which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Forest and Rangeland Renewable Resources Planning Act of 1974 to promote reforestation following unplanned events on Federal land, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Repairing Existing Public Land by Adding Necessary Trees Act</short-title></quote> or the <quote><short-title>REPLANT Act</short-title></quote>.</text></section><section id="id3296E15B4B5A40B193B558919E49912C"><enum>2.</enum><header>Reforestation following wildfires and other unplanned events</header><subsection id="id72E47863CB3145929619976226441119"><enum>(a)</enum><header>Forest and Rangeland Renewable Resources Planning Act of 1974</header><paragraph id="id997408C20A264064844082D5DBCC27F3"><enum>(1)</enum><header>National forest cover policy</header><subparagraph id="id069873CFBD38444DACBFC43C1BE8C042"><enum>(A)</enum><header>In general</header><text>Section 3 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>) is amended—</text><clause id="id5838170B43C8412A96A1A50893218641"><enum>(i)</enum><text>by redesignating subsection (e) as subsection (f);</text></clause><clause id="id2BF7EA3891774594A7102D0AA6D1BD74"><enum>(ii)</enum><text>by redesignating the second subsection (d) (relating to the policy of Congress regarding forested land in the National Forest System) as subsection (e); and</text></clause><clause id="idE09CD861C9C7471C8EC82FDC1592A050"><enum>(iii)</enum><text>in subsection (e) (as so redesignated)—</text><subclause id="idD9B68AA5DE5A4B1A81122E33FDE02122"><enum>(I)</enum><text>in paragraph (2)—</text><item id="idA3AB3B7163054655AFAB1C485599CED5"><enum>(aa)</enum><text>in the first sentence—</text><subitem id="id491F8573F6554F5F84B84898835784DA"><enum>(AA)</enum><text>by striking <quote>9 of this Act, the Secretary shall annually for eight years following the enactment of this subsection</quote> and inserting <quote>9, the Secretary shall, annually during each of the 10 years beginning after the date of enactment of the <short-title>REPLANT Act</short-title></quote>; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id68AE2EA18B6B4CF38F47FC48EBB1EE89"><enum>(BB)</enum><text>by striking <quote>eight-year</quote> and inserting <quote>10-year</quote>; </text></subitem></item><item id="id7B909F6C232C47C6AB8D657E559DCC93"><enum>(bb)</enum><text>in the second sentence, by striking <quote>such eight-year period</quote> and inserting <quote>the 10-year period</quote>; and</text></item><item id="idAD8EF50E9B6A4FABB9C76D08B31ED3AE"><enum>(cc)</enum><text>in the third sentence, by striking <quote>1978</quote> and inserting <quote>2021</quote>;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id1BF622003423431E95DEDCB8D245D98E"><enum>(II)</enum><text>in paragraph (3), in the first sentence, by striking <quote>subsection (d)</quote> and inserting <quote>subsection</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF6834C7681E74CBF9BC85583911D18E0"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4BD0BDCE18AD4658AF230E7304ADBF9F"><paragraph commented="no" display-inline="no-display-inline" id="id5BED73AD22274F8993112F1A50D34E00"><enum>(4)</enum><header>Reforestation requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="id542619E04E6946FEA36D7284791F09FF"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="idba52dad108f74da993ada616dc6c7ce1"><enum>(i)</enum><header>Natural regeneration</header><subclause id="id37B6EE33811E4C74A4B8A4BD93D50261"><enum>(I)</enum><header>In general</header><text>The term <term>natural regeneration</term> means the establishment of a tree or tree age class from natural seeding, sprouting, or suckering in accordance with the management objectives of an applicable land management plan.</text></subclause><subclause id="idEB1C0A35A650400AB1421F9D6C3D05DB"><enum>(II)</enum><header>Inclusion</header><text>The term <term>natural regeneration</term> may include any site preparation activity to enhance the success of regeneration to the desired species composition and structure.</text></subclause></clause><clause id="id6170109352d948bb9b16ff159fa54808"><enum>(ii)</enum><header>Priority land</header><text>The term <term>priority land</term> means National Forest System land that, due to an unplanned event—</text><subclause id="id81d1ae8404c74f8db17b7e4885250101"><enum>(I)</enum><text>does not meet the conditions for appropriate forest cover described in paragraph (1);</text></subclause><subclause id="id4134006573e64890a0eedce8915dc515"><enum>(II)</enum><text>requires reforestation to meet the objectives of an applicable land management plan; and</text></subclause><subclause id="id5073b516eaa4476a9cd3428b8851b69e"><enum>(III)</enum><text>is unlikely to experience natural regeneration without assistance.