Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a joint task force on air travel during and after the COVID–19 Public Health Emergency, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Health Safety in the Skies Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id38cd29cd97354ce4830e54d1abc47cc7"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id6e773518f19941738860429a05f4b370"><enum>(1)</enum><header display-inline="yes-display-inline">Advisory Committee</header><text display-inline="yes-display-inline">The term <term>Advisory Committee</term> means the Joint Federal Advisory Committee established under section 4.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbebf1cec3aa44b1183dc1abff64dc659"><enum>(2)</enum><header display-inline="yes-display-inline">Air travel</header><text display-inline="yes-display-inline">The term <term>air travel</term> includes international air travel.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide01c75ceaa3549aca42b4e6ffde3c3e8"><enum>(3)</enum><header display-inline="yes-display-inline">COVID–19 public health emergency</header><text display-inline="yes-display-inline">The term <term>COVID–19 public health emergency</term> means the public health emergency first declared on January 31, 2020, by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) with respect to COVID–19 and includes any renewal of such declaration pursuant to such section 319.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id047ef073a567469ab2737c676fb19941"><enum>(4)</enum><header display-inline="yes-display-inline">Joint Task Force</header><text display-inline="yes-display-inline">The term <term>Joint Task Force</term> means the Joint Task Force on Air Travel During and After the COVID–19 Public Health Emergency established under section 3(a).</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd600216b5071425b86786b942b0f3735"><enum>3.</enum><header display-inline="yes-display-inline">Joint Task Force on Air Travel During and After the COVID–19 Public Health Emergency</header><subsection commented="no" display-inline="no-display-inline" id="ide541f65cd2f74bfb86f7ca381abc5185"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of Transportation, the Secretary of Homeland Security, and the Secretary of Health and Human Services shall establish the Joint Task Force on Air Travel During and After the COVID–19 Public Health Emergency.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4e81d81682bb4c61ab2790acce917e2a"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><paragraph commented="no" display-inline="no-display-inline" id="id2a1cffce7742497990686ad7b81ae071"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Joint Task Force shall develop recommended requirements, plans, and guidelines to address the health, safety, security, and logistical issues relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id40620469CF914CC08A78F8A89161665A"><enum>(A)</enum><text display-inline="yes-display-inline">the continuation of air travel during the COVID–19 public health emergency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C4B8C5400A94427A42E7524DEDD55C2"><enum>(B)</enum><text display-inline="yes-display-inline">the resumption of full operations at airports and increased passenger air travel after the COVID–19 public health emergency.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52db78c89a9545a3a8f37ff33a5a0c83"><enum>(2)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">The recommendations developed under paragraph (1), with respect to the applicable periods described in paragraph (3), shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0817ab2aa5246f58b929995dc4c63a2"><enum>(A)</enum><text display-inline="yes-display-inline">modifying airport, air carrier, security (including passenger security screening), and other operations related to passenger air travel, including passenger queuing, boarding, deplaning, and baggage handling procedures, as a result of—</text><clause commented="no" display-inline="no-display-inline" id="id3885a77c049843cba44e3c965bde0fcc"><enum>(i)</enum><text display-inline="yes-display-inline">current and anticipated changes to passenger air travel during and after the COVID–19 public health emergency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb2540766a2d4a02a28d71d6dd26ddbf"><enum>(ii)</enum><text display-inline="yes-display-inline">anticipated changes to passenger air travel resulting from any seasonal recurrence of the coronavirus;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2897e2f306ab4ba0a6407c8aed5a337b"><enum>(B)</enum><text display-inline="yes-display-inline">mitigating the public health and economic impacts of the COVID–19 public health emergency and any seasonal recurrence of the coronavirus on airports and passenger air travel (including through the use of personal protective equipment, the implementation of strategies to promote overall passenger and employee safety, and the accommodation of social distancing as feasible and necessary);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11615a23dd7f49b099c6f5b31bdee62a"><enum>(C)</enum><text display-inline="yes-display-inline">addressing privacy and civil liberty issues that may arise from passenger health screenings, contact-tracing, or other processes used to monitor the health of individuals engaged in air travel; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85d9486991564eeba3060e0a99ec04b2"><enum>(D)</enum><text display-inline="yes-display-inline">operating procedures to manage future public health crises that can be anticipated, to the extent such public health crises may impact air travel.