917"><enum>(k)</enum><header>Effective date</header><text>This section shall take effect 1 year after the date of enactment of this Act.</text></subsection><subsection id="id0526dd9c3c92421d9550c9d5bd4f5987"><enum>(l)</enum><header>Savings clause</header><text>Nothing in this section diminishes—</text><paragraph id="idd7b38c5bfbfd47cdbb89388a3a03339d"><enum>(1)</enum><text>any right granted through the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) to the public; or</text></paragraph><paragraph id="id2861fd98819f41bc97ef7fcb3fac8770"><enum>(2)</enum><text>the requirements under that Act to consider direct, indirect, and cumulative impacts.</text></paragraph></subsection></section><section commented="no" id="HF1FB60B5B0EB4DD8AE4188F7A19BF36C"><enum>15.</enum><header>Training of employees of Federal agencies</header><subsection commented="no" id="H700ABD99A47C49439B7BCC9F601F0946"><enum>(a)</enum><header>Initial training</header><text>Not later than 1 year after the date of enactment of this Act, each employee of the Department of Energy, the Environmental Protection Agency, the Department of the Interior, and the National Oceanic and Atmospheric Administration shall complete an environmental justice training program to ensure that each such employee—</text><paragraph commented="no" id="H694D41AEAAE24FEA82712EDC39FC334C"><enum>(1)</enum><text>has received training in environmental justice; and</text></paragraph><paragraph commented="no" id="HB181D32BB9494059BB547527AE85FE3F"><enum>(2)</enum><text>is capable of—</text><subparagraph commented="no" id="H17F3EDF5FD0E475C96F316D90A0C3E8E"><enum>(A)</enum><text>appropriately incorporating environmental justice concepts into the daily activities of the employee; and</text></subparagraph><subparagraph commented="no" id="HC7BED8D8495D4D4D9094B7311C657BCD"><enum>(B)</enum><text>increasing the meaningful participation of individuals from environmental justice communities in the activities of the applicable agency.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H6DCC1C5EF74B48F8B4F9882F719AF956"><enum>(b)</enum><header>Mandatory participation</header><text display-inline="yes-display-inline">Effective on the date that is 1 year after the date of enactment of this Act, each individual hired by the Department of Energy, the Environmental Protection Agency, the Department of the Interior, and the National Oceanic and Atmospheric Administration after that date shall be required to participate in environmental justice training.</text></subsection><subsection commented="no" id="H881BC5E1BB27451F89325709D87DEF29"><enum>(c)</enum><header>Requirement relating to certain employees</header><paragraph commented="no" id="H9EDDE6B9F9D0430B9125DBB119775085"><enum>(1)</enum><header>In general</header><text>With respect to each Federal agency that participates in the Working Group, not later than 30 days after the date on which an individual is appointed to the position of environmental justice coordinator, Environmental Justice Ombuds, or any other position the responsibility of which involves the conducting of environmental justice activities, the individual shall be required to possess documentation of the completion by the individual of environmental justice training.</text></paragraph><paragraph commented="no" id="HD319943B3A6C42D682E43AD3E7C70D57"><enum>(2)</enum><header>Effect</header><text>If an individual described in paragraph (1) fails to meet the requirement described in that paragraph, the Federal agency at which the individual is employed shall transfer the individual to a different position until the date on which the individual completes environmental justice training.</text></paragraph><paragraph commented="no" id="HC30681D17B464B23BEC0E8C2C1F21737"><enum>(3)</enum><header>Evaluation</header><text>Not later than 3 years after the date of enactment of this Act, the Inspector General of each Federal agency that participates in the Working Group shall evaluate the training programs of such Federal agency to determine if such Federal agency has improved the rate of training of the employees of such Federal agency to ensure that each employee has received environmental justice training.</text></paragraph></subsection></section><section commented="no" id="H988A083E555E451FBFEF77237B8AC9E9"><enum>16.</enum><header>Environmental justice grant programs</header><subsection commented="no" id="HAF8B9759F7004BB6A2D6D2F4E8B2C2C5"><enum>(a)</enum><header>Environmental justice community grant program</header><paragraph commented="no" id="HE5DF90D836AB4B0CBF4E882FB3E5BB2E"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish a program under which the Administrator shall provide grants to eligible entities to assist the eligible entities in—</text><subparagraph commented="no" id="H4B0E74F4E98C49B090D1E3705880DC9B"><enum>(A)</enum><text>building capacity to address issues relating to environmental justice; and</text></subparagraph><subparagraph commented="no" id="HBF48CAF382054A07BF783DB81C40ACE5"><enum>(B)</enum><text>carrying out any activity described in paragraph (4).</text></subparagraph></paragraph><paragraph commented="no" id="H5DD025C345364BF394D72A2370B42A9A"><enum>(2)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under paragraph (1), an eligible entity shall be a nonprofit, community-based organization that conducts activities, including providing medical and preventive health services, to reduce the disproportionate health impacts of environmental pollution in the environmental justice community at which the eligible entity proposes to conduct an activity that is the subject of the application described in paragraph (3).</text></paragraph><paragraph commented="no" id="H112CA763D12B4682BE2A0DF7D1311EE9"><enum>(3)</enum><header>Application</header><text>To be eligible to receive a grant under paragraph (1), an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><subparagraph commented="no" id="HB95C3FA1520E4318BF37A618B2B5CDAA"><enum>(A)</enum><text>an outline describing the means by which the project proposed by the eligible entity will—</text><clause commented="no" id="H7A2E99B69FE4487E9186652B2B7C6F68"><enum>(i)</enum><text>with respect to environmental and public health issues at the local level, increase the understanding of the environmental justice community at which the eligible entity will conduct the project;</text></clause><clause commented="no" id="HCDB4198F7F394E2697FFB97EA78B2481"><enum>(ii)</enum><text>improve the ability of the environmental justice community to address each issue described in clause (i); </text></clause><clause commented="no" id="HE44172F1FC794C25AA00374D15D407CE"><enum>(iii)</enum><text>facilitate collaboration and cooperation among various stakeholders (including members of the environmental justice community); and</text></clause><clause commented="no" id="HA6E87FD90992412BABDBEC09963FEC7B"><enum>(iv)</enum><text display-inline="yes-display-inline">support the ability of the environmental justice community to proactively plan and implement just sustainable community development and revitalization initiatives, including countering displacement and gentrification;</text></clause></subparagraph><subparagraph commented="no" id="H18F9A47A5A704089A5D7265E04F6C400"><enum>(B)</enum><text>a proposed budget for each activity of the project that is the subject of the application;</text></subparagraph><subparagraph commented="no" id="HD4440D5087EF4E69A1CB366263BBE5FE"><enum>(C)</enum><text>a list of proposed outcomes with respect to the proposed project;</text></subparagraph><subparagraph commented="no" id="H4E5B2B9F1D7249498DB8462C6BA6542A"><enum>(D)</enum><text>a description of the ways by which the eligible entity may leverage the funds of the eligible entity, or the funds made available through a grant under this subsection, to develop a project that is capable of being sustained beyond the period of the grant; and</text></subparagraph><subparagraph commented="no" id="H96618F2934764011AF2F76BD1D62C238"><enum>(E)</enum><text>a description of the ways by which the eligible entity is linked to, and representative of, the environmental justice community at which the eligible entity will conduct the project.</text></subparagraph></paragraph><paragraph commented="no" id="H22243E5A511E480184F104155B437822"><enum>(4)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity may only use a grant under this subsection to carry out culturally and linguistically appropriate projects and activities that are driven by the needs, opportunities, and priorities of the environmental justice community at which the eligible entity proposes to conduct the project or activity to address environmental justice concerns and improve the health or environment of the environmental justice community, including activities—</text><subparagraph commented="no" id="H16FD8215967C4D15A131F4E72A09C009"><enum>(A)</enum><text>to create or develop collaborative partnerships;</text></subparagraph><subparagraph commented="no" id="H76AE503F06C94F16A16955B01584D1E5"><enum>(B)</enum><text>to educate and provide outreach services to the environmental justice community;</text></subparagraph><subparagraph commented="no" id="H4C53EC0CC6964BF2AA814F47F06FDC48"><enum>(C)</enum><text>to identify and implement projects to address environmental or public health concerns; or</text></subparagraph><subparagraph commented="no" id="H5AD3C57A5976446E85160114E381344D"><enum>(D)</enum><text>to develop a comprehensive understanding of environmental or public health issues.</text></subparagraph></paragraph><paragraph commented="no" id="H055A7C8A74304B4BA574B3F0B61AFEBC"><enum>(5)</enum><header>Report</header><subparagraph commented="no" id="HF6B850354B9947FC9DB1691DBDB2D6B0"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives and the Committees on Environment and Public Works and Energy and Natural Resources of the Senate a report describing the ways by which the grant program under this subsection has helped community-based nonprofit organizations address issues relating to environmental justice.</text></subparagraph><subparagraph commented="no" id="H1CB8441BAFE34EA5B13AB2C156BB4A3B"><enum>(B)</enum><header>Public availability</header><text>The Administrator shall make each report required under subparagraph (A) available to the public (including by posting a copy of the report on the website of the Environmental Protection Agency).</text></subparagraph></paragraph><paragraph commented="no" id="H871B9378751E4A7EBF24F0BF1A4AFC98"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $25,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><subsection commented="no" id="H14D69774329540DDAE8A88FE3F50F140"><enum>(b)</enum><header>State grant program</header><paragraph commented="no" id="HA6466B043D87482EB38FA4A350ED00B0"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish a program under which the Administrator shall provide grants to States to enable the States—</text><subparagraph commented="no" id="HBAF10CAB32064670B2A493D3316A2C19"><enum>(A)</enum><text>to establish culturally and linguistically appropriate protocols, activities, and mechanisms for addressing issues relating to environmental justice; and</text></subparagraph><subparagraph commented="no" id="H5CC47228CBDE419691E94B240A4BEFEA"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out culturally and linguistically appropriate activities to reduce or eliminate disproportionately adverse human health or environmental effects on environmental justice communities in the State, including reducing economic vulnerabilities that result in the environmental justice communities being disproportionately affected.