</text></subclause></clause><clause id="id45925400e9a849ff98fcc5023f8e3775"><enum>(iii)</enum><header>Reforestation</header><text>The term <term>reforestation</term> means the act of renewing tree cover, taking into consideration species composition and resilience, by establishing young trees through—</text><subclause id="idf5bb9f1fea984e3bb091d0343ca45a26"><enum>(I)</enum><text>natural regeneration;</text></subclause><subclause id="id527232357D8149E1A58FC1FA1B436310"><enum>(II)</enum><text>natural regeneration with site preparation; or</text></subclause><subclause id="id9c39dec6ce544a5999e97a628b055082"><enum>(III)</enum><text>planting or direct seeding.</text></subclause></clause><clause id="id92FDB52C228E4F18882A55F5F3CB6C67"><enum>(iv)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Chief of the Forest Service.</text></clause><clause id="id2178d193e8994471b3064c789b01bd73"><enum>(v)</enum><header>Unplanned event</header><subclause id="idE0BAA282573F495B81AE7FC96FBA6277"><enum>(I)</enum><header>In general</header><text>The term <term>unplanned event</term> means any unplanned disturbance that—</text><item id="ida02ce4a86246463eb048d3ce8440dcbe"><enum>(aa)</enum><text>disrupts ecosystem or forest structure or composition; or</text></item><item id="iddda2c3dff2d044d7943eae555819585a"><enum>(bb)</enum><text>changes resources, substrate availability, or the physical environment.</text></item></subclause><subclause id="idbe138531b4f0464d9cb8541ac035ff2d"><enum>(II)</enum><header>Inclusions</header><text>The term <term>unplanned event</term> may include—</text><item id="idCD563ED0FBA942188FDA1BE21BE98F36"><enum>(aa)</enum><text>a wildfire;</text></item><item id="id531C5C07A45D46D487FEFC64B255D355"><enum>(bb)</enum><text>an infestation of insects or disease;</text></item><item id="id331B334A47884280813620FB2489911F"><enum>(cc)</enum><text>a weather event; and</text></item><item id="idAE3C01FFF9D24BB6B76354618AA46FB2"><enum>(dd)</enum><text>animal damage.</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1A023162575A4200ADCC88C83D13A6D6"><enum>(B)</enum><header>Requirement</header><text>Each reforestation activity under this section shall be carried out in accordance with applicable Forest Service management practices and definitions, including definitions relating to silvicultural practices and forest management.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18AF4F966CE04AEE92E5CB819680C4E7"><enum>(C)</enum><header>Reforestation priority</header><clause commented="no" display-inline="no-display-inline" id="id1BFC25D3847B4289AEB0020198D793B9"><enum>(i)</enum><header>In general</header><text>In carrying out this subsection, the Secretary shall give priority to projects on the priority list described in clause (ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="id1AECE796301546DCABCD3B90E2C5144E"><enum>(ii)</enum><header>Priority list</header><subclause commented="no" display-inline="no-display-inline" id="idDD1F4AA6FDD74345B103C5BA020C9FFA"><enum>(I)</enum><header>In general</header><text>The Secretary shall, based on recommendations from regional foresters, create a priority list of reforestation projects that—</text><item commented="no" display-inline="no-display-inline" id="id61C80C5BF0D343FFB6FE61A665D134F8"><enum>(aa)</enum><text>primarily take place on priority land;</text></item><item id="id3c2eaa052f6b4eaca001c0767fe481ea"><enum>(bb)</enum><text>promote effective reforestation following unplanned events; and</text></item><item id="id49d5f4b80f4d49b69a4f6e1880b456df"><enum>(cc)</enum><text>may include activities to ensure adequate and appropriate seed availability.</text></item></subclause><subclause id="idf4cd06b3ced048ae933c870d335827d1"><enum>(II)</enum><header>Ranking</header><text>The Secretary shall rank projects on the priority list under subclause (I) based on—</text><item id="idf31f378a83a94c1998722f2d4675affc"><enum>(aa)</enum><text>documentation of an effective reforestation project plan;</text></item><item id="id3e57e4cf81094d52bae481bbd823d6b3"><enum>(bb)</enum><text>the ability to measure the progress and success of the project; and</text></item><item id="idd59ce9c983664cda946eeddfd26fef9e"><enum>(cc)</enum><text>the ability of a project to provide benefits relating to forest function and health, soil health and productivity, wildlife habitat, improved air and water quality, carbon sequestration potential, resilience, job creation, and enhanced recreational opportunities.