which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to ensure that the 2021 Recovery Rebates are not provided to illegal immigrants. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Prohibiting 2021 Recovery Rebates from being provided to illegal immigrants</header><subsection id="id95FEC1BD625245E79FBA0652EBA62463"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/6428B">section 6428B</external-xref> of the Internal Revenue Code of 1986, as added by section 9601 of the American Rescue Plan Act of 2021, is amended—</text><paragraph id="id7B8BB9FA3C864168B2172BA674E8ECB7"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), and</text></paragraph><paragraph id="id00C3559FC566461695E0A0EC5FCF340F"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5B24735B8CFD4518A9FDED09291C1A60"><paragraph id="id814403CD02084BCCA21E648E215572C4"><enum>(2)</enum><text>as determined by the Secretary in coordination with the Secretary of Health and Human Services and the Secretary of Homeland Security, any alien who is not lawfully present (as such term is used in section 36B(e)(1)),</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9B3452B4432F444F82FC86EDDE27F66D"><enum>(b)</enum><header>Modification of definition of valid identification number</header><text>Subparagraph (D) of <external-xref legal-doc="usc" parsable-cite="usc/26/6428B">section 6428B(e)(2)</external-xref> of the Internal Revenue Code of 1986, as added by section 9601 of the American Rescue Plan Act of 2021, is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idCD35024C476746519070BC9E3F91FEA9"><subparagraph id="id7C966AE3D7894E36A9EBB39E6C0C4C95"><enum>(D)</enum><header>Valid identification number</header><clause id="idB07E0428E9A34B008C49D41EB5EEB055"><enum>(i)</enum><header>In general</header><text>For purposes of this paragraph, except as provided in clause (ii), the term <term>valid identification number</term> means a social security number (as such term is defined in section 24(h)(7)). </text></clause><clause id="id197D27FD190E4E729F80BF606CAEC211"><enum>(ii)</enum><header>Special rule for employment-authorized nonimmigrants</header><subclause id="id1961DEAA7CD94CB6A4EA6E8403E0450C"><enum>(I)</enum><header>In general</header><text>For purposes of this paragraph, in the case of an alien admitted to the United States pursuant to a nonimmigrant visa described in section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) to whom a social security number has been issued pursuant to section 205(c)(2)(B)(i)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(c)(2)(B)(i)(I)</external-xref>), the term <term>valid identification number</term> means only such a social security number with respect to which employment is authorized on the date of enactment of this section. </text></subclause><subclause id="idA72DACE15A574D04B923F20E0F7E6058"><enum>(II)</enum><header>Determination</header><item id="id8723394638E84731AE1ADE89EDC99EDB"><enum>(aa)</enum><header>In general</header><text>The Secretary shall take all necessary measures to determine whether employment is authorized with respect to such a social security number.</text></item><item id="id1861349951EE4BEBA5E8E315CA95CDD5"><enum>(bb)</enum><header>Coordination required</header><text>The Secretary of Homeland shall provide information to the Secretary with respect to whether aliens to whom a social security number has been issued are authorized to be employed in the United States. </text></item></subclause></clause><clause id="idEA426E0C54FF43BF8BD7BCB8D3F493E0"><enum>(iii)</enum><header>Adoption taxpayer identification number</header><text>For purposes of subparagraph (C), in the case of a dependent who is adopted or placed for adoption, the term <term>valid identification number</term> shall include the adoption taxpayer identification number of such dependent.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id59A00D16901D4DDFA99AF1A4ECCA768C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of section 9601 of the American Rescue Plan Act of 2021. </text></subsection></section></legis-body></bill>
