which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Office of Supply Chain Preparedness within the Department of Commerce to manage the partnership of the United States with private industry and State and local governments with respect to the manufacturing of critical resources, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Manufacturing Guard Act</short-title></quote>.</text></section><section id="idD269C1497A994CFE85E0BB72AA60948E"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idCE07573AB8B04ABEBA8611754FC1C7A8"><enum>(1)</enum><text display-inline="yes-display-inline">the COVID–19 pandemic has—</text><subparagraph id="id91E1E027E4764EF5BA05E11D072E248D"><enum>(A)</enum><text display-inline="yes-display-inline">exposed significant vulnerabilities in the manufacturing sector of the economy of the United States; and</text></subparagraph><subparagraph id="idA16C19BBE438428094AF1A2035DF6273"><enum>(B)</enum><text display-inline="yes-display-inline">led to equipment shortages, supply chain bottlenecks, and workforce misalignments;</text></subparagraph></paragraph><paragraph id="idDC769C25274540B185617A37A41870D2"><enum>(2)</enum><text display-inline="yes-display-inline">the vulnerabilities described in paragraph (1) go largely unnoticed until those vulnerabilities are revealed by crises, such as disease outbreaks, cyber attacks, natural disasters, national security threats, wars, trade wars, embargoes, and other emergencies;</text></paragraph><paragraph id="idF352A3FD8E9C44A4B8413A76DCD9938A"><enum>(3)</enum><text display-inline="yes-display-inline">the crises described in paragraph (2) produce valuable information, the collection and analysis of which can inform policies to fortify the economy of the United States against future threats;</text></paragraph><paragraph id="idCFF0274104AC420DA754CCC66D5D1C48"><enum>(4)</enum><text display-inline="yes-display-inline">the responsibility for promoting the economic resilience of the United States lies with the Federal Government, which must not miss the opportunity presented by the COVID–19 pandemic to learn from that crisis and prepare the United States to better withstand future emergencies; and</text></paragraph><paragraph id="id9CB0EDF154D440C39B92266F49F2CD23"><enum>(5)</enum><text display-inline="yes-display-inline">the Federal Government has an interest in increasing educational and training opportunities for underrepresented minorities, women, and veterans. </text></paragraph></section><section id="idF873ABDEE95D4AD9B6CA2F3FD9F7852F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id053D1B745F2848CB8B8B14F48D0AAE9A"><enum>(1)</enum><header>Council</header><text>The term <term>Council</term> means the Supply Chain Advisory Council established under section 5.</text></paragraph><paragraph id="id86B45871287649FFA54A91BDEBAED68F"><enum>(2)</enum><header>Crisis</header><text>The term <term>crisis</term> means a situation that threatens the ability of manufacturers and supply chains in the United States to provide sufficient critical resources.</text></paragraph><paragraph id="id40A7EC6F5C344CEFAA6D9241863A61E9"><enum>(3)</enum><header>Critical resources</header><text>The term <term>critical resources</term>—</text><subparagraph id="id3E171EA7A538489293C28ACCE53DF4E7"><enum>(A)</enum><text>means supplies that—</text><clause id="idFFF8B1C4BFFF4F089EC5180C70781461"><enum>(i)</enum><text>are life-sustaining or otherwise critical to the national security of the United States; and</text></clause><clause id="idEBA789D919D6491BBF3561DAF74DD170"><enum>(ii)</enum><text>may be subject to national shortages during a pandemic, cyber attack, natural disaster, or other catastrophic event; and</text></clause></subparagraph><subparagraph id="id40A5D40292A142E799B3EF0E0256E379"><enum>(B)</enum><text>includes items classified as—</text><clause id="id5820A7619BD14BC5B786ED7F7291C4C8"><enum>(i)</enum><text>personal protective equipment;</text></clause><clause id="id05A3C0D45D384A05B8DB23E250F29414"><enum>(ii)</enum><text>pharmaceuticals or biopharmaceuticals;</text></clause><clause id="id9CED38CFB9034A8596CE5E02CE604D60"><enum>(iii)</enum><text>medical supplies; or</text></clause><clause id="idD9B6A9E78100497A80C44CAEA75C6245"><enum>(iv)</enum><text>other resources to be determined by the Director, in consultation with the Council, which may include healthcare-related supplies or other supplies.</text></clause></subparagraph></paragraph><paragraph id="id9914B03C534144EC96CF9451A3287B4F"><enum>(4)</enum><header>Data Exchange</header><text>The term <term>Data Exchange</term> means the Supply Chain Data Exchange established under section 7.</text></paragraph><paragraph id="id66AD998CBAFB4E728EA2AA90A46CB190"><enum>(5)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office.</text></paragraph><paragraph id="id8AD7EBCED4FE42B7B882A0C01B50D2A2"><enum>(6)</enum><header>Guard</header><text>The term <term>Guard</term> means the National Manufacturing Guard established under section 6.