which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to require the Director of the Office of Personnel Management to establish and maintain a public directory of the individuals occupying Government policy and supporting positions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H54A440B3EBDD453B90C816333A554BFA"><section commented="no" section-type="section-one" id="HA5E2DCCDC8E2481C9CD9C9AFA162276B"><enum>1.</enum><header>Short title; purposes</header><subsection id="H5F6C7F3A0FC84CEDA3DBE09E82285EA8"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Periodically Listing Updates to Management Act</short-title></quote> or the <quote><short-title>PLUM Act</short-title></quote>.</text></subsection><subsection id="HA9E10A76F54F4A2A96E5FC978BA286DA"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to—</text><paragraph id="HDF3CDBDED9CE4CA1811E3D3DF3ADDDB5"><enum>(1)</enum><text>modernize the practice of publishing the <quote>Plum Book,</quote> which has occurred nearly every 4 years since 1952, and contains data on more than 9,000 Federal civil service leadership and support positions in the legislative and executive branches of the Government that may be subject to noncompetitive appointment;</text></paragraph><paragraph id="H96DC7060B18C4C6FBAF7CA1120D94B82"><enum>(2)</enum><text>enhance transparency by reporting who is serving in the Government and making policy decisions; and</text></paragraph><paragraph id="H35163DCDFA964BC8A450F9E6986B9DA7"><enum>(3)</enum><text>improve the frequency, accuracy, and accessibility of data on the individuals filling Government policy and supporting positions.</text></paragraph></subsection></section><section id="HA578586FC476458D83B51C9AF71F4CC6"><enum>2.</enum><header>Establishment of public website on Government policy and supporting positions</header><subsection id="HB04D4548E2FC4B73A8B9F605C481908A"><enum>(a)</enum><header>Establishment</header><paragraph id="HD0F7B2DD581A429091F4B7EE4D0F18BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1DAFB62C0BBF47E59441D4C5A825E16C"><section id="H1A6091F35F624DA8AC2C9BC65645D751"><enum>3330f.<?LEXA-Enum 3330f.?></enum><header>Government policy and supporting position data</header><subsection id="H861A1DAD895747BC8D9F95161BD60C5B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H51AE7BFB7A8C42439E6B2D5E0BB0C002"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> means—</text><subparagraph id="H34914FF149CC4730B5E8DB707B4E37F3"><enum>(A)</enum><text>any Executive agency, including the United States Postal Service and the Postal Regulatory Commission;</text></subparagraph><subparagraph id="H61C0B3691D7646D08346F345240F8C84"><enum>(B)</enum><text>the Architect of the Capitol, the Government Accountability Office, the Government Publishing Office, and the Library of Congress; and</text></subparagraph><subparagraph id="HBD46E7B603ED43DA851C8A5D71047067"><enum>(C)</enum><text>the Executive Office of the President and any component within that Office (including any successor component), including—</text><clause id="H1704C6AA48E74D9F8676780F63D3D4E8"><enum>(i)</enum><text>the Council of Economic Advisors;</text></clause><clause id="HC206C2056E474582BE032CC7EABAC730"><enum>(ii)</enum><text>the Council on Environmental Quality;</text></clause><clause id="H0AE6F5FE45874761A62910CDDFB4578E"><enum>(iii)</enum><text>the National Security Council;</text></clause><clause id="HD3EBD08A87C747D09E58F37FB160C11F"><enum>(iv)</enum><text>the Office of the Vice President;</text></clause><clause id="HE87AD0D6A24146FDA7D40873A08E53FE"><enum>(v)</enum><text>the Office of Policy Development;</text></clause><clause id="H8354B3B2C8B44E13B11BDE953E80AB7F"><enum>(vi)</enum><text>the Office of Administration;</text></clause><clause id="H020BC96F337649A8AE8AC438C5789F1F"><enum>(vii)</enum><text>the Office of Management and Budget;</text></clause><clause id="H4F9A688482434769BB29A3A4446B4617"><enum>(viii)</enum><text>the Office of the United States Trade Representative;</text></clause><clause id="HCBE69D0D8F1446AAA452F57CADB16FB0"><enum>(ix)</enum><text>the Office of Science and Technology Policy;</text></clause><clause id="HED3C1091A8CC423999D1F3B795EA359D"><enum>(x)</enum><text>the Office of National Drug Control Policy; and</text></clause><clause id="HCC94F6B6D1EB4F6AB5FB366FD3AD0F9F"><enum>(xi)</enum><text>the White House Office.