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd20cba8b634e4df6a8c5b7ddc9ae6b03"><enum>(3)</enum><header display-inline="yes-display-inline">Applicable periods</header><text display-inline="yes-display-inline">For purposes of paragraph (2), the applicable periods described in this paragraph are the following periods:</text><subparagraph commented="no" display-inline="no-display-inline" id="idf07d62762eae4d1990be1d34426a42f8"><enum>(A)</enum><text display-inline="yes-display-inline">The period beginning on the date of the first meeting of the Joint Task Force and ending on the last day of the COVID–19 public health emergency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97ef69b189f74b8e8a641f3e455e75a6"><enum>(B)</enum><text display-inline="yes-display-inline">The 1-year period beginning on the day after the end of the period described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id16eac0f7c2154fa193b3cbce3df71b26"><enum>(c)</enum><header display-inline="yes-display-inline">Activities of the Joint Task Force</header><paragraph commented="no" display-inline="no-display-inline" id="id5e544f4b1e8f4720a4f4b74afc5a3745"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In developing the recommended requirements, plans, and guidelines under subsection (b), and prior to including such recommendations in the final report required under section 5(b), the Joint Task Force shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb524322cefd44a2480e71b2bb6115531"><enum>(A)</enum><text display-inline="yes-display-inline">conduct cost-benefit evaluations regarding such recommendations, including costs impacting air operations and impacts on air travel;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id294a240f8bb9450196e4e2206b795172"><enum>(B)</enum><text display-inline="yes-display-inline">consider funding constraints;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf17cceb9a1d4c9286ccde294ddf05a3"><enum>(C)</enum><text display-inline="yes-display-inline">use risk-based decision-making; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida718021ecfbe4634a7cf7c87fe9f9bd7"><enum>(D)</enum><text display-inline="yes-display-inline">consult with the Advisory Committee established in section 4(a) and consider any consensus policy recommendations of the Advisory Committee submitted under section 4(b).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6790ac18125946519f283a5317c14009"><enum>(2)</enum><header display-inline="yes-display-inline">International consultation</header><text display-inline="yes-display-inline">The Joint Task Force shall consult, as practicable, with relevant international entities and operators, including the International Civil Aviation Organization, to harmonize (to the extent possible) recommended requirements, plans, and guidelines for air travel during and after the COVID–19 public health emergency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb121806cd26d42c0bb9e5736142f949b"><enum>(d)</enum><header display-inline="yes-display-inline">Membership</header><paragraph commented="no" display-inline="no-display-inline" id="idbc3f331fd8244e04ae509636baaa8b0f"><enum>(1)</enum><header display-inline="yes-display-inline">Chair</header><text display-inline="yes-display-inline">The Secretary of Transportation (or the Secretary’s designee) shall serve as Chair of the Joint Task Force.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a480c03b04f45908eff5ff8636c08c4"><enum>(2)</enum><header display-inline="yes-display-inline">Vice-Chair</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (or the Secretary’s designee) shall serve as Vice-Chair of the Joint Task Force.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id502e24c280d041958d4a1190fbc0c59e"><enum>(3)</enum><header display-inline="yes-display-inline">Other members</header><text display-inline="yes-display-inline">In addition to the Chair and Vice-Chair, the members of the Joint Task Force shall include representatives of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id6c8e90d9722142e2be5d39de2611440f"><enum>(A)</enum><text display-inline="yes-display-inline">The Department of Transportation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idce9a2b5c2adb46999faf155822d700d3"><enum>(B)</enum><text display-inline="yes-display-inline">The Department of Homeland Security.