</text></paragraph><paragraph id="id42D50D080D9E498C9F16565AD46DFDD1"><enum>(7)</enum><header>Host organization</header><text>The term <term>host organization</term> means an entity that—</text><subparagraph id="id7C7856BFEEDB44A4B65DE485CBED3787"><enum>(A)</enum><text>offers an apprenticeship with respect to which there is a registered apprenticeship program (as defined in section 29.2 of title 29, Code of Federal Regulations, or any successor regulation); and</text></subparagraph><subparagraph id="idF09E56B0896E49FE93BC1C2814C12E01"><enum>(B)</enum><text>is—</text><clause id="idEF411159181C4733BADBF2837AE6447A"><enum>(i)</enum><text>a business;</text></clause><clause id="id8B6B1F3BECD94AA99B20DA6E39A56946"><enum>(ii)</enum><text>an industry consortium or trade group;</text></clause><clause id="idAAC96CB31ED34BAC9C6A81E451B95177"><enum>(iii)</enum><text>a Manufacturing USA institute;</text></clause><clause id="id0C060159484940969BB08B1212986EF2"><enum>(iv)</enum><text>an MEP center;</text></clause><clause id="idFFF761EC62754A1B8F2040E76228D962"><enum>(v)</enum><text>an academic or research institute, or</text></clause><clause id="idF0F294AF128C48B38700AC8C0A49BBFD"><enum>(vi)</enum><text>a labor organization.</text></clause></subparagraph></paragraph><paragraph id="id34D1D33E0CA54EFDB63AAC3D2223B833"><enum>(8)</enum><header>Industry partner</header><text>The term <term>industry partner</term> means a manufacturer, producer, supplier, or distributor of a critical resource.</text></paragraph><paragraph id="idBAA31377F11F49B9915EB006156890D1"><enum>(9)</enum><header>Manufacturing Corps</header><text>The term <term>Manufacturing Corps</term> means the Manufacturing Corps established under section 8.</text></paragraph><paragraph id="id3AA769B792ED41E4AFC8F8D3072103CA"><enum>(10)</enum><header>Manufacturing USA institute</header><text>The term <term>Manufacturing USA institute</term> means an institute described in section 34(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)</external-xref>).</text></paragraph><paragraph id="id6D0F86BFA59645A292C895F74D476CEE"><enum>(11)</enum><header>MEP center</header><text>The term <term>MEP center</term> has the meaning given the term <term>Center</term> in section 25(a) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(a)</external-xref>).</text></paragraph><paragraph id="id4014F1539FC848798E1F74FCB359F276"><enum>(12)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Supply Chain Preparedness established under section 4.</text></paragraph><paragraph id="id8B18EE5D3F3D44A99875CA14BA021D6B"><enum>(13)</enum><header>Registered apprenticeship</header><text>The term <term>registered apprenticeship</term>—</text><subparagraph id="id1593EBE223CB4195B1E076BB861CF071"><enum>(A)</enum><text>means an apprenticeship with a host organization for which there is a registration of an apprenticeship agreement (as defined in section 29.2 of title 29, Code of Federal Regulations, or any successor regulation); and</text></subparagraph><subparagraph id="idC635FC81E2574C32A7AE968B0FB4EF58"><enum>(B)</enum><text>does not include an apprenticeship under an Industry-Recognized Apprenticeship Program under subpart B of part 29 of title 29, Code of Federal Regulations, or any successor regulation.</text></subparagraph></paragraph><paragraph id="idD4C5CC42F0A341599874761D0DF7A765"><enum>(14)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section><section id="id0227B164DC84459D962168FDA1BBD1F4"><enum>4.</enum><header>Office of Supply Chain Preparedness</header><subsection id="id43CE917A74264A378FD8425D6547C742"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department of Commerce the Office of Supply Chain Preparedness.</text></subsection><subsection id="id91064CDE8E4B432BB6EAABAB1DB47AE0"><enum>(b)</enum><header>Director</header><text>The Office shall be headed by a Director, to be appointed by the Secretary.</text></subsection><subsection id="id27B24FED898842B78E7316A177BF80E2"><enum>(c)</enum><header>Purpose</header><text>The purpose of the Office shall be to—</text><paragraph id="id27EF06B1A5F64E3EBCE02A8F356B7326"><enum>(1)</enum><text>establish and manage the partnerships of the Federal Government with industry partners and State, local, territorial, and Tribal governments to respond to crises;</text></paragraph><paragraph id="id74D7DCA403514FCCA02E158F49052763"><enum>(2)</enum><text>develop capabilities to—</text><subparagraph id="idD0D5FBDC3A8647ABA6F48AC6B976DC08"><enum>(A)</enum><text>determine which resources qualify as critical resources;</text></subparagraph><subparagraph id="idED3AA7100B114F5EB745B5234C28F93A"><enum>(B)</enum><text>make the supply of critical resources more resilient; and</text></subparagraph><subparagraph id="idE00AEE14E9284DD69D6BE70AC83C1733"><enum>(C)</enum><text>coordinate the distribution of critical resources to areas that have the greatest needs during a crisis; and</text></subparagraph></paragraph><paragraph id="id948CA450DAF54E0AAF6991631F688DC8"><enum>(3)</enum><text>develop contingency plans to ensure a robust supply chain response for potential crises.