</text></item></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="id13A835D9F73C480294C4B8F4AC2C9644"><enum>(B)</enum><header>Conforming amendment</header><text>Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>) is amended, in the undesignated matter following paragraph (5) of subsection (g)—</text><clause id="id101FDDDC7AEB4D21AFBBB7580240F274"><enum>(i)</enum><text>by striking <quote>section 3(d)</quote> and inserting <quote>subsection (e) of section 3</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id60B3D39E04654BFE964BDAF615712BA0"><enum>(ii)</enum><text>by striking <quote>1601(d)</quote> and inserting <quote>1601</quote>.</text></clause></subparagraph></paragraph><paragraph id="id6DD27C54BE2C45659F41241503A503BE"><enum>(2)</enum><header>National Forest System program elements</header><text>Section 9 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1607">16 U.S.C. 1607</external-xref>) is amended, in the second sentence, by striking <quote>2000</quote> and inserting <quote>2030</quote>.</text></paragraph></subsection><subsection id="id8771EDFDE2954CE58FA79799DFAE8F23"><enum>(b)</enum><header>Reforestation Trust Fund</header><text display-inline="yes-display-inline">Section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>) is amended—</text><paragraph id="id244F16B42141402CAD11B4620D57ED33"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idCFCCC161D4D04294BA0AD0735398D657"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="id22AF1FEA5C0B4585ACB8814D41CD33FD"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="idACBBD24A8A404BB4910B9EA8F92B5F66"><enum>(i)</enum><text>in the second sentence, by striking <quote>Proper adjustment</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67811C2313DB4A44AD94041C01823090"><paragraph id="id3364CDD1B6B64CB7B7DBF99D57005F08"><enum>(3)</enum><header>Adjustment of estimates</header><text>Proper adjustment</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idAA70C027E2A94BDB8CD0F6FCA72056A9"><enum>(ii)</enum><text>by striking <quote>(3) The amounts</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB1F0BBECE6174B44AD19EAB3AF25D4F7"><paragraph id="id2C7B6ECB6ACA4C779AAB531B41AC6D6F"><enum>(2)</enum><header>Frequency</header><text>The amounts</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idC8367C57F15B44CFB48C6A6FAD3FE19C"><enum>(C)</enum><text>by striking the subsection designation and all that follows through <quote>the Secretary</quote> in paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id026F122BAB584E3DBEADB3D5B5A70952"><subsection id="id43A65E11F6FE480494A6C1E02E17DB31"><enum>(b)</enum><header>Transfers to Trust Fund</header><paragraph id="idE4B52928BD6E46B19D447DD15CFBF6EC"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1EE9D742625E4636A6A82E69CBCC9664"><enum>(2)</enum><text>in subsection (d)(1)—</text><subparagraph id="idF7F01258A96447848630FD82CDA104CE"><enum>(A)</enum><text>by striking <quote>section 3(d)</quote> and inserting <quote>subsection (e) of section 3</quote>; and</text></subparagraph><subparagraph id="id208390FBB7B442E593002EA0174CDD88"><enum>(B)</enum><text>by striking <quote>1601(d)</quote> and inserting <quote>1601</quote>.</text></subparagraph></paragraph></subsection></section><section id="id9986E8836AFB471790954161DBE34A14"><enum>3.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Agriculture shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives, and make publicly available on the website of the Forest Service, a report that describes, with respect to the preceding year—</text><paragraph id="id359b15b0b2ce4eb79b0cf9e29d330836"><enum>(1)</enum><text>an evaluation of the degree to which the Secretary has achieved compliance with the requirements contained in the amendments made by this Act, including, as a result of those amendments, the number of acres covered by reforestation projects that follow unplanned events (such as wildfires);</text></paragraph><paragraph id="idf6840873e9be4abca1cfb6b45fbc07d4"><enum>(2)</enum><text>the total number of acres of land reforested under each authority of the Secretary under which reforestation projects have been carried out; </text></paragraph><paragraph id="idd2592eb3afbe458d9f8fce6f23e07ae5"><enum>(3)</enum><text>the number of acres of National Forest System land affected by, and the substance of reforestation needs on that land resulting from, unplanned events; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5351182838784f5ea4a16df4e89cd3e5"><enum>(4)</enum><text>the number of acres in need of reforestation under subsection (e)(1) of section 3 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>).</text></paragraph></section></legis-body></bill>