</text></clause></subparagraph></paragraph><paragraph id="HC96F2EA6F0D64F869668737DEE86F505"><enum>(2)</enum><header>Appointee</header><text>The term <term>appointee</term>—</text><subparagraph id="H0F0CC94FC9C04CA38A08F3F5C296C6D6"><enum>(A)</enum><text display-inline="yes-display-inline">means an individual serving in a policy and supporting position; and</text></subparagraph><subparagraph id="H36AEB06369A546E2BE67EEA642103B75"><enum>(B)</enum><text display-inline="yes-display-inline">includes an individual serving in a policy and supporting position temporarily in an acting capacity in accordance with—</text><clause id="H41A14DDD7F92416FAA8CA2D3F12898FD"><enum>(i)</enum><text>sections 3345 through 3349d (commonly referred to as the <quote>Federal Vacancies Reform Act of 1998</quote>);</text></clause><clause id="H1F040E555AEA45ED9DE76B3D3E3E3B36"><enum>(ii)</enum><text>any other statutory provision described in section 3347(a)(1); or</text></clause><clause id="H628A0E2297614DCA832BCC5EBB2ACFBB"><enum>(iii)</enum><text>a Presidential appointment described in section 3347(a)(2). </text></clause></subparagraph></paragraph><paragraph id="HD32A88D04CFC4B20BDADB3532EDC575E"><enum>(3)</enum><header>Covered website</header><text>The term <term>covered website</term> means the website established and maintained by the Director under subsection (b).</text></paragraph><paragraph id="H0EB317CCB9A94C38AA2F640B996A9601"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph commented="no" id="H156F18B739BA4B7789E460019A8C23D7"><enum>(5)</enum><header>Policy and supporting position</header><text>The term <term>policy and supporting position</term> means—</text><subparagraph commented="no" id="HDF6CA5CB1D204D98AD08FF9CB05151CF"><enum>(A)</enum><text>a position that requires appointment by the President, by and with the advice and consent of the Senate;</text></subparagraph><subparagraph commented="no" id="HD9C7FD12B6C644EEBCA61D0B1FED9D2D"><enum>(B)</enum><text>a position that requires or permits appointment by the President or Vice President, without the advice and consent of the Senate;</text></subparagraph><subparagraph commented="no" id="HA521798B34C74F23A56D6091D7A8A7CF"><enum>(C)</enum><text>a position occupied by a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service, as defined under paragraphs (5), (6), and (7), respectively, of section 3132(a);</text></subparagraph><subparagraph commented="no" id="H0D8C0A7DAE6543CC97E3349FC0738A6B"><enum>(D)</enum><text>a position of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any successor regulation;</text></subparagraph><subparagraph commented="no" id="HCEED25704EBC430BAAB59AE3336CB571"><enum>(E)</enum><text>a position in the Senior Foreign Service;</text></subparagraph><subparagraph commented="no" id="H54C03E7643974D869162E4274323B77B"><enum>(F)</enum><text display-inline="yes-display-inline">any career position at an agency that, but for this section and section 2(b)(4) of the <short-title>PLUM Act</short-title>, would be included in the publication entitled <quote>United States Government Policy and Supporting Positions</quote> (commonly referred to as the <quote>Plum Book</quote>); and</text></subparagraph><subparagraph commented="no" id="HF5395705EB73419F96E9485AF4BC4264"><enum>(G)</enum><text>any other position classified at or above level GS–14 of the General Schedule (or equivalent) that is excepted from the competitive service by law because of the confidential or policy-determining nature of the position duties. </text></subparagraph></paragraph></subsection><subsection id="H656DCFCB590240799004801F1B0D07C4"><enum>(b)</enum><header>Establishment of website</header><text display-inline="yes-display-inline">The Director shall establish and maintain a public website containing the following information:</text><paragraph id="H003A7FCC7782468B9782BADB899347AA"><enum>(1)</enum><text>Each policy and supporting position in the Federal Government, including any such position that is vacant.</text></paragraph><paragraph id="H50273EC7E2AD46C08A1BA01448081426"><enum>(2)</enum><text>Each individual who—</text><subparagraph id="H6CB65FFFE80340C6901A96792801D6C9"><enum>(A)</enum><text>is serving in a position described in paragraph (1); or</text></subparagraph><subparagraph id="HC781CA983ADF4D33A7D06A60280F474D"><enum>(B)</enum><text>previously served in a position described in paragraph (1) under the President then in office.