</text></subparagraph></paragraph><paragraph commented="no" id="HB8C029AC097849EFB6457B6B2FCEECC4"><enum>(2)</enum><header>Eligibility</header><subparagraph commented="no" id="H8F634817F15849C89489B20CB0C23F51"><enum>(A)</enum><header>Application</header><text>To be eligible to receive a grant under paragraph (1), a State shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><clause commented="no" id="HA66AE530EE9045199D9D6F48B4AEB68C"><enum>(i)</enum><text>a plan that contains a description of the means by which the funds provided through a grant under paragraph (1) will be used to address issues relating to environmental justice at the State level; and</text></clause><clause commented="no" id="HA8C43A6EAB954C68BD062905EA9DBC36"><enum>(ii)</enum><text>assurances that the funds provided through a grant under paragraph (1) will be used only to supplement the amount of funds that the State allocates for initiatives relating to environmental justice.</text></clause></subparagraph><subparagraph commented="no" id="HFAC92F3687624A298DEEECC851F87CB6"><enum>(B)</enum><header>Ability to continue program</header><text>To be eligible to receive a grant under paragraph (1), a State shall demonstrate to the Administrator that the State has the ability to continue each program that is the subject of funds provided through a grant under paragraph (1) after receipt of the funds.</text></subparagraph></paragraph><paragraph commented="no" id="HF1AE52D6486E46B2884AB0EC849FAB2A"><enum>(3)</enum><header>Report</header><subparagraph commented="no" id="H13B4732679494C918F6EFF87FA7FF10A"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives and the Committees on Environment and Public Works and Energy and Natural Resources of the Senate a report describing—</text><clause commented="no" id="H75C864CA0AD74B0AB200DDC42DB690BA"><enum>(i)</enum><text>the implementation of the grant program established under paragraph (1);</text></clause><clause commented="no" id="H89C4BF64872E402CB2FCB862585FDFF2"><enum>(ii)</enum><text>the impact of the grant program on improving the ability of each participating State to address environmental justice issues; and</text></clause><clause commented="no" id="H4CF52E5D8D83486EB4DDE7135501DC39"><enum>(iii)</enum><text>the activities carried out by each State to reduce or eliminate disproportionately adverse human health or environmental effects on environmental justice communities in the State.</text></clause></subparagraph><subparagraph commented="no" id="HF49B2542696D4AFFB7E7EE865572D0D5"><enum>(B)</enum><header>Public availability</header><text>The Administrator shall make each report required under subparagraph (A) available to the public (including by posting a copy of the report on the website of the Environmental Protection Agency).</text></subparagraph></paragraph><paragraph commented="no" id="HA6C70714D605478D9E7E0AB9F1507646"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $15,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><subsection commented="no" id="H6A764FD7E34F4885AB9475AB99EBA8E3"><enum>(c)</enum><header>Tribal grant program</header><paragraph commented="no" id="H95A993B4442B47DA953BC2D8469DDE65"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish a program under which the Administrator shall provide grants to Tribal Governments to enable the Indian Tribes—</text><subparagraph commented="no" id="H95CD28A0BC134BFEA34E6E073E8352F5"><enum>(A)</enum><text>to establish culturally and linguistically appropriate protocols, activities, and mechanisms for addressing issues relating to environmental justice; and</text></subparagraph><subparagraph commented="no" id="H6BB76053934D48C7810622E19BBA7B5E"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out culturally and linguistically appropriate activities to reduce or eliminate disproportionately adverse human health or environmental effects on environmental justice communities in Tribal and Indigenous communities, including reducing economic vul­ner­a­bil­i­ties that result in the Tribal and Indigenous communities being disproportionately affected.</text></subparagraph></paragraph><paragraph commented="no" id="HF575CF31F83746EDB7A0D28D3EF27558"><enum>(2)</enum><header>Eligibility</header><subparagraph commented="no" id="H846D767A99B04D518FDA792ABED2179A"><enum>(A)</enum><header>Application</header><text>To be eligible to receive a grant under paragraph (1), a Tribal Government shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><clause commented="no" id="H74878034B9114351A2C6325282AA67C9"><enum>(i)</enum><text>a plan that contains a description of the means by which the funds provided through a grant under paragraph (1) will be used to address issues relating to environmental justice in Tribal and Indigenous communities; and</text></clause><clause commented="no" id="H3FFE0643FBA4489C8474CC587832C7A6"><enum>(ii)</enum><text>assurances that the funds provided through a grant under paragraph (1) will be used only to supplement the amount of funds that the Tribal Government allocates for initiatives relating to environmental justice.</text></clause></subparagraph><subparagraph commented="no" id="H3BD9D26C7A614C0C9986A465AAE2E9E9"><enum>(B)</enum><header>Ability to continue program</header><text>To be eligible to receive a grant under paragraph (1), a Tribal Government shall demonstrate to the Administrator that the Tribal Government has the ability to continue each program that is the subject of funds provided through a grant under paragraph (1) after receipt of the funds.</text></subparagraph></paragraph><paragraph commented="no" id="H9EB1CA65C1F44E1C9F1C3A29F7D5F675"><enum>(3)</enum><header>Report</header><subparagraph commented="no" id="HD968486A44724733BE4F388BC133C086"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives and the Committees on Environment and Public Works and Energy and Natural Resources of the Senate a report describing—</text><clause commented="no" id="HF7555292503F4D0F90F6C7EB7E4DAC24"><enum>(i)</enum><text>the implementation of the grant program established under paragraph (1);</text></clause><clause commented="no" id="H497028514E324ABCB577BEFEBD69BCE7"><enum>(ii)</enum><text>the impact of the grant program on improving the ability of each participating Indian Tribe to address environmental justice issues; and</text></clause><clause commented="no" id="HE772DA7B64574DFB878B15DB0E0DC85E"><enum>(iii)</enum><text>the activities carried out by each Tribal Government to reduce or eliminate disproportionately adverse human health or environmental effects on applicable environmental justice communities in Tribal and Indigenous communities.</text></clause></subparagraph><subparagraph commented="no" id="H190D7BFA56F24046A91F083E12D678CD"><enum>(B)</enum><header>Public availability</header><text>The Administrator shall make each report required under subparagraph (A) available to the public (including by posting a copy of the report on the website of the Environmental Protection Agency).</text></subparagraph></paragraph><paragraph commented="no" id="HF5139912C7904D7CB81367C13B51BE22"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $25,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><subsection commented="no" id="H2896679542AD4E3488DB486C7F30DB8D"><enum>(d)</enum><header>Community-Based participatory research grant program</header><paragraph commented="no" id="H41CB11B55BA148CF827E6A6A88116BDE"><enum>(1)</enum><header>Establishment</header><text>The Administrator, in consultation with the Director, shall establish a program under which the Administrator shall provide not more than 25 multiyear grants to eligible entities to carry out community-based participatory research—</text><subparagraph commented="no" id="H6AF320C4FFBD4CA78E0AA0338868308E"><enum>(A)</enum><text>to address issues relating to environmental justice;</text></subparagraph><subparagraph commented="no" id="HD0C6435002054CBC9CFDF18023F46120"><enum>(B)</enum><text>to improve the environment of residents and workers in environmental justice communities; and</text></subparagraph><subparagraph commented="no" id="H59A1A6B2C7E14C1FBDC27C37AA8AAA1A"><enum>(C)</enum><text>to improve the health outcomes of residents and workers in environmental justice communities.</text></subparagraph></paragraph><paragraph commented="no" id="HAC23AADF28204876B3CB250961AA742E"><enum>(2)</enum><header>Eligibility</header><text>To be eligible to receive a multiyear grant under paragraph (1), an eligible entity shall be a partnership composed of—</text><subparagraph commented="no" id="H19AA5D5CD921493B820405AD8C78FBD4"><enum>(A)</enum><text>an accredited institution of higher education; and</text></subparagraph><subparagraph commented="no" id="H00747AFB426E42F490C1B34454471949"><enum>(B)</enum><text>a community-based organization.</text></subparagraph></paragraph><paragraph commented="no" id="H49FED274D5334DD3BC78ACD277692E4C"><enum>(3)</enum><header>Application</header><text>To be eligible to receive a multiyear grant under paragraph (1), an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><subparagraph commented="no" id="H424D3B66643A419186DC006B4D754B5A"><enum>(A)</enum><text>a detailed description of the partnership of the eligible entity that, as determined by the Administrator, demonstrates the participation of members of the community at which the eligible entity proposes to conduct the research; and</text></subparagraph><subparagraph commented="no" id="H4E6E2051ACDC4A3DB81F28DC81609B1E"><enum>(B)</enum><text>a description of—</text><clause commented="no" id="H66A6B7AC335D48A8894F59F19B519DB1"><enum>(i)</enum><text>the project proposed by the eligible entity; and</text></clause><clause commented="no" id="H6E08B0FD738842A5AA4CD2C1AC04F71D"><enum>(ii)</enum><text>the ways by which the project will—</text><subclause commented="no" id="HF50DC5EDC1344A959C915272FE67B4E8"><enum>(I)</enum><text>address issues relating to environmental justice;</text></subclause><subclause commented="no" id="H10AEE53B149243438E50A066C64DC0F5"><enum>(II)</enum><text display-inline="yes-display-inline">assist in the improvement of health outcomes of residents and workers in environmental justice communities; and</text></subclause><subclause commented="no" id="HA5380F0D6FD34B749AE75CC83C489CB3"><enum>(III)</enum><text display-inline="yes-display-inline">assist in the improvement of the environment of residents and workers in environmental justice communities.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H13390464088847E79FD630613521F39E"><enum>(4)</enum><header>Public availability</header><text display-inline="yes-display-inline">The Administrator shall make the results of the grants provided under this subsection available to the public, including by posting on the website of the Environmental Protection Agency a copy of the grant awards and an annual report at the beginning of each fiscal year describing the research findings associated with each grant provided under this subsection. </text></paragraph><paragraph commented="no" id="HD1F371D6EC064EBF8966CED3A8237167"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection></section><section commented="no" id="H1A4440E658044BB1B764DEB0BF6CD998"><enum>17.