</text></paragraph></subsection><subsection id="id544145DD405B4B19993C359944192C50"><enum>(d)</enum><header>Duties</header><text>The Director shall—</text><paragraph id="id3160d530952642e495016e40591b08bf"><enum>(1)</enum><text>determine—</text><subparagraph id="id4CC9211C1BEF4A4E8F03A1A24F7F7BE0"><enum>(A)</enum><text>the responsibilities of members of the Council; and</text></subparagraph><subparagraph id="id0113F584E7FA499E9AC32B77842DFDFC"><enum>(B)</enum><text>the procedures governing the service of members of the Council;</text></subparagraph></paragraph><paragraph id="id41befa2177d04b178d0fccb2c3d15d02"><enum>(2)</enum><text>establish procedures relating to the operation of the Council, including the frequency with which the Council meets;</text></paragraph><paragraph id="idBEF775FD722E4E1084BBFB6C0E0F0D26"><enum>(3)</enum><text>identify critical vulnerabilities in the supply chains of critical resources, including vulnerabilities exacerbated by the COVID–19 pandemic;</text></paragraph><paragraph id="idd68e9276c1a3461290484480d5798569"><enum>(4)</enum><text>coordinate the preparedness and response of the supply chains of critical resources during a crisis by—</text><subparagraph id="idA4CC153ABBD24021AA980843DA364056"><enum>(A)</enum><text>coordinating with Federal agencies;</text></subparagraph><subparagraph id="id603D156C0236435BAB018588D3359FB9"><enum>(B)</enum><text>managing partnerships of the Federal Government with industry partners; and</text></subparagraph><subparagraph id="idAEEC8EFEFA0847C48772CAFAFDD9FB54"><enum>(C)</enum><text>directing the Guard;</text></subparagraph></paragraph><paragraph id="idaeeff5beb3f24109a40cbb84018d8902"><enum>(5)</enum><text>direct the establishment and operations of the Guard, the Data Exchange, and the Manufacturing Corps; and</text></paragraph><paragraph id="id969cc84562bb42429ba59ed67d71fcf7"><enum>(6)</enum><text>maintain collaborations with industry partners that contribute to the Data Exchange.</text></paragraph></subsection><subsection id="id86AA6868021F4D51A87DA72AB41EBF82"><enum>(e)</enum><header>Reports</header><paragraph id="id287cbd4684a446f29ff52e0f38e16c34"><enum>(1)</enum><header>Report on Director</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall submit to Congress a report relating to the appointment of the Director.</text></paragraph><paragraph id="id7ce35c0ca8b2485fab98b963c33801b4"><enum>(2)</enum><header>Report on council</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall submit to Congress a report that—</text><subparagraph id="id4AC711FF44E24FCD8DA691E352041C62"><enum>(A)</enum><text>identifies the members of the Council; and</text></subparagraph><subparagraph id="id133B030DAD494135B8A989335014F2D0"><enum>(B)</enum><text>states, with respect to the members of the Council—</text><clause id="idAB3FD6F9AAE44D9DAB42D41BA31249F1"><enum>(i)</enum><text>the respective areas of expertise of the members; and</text></clause><clause id="id3D5667F0083B4F6AB36B4A2A6B2BB9F0"><enum>(ii)</enum><text>the expected roles of the members.</text></clause></subparagraph></paragraph><paragraph id="id43a381820dd8482e948d9b059f812fd1"><enum>(3)</enum><header>Report on activities</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall submit to Congress a report that includes—</text><subparagraph id="id9F0F4B00C058461989CCE8CDE47878BE"><enum>(A)</enum><text>a summary of the activities of the Council and the Office; and</text></subparagraph><subparagraph id="idD1AAB12D24BD4AFFAF3002A1EF3FA150"><enum>(B)</enum><text>a preliminary plan for—</text><clause id="id8031C3B9CB32481789C9A9F40AA772F3"><enum>(i)</enum><text>the establishment of the Guard, the Data Exchange, and the Manufacturing Corps, including cost estimates, preliminary timelines, and expected resource needs; and</text></clause><clause id="id65B1F25AF5894F90AFF1A0BE6486E2BC"><enum>(ii)</enum><text>carrying out the responsibilities of the Director under sections 6, 7, and 8.</text></clause></subparagraph></paragraph><paragraph id="id8f9cb2986ce74deeb2f7a9dfe5959452"><enum>(4)</enum><header>Annual report</header><text>Not later than 2 years after the date of enactment of this Act, and annually thereafter, the Council shall submit to Congress a report that includes—</text><subparagraph id="idaceae2f833c74bddb68c14a0a2223fef"><enum>(A)</enum><text>a list of resources that the Director has determined to be critical resources and the justification for the determination;</text></subparagraph><subparagraph id="id8d92eb6aab2846c6a9aa2d5dccce739a"><enum>(B)</enum><text>a list of manufacturing and supply chain vulnerabilities identified under subsection (d)(3); and</text></subparagraph><subparagraph id="idB5474F3CDDFE4D45AC8996FD5CF4DCCF"><enum>(C)</enum><text>recommendations for mitigating the vulnerabilities listed under subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="id70CE429F4BFB495C8880D80F59CE3246"><enum>(f)</enum><header>Staff</header><text>The Director may appoint staff to manage the operations of the Office and the Council.</text></subsection></section><section id="id1BA9D77846FD4C76AAE54553674DC41B"><enum>5.