<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 870</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="S284">Ms. Stabenow</sponsor> (for herself, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, and <cosponsor name-id="S403">Ms. Sinema</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to improve access to mental health services under the Medicare program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5C7531F7FDF74A26AA076BB75D02E6B5"><section section-type="section-one" id="H081F38360D5846D4AA580BE0898332AD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Mental Health Act of 2021</short-title></quote>.</text></section><section id="H1677AC84CB1C422991D7FE0C8C37706C"><enum>2.</enum><header>Improved access to mental health services under the Medicare program</header><subsection id="H2994365F60A942509086B2D1F6354157"><enum>(a)</enum><header>Access to clinical social workers</header><text>Section 1833(a)(1)(F)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(F)(ii)</external-xref>) is amended by striking <quote>75 percent of the amount determined for payment of a psychologist under clause (L)</quote> and inserting <quote>85 percent of the fee schedule amount provided under section 1848</quote>.</text></subsection><subsection id="HA8650A2F692B4B80838A248924B30229"><enum>(b)</enum><header>Access to clinical social worker services provided to residents of skilled nursing facilities</header><paragraph id="H5F109D52364E4D09BB93A9CC43C498A6"><enum>(1)</enum><header>In general</header><text>Section 1888(e)(2)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395yy">42 U.S.C. 1395yy(e)(2)(A)(ii)</external-xref>) is amended by inserting <quote>clinical social worker services,</quote> after <quote>qualified psychologist services,</quote>.</text></paragraph><paragraph id="H7A70178836C2495399EB46A25C4EA291"><enum>(2)</enum><header>Conforming amendment</header><text>Section 1861(hh)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(hh)(2)</external-xref>) is amended by striking <quote>and other than services furnished to an inpatient of a skilled nursing facility which the facility is required to provide as a requirement for participation</quote>.</text></paragraph></subsection><subsection id="H6DCF0950482B4D479647CF8DE890AE71"><enum>(c)</enum><header>Access to the complete set of clinical social worker services</header><text>Section 1861(hh)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(hh)(2)</external-xref>) is further amended by striking <quote>for the diagnosis and treatment of mental illnesses (other than services</quote> and inserting <quote>(including services for the diagnosis and treatment of mental illnesses or services for health and behavior assessment and intervention (identified as of January 1, 2021, by HCPCS codes 96150 through 96161 (and any succeeding codes)), but not including services</quote>.</text></subsection><subsection id="HF93AFB9A7E5D427997A1A9149807C36C"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to items and services furnished on or after January 1, 2022.</text></subsection></section></legis-body></bill>