</enum><header>Environmental justice basic training program</header><subsection commented="no" id="H6CAE66BE9EB24DFAB901BF5D3195B7C2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a basic training program, in coordination and consultation with nongovernmental environmental justice organizations, to increase the capacity of residents of environmental justice communities to identify and address disproportionately adverse human health or environmental effects by providing culturally and linguistically appropriate—</text><paragraph commented="no" id="H9D4B7042191D421FBB3D0720E6862B06"><enum>(1)</enum><text>training and education relating to—</text><subparagraph commented="no" id="H281801C9D9C245D0A0BF1C1278C9A206"><enum>(A)</enum><text>basic and advanced techniques for the detection, assessment, and evaluation of the effects of hazardous substances on human health;</text></subparagraph><subparagraph commented="no" id="HE8CBCBDA48B14D0DB271D9BB9F986EFA"><enum>(B)</enum><text>methods to assess the risks to human health presented by hazardous substances;</text></subparagraph><subparagraph commented="no" id="H5565D2E393514162A377C64A59F0C166"><enum>(C)</enum><text>methods and technologies to detect hazardous substances in the environment; </text></subparagraph><subparagraph commented="no" id="H02AEBB4E7F65415EA37CD6A4CF8D3E31"><enum>(D)</enum><text>basic biological, chemical, and physical methods to reduce the quantity and toxicity of hazardous substances; </text></subparagraph><subparagraph commented="no" id="H037C33ED6BC5476D986A00D6BB02DE16"><enum>(E)</enum><text>the rights and safeguards currently afforded to individuals through policies and laws intended to help environmental justice communities address disparate impacts and discrimination, including—</text><clause commented="no" id="HB4D89FEE8EA34B9CAC6FDA0DDEF18E46"><enum>(i)</enum><text>environmental laws; and</text></clause><clause commented="no" id="HDC3CA766C8A445D0B4D52797766D1363"><enum>(ii)</enum><text>section 602 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref>);</text></clause></subparagraph><subparagraph commented="no" id="H764F3B63B78C47408B55C582574DD828"><enum>(F)</enum><text>public engagement opportunities through the policies and laws described in subparagraph (E);</text></subparagraph><subparagraph commented="no" id="H561E09B317824F888EC81AAA2B65B184"><enum>(G)</enum><text>materials available on the Clearinghouse; </text></subparagraph><subparagraph commented="no" id="H7C46AAE22CA8453DBF246A5CFA5D4772"><enum>(H)</enum><text>methods to expand access to parks and other natural and recreational amenities; and</text></subparagraph><subparagraph commented="no" id="H9A2DFAD4A958404DB9345C9047FE0126"><enum>(I)</enum><text>finding and applying for Federal grants related to environmental justice; and</text></subparagraph></paragraph><paragraph commented="no" id="HFA0A965E1E794452A347A4908F7246E1"><enum>(2)</enum><text>short courses and continuation education programs for residents of communities who are located in close proximity to hazardous substances to provide—</text><subparagraph commented="no" id="H56DDB179F7CE42CD909AE4DC97F92EDF"><enum>(A)</enum><text>education relating to—</text><clause commented="no" id="H0127578E16B84BE0813941F5A0B590FB"><enum>(i)</enum><text>the proper manner to handle hazardous substances;</text></clause><clause commented="no" id="H432A30C8DCCA4915AB6E4DD4FDE794E5"><enum>(ii)</enum><text>the management of facilities at which hazardous substances are located (including facility compliance protocols); and</text></clause><clause commented="no" id="H726C2C1B7D1E45C2B9123CBE64EB91A4"><enum>(iii)</enum><text>the evaluation of the hazards that facilities described in clause (ii) pose to human health; and</text></clause></subparagraph><subparagraph commented="no" id="HA636BD90C1F248579A9AB635A6BE3A61"><enum>(B)</enum><text>training on environmental and occupational health and safety with respect to the public health and engineering aspects of hazardous waste control.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H025A209B22384024B83670A8D2AB512F"><enum>(b)</enum><header>Grant program</header><paragraph commented="no" id="H6A83FC7B2BA7458893234D28E3933E5C"><enum>(1)</enum><header>Establishment</header><text>In carrying out the basic training program established under subsection (a), the Administrator may provide grants to, or enter into any contract or cooperative agreement with, an eligible entity to carry out any training or educational activity described in subsection (a).</text></paragraph><paragraph commented="no" id="H28BD9085B8514B92851015A88955A02B"><enum>(2)</enum><header>Eligible entity</header><text>To be eligible to receive assistance under paragraph (1), an eligible entity shall be an accredited institution of education in partnership with—</text><subparagraph commented="no" id="HD4658C96CBC34D0EABC26261290505B0"><enum>(A)</enum><text>a community-based organization that carries out activities relating to environmental justice;</text></subparagraph><subparagraph commented="no" id="H271DE8D6276A4AE9BC55AE71A3BB7CBD"><enum>(B)</enum><text>a generator of hazardous waste;</text></subparagraph><subparagraph commented="no" id="HFF5D3D1D79AE40C7BD31582E3DF7A07B"><enum>(C)</enum><text display-inline="yes-display-inline">any individual who is involved in the detection, assessment, evaluation, or treatment of hazardous waste;</text></subparagraph><subparagraph commented="no" id="H5C4E41460F974C289ED94F8B4570F046"><enum>(D)</enum><text>any owner or operator of a facility at which hazardous substances are located; or</text></subparagraph><subparagraph commented="no" id="HAB7A0339FCA3405C9B6CA23E5A88812D"><enum>(E)</enum><text>any State government, Tribal Government, or local government.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H08EA0B0988AD45498970F5AD37B6D4B8"><enum>(c)</enum><header>Plan</header><paragraph commented="no" id="HA4DFFFA269C046AEA6C9BA47B824CA36"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in consultation with the Director, shall develop and publish in the Federal Register a plan to carry out the basic training program established under subsection (a).</text></paragraph><paragraph commented="no" id="HDA278082EEFD45778BA25DE2B917249C"><enum>(2)</enum><header>Contents</header><text>The plan described in paragraph (1) shall contain—</text><subparagraph commented="no" id="H3C8E9943E451450691151A07CDFF165C"><enum>(A)</enum><text>a list that describes the relative priority of each activity described in subsection (a); and</text></subparagraph><subparagraph commented="no" id="HBC5257F649834E568C29F20F397DD727"><enum>(B)</enum><text>a description of research and training relevant to environmental justice issues of communities adversely affected by pollution.</text></subparagraph></paragraph><paragraph commented="no" id="H75A086B755F64D568531159377FB0E7A"><enum>(3)</enum><header>Coordination with Federal agencies</header><text>The Administrator shall, to the maximum extent practicable, take appropriate steps to coordinate the activities of the basic training program described in the plan with the activities of other Federal agencies to avoid any duplication of effort.</text></paragraph></subsection><subsection commented="no" id="HE1C6E9CF72AA450E896A59C40D878C51"><enum>(d)</enum><header>Report</header><paragraph commented="no" id="HD2C641E84CC9436AB190896AC17F3F19"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Administrator shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives and the Committees on Environment and Public Works and Energy and Natural Resources of the Senate a report describing—</text><subparagraph commented="no" id="H82D27B0C09B94FEFB458F42A5068EF8D"><enum>(A)</enum><text>the implementation of the basic training program established under subsection (a); and</text></subparagraph><subparagraph commented="no" id="HA3850B5802BB43A4ACA90DD2794B5191"><enum>(B)</enum><text display-inline="yes-display-inline">the impact of the basic training program on improving training opportunities for residents of environmental justice communities.</text></subparagraph></paragraph><paragraph commented="no" id="H7E81CB8688DE42719F15C299216E72FF"><enum>(2)</enum><header>Public availability</header><text>The Administrator shall make the report required under paragraph (1) available to the public (including by posting a copy of the report on the website of the Environmental Protection Agency).</text></paragraph></subsection><subsection commented="no" id="HE2AF6CAAB75844119FB5CD708D725E0D"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><section commented="no" id="H2C8028F014DD4FE683E376DACF549C2D"><enum>18.</enum><header>National Environmental Justice Advisory Council</header><subsection commented="no" id="HC58287AF034F4B7986020181E859EF0F"><enum>(a)</enum><header>Establishment</header><text>The President shall establish an advisory council, to be known as the <quote>National Environmental Justice Advisory Council</quote>.</text></subsection><subsection commented="no" id="H96BBAFE66EEF49909565EA980BC614AF"><enum>(b)</enum><header>Membership</header><text>The Advisory Council shall be composed of 26 members who have knowledge of, or experience relating to, the effect of environmental conditions on communities of color, low-income communities, and Tribal and Indigenous communities, including—</text><paragraph commented="no" id="H95E9615BBCCA40CF8E10BA69E41770A1"><enum>(1)</enum><text>representatives of—</text><subparagraph commented="no" id="HD39B45DE313240B9A89717E4470FC591"><enum>(A)</enum><text display-inline="yes-display-inline">community-based organizations that carry out initiatives relating to environmental justice, including grassroots organizations led by people of color;</text></subparagraph><subparagraph commented="no" id="H8E18415FA01D4E47A006994AE90717D2"><enum>(B)</enum><text>State governments, Tribal Governments, and local governments;</text></subparagraph><subparagraph commented="no" id="H54E96651B942424599F6D8989825CE67"><enum>(C)</enum><text>Indian Tribes and other Indigenous groups;</text></subparagraph><subparagraph commented="no" id="H6F3DDA69D1CC439E9353AE482B414FC2"><enum>(D)</enum><text>nongovernmental and environmental organizations; and</text></subparagraph><subparagraph commented="no" id="H1E1A705B8D3143CE9BC4F45831F14222"><enum>(E)</enum><text>private sector organizations (including representatives of industries and businesses); and</text></subparagraph></paragraph><paragraph commented="no" id="HF8C58B7071DF47D998D335402E921BF6"><enum>(2)</enum><text>experts in the field of—</text><subparagraph commented="no" id="HA12EBF39E10349E08C5D0704E9A3AC03"><enum>(A)</enum><text>socioeconomic analysis;</text></subparagraph><subparagraph commented="no" id="HC9DAC56EFF2442E9A66357A24EED8378"><enum>(B)</enum><text>health and environmental effects;</text></subparagraph><subparagraph commented="no" id="HE2E6823C7DD84520955AE1A4BF4E910A"><enum>(C)</enum><text>exposure evaluation;</text></subparagraph><subparagraph commented="no" id="HD19145A24CDB48D5ACE2E2913CAEC06C"><enum>(D)</enum><text>environmental law and civil rights law; or</text></subparagraph><subparagraph commented="no" id="H8480016A567D4A03978FEDB9948472F0"><enum>(E)</enum><text>environmental health science research.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H8BFADFEE7AFB4BB1AFB6F044D0EA4FD8"><enum>(c)</enum><header>Subcommittees; workgroups</header><paragraph commented="no" id="H3BA454AA4E8A40D3B8F11845D4A074F3"><enum>(1)</enum><header>Establishment</header><text>The Advisory Council may establish any subcommittee or workgroup to assist the Advisory Council in carrying out any duty of the Advisory Council described in subsection (d).</text></paragraph><paragraph commented="no" id="H2827D6D10F6B43ABB6C315D090F80CBB"><enum>(2)</enum><header>Report</header><text>Upon the request of the Advisory Council, each subcommittee or workgroup established by the Advisory Council under paragraph (1) shall submit to the Advisory Council a report that contains—</text><subparagraph commented="no" id="HA6F2587CDD8546D2984E46B062FEF4AD"><enum>(A)</enum><text>a description of each recommendation of the subcommittee or workgroup; and</text></subparagraph><subparagraph commented="no" id="HDFFEF4DA35D8449693E2FD50CC94F839"><enum>(B)</enum><text>any advice requested by the Advisory Council with respect to any duty of the Advisory Council.