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71d2fdeafe1d4714b48b591a20647a5a"><enum>(C)</enum><text display-inline="yes-display-inline">The Department of Health and Human Services.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id181766aa3b2147848d8e70529843128d"><enum>(D)</enum><text display-inline="yes-display-inline">The Federal Aviation Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb9552c87be44d3eb8f11084eaf95a39"><enum>(E)</enum><text display-inline="yes-display-inline">The Transportation Security Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3a387156ac7e4e3aa89a1d8e77b32834"><enum>(F)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68efd982580847fcbe57efbded84a04b"><enum>(G)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and Prevention.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb502f1358f994a0992e23cfafa258298"><enum>(H)</enum><text display-inline="yes-display-inline">The Occupational Safety and Health Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd191c32b1bff4b16992b9ca6d608d541"><enum>(I)</enum><text display-inline="yes-display-inline">The National Institute for Occupational Safety and Health.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc70b425fe6bc4ac7a54a97c7f7e430ee"><enum>(J)</enum><text display-inline="yes-display-inline">The Pipeline and Hazardous Materials Safety Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11ce875f021540c8b7db4a6dfe49e343"><enum>(K)</enum><text display-inline="yes-display-inline">The Department of State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb86842b630c44ee4b9538a1314a3b0a3"><enum>(L)</enum><text display-inline="yes-display-inline">The Environmental Protection Agency.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida48085d596804ec8a14b57b54d54e6da"><enum>4.</enum><header display-inline="yes-display-inline">Joint Federal Advisory Committee</header><subsection commented="no" display-inline="no-display-inline" id="id9439a4c9328a4c5988254a26cddcb11e"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 15 days after the date on which the Joint Task Force is established under section 3(a), the Secretary of Transportation, in consultation with the Secretary of Homeland Security and the Secretary of Health and Human Services, shall establish a Joint Federal Advisory Committee to advise the Joint Task Force.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6fa8da7684ea4308aecadc27f025777f"><enum>(b)</enum><header display-inline="yes-display-inline">Duties of the Advisory Committee</header><text display-inline="yes-display-inline">The Advisory Committee shall develop and submit consensus policy recommendations to the Joint Task Force for the Joint Task Force to consider when developing recommendations under section 3(b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3b36cec0683c4a0c8270338b9d26ee15"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The members of the Advisory Committee shall include representatives of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id578741ccdb8743059920f85ef2f2e3b5"><enum>(1)</enum><text display-inline="yes-display-inline">Airport operators designated by the Secretary of Transportation in consultation with the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d05bf39df30491e8cfc816e1fed38c6"><enum>(2)</enum><text display-inline="yes-display-inline">Air carriers designated by the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc59e15fee9034873975edb2dfec5bfe0"><enum>(3)</enum><text display-inline="yes-display-inline">Aircraft and aviation manufacturers designated by the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide19e1523ad7b4dad9a131aeb6cbd571b"><enum>(4)</enum><text display-inline="yes-display-inline">Labor organizations representing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id014B089B02E2467A8177AA1244E1D753"><enum>(A)</enum><text display-inline="yes-display-inline">aviation industry workers (including pilots, flight attendants, engineers, maintenance, mechanics, air traffic controllers, safety inspectors, and workers performing airport services such as security, terminal and cabin cleaning, passenger assistance, and aircraft loading) designated by the Secretary of Transportation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FB3674C8CDA4C38AE1C82F25FE72A87"><enum>(B)</enum><text display-inline="yes-display-inline">security screening personnel designated by the Secretary of Homeland Security.