</text></subparagraph></paragraph></subsection><subsection id="HFA39CE81BCCA417F819EC7CDC20508E2"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">With respect to any policy and supporting position listed on the covered website, the Director shall include—</text><paragraph id="HEAEB362A7B07458587931C9CA33E3A7C"><enum>(1)</enum><text>the agency and agency component (including the agency and bureau code used by the Office of Management and Budget) in which the position is located;</text></paragraph><paragraph id="HE83557E5E28F44779A722B49E9D2A126"><enum>(2)</enum><text>the name of the position;</text></paragraph><paragraph id="HCDA8E0A6C4E542CC962FFC7A32A56739"><enum>(3)</enum><text>the name of the individual occupying the position (if any);</text></paragraph><paragraph id="H4341E0594C9741B88C83C54120F4F35C"><enum>(4)</enum><text>the geographic location of the position, including the city, State or province, and country;</text></paragraph><paragraph id="H001462346AA444D5B440D6691D4E6AA4"><enum>(5)</enum><text>the pay system for the position;</text></paragraph><paragraph id="H820427048CAD43CA84760A8D3FB3AD8B"><enum>(6)</enum><text>the level, grade, or rate of pay;</text></paragraph><paragraph id="H0DA03FDC86D6408B8E5A2E4C54FBE433"><enum>(7)</enum><text>the term or duration of the appointment (if any);</text></paragraph><paragraph id="H4CD270F70D044AB09C72E0870900B773"><enum>(8)</enum><text>the expiration date, in the case of a time-limited appointment;</text></paragraph><paragraph commented="no" id="H8D26BE4961604D3995310BE0AE232C6F"><enum>(9)</enum><text>a unique identifier for each appointee to enable tracking the appointee across positions; and</text></paragraph><paragraph id="H7A99D918D14241669DBA3D3E4975F5EA"><enum>(10)</enum><text>whether the position is vacant.</text></paragraph></subsection><subsection id="HF1B275CF332048E2BE62F9E946029950"><enum>(d)</enum><header>Format</header><text>The Director shall make the data on the covered website available to the public at no cost over the internet in a searchable, sortable, downloadable, and machine-readable format so that the data qualifies as an open Government data asset, as defined in section 3502 of title 44.</text></subsection><subsection id="H3F0EE9B3CCA946239FCFA103DFB1A1BA"><enum>(e)</enum><header>Authority of Director</header><paragraph id="H12B3C5E26274421EACE5DDDC0124E4AD"><enum>(1)</enum><header>Information required</header><text>Each agency shall provide to the Director any information that the Director determines necessary to establish and maintain the covered website, including the information uploaded under paragraph (4).</text></paragraph><paragraph commented="no" id="H6C68983462DD4037A086B7B25D913185"><enum>(2)</enum><header>Requirements for agencies</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>PLUM Act</short-title>, the Director shall issue instructions to agencies with specific requirements for the provision or uploading of information required under paragraph (1), including—</text><subparagraph commented="no" id="H9407B9993DFB49F480BFE65B81437E05"><enum>(A)</enum><text>specific data standards that an agency shall follow to ensure that the information is complete, accurate, and reliable;</text></subparagraph><subparagraph commented="no" id="H10A29B570C9D4336A229F8C467D91C69"><enum>(B)</enum><text>data quality assurance methods; and</text></subparagraph><subparagraph commented="no" id="H736CE3BAB81C4023B18407EC8CC145A6"><enum>(C)</enum><text display-inline="yes-display-inline">the timeframe during which an agency shall provide or upload the information, including the timeframe described under paragraph (4).</text></subparagraph></paragraph><paragraph id="H9543BF1E55284E1C9A069A1C3A09F2F6"><enum>(3)</enum><header>Public accountability</header><text>The Director shall identify on the covered website any agency that has failed to provide—</text><subparagraph id="H6E9F93488E2B40A4A1B26B059CF2F4A9"><enum>(A)</enum><text>the information required by the Director;</text></subparagraph><subparagraph id="H4CAE4E54EFBB4B668D5A1895CD6A6591"><enum>(B)</enum><text>complete, accurate, and reliable information; or</text></subparagraph><subparagraph id="H2D6D064B27C14BE7AD46F9BA5897F6FB"><enum>(C)</enum><text>the information during the timeframe specified by the Director.</text></subparagraph></paragraph><paragraph id="HEAB6FDE3DB444F52AF93A27C090F3659"><enum>(4)</enum><header>Monthly updates</header><subparagraph id="H5A8A24A28CBA43A3B2E658807F5FFEF0"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date on which the covered website is established, and not less than once during each 30-day period thereafter, the head of each agency shall upload to the covered website updated information (if any) on—</text><clause id="HFA6D17CCC0BF421F8204C631A9B52732"><enum>(i)</enum><text display-inline="yes-display-inline">the policy and supporting positions in the agency;</text></clause><clause id="H83BEAFAB7FAE4E29826F983F984B5E5C"><enum>(ii)</enum><text>the appointees occupying those positions in the agency; and</text></clause><clause id="H15D8FEAD91D2486AB8A871DA1757EEF1"><enum>(iii)</enum><text>the former appointees who served in policy and supporting positions in the agency under the President then in office.