<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 846</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="S359">Mr. Heinrich</sponsor> (for himself, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S402">Ms. Rosen</cosponsor>, <cosponsor name-id="S259">Mr. Reed</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S308">Mr. Cardin</cosponsor>, <cosponsor name-id="S409">Mr. Luján</cosponsor>, and <cosponsor name-id="S057">Mr. Leahy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the confidentiality of information submitted in requests for deferred action under the deferred action for childhood arrivals program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect DREAMer Confidentiality Act of 2021</short-title></quote>.</text></section><section id="id42A8A2142D244B7F893E5982E0E97FDC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0C9D81CFC67647DFA0129C710C3CCD18"><enum>(1)</enum><header>DACA program</header><text>The term <term>DACA program</term> means the deferred action for childhood arrivals program described in the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012.</text></paragraph><paragraph id="id4AF6013EB36248B2B129AEE0953153A1"><enum>(2)</enum><header>Individual application information</header><text>The term <term>individual application information</term> means any information, including personally identifiable information, submitted to the Secretary after June 15, 2012, as part of a request for consideration or reconsideration for the DACA program.</text></paragraph><paragraph id="id269D5258031B4443ABC84CD963AE4CCA"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="id8CF7B7689EE94407A61D2C2BB7A81A39"><enum>3.</enum><header>Confidentiality of information submitted for DACA program</header><subsection id="id8B6AE9CDD5D4437A94C062631FAF5C3E"><enum>(a)</enum><header>In general</header><text>The Secretary shall protect individual application information from disclosure to U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection for any purpose other than the implementation of the DACA program.</text></subsection><subsection id="id3938BD7F700341D490BB1141CBE4070A"><enum>(b)</enum><header>Referrals prohibited</header><text>The Secretary may not refer to U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, the Department of Justice, or any other law enforcement agency any individual the case of whom has been deferred pursuant to the DACA program.</text></subsection><subsection id="idBBDF5426B9414FF4870858D6E27AB08C"><enum>(c)</enum><header>Limited exception</header><text>Individual application information may be shared with national security and law enforcement agencies—</text><paragraph id="idD4FC04758B0E4D4685D43A20F6E7C74B"><enum>(1)</enum><text>to identify or prevent fraudulent claims;</text></paragraph><paragraph id="idF3D3071D9265425698F7057DC84C3FF8"><enum>(2)</enum><text>for particularized national security purposes relating to an individual application; and</text></paragraph><paragraph id="idABB430F8A5954026BC1D6A1F70177203"><enum>(3)</enum><text>for the investigation or prosecution of any felony not related to immigration status.</text></paragraph></subsection></section></legis-body></bill>
