<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 858</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish criminal penalties for aliens who fail to depart before the expiration of their visas. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id82FD0ED613E24DF1993101E8A7CB9DE2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Visa Overstays Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA650A5215DFD4F5D96D9B997148F0530"><enum>2.</enum><header>Criminal penalties for aliens who fail to depart from the United States before the expiration of their visas</header><subsection id="idD2939CCDCE8D400EB7FAAADE85328740"><enum>(a)</enum><header>In general</header><text>Section 274D of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324d">8 U.S.C. 1324d</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id109106609A1C4353991976B5EC51277E"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ID37650D5C537142929A7514095AEF7879"><enum>274D.</enum><header display-inline="yes-display-inline">Penalties for failure to depart</header><subsection commented="no" display-inline="no-display-inline" id="id93265044C210457D9C8B42D4EE527EE2"><enum>(a)</enum><header>Prohibited conduct</header><text>It is unlawful for any alien who is subject to a final order of removal—</text><paragraph id="ID14066C7D54004A5B9E9894C33A3452AA"><enum>(1)</enum><text>to willfully fail or refuse—</text><subparagraph id="IDBAFA43F537E14ADD9E378F2BCDC6A898"><enum>(A)</enum><text>to depart from the United States pursuant to such order;</text></subparagraph><subparagraph id="ID9CAD1CBA5EDC4CC88D79A3E6EB52193C"><enum>(B)</enum><text>to make a timely application in good faith for travel or other documents necessary for departure; or</text></subparagraph><subparagraph id="IDAF2FDB140BBC4611A48A04379FF33432"><enum>(C)</enum><text>to present for removal at the time and place required by the Secretary of Homeland Security; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0E5F91EF030743A6A43CE670E7971B65"><enum>(2)</enum><text>to conspire to or take any action designed to prevent or hamper the alien’s departure pursuant to such order.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEA377E38727C41A2B27B8D10E1EA2857"><enum>(b)</enum><header>Civil penalties</header><text>Any alien who violates subsection (a) shall pay a civil penalty of not more than $500 to the Secretary of Homeland Security for each day the alien remains in violation of such subsection.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id04BB103493BD43D2BA5B12958DAE0062"><enum>(c)</enum><header>Criminal penalties</header><text>Any alien who is required to depart from the United States as a result of the expiration of the alien’s visa and fails to depart the United States within the prescribed period shall be fined under title 18, United States Code, imprisoned for not more than 1 year, or both.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ID21BC06A92A1C49B483132E935A978ABA"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to diminish or qualify any penalties to which an alien may be subject for activities proscribed under section 243(a) or under any other section of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA1E121727C51458FBE56827477D7CEF7"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended by striking the item relating to section 274D and inserting the following:</text><quoted-block style="OLC" id="id449765b3-f1fc-42e0-ac8f-175b4fa586d0"><toc><toc-entry level="section">Sec. 274D.