</text></clause></subparagraph><subparagraph commented="no" id="H237961D104424D1CBB2A15B0EFA69F59"><enum>(B)</enum><header>Supplement not supplant</header><text>Information provided under subparagraph (A) shall supplement, not supplant, data previously provided under that subparagraph.</text></subparagraph></paragraph><paragraph id="H6D004FB0C1194467819B8B0B8FB365EA"><enum>(5)</enum><header>OPM help desk</header><text>The Director shall establish a central help desk, to be operated by not more than 1 full-time employee, to assist any agency with implementing this section.</text></paragraph><paragraph id="HFC0A57145CB5447FB12F623056BDA88F"><enum>(6)</enum><header>Coordination</header><subparagraph id="HBB847EDE9722453387D1B49D77896E1F"><enum>(A)</enum><header>18F office</header><text display-inline="yes-display-inline">The Director shall consult with the 18F office (or any successor office) within the General Services Administration for purposes of the development, establishment, operation, and support of the covered website.</text></subparagraph><subparagraph id="HA1CD06AD7373471DB1FB240B5C21BA13"><enum>(B)</enum><header>Designation of agencies</header><text>The Director—</text><clause id="idA1B25BF924D7421BB617DEFB56D970AD"><enum>(i)</enum><text>may designate 1 or more agencies to participate in the development, establishment, operation, and support of the covered website; and</text></clause><clause id="idA2C009C06D8E4D4786DB4B6E3F735181"><enum>(ii)</enum><text>with respect to any such designation, may specify the scope of the responsibilities of the agency so designated.</text></clause></subparagraph></paragraph></subsection><subsection id="H95CEDC81BDA642A394A816FD6358FCF5"><enum>(f)</enum><header>Responsibility of agencies</header><paragraph id="H289CB5AE137D44D6B224FB65575E521D"><enum>(1)</enum><header>Provision of information</header><text display-inline="yes-display-inline">Each agency shall comply with the instructions and guidance issued by the Director to carry out this section, and, upon request of the Director, shall provide appropriate assistance to the Director to ensure the successful operation of the covered website in the manner and within the timeframe specified by the Director under subsection (e)(2).</text></paragraph><paragraph id="H0CF0A45BFB0B40B99190C935668ADCCC"><enum>(2)</enum><header>Ensuring completeness, accuracy, and reliability</header><text display-inline="yes-display-inline">The head of an agency shall include with any submission of information described in paragraph (1)—</text><subparagraph id="idBE1BDFF41B7D4154931D61098ADDB50B"><enum>(A)</enum><text display-inline="yes-display-inline">an explanation of how the agency ensured the information is complete, accurate, and reliable; and</text></subparagraph><subparagraph id="idADC69B9BC35E450A86F32D7AA5E5F514"><enum>(B)</enum><text display-inline="yes-display-inline">a certification that the information is complete, accurate, and reliable.</text></subparagraph></paragraph></subsection><subsection id="HD487729256FC47A882A65D8BF1A087FB"><enum>(g)</enum><header>Information verification</header><paragraph id="HADEBBA60FCFD4441B88F7ED0B01E4D86"><enum>(1)</enum><header>Semiannual confirmation</header><subparagraph id="id8F3B6C61E7DC411BA077C0228F38859B"><enum>(A)</enum><header>In general</header><text>Not less frequently than semiannually, the Director, in coordination with the White House Office of Presidential Personnel, shall confirm that the information on the covered website is complete, accurate, reliable, and up-to-date.</text></subparagraph><subparagraph id="idD09CCE2A4C004615890DAD76F3379067"><enum>(B)</enum><header>Certification</header><text>On the date on which the Director makes a confirmation under subparagraph (A), the Director shall publish on the covered website a certification that the confirmation has been made.</text></subparagraph></paragraph><paragraph id="H68EBE49D8B5F4C738A4EC33E639227E7"><enum>(2)</enum><header>Authority of director</header><text>In carrying out paragraph (1), the Director may—</text><subparagraph id="H182BCAB349904628ADAA98D5F58DD78B"><enum>(A)</enum><text>request additional information from an agency; and</text></subparagraph><subparagraph id="HE996AD7319A04E8C97948E3245613136"><enum>(B)</enum><text>use any additional information provided to the Director or the White House Office of Presidential Personnel for the purposes of verification.</text></subparagraph></paragraph><paragraph id="HA2404028A11941CEB24ACBCBB29CDE27"><enum>(3)</enum><header>Public comment</header><text>The Director shall establish a process under which members of the public may provide feedback regarding the accuracy of the information on the covered website.