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HE4110F10DB034E8CBF664D9EED538C82"><enum>(d)</enum><header>Duties</header><text>The Advisory Council shall provide independent advice and recommendations to the Environmental Protection Agency with respect to issues relating to environmental justice, including advice—</text><paragraph commented="no" id="H408CA0C0DCDB4CFFB23429E23ACDC7F4"><enum>(1)</enum><text>to help develop, facilitate, and conduct reviews of the direction, criteria, scope, and adequacy of the scientific research and demonstration projects of the Environmental Protection Agency relating to environmental justice;</text></paragraph><paragraph commented="no" id="H19EA55E323FF4780884298803C6052B8"><enum>(2)</enum><text>to improve participation, cooperation, and communication with respect to such issues—</text><subparagraph commented="no" id="H48090099F25345229B01DDFBDFE8C359"><enum>(A)</enum><text>within the Environmental Protection Agency;</text></subparagraph><subparagraph commented="no" id="HAA39DCA9ECC14F089AD62D85EBD2137A"><enum>(B)</enum><text>between the Environmental Protection Agency and other entities; and</text></subparagraph><subparagraph commented="no" id="HB21416B55DAE4EE6B5A35852E839E72A"><enum>(C)</enum><text>between, and among, the Environmental Protection Agency and Federal agencies, State and local governments, Indian Tribes, environmental justice leaders, interest groups, and the public;</text></subparagraph></paragraph><paragraph commented="no" id="HE7AA6A1987FF4F7ABE1C6A074BA244FE"><enum>(3)</enum><text>requested by the Administrator to help improve the response of the Environmental Protection Agency in securing environmental justice for communities of color, low-income communities, and Tribal and Indigenous communities; and</text></paragraph><paragraph commented="no" id="H19FAE5DED16D4B25ACD24A3918D02204"><enum>(4)</enum><text>on issues relating to—</text><subparagraph commented="no" id="H9D42883FD1B94D8FA68615EE6C68EAAB"><enum>(A)</enum><text>the developmental framework of the Environmental Protection Agency with respect to the integration by the Environmental Protection Agency of socioeconomic programs into the strategic planning, annual planning, and management accountability of the Environmental Protection Agency to achieve environmental justice results throughout the Environmental Protection Agency;</text></subparagraph><subparagraph commented="no" id="H75CD205E858348FE9CE37104D260EE97"><enum>(B)</enum><text>the measurement and evaluation of the progress, quality, and adequacy of the Environmental Protection Agency in planning, developing, and implementing environmental justice strategies, projects, and programs;</text></subparagraph><subparagraph commented="no" id="H8A29757EE9184152895C3D4C133576BF"><enum>(C)</enum><text>any existing and future information management systems, technologies, and data collection activities of the Environmental Protection Agency (including recommendations to conduct analyses that support and strengthen environmental justice programs in administrative and scientific areas);</text></subparagraph><subparagraph commented="no" id="H0870DB6EF7BC4C2BAFB66273CF703BD4"><enum>(D)</enum><text>the administration of grant programs relating to environmental justice assistance; and</text></subparagraph><subparagraph commented="no" id="H7F33C32B4FB641BA99EA823BE9C7E1F0"><enum>(E)</enum><text>education, training, and other outreach activities conducted by the Environmental Protection Agency relating to environmental justice.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H0CD97804A6744F9AA32689DA3B3F9410"><enum>(e)</enum><header>Meetings</header><paragraph commented="no" id="HF0006FA36C3A43D8A89E96C16301D92A"><enum>(1)</enum><header>Frequency</header><subparagraph commented="no" id="HCBBDD55F2D4243C492268E25C60F7629"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Advisory Council shall meet biannually.</text></subparagraph><subparagraph commented="no" id="H6AB745E0722D4D8D9C3C57E7C0E3BDA3"><enum>(B)</enum><header>Authority of Administrator</header><text>The Administrator may require the Advisory Council to conduct additional meetings if the Administrator determines that the conducting of any additional meetings is necessary.</text></subparagraph></paragraph><paragraph commented="no" id="H584E7934D9B84142A080FFEE8AD4C510"><enum>(2)</enum><header>Public participation</header><subparagraph commented="no" id="H944C2BBE0B804B7C931AD01FC427D18D"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), each meeting of the Advisory Council shall be open to the public to provide the public an opportunity—</text><clause commented="no" id="H1610E39FB7194FCC9665447E86644932"><enum>(i)</enum><text>to submit comments to the Advisory Council; and</text></clause><clause commented="no" id="H6D6C955780904DE28DD7B6A35FC494C1"><enum>(ii)</enum><text>to appear before the Advisory Council.</text></clause></subparagraph><subparagraph commented="no" id="H33B59B6C78D147B8A29A06BAE18116E2"><enum>(B)</enum><header>Authority of Administrator</header><text>The Administrator may close any meeting, or portion of any meeting, of the Advisory Council to the public.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HCFF217FBCB424DC5BADDAF975454850B"><enum>(f)</enum><header>FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Advisory Council.</text></subsection><subsection commented="no" id="H97BA093A035A40A085B48BB2C0E438F2"><enum>(g)</enum><header>Travel expenses</header><text>The Administrator may provide to any member of the Advisory Council travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Advisory Council.</text></subsection></section><section commented="no" id="H0CCB6E40F6FF4598AB8346C8FAD07143"><enum>19.</enum><header>Environmental Justice Clearinghouse</header><subsection commented="no" id="HCEC7EB7D711E4742AE83DE22EEBD4CDB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall establish a public internet-based clearinghouse, to be known as the Environmental Justice Clearinghouse. </text></subsection><subsection commented="no" id="HDDC3D34DE2F449E8B972B1F2CC593E18"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The Clearinghouse shall be composed of culturally and linguistically appropriate materials related to environmental justice, including—</text><paragraph commented="no" id="H2C6963460F174291A869B42B97676BCA"><enum>(1)</enum><text>information describing the activities conducted by the Environmental Protection Agency to address issues relating to environmental justice;</text></paragraph><paragraph commented="no" id="H1176160ED07C4459AD598AE678E17DE7"><enum>(2)</enum><text>copies of training materials provided by the Administrator to help individuals and employees understand and carry out environmental justice activities;</text></paragraph><paragraph commented="no" id="HC87B3D85488546A08CC231F09F2F5DE5"><enum>(3)</enum><text>links to web pages that describe environmental justice activities of other Federal agencies;</text></paragraph><paragraph commented="no" id="H97F7DA32574C40D19B631DCEFA44BAFC"><enum>(4)</enum><text>a directory of individuals who possess technical expertise in issues relating to environmental justice;</text></paragraph><paragraph commented="no" id="H16EE7AA3ABD048ACA22F96EA5ECBF9E4"><enum>(5)</enum><text display-inline="yes-display-inline">a directory of nonprofit and community-based organizations, including grassroots organizations led by people of color, that address issues relating to environmental justice at the local, State, and Federal levels (with particular emphasis given to nonprofit and community-based organizations that possess the capability to provide advice or technical assistance to environmental justice communities); and</text></paragraph><paragraph commented="no" id="HA9774E542B814283A891B0F603DCEDEF"><enum>(6)</enum><text display-inline="yes-display-inline">any other appropriate information as determined by the Administrator, including information on any resources available to help address the disproportionate burden of adverse human health or environmental effects on environmental justice communities.</text></paragraph></subsection><subsection commented="no" id="HB18470933CDF44369360ACC8B1721502"><enum>(c)</enum><header>Consultation</header><text>In developing the Clearinghouse, the Administrator shall consult with individuals representing academic and community-based organizations who have expertise in issues relating to environmental justice.</text></subsection><subsection commented="no" id="H14F39FA516A94BA39F9F25D4CD18D088"><enum>(d)</enum><header>Annual review</header><text>The Advisory Council shall—</text><paragraph commented="no" id="H2C1A726901D34CC7881F21719B77413E"><enum>(1)</enum><text>conduct a review of the Clearinghouse on an annual basis; and</text></paragraph><paragraph commented="no" id="HDC2BF0288A184B50ADD6F7648B2EF4F3"><enum>(2)</enum><text>recommend to the Administrator any updates for the Clearinghouse that the Advisory Council determines to be necessary for the effective operation of the Clearinghouse.</text></paragraph></subsection></section><section commented="no" id="H62FCC9D0F6A04D1DAB44BE3EE35B5330"><enum>20.</enum><header>Public meetings</header><subsection commented="no" id="H4F2894A6793645329C9F2BED99825730"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and biennially thereafter, the Administrator shall hold public meetings on environmental justice issues in each region of the Environmental Protection Agency to gather public input with respect to the implementation and updating of environmental justice strategies and efforts of the Environmental Protection Agency.</text></subsection><subsection commented="no" id="H3C850E2487F543939613087319DA6C00"><enum>(b)</enum><header>Outreach to environmental justice communities</header><text>The Administrator, in advance of the meetings described in subsection (a), shall to the extent practicable hold multiple meetings in environmental justice communities in each region to provide meaningful community involvement opportunities.</text></subsection><subsection commented="no" id="HAFE9990DD17046CEB2AF3416ABDF08A6"><enum>(c)</enum><header>Notice</header><text>Notice for the meetings described in subsections (a) and (b) shall be provided—</text><paragraph commented="no" id="H96038D24B9524D54A23828242086C23C"><enum>(1)</enum><text>to applicable representative entities or organizations present in the environmental justice community, including—</text><subparagraph commented="no" id="HDFFE62FCDC87438BB37557A2B21177EB"><enum>(A)</enum><text>local religious organizations;</text></subparagraph><subparagraph commented="no" id="HEAFFEA0D66BB4D2F8A15205258BA5155"><enum>(B)</enum><text>civic associations and organizations;</text></subparagraph><subparagraph commented="no" id="H685B93A1813042258F068457D279DDB2"><enum>(C)</enum><text>business associations of people of color;</text></subparagraph><subparagraph commented="no" id="H15FA464FD6D74B59949BDE5A4A659EBC"><enum>(D)</enum><text>environmental and environmental justice organizations;</text></subparagraph><subparagraph commented="no" id="H68C1DBD8B86B47B9B87F23DBEC2776FC"><enum>(E)</enum><text>homeowners’, tenants’, and neighborhood watch groups;</text></subparagraph><subparagraph commented="no" id="HAC1A2B235FEF4EE2B2C1B5186D9C3B50"><enum>(F)</enum><text>local and Tribal Governments;</text></subparagraph><subparagraph commented="no" id="HB18775D775EA4048B85C9CF8C909A71A"><enum>(G)</enum><text>rural cooperatives;</text></subparagraph><subparagraph commented="no" id="HEC6CFF313D2C418181C50164E27D7264"><enum>(H)</enum><text>business and trade organizations;</text></subparagraph><subparagraph commented="no" id="H6994BC741565476CA31A3EA3DE5BC364"><enum>(I)</enum><text>community and social service organizations;</text></subparagraph><subparagraph commented="no" id="HE4DB38654AFA437CBB851BCF7F257C2D"><enum>(J)</enum><text>universities, colleges, and vocational schools;</text></subparagraph><subparagraph commented="no" id="H70EA6CC658C64BE58AF95D6B11BB7F34"><enum>(K)</enum><text>labor organizations;</text></subparagraph><subparagraph commented="no" id="HBCB3AC81B9D44A2E8C28DD9605834CA4"><enum>(L)</enum><text>civil rights organizations;</text></subparagraph><subparagraph commented="no" id="H146A9661FD704DD9891126EE90E4A13B"><enum>(M)</enum><text>senior citizens’ groups; and</text></subparagraph><subparagraph commented="no" id="H74E62F90677A489E97A629E2FA3B0742"><enum>(N)</enum><text>public health agencies and clinics;</text></subparagraph></paragraph><paragraph commented="no" id="H776922966E214B408E98AAEDDFC53B59"><enum>(2)</enum><text>through communication methods that are accessible in the applicable environmental justice community, which may include electronic media, newspapers, radio, and other media particularly targeted at communities of color, low-income communities, and Tribal and Indigenous communities; and</text></paragraph><paragraph commented="no" id="HFB962FF774934719B9CA83683C6A4EE5"><enum>(3)</enum><text>at least 30 days before any such meeting.