</enum><header>Supply Chain Advisory Council</header><subsection id="id670148E061734F1C958309119185697B"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish the Supply Chain Advisory Council.</text></subsection><subsection id="id43f8794bc5e34da3880ea8e92afdd2b6"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Council is to advise the Director on manufacturing and supply chain logistics that would be necessary to direct the response of the supply chain of the United States during a crisis.</text></subsection><subsection id="idae2aaa53d51544c9a6035cf3f84b0453"><enum>(c)</enum><header>Composition</header><paragraph id="id7506B02432B744EF815C704A109DA376"><enum>(1)</enum><header>In general</header><text>The Council shall be comprised of the following members:</text><subparagraph id="idc51401de105f427994e3502a7bb2b0c2"><enum>(A)</enum><text>A representative of the Department of Health and Human Services, who shall be appointed by the Secretary of Health and Human Services.</text></subparagraph><subparagraph id="ide7d23b344675464cbbedad3ba83ee488"><enum>(B)</enum><text>A representative of the Department of Homeland Security, who shall be appointed by the Secretary of Homeland Security.</text></subparagraph><subparagraph id="id972c5de0f3ee45c3b31806afed6141ae"><enum>(C)</enum><text>A representative of the Department of Defense, who shall be appointed by the Secretary of Defense.</text></subparagraph><subparagraph id="id8955d9eafa4a4ea1ba5d51dec2cd6c80"><enum>(D)</enum><text>A representative of the Department of Energy, who shall be appointed by the Secretary of Energy.</text></subparagraph><subparagraph id="idD2A60714D65545A0848B6EA98F75F241"><enum>(E)</enum><text>A representative of the Department of Transportation, who shall be appointed by the Secretary of Transportation.</text></subparagraph><subparagraph id="id0799b10e7d4342a28c8adef33338b18d"><enum>(F)</enum><text>A representative of the United States International Trade Commission, who shall be appointed by the Chair of the United States International Trade Commission.</text></subparagraph><subparagraph id="id13FF607BC56443F28D3D5250662139C4"><enum>(G)</enum><text>A representative of the Department of State, who shall be appointed by the Secretary of State.</text></subparagraph><subparagraph id="idA98EE8328E2C45BD8D3FC68FC235F406"><enum>(H)</enum><text>A representative of the Office of the Director of National Intelligence, who shall be appointed by the Director of National Intelligence.</text></subparagraph><subparagraph id="idf255c964690549ac87b174b283e8f3fe"><enum>(I)</enum><text>The director of a Manufacturing USA institute, who shall be appointed by the Secretary.</text></subparagraph><subparagraph id="idece9871d3699441db86e553d02350091"><enum>(J)</enum><text>The director of an MEP center, who shall be appointed by the Secretary.</text></subparagraph><subparagraph id="id319294AA23EB4B209BCBF7D4BFECF832"><enum>(K)</enum><text>A representative of State governments, who shall be appointed by the Secretary in, consultation with Governors of States;</text></subparagraph><subparagraph id="id866C9CF808D443428EA2E4048C890C65"><enum>(L)</enum><text>Not less than 1 representative of a local, territorial, or Tribal government, who shall be appointed by the Secretary.</text></subparagraph><subparagraph id="id206654a37d2345cdb24337751074cfac"><enum>(M)</enum><text>Not less than 3 manufacturing or supply chain experts, who shall be appointed by the Secretary and represent each of, respectively—</text><clause id="id3c0b06ddefd843c19a48487760b7e6d0"><enum>(i)</enum><text>private industry;</text></clause><clause id="id1eaaa59a417c4a1ba6aafad9ad600fa5"><enum>(ii)</enum><text>labor organizations; and</text></clause><clause id="idd4c2c504401d4d25a2728cc6dcc5c39a"><enum>(iii)</enum><text>research institutions.</text></clause></subparagraph></paragraph><paragraph id="idFA7907F5D19143ABA0BF22D73114A17F"><enum>(2)</enum><header>Additional members</header><text>The Secretary may appoint additional members to the Council on a rotating or permanent basis.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idF400D8F6197F44A899FF2E828E03C149"><enum>(3)</enum><header>Status</header><text>The members of the Council appointed under subparagraphs (K), (L), and (M) of paragraph (1) shall serve as special Government employees (as defined in section 202 of title 18, United States Code).</text></paragraph></subsection><subsection id="idCE5A037A998048F48EAE1D431BDC6AE6"><enum>(d)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="ide74633c11a2a40c389b5c6deab323c0a"><enum>(1)</enum><text>convene according to a schedule established by the Director; and</text></paragraph><paragraph id="idd50d76c2926840e0872b579e8268a8bf"><enum>(2)</enum><text>advise the Director on carrying out the duties of the Director under section 4(d).</text></paragraph></subsection><subsection id="id56091DB254F64279A630D6FE0309FBC1"><enum>(e)</enum><header>Permanence</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Council.</text></subsection></section><section id="id7158ec496b4e4a4d84008e383b79229b"><enum>6.