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id989dfa6711e846eb9da17f9b1479cbd2"><enum>(5)</enum><text display-inline="yes-display-inline">Public health experts designated by the Secretary of Health and Human Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac5a83120b1c4826b1de92da7cef41c6"><enum>(6)</enum><text display-inline="yes-display-inline">Organizations representing airline passengers designated by the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c77b854785049caa3adbebe91738643"><enum>(7)</enum><text display-inline="yes-display-inline">Privacy and civil liberty organizations designated by the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7577a74dad445e6a973fcf4e2e243ff"><enum>(8)</enum><text display-inline="yes-display-inline">Manufacturers and integrators of passenger screening and identity verification technologies designated by the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7584255315de407a9fdb3449ffd546ac"><enum>(9)</enum><text display-inline="yes-display-inline">Trade associations representing air carriers (including major passenger air carriers, low-cost passenger air carriers, regional passenger air carriers, cargo air carriers, and foreign passenger air carriers) designated by the Secretary of Transportation in consultation with the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84d4480d211f49a59b8b6b915a231cc7"><enum>(10)</enum><text display-inline="yes-display-inline">Trade associations representing airport operators (including large hub, medium hub, small hub, nonhub primary, and nonprimary commercial service airports) designated by the Secretary of Transportation in consultation with the Secretary of Homeland Security.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id8C535B8C2DBA4361ADE84B9834E9B679"><enum>(11)</enum><text>Aviation contractors designated by the Secretary of Transportation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7c4762b5492f46fda5cfeed27c7bd657"><enum>(d)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Any vacancy in the membership of the Advisory Committee shall not affect its responsibilities but shall be filled in the same manner as the original appointment and in accordance with the Federal Advisory Committee Act (5 U.S.C. App).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3033745f630f4c2cb863e8b6065c62c5"><enum>(e)</enum><header display-inline="yes-display-inline">Prohibition on compensation</header><text display-inline="yes-display-inline">The members of the Advisory Committee shall not receive any compensation from the Federal Government by reason of their service on the Advisory Committee.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd8548c421db944d7a335580c36f501ee"><enum>(f)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Not later than 14 days after the date on which the Advisory Committee submits policy recommendations to the Joint Task Force pursuant to subsection (b), the Secretary of Transportation shall publish such policy recommendations on a publicly accessible website.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd4b528f634b143b2b9ec54cf12a6a703"><enum>5.</enum><header display-inline="yes-display-inline">Briefings and Reports</header><subsection commented="no" display-inline="no-display-inline" id="id7b828f27ae73424db7274e15bb1622fe"><enum>(a)</enum><header display-inline="yes-display-inline">Preliminary briefings</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 6 months after the date on which the Joint Task Force is established under section 3(a), the Joint Task Force shall begin providing preliminary briefings to Congress on the status of the development of the recommended requirements, plan, and guidelines under section 3(b). The preliminary briefings shall include interim versions, if any, of the recommendations of the Joint Task Force.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4006F9FE165C4693995D6F4910CBAFD2"><enum>(b)</enum><header display-inline="yes-display-inline">Final report</header><paragraph commented="no" display-inline="no-display-inline" id="id7f8d49786907477896de1932b86adb96"><enum>(1)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 18 months after the date of enactment of this Act, the Joint Task Force shall submit a final report to Congress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a790bf76f854b908e025158a7042d8a"><enum>(2)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">The final report shall include the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id527f51b8be3c427392b48f467138ae33"><enum>(A)</enum><text display-inline="yes-display-inline">All of the recommended requirements, plans, and guidelines developed by the Joint Task Force under section 3(b), and a description of any action taken by the Federal Government as a result of such recommendations.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59bf5e68f418456588898afe3fb3a02e"><enum>(B)</enum><text display-inline="yes-display-inline">Consensus policy recommendations submitted by the Advisory Committee under section 4(b), and an explanation (including data and risk analysis) of any action by the Joint Task Force in response to such recommendations.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4f4b2e0bcba44ee09a0ea8986623bdd6"><enum>6.</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="no-display-inline">The Joint Task Force and the Advisory Committee shall terminate 30 days after the date on which the Joint Task Force submits the final report required under section 5(b). </text></section></legis-body></bill>