</text></paragraph></subsection><subsection commented="no" id="H967F2AD7F3CA4467B04F9860C2F0601C"><enum>(d)</enum><header>Communication methods and requirements</header><text>The Administrator shall—</text><paragraph commented="no" id="HB8E6DCA51A9248F994268772AA08CB1E"><enum>(1)</enum><text>provide translations of any documents made available to the public pursuant to this section in any language spoken by more than 5 percent of the population residing within the applicable environmental justice community, and make available translation services for meetings upon request; and</text></paragraph><paragraph commented="no" id="H624898D5747746D0AEDCE29FE5563D51"><enum>(2)</enum><text>not require members of the public to produce a form of identification or register their names, provide other information, complete a questionnaire, or otherwise fulfill any condition precedent to attending a meeting, but if an attendance list, register, questionnaire, or other similar document is utilized during meetings, it shall state clearly that the signing, registering, or completion of the document is voluntary.</text></paragraph></subsection><subsection commented="no" id="HB7EBEB1B67904DB1A06F2D614C33A388"><enum>(e)</enum><header>Required attendance of certain employees</header><text>In holding a public meeting under subsection (a), the Administrator shall ensure that at least 1 employee of the Environmental Protection Agency at the level of Assistant Administrator is present at the meeting to serve as a representative of the Environmental Protection Agency.</text></subsection></section><section commented="no" id="H133B052BAEDA4F3FACBC7BABA32D0398"><enum>21.</enum><header>Environmental projects for environmental justice communities</header><text display-inline="no-display-inline">The Administrator shall ensure that all environmental projects developed as part of a settlement relating to violations in an environmental justice community—</text><paragraph commented="no" id="H6D360E55ED03451D996D603618C18C61"><enum>(1)</enum><text>are developed through consultation with, and with the meaningful participation of, individuals in the affected environmental justice community; and</text></paragraph><paragraph commented="no" id="HFEFD605034EA4B38BA2D2A056E3753B5"><enum>(2)</enum><text>result in a quantifiable improvement to the health and well-being of individuals in the affected environmental justice community.</text></paragraph></section><section commented="no" id="H03F056928B2B41C59A686567E37D1966"><enum>22.</enum><header>Grants to further achievement of Tribal coastal zone objectives</header><subsection commented="no" id="H8E0981C39F6F43E3B87F358FA8A21761"><enum>(a)</enum><header>Grants authorized</header><text>The Coastal Zone Management Act of 1972 is amended by inserting after section 309 (<external-xref legal-doc="usc" parsable-cite="usc/16/1456b">16 U.S.C. 1456b</external-xref>) the following:</text><quoted-block style="OLC" id="H939A7E0371BF4CF29B2AE922F651257E"><section commented="no" id="H5AC3A1CC45FD429796723C6AABA8050B"><enum>309A.</enum><header>Grants to further achievement of Tribal coastal zone objectives</header><subsection commented="no" id="H837311D0CAF84F2E86C75AD39BE7B1CB"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary may award grants, on a competitive basis, to Indian Tribes to pay for the Federal share of the cost of furthering achievement of the Tribal coastal zone objectives of such a Tribe.</text></subsection><subsection commented="no" id="HA1C1572EDE934B98843DA2EAF9E7E741"><enum>(b)</enum><header>Federal share</header><paragraph commented="no" id="HDE35372B1CFF42679B2AF9309028BF92"><enum>(1)</enum><header>In general</header><text>The Federal share of the cost of any activity carried out under a grant under this section shall be—</text><subparagraph commented="no" id="H4CC8C092628E4C9D8CA4A4487C7C56B2"><enum>(A)</enum><text>in the case of a grant of less than $200,000, 100 percent of such cost; and</text></subparagraph><subparagraph commented="no" id="H47A73563C6C84B789D487AE4B457CCA4"><enum>(B)</enum><text>in the case of a grant of $200,000 or more, 95 percent of such cost, except as provided in paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" id="H7D9899749AD8413DBFA729E769AF4697"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraph (1)(B) with respect to a grant to an Indian Tribe, or otherwise reduce the portion of the share of the cost of an activity required to be paid by an Indian Tribe under such paragraph, if the Secretary determines that the Tribe does not have sufficient funds to pay such portion. </text></paragraph></subsection><subsection commented="no" id="H1363D159551A456DA0A631550EB6533B"><enum>(c)</enum><header>Compatibility</header><text>The Secretary may not award a grant under this section to an Indian Tribe unless the Secretary determines that the activities to be carried out under the grant are compatible with this title and that the Indian Tribe has consulted with the affected coastal state regarding the grant objectives and purposes.</text></subsection><subsection commented="no" id="H51F913D3BC224D3E9D1B06D3CAEE2DA6"><enum>(d)</enum><header>Authorized objectives and purposes</header><text>An Indian Tribe that receives a grant under this section shall use the grant funds for one or more of the objectives and purposes authorized under subsections (b) and (c), respectively, of section 306A, with respect to the Indian Tribe and its Tribal coastal zone. In applying section 306A(b) under this subsection, a reference in that section to a provision shall be considered to be a corresponding provision or policy for an Indian Tribe.</text></subsection><subsection commented="no" id="H76B4F10FA56A419C9C7EB7BDB806B0A6"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each fiscal year.</text></subsection><subsection commented="no" id="id8FD7ED730A134579A5A77969A721FB6A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="idD395C6E894DA4600BF035813A9CFF3AC"><enum>(1)</enum><header>Indian land; Indian Tribe</header><text>The term <term>Indian land</term> has the meaning given the term, and the term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term>, under section 2601 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>).</text></paragraph><paragraph commented="no" id="id16A806737D08470C9E2C0FD3F1E6BEA9"><enum>(2)</enum><header>Tribal coastal zone</header><text>The term <term>Tribal coastal zone</term> means any Indian land of an Indian Tribe that is within the coastal zone.</text></paragraph><paragraph commented="no" id="idEB7C4AC4D5A74D8DBB3484A227846C54"><enum>(3)</enum><header>Tribal coastal zone objective</header><text>The term <term>Tribal coastal zone objective</term> means, with respect to an Indian Tribe and its Tribal coastal zone, any of the following objectives:</text><subparagraph commented="no" id="idED755E9574604E2D81C62F1C03E11BF6"><enum>(A)</enum><text>Protection, restoration, or preservation of areas in that zone of that Tribe that—</text><clause commented="no" id="id33AF0405589A442BAD2292985BC02115"><enum>(i)</enum><text>hold important ecological, cultural, or sacred significance for such Tribe; or</text></clause><clause commented="no" id="idEE5A11DA483D47B08E292C47D91D24D4"><enum>(ii)</enum><text>reflect traditional, historic, and esthetic values essential to such Tribe.</text></clause></subparagraph><subparagraph commented="no" id="id2BFA59ABE5E04FA98A8EA4BCB93E2081"><enum>(B)</enum><text>Preparing and implementing a special area management plan and technical planning for important coastal areas.</text></subparagraph><subparagraph commented="no" id="id99079DF9089E433582872CA4A377A3C5"><enum>(C)</enum><text>Taking any coastal or shoreline stabilization measure, including any mitigation measure, for the purpose of public safety, public access, or cultural or historical preservation. </text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H2C913E9D1B0E4FD1A443E6AD915D4743"><enum>(b)</enum><header>Guidance</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Commerce shall issue guidance for the program established under the amendment made by subsection (a), including the criteria for awarding grants under such program based on consultation with Indian Tribes (as that term is defined in that amendment).</text></subsection><subsection commented="no" id="H51823A342581419AB5519505BF461AAC"><enum>(c)</enum><header>Use of State grants To fulfill Tribal objectives</header><text>Section 306A(c)(2) of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1455a">16 U.S.C. 1455a(c)(2)</external-xref>) is amended—</text><paragraph commented="no" id="idF5B50C1E4BF84095BA31A67E7AC55A25"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" id="id0F990C38FC584B0C81908A521A6F35D1"><enum>(2)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph><paragraph commented="no" id="id599776FA5AC04512962E5B8E7D308D1E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HD9FF1EC5F3D8400F9468C278D2EDDC1D"><subparagraph commented="no" id="H0A53187DF6F14387925C83552C8A31BC" indent="up1"><enum>(F)</enum><text>fulfilling any Tribal coastal zone objective (as that term is defined in section 309A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2A74AA2E12E3462E98EFA38A4256DBB6" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Other programs not affected</header><text>Nothing in this section, including an amendment made by this section, shall be construed to affect the ability of an Indian Tribe to apply for assistance, receive assistance under, or participate in any program authorized by the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451</external-xref> et seq.) or other related Federal laws.</text></subsection></section><section id="H877E7B961EB74E3E90869A39E50DBDCB"><enum>23.</enum><header>Cosmetic labeling</header><subsection id="H9C7C370A4A5C49BEB471CB0E25A52AA1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter VI of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H28FD591AD29E41D5931221ED15EE4346"><section id="H4573DE5F1D4046E5B59A5CF312193D6C"><enum>604.</enum><header>Labeling</header><subsection commented="no" id="HC39DD3A0E1E44521A9449FD97FD81E69"><enum>(a)</enum><header>Cosmetic products for professional use</header><paragraph commented="no" id="HA65275CB26254A179D73647464576BD5"><enum>(1)</enum><header>Definition of professional</header><text>With respect to cosmetics, the term <term>professional</term> means an individual who—</text><subparagraph commented="no" id="HA25BBF3E4A434B348C8011497E1B4DFD"><enum>(A)</enum><text>is licensed by an official State authority to practice in the field of cosmetology, nail care, barbering, or esthetics;</text></subparagraph><subparagraph commented="no" id="HFD357259A54F4FE9A8C16C88836343FB"><enum>(B)</enum><text>has complied with all requirements set forth by the State for such licensing; and</text></subparagraph><subparagraph commented="no" id="HE1D1637539404360B2C4D4AB7DAF58C2"><enum>(C)</enum><text>has been granted a license by a State board or legal agency or legal authority.</text></subparagraph></paragraph><paragraph commented="no" id="H89E0AC7044C945FFBBEF1EF5B3B56F4C"><enum>(2)</enum><header>Listing of ingredients</header><text>Cosmetic products used and sold by professionals shall list all ingredients and warnings, as required for other cosmetic products under this chapter.</text></paragraph><paragraph commented="no" id="H7373A3977EF14A8DAEA650A4B52082CF"><enum>(3)</enum><header>Professional use labeling</header><text>In the case of a cosmetic product intended to be used only by a professional on account of a specific ingredient or increased concentration of an ingredient that requires safe handling by trained professionals, the product shall bear a statement as follows: <quote>To be Administered Only by Licensed Professionals</quote>.