</enum><header>National Manufacturing Guard</header><subsection id="idEE557E7C0DA34878B34E1A22B40B84A8"><enum>(a)</enum><header>Establishment</header><paragraph id="idB2C945D73BA348EDBF8FB4BB127C13EF"><enum>(1)</enum><header>In general</header><text>There is established within the Office the National Manufacturing Guard.</text></paragraph><paragraph id="id394A346E6E2347688EDD69916E1DCFBD"><enum>(2)</enum><header>Eligibility requirements</header><text>The Director shall establish eligibility requirements for membership in the Guard, which may include—</text><subparagraph id="id96559E923BC54516BBC50277E3D399E6"><enum>(A)</enum><text>experience or expertise in manufacturing or logistics;</text></subparagraph><subparagraph id="id4098263CAC1D48B0984B2F594659D3AC"><enum>(B)</enum><text>holding a senior-level position in a manufacturing or supply chain organization; and</text></subparagraph><subparagraph id="id7BE4F67D6B884694804E38B00E599B45"><enum>(C)</enum><text>direct experience in manufacturing and supply chain operations.</text></subparagraph></paragraph><paragraph id="id9789F18DE4FE497F87B7E838CF0F9A04"><enum>(3)</enum><header>Size and organization</header><text>The Director, in consultation with the Council, shall establish—</text><subparagraph id="id104289C4C10742D590CD602F42705BC5"><enum>(A)</enum><text>the size of the Guard;</text></subparagraph><subparagraph id="id8DE9F0F2A9124877BEA18337CF547111"><enum>(B)</enum><text>the organization of the Guard; and</text></subparagraph><subparagraph id="id6A4B4E5E2CAE4372B17075A15D4B378A"><enum>(C)</enum><text>the target skillsets of members of the Guard.</text></subparagraph></paragraph></subsection><subsection id="id1169F0B9ACDC48F6B90AFAA3FA9104BF"><enum>(b)</enum><header>Training</header><paragraph id="id2BB61C7ADF334E0896A870ECE09181C6"><enum>(1)</enum><header>In general</header><text>The Director, in consultation with the Council, shall establish a training program for members of the Guard to ensure the readiness of members to perform the duties of the Guard.</text></paragraph><paragraph id="id6BF228B646DE4560B16C1517CBBD9D18"><enum>(2)</enum><header>Remote training</header><text>A portion of the training program established under paragraph (1) may be conducted remotely to prepare for crises that may prevent the Guard from convening in a single physical location.</text></paragraph><paragraph id="id584C0DEBDC4B447BA82A14AEEC167D0A"><enum>(3)</enum><header>Crisis simulation</header><text>Not less frequently than annually, the Director shall hold a full-time training program during which each member of the Guard, the Director, and the Council simulate a response to a crisis over a period of not less than 7 days.</text></paragraph></subsection><subsection id="id43C41371DC164BB3A15B0A2BB07696D3"><enum>(c)</enum><header>Activation</header><paragraph id="id9E36062CDBF9403194B9A0199183A155"><enum>(1)</enum><header>In general</header><text>The Director may activate members of the Guard—</text><subparagraph id="idDE7EBAF9009A4C97962784C0579BD73C"><enum>(A)</enum><text>during a crisis for the purpose of providing expertise and labor to promote the ability of the United States to procure, manufacture, and distribute critical resources; and</text></subparagraph><subparagraph id="id1813D3CB07C24E588C387A4DE3143CA5"><enum>(B)</enum><text>to perform full-time training programs under subsection (b)(3).</text></subparagraph></paragraph><paragraph id="id76E09249B49341FA9A5E17F1E1940A34"><enum>(2)</enum><header>Full-time service</header><text>Upon an activation under subparagraph (A), the Director may compel members of the Guard to active, full-time service.</text></paragraph><paragraph id="id427C6EAD2B7D4E25B270432EDB22ACDA"><enum>(3)</enum><header>Duties</header><text>If the Director activates the Guard under paragraph (1), the Guard may—</text><subparagraph id="idBADA2A4A2E7848A59328586730A3DAF5"><enum>(A)</enum><text>share best practices across industry partners;</text></subparagraph><subparagraph id="idBBF7D88036CD4FB991D1BCE62FA56C93"><enum>(B)</enum><text>coordinate the manufacturing efforts of industry partners;</text></subparagraph><subparagraph id="idD93042A030414577BD526719F5C120B2"><enum>(C)</enum><text>provide technical assistance to industry partners;</text></subparagraph><subparagraph id="id79F7CD46C72241C8A39B3FA6EF7102CF"><enum>(D)</enum><text>procure raw materials or supplies;</text></subparagraph><subparagraph id="id51FD37B7256D48A8AD7731E703CDA75B"><enum>(E)</enum><text>facilitate communications between industry partners;</text></subparagraph><subparagraph id="idF165FE4E95CF438982573F4D88B930A6"><enum>(F)</enum><text>provide logistics support in the delivery of critical resources;</text></subparagraph><subparagraph id="idB00021691A134E1EB0153E5948AE53EE"><enum>(G)</enum><text>identify suppliers of scarce critical resources;</text></subparagraph><subparagraph id="idCC36CF646E604BF0B54025D9F448548D"><enum>(H)</enum><text>coordinate between private industry, MEP centers, and Manufacturing USA institutes; and</text></subparagraph><subparagraph id="idAAACAF17379945CC957D80043044BC8B"><enum>(I)</enum><text>conduct any other activities that help provide critical resources to areas of greatest need, as determined by the Director, in consultation with the Council.