</text></paragraph></subsection><subsection id="H55E9F5A19B88497DAA61B9BA02039D2A"><enum>(h)</enum><header>Data archiving</header><paragraph id="H1B661C8CCE0247BCBE9855C2DC2FF162"><enum>(1)</enum><header>In general</header><text>As soon as practicable after a transitional inauguration day (as defined in section 3349a), the Director, in consultation with the Archivist of the United States, shall archive the data that was compiled on the covered website for the preceding presidential administration.</text></paragraph><paragraph id="H9A38329EA605454F82BBDADA3B25C783"><enum>(2)</enum><header>Public availability</header><text>The Director shall make the data described in paragraph (1) publicly available over the internet—</text><subparagraph id="HCE29087A281E44BE8D029CB0A7CB8B04"><enum>(A)</enum><text>on, or through a link on, the covered website;</text></subparagraph><subparagraph id="H591F55C916EB41928A86D8C2D1D827F4"><enum>(B)</enum><text>at no cost; and</text></subparagraph><subparagraph id="HC004266B914C43C2823C0DBBD168ABC0"><enum>(C)</enum><text>in a searchable, sortable, downloadable, and machine-readable format.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HEE1D7B9A16A64296999EAE718839ABB0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H9BC51A5363044B91924D7FEC71B8A886"><toc><toc-entry bold="off" level="section">3330f. Government policy and supporting position data.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id834F36C6057D4F9A9B8DEFD53A76DDA0"><enum>(3)</enum><header>Deadline</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office of Personnel Management shall establish the website required under section 3330f(b) of title 5, United States Code, as added by subsection (a)(1).</text></paragraph></subsection><subsection id="H69992F7787714095A4F0B16CFFEA42AD"><enum>(b)</enum><header>Other matters</header><paragraph id="H1D88CF91B4854C6999918D8759D47335"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the terms <term>agency</term>, <term>covered website</term>, and <term>policy and supporting position</term> have the meanings given those terms in section 3330f of title 5, United States Code, as added by subsection (a)(1).</text></paragraph><paragraph id="id987C32ABC8444C9AB50CCE1DF04B7876"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $10,000,000, to remain available until expended, for developing the covered website under section 3330f(b) of title 5, United States Code, as added by subsection (a)(1).</text></paragraph><paragraph id="HD0ACCF54CD9946B49F795D5C8A8EA192"><enum>(3)</enum><header>GAO review and report</header><subparagraph id="id269AC502F9DC4192ACA03F094299C1A4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the covered website is established, the Comptroller General of the United States shall conduct a review of, and issue a briefing or report on, the implementation of this Act and the amendments made by this Act.</text></subparagraph><subparagraph id="id083B243984A547C98898D0B78EF6AEDB"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The review conducted under subparagraph (A) shall include—</text><clause id="H3E35F20A03A04D1C8911F5E2B604E849"><enum>(i)</enum><text>the quality of data collected and whether the data is complete, accurate, timely, and reliable;</text></clause><clause id="H275E7437D23843A4B45212D70C234C71"><enum>(ii)</enum><text display-inline="yes-display-inline">any challenges experienced by agencies in implementing this Act and the amendments made by this Act; and</text></clause><clause id="H74A86547F325442387DF9432E1C5F64F"><enum>(iii)</enum><text display-inline="yes-display-inline">any suggestions or modifications to enhance compliance with this Act and the amendments made by this Act, including best practices for agencies to follow.</text></clause></subparagraph></paragraph><paragraph id="H3676BA2BA6C84FB69FED31F70248F3C4"><enum>(4)</enum><header>Sunset of Plum Book</header><text display-inline="yes-display-inline">Beginning on January 1, 2024—</text><subparagraph id="idBF06D6811BBC489083FCD9DC0E0B0A6A"><enum>(A)</enum><text display-inline="yes-display-inline">the covered website shall serve as the public directory for policy and supporting positions in the Government; and</text></subparagraph><subparagraph id="id8D231548D08849F0A22A9A32962437A3"><enum>(B)</enum><text display-inline="yes-display-inline">the publication entitled <quote>United States Government Policy and Supporting Positions</quote>, commonly referred to as the <quote>Plum Book</quote>, shall no longer be issued or published.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