</text></paragraph></subsection><subsection id="HBD12267602D04661BBCBFFC706303632"><enum>(b)</enum><header>Display requirements</header><text>A listing required under subsection (a)(2) and a statement required under subsection (a)(3) shall be prominently displayed—</text><paragraph id="HD5069D90FB66465AA2756BA2DF3C5CC6"><enum>(1)</enum><text>in the primary language used on the label; and</text></paragraph><paragraph id="H419731EF69294EA5A000DE2E79C0B19F"><enum>(2)</enum><text>in conspicuous and legible type in contrast by typography, layout, or color with other material printed or displayed on the label.</text></paragraph></subsection><subsection id="H0A95DF47276843638D353DC7EC43973F"><enum>(c)</enum><header>Internet sales</header><text>In the case of internet sales of cosmetics, each internet website offering a cosmetic product for sale to consumers shall provide the same information that is included on the packaging of the cosmetic product as regularly available through in-person sales, except information that is unique to a single cosmetic product sold in a retail facility, such as a lot number or expiration date, and the warnings and statements described in subsection (b) shall be prominently and conspicuously displayed on the website.</text></subsection><subsection id="HBB3FC9586BE44409B9FFC71D8EF0A9E6"><enum>(d)</enum><header>Contact information</header><text>The label on each cosmetic shall bear the domestic telephone number or electronic contact information, and it is encouraged that the label include both the telephone number and electronic contact information, that consumers may use to contact the responsible person with respect to adverse events. The contact number shall provide a means for consumers to obtain additional information about ingredients in a cosmetic, including the ability to ask if a specific ingredient may be present that is not listed on the label, including whether a specific ingredient may be contained in the fragrance or flavor used in the cosmetic. The manufacturer of the cosmetic is responsible for providing such information, including obtaining the information from suppliers if it is not readily available. Suppliers are required to release such information upon request of the cosmetic manufacturer.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2B5605B2DB3E494D8BF75F39E4FED335"><enum>(b)</enum><header>Misbranding</header><text>Section 602 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/362">21 U.S.C. 362</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9C954F5443D4416DA138E9C15EF6FC03"><subsection id="H427F6161ED004F9C93AAC1918125A14B"><enum>(g)</enum><text display-inline="yes-display-inline">If its labeling does not conform with a requirement under section 604.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB419379A217E471A8194485C7F418DCA"><enum>(c)</enum><header>Effective date</header><text>Section 604 of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a), shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subsection></section><section commented="no" id="H52FB5CA0E2114E9ABE00669DBACAF7D5"><enum>24.</enum><header>Safer cosmetic alternatives for disproportionately impacted communities</header><subsection commented="no" id="H2AD5353A78514A9891F9254F7CE8D7DB"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>), acting through the Commissioner of Food and Drugs, shall award grants to eligible entities—</text><paragraph id="HC8627B5AEF8944AEB1FF242B48CB9717"><enum>(1)</enum><text>to support research focused on the design of safer alternatives to chemicals in cosmetics with inherent toxicity or associated with chronic adverse health effects; or</text></paragraph><paragraph id="H1889FEF5C9E3485087F9249F3C8A4DBC"><enum>(2)</enum><text display-inline="yes-display-inline">to provide educational awareness and community outreach efforts to educate and promote the use of safer alternatives in cosmetics.</text></paragraph></subsection><subsection commented="no" id="HA8F1BF98B8B54046BCFEFCB8E20ECD6A"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under subsection (a), an entity shall—</text><paragraph commented="no" id="HD6C93DA35C234DE094E965DA23710480"><enum>(1)</enum><text display-inline="yes-display-inline">be a public institution such as a university, a nonprofit research institution, or a nonprofit grassroots organization; and</text></paragraph><paragraph commented="no" id="HE55831259E804A82B801282AE18AA254"><enum>(2)</enum><text>not benefit from a financial relationship with a chemical or cosmetics manufacturer, supplier, or trade association.</text></paragraph></subsection><subsection commented="no" id="HD6B2064D136A43F4B41AD94CAFF7E53D"><enum>(c)</enum><header>Priority</header><text>In awarding grants under subsection (a), the Secretary shall give priority to applicants proposing to focus on—</text><paragraph commented="no" id="H0C2B5767718B41D0879AF1E7F02DC8E0"><enum>(1)</enum><text>replacing chemicals in professional cosmetic products used by nail and hair and beauty salon workers with safer alternatives; or</text></paragraph><paragraph commented="no" id="H6837CF36BCBE4D2A8794C5A50B2B48E8"><enum>(2)</enum><text>replacing chemicals in cosmetic products marketed to women and girls of color, including any such beauty, personal hygiene, and intimate care products, with safer alternatives.</text></paragraph></subsection><subsection commented="no" id="H9E247CD236424ABD97391BB2D07EC5E9"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary for fiscal years 2022 through 2026.</text></subsection></section><section id="id4D5B45765F754984A5C9FB7C90DBD671"><enum>25.</enum><header>Safer child care centers, schools, and homes for disproportionately impacted communities</header><subsection id="id5FB0BAF1F64D47C6AA3EE1BA79B2AB94"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>), acting through the Commissioner of Food and Drugs, in consultation with the Administrator of the Environmental Protection Agency, shall award grants to eligible entities to support research focused on the design of safer alternatives to chemicals in consumer, cleaning, toy, and baby products with inherent toxicity or that are associated with chronic adverse health effects.</text></subsection><subsection id="idADD623BC98244725BD72316CB9DCF506"><enum>(b)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (a), an entity shall—</text><paragraph id="idB180ADE224D240E89218158377BDA68E"><enum>(1)</enum><text display-inline="yes-display-inline">be a public institution such as a university or a nonprofit research institution; and</text></paragraph><paragraph id="id49DADF4F20DE4B009D6C02527B33456D"><enum>(2)</enum><text display-inline="yes-display-inline">not benefit from a financial relationship with—</text><subparagraph id="idDC1AC0D9B7C8436899C8AD6224E99006"><enum>(A)</enum><text>a chemical manufacturer, supplier, or trade association; or</text></subparagraph><subparagraph id="idA328915BC38C4B3FA788458FF3C5BBBD"><enum>(B)</enum><text>a cleaning, toy, or baby product manufacturer, supplier, or trade association.</text></subparagraph></paragraph></subsection><subsection id="id76386185DA394850A4E16AC3FFCFCDC1"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under subsection (a), the Secretary shall give priority to applicants proposing to focus on replacing chemicals in cleaning, toy, or baby products used by child care providers with safer alternatives.</text></subsection><subsection id="id2D18528987E64C6C85A237A7FFBA30B8"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated such sums as may be necessary for fiscal years 2022 through 2026.</text></subsection></section><section section-type="subsequent-section" id="HBCD810549761477195D766D2375017F6"><enum>26.</enum><header>Certain menstrual products misbranded if labeling does not include ingredients</header><subsection id="H797A56621CD047319F31C0C4E64E00A4"><enum>(a)</enum><header>In general</header><text>Section 502 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7E68AEAF793A44E192C50428CBCBA1D7"><subsection id="H538A51FB7E154696B1D419C0B7C3A279"><enum>(gg)</enum><text display-inline="yes-display-inline">If it is a menstrual product, such as a menstrual cup, a scented, scented deodorized, or unscented menstrual pad or tampon, a therapeutic vaginal douche apparatus, or an obstetrical and gynecological device described in section 884.5400, 884.5425, 884.5435, 884.5460, 884.5470, or 884.5900 of title 21, Code of Federal Regulations (or any successor regulation), unless its label or labeling lists the name of each ingredient or component of the product in order of the most predominant ingredient or component to the least predominant ingredient or component.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB6C36C82579841CE8CAC22FE199B6A85"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) applies with respect to products introduced or delivered for introduction into interstate commerce on or after the date that is one year after the date of the enactment of this Act.</text></subsection></section><section commented="no" id="id21A4F0677F6748B98A52E827B93DFA2D"><enum>27.</enum><header>Support by National Institute of Environmental Health Sciences for research on health disparities impacting communities of color</header><text display-inline="no-display-inline">Subpart 12 of part C of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285l">42 U.S.C. 285l</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="idB3FD6B49D93D45F5BD0B34BE19385E22"><section commented="no" id="idA6A27B5E18404B4A89535C6E6DAE0A22"><enum>463C.</enum><header>Research on health disparities related to cosmetics impacting communities of color</header><subsection commented="no" id="idC646355045134158BC9C2DAAF8507DDB"><enum>(a)</enum><header>In general</header><text>The Director of the Institute shall award grants to eligible entities—</text><paragraph commented="no" id="id0E3FB05DE01B45619A925F451472C1BD"><enum>(1)</enum><text>to expand support for basic, epidemiological, and social scientific investigations into—</text><subparagraph commented="no" id="id7777158FE85A449AAC6086D178F97FD2"><enum>(A)</enum><text>the chemicals linked (or with possible links) to adverse health effects most commonly found in cosmetics marketed to women and girls of color, including beauty, personal hygiene, and intimate care products;</text></subparagraph><subparagraph commented="no" id="id30AA1D7183864BFE8BDCF48D43FD95C7"><enum>(B)</enum><text>the marketing and sale of such cosmetics containing chemicals linked to adverse health effects to women and girls of color across their lifespans; </text></subparagraph><subparagraph commented="no" id="id55B3A57F793740119678C4B86C2F783F"><enum>(C)</enum><text>the use of such cosmetics by women and girls of color across their lifespans; or</text></subparagraph><subparagraph id="id2606E3DB8EA84F3AA4081B5D205EC4D1"><enum>(D)</enum><text display-inline="yes-display-inline">the chemicals linked to the adverse health effects most commonly found in products used by nail, hair, and beauty salon workers; </text></subparagraph></paragraph><paragraph id="id06C47A67BAAF42FA9EC78140A5114CFB"><enum>(2)</enum><text display-inline="yes-display-inline">to provide educational awareness and community outreach efforts to educate and promote the use of safer alternatives in cosmetics; and</text></paragraph><paragraph commented="no" id="id3EA8B5AE0E6D4D03B31F593E39F2EAD2"><enum>(3)</enum><text>to disseminate the results of any such research described in subparagraph (A) or (B) of paragraph (1) (conducted by the grantee pursuant to this section or otherwise) to help communities identify and address potentially unsafe chemical exposures in the use of cosmetics.</text></paragraph></subsection><subsection commented="no" id="id2D0196AC696D4E9E8517ABCA75234E08"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under subsection (a), an entity shall—</text><paragraph commented="no" id="id7D52BE41FA2049AFB968733153F16B4C"><enum>(1)</enum><text display-inline="yes-display-inline">be a public institution such as a university, a nonprofit research institution, or a nonprofit grassroots organization; and</text></paragraph><paragraph commented="no" id="id4A6BD211F21944C4A978460A4295AD08"><enum>(2)</enum><text>not benefit from a financial relationship with a chemical or cosmetics manufacturer, supplier, or trade association.