</text></subparagraph></paragraph></subsection><subsection id="id59237BFA77254028A92E4DBC79868C24"><enum>(d)</enum><header>Compensation</header><text>The Director may provide compensation to members of the Guard at rates to be fixed by the Secretary without regard to any other law, including any provision of title 5, United States Code, and any rule issued under that title.</text></subsection><subsection id="idBBA5805D44F0427EAE032E7BD71D93C7"><enum>(e)</enum><header>Participation incentives</header><text>The Director may establish incentives to encourage industry partners to employ members of the Guard.</text></subsection><subsection id="id6D97B221539E4100B1CD5EBEA0A99C11"><enum>(f)</enum><header>Office of Personnel Management</header><text>The Secretary, in coordination with the Director of the Office of Personnel and Management, shall establish procedures with respect to the appointment of members of the Guard and the conditions of employment with respect to those members.</text></subsection></section><section id="idc9d1f4def42d4deea89416ac2905d4bb"><enum>7.</enum><header>Supply chain data exchange</header><subsection id="id97DB112EFB1C44AE83992B713B976693"><enum>(a)</enum><header>Establishment</header><paragraph id="id08714564DE85478D8C31B153EDBDC241"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall develop a plan to establish the Supply Chain Data Exchange.</text></paragraph><paragraph id="idE6CF0DA3CE5843CFB7FC96C0D2F5E0F5"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Data Exchange shall be to—</text><subparagraph id="id00DFF5FD2E9D4B828BBA51BB3A854BA7"><enum>(A)</enum><text>allow the Director to—</text><clause id="id49E05A7B4ED14EBE968C9B116C5269FB"><enum>(i)</enum><text>take account of—</text><subclause id="idA11DAD12DA0A416F8F733070A8A301A7"><enum>(I)</enum><text>critical resources that have been recently manufactured, imported, or distributed; and</text></subclause><subclause id="id334750D880FA46B29F48C316C569B364"><enum>(II)</enum><text>the ability of industry partners to manufacture critical resources; and</text></subclause></clause><clause id="id1F2E1C70689F45B79ED812E084B1A713"><enum>(ii)</enum><text>plan the flow of critical resources during a crisis;</text></clause></subparagraph><subparagraph id="id5CF95638474545AAB369309B787C2302"><enum>(B)</enum><text>provide the Director with an understanding of the volume of critical resources provided by industry partners to enable the Director to develop plans to—</text><clause id="idEEF6514F66E24F0FAA6BF1EB250EE635"><enum>(i)</enum><text>direct the Guard to assist industry partners in increasing the production capacity of critical resources;</text></clause><clause id="id64D1BA7825B5453AABBE9424800CA7DB"><enum>(ii)</enum><text>alleviate supply chain bottlenecks;</text></clause><clause id="id0CD83D2663584EB98E8018F491E0E970"><enum>(iii)</enum><text>allocate supplies of the Federal Government to the areas of greatest need; and</text></clause><clause id="idC2626E4B4A9E4488AF3BADED9161F616"><enum>(iv)</enum><text>coordinate between manufacturers and distributors to mitigate scarcity of critical resources;</text></clause></subparagraph><subparagraph id="idfeca0b9114004bdeb9626b291ff6450d"><enum>(C)</enum><text>allow the Director to predict local or national scarcity of critical resources for the duration of a crisis; and</text></subparagraph><subparagraph id="id8AF70EDBC44A49DD83A7FC6ACD399354" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>enable the Director to direct the Guard or collaborate with industry partners or Federal agencies to mitigate scarcities of critical resources.</text></subparagraph></paragraph><paragraph id="id8C1F3A2FB96045FB910E727FF451EB35"><enum>(3)</enum><header>Contents</header><text>The Director shall—</text><subparagraph id="idF7ABDA7EBE3C42049AC8FFC2FC4D4DAA"><enum>(A)</enum><text>solicit data from industry partners relating to the manufacturing output of critical resources; and</text></subparagraph><subparagraph id="idBC2762DAB43A4B4C89F429C18C888EAB"><enum>(B)</enum><text>add the data received under subparagraph (A) to the Data Exchange.</text></subparagraph></paragraph><paragraph id="id110CD92A5B7B4C3CAC83B240C3145EB8"><enum>(4)</enum><header>Data privacy</header><subparagraph id="id5F0559C8F40647F49991C475EDB1EB02"><enum>(A)</enum><header>In general</header><text>In consultation with industry partners, the Director may develop security measures that are necessary to protect information in the Data Exchange, including protocols to ensure that, depending on the nature of information in the Data Exchange, only individuals with the appropriate level of authorization may access the information.</text></subparagraph><subparagraph id="id9CD7C24D16104516B813C6C76F28C13E"><enum>(B)</enum><header>Information disclosure</header><clause id="idB1FEE628F24A4ABC861C3C00A1BF7767"><enum>(i)</enum><header>In general</header><text>The Director may withhold information obtained from an industry partner under this section only to the extent permitted by law.