</text></paragraph></subsection><subsection commented="no" id="idC19E1814809B426EBD6E679D4D3ADE18"><enum>(c)</enum><header>Report</header><text>Not later than the end 1 year after awarding grants under this section, and each year thereafter, the Director of the Institute shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate, and make publicly available, a report on the results of the investigations funded under subsection (a), including—</text><paragraph commented="no" id="id31716C3344984D7CB4082975F03FFA07"><enum>(1)</enum><text>summary findings on—</text><subparagraph commented="no" id="idE307FB9A0E08436984F640A761E4A116"><enum>(A)</enum><text>marketing strategies, product categories, and specific cosmetics containing ingredients linked to adverse health effects; and</text></subparagraph><subparagraph commented="no" id="idCE5446FF00EB4CCBAC68547F673EB7C0"><enum>(B)</enum><text>the demographics of the populations marketed to and using cosmetics containing such ingredients for personal and professional use; and</text></subparagraph></paragraph><paragraph commented="no" id="id0EF7B14B83E74C2CA174E746F2F532DC"><enum>(2)</enum><text>recommended public health information strategies to reduce potentially unsafe exposures to cosmetics.</text></paragraph></subsection><subsection commented="no" id="id89DAC7CAABD74429B5E91D4172C0969B"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary for fiscal years 2022 through 2026.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H1C363C376E1C4BE28FB3C4043BEC51A5"><enum>28.</enum><header>Revenues for just transition assistance</header><subsection id="H90B9A7331BEE4DD39D6B4A722618EF8C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H9859309583B04D8894ACA10E418CBFB1"><enum>(1)</enum><header>Nonproducing lease</header><text>The term <term>nonproducing lease</term> means any Federal onshore or offshore oil or natural gas lease under which oil or natural gas is produced for fewer than 90 days in an applicable calendar year.</text></paragraph><paragraph id="H5AD5CA8796514BE4BADAEFD365545957"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></subsection><subsection commented="no" id="HF08B99CAA3DC4E0FA7B2762AB1F931E6"><enum>(b)</enum><header>Mineral leasing revenue</header><paragraph id="id748cb611fec743d39cf131f2cdde9b4f"><enum>(1)</enum><header>Coal leases</header><text>Section 7(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/207">30 U.S.C. 207(a)</external-xref>) is amended, in the fourth sentence, by striking <quote>12<fraction>1/2</fraction> per centum</quote> and inserting <quote>18.75 percent</quote>.</text></paragraph><paragraph id="ida5ac8fb23a0240d2b0f069a234c42ea5"><enum>(2)</enum><header>Leases on land known or believed to contain oil or natural gas</header><text>Section 17 of the Mineral Leasing Act (<external-xref Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/188">30 U.S.C. 188(e)(3)</external-xref>) is amended by striking <quote>16<fraction>2/3</fraction></quote> each place it appears and inserting <quote>25</quote>.</text></paragraph><paragraph id="HF39106B4E31140D78F4D7FD4CAFCAD60"><enum>(4)</enum><header>Deposits</header><text>Section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) is amended—</text><subparagraph id="idD76CC6DA702F4851ADE4592DC7614D29"><enum>(A)</enum><text>in subsection (a), in the first sentence, by striking <quote>All</quote> and inserting <quote>Except as provided in subsection (e), all</quote>; and</text></subparagraph><subparagraph amount of any increase in revenues collected as a result of the amendments made by subsection (b) of section 28 of the <short-title>Environmental Justice For All Act</short-title> shall be deposited and distributed in accordance with subsection (d) of that section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="idA97B9B9FCCA64621A3665A47D03256FD"><enum>(c)</enum><header>Fees for producing leases and nonproducing leases</header><paragraph id="H4A71E5C7DFDE4866AD8CB6B8EAACC803"><enum>(1)</enum><header>Conservation of resources fees</header><text>There is established a fee of $4 per acre per year on producing Federal onshore and offshore oil and gas leases.</text></paragraph><paragraph id="HFB5FEAA1B2804B6D97D7C697B5380240"><enum>(2)</enum><header>Speculative leasing fees</header><text>There is established a fee of $6 per acre per year on nonproducing leases.</text></paragraph></subsection><subsection id="H72A23BE04DE247A4BDC3899A1B2C1D7A"><enum>(d)</enum><header>Deposit</header><paragraph id="HFA0489E8974745D48CB88DC3F417CB24"><enum>(1)</enum><header>In general</header><text>All amounts collected under paragraphs (1) and (2) of subsection (c) shall be deposited in the Federal Energy Transition Economic Development Assistance Fund established by section 29(c).</text></paragraph><paragraph id="H2E71C06A93834C86B6657AE806201EBD"><enum>(2)</enum><header>Mineral leasing Revenue</header><text>Notwithstanding any other provision of law, of the amount of any increase in revenue collected as a result of the amendments made by subsection (b)—</text><subparagraph id="idA31C957A51AA4F51BA32D2ADE97FDCFC"><enum>(A)</enum><text>50 percent shall be deposited in the Federal Energy Transition Economic Development Assistance Fund established by section 29(c); and</text></subparagraph><subparagraph id="H22162FD60C314A30ADDAAC4A81E37182"><enum>(B)</enum><text>50 percent shall be distributed to the State in which the production occurred.</text></subparagraph></paragraph></subsection><subsection id="HB89949DE592F4E81B64EA009BE1F0C14" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Adjustment for inflation</header><text>The Secretary shall, by regulation at least once every 4 years, adjust each fee established by subsection (c) to reflect any change in the Consumer Price Index (all items, United States city average) as prepared by the Department of Labor.</text></subsection></section><section commented="no" id="idFC8E0886B7474DED9157E5A336A185FC"><enum>29.</enum><header>Economic revitalization for fossil fuel-dependent communities</header><subsection commented="no" id="idAE671233BF954471889CD71E6BD9DDE6"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to promote economic revitalization, diversification, and development in communities— </text><paragraph commented="no" id="id366CB61524DC49288B42334AFF6F7EC5"><enum>(1)</enum><text display-inline="yes-display-inline">that depend on fossil fuel mining, extraction, or refining for a significant amount of economic opportunities; or </text></paragraph><paragraph commented="no" id="id4EB633FFD0AF4A0DBDE9E807830E5319"><enum>(2)</enum><text display-inline="yes-display-inline">in which a significant proportion of the population is employed at electric generating stations that use fossil fuels as the predominant fuel supply.</text></paragraph></subsection><subsection id="idBAF3244C277944F481A90A985E492B59"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idDA2CF25889B0477A9A6684C40934FD2C"><enum>(1)</enum><header>Advisory committee</header><text>The term <term>Advisory Committee</term> means the Just Transition Advisory Committee established by subsection (g)(1).</text></paragraph><paragraph id="id57EB0F77D4EB4D65BAE8DA9BAC5A2410"><enum>(2)</enum><header>Displaced worker</header><text>The term <term>displaced worker</term> means an individual who, due to efforts to reduce net emissions from public land or as a result of a downturn in fossil fuel mining, extraction, or production, has suffered a reduction in employment or economic opportunities. </text></paragraph><paragraph id="id4221AD985630416B99AFF704D2A74329"><enum>(3)</enum><header>Fossil fuel</header><text>The term <term>fossil fuel</term> means coal, petroleum, natural gas, tar sands, oil shale, or any derivative of coal, petroleum, or natural gas. </text></paragraph><paragraph id="idEAB6C9952AC04A3E86DD1CD6AE170F58"><enum>(4)</enum><header>Fossil fuel-dependent community</header><text>The term <term>fossil fuel-dependent community</term> means a community—</text><subparagraph id="idCF2D5FDA2D114E8BB10D260D8E820BEF"><enum>(A)</enum><text>that depends on fossil fuel mining, and extraction, or refining for a significant amount of economic opportunities; or </text></subparagraph><subparagraph id="idC1E8090E9F054040BC6CA63B82097758" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in which a significant proportion of the population is employed at electric generating stations that use fossil fuels as the predominant fuel supply. </text></subparagraph></paragraph><paragraph id="id4A4E84716F70493D9E36ACC5E26C122C"><enum>(5)</enum><header>Fossil fuel transition community</header><text>The term <term>fossil fuel transition community</term> means a community—</text><subparagraph id="idB1EDF21145ED4C2887CA2F498A5E9162"><enum>(A)</enum><text>that has been adversely affected economically by a recent reduction in fossil fuel mining, extraction, or production-related activity, as demonstrated by employment data, per capita income, or other indicators of economic distress;</text></subparagraph><subparagraph id="idB6D7A6C2B01641C980512C64F3390A34"><enum>(B)</enum><text>that has historically relied on fossil fuel mining, extraction, or production-related activity for a substantial portion of its economy; or</text></subparagraph><subparagraph id="id9A1CB24418D94D1AA61F9C5717656A83"><enum>(C)</enum><text>in which the economic contribution of fossil fuel mining, extraction, or production-related activity has significantly declined. </text></subparagraph></paragraph><paragraph id="id1025FA9115DB4C0E849726A126A13AF2"><enum>(6)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Federal Energy Transition Economic Development Assistance Fund established by subsection (c).</text></paragraph><paragraph id="idE11B6D8FB5534FA09817219106CDE8F1"><enum>(7)</enum><header>Public land</header><subparagraph id="id40A1199413F641C48E5AC694AA133D15"><enum>(A)</enum><header>In general</header><text>The term <term>public land</term> means any land and interest in land owned by the United States within the several States and administered by the Secretary or the Secretary of Agriculture (acting through the Chief of the Forest Service) without regard to how the United States acquired ownership.</text></subparagraph><subparagraph id="id0C57B1C0BF47488D8A341E16856101B7"><enum>(B)</enum><header>Inclusion</header><text>The term <quote>public land</quote> includes land located on the outer Continental Shelf.</text></subparagraph><subparagraph id="idC756F80CB7F04B4B88217F505E192DF3"><enum>(C)</enum><header>Exclusion</header><text>The term <quote>public land</quote> does not include land held in trust for an Indian Tribe or member of an Indian Tribe.</text></subparagraph></paragraph><paragraph id="idCBA14F4D330F491D996BF7145D0F4F9A"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></subsection><subsection commented="no" id="idE6E308882D994B228792A3071590C4F4"><enum>(c)</enum><header>Establishment of Federal Energy Transition Economic Development Assistance Fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the <quote>Federal Energy Transition Economic Development Assistance Fund</quote>, which shall consist of amounts deposited in the Fund under section 28(d).</text></subsection><subsection id="id9AE853C2D8684E57B92A137BC562F614"><enum>(d)</enum><header>Distribution of funds</header><text>Of the amounts deposited in the Fund—</text><paragraph id="id8B11B75FFA444ED89E28769AF4FDD0E0"><enum>(1)</enum><text>35 percent shall be distributed by the Secretary to States in which extraction of fossil fuels occurs on public land, based on a formula reflecting existing production and extraction in the State;</text></paragraph><paragraph id="id5AE29CB04AFF4AB1AA88240E033604F5"><enum>(2)</enum><text>35 percent shall be distributed by the Secretary to States based on a formula reflecting the quantity of fossil fuels historically produced and extracted in the State on public land before the date of enactment of this Act; and</text></paragraph><paragraph id="idC04443A34610484CADA52B9614D49A66"><enum>(3)</enum><text>30 percent shall be allocated to a competitive grant program under subsection (f).</text></paragraph></subsection><subsection commented="no" id="idC8283F6AB9F3455CB4C5E881F8BEE9AE"><enum>(e)</enum><header>Use of Funds</header><paragraph commented="no" id="id68AFD1CD8C974B0EBF26A126BD2F0866"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Funds distributed by the Secretary to States under paragraphs (1) and (2) of subsection (d) may be used for—</text><subparagraph commented="no" id="id4E9FE869F3D9437EB1C45284BC97713A"><enum>(A)</enum><text display-inline="yes-display-inline">environmental remediation of land and waters impacted by the full lifecycle of fossil fuel extraction and mining;</text></subparagraph><subparagraph commented="no" id="idEECA8CB28F4F4486BD6132DB129F2B7D"><enum>(B)</enum><text>building partnerships to attract and invest in the economic future of historically fossil fuel-dependent communities;</text></subparagraph><subparagraph commented="no" id="id5B25BA313C8E468DB99FEDEEF2BF3A5E"><enum>(C)</enum><text>increasing capacity and other technical assistance fostering long-term economic growth and opportunity in historically fossil fuel-dependent communities;</text></subparagraph><subparagraph commented="no" id="id56B05106978B480B8D7A84F7746C3C62"><enum>(D)</enum><text>guaranteeing pensions, healthcare, and retirement security and providing a bridge of wage support until a displaced worker either finds new employment or reaches retirement;</text></subparagraph><subparagraph id="idC23BD5CE0B4C400EA87948AE080AC3A2"><enum>(E)</enum><text>severance payments for displaced workers;</text></subparagraph><subparagraph commented="no" id="idDE46A0F4FBFF460EA3EEAC05C302FDD2"><enum>(F)</enum><text>carbon sequestration projects in natural systems on public land; or</text></subparagraph><subparagraph commented="no" id="idFEEB6BB36D1C41458F5CD0408EF37AC4"><enum>(G)</enum><text>expanding broadband access and broadband infrastructure.</text></subparagraph></paragraph><paragraph commented="no" id="id9DE4D74C60144C628D761DAD34F31B96"><enum>(2)</enum><header>Priority to fossil fuel workers</header><text>In distributing funds under paragraph (1), the Secretary shall give priority to assisting displaced workers dislocated from fossil fuel mining and extraction industries.</text></paragraph></subsection><subsection id="id654424B1EEAC46089311F2A63BD8EF2C"><enum>(f)</enum><header>Competitive grant program</header><paragraph id="id28DD6F5F1394484AB7601A41176CE15F"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a competitive grant program to provide funds to eligible entities for the purposes described in paragraph (3). </text></paragraph><paragraph id="id90CDF8D584F143F3A0F31E3806013360"><enum>(2)</enum><header>Definition of eligible entity</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible entity</term> means a local, State, or Tribal government, local development district (as defined in section 382E(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2009aa-4">7 U.S.C. 2009aa–4(a)</external-xref>)), a nonprofit organization, labor union, economic development agency, or institution of higher education (including a community college).</text></paragraph><paragraph id="id39962B4DFA5F4968AFA3CDABCC7CD540"><enum>(3)</enum><header>Eligible use of funds</header><text>The Secretary may award grants from amounts in the Fund made available under subsection (d)(3) for—</text><subparagraph id="id3F1E627E8A3D41B8A9E2E5034D8A1627"><enum>(A)</enum><text>the purposes described in subsection (e)(1);</text></subparagraph><subparagraph id="id3D636ECDE74F4F6486FDD3DB4602390C"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id23BC2CD4D7E14510ABDE6893C4479CA5"><enum>(i)</enum><text>existing job retraining and apprenticeship programs for displaced workers; or </text></clause><clause id="idE1F2C2E7E32C4476AECCEECDBFBC7A58" indent="up1"><enum>(ii)</enum><text>programs designed to promote economic development in communities affected by a downturn in fossil fuel extraction and mining;</text></clause></subparagraph><subparagraph id="idB13B930E44C1402DA3FDA7F29CAA8D77"><enum>(C)</enum><text>developing projects that—</text><clause id="id4018B11094FD466A8B54EC0596246C68"><enum>(i)</enum><text>diversify local and regional economies;</text></clause><clause id="id6254ED725A0A4299A80FA076BB3BD0E9"><enum>(ii)</enum><text>create jobs in new or existing non-fossil fuel industries;</text></clause><clause id="id567AAA3CF81C4D37AE130B2624221DB5"><enum>(iii)</enum><text>attract new sources of job-creating investment; or</text></clause><clause id="idB7B71957442241F48F07FFEFC0D250C2"><enum>(iv)</enum><text>provide a range of workforce services and skills training;</text></clause></subparagraph><subparagraph id="idE02D21446ED34F6BBD01E543B3026EB2"><enum>(D)</enum><text>internship programs in a field related to clean energy; and</text></subparagraph><subparagraph id="id8B63949112E443FDA0811098EACA4A31"><enum>(E)</enum><text>the development and support of—</text><clause id="id6686F6AF9F864FF9BA38369666701A68"><enum>(i)</enum><text>a clean energy certificate program at a labor organization; or</text></clause><clause id="id5CAE925915C248028525C5F1AA81A33A"><enum>(ii)</enum><text>a clean energy major or minor program at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></clause></subparagraph></paragraph></subsection><subsection id="idFCD34AC1ADEE4AB4B82AA1E8925AEEDC"><enum>(g)</enum><header>Just transition advisory committee</header><paragraph id="idCBB9EF70374B4C4DAFD4F7604BF462E0"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an advisory committee, to be known as the <quote>Just Transition Advisory Committee</quote>.</text></paragraph><paragraph id="id0D81CB89698C42C79DA45AD5E9BB5F2B"><enum>(2)</enum><header>Chair</header><text>The President shall appoint a Chair of the Advisory Committee.</text></paragraph><paragraph id="id76C49983BD6A4B9999CA40D4C27584F2"><enum>(3)</enum><header>Duties</header><text>The Advisory Committee shall—</text><subparagraph id="id9815BC5D7F624C08AA1696E71FDD6A06"><enum>(A)</enum><text>advise, assist, and support the Secretary in—</text><clause id="id2AA5716FFDC34992A5C667DD9A9D5E73"><enum>(i)</enum><text>the management and allocation of funds available under subsection (d); and</text></clause><clause id="id77D57A54375A430F9BDD3971491179CF"><enum>(ii)</enum><text>the establishment and administration of the competitive grant program under subsection (f); and</text></clause></subparagraph><subparagraph id="id5B6602B459E3470EA9C154E35C12332A"><enum>(B)</enum><text display-inline="yes-display-inline">develop procedures to ensure that States and applicants eligible to participate in the competitive grant program established under subsection (f) are notified of the availability of Federal funds pursuant to this section.</text></subparagraph></paragraph><paragraph id="idA7ED42230B224904BACEF5E6A2DD43E3"><enum>(4)</enum><header>Membership</header><subparagraph id="id48B4717CDAB940C6B1771F606F3604DA"><enum>(A)</enum><header>In general</header><text>The total number of members of the Advisory Committee shall not exceed 20 members.</text></subparagraph><subparagraph id="id73545B5677004CA19DE7C43D88CCCBD6"><enum>(B)</enum><header>Composition</header><text>The Advisory Committee shall be composed of the following members appointed by the Chair:</text><clause id="id0B1A27B30BB842FB838938E4B10E03E0"><enum>(i)</enum><text>A representative of the Assistant Secretary of Commerce for Economic Development.</text></clause><clause id="id8E1ACC05BB864C00B6183C529E0F712E"><enum>(ii)</enum><text>A representative of the Secretary of Labor.</text></clause><clause id="idCBB23386807648558F808ED18AE8EEB0"><enum>(iii)</enum><text>A representative of the Under Secretary for Rural Development.</text></clause><clause id="id6549F382FF5C4AABA8B81C28584B71FE"><enum>(iv)</enum><text>Two individuals with professional economic development or workforce retraining experience.</text></clause><clause id="id50D5935DA34E440995A917C7832F12D9"><enum>(v)</enum><text>An equal number of representatives from each of the following:</text><subclause id="id2D30F79716CB4B4392451C3C55BD624D"><enum>(I)</enum><text>Labor unions.</text></subclause><subclause id="id7303373492984899AA0F9F2C271AC88A"><enum>(II)</enum><text>Nonprofit environmental organizations.</text></subclause><subclause id="id3F5B301D400043049327FCD54D2118C5"><enum>(III)</enum><text>Environmental justice organizations.</text></subclause><subclause id="idC1EDBD11A9C34752A3D9EE780C5BC35D"><enum>(IV)</enum><text>Fossil fuel transition communities.</text></subclause><subclause id="idC6C716973285494BBD35A6714CDEDC58"><enum>(V)</enum><text>Public interest groups.</text></subclause><subclause id="idEC05A5B959814A3291ABD88845A91D13"><enum>(VI)</enum><text display-inline="yes-display-inline">Tribal and Indigenous communities.</text></subclause></clause></subparagraph></paragraph><paragraph id="id2F2E0667F5834388B6DC71FBAC860C2B"><enum>(5)</enum><header>Termination</header><text>The Advisory Committee shall not terminate except by an Act of Congress.</text></paragraph></subsection><subsection commented="no" id="id53C24C7E51C74CA3A7B9A93804A0AAF7"><enum>(h)</enum><header>Limit on Use of Funds</header><paragraph commented="no" id="id3F22509346FD472EBAAE6A20898E2176"><enum>(1)</enum><header>Administrative costs</header><text>Not more than 7 percent of the amounts in the Fund may be used for administrative costs incurred in implementing this section.</text></paragraph><paragraph commented="no" id="id28838CB3994541E0B6305B97A30661EE"><enum>(2)</enum><header>Limitation on funds to a single entity</header><text>Not more than 5 percent of the amounts in the Fund may be awarded to a single eligible entity.</text></paragraph><paragraph commented="no" id="id80A5518C4A514FF9B454A93591DAB0A8"><enum>(3)</enum><header>Calendar year limitation</header><text>Not less than 15 percent of the amounts in the Fund shall be spent in each calendar year.</text></paragraph></subsection><subsection commented="no" id="id8B6B20E8707F4C288C1946979F86A3DC"><enum>(i)</enum><header>Use of American iron, steel, and manufactured goods</header><text display-inline="yes-display-inline">None of the funds appropriated or otherwise made available by this section may be used for a project for the construction, alteration, maintenance, or repair of a public building or public work unless all of the iron, steel, and manufactured goods used in the project are produced in the United States, unless the manufactured good is not produced in the United States.</text></subsection><subsection id="id7B6942D5F4E445989C95EEF416403D9F" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committees on Appropriations and Energy and Natural Resources of the Senate and the Committees on Appropriations and Natural Resources of the House of Representatives, with the annual budget submission of the President, a list of projects, including a description of each project, that received funding under this section in the previous calendar year. </text></subsection></section><section id="H1F31730BEEA04475BF34EB4E76785035" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>30.</enum><header>Evaluation by Comptroller General of the United States</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and biennially thereafter, the Comptroller General of the United States shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives, and the Committees on Environment and Public Works and Energy and Natural Resources of the Senate, a report that contains an evaluation of the effectiveness of each activity carried out under this Act and the amendments made by this Act.</text></section></legis-body></bill>