</text></clause><clause id="idB8E8FDD706584CFF87FF309A22154533"><enum>(ii)</enum><header>FOIA exemption</header><text>Unless the disclosure of data described in paragraph (3)(A) would be consistent with security measures developed under subparagraph (A) of this paragraph, the data shall be—</text><subclause id="id5EEF7ABD471F41DFAFEF22D44C52AE68"><enum>(I)</enum><text>withheld from public disclosure; and</text></subclause><subclause id="idE1A0739FC0E74B2991F73114B31234AF"><enum>(II)</enum><text>exempt from disclosure under section 552(b)(3) of title 5, United States Code.</text></subclause></clause></subparagraph><subparagraph id="id34DFB781457745669EC60848A191125B"><enum>(C)</enum><header>Usage agreements</header><text>The Director shall develop a usage agreement for the Data Exchange to ensure that data shared to the Data Exchange by an industry partner is—</text><clause id="id98691D58D3D847239182A3F4E9771992"><enum>(i)</enum><text>hosted securely; and</text></clause><clause id="id8C9CABE546904D7A82D84C3098C88C89"><enum>(ii)</enum><text>only used for purposes agreed to in advance by the Director and the industry partner.</text></clause></subparagraph></paragraph><paragraph id="id6723EA883E4C47D49432F4955840DDDD"><enum>(5)</enum><header>Development</header><subparagraph id="idA16B9FD7D3BE4F4BA6DA8D09AEE83CDA"><enum>(A)</enum><header>In general</header><text>The Director, with the consent of a Federal agency, may use the services, equipment, personnel, and facilities of a Federal agency, with or without reimbursement, to—</text><clause id="id8DBA12A4249A4FA5AB607430D4137891"><enum>(i)</enum><text>develop the Data Exchange; or</text></clause><clause id="idE7E6971000FA4A7F982A4B946EAE640E"><enum>(ii)</enum><text>identify a data exchange existing on the date of enactment of this Act that can be modified to have the capacity to host the Data Exchange required under this section that provides—</text><subclause id="idA48213483E4B474A86795E56F2A6DB05"><enum>(I)</enum><text>necessary functionality to the Director; and</text></subclause><subclause id="id00047A38058C41C3A5C02A64107BFB79"><enum>(II)</enum><text>additional functionality to industry partners.</text></subclause></clause></subparagraph><subparagraph id="id3E48D33AECC04B1B8055DF828D719423"><enum>(B)</enum><header>Value to participants</header><text>In order to encourage the participation of industry partners in the Data Exchange, the Director may develop a Data Exchange that provides—</text><clause id="id9DC8D776D19E43EC9898624EEDB8ED9F"><enum>(i)</enum><text>value to industry partners outside of a time of crisis; and</text></clause><clause id="id51F8C4DA40B94EED907AABC4EC01FC98"><enum>(ii)</enum><text>access to aggregated data or analytics to industry partners that participate in the Data Exchange that complies with the provisions of the usage agreement developed under paragraph (4)(C).</text></clause></subparagraph></paragraph><paragraph id="id7B2626FDD5C84149A0C6CA07DCBA4CD3"><enum>(6)</enum><header>Participation incentives</header><text>The Director may establish incentives to encourage the participation and cooperation of industry partners with the Data Exchange.</text></paragraph></subsection></section><section id="idDCE802549ECD404D8139C4FED7DAAAA6"><enum>8.</enum><header>Manufacturing Corps</header><subsection id="idC0D81D53769F48C58CBEBEC263F2DF5D"><enum>(a)</enum><header>Establishment</header><text>There is established within the Office the Manufacturing Corps.</text></subsection><subsection id="idA4EDF4E501E24B37B88CEFDB282F9527"><enum>(b)</enum><header>Duties</header><text>The Manufacturing Corps shall—</text><paragraph id="idC4A5C5E25ED44ED78E47410C59764563"><enum>(1)</enum><text>function as a workforce development program that prioritizes the training of manufacturing skills determined to be essential to the economic security of the United States by the Director and the Council;</text></paragraph><paragraph id="idDD3DCD47A4FF4E17B08AA02FFEB54AB9"><enum>(2)</enum><text>support the development of an innovative and flexible manufacturing workforce in the United States;</text></paragraph><paragraph id="idF6DE45F976B14587B47854ACE68D56CB"><enum>(3)</enum><text>provide on-the-job training to members of the Manufacturing Corps; and</text></paragraph><paragraph id="id1026D479945046739ACE1F055EC65A13"><enum>(4)</enum><text>provide a qualified base of individuals to join the Guard upon the completion of the Manufacturing Corps program.</text></paragraph></subsection><subsection id="id1E3E6C1EFD0C4D9D81FD2C9DB1F79473"><enum>(c)</enum><header>Membership</header><paragraph id="idEC59768E268B46C8B557794107A222DF"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall develop criteria for membership in the Manufacturing Corps, which may include a competitive process that evaluates the dedication and enthusiasm of individuals for assisting the public during a crisis.</text></paragraph><paragraph id="idB9907E5CAF2642FC8B8D0125FFD7EED0"><enum>(2)</enum><header>Preference</header><text>In selecting members of the Manufacturing Corps, the Director shall give preference to an individual who is—</text><subparagraph id="id6F2146A727CD40589DEFD5C97747A8DE"><enum>(A)</enum><text>an underrepresented racial or ethnic minority;</text></subparagraph><subparagraph id="id58EB6257FFC34E26978BD6EC07BF5665"><enum>(B)</enum><text>a woman;</text></subparagraph><subparagraph id="idDB41C01B8FCA48AA85F09620FC99F350"><enum>(C)</enum><text>a veteran (as defined in section 101 of title 38, United States Code); or</text></subparagraph><subparagraph id="id459945C540F5454791A9B6B8E1AAC1FD"><enum>(D)</enum><text>a resident of an underrepresented geographic region.</text></subparagraph></paragraph><paragraph id="idA18CE7DF62D34BEB8CC2FE4253AB00C1"><enum>(3)</enum><header>Term</header><text>The term of a member in the Manufacturing Corps shall be for a period of not less than 1 year and not more than 2 years.</text></paragraph></subsection><subsection id="idBA1DFBBA5FE241108BEE9AA6E8BA51B0"><enum>(d)</enum><header>Activities</header><paragraph id="id23025E6B4DC84D9183C3EE82C073F95D"><enum>(1)</enum><header>Apprenticeship</header><subparagraph id="id9202AD4D9F0D44748A9ECF4C720545EA"><enum>(A)</enum><header>In general</header><text>A member of the Manufacturing Corps shall participate in a registered apprenticeship with a host organization for a 1-year period.</text></subparagraph><subparagraph id="idE49C7D63007240F79C3F0D671B497152"><enum>(B)</enum><header>Skills</header><text>A registered apprenticeship of a member of the Manufacturing Corps with a host organization shall—</text><clause id="idC7FF93BC72E0409A89608086B8409807"><enum>(i)</enum><text>provide the member with fundamental skills necessary to be successful in a manufacturing or supply chain workforce;</text></clause><clause id="id71A67A4A9EF64F7599D4FD2AAC73E26B"><enum>(ii)</enum><text>qualify the member as a full-time employee of the host organization; and</text></clause><clause id="id98DA81F26576481FADD4318BF1D4F71F"><enum>(iii)</enum><text>provide training and career development opportunities.</text></clause></subparagraph></paragraph><paragraph id="id5214F4725B4A41C38FBD58E8D25617E7"><enum>(2)</enum><header>Training requirement</header><subparagraph id="id99495023E0D64AAFA95C6851A2368B9B"><enum>(A)</enum><header>Initial training</header><text>The Director shall provide individuals who are selected as members of the Guard with initial training that—</text><clause id="idE0A8B1850FF3467FB8C02E6C63A24FDC"><enum>(i)</enum><text>lasts for not fewer than 2, and not more than 4, weeks;</text></clause><clause id="id98E3485F839F4D8C81E856F65084A681"><enum>(ii)</enum><text>serves as an orientation for the Guard; and</text></clause><clause id="id0D63FEA9616246439E10943CC62BF8EF"><enum>(iii)</enum><text>includes a survey of basic skills in preparation for a registered apprenticeship.</text></clause></subparagraph><subparagraph id="id4D80F01B8C6A46849AF275DD7C7DD75B"><enum>(B)</enum><header>Periodic training</header><text>The Director shall provide regular training to members of the Manufacturing Corps that—</text><clause id="id7B9177FEA1194F32BF08E240AFDB45EA"><enum>(i)</enum><text>ensures that the members have the ability to serve as effective members of the Guard; and</text></clause><clause id="id4EF03FA1AC65406FBAA73B771B87F739"><enum>(ii)</enum><text>enhances the ability of members to contribute to the workforce of the United States and the Guard.</text></clause></subparagraph></paragraph><paragraph id="id576E8EDE6B4E4B68B9ECD404A8581EA0"><enum>(3)</enum><header>Compensation</header><text>The Director may provide supplemental compensation to members of the Manufacturing Corps at rates to be fixed by the Secretary without regard to any other law, including any provision of title 5, United States Code, and any rule issued under that title. </text></paragraph></subsection><subsection id="id6E7453A3AEE940DAB9F6BD5EB387B90D"><enum>(e)</enum><header>Graduation</header><paragraph id="idC57119F23F8149BCB618692901BCD95B"><enum>(1)</enum><header>In general</header><text>Upon the expiration of the term of a member of the Manufacturing Corps, the Director shall review the performance of the member in—</text><subparagraph id="idFDD1BC2AD77A4C0E9298ECA6DC0C4717"><enum>(A)</enum><text>the registered apprenticeship under subsection (d)(1)(A); and</text></subparagraph><subparagraph id="id8EA0AA07EA294BF79F7F7B0B688EB5CB"><enum>(B)</enum><text>the training under subsection (d)(2).</text></subparagraph></paragraph><paragraph id="idB9D55537A8AE48C8BCB2C471C7ACA7AC"><enum>(2)</enum><header>Incentives</header><text>The Director may establish incentives to encourage members of the Manufacturing Corps who receive favorable reviews under paragraph (1) to join the Guard.</text></paragraph></subsection></section><section id="idFD324BC8E5B24D69896845B684EEA9ED"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act $1,000,000,000 for the 5-fiscal year period beginning with fiscal year 2021